It may be April Fools Day, but its no joke that we are back on today's BradCast after a half-planned, half-doctor-advised Spring Break week off! [Audio link to full show follows this summary.]

Before we left, it seemed like last week might prove to be a slow news week, with Congress on vacation, no primary elections last Tuesday and Trump's New York felony hush-money trial postponed a few weeks until this month.

Boy were we wrong about that. Last week was anything but a slow news week, and we've got the headlines today to prove it! To add some actual context, depth and insight to those headlines --- and to hold my hand after I'd been trying to look away for the past week --- we're joined by two old friends, though only one who you may have heard on this program before.

Our friend known mostly as 'DRIFTGLASS' is back with us again today. He is co-host, along with his wife, of The Professional Left podcast recorded each week from "Flyover Country, Illinois." He is also, today, celebrating his 19th blogiversary at the Driftglass blog, so we're honored he agreed to spend it with us!

And, as if that's not swell enough, his Pro Left Pod co-hosting wife, FRANCES LANGUM, who is also a longtime Associate Editor over at the Crooks & Liars blog, joins us as well today for a romping, rollicking, breathless review of much that we missed last week and why most of it still matters this week!

  • Rep. Marjorie Taylor Greene (R-GA)'s vow to call for removing House Speaker Mike Johnson for his daring to work with Democrats to keep the government from shutting down by passing a long-delayed 2024 spending bill just over a week ago.

Security Council resolution demanding a ceasefire in Gaza may mean for Israel and for some on the Left in the U.S. And why, if you don't like what Israel is doing, Fran advises: "Don't elect Bibi Netanyahu President of the United States --- which is what Trump is."
  • Why NBC News' ill-considered hiring and then firing of former RNC Chair and attempted election thief Ronna Romney McDaniel matters.

  • The desperate-for-quick-cash former President and huckster-in-chief is now selling bibles for $59.99 a piece. Though, to be fair, this version also includes the U.S. Constitution. Has Donald Trump ever read either of them? Says Driftglass today: "Good thing he did this to raise money to pay for the court costs of paying off a [porn star] that he was sleeping with while his wife was nursing their child. So the circle of absolute blasphemy is now complete."
  • Joe Lieberman died last week.
  • Independent 2024 Presidential candidate Robert F. Kennedy, Jr., currently on the ballot in 8 states, thrilled dozens with his announcement of his running mate last week, the former wife of one of Google's founders, Nicole Shanahan. Or, as Driftglass describes her, "a big bag of money who is as crazy as he is".

On today's BradCast, we're honored to be joined by one of the Constitutional law experts who first brought the issue of the Constitution's "Insurrection Disqualification Clause" to the attention of the nation...before our corrupted, activist U.S. Supreme Court, he explains, "invented" a way to nullify it to help protect our disgraced former President on Monday. [Audio link to full show follows this summary.]

Free Speech for People (FSFP) is the non-partisan government accountability group which first raised the issue of Donald Trump's clear violation of Section 3 of the 14th Amendment way back during the summer of 2021. At the time, they sent letters to chief election officials in all 50 states warning them not to place Trump on the ballot should the disgraced former President chose to run again in 2024, as he was in violation of the Constitutional clause barring oath-breakers from public office after having "engaged in insurrection or rebellion" against the nation. After having incited the January 6, 2021 attack on the U.S. Capitol, they explained to state officials, he was no longer eligible for office under the post-Civil War Amendment.

They were, of course, correct. Both chambers of Congress, in bipartisan votes, found that Trump had, in fact, incited the insurrection while attempting to prevent Joe Biden, the winner of the 2020 election from being certified by Congress. Late last year the Colorado Supreme Court agreed [PDF], and barred Trump from the state's ballot. He appealed the ruling to SCOTUS, which quickly heard the matter and issued its 13-page ruling [PDF] on Monday, pulling reasons out of thin air for why Colorado could not bar Trump from running in the state.

The Republican Supremes went even further by inventing a new mandate that will prevent insurrectionists from being barred from federal office under 14.3 unless Congress adopts a new law to execute the 150 year old Amendment. (Or, at least, to execute it's two-sentence Section 3. All of the other mandates of the 14th --- such as citizenship for those born or naturalized in the U.S., due process for all and equal protection under the law --- are all self-executing. A special law by Congress is, apparently, only necessary for Section 3, for some reason, according to the Supreme Court as of this week.)

We're joined today by FSFP's Legal Director, RON FEIN, who, with fellow FSFP Constitutional law experts John Bonifaz and Ben Clement, penned an op-ed on Wednesday, describing the Court's ruling as "an error of historic proportions and a sham."

The Court's ruling, he argues today, "had nothing to do with the text of Section 3 of the 14th Amendment, nor of the history, or the original public understanding of Section 3. Instead, the Justices --- and it's not just the six conservative Justices but also the three so-called liberals --- started from the endpoint of the result that they wanted to reach and then worked backwards to find a rationale."

"If they had wanted to say that Trump didn't engage in insurrection," he tells me, "I would have had a little bit more respect. It would have been very brazen and obviously ridiculous. But at least they would have been straightforwardly saying something that would have meant that he wasn't disqualified --- if they wanted to defy all evidence and say that he didn't engage in insurrection. But instead, they fabricated an exception that can be found nowhere in the Constitution, that basically lets Trump and others off without ever confronting the merits of what he did."

As anyone who has read Monday's ruling may have noticed, the Justices never dispute the Colorado Supreme Court's finding --- following a five-day trial --- that, yes, Trump is, in fact, an insurrectionist. In fact, the Court's three liberals, in response to the part of the majority's Opinion from which they dissent, refer to Trump as an "oathbreaking insurrectionist" on numerous occasions.

Fein describes how the SCOTUS ruling makes a mockery of their claim to require "uniformity" in elections. "This is something that they pull when they want to, but it has no real basis in reality," he notes, describing how our Presidential election system is actually set up to allow each state to determine their own way of running elections.

"We have state by state elections," he asserts, "both at the primary stage and in the general election. We have, for better or worse, an Electoral College system. That's the system under which Donald Trump became President under in 2016. It is not at all uncommon, both in the primaries and in the general election, for some candidates to be on some states' ballots and not others. In fact, we're going to see that in this election. We're going to see RFK Jr. will be on some states' ballots, but not all of them. Cornel West will probably be in the same situation. The Constitution says that states have the power to determine how they appoint electors."

Those facts make the Court's argument that removing Trump from the ballot would allow a single state to determine the result of the election a joke. Then again, the entire ruling is exactly that, if not a particularly amusing one.

Fein eviscerates the rest of their opinion as well today, while warning that there may now be further Constitutional bastardizations regarding Trump in the days and years ahead. As he, Bonifaz and Clement explain in the chilling conclusion of their op-ed: "If Trump wins, prepare for a third term. Sure, the Twenty-Second Amendment says that '[n]o person shall be elected to the office of the President more than twice.' But Trump has already claimed that he is entitled to a third term because 'they spied on my campaign.' When Trump’s lawyers make this argument, what credibility will the Supreme Court have as he runs roughshod over our constitutional democracy?"

I'm fighting (and losing to) a sinus infection, so otherwise exhausted after today's very lively BradCast. Thus, Imma try to keep this short and leave you to tune in for all the juicy fun on today's program. [Audio link to full show follows this summary.]

In general, amongst the stuff we covered...

  • A whole bunch of primaries (and caucuses and dysfunctional GOP party conventions) are coming up in a whole bunch of states over the next week, beginning with Michigan tomorrow and some 16 states and territories next Tuesday --- Super Tuesday --- March 5th. We lay out all of the confusing details, attempts by Trump to game the GOP nomination, and a move from some on the Left in Michigan to call out President Biden or his position on Israel.
  • In addition to a whole bunch of nominating contests over the next week, the inept House GOP has scheduled a potential (if partial) government shutdown for this Friday, the same day that President Biden is set to deliver his State of the Union Address. At the same time, SCOTUS could come down with two key rulings any minute on whether Trump is allowed to be on the ballot at all this year, as per the Constitution's "Insurrectionist Disqualification Clause", and on his ridiculous "Presidential Immunity" argument in his criminal trials. Buckle up for all of the above over the next week or so.
  • AND THEN: Russia's deadly invasion of its peaceful, democratic sovereign neighbor of Ukraine has now entered its third horrific year. More and more evidence over the past week has emerged to document both Vladimir Putin's treachery and his Kremlin's decade-long, active intelligence operation to interfere with the U.S. electoral system. All of it highlights the perfidy and/or stupidity of a whole bunch of Useful Idiots on the Right --- from Trump to rightwing media to Republicans in Congress --- who are all too happy to echo blatant Kremlin propaganda for (potential) political gain.

    But what of the small, if intense, number of folks on the supposed, "anti-war" progressive Left who have also spent years at this point echoing much of the same Kremlin propaganda? The one who, today, agree with Republicans who want to simply throw Ukraine to the Russian wolves because, something something "World War III", something something NATO, something something "negotiate" with the invaders, something something "privileged few" who want Ukraine to "fight to the last Ukrainian"? (That last, literally a documented Russian intel talking point, repeated endlessly now by many on the Left and Right who oppose aid to Ukraine to allow them to both defend themselves and democracy itself against imperialist foreign military aggression.)

    We call out some of those on the Left today for falling for disinformation and talking points, knowingly or unknowingly...because someone has to...and they call in to today's BradCast in response.

On today's BradCast: As of this week, if it wasn't clear before (and, obviously, for many, it was not) it is now clearer than ever that the U.S., its corporate media, the Republican Party, its front-runner for the 2024 Presidential nomination (and, sadly, even too many on the "left"), have all fallen prey --- knowingly or unknowingly (it doesn't really matter) --- to a wildly successful, decade-long Russian intel op. From the Hillary emails in 2016 to the Hunter Biden laptop in 2020 to the Biden Burisma "bribery" allegations that fell apart so spectacularly this week with the arrest of the man who House GOPers cited as the lynch-pin for their entire Revenge Impeachment case against President Biden, it turns out it was all part of a wildly successful foreign campaign to divide and threaten American political system.

Turns out Alexander Smirnov, that guy with the false Burisma claims about the Bidens, apparently got it all from Russian intel operatives who have, for the past ten years, been pushing all of these phony narratives straight out from the Kremlin through various useful idiots, onto the set of Fox "News" and the rest of the rightwing media, into the mouth of the disgraced former President, and straight through to the hearing rooms of the U.S. Congress where it was shared --- either knowing or unknowingly (it doesn't really matter) --- by GOP dupes.

It's quite an extraordinary success story, in truth. For Vladimir Putin. And a shameful failure of our corporate mainstream media to even notice much of it happening in real time. They also played the role of useful idiots when it counted the most over much of the past decade and right on up until today.

Josh Marshall described it as "A Bigger Story Than You Can Possibly Imagine" this week, and I believe he is correct. Much more on all of that --- and Putin's deadly rise --- on today's program.

  • MyPillow CEO Mike Lindell is not only an election denier and grifter. He also won't pay off a bet. In 2021, Lindell claimed to have obtained "irrefutable" evidence that the 2020 election was stolen from Donald Trump by China over the Internet. His evidence was Internet data packets that he claims to have obtained from a "whistleblower". He offered $5 million to anyone who could prove the data wasn't from the election. A two-time Trump voter did so in 2022. The data, he proved, was nothing but junk. But Mike wouldn't pay up the $5 million he offered via his "Prove Mike Wrong" challenge. A private arbitration panel agreed the man was owed the money. Cheap chiseler Mike still wouldn't pay. This week, a federal judge ordered him to do so.
  • Corporate media spend a lot of time focusing on Joe Biden's bad polling numbers against Donald Trump. This week, a new survey by Quinnipiac University, a major pollster, found Biden beating Trump among registered voters nationally by 4 points. So Politico covered the new survey with this headline: "Poll: Nearly 70 percent of voters say Biden is too old to serve again".
  • Is it any wonder so many on the left are still under the misguided impression that someone, anyone, who knows who?, but certainly someone, should replace Joe Biden on the 2024 ballot! Because that unidentified someone would certainly have a better chance of defeating Donald Trump this year! Well, even if there was evidence of Biden not running this year (there isn't), recent polling doesn't even back up the assertion that other Dems would do better against Trump than Biden would. But, hey, if you've got a realistic scenario to replace Joe Biden that won't result in a second Trump Presidency, please feel free to email me! For the record, if you haven't seen Daniel Rohr's astonishing 2022 documentary Navalny, from which the above is excerpted, I can't recommend it enough. It's available via Max and Amazon Prime and perhaps elsewhere. I saw it some months ago and found it absolutely jaw-dropping. That said, I suspect it will be much sadder watching that film as of today.

I can only hope Russians will take notice of Navalny's words above...

Some days these days on The BradCast, it's hard to believe we're covering what we are covering. I'd say that's the case on most days, these days. Today is, yet again, one of those days. [Audio link to full show follows below this summary.]

FIRST, we try to bring you up to date following Donald Trump's rigged GOP Caucuses in Nevada last week. Given that he and some guy named Ryan Binkley were the only two on the ballot, Trump won with Saddam Hussein-like or Vladimir Putin-like numbers, taking 99.1% of the vote and all of the state's available RNC delegates in the bargain. Nikki Haley, having competed in the state-run Primary just two days earlier, was not allowed to participate in the state's GOP-run Caucuses.

The Virgin Islands also held a GOP Caucus on the same day. Trump won there as well, defeating Haley (who was allowed to be on that ballot) by about 74% to 26%. Only about 250 voters bothered to show up, so don't read too much into it.

On the Dem side of the aisle, Joe Biden's only noteworthy competitor on the Nevada Primary ballot last Tuesday (which he handily won), was self-help guru Marianne Williamson. She dropped out of her run for the Democratic nomination the next day.

Tomorrow, however, expect an actual contest in the 3rd Congressional District in New York, where voters on Republican-leaning Long Island will select a replacement member of the U.S. House for the recently expelled pathological liar and Republican con-artist, Rep. George Santos. The polls suggest a close race for the seat between conservative Democrat and former Democratic Rep. Tom Suozzi and his Republican opponent, the Ethiopian-born Israeli-American Mazi Pilip. The winning party will explain why the contest in the district should be seen as a bellwether for November's elections. The losing party will insist that it isn't.

THEN, it's back to the last few mad days since we last spoke, during which Trump (just before airtime today) filed his appeal to the U.S. Supreme Court, hoping that his friends and appointees on the High Court will agree, unlike anyone on the lower courts, that U.S. Presidents have complete immunity to commit any crime they like while in office; Robert Hur, a former Trump-appointed DoJ prosecutor tapped by A.G. Merrick Garland to be a Special Counsel, ended a year-long nearly 400-page investigation [PDF] by finding there were no crimes to charge President Biden with concerning his possession and return of some classified documents following his two terms as Vice President. But, Hur took pains to also note, Joe Biden is old; and, our disgraced former President attacked Haley, his final GOP opponent, because her husband, Maj. Michael Haley is in the Horn of Africa for a year-long active duty deployment with the South Carolina National Guard. (No word on the whereabouts of Trump's wife Melania. Though it's a safe bet that she, like the entirety of the Trump family going back generations, is not out serving her country as a member of the military.)

But it was Trump's remarks about NATO at that very same South Carolina rally over the weekend that have, appropriately, received the most coverage since then. (If nothing near the absurd coverage that the corporate media has given to Special Counsel Hur's inappropriate insinuations regarding Biden's mental fitness.)

Trump relayed a story at the rally in which he claims that, when he was President, he told the leader of a NATO nation that, if they hadn't "paid their bills" to NATO, and were attacked by Russia, the U.S. would NOT come to their defense. That, in defiance of the NATO Treaty's Article 5 agreement that states that if one member is attacked, “each and every other member of the Alliance will consider this act of violence as an armed attack against all members and will take the actions it deems necessary to assist the Ally attacked".

NATO nations, however, don't "pay" to be in NATO. In 2014, President Obama led an agreement among the treaty's 30+ member nations to work toward each spending a minimum of 2% of their annual GDP on defense. That's the "bill" for which Trump (who has been sued thousands of times personally for not paying bills) claims that many of those countries are "delinquent".

Making matters worse --- unimaginable just a few short years ago, in fact --- Trump also claims to have told that NATO leader that while the U.S. would not come to their defense, he would also encourage Russia "to do whatever the hell they want" to such countries.

NATO's Secretary-General, as well as the governments of several NATO nations, including Germany and Poland, issued unusual and harsh rebukes on Sunday in response to Trump's astonishing --- once unthinkable --- remarks.

FINALLY today, we open up the phone lines to listeners to get their thoughts on all of the above and anything else they may wish to ring in on today. And so they do. Today on The BradCast: Bad news from the DC Court of Appeals for the disgraced former President, though things could get much worse this week depending on how things go at SCOTUS on Thursday. [Audio link to full program follows this summary.]

Among our stories today...

  • The unrelenting downpour in Southern California continues for a third straight day, as Los Angeles alone reports more than 300 mudslides since the atmospheric river began pouring in on Sunday, resulting in continuing flash flooding and evacuations throughout the region. Thankfully, there have been no deaths or major catastrophes yet reported, though three were killed in Northern California where strong winds toppled trees as the storm blew ashore on Sunday. It's not yet over, but we're told the sun may finally reappear again in SoCal, at least for a time, on Wednesday.
  • Today was the last day to vote in Nevada's all vote-by-mail 2024 Presidential primaries, though few may have bothered. On the Democratic side, President Biden faces little or no competition. On the Republican side, Donald Trump helped rigged the state in his favor with the help of NV state party officials. He's not on the NV Primary ballot, since he objected to the all-mail process created by the state. He demanded caucuses instead. So Nikki Haley will be on the primary ballot, but Trump won't. While Haley won't be participating in the Thursday caucuses, but Trump will. Republican Delegates, however, will only be awarded to the winner of the rigged GOP Caucuses.
  • Welp, it took nearly a month, but a three-judge panel on the D.C. Court of Appeals finally released their long-awaited ruling on whether Presidents have immunity against any and all criminal charges for crimes they carry out while serving as President. That is what the four-time indicted former President is arguing. And, to the shock of pretty much nobody, the court ruled in a unanimous, very thorough 57-page decision [PDF] today, that, nope, a President may not avoid criminal consequences for, by way of an example Donald Trump's attorney defended in court last month, ordering Seal Team 6 to murder a political rival. While the ruling was not surprising, it was successful for Trump, at least in part, by delaying his previously scheduled March 4th federal trial on four felony counts [PDF] related to his many attempts to steal the 2020 election. The D.C. panel struck down every single argument made by Trump and ordered the case to be returned to the trial court unless the defendant appeals the ruling to SCOTUS by Monday. Of course he will. The only question for the moment is: will there be enough votes at the corrupted rightwing SCOTUS to bother even hearing this dumb case.
  • Then, we're joined by BRAD BLOG's longtime legal contributor ERNEST A. CANNING to discuss both today's Immunity ruling and the arguably far more consequential matter that will be heard by the U.S. Supreme Court on Thursday. The Supremes will hear oral argument for and against the case for disqualifying Donald J. Trump from the ballot under Section 3 of the 14th Amendment, the "Insurrectionist Disqualification Clause". The specific case, Trump v. Anderson, is named for the 91-year old Republican, Norma Anderson, who is one of six Republican and independent voters that sued under 14.3 in the state of Colorado to bar Trump from the state's Presidential ballot. They were successful. The CO Supreme Court barred Trump in a very well argued (and very conservative) ruling [PDF] late last year, pending a decision from SCOTUS. In the month since the Justices agreed to hear the case, as Canning writes this week, no fewer than 50 amici (friend of the court) briefs have been filed both for and against the Constitution's post-Civil War ban on insurrectionists serving in public office.

    Canning cites several key points offered in the various briefs from a host of scholars and experts, and we preview the questions likely to be up for debate during this Thursday's landmark hearing. The eventual opinion issued by SCOTUS could determine whether Trump is barred from the Presidential ballot in all 50 states. And what might happen then?

    Canning argues that if you follow conservative "textualist" and "originalist" doctrine, "what the intent was, what the actual language was" by the framers of the 14th Amendment, "there's no way you can come to a decision other than the fact that Donald Trump is disqualified within the meaning of the statute."

    That largely matches conventional wisdom suggesting the Constitutional case for banning Trump from office is pretty rock solid legally. Nonetheless, most of those media pundits and legal experts also tend to argue that the former President's friends and appointees on the High Court are likely to conjure up some sort of jiggery-pokery and pure applesauce to allow him to remain on the ballot this year anyway. "That could very well happen here," Canning tells me, before adding: "But I wouldn't bet the farm either direction."

COP28 in 'overtime'; Democracy rises in Poland; New U.S. House maps for NY; More good economic news; Trump at SCOTUS; Rudy defames amid defamation trial; Johnson lies about WI's fake electors...

If, like me, you're old enough to get the joke in today's headline, congratulations on still being alive! (If you don't remember it, here's a reminder.) But, no, we didn't forget Poland on today's chocked-with-a-surprising-amount-of-not-awful-news BradCast!

Among our stories covered today....

  • Who knew that holding a U.N. conference (COP28) on our climate catastrophe in a petrostate like the United Arab Emirates might end without an agreement --- or with a bad one --- from all 200 participating nations for the first time in the annual summit's 28 year history? Well, it ain't over until it's over, with nations now officially in "overtime" at the Conference, which was otherwise set to end last night. Will they dare mention the phrase "fossil fuels" in whatever final statement they finally unanimously agree to make? Stay tuned!
  • In what is being described as a "political earthquake", after eight years under the heavy hand of a far-right anti-immigrant, anti-media, anti-woman authoritarian party's Prime Minister and President, Poland --- with a front-row seat over the past two years to Russia's autocratic invasion of Ukraine --- elected a centrist, pro-EU Prime Minister on Monday! That is good news on a whole bunch of fronts. It became official today when Donald Tusk received a vote of confidence from parliament after a brief delay when a right-wing lawmaker used a fire-extinguisher to douse candles in a Hanukkah menorah in parliament. "This is a wonderful day," said Tusk to the Polish people on Monday night. "Not for me, but for all those who have deeply believed over these years that things will get even better, that we will chase away the darkness, that we will chase away evil. From tomorrow, we will be able to right the wrongs so that everyone, without exception, can feel at home." The news is a welcome counter-point to the recent rise of right-wing authoritarianism in nations from Argentina to The Netherlands. And, hopefully, its a good omen for 2024 in the U.S.
  • On the other hand, Ukrainian President Volodymyr Zelenskyy had to fly all the way to the U.S. on Tuesday to, essentially, beg far-right Congressional Republicans --- who have apparently lost the plot of democracy --- to continue supporting Ukraine's efforts to hold off the imperialist invasion of his country by fascist Russian dictator Vladimir Putin.
  • Speaking of Congress and democracy, very good news out of New York's high court today, which ordered a new U.S. House map for next year's 2024 Congressional elections, after the map used in 2022 resulted in a bunch of seats flipping from D to R in newly drawn districts after state Dems kinda screwed up the whole process. We explain.
  • And in more potentially good news for 2024, inflation continues to fall faster than expected, as the U.S. economy continues to show surprising resilience and little sign of the recession that many had feared when Donald Trump's Federal Reserve Chairman, Jerome Powell, began raising interest rates last year to combat inflation. Inflation is almost back to normal at 3.1% over last year; gasoline is down 11% over the past two months; employers are still hiring and unemployment remains at a near record-low rate of 3.7%. But, some prices are still high at grocery stores, as is rent and the cost of a home mortgage. Economists are watching Powell closely for a read as to when the Fed may deign to finally lower interest rates next year.
  • No sooner had we gotten off air yesterday, than the U.S. Supreme Court announced it would consider an expedited petition filed on Monday by Special Counsel Jack Smith to hear Donald Trump's appeal on Presidential Immunity in his January 6 federal indictment. It doesn't necessarily mean SCOTUS will hear the full case. But it means they will consider doing so. Smith had filed the petition for cert just hours earlier, leapfrogging the D.C. Circuit Court of Appeals in hopes of keeping next year's scheduled March 4th trial date for Trump on track. All of which, at least for now, is encouraging news to suggest that SCOTUS may both do the right thing and do so with the alacrity that would allow the American people a verdict in the case against Trump in advance of next year's Presidential election.
  • The defamation damages trial against dirtbag former NYC Mayor and Trump attorney Rudy Giuliani --- in which he's already been found guilty of defamation --- continued into its second day on Tuesday. But not before his attorney admitted in Court on Monday (as the federal judge has already found), that Rudy's horrendous claims about two Georgia election workers in 2020 committing fraud for Joe Biden were false. And not before Giuliani then stepped out of the courtroom on Monday and repeated the same baseless claims yet again on the courthouse stairs. Today, U.S. District Court Judge Beryl Howell scolded both Rudy and his attorney, noting that Giuliani's remarks on Monday night "could support another defamation claim" by mother and daughter plaintiffs Ruby Freeman and Shaye Moss. The pair are currently seeking damages in the amount of $15.5 to $43 million in their civil lawsuit. And they will deserve every penny they receive.
  • Speaking of dirtbags, following the news last week that Wisconsin's 10 fake Trump electors had settled a civil lawsuit against them, the state's U.S. Senator Ron Johnson --- already on record as having encouraged state lawmakers to steal the Badger State's 2020 election for Trump --- described the settlement as a "travesty of justice." He insisted that Democrats had done the very same thing "repeatedly" and "in multiple states" in the past. Nonetheless, he couldn't name any state where Democrats had secretly created false slates of electors in hopes of stealing an election when pressed by CNN's Kaitlan Collins. (If Johnson was referring to what happened in Hawaii in 1960, he is wrong about that as well.)
  • Finally, Desi Doyen joins us for our latest Green News Report, with both the good and bad, so far, out of the COP28 Climate Conference in Dubai, and some very good news indeed from President Biden regarding the nation's largest ever investment in high speed rail and U.S. passenger rail service.

On the heels of last weekend's Hamas attack on Israel and Israel's subsequent retaliation against Gaza, there has been a flood of disinformation about the conflict allowed to circulate on social media. Also on today's BradCast, we take some time to focus on a major victory back home in the ongoing strike by auto workers against Detroit's Big Three. [Audio link to full show follows below.]

FIRST UP, a quick word or two on the landfall of Hurricane Lidia last night on the Pacific Coast of Mexico near the resort of Puerta Vallarta. When we got off air yesterday, the storm had quickly spun up to a Category 3 before ultimately making landfall as a Category 4, with windspeeds topping 140 mph. Happily, it hit in a sparsely populated area, so damage and loss of life, so far, has reportedly been minimal. But the rapid intensification of the storm, and its gaining of strength as it got closer to land is both remarkable and something we have seen much more of in recent years as our climate crisis worsens. Also, the fact that Lidia made landfall on the Pacific Coast of Mexico just one day after another storm, Max, did as well, should similarly be ringing alarm bells.

NEXT, the relentless military response by Israel against Gaza continues in the wake of the unspeakably horrific attack by Hamas on Israel over the weekend. So does a flood of misinformation, disinformation and propaganda on social media sites. Elon Musk's Twitter/X site is particularly horrible in this regard, following his firing of most of the company's content moderation team and its replacement by community volunteers who are, according to an NBC report today, largely being ignored by the company as false and inflammatory content runs wild. AP is helpful today in offering independently verifiable facts to correct the record on a number of viral social media videos and photos purposely doctored to mislead. One, for example, showed a manipulated "order" from President Biden, claiming to send $8 billion in aid to Israel. Another purports to show videos of Russian President Vladimir Putin warning the U.S. to "stay away" from the Israel-Hamas conflict. Both assertions were completely false, but were allowed to remain on Twitter for hours without correction to be seen by millions of users.

THEN, in some brighter news, the United Auto Workers union struck a stunning deal late last week with GM that will allow workers who build batteries for electric vehicles to join the union's master agreement with the company. That, after many thought that an agreement to unionize workers at EV plants would be impossible.

Our guest today is DR. MARICK MASTERS, Professor of Business and Political Science at Wayne State University in Detroit, where he also served as Director of the Labor@Wayne program. He joins us to discuss the big news for workers at battery plants and other successes, so far, by the UAW and its President Shawn Fain during the ongoing, unprecedented strike against all three major U.S. automakers.

Late last week, Masters published an article at The Conversation on "Why the UAW union's tough bargaining strategy is working". He joins us today to discuss the new tactics and strategies employed by union leaders in the growing work stoppage and how it might both lead to success and ultimately be adopted by other union organizers.

On the landmark agreement with GM to include workers making parts for battery electric vehicles in the master union contract, Masters describes the deal as "a monumental achievement on the part of the UAW," adding: "I don't think that anyone, including myself, thought that this was doable. I didn't think that was something that the companies would concede, but GM did."

He cautions, however, that "it remains to be seen whether the two other companies [Ford and Stellantis] will accede to this demand of the union. But I don't think the UAW would sign a tentative agreement with them if they didn't."

Masters breaks down the UAW's so-far successful three-part strategy in the ongoing strike; explains why labor leader Fain is receiving so much support from the public both for his "audacious" demands and style of negotiations; and discusses whether the strategies employed by the auto workers might be applied elsewhere, at both non-union companies like Elon Musk's Tesla and in other industries where workers are finally standing up to management and demanding better pay, benefits and working conditions...

Biden, Zelenskyy fight for democracy at U.N.; House GOP in 'civil war' as government shutdown looms, impeachment scam moves forward...

Thanks to the billionaire-funded rightwing media machine (and much of the corporate media that is a part of it), it remains all too easy to muddy enough waters to fool a huge chunk of the American people these days with evil, lies and bad faith. All we can do is hold on for dear life on The BradCast each day and hope that pushing back with facts and truth ultimately wins out over evil, bad faith and lies. On today's program...

  • President Biden made an impassioned case to world leaders for continuing support for Ukraine's existential battle against Russia's evil and lies --- and in defense of democracy --- at the U.N. General Assembly on Tuesday. He also called for uniting the world against our ever-worsening climate crisis.
  • Ukrainian President Volodymyr Zelenskyy also addressed the same body to make his own impassioned case that his nation's battle against the barbaric, 19-month invasion by autocratic neighboring Russia is, in fact, a warning for other democracies around the world.
  • Here at home, U.S. House Republicans --- who have become alarmingly pro-Putin, pro-Russia and pro-autocracy --- are now eating themselves alive. It seems increasingly unlikely that they can even come to an agreement among their own warring factions to adopt a measure to simply keep the government open and funded after the federal fiscal year ends next week. It is unclear that many of them even want to. As Democratic House Leader Hakeem Jeffries aptly observed over the weekend, the House GOP is now "in the middle of a civil war."
  • So, what is Speaker Kevin McCarthy's plan to get out of this mess by October 1, when his extremist GOP caucus threatens to shut down the government without, at the very least, adopting a Continuing Resolution to stay open for another 30 days so Republicans can negotiate with themselves? Impeachment of Joe Biden, of course! (Spoiler alert: There is still no evidence of either high crimes or misdemeanors, but that may not matter. As we discuss, this is the very same playbook that did in Hillary Clinton with "but her emails!" and, back in 2004, John Kerry with that swiftboat nonsense. Apparently, the American people are very easy to fool. Do Democrats have a plan in response?)
  • Finally, speaking of being fooled again, Desi Doyen joins us for our latest Green News Report, as California pushes back, in court, against Big Oil's decades of deadly climate lies. As Gov. Gavin Newsom explained when announcing the state's lawsuit against five of the largest fossil fuel companies: "These guys have been playing us for fools. They've been playing all of us for fools."

Don't get fooled again.

Navarro 'guilty'; Prigozhin's interference; DeSantis law v. Idalia recovery; Lee strengthens; OH GOP lawyer sentenced; AL GOP Rep. arrested; 'Crooked' Coffee County, GA; Solution to 'Rich Men from Richmond'...

As the headline suggests, we've got a bunch of different odds and ends and follow-ups and codas to share with you on today's BradCast, along with, several new stories and even a musical ending to it all. [Audio link to full show follows this summary.]

Among today's stories...

  • Trump advisor Peter Navarro was found guilty by a jury in D.C. on Wednesday on two counts of Contempt of Congress for refusing to answer his House January 6 Committee subpoenas for testimony and documents. It's the second such conviction for a scofflaw Trump apparatchik. Last year, Steve Bannon was found guilty of the same crimes and sentenced to 4 months in prison. He remains out on appeal. Navarro is expected to appeal as well. We wish them both nothing but luck in their continuing efforts to evade the Rule of Law on behalf of the disgraced former President and continuing con-man.
  • Just a friendly reminder, because I haven't seen it covered much in the wake of the recent small plane death of former Vladimir Putin-ally turned short-lived Russian mutineer Yevgeny Prigozhin. I just wanted to make sure this factoid doesn't fall down the Memory Hole of History: On the day before last year's mid-term elections in the U.S., Prigozhin admitted, for the first time publicly, that Russia had, in fact, "interfered, are interfering and will interfere" in U.S. elections. Yes, in addition to heading up the brutal Wagner mercenary group in Ukraine and elsewhere, being known as "Putin's Chef" and eventually failed mutineer, he was also the guy who finally admitted to having interfered in U.S. elections. He was charged by Special Counsel Robert Mueller in 2018, for having done so in 2016.
  • Following Hurricane Idalia's landfall in Northern Florida last week, it's become clear that a radical new anti-immigrant law signed by the state's Republican Governor Ron DeSantis earlier this year will hamper rebuilding and recovery efforts in the Sunshine State. While damage from Idalia was intense, it made landfall on a sparsely populate part of the state. Next time, Florida may not be so "lucky". In not-unrelated news for the U.S. East Coast, the huge Hurricane Lee has now intensified to a Category 4 today as it nears the Caribbean.
  • A couple of weeks ago, we covered yet another case of voter fraud by a White Republican Trump donor after James Saunders, a 56-year old Ohio attorney, was convicted of unlawfully voting in both Florida and the Buckeye State in the 2020 and 2022 general elections. Last week, he received Ohio's maximum sentence of three years in prison. The judge sent him immediately to jail following his conviction without allowing him to remain free pending appeal.
  • In yet another new case of GOP election fraud last week, Alabama state Rep. David Cole was arrested and charged with voting in "multiple or unauthorized locations" after law enforcement officials determined the District 10 lawmaker actually resided in District 4 in violation of state law. He faces up to 10 years in prison for his crimes, though --- in a turnabout for GOPers these days --- Cole who was elected to public office last year, had the decency to resign following his arrest and says he plans to plead guilty.
  • We've been spent quite a bit of time over the past year and a half on both The BradCast and at The BRAD BLOG covering the alarming, unlawful breach, copying and distribution of Georgia's statewide voting system software by a bunch of MAGA folks on January 7th, 2021 in rural Coffee County. The scheme was allegedly organized by Trump attorney Sidney Powell after being hatched in the Oval Office in December of 2020. Powell and three others were finally charged by Atlanta-area D.A. Fani Willis for their parts in the plot, in Donald Trump's sprawling, 41-count RICO indictment [PDF]. We helped break some of the story last year and have been covering in detail it ever since, including yesterday with guest Marilyn Marks, the woman who first revealed the breach after learning about it via a bizarre phone call she received from one of the participants (who has also since been charged.)

    But there is another, less reported aspect to all of this, with no small amount of irony. Two of those charged for key roles in the plot, the County's then GOP Chair Cathy Latham and then Election Supervisor Misty Hampton, were also part of a voter suppression cabal in the heavily Republican County where about a quarter of the population is Black. In fact, for years, the pair had helped to bring false voter fraud charges against County Commissioner Olivia Coley Pearson, a Black Democrat, for her terrible habit of helping folks get to the polls when they need assistance. As CNN's Elle Reeve details in an excellent report this week from on the ground in Coffee County, there is good reason that some refer to it as "Crooked Coffee"...even before the massive Republican election fraud breach carried out by Hampton, Latham and many others.

  • Next up, Desi Doyen joins us for our latest Green News Report following a record brutal summer across the globe. But she also has some good news, such as the Biden Administration's effort to reverse Trump's oil drilling up in the previously pristine Alaska National Wildlife Refuge (ANWR).
  • Finally, we close out Labor Day week with a new tune from musician and longtime labor advocate Billy Bragg, who says he was inspired by "the ghost of Woody Guthrie" to respond to a song named Rich Men North of Richmond by Virginia-based singer Oliver Anthony after it recently went viral in GOP circles. Bragg's new tune in response is called Rich Men Earning North of a Million and it has a very clear message and solution for Anthony "and people like you."

Today's BradCast might be best summarized by matching up the mugshots and court appearances this week (most of them just today!) of Republican attorneys who are being held accountable for felony crimes, most related to election fraud. [Audio link to full show follows below this summary.]

From left to right of the rogues gallery pictured above...

  • Ohio attorney and Trump donor James Saunders was found guilty on Tuesday of two counts of election fraud for having voted twice, once in Ohio and once in Florida, in both the 2020 and 2022 general elections. The judge immediately sent him to jail after the verdict, even before his sentencing next week. Saunders apparently committed the same crimes in 2014 and 2016, but the statute of limitations had already run before Cuyahoga County prosecutors nabbed him.
  • Republican Texas Attorney General Ken Paxton's trial on 20 impeachment charges in the state Senate is scheduled to begin on September 5. The photo above (second from left) is his mugshot from 2015 when he was charged with state felony Securities Fraud which he has yet to be tried for. TX voters elected him twice since then, nonetheless. As to the charges for which he has now been impeached, Texas House impeachment managers this week released new details about Paxton's abuse of office as the state's top law enforcement official, which include abuse of office to help his friend and donor Nate Paul, his use of a fake Uber account, burner phones and secret personal emails accounts used, in part, to facilitate his secret visits with his mistress who Paul's firm hired in order to make it easier for Paxton to visit her in Austin. All of that, even as Paul was secretly paying to renovate Paxton's home in McKinney. Paxton, who led the failed U.S. Supreme Court lawsuit attempting to toss out every vote cast in Georgia, Michigan, Wisconsin, and Pennsylvania, in the 2020 Presidential election, is also under federal investigation for many of the crimes he has been impeached for in the Lone Star State where he is now serving his third term as A.G.
  • A whole passel of Donald Trump co-defendants --- many of them also Republican attorneys --- were in the news today, as many surrendered to felony charges in Fulton County, Georgia, after being charged in the state racketeering conspiracy indictment along with Trump for their efforts to steal the 2020 election in the Peach State. Seen in mugshots above (slots 3 through 6) are Trump attorneys Rudy Giuliani, John Eastman (booked yesterday), Ken Chesebro, and Sidney Powell. Also surrendering today in Atlanta was Misty Hampton, the Republican Election Director of Coffee County, GA who invited Powell, and a bunch of other MAGA folks in to the Elections Office in the rural, Republican-leaning GA county to make unlawful copies of the state's sensitive voting system software. Also in related news today were Trump's former Chief of Staff Mark Meadows and former Trump DoJ attorney Jeffrey Clark. Both are co-defendants in the RICO case, currently seeking to move their trials to federal court. Both had moved in federal court to postpone or cancel their surrenders in Fulton County. Both motions were rejected by the federal court today just before airtime after Fulton County District Attorney Fani Willis made clear that they had both been given more than enough time before this Friday's deadline to turn themselves in.

In other, occasionally related news on today's program...

  • Yevgeny Prigozhin, founder of the Russian mercenary Wagner military battalion and leader of a short-lived coup against his former close ally, Vladimir Putin, earlier this year, reportedly died along with 9 others in a private jet that crashed shortly after takeoff approximately 60 miles north of Moscow on Wednesday. The plane was video-taped falling out of the sky after something appears to have caused an explosion after the jet had reached cruising altitude.
  • Milwaukee Public Schools were closed today in Wisconsin due to a dangerous heat wave. The closure comes on the same day that eight GOP candidates --- none named Trump --- are to appear in Milwaukee this evening for the party's first Presidential Primary debate of the 2024 season. Pretty much all of these candidates, many of whom pretended to be furious about school closures due to COVID, are also climate crisis deniers. Nonetheless, they are unlikely to raise the issue of our climate emergency at tonight's debate, despite the school closures today due to climate change in the very city in which they will be debating tonight.
  • The newly all-male state Supreme Court in South Carolina reversed the Court's own ruling from earlier this year today, regarding the state Legislature's near total abortion ban, even though the majority opinion concedes the new law infringes "a woman’s right of privacy and bodily autonomy." The 5 men now serving as Justices --- following the lone female Justice's mandatory retirement earlier this year --- just don't care, apparently. Unlike the now-retired female Justice who wrote the majority opinion blocking the new law earlier this year, the dudes now sitting on the state's High Court believe those state Constitutional interests of women do not outweigh "the interest of the unborn child to live."

And finally...

  • Trump says he will go in for booking at the Fulton County jail on Thursday evening, during TV's prime-time, of course. As he is set to be arraigned for his fourth criminal indictment of the year (his second one for attempting to steal the 2020 election), musical satirist Randy Rainbow returns with an all new, hilarious tune to mark the occasion and close today's program...

The fight against propaganda, denial, corruption and racism continues...

We wrap up our last BradCast before standing down next week with a bunch of disparate stuff, both good and bad, and even a song to help you whistle as you leave the theater before next week's holiday. [Audio link to full show follows below this summary.]

WE DID START THE FIRE: And we're also responsible for the smoke from hundreds of them in Canada, now threatening the health of more than 100 million Americans. We're also responsible for the record, weeks-long deadly, triple-digit heat wave in Texas now spreading north and east and touching off deadly severe storms along with it. Of course, those who watch Fox "News" and the read their deceptive Fox Weather website will never know who's to blame for it all and who is endangering their lives and those of their great grand-kids. But keeping their viewers and readers dumb and disinformed is the whole purpose of the Fox fake news project. Sadly, we all pay the price.

'CEASEFIRE AND NEGOTIATE!': Happily, it seems the 24-hour mutiny in Russia last weekend --- wherein longtime Vladimir Putin-ally, Yevgeny Prigozhin, gave the game away by declaring that their imperialist invasion of Ukraine was built on lies and was never about either "demilitarizing" or "de-Nazifying" Ukraine --- has helped the scales fall from a bunch of Americans' eyes. New polling from Reuters/Ipsos since the Prigozhin's short-lived insurrection finds a nearly 20-point bump since last month in American support for Joe Biden's policy of helping Ukraine defend themselves. That includes majorities in both major parties as well as independents. That's very good news. And, while I'm unlikely to reach many of the duped rightwingers who have fallen hook, line and sinker for Putin (and Trump) propaganda about the conflict, I am hoping that I might still be able to help some of those on the supposed anti-war Left who have fallen for the same propaganda. I'm talking largely about the "ceasefire and negotiate!" crowd. A few words for them today in hopes of helping a least a few of them understand how they have also been played by the same, authoritarian sources as the rightwingers.

'THIS IS NOT A NORMAL COURT': President Biden was right about that today, at least. We knew after all of the surprisingly good rulings of late from our otherwise corrupted, stolen and packed U.S. Supreme Court majority --- on issues of democracy and voting, in particular --- that it was almost certainly too good to last. As the high court's 2022 term comes to a close, they returned to their corrupted form on Thursday by overturning more than 40 years of precedent to bar Affirmative Action policies in college admissions for all private and public colleges and universities (while exempting military academies for some odd reason). Though it's not easy, we try to make sense of the Court's dizzying 237-page ruling [PDF], including multiple concurrences and dissents, as the far-right activists on the bench --- and those that put them there --- get to cross another long-term project off their list today.

SMOKE GETS IN YOUR EYES: And lungs, from the record shattering Canadian wildfires. At least if you live in any of a whole bunch of states in the mid-west or east this week. That, and more climate news, both good and bad, as Desi Doyen joins us for our latest Green News Report.

THEY DEFINITELY DIDN'T START THE FIRE: But they did, after 34 years, put all news words to it! And not a moment too soon, in my opinion! Yours may vary. Either way, we're happy to close out today's final show before taking off next week over the Independence Day holiday, with Fall Out Boy's brand-new version of a 1989 Billy Joel classic...

Also: Unrelenting climate change-fueled weather pummels nation...

Welp, it was another slow news weekend [insert eyes-rolling emoji here]. But we try to come up with something to cover on today's BradCast nonetheless. [Audio link to full show is posted below this summary.]

Among the many stories covered on today's program...

  • Extreme weather and warnings of same walloping much of the nation today, as two weeks of historic triple digit temperatures in Texas spread to other states, resulting in major storms, deadly tornadoes, widespread power outages and cancelled flights from Arizona through the mid-west up into New England and down to the Carolinas and Florida. But if you hear about these seemingly ever-worsening nightmares from some major U.S. outlets --- like Fox "News" (and even ABC, etc.) --- you may hear absolutely nothing about the man-made climate change that is fueling our intensifying global crisis.
  • On Friday, Politico finally covered the story that we broke on this show six weeks ago about how Georgia Sec. of State Brad Raffensperger says he will not be installing urgently recommended security upgrades to its horribly vulnerable Dominion voting systems until after the 2024 Presidential election in the critical battleground state. We covered that news exclusively here in mid-May. Politico covered it here on Friday. And my tweet pointing both out was throttled by Twitter over the weekend so that it's nearly impossible to find without a direct link. That is here. (More, hopefully, on this issue tomorrow!)
  • Speaking of Georgia, a federal judge has ordered Rudy Giuliani to pay the legal fees for the two Atlanta election workers --- Shaye Moss and her elderly mother Ruby Freeman --- who are suing him for defamation after he (and Trump, and the rest of the MAGA crew) falsely accused them of committing fraud in the ballot tabulation room during the 2020 Presidential election.
  • Curiously enough, the far-right, wildly corrupted U.S. Supreme Court keeps making not terrible rulings at the end of this year's term. Today, a challenge to a ruling on a case out of Louisiana, where a federal court mandated an additional black majority U.S. House district, was rejected. The case will be sent back to a lower court. If the lower court rules as SCOTUS did a few weeks ago --- when they stunned the world by upholding the Voting Rights Act and requiring another black majority House district in Alabama --- today's decision could be very good news for those that care about voting rights, the Constitution, and equal representation for all.
  • Also today, SCOTUS allowed several lawsuits against Ohio State University to proceed, after it was discovered the school had, for years, protected a serial sexual abuser who served as a team doctor for years. This is probably not good news for OSU's former wrestling coach and serial denier Rep. Jim Jordan (R-OH).
  • The lower courts are holding as well, for now. Last week, a federal judge permanently overturned Arkansas' unspeakably cruel ban on gender-affirming medical care for transgender kids, and a federal judge in Florida temporarily blocked Gov. Ron DeSantis' anti-freedom crusade to ban minors from attending drag shows. Amusingly, one of the reasons the judge blocked the new law was because it was in conflict with DeSantis' so-called "Parents Bill of Rights" legislation adopted in 2021.
  • Finally today, before opening the phones to listeners, we discuss the bizarre story of whatever the hell happened over the weekend in Russia where, for about 24 hours or so, civil war nearly broke out. That, as Yevgeny Prigozhin, formerly a close ally of Vladimir Putin and commander of the mercenary Wagner Group (arguably Russia's best fighting force in Ukraine), declared Russia's justification for attacking Ukraine --- to demilitarize and de-Nazify the sovereign nation --- to be a lie. Wagner's march toward Moscow, however, ended as quickly as it began, with Putin theoretically granting Prigozhin safe harbor in Belarus, even if both his future and those of the troops in the Wagner brigade remain uncertain at this hour. We open the phones with what is left of today's show to discuss what the hell is going on and where both Russia and Putin's fortunes may be heading from here...
