A study conducted by a researcher in France has uncovered that polling locations which use electronic voting machines exhibit a higher number of discrepancies than those using conventional paper ballots. Unsurprising to those who have followed the problems plaguing e-voting since its introduction, the revelation has fueled renewed calls for greater scrutiny of electronic voting technology in France.

The study was conducted at over 21,000 polling stations by comparing electoral registers, which voters sign after voting, with the total vote counts from machines and paper ballots in several elections. Discrepancies were found at almost 30 percent of polling stations that use electronic machines and only at about 5 percent of those using paper ballots.

The findings of the French study are hardly surprising to those of us who haven't been ignoring the exact same problems for years here in the U.S.. The difference, of course, will likely come in the way that France --- like other European countries, and decidedly unlike the U.S. --- responds to the findings...

The Pima County, Arizona, Diebold vote tabulation system was manipulated to "pass" a 2006 ballot initiative when, in fact, the measure was actually voted down, according to a startling new allegation revealed today by the election watchdog group Audit AZ.

The long-running election integrity battles in Pima flared up again this afternoon as an explosive affidavit from a former county official was released at a press conference held by the tenacious local organization. On the heels of several recent Audit AZ court victories, resulting in the unprecedented if long overdue release of mountains of previously "proprietary" Diebold election databases, today's presser was well attended by much of the local media.

The conference was held as news comes that the ballots for the 2006 Regional Transportation Authority (RTA) election are set to be destroyed, according to a letter sent by the Pima County Treasurer to the Chair of the Pima County Democratic Party, Vince Rabago. The June 2008 letter, posted at the end of this article, says that Rabago has the right to request that the ballots not be destroyed, which would save them temporarily. Bill Risner, the lawyer for the successful suit to obtain copies of the county's election databases, said at the press conference that the State Attorney General needs to step in and not only demand that the ballots be saved but order that they be counted to see if the total agrees with the "official" numbers that came out of the election department's computer given the extraordinary new allegations.

The potentially explosive new piece of information introduced during the press conference was a sworn affidavit from Zbigniew Osmolski, a former Pima County employee, stating that Bryan Crane, the computer operator at the Pima County Elections Division, told him, during a conversation in a bar, that the RTA Election was "fixed...on the instructions of his bosses."

According to Osmolski's affidavit (posted in full at the end of this article):

During that conversation Bryan Crane told me he "fixed" the RTA, or Regional Transportation Authority election on the instructions of his bosses and he did what he was told to do. Mr. Crane expressed his concern about being indicted and said he would like to talk but couldn't trust anyone.

The affidavit is the latest in a series of red flags concerning the RTA election. Other red flags include: (1) This was a sales tax increase, the type of vote that usually fails, and it looked like it was going down in the days prior to the election; (2) The database on the vote counting computer was erased and replaced a day into the early ballot scanning; (3) Unauthorized vote total summary reports were printed during the counting; (4) A tape of the original ballot layout stored with the Secretary of State --- which could have indicated if the vote was flipped --- was sent back to the County, which lost it; (5) An investigation into the election completed by the Attorney General's office was cursory and inconclusive.

Complaint Against Hart InterCivic Withdrawn Following Adverse Ruling Limiting Whistleblower Claims

The whistleblower lawsuit against voting machine company Hart InterCivic, as filed in federal court on behalf of former employee William Singer, has been withdrawn following a decision by the Supreme Court that makes pursuing the case nearly impossible, according to the law firm who originally filed the complaint.

The suit had been sealed for nearly two years as the Dept. of Justice asked for extension after extension during their decision on whether or not to join the case. Earlier this year, they ultimately decided not to join the case, as we reported last March, leaving the firm of Levin Papantonio Thomas Mitchell Echsner & Proctor, P.A to proceed on their own. The DoJ declines to join some 76% of such cases.

In the interim, while waiting for the DoJ, the case of Rockwell Intl Corp. v. U.S. [PDF] came before the U.S. Supreme Court, and the findings in that decision, as attorney Mike Papantonio told The BRAD BLOG, has "made it next to impossible to proceed with any and all federal whistleblower (qui tam) cases."

The decision found that Rockwell was required to pay millions of dollars under the federal False Claims Act to the federal government, but that the relator of the case --- the insider who blew the whistle --- was not entitled to any of that money, nor even for the millions of dollars accrued in legal costs since the amended complaint, filed with the Justice Dept., included information about which the relator did not have direct inside knowledge.

The SCOTUS finding, as expressed for the majority by Justice Antonin Scalia, may well hamstring future whistleblower cases in federal courts, according to legal experts.

"I used to think qui tam was the way to go," Papantonio told me as his firm was weighing their decision on how to proceed after the case was finally unsealed, "but now I just don't know anymore."

Papantonio's Florida law firm has used the qui tam laws successfully in the past, and has taken on giants such as the Tobacco Industry. After he and his radio partner Robert F. Kennedy Jr. had learned about Singer's case from The BRAD BLOG --- we originally reported Singer's extraordinary saga back in early 2006 --- they decided to launch the federal fraud suit on his behalf later that year.

(I was interviewed about the withdrawal of the federal case by Mike Papantonio for this weekend's Ring of Fire radio program, which he co-hosts with Robert F. Kennedy, Jr.. Though the attorneys working on the case have gone out of their way to express their faith in both Singer and his remarkable complaint --- detailing more than 40 federal fraud allegations, and accusing Hart of doctoring voting machines, covering up system failures, including the loss and miscounting of votes, and other malfeasance, in order to attain contracts and payment under the Help America Vote Act (HAVA) of 2002 --- the chance that millions of dollars spent pursuing the case might be unrecoverable at the end of the process, even if successful, in light of the Rockwell decision, forced them to withdraw the complaint from federal court...

Committee weighs risks, benefits of electronic voting machines
Fla. 'vote-flipping' programmer voices doubts about tool

Clint Curtis touched a hidden button on the screen of a simulated electronic voting machine as onlookers witnessed votes switch from one candidate to another.

The House Committee on Elections invited Curtis, a computer programmer from Florida, to testify Wednesday on the accuracy, risks, benefits and security of electronic voting technology. The committee also heard from other expert witnesses, election officials and the Texas secretary of state.

Curtis said a Florida representative approached him in 2000 to design "vote-flipping" software to help the congressman win an election. Requesting a fraudulent program for a machine is not illegal in Florida, but using one is.

"You cannot trust electronic machines, no matter how many honest people you have. It only takes one person with access to the machine," said Curtis, an advocate for hand-counted paper ballots. "Programmers can be bought."

The committee watched as Curtis clicked on an invisible button that suddenly placed the losing candidate of his mock election safely in the lead.

"24 lines of code can flip an election," Curtis said.

He offered to write a new code from scratch in less than three minutes, emphasizing the ease of creating a "flipping" code.

On Wednesday, coverage of his testimony by the Dayton-Beach News-Journal (who endorsed Curtis during his 2006 run against Tom Feeney, the Republican U.S. House Rep who Curtis alleges asked him to create vote-rigging software) included this:

"They seem to understand," Curtis said in a telephone interview afterwards. "They seem to get it. I think they'll do what Florida did, get rid of (electronic touch screens) and get something voters can count on."

John McCain's election strategists plan to tone down the Republicans' traditionally aggressive and public campaign against potential voter fraud, several Republicans familiar with the situation say.

The strategists and consultants all would speak only on the condition that their names and affiliations not be used because they were not permitted to divulge the information, they did not want to disclose internal deliberations, and because the issue is still being discussed within the party.

Sources with direct knowledge of the coordinated Republican effort this year say that high-ranking Republicans, including some within McCain's campaign, are convinced that GOP efforts in 2004 were damaging.

"Spreading 10,000 lawyers around the country and announcing a challenge to 40,000 new registrants in Ohio was counterproductive," a Republican familiar with the situation said.

And if you believe the GOP has any intention of scaling back any such thing in 2008, we've got a swell bridge, beautifully located near Manhattan, to sell ya.

I think we've kept our oft-made promise, so far, to bring you coverage of the 2008 Election that you will find nowhere else.

Heather Wilson's vote-buying scandal in NM (she lost her bid for the Senate nomination, btw, poor dear); to thousands of "Double Bubble" ballots left uncounted on Super Tuesday in Los Angeles; to miscounted votes on Sequoia machines in NJ and the dope the company tried to put in charge of the "investigation"; to being called to testify to the U.S. Election Assistance Commission on their utter failures of federal oversight; to the federal fraud suit filed against Hart InterCivic; to their attempted takeover of Sequoia and our exclusive findings that the company doesn't even control its own software or intellectual property and their CEO has been busy lying about it; to nuns, students, vets, the elderly being disenfranchised altogether by the Supreme Court upholding unconstitutional Photo ID restrictions; to multiple races flipped by e-voting machines in Arkansas; to the continuing saga of voter fraud felon Ann Coulter and Fox "News'" attempts to ignore it; up to my very own e-votes getting flipped in L.A. the week before last; and so much more in between.

Email from Acting Registrar Dean Logan Says Poll Workers Entered Incorrect Ballot Codes into E-Voting System

Last week I reported in great detail that four out of the twelve votes I'd cast on my ballot on L.A. County's e-voting system, during California's state primary on June 3rd, were flipped to candidates that I hadn't voted for. The ES&S InkaVote Plus system printed my ballot incorrectly.

I was voting on the audio ballot voting system meant primarily for blind and visually-impaired voters. Had I not been able to inspect my ballot visually after it had printed --- for example, had I been blind --- I would never have known that I was about to cast votes for candidates that I had not selected.

Because the "disabled-accessible" e-voting system at my own precinct was not working, again, for the second election in a row, I was told I'd have to cast a provisional ballot on the "disabled-accessible" e-voting system at the other "precinct," in the same polling place, in the same room, as my own "precinct."

The machine had been down all day, and nobody had come out to replace or repair it, even though the county had been called early in the day and told about the problem. Last election, on Super Tuesday, the machine was also broken, and none of the poll workers would touch it, due to exposed wires.

This time, despite asking to vote in a specific party's open primary, I was given a non-partisan audio ballot to compound the fiasco when I tried to vote provisionally on the other "precinct's" e-voting system that was up and running, even though not a single voter had used it in either this, or the previous election.

The voting went smoothly enough --- even if it took 20 minutes to move through the short audio ballot, shorter than usual because it was a state primary, and because I wasn't allowed to vote in partisan races for some reason --- at least until it misprinted my selections, which I had confirmed as correct while actually moving through the audio selections.

Luckily, after noticing that the e-voting system had printed my ballot incorrectly, I was allowed to VOID that ballot, and this time chose to vote on a regular, hand-marked paper ballot instead. My hand filled in the ballot far more accurately than the computer did.

That night, I alerted officials at the CA Sec. of State's office and L.A. County's acting Registrar of Voters, Dean Logan, about the problem, and the machines and ballots in question were isolated for testing. Whether someone who wasn't a loud, muckracking journalist, specializing in issues of election integrity, would have had that kind of quick service, I can't tell you.

Logan promised the machine would be tested, and the SoS office promised to follow the testing closely.

Earlier this week, Logan sent me an update via email, with photos, on what the investigation had so far found. The problem, Logan wrote, is being attributed to the "human error" of the poll workers who, he says, entered incorrect information into the e-voting system when setting up my ballot for me to vote.

Logan's complete email, detailing the findings of the cursory investigation to date, follows below, along with my email in response to it. As you'll see, the all-too de rigueur "human error" excuse does not sit well with me...

Looks like we're coming into rewards season at the White House for longtime Bush loyalists. Of course, we thought that's what the last seven year were about, but we digress.

Apparently, being named as a criminal co-conspirator in Articles of Impeachment is worthy of a prize from this particular White House, as Bush/Cheney '04 Inc.'s self-proclaimed "non-partisan" "longtime voting rights advocate" --- and not-self-proclaimed national champion GOP vote-suppressor Thor Hearne --- received yet another thank you gift from the White House today: A non-partisan appointment to a "non-partisan Commission" (according to the nationally renowned liar Thor) by George W. Bush.

Jo Mannies of the St. Louis Post-Dispatch, one of the few reporters Thor will answer the phone for (other than those at "liberal media" outlets such as NYTimes, NPR, USA Today and again at USA Today) writes today, while failing to note Hearne's infamous entry into the history books on the floor of the U.S. House this week...

UPDATE: Now back home, and watching Kucinich myself on C-SPAN. He's been reading for hours, and may have hours ahead still. As mentioned on the air, I was consulted for these Articles of Impeachment and submitted a number of suggestions and material concerning impeachable offenses related to election tampering by George W. Bush and his agents. Don't know whether those articles are still in the final version. We shall see. But I wanted to be sure to disclose that.

No doubt we'll be talking about this tomorrow on the PBC Show (which I'm Guest Hosting all week). We're trying to get Kucinich for tomorrow's show...if he still has any voice left.

FURTHER UPDATE: Looks like the election-related Articles of Impeachment made it into the final version, including a mention of GOP "voter fraud" sheister Mark F. "Thor" Hearne of front-group American Center for Voting Rights (ACVR). Nice to see Hearne get the recognition on the floor of the U.S. Congress that he so richly deserves.

STILL MORE: Reuters coverage notes Kucinich "defied his party leadership" in filing. AP incorrectly writes:

Kucinich introduced a resolution last year to impeach Vice President Dick Cheney. That resolution was killed, but only after Republicans initially voted in favor of taking up the measure to force a debate.

In fact, his Articles of Impeachment against Dick Cheney were not "killed," they were sent to the House Judiciary Committee, where they remain without action having been taken on them by the Dem leadership, despite best efforts by folks like Rep. Robert Wexler (D-FL), and others.

POST-ADJOURNMENT UPDATE: Just prior to midnight ET, Kucinich finally finished reading the list of High Crimes and Misdemeanors. Equal Justice Society writes:

"We've waited seven years to find one Member of Congress brave enough to stand up for our Constitution, for which generations of Americans have fought and died," said Bob Fertik, President of Democrats.com. "We are thrilled and honored that Dennis Kucinich has chosen to be that one genuine patriot. We congratulate him on his historic leadership, and pledge to do everything in our power to persuade Congress to adopt all 35 Articles and put George W. Bush on trial before the Senate of the United States, exactly as the Founding Fathers wanted."

"Some might question why Congressman Kucinich has done this now," continued Fertik. "My question is why 434 other Congress Members have not done it before. Despite the uncountable and unspeakable crimes this administration has committed, George Bush and Dick Cheney remain in power and immune from prosecution. Congress must impeach Bush and Cheney now - before they further abuse their power by pardoning for all of their crimes."

The Entire Brad Friedman Exposé, as Published, In-Full for the First Time, in Hustler Magazine...

While the conspiracy theorists at Fox "News" ramp up their "special investigation" into the exceedingly rare crime of voter fraud, misleading their viewers before the upcoming election with breathless reports of "illegal immigrants" and "people who are not even citizens voting for whomever they want" in order to "sway an election," I thought it might be useful to publish the complete cover-story, detailing Ann Coulter's no-uncertain-terms felony voter fraud, as it was published in the recent exposé I wrote for Hustler magazine.

Up until now, the story --- along with complete documentation, such as the voter registration form on which she purposely lied and the evidence proving she knowingly voted in the wrong location --- has been told piece-meal in smaller stories as the scandal unfolded over the last two years (all indexed in full here.)

But, with Fox "News" requesting tips via their special VoterFraud@foxnews.com address, I thought it might be nice to help them out by publishing, for the first time online, the entire story of Coulter's purposeful voter fraud: What she did, how she publicly used Fox and other media to lie about it, and how she's gotten away with her several felonies and at least one misdemeanor...so far.

Hopefully the crime fighters at Fox will help enforce the rule of law, and bring this documented fugitive to justice once and for all! Especially since, as you'll see in the following story, she used the network's own airwaves to lie to Alan Colmes and others. Please do your civic duty and let them know!

4 Out of 12 Ballot Selections Printed Out Incorrectly, Myriad Other Laws Violated
ES&S InkaVOTE Plus System Fails Miserably, Mars What Should Have Been a Simple Voting Experience During L.A. County's Very Low Turnout State Primary Election...

As a fairly well-known Election Integrity journalist who has personally covered, for years, the myriad election woes of thousands (if not millions) of voters around the country who have tried to bring seemingly endless stories of votes flipped on e-voting systems to the attention of officials, these stories always continue to be remarkable to me, even if not to many others in the rest of the mainstream media.

It's even more troubling when one realizes that so little ever seems to be done in light of so many of these horror stories, as those very same failed systems are still deployed across the nation, with little or no modification to correct the mountains of documented problems even now, as we head towards an election likely to be of historic proportions this November.

What follows is yet another one of those stories, where a voter had vote selections flipped by the electronic voting system, such that candidates were chosen other than the ones intended to be selected by the voter, though no fault of his own.

But this time, the voter is me.

Though I've covered so many of these stories, it was nonetheless remarkable to see it happen before ones very eyes, as occurred yesterday when I voted here in Los Angeles during our very low turnout California state Primary election.

The ES&S electronic voting system that I used to try to vote on yesterday, ended up flipping a total of 4 out of the 12 contests and initiatives for which I had attempted to vote.

Right before my very eyes, the computer-printed ballot produced by the voting system I was using, incorrectly filled in bubbles for four of the races I was voting in. Had I not been incredibly careful, after the ballot was printed out, to painstakingly compare what was printed to what I actually voted for, I'd have never known my votes were being given to candidates I did not vote for.

Had I been a blind voter --- as the system I was using is largely intended for use by the disabled --- I would have cast my ballot without having a clue that a full 40% of the votes I'd tried to cast for various California Superior Court judges were flipped to other candidates...

Yes, four different selections, on my very own ballot, were flipped before my very eyes when I went to vote in yesterday's California state Primary Election.

One might think that someone might have been smart enough to make damned sure, at the very least, that the equipment where that widely-known Election Integrity muckraking journalist jerk, Brad Friedman of The BRAD BLOG goes to vote, would have been thoroughly tested and working as it was supposed to. One might think that. But if so, one would be wrong.

There was a very low-turnout state Primary Election in New Mexico today. And yet, it brought more November tea leaves....

Computer problems affected ballot verification procedures in some counties across the state earlier Tuesday.

The Secretary of State's office started getting calls around noon from smaller counties saying their computer connection to Santa Fe wasn't working. By 1 p.m., no county in the state was connected to the system that allows counties to access voter registrations and also report results.

Cibola County also experienced some computer problems. Election officials there said they only had one computer to verify where people should go to vote, as all other computers crashed.

Last we had checked (and no time to re-check for the moment), ES&S ran the voter registration system in NM. During the state's Democratic Caucus last February, thousands of voters were reportedly dumped from the newly-privatized voting rolls. If you live in New Mexico, or anywhere else, please check your voter registration status soon!

Do-it-Yourself Election Results...

How easy is it to enter any election results you want into the Diebold central tabulator? When you use Diebold's "Manual Override" option, it's exactly this easy...


The video above was shot on the night of the recent Primary at the election headquarters in Florida's Sarasota County, home of the infamous 2006 13th Congressional District where 18,000 votes disappeared on ES&S iVotronic touch-screens in an election decided by a 369 vote margin. The county now uses Diebold's paper-based optical-scan system, which failed to work as it was supposed to on Election Night. So, as seen in the above, the county election staff used Diebold's "Manual Override" to enter voting results into the tabulator with none of the party observers or board of election commissioners bothering to watch.

Kudos to one of Florida's Election Integrity citizen activist/video heroes, Jeannie Dean, for shooting and compiling the above.

Please note her advice tips, at the end of the video, instructing how you can similarly help out big time this November!
