On today's BradCast, we have not one, but two important and separate warnings for Donald Trump and the Republican Party, as pulled from the deep audio archives of 1988. Both of which --- on two separate topics from two separate people --- they seem to be completely ignoring, even as one of those warnings comes from their supposed idol Ronald Reagan. [Audio link to show posted below.]

First up today, the Trump-caused child immigration crisis continues to unfold with several disturbing new reports of unspeakable abuse at two separate federally-contracted facilities, based on filings in new federal court cases. One from Associated Press on beatings and more at a youth facility in Virginia and the other from the Center for Investigative Reporting on the forced injection of psychotropic drugs at a facility near Houston. That, as an Executive Order signed by the President on Wednesday, reversing part of his Administration's policy, fails to speak to family reunification for more than 2,300 children separated from their parents in recent weeks under Trump's "zero tolerance" border policy, and an Administration request to the Pentagon for space to house some 20,000 migrant children.

While all of those American nightmares have been unfolding over the past week, the effects of Trump's growing trade war have been quietly playing out in the background, as the Dow has dropped some 600 points over the past four days, with China and friendly allies like Canada, Mexico and the EU vowing massive and swift retaliation for ill-considered tariff's on foreign imports instituted by Trump. Among the hardest-hit victims of his new trade wars: farmers who were among some of biggest supporters of Trump's candidacy in 2016.

Perhaps that explains why, as share in an audio clip from 1988 today, Ronald Reagan warned: "We should beware of the demagogues who are ready to declare a trade war...all while cynically waving the American flag."

Next, we're joined by MARK JOSEPH STERN, legal reporter at Slate, and our "Supreme Correspondent" this month, as the U.S. Supreme Court slowly releases a bevy of decisions in advance of their planned Summer recess, on a number of major cases heard at the high court over the past term. Among the cases we discuss today:

  • On Thursday, SCOTUS released a 5 to 4 decision allowing states to impose sales taxes on all online purchases. The ruling found some very strange bedfellows in both its majority and minority opinions, but both Stern and I agree, the decision makes sense, and will be good for local retailers, jobs, the economy and state budgets where, particularly in "red" states, tax cuts in recent years have lead to the gutting of education, infrastructure and other important social services. The 1967 SCOTUS ruling struck down today, was "a totally capricious standard that the Court created itself," Stern argues. "This was the Court fixing a problem that it made."
  • Stern also details an exceedingly troubling --- if little reported --- case out of South Dakota, where a man was found guilty of murder and sentenced to death, according to jury members themselves, they feared, as a gay man, he might enjoy life in prison too much. Seriously. Perhaps the most disturbing part of this matter: the Court declined to hear the case at all. Even the liberal Justices failed to offer a written dissent to the Court's decision.
  • We also discuss the SCOTUS' regrettable punts this week on two partisan gerrymandering cases in Wisconsin and Maryland. (More on those cases earlier this week, with author David Daley on Monday's BradCast.)
  • And the seemingly unprecedented federal court smack down of Kris Kobach, notorious GOP "voter fraud" fraudster and Kansas Secretary of State. His "Proof of Citizenship" voter registration law was struck down by a George W. Bush-appointed federal judge, and he was slapped for his contemptible performance in the courtroom --- where he represented both himself and the state of KS --- with more humiliating sanctions that include an order to attend six hours of legal classes. Moreover, as Stern reports, Kobach appears to be in still more violation of court orders, as he has yet to remove the requirement for citizenship documentation for voter registration from the KS Sec. of State website, as the judge ordered him to do "immediately" in her ruling on Monday.

    "I think that there is a decent chance that we could see even more sanctions for Kobach after this," Stern tells me. "Kobach is such a clown that this judge is going to finally have to bring down the hammer and I think it's going to be a glorious sight." (More on that case, with Sophia Lakin, one of the ACLU trial attorneys on the case, from Tuesday's BradCast.)

  • Previewing the cases still to come before the end of the month, Sterns warns: "I think the Supreme Court is going to hobble public sector unions by preventing them from collecting dues from no-union members. I worry the Supreme Court is going to uphold the [Muslim] travel ban. I do think the Court may put real limits on the government's ability to collect information about where your cell phone has been from your provider. That's going to be a bright spot, I hope. But I also think the court's going to end up striking down California's disclosure requirements for crisis pregnancy centers. So, this is s not going to be a good term for progressives. I think everyone needs to just buckle in and focus on November."

Finally, Desi Doyen joins us for the latest Green News Report on a number of important issues that the Trump Administration did quietly this week as the rest of the nation and media were consumed with the child immigration story, and the 30th anniversary of Dr. James Hansen's first dire warning to Congress --- also in 1988 --- about the then-looming menace of global warming due to the unprecedented release of greenhouse gasses, such as carbon dioxide from the manmade burning of fossil fuels, into the atmosphere...

Among the stories both covered and elucidated upon today...

  • Former prosecutor and New York City Mayor Rudy Giuliani joins Donald Trump's legal defense team hoping to "negotiate an end" to Special Counsel Robert Mueller's probe into Team Trump;
  • After a months-long struggle on Thursday, the U.S. Senate barely managed to confirm the wholly unqualified Rep. Jim Bridenstine (R-OK, pictured above), a long-time, wildly partisan, non-scientist climate science denier to head NASA, the $20 billion federal agency which, among other things, tracks key climate change-related data for the world;
  • Vulnerable Democratic U.S. Senator Heidi Heitkamp of North Dakota announces she will vote in favor of Trump's nominee for Secretary of State, CIA Director Mike Pompeo (also a climate denier), seemingly all but assuring Pompeo's otherwise still-troubled confirmation process;
  • GOP "voter fraud" fraudster, Kansas Sec. of State and gubernatorial candidate Kris Kobach is held in contempt of federal court for a second time, receiving an humiliating drubbing from a George W. Bush-appointed federal judge for repeatedly and "disingenuously" misleading the court in a major voter suppression case in the state, affecting tens of thousands of voters;
  • The Republican-controlled state legislature in Arizona attempts a sneaky maneuver to try and prevent voters from filling a vacated U.S. Senate seat for as long as two and a half years, should one occur, as Sen. John McCain battles brain cancer. (They now appear to be backing off the scheme.);
  • And, in Texas, a new poll finds Rep. Beto O'Rourke, the Democratic challenger to Republican Senator Ted Cruz, now within the poll's margin of error to unseat Cruz in what had previously been the very "red" Lone Star State;

The chaos in Congress, as Republicans race to come up with a plan to avoid a Government shutdown this weekend, echoes what happened just last week as they they tried to pass a reauthorization and extension of the FISA Amendment Act in the U.S. House. Though GOP leadership and the White House had long lobbied for the reauthorization, Donald Trump unleashed chaos when he tweeted against his own bill. That legislation, which allows for warrantless surveillance of emails and phone calls by all Americans, ultimately passed after Paul Ryan called the President to explain it, and enough Democrats came on board to help them in the House. (It passed today, again with the help of Democrats in the Senate, and now heads to Trump's desk to be signed.)

On Thursday, as Congressional Republicans attempted to pass a short-term spending bill to keep the government open --- after a long-term deal was plunged into chaos when Trump refused a deal that included immigrants from "shithole countries" --- Trump did it again. He tweeted against a GOP stopgap plan which includes reauthorization of the Children's Health Insurance Program (CHIP). The reauthorization, which both helps sick kids and saves the government billions of dollars, was included by Republicans in hopes of enticing Democrats to help them avoid a full government shutdown as of midnight Friday. Most Dems don't seem to be buying it --- despite Ryan, once again, calling the White House to get Trump back on board --- as they appear unwilling to help Republicans out of this jam without the inclusion of a fix to the Deferred Action on Childhood Arrivals (DACA) program.

Republicans refuse to include a fix to DACA, the Obama-era protection against deportation of some 800,000 children of immigrants, which Trump reversed, in their short-term measure. Dems say they won't support such a bill unless DACA is included. In other words, the children helped by both CHIP and DACA are now being held as hostages by the Republican Party. The measure squeaked by tonight in the U.S. House, but passage in the Senate, where 60 votes are needed to overcome a filibuster, is far from certain.

Then, after Donald Trump's fake "Fake News" awards face plant on Wednesday night, we have a few real "Fake News" awards to offer, based on actual facts, as we reach the end of Trump's agonizingly long first year in office this weekend.

Finally, Desi Doyen joins us for the latest Green News Report, with bad news out of China, good news out of the Detroit Auto Show (and even from McDonald's), and some late breaking news from NOAA and NASA on the record heat of 2017, as man-made global warming continues apace in the new year...

Guest: Author, naturalist Tony Russell...

On today's BradCast: It's been 29 years since NASA's chief scientist, Dr. James Hansen, offered landmark testimony to the U.S. Senate in June of 1988, explaining that scientists had determined with 99% certainty, as the New York Times reported it at the time, that record atmospheric warming since the 1950s "was not a natural variation but was caused by a buildup of carbon dioxide and other artificial gases in the atmosphere." [Audio link to show follows below.]

Of note in the Times coverage at the time --- headlined "Global Warming Has Begun, Expert Tells Senate" --- there was nobody quoted from the fossil fuel industry offering denial to the basic scientific facts about which Hansen and others testified that day, based on temperature records going back (at the time) 130 years, and finding that the first five months of that year had been the hottest on record. (The record temperatures that year don't even rate among the top 20 anymore.)

"It is time to stop waffling so much and say that the evidence is pretty strong that the greenhouse effect is here," Hansen told the paper after his 1988 testimony. "Global warming has reached a level such that we can ascribe with a high degree of confidence a cause and effect relationship between the greenhouse effect and observed warming,'' he testified to the Senators. ''It is already happening now.''

The panel of scientists warned that "If the current pace of the buildup of these gases continues, the effect is likely to be a warming of 3 to 9 degrees Fahrenheit from the year 2025 to 2050." They were pretty much exactly on target, so far, with those projections. Then Senator Timothy E. Wirth (D-CO), chair of the Committee, responded: "'As I read it, the scientific evidence is compelling: the global climate is changing as the earth's atmosphere gets warmer. Now, the Congress must begin to consider how we are going to slow or halt that warming trend and how we are going to cope with the changes that may already be inevitable."

In the 29 years since --- particularly in the seven years since the Supreme Court's Citizen United opinion unleashed unlimited fossil fuel industry funds into our electoral process --- Republicans (and some Democrats) have instead figured out how to "cope with the changes" by denying they exist at all, or pretending there is uncertainty about who is responsible for it.

But the science is very clear, even more now than than. (And it was even clear some 30 years prior to Hansen's 1988 testimony, as a clip from a 1958 television program, dug up by Desi Doyen and played in part on today's show, makes evident.) And yet, the President of the United States and his top lieutenants --- among them EPA Administrator Scott Pruitt and Energy Secretary Rick Perry --- have been taking to the airwaves of late to confuse the public with blatant misinformation to distract from the point that man is responsible for all of Earth's warming recorded since the 1950s.

Marking the 29th anniversary of Hansen's testimony, naturalist and author Tony Russell penned a very simple, very clear explanation --- "Global Warming in a Nutshell" --- of the very simple science and math behind global warming, how we know that man is responsible for the 48% increase of heat-trapping CO2 over the past 60 years (CO2 emitted by the burning of fossil fuels lacks a specific carbon isotope, so we can actually measure it!), and what we must do about it...and quickly. He joins us today to discuss that article, and the reasons he wrote it. "I have 9 grandchildren," he tells me, "so they are very much on my mind."

"In some ways, I'm starting to see our situation as desperate," he warns, explaining how it is that we know that disinformation from folks like Pruitt and Perry is simply, and demonstrably, wrong. "When you have warming in the pipeline, with CO2 hanging in the atmosphere that's going to continue to re-radiate heat for tens of thousands of years, and we keep adding new carbon dioxide to the mix, there's no way to stop it. We're loosing a runaway train."

Noting that natural sources, such as oceans and forests, have been able (at least up until recently) to absorb some 50% of the carbon we release, Russell explains: "If you want to stop adding to the CO2 in the atmosphere, then humans have to cut their emissions by 50% from current levels. The figures you see are usually on the order of cutting emissions by 20% by, say, the year 2025. Every year that you hold it at 20%, then 30% will go into the atmosphere. CO2 levels will keep on climbing, more long term warming will be locked in. It really is that simple."

We've covered climate quite a bit over the years on The BradCast and, of course, on our Green News Report. But sometimes it's important to go back to the basics on how stark the science and the reality of our dire situation now is.

On the same topic, speaking of U.S. Senate testimony that's been too-much overlooked, as Dr. Joe Romm at Climate Progress notes this week, Sen. Al Franken (D) recently "set climate deniers' last strawman on fire" during an exchange last week with Sec. Perry, when the Minnesota Senator pointed out that even the Koch Brothers own climate scientist Richard Muller recently conceded that all of the recent warming in the atmosphere was due to our burning of fossil fuels. We play the remarkable exchange today in full.
