On today's BradCast, Desi Doyen and I are finally back from a week of maddening illness over the holiday! My enormous thanks to Nicole Sander of RadioOrNot.com for her generously quick-footed and quick-witted guest-hosting in our absence!

First up today is a quick review of what we can (or can't) look forward to over the next two weeks in Paris, where the largest gathering of world leaders in history is now underway in hopes of carving out a "final" agreement to curb the global emissions that cause deadly climate change. We will have much more on the COP21 conference as it unfolds over the next two weeks.

Then it's onto the rightwing extremism --- from the Black Lives Matter protesters shot in Minneapolis to the attack at Planned Parenthood in Colorado Springs --- that took place over the past week. As we note, it wasn't ISIS or Syrian refugees threatening our nation last week. Rather, as made clear once again, "the call is coming from inside the house."

Finally, we are joined for the interview by independent journalist Brandon Smith of the blog Muckrakery. It was Smith's persistent work and FOIA requests and lawsuit (along with the efforts of independent activists and attorneys) that eventually led to the release last week of the Chicago PD dash-cam video showing the outrageous killing of 17-year old Laquan McDonald by Officer Jason Van Dyke who has now been charged with first-degree murder.

"The Freedom of Information Act," Smith explains, "can be used by anyone. So, if you're reading a news story and something sounds fishy to you, you can ask for any document or piece of information. It's your government. It's your responsibility, and mine too, to hold them accountable for what they do with their positions of power."

We discuss why it took more than a year for the Chicago Police to release the tape during its cover up of an apparent murder, whether Mayor Rahm Emanuel has responded sufficiently, and what we still do not know about the killing. (For example: What happened to the audio on that video tape?; What about the surveillance video allegedly deleted by cops at the Burger King?; Why didn't the corporate media file suit to get at the video themselves?; And what of all of those other officers at the scene who failed to take action, or lied about it, after witnessing Van Dyke pump 16 bullets into McDonald --- the first two while he was walking away from them, the other 14 while he was shot, on the ground, and a threat to nobody?)

"I'm just trying to report the story of police brutality in Chicago," Smith tells me while describing how much remains unknown and what he plans to FOIA next. "We want to know who knew what about the case, and how long they kept it hidden, and kept that story out there that Laquan was acting erratically and threatening officers. Not only that, but keeping the video secret and fighting the release of the video which would tell people this was a murder, according to the prosecutors."

All of that and more today on what is clearly just the tip of the very bad and racially-based policing in the Windy City and beyond...

Remember that 2009 Dept. of Homeland Security report about Rightwing Domestic Extremism that Republicans forced the Obama Administration to retract?

We do --- once again --- on today's BradCast, particularly in the bloody wake of this week's domestic terrorist attack at Charleston's Emanuel AME Church. For some reason, Rightwingers don't want to remember that report, much less describe this week's attack at "terrorism". Wonder why. And so does Jon Stewart.

Greg Abbott actually says, with a straight face, that, in fighting for fossil fuel industry profits over people, he's protecting private property rights from the "heavy hand of local regulation." (Yes, he actually said that.)

Adam Briggle of FrackFreeDenton.com joins us to discuss how Denton hopes to fight the GOP's Big Government attack on democracy, local control and private property rights across the state --- ya know, all that stuff Republicans like to pretend they believe in.

"The industry went to the legislators that they have bought and paid for, and they wrote a new law for them to change the rules," Briggle tells me. "They just bought a new law that changed the standards by which you evaluate the constitutionality of local ordinances."

Finally, Desi Doyen joins us for the latest Green News Report, on the Pope's climate encyclical and Donald Trump's global warming denialism...

In July of 2011, just days after the massacre of 77 mostly children at a youth summer camp by a Rightwing extremist in Norway, Brian Levin, the Director of the Center for the Study of Hate and Extremism at California State University interviewed Daryl Johnson, formerly of the Dept. of Homeland Security (DHS).

Johnson was the agency's senior domestic terrorism analyst from 2004 to 2010. He was also the lead author of DHS' April 2009 draft report --- which was, shortly thereafter, retracted under pressure from Republicans, rightwingers and some veterans groups --- entitled "Rightwing Extremism: Current Economic and Political Climate Fueling Resurgence in Radicalization and Recruitment" [PDF].

After the public outcry from the Rightwing victimization industry, the DHS shamefully apologized for working on the report at all, even though it was begun during the Bush Administration; was being produced in response to a mandate from Congress; followed a DHS report on Leftwing extremism [PDF] (which received no similar outraged protestations) in January of 2009; and was authored by Johnson, who describes himself in the interview below as a pro-life, pro-gun, conservative Republican Mormon.

The draft 9-page DHS report had cautioned about the re-emergence of potentially violent extremist groups "that are mainly antigovernment, rejecting federal authority in favor of state or local authority, or rejecting government authority entirely."

It warned that similar conditions to those in the 1990's (an economic recession, a Democrat in the White House) which had led to, among other domestic terrorist incidents, the 1995 bombing of the Alfred P. Murrah federal building in Oklahoma City, had brought about a "growth in the number of domestic rightwing terrorist and extremist groups and an increase in violent acts targeting government facilities, law enforcement officers, banks, and infrastructure sectors."

The report cautioned that "lone wolves and small terrorist cells embracing violent rightwing extremist ideology are the most dangerous domestic terrorism threat in the United States" and concluded that "rightwing extremism is likely to grow in strength."

Following the deadly attack on two police offers and another person on Sunday in Las Vegas, allegedly carried out by two married members who self-identified as part of the so-called "Liberty Movement" and who appeared at the Nevada ranch of Cliven Bundy during the recent armed protest against the federal government with others in the movement, it seems a good moment to revisit that 2011 interview with the lead author of that retracted DHS report.

The alleged killers in the tragedy over the weekend later killed themselves. They reportedly draped the dead bodies of the two cops they shot with the Gadsden ("Don't Tread on Me") flag, popular with those in the "Tea Party" and "Liberty" movements, and were said to have kept Swastikas and other Nazi memorabilia in their apartment.

Neighbors told reporters that the two "had a reputation for spouting racist, anti-government views, bragging about their gun collection and boasting that they'd spent time at Cliven Bundy's ranch during a recent standoff there between armed militia members and federal government agents."

In other words, the warnings of Johnson, both in the retracted 2009 DHS report and in his 2011 interview, seem extraordinarily prescient today, for some odd reason.

Here are extended excerpts, some of them chilling in retrospect, from that 2011 interview of Daryl Johnson by Brian Levin...

Whistleblower Edward Snowden did more than simply expose a level of NSA surveillance that suggests the entire system has grown dangerously close to that of "Big Brother" in George Orwell's 1984.

In disclosing that he served at the NSA as a third-party contractor employed by Booz Allen Hamilton, Snowden's revelations touch upon the disturbing fact that the U.S. has become not only a national security surveillance state, but a privatized national security surveillance state. Our national security apparatus is now run, in no small part, by massive private corporations whose financial interests may be better served by operating in secret and by exploiting and exaggerating public fears.

As reported by The New York Times on Monday, Booz Allen "has become one of the largest and most profitable corporations in the United States almost exclusively by serving a single client: the government of the United States." The company "reported revenues of $5.76 billion for the fiscal year ended in March."

The majority shareholder in Booz Allen is The Carlyle Group, the massive global asset management firm whose defense industry contracts raised questions of a conflict of interest during the George W. Bush administration in light of the direct financial ties and active rolls in Carlyle maintained by Bush's father, former President George H.W. Bush, his Sec. of State, James Baker, III, Ronald Reagan's Defense Sec. Frank Carlucci and even Shafiq Bin Laden (Osama's brother).

These new revelations serve as a reminder that 9/11 did more than serve as an economic boon for the military-industrial complex. The events of that horrible day gave rise to an endless "war on terror," to the starkly swift passage of the USA PATRIOT Act of 2001 and eventually, along with it, --- as Sen. Russ Feingold, the only U.S. Senator to vote against the Act, predicted at the time --- to the massive reach of the NSA surveillance state. Feingold's prediction echoed the ominous warning provided by Sen. Frank Church (D-ID) some thirty years earlier, that if the NSA's surveillance capabilities were ever allowed to go unchecked, there would be "no place to hide."

But what Senators Feingold and Church do not seem to have anticipated was that this Orwellian level of surveillance capabilities would be placed into the hands of private cyber security contractors, and their billionaire benefactors, whose financial interests lie in an exaggerated state of fear and secrecy. The merger between the NSA and private corporate power raises the specter that this never-ending "war on terror" has given rise to a national security apparatus whose real purpose is to protect wealth and privilege against the threat democracy poses to our increasingly stark levels of inequality.

So, is it terrorism or democracy which is the real target of an omnipresent NSA surveillance capability? Or is it something else entirely?...

In the wake of the latest revelations of our massive, secret, invasive national security surveillance state, I've been trying to remind folks how we got here, and how it was that many on both the Right and Left --- though far more robustly on the Right --- not only allowed for these outrageous intrusions into the private lives of Americans, but actually supported them, a great deal, for well over a decade.

The hypocrisy of some, particularly those on the Right, to be "outraged" about it all now, is laughable.

Nonetheless, for some of the very important context and backstory about how we got to this place --- and how, in fact, some Democrats tried (and failed) to reign in at least the most unlawful excesses of it (even while some also supported it --- talking to you, Sen. Feinstein & Sen./President Obama) --- Rachel Maddow's piece from last night's show is extremely helpful and educational...

Man, Glenn Greenwald at the UK Guardian has got a very good, and very high-level, source (or sources).

After his Wednesday blockbuster release of secret court documents detailing an order to release millions of Verizon phone records to the NSA, and his arguably more disturbing Thursday blockbuster release of classified documents detailing the secret PRISM program allowing the government "direct access" to the servers of giant Internet service providers like Microsoft, Yahoo!, YouTube, Google and Skype, he has, as promised earlier today, just released another major classified document.

This one is a classified 18-page Presidential Policy Directive issued by President Obama last October detailing "Offensive Cyber Effects Operations (OCEO)" which "can offer unique and unconventional capabilities to advance US national objectives around the world with little or no warning to the adversary or target and with potential effects ranging from subtle to severely damaging".

It is said, by an Administration national security spokesperson, to be an update to "a similar directive dating back to 2004."

A BRAD BLOG investigation by Ernest A. Canning & Brad Friedman

Florida Governor Rick Scott's attempted purge of "potential non-citizen" voters --- a purge which Scott's Republican predecessor Gov. Charlie Crist described last week as a "shameless," "mean-spirited," "insidious" and "sweeping" effort to gain partisan advantage "under the guise of removing non-U.S. citizens" --- has been an abject failure.

Scott's claims of success in unearthing "non-citizens" said to be registered to vote in the Sunshine State, repeated by his hand-picked Sec. of State Ken Detzner and uncritically echoed by a compliant mainstream corporate media, have amounted to less --- far less --- than meets the eye.

Over the course of our months-long investigation, which included public records requests and interviews with state and county officials, The BRAD BLOG has discovered that the Scott/Detzner claim of having captured some 107 "non-citizens" on the Sunshine State voter rolls as a result of their purge is, at best, a reckless overstatement. Yet, that number (107), which Scott described as "alarming," has been uncritically accepted as fact by corporate mainstream media.

Even if it had been accurate, 107 would amount to an infinitesimal percentage of the original 182,000 who had initially been identified as "potential non-citizens" by Florida officials --- 107 as against Florida's 11.2 million legally registered voters, with an untold number of perfectly legal voters threatened with losing their right to vote as collateral damage of the state's attempted purge.

But the 107 number isn't even close to being accurate. To the contrary, Florida election officials have been unable to confirm that more than ten percent of those whom Scott and Detzner claim their purge captured were in fact non-citizens.

For example, in the two counties, Lee and Collier, where 92 of Scott and Detzner's claimed 107 have been removed, just nine (9) of them have actually been verified, to date, as "non-citizens" named by Scott and Detzner on their list of "potential non-citizens" sent to county election officials for purging earlier this year. The rest have either been removed from the rolls without independent verification of whether or not they are lawfully registered U.S. citizens, or they were removed after their names surfaced on a separate list that had nothing to do with the list compiled by Scott and Detzner. That separate list, as gathered by a local news outlet, similarly, may or may not accurately identify the named registered voters as "non-citizens".

Despite the extraordinary failure to date, Scott and Detzner have repeatedly proclaimed "victory" in their voter purge scheme. Making matters worse for the general populace trying to make sense of what is actually going on, numerous corporate-owned media outlets have compliantly echoed their extraordinarily misleading and deceptive spin...

I was on Thom Hartmann's Big Picture yesterday to discuss The BRAD BLOG's special exclusive report on Monday in which counselor Canning and I detailed how Gov. Rick Scott (R) and the state of Florida is attempting to deceive the media, the public, and apparently even the federal court system about this year's attempted voter purge in the Sunshine State. The Dept. of Justice has filed suit alleging that the systematic removal of voters within 90 days before Florida's federal primary is a violation of the National Voter Registration Act (NVRA).

As documented in our investigative report, claims being made by Scott, his Sec. of State Ken Detzner and their surrogates in a recent media blitz, charging that the U.S. Dept. of Homeland Security was purposely restricting them from access to a federal immigration database in order to keep the state from using it, appear to be baseless. FL had hoped to use the SAVE database to help purge some 182,000 "potential non-citizen" voters they claim are on the rolls.

But FL's claims (which is used to underscore a dark conspiracy the actions of the federal government are all being done to enhance President Obama's re-election prospects), are belied by documented email concessions from the FL Dept. of State's Asst. General Counsel Maria Matthews who acknowledged, as long ago as October of 2011, that the state simply didn't have the unique numeric identifiers required by DHS to check those "suspected non-citizens" against their immigration and citizenship database.

Florida Gov. Rick Scott (R), his recently appointed Secretary of State Ken Detzner (R), and their surrogates are attempting to deceive the media, the public, and possibly even the federal court system about their state's effort to use a federal immigration database as part of a state program that could result in the purge up to 182,000 registered voters who, the state says, are "potential non-citizens".

A review of public documents and internal emails obtained by The BRAD BLOG on the heels of a federal lawsuit filed against the state last week by the U.S. Department of Justice (DoJ) --- charging that Florida's attempted purge of voter rolls violates federal law --- reveals that claims being repeatedly made by the Florida officials about both the U.S. Department of Homeland Security (DHS) and DoJ are disingenuous at best.

Admissions made to DHS officials on at least two occasions, by a high-ranking attorney at the FL Dept. of State (FDOS), undermine the public assertions of both Scott and Detzner, who each claim that the federal government is purposely withholding access to a federal immigration database so that it cannot be used for scrubbing illegal voters off the state rolls.

The false allegation that the DHS has "refused" to provide access to the database, so as to prevent the state from lawfully removing illegally registered non-citizen voters, was also repeated in Florida's own federal complaint, which it recently filed against DHS.

In offering this deceptive claim, Scott and Detzner are knowingly inflaming an unsubstantiated conspiratorial scheme that the Obama Administration is working to keep illegal voters on the rolls in order to enhance the President's 2012 election prospects.

The first-hand evidence reviewed by The BRAD BLOG, obtained via public records requests under Florida's Sunshine Act, reveals that both Scott and Detzner are advancing the "refused access" canard --- echoed by both the Rightwing and non-Rightwing media --- in order to confuse the public and obscure the reality that the state's controversial purge could potentially disenfranchise thousands of perfectly legal citizen voters...

Yesterday morning, we detailed the ACLU's lawsuit against the state of Florida for their attempted, illegal purge of as many as 180,000 "potential non-citizens" from the voter rolls, despite the fact that, to date, almost all of the targeted voters have been shown to be both legal citizens and legal voters. (In his coverage, Ernest Canning also offered a nice summarized round-up of Florida's twelve-year recent history of pulling this crap by illegally removing legal voters from the voting rolls in election after election.)

Later yesterday, Florida filed suit against the Dept. of Homeland Security (DHS), arguing that the feds are refusing to turn over their database, so that the attempted voter purge might more accurately target actual non-citizens. The state claims they've been trying to gain access to that federal database for months --- since it is supposedly more accurate than the state's drivers license database (which legally includes non-citizens, but fails to note many them have become naturalized citizens since getting their drivers license.) The suit argues that the feds have disallowed them from doing so, for some reason.

Now, the real story becomes a bit easier to understand, thanks to a 5-page letter [PDF] released later in the day yesterday from the Dept. of Justice to the State of Florida in response to their previous refusal to halt the illegal voter roll purge.

The new letter explains why FL is currently being denied access to the federal DHS database; details how FL is blatantly violating several federal laws with their attempted purge; requests the state "immediately cease this unlawful conduct"; and, just in case they don't, notifies them that the DoJ has now "authorized the initiation of an enforcement action against Florida in Federal court."

In other words, the DoJ is going to court to sue the state of Florida to stop the illegal purge.

I'd go into more details on the above, but I'm scrambling to prepare for tonight's nationally-syndicated Mike Malloy Show (which I'm guest hosting all week). So hopefully the above will give you the skinny on this maddening attempt at voter suppression by the GOP in the Sunshine State for the moment.
