10th Circuit stays order compelling EAC to add 'Proof of Citizenship' requirement to federal voter registration form...

Early last week, with little attention in the media, the U.S. 10th Circuit Court of Appeal applied the brakes, for now, to one of the newest voter suppression schemes on the bleeding front edge of the GOP's ongoing War on Voting.

The insidious new Republican scheme, if it manages to overcome continuing challenges in court, such as the stay and appeal it now faces in the 10th Circuit, could result in thousands of otherwise eligible voters in Kansas and Arizona (and elsewhere, if the effort is allowed to move forward in KS and AZ) unable to even register to vote, much less cast a ballot on Election Day.

An investigative report by the Arizona Republic last year found the evidence for the purported basis of the new law --- claims by Republicans that non-citizens are casting ballots in the state --- to be "nearly non-existent".

Judith Brown Dianis, a civil rights litigator at The Advancement Project, described the nearly decade-long, coordinated, nationwide GOP voter suppression effort as "the largest legislative effort to roll back voting rights since the post-Reconstruction era". While appearing before a U.S. Senate Subcommittee in 2011, she described the effort as one designed to make "it harder to register to vote, harder to cast a ballot and harder to have a vote counted."

One of the primary GOP efforts to make it "harder to cast a ballot" can be found in the spate of polling place Photo ID laws that Republicans have sought to justify on the basis of what amounts to a phantom menace. Cases of in-person voter impersonation --- the only type of voter fraud that can be prevented by Photo ID --- are about as scarce as hen's teeth.

The same can be said about baseless GOP claims of an epidemic of voter fraud in the form of votes cast by non-citizens --- an allegation that is now being used as part of the new Republican ploy to prevent perfectly lawful citizens from even registering to vote...

But another admission is even more disturbing...

The radically activist Supreme Court Justice Antonin Scalia --- who, despite his increasing tendency to legislate from the bench, likes to pretend he's not an activist and not legislating from the bench --- was asked about his personal sources for news in a New York interview by Jennifer Senior published over the weekend.

His answer, while perhaps the least surprising news of the day, may explain a lot...

We just get The Wall Street Journal and the Washington Times. We used to get the Washington Post, but it just … went too far for me. I couldn’t handle it anymore. It was the treatment of almost any conservative issue. It was slanted and often nasty. And, you know, why should I get upset every morning? I don’t think I’m the only one. I think they lost subscriptions partly because they became so shrilly, shrilly liberal. …No New York Times, no Post. I get most of my news, probably, driving back and forth to work, on the radio. Sometimes NPR. But not usually. Talk guys, usually.

His "favorite" "talk guy", he says, is former Reagan official, Bill Bennett, who once declared "you could abort every black baby in this country, and your crime rate would go down." That's the type of person that Scalia looks to for his "news", apparently.

Ian Millhiser who, after quaintly describing the aging Justice as "Archie Bunker in a less comfy chair," citing the remarks from the interview above, as well as Scalia's statements that he believes the Devil is "a real person", and his being troubled by Hollywood "ladies" using "the f-word" in movies, notes a more disturbing revelation from the interview...

Today, President Obama offered an address to mark the fifth anniversary of the Lehman Brothers bankruptcy and the beginning of the 2008 collapse of the Wall Street casino or, as the President described it, "the worst economic crisis of our lifetimes." (He also spoke briefly, at the top of his remarks, on our latest mass shooting rampage which took place at the Washington D.C. Navy Yard this morning, reportedly resulting, in the deaths of at least 12 people at the military installation.)

"It was five years ago, this week, that the financial crisis rocked Wall Street, and sent an economy already into recession, into a tail spin," Obama reminded us. "And it's hard sometimes to remember everything that happened during those --- those months, but in a matter of a frightening few days and weeks, some of the largest investment banks in the world failed, stock markets plunged, banks stopped lending to families and small businesses, our auto industry --- the heartbeat of American manufacturing --- was flat-lining."

The President went on to tout the reforms and the recovery that have taken place since that time, arguing that "we’ve cleared away the rubble from the financial crisis and we’ve begun to lay a new foundation for economic growth and prosperity," while conceding "we are not yet where we need to be."

"Most of the gains have gone to the top one-tenth of 1 percent," Obama correctly noted. "So, in many ways, the trends that have taken hold over the past few decades of a winner-take-all economy, where a few do better and better and better, while everybody else just treads water or loses ground, those trends have been made worse by the recession."

Over the weekend, the 40-year old advocacy group, Public Citizen, marked the same occasion of the fifth anniversary of the 2008 crash with an email blast highlighting a few numbers the President did not highlight in his remarks today, including a few jarring stats that remind us how and why, despite the modest recovery and incredibly tepid reforms of the past five years, the "too big to fail" foxes still remain firmly in charge of America's economic hen house...

Nullification of $21m judgment shields generic pharmaceutical manufacturers from liability for unreasonably dangerous drugs...

Amidst the understandable sound and fury of the U.S. Supreme Court's recent decisions on marriage equality and their activist zeal to gut the Voting Rights Act in their determination to legislate from the bench that which is specifically mandated by the Constitution to be legislated by Congress, a number of their other end-of-term decisions managed to fly largely beneath the radar.

One of those decisions came late last month when the five right-wing members of the Court ruled that citizens who are severely injured, maimed or even killed by FDA-approved --- but unreasonably dangerous --- generic prescription drugs, have no right to seek compensation from the giant pharmaceutical companies which manufacture and market them to unsuspecting consumers.

In its 5-4 decision in Mutual Pharmaceutical Co., Inc. vs. Bartlett [PDF] ("Bartlett"), the Court annulled a $21 million judgment that had been awarded to New Hampshire resident Karen L. Bartlett. Her use of the generic drug, Sulindac, in 2004, produced catastrophic injuries when she suffered an acute toxic necrolysis (aka Stevens-Johnson Syndrome).

In his majority opinion, Justice Samuel Alito described her injuries as "tragic" and acknowledged that over 65% of Bartlett's body "was burned off, or turned into an open wound. She spent months in a medically induced coma, underwent 12 eye surgeries, and was tube fed for a year. She is now severely disfigured…and is nearly blind."

For Alito, and the rest of the Court's right-wing majority, the severity of Bartlett's injury proved inconsequential when measured against Big Pharma's bottom line and their interest in selling generic drugs, which account for 75% of the prescription drugs sold in the U.S.

As a result, as it applies to generics, for the first time in our nation's history, FDA permission to market has been treated as a final stamp of approval as to the generic drug's safety, irrespective of the scope of subsequently obtained scientific evidence that reveals otherwise.

Anyone who is now injured, maimed or killed by what turn out to be generic, poison pills are S.O.L....

"In my opinion, you don't need to hedge," Mark Rumold, attorney at the Electronic Frontier Foundation told me.

"There's no question in my mind", he said, that the surveillance programs revealed by former NSA contractor Edward Snowden include both illegalities and unconstitutionalities. They "violate the First and Fourth Amendment of the Constitution" and even "the plain terms of FISA [the Foreign Intelligence Surveillance Act], the law on which the authority is purportedly based, and...other federal statutes."

Rumold was my guest this week on the KPFK/Pacifica Radio BradCast where my hope was to strip away all of the nonsense "controversy" about Snowden and Guardian journalist Glenn Greenwald in order to focus on the actual disclosures, what we know about them, what we don't, and what we know about the lies told by the Administration about them (especially those by Director of National Intelligence James Clapper.)

Also, Rumold discussed the status of his EFF lawsuit attempting to force the secret Foreign Intelligence Surveillance Court (FISC) to release their 2011 finding on the illegalities/unconstitutionalities of one of the very few programs that they actually rejected.

If you are confused about any or all of that, today's show is a great primer on those key points and several more. And though he may be somewhat biased, I --- who am completely objective on these things --- would tend to agree with him.

In a ruling hailed by voting rights advocates today, Arizona's requirement that newly registered voters submit proof of citizenship with their registration has been struck down by the U.S. Supreme Court in a 7-2 decision. Justice Antonin Scalia authored the opinion for the majority, while Justices Clarence Thomas and Samuel Alito dissented.

The court rejected provisions of Proposition 200, a ballot measure approved by AZ voters in 2004, which mandated that state election officials reject all applications to register to vote that did not include documentary proof of citizenship. Those documents, however, are not currently required by the Federal Form for voter registration, as approved by the Elections Assistance Commission (EAC) pursuant to provisions of the National Voter Registration Act of 1993 (NVRA).

Today's ruling in Arizona v. Inter Tribal Council of Arizona [PDF], is grounded upon the plenary power given to Congress by the Elections Clause (Art. I §4 of the U.S. Constitution) empowering Congress to preempt state regulations governing the "Times, Places and Manner" of holding federal elections. The court found that the NVRA mandate that states "accept and use" the Federal Form for voter registration takes precedence, and that Prop 200 is invalid because it conflicts with the Congressional intent that the NVRA help ease the ability of citizens to register to vote.

Writing for the majority, Justice Scalia observed that if a state could "demand of Federal Form applicants every additional piece of information the State requires…the Federal Form ceases to perform any meaningful function, and would be a feeble means of 'increas[ing] the number of eligible citizens who register to vote in elections for Federal office.'"

This does not close the door on the issue altogether, however. Justice Scalia noted that, pursuant to the NVRA, any state can ask that "the EAC alter the Federal Form to include information the State deems necessary to determine eligibility." If the EAC then rejects such a request, the state "may challenge the EAC's rejection of that request [in court]"...

It's been a big gay week at the U.S. Supreme Court! So it seemed time to call on my friend Mike Rogers of RawStory.com to join me on the KPFK BradCast to talk about it all.

Rogers has joined me over the years for various 'Big Gay Hours' on the radio --- going all the way back to the darkest anti-gay years of 2004 and 2005 when the campaign against marriage equality had first been weaponized by the Republican Party. So it is with some joy that we were able to mark the extraordinary victories, and speed with which they have happened, for the gay community, as well as for those of us in the constitutional conservative community who believe in things like Equal Protection under the Law, etc.

We discussed both the CA Prop 8 and DOMA hearings this week at SCOTUS, how we all got here, and what has become of some of those closeted gay politicians who fought against gay rights and inspired Rogers to become an investigative blogger, open his old BlogActive.com site and begin reporting (and outing) the hypocrites standing in the way of equality for all. His work, outing folks such as Sen. Larry Craig and others, eventually helped to inspire Kirby Dick's 2009 documentary Outrage (in which he is featured).

We played and discussed some of the clips from this week's hearings, including some of the shameful performances from Justice Antonin "Just Makin' Shit Up Again" Scalia, Prop 8 proponent attorney Charles Cooper and the Obama Administration's horrible Solicitor General Donald Verrilli.

I also covered a bit of the mysterious Florida Election cyberhack story out of Miami-Dade (and a new clue to the mystery), and Desi Doyen joined me to have a laugh at the Tennessee "conservatives" who've suddenly found an amusing reason to finally give a damn about mountaintop removal mining, and for the latest Green News Report...

Supreme Court Justice Antonin Scalia's obnoxious remark Wednesday about the Voting Rights Act as a "perpetuation of racial entitlement" wasn't the half of it.

Scalia is often held up by self-described "conservatives" as a model jurist, setting the standard for the type of "strict constructionism" or "originalist" interpretation of the Constitution that Republicans would like to see more of on the bench.

Jurists like Scalia, the pretend argument goes, are the antidote to those "liberal activist judges" who don't appreciate the limited authority of the judicial branch and who abuse their position in order to usurp the power of the executive and/or legislative branches by --- gasp! --- "legislating from the bench!"

Wednesday's shameful display by Scalia, however, during the Shelby v. Holder hearing at the U.S. Supreme Court, on whether or not Section 5 of the Voting Rights Act (VRA) ought to be discontinued, should serve to put the bald hypocrisy of that entire Republican myth to bed for good. The Supreme Court Justice beloved by the hard right demonstrated exactly why that hard right loves him --- and it has nothing to do with "conservatism" or "judicial restraint" or "strict constructionism" or any of those other absurd partisan talking points bandied about in regard to Scalia...

Oligarchic perversion of our legal system continues apace...

In light of GOP Presidential front-runner Newt Gingrich's recently revitalized attacks on the judiciary as, apparently, not yet extreme or activist enough for his tastes --- though he finds, like most of the other GOP candidates, Justices Roberts, Scalia, Thomas and Alito to be "pretty darn good" --- it's worth taking note of just some of the recent behavior, judicial temperament and fundamental principles of those far-Right extremist Supreme Court Justices he apparently does approve of.

To that end, the opening paragraph of a Nov. 14 Los Angeles Times article was disturbing but not surprising:

The day the Supreme Court gathered behind closed doors to consider the politically divisive question of whether it would hear a challenge to President Obama’s healthcare law, two of its justices, Antonin Scalia and Clarence Thomas, were feted at a dinner sponsored by the law firm that will argue the case before the high court.

Dishonorable SCOTUS Justice to American Democracy: 'Go Fuck Yourself'

AP reports the following comments made Tuesday by the unimpeached Supreme Court Justice Antonin Scalia concerning his decision to overthrow American democracy in the 2000 Presidential Election:

"It's water over the deck - get over it," Scalia said, drawing laughs from his audience.

We wonder what other decisions by the SCOTUS that Americans should "get over." We wonder if the voters of Florida who were denied their expressed intent to elect Al Gore should also "get over it." Doubtless, the more than 3000 U.S. troops killed by George W. Bush's unnecessary war have no choice but to "get over it."

Deceptively attempting to justify his wholly incorrect and unconstitutional decision by playing the unequally applied "Equal Protection Clause" card once again, Scalia reportedly added, "Counting somebody else's dimpled chad and not counting my dimpled chad is not giving equal protection of the law."

Interestingly enough, Scalia and the SCOTUS have stood by and allowed all forms of un-Equal Protection in Elections ever since --- from the myriad different voting systems and "standards" now used, to the myriad ways in which votes by voters in the very same county are counted differently and at different times. In other words, the repugnant democracy-hating Scalia is full of shit.

As pointed out --- though somewhat cryptically --- in the AP piece by Mark Sherman, subsequent study of the actual ballots in the state of Florida in 2000 showed that, in fact, had all of the them actually been counted (we know, it's a quaint idea) Gore would have won [PDF] the state, and thus the Presidency.

Speaking of which, Rolling Stone's Tim Dickinson says: Run, Al, Run. We concur, and offer John Lennon's "(Just Like) Starting Over" as our suggestion for the campaign's victory song.
