Today on The BradCast, Bernie Sanders beats front-runner Hillary Clinton once again, this time in the West Virginia Primary. But Exit Polls reveal some bizarre demographics, even as a new national poll now finds Donald Trump surging and tied with Clinton nationally. [Audio link to the show is below.]

Sanders racked up another win on Tuesday, even as his odds for winning the Democratic nomination remain long (if not impossible) against Clinton. But with Trump's GOP competition now finally out of the way, Exit Polling coming out of the Mountain State last night suggests that many "Democratic" voters there are prepared to vote for Trump in November...even if he's running against Sanders, oddly enough. So is that new reason for Dems to be worried?

Ninth generation WV native, Head-On Radio Network host, co-founder of the Appalachian Communities Health Emergency Campaign and President of Coal River Mountain Watch Bob Kincaid joins me to try and make sense of the reported results and Exit Polling. We also examine what effect Clinton's out-of-context remarks about "putting miners and coal companies out of business" may have had on the state's electorate, as well as on the upcoming primary next week in Kentucky, and even for the general election in key swing coal states like Ohio and Pennsylvania (where another new poll this week found Clinton tied or losing to Trump.)

"The coal issue is a considerable part of this process because you've got a lot of people in West Virginia who will clutch at any straw, even though the coal industry doesn't wield the power it once wielded," he tells me. "But the openly anti-coal rhetoric that comes from our side, and of which I am a practitioner, puts a lot of people off."

Kincaid, however, is no fan of Clinton's, at least when it comes to what he sees as her chances in a head-to-match with Clinton nationally. "I've gone on record saying that I fully expect her to lose in November if she's the nominee. She's a terrible candidate. She's an awful campaigner, and --- I don't like saying this, Brad --- I want a Democrat in the White House. I'm a grown-up politically. I know that 'I want a pony' is not on the ballot. But, she's a tone-deaf campaigner. She's got 25 years worth of real and imagined baggage, and a 25-year-old Republican-funded filth machine that runs on 200-proof pure hate, that's humming along on 64 valves, okay?"

The colorful longtime radio host also goes on to offer a no-uncertain-terms warning to Democrats about the party's Gubernatorial nominee Jim Justice who, he predicts, will end up endorsing Trump this Fall.

In related news today: New polling shows Trump surging 13 points over the last week and now tied nationally with Clinton. (Not to say 'we told ya so', but...well...); Also: New indications that the GOP electorate in North Carolina may now be turning against state Republican lawmakers in the wake of their Big Government, anti-business, anti-LGBT 'bathroom law'; and, finally, a follow-up on the stupid, recent investigation against black, female cadets at West Point...

Guest: Vape shop owner Chris Hughes of Smoke Free Alternatives

On today's BradCast, voters head to the polls in West Virginia and Nebraska; The Philippines elects its own version of Trump (but worse); and the FDA issues deadly new rules that may wipe out an industry and help kill hundreds of thousands, if not millions, of American. [Link to full audio below.]

First up, it's Primary Election day again, this time in West Virginia and Nebraska (Republicans only). In WV, many voters will be forced to vote once again on 100% unverifiable touch-screen systems, though Donald Trump tells voters not to vote at all, at least until the general election. At the same time, new polling from Quinnipiac [PDF] shows Hillary Clinton virtually tied with or losing to Trump in three key swing-states (OH, FL and PA), while Sanders outpaces Clinton in each, beating Trump in all three crucial states.

Meanwhile, in elections overseas, London elects its first Muslim as Mayor, though he's worried he may not be able to visit other Mayors in the U.S. if Trump becomes President and, in The Philippines, it looks as if they have elected a new President who is even more disturbing than Donald Trump. So, yes, it can happen.

Then: the FDA issues insane new rules for electronic cigarette and e-liquid manufacturers which could end up killing the vaping industry that is currently helping to prevent the tobacco-related deaths of some 500k Americans each year. Chris Hughes, President of the PA Chapter of the Smoke Free Alternatives Trade Association, and owner of the Fat Cat Vapor Shop, explains the new onerous regulations and how Democrats are supporting them despite scientists and experts, such as those at UK's Royal College of Physicians who recently announced: "in the interests of public health it is important to promote the use of e-cigarettes...as widely as possible as a substitute for smoking."

If the misguided FDA rules are finalized, it could cost as much as $1 million to receive approval for every single vaping product, e-liquid flavor (including each level of nicotine). The only companies likely to afford that process are the Big Tobacco companies that the bulk of the vaping industry is hoping to put out of business. In turn, millions of folks who have quit smoking by moving to vaping (which has almost none of the dangers of tobacco cigarettes) are likely to begin smoking again. "People smoke for the nicotine but die from the tar," explains Hughes, adding, "there are over 7,000 chemicals in cigarette smoke. And many of them act in concert with nicotine to make it more addictive." That is not the case for vaping products!

As someone who, thanks to vaping, was able to quit the deadly habit after decades of smoking myself, this is a very disturbing development. It's made even more disturbing by the particular big name Democrats (some of the otherwise best Dems --- Hughes names names!) who support the new regulations that will only help both Big Tobacco and, as Hughes notes, "the same giant pharmaceutical corporations that make nicotine patches, lozenges and gums [and inhalers!] and view my business, and thousands of other small businesses in the country, as competitors."

"This plan, if its fully implemented," he says, "will close every vape shop like mine in the United States. The only other thing we can say certainly will happen is smoking rates will skyrocket again across all demographics. There are currently over 9 million adults using these products regularly in the U.S. and those people will seek an alternative product. The alternative for them may be to go back to smoking in many instance. Half of those people will die prematurely as a result of smoking. And that's the catastrophe."

While I try to contain my rage here, even in writing this item, Hughes suggests those who would like to support the effort to kill smoking by saving vaping should stop by the Consumer Advocates for Smoke-free Alternatives Association (CASAA.org). They offer a number of things you can do immediately. He also suggest you "call your representatives and tell them --- politely --- that you feel very strongly that the Senators should re-evaluate their stance on vapor products."

  • New polls find, once again, that Bernie Sanders leads Hillary Clinton in match-ups against all potential Republican opponents (and even among Democrats nationally); Also, that the front-runners in each party are remarkably unpopular within their own parties.
  • Bruce Springsteen cancels a North Carolina concert Sunday due to the state Republicans' new pro-discrimination law;
  • The GOP in Nebraska is attempting to 'swipe' a potential electoral college vote from Democrats;
  • San Francisco (where the economy is booming, as it is elsewhere here in California, now under Democratic control), becomes the first U.S. city to mandate paid parental leave;
  • More clear evidence that thinking big about policies and progressive ideas pays off when the people bother to fight for them and turn out to vote (when they are allowed to vote, anyway), rather than turn cynical and stay home.

Nebraska does it again! The majority-GOP state legislature overrides yet another veto by the state's GOP governor to do the right thing yet again, this time to allow the children of immigrants to obtain drivers' licenses. The latest move by Conservative legislators in the state comes on the heels of overriding vetoes and/or filibuster-proof majorities to protect voting rights, raise tax revenue to repair roads and bridges and ban the death penalty. (Today's news, by the way, was available last week to regular BradCast listeners, as it was hinted at quite directly on our show at the time by my guest that day, Republican state Sen. Al Davis.)

In the meantime, my guest on today's The BradCast is Montana's Commissioner of Political Practices John Motl. He explains the state's latest disturbing court battle to retain their long-standing caps on campaign donations. As noted during the show, this case could very well end up at the U.S. Supreme Court and serve to remove all caps on donations to candidates across the country. So it's very important. This in a state which recently saw SCOTUS gut it's 100-year old prohibition on corporate campaign spending (the Corrupt Practices Act of 1912) in the wake of Citizens United.

"We fully understand we are standing in on behalf of the average person," Motl tells me. "We're not standing here on behalf of the large moneyed interests. And we're willing to take that burden on." He adds that he's confident they will win this case. "If there's justice, we will prevail." I'm not quite as confident as he is, to be frank. Pay attention to this case.

After a bunch of breaking news on The BradCast today --- out of Baltimore, on Gov. Don Siegelman (D-AL)'s rejected criminal appeal, on Jeb Bush's latest easily disprovable nonsense in hopes to rewriting Iraq and his brother's criminal culpability in it --- I was delighted to move on to some very encouraging news out of Nebraska.

On Wednesday, in Nebraska's unique, non-partisan unicameral state Senate, Republicans and Democrats voted --- with a "veto proof majority" --- to end the use of the death penalty in the state. The move, in the pretty deeply Republican state, seems to have shocked many, particularly with the state's Republican Governor having just announced his purchase of a a new batch of drugs to kill people with...from a very questionable source.

State Sen. Al Davis (R-District 43), one of those who voted to end the state's immoral killing of prisoners, joined me on today's show to explain why he voted as he did (on this matter and in the recent bipartisan rejection of a polling place Photo ID voting restriction); whether he believes the "veto proof" majority on the death penalty ban will hold at this point; why the state's unicameral, non-partisan chamber seems to result in common sense alliances rarely seen elsewhere across our dysfunctional partisan landscape; and what other surprising moves (yes, increased taxes and more!) may soon come out of the majority Republican statehouse.

All of that today, along with a thought on David Letterman's departure and Desi Doyen with the latest, very oily, Green News Report...

Earlier this week, the U.S. Supreme Court severely curtailed the government's ability to utilize a routine traffic stop as an excuse to subject motorists to a canine-sniff of their vehicles as a precursor to a search for narcotics.

In Rodriguez v. United States, the Court ruled that the right of "seizure" during a routine traffic stop extends only for the length of time necessary to effectuate the purpose of the stop --- a purpose that ends with the issuance of a citation or warning for the routine stop. While the time needed to effectuate the purpose of the stop includes such measures as necessary to protect an officer’s safety, it does not, according to the Supremes, include a "dog sniff" which, as Justice Ruth Bader Ginsburg wrote on behalf of the court's majority, relates to "the Government’s endeavor to detect crime in general or drug trafficking in particular."

While the 6 to 3 decision (Justices Thomas, Alito and Kennedy dissenting) was handed down in a case in which a motorist was caught transporting methamphetamine inside his car, it also serves to protect the rights of those who are innocent, such as 63-year old Dennis Eckhart, whose nightmarish plight --- including multiple, invasive, forced medical procedures --- all came about as the result of a routine traffic stop and wholly unfounded suspicion by local police...

A bit of good voting news, for a change, via Zach Roth at MSNBC today...

Opponents of a voter ID bill in the Nebraska legislature say they've succeeded in killing the measure.

Eleven Republicans joined all 14 Democrats Wednesday in voting to shelve for the year an ID bill that just last month was seen as having a good shot at passing.

"It is victory. It's done," state Sen. Adam Morfeld, who led the opposition, told msnbc moments after coming off the floor. "The bill is dead."

The utter lack of documented voter fraud in the state made the bill a tough sell even with many Republicans. The measure's backers were unable to cite even one example of fraud that would have been stopped by the law.

While that may be true, that same fact --- the lack of "even one example of fraud that would have been stopped by the law" --- hasn't stopped Republicans from passing similar restrictions on voting in states like Pennsylvania, Wisconsin, North Carolina and Texas, over the last several years (even as many of those restrictions have been found unconstitutional by courts thereafter.)

In 2012, a Photo ID restriction bill in Nebraska was defeated by a fillibuster, when, as AP reported at the time, critics "blasted the proposal as an attempt to keep poor, elderly, disabled and college-aged voters from casting a ballot." This time, Roth reports, the bill was killed outright.

"We found out half-way through the filibuster that we actually had a majority of folks that wanted to kill the bill," Morfeld told MSNBC, which reports that "Voting rights advocates had said at least 112,000 Nebraskans, likely significantly more, lack the ID that would have been required" to vote under the proposed restriction.

But Roth also notes that the key to killing the bill outright was likely found in the non-partisan nature of the state's unicameral legislature which "isn't organized by party, though individual members have party affiliations. That makes it easier for lawmakers to vote their consciences."

"It's much less partisan in our body, and people are able to be more independent," Morfeld told MSNBC. "People aren't punished for not following the party lines on certain issues, because our leadership is non-partisan."

Also, it seems, thanks to the body's unique structure, the voters of the state will not be punished either, by purposely discriminatory partisan voting restrictions --- at least not this year.

Sean Hannity and his friends on the Republican right must be furious about the outrageous land grab happening to private American citizens in Nebraska. Wait, what? He's in favor of the Keystone XL pipeline project anyway? How could that be?

The pipeline's owner, TransCanada Corp., has now filed an eminent domain action in a Nebraska state court seeking to force private landowners to grant an easement that would permit the Canadian-owned company to erect sections of the highly controversial Keystone XL on privately owned land.

The new filing comes on the heels of a controversial decision earlier this month in which a 3-judge minority of the 7-judge Nebraska Supreme Court were permitted to overturn a lower court ruling that the process by which the state's Republican Governor Dave Heineman permitted TransCanada to revise the pipeline's route was unconstitutional. Heineman's decision was upheld because of a Cornhusker state requirement that state constitutionality be determined by a super-majority of high court's justices. (The new route was necessary after both the Republican Governor and GOP-controlled state legislature objected to the originally-planned route.)

While the Nebraska Supreme Court's decision at the time served to shift the immediate focus of the debate back to Washington D.C., where the Republican-controlled House voted for fast-track approval of the pipeline and a similar bill is quickly working its way through the newly GOP-controlled U.S. Senate, TransCanada's eminent domain filing in the state may prove a major embarrassment to those same elected Republicans. Many of those same GOPers, and their mouthpieces in the media like Hannity, have previously declared fierce opposition to eminent domain abuse that occurs when either state or local entities condemn properties owned by ordinary citizens, where such condemnations primarily benefit commercial interests of wealthy corporations and developers...

Battle over controversial Canadian project now moves back to D.C...

Thanks to a bizarre provision of their state Constitution, the minority ruled today at the Nebraska Supreme Court.

In a split decision by the state Supremes on Friday, the court vacated a lower state court ruling that had found the approval process for a new, revised route for the controversial Keystone XL pipeline to be in violation of the state constitution. Although a 4 to 3 majority of the court's jurists found the law in question to be unconstitutional, a state requirement that constitutionality be determined by a super-majority means that the lower court ruling is struck down. The state legislation allowing the revised route "must stand by default," according to the ruling [PDF].

The new decision clears the way for President Obama to offer final approval or rejection of the pipeline, which is set to ship dirty tar sands oil from Canada across the continental U.S. to the Gulf of Mexico for ultimate export overseas. The future for the pipeline, however, is still unclear.

The Nebraska Supreme Court did not approve the Keystone XL pipeline itself, but rather addressed whether an attempt to revise the pipeline's route to avoid an environmentally-sensitive region in Nebraska was legal under the state's constitution, Climate Progress reports.

Simply put, the Nebraska ruling narrowly focused on the question of process. Four of the seven state Supreme Court justices agreed with the lower court that state legislation allowing TransCanada, the foreign company behind the pipeline, the option to essentially select which state entity would approve its revised route, was unconstitutional.

But Nebraska's state constitution requires questions of constitutionality to be decided by a super-majority of 5 votes. Therefore, even though a 4 to 3 majority of the justices agreed with the lower court ruling that the approval process for the revised route was unconstitutional, the approval is nonetheless allowed to stand on what is, essentially, a legal technicality.

The Nebraska Supreme Court ruling moves the fight back to Washington, DC, where Republicans (and some Democrats) have long pressured President Obama to approve the massive new pipeline, which critics regard as a serious threat to the environment, with impacts on groundwater supplies and global warming...
