The U.S. House Judiciary Committee's subcommittee on the Constitution, Civil Rights, and Civil Liberties will be holding a hearing this Thursday on "Lessons Learned from the 2004 Presidential Election."

Though no press release has yet been sent out by the Committee, and the link to the hearing's page at the Judiciary website is currently broken, The BRAD BLOG has both good news and bad news to report here.

The good news: Ohio's former Sec. of State J. Kenneth Blackwell has been invited to testify and has confirmed that he will actually show up this time, according to several Judiciary sources. Blackwell had previously snubbed the committee's earlier invitation to testify back in February about the myriad crimes that were committed on and by his watch in the 2004 Presidential Election.

Following his last refusal to appear --- when he responded to the committee claiming "my schedule will not permit me to attend the hearings" --- Judiciary Committee spokesperson Jonathon Godfrey hinted that a subpoena might be forthcoming if Blackwell continued to refuse to appear. This time, at least as of today, it looks like he's coming, according to confirmation by Godfrey this afternoon. Thus guaranteeing what should be a very lively hearing.

More good news: Shameless GOP "voter fraud" zealot and disgraced former FEC chair Hans Von Spakovsky will also be appearing. By invitation of the Republicans on the committee, amusingly enough. What were they thinking in inviting this embarrassment? Beats us, but we're happy to hear he'll be back on the Congressional hot seat. Thanks Repubs!

John McCain's election strategists plan to tone down the Republicans' traditionally aggressive and public campaign against potential voter fraud, several Republicans familiar with the situation say.

The strategists and consultants all would speak only on the condition that their names and affiliations not be used because they were not permitted to divulge the information, they did not want to disclose internal deliberations, and because the issue is still being discussed within the party.

Sources with direct knowledge of the coordinated Republican effort this year say that high-ranking Republicans, including some within McCain's campaign, are convinced that GOP efforts in 2004 were damaging.

"Spreading 10,000 lawyers around the country and announcing a challenge to 40,000 new registrants in Ohio was counterproductive," a Republican familiar with the situation said.

And if you believe the GOP has any intention of scaling back any such thing in 2008, we've got a swell bridge, beautifully located near Manhattan, to sell ya.

Looks like we're coming into rewards season at the White House for longtime Bush loyalists. Of course, we thought that's what the last seven year were about, but we digress.

Apparently, being named as a criminal co-conspirator in Articles of Impeachment is worthy of a prize from this particular White House, as Bush/Cheney '04 Inc.'s self-proclaimed "non-partisan" "longtime voting rights advocate" --- and not-self-proclaimed national champion GOP vote-suppressor Thor Hearne --- received yet another thank you gift from the White House today: A non-partisan appointment to a "non-partisan Commission" (according to the nationally renowned liar Thor) by George W. Bush.

Jo Mannies of the St. Louis Post-Dispatch, one of the few reporters Thor will answer the phone for (other than those at "liberal media" outlets such as NYTimes, NPR, USA Today and again at USA Today) writes today, while failing to note Hearne's infamous entry into the history books on the floor of the U.S. House this week...

Congressman Kucinich Takes Hours to Read ALL Articles in Full on the Floor of the U.S. House of Representatives

Rep. Dennis Kucinich (D-OH) is currently reading all 35 Articles of Impeachment, against George W. Bush, on the floor of the House of Representatives.

I'm on the radio for the moment, so see RAW STORY for details. I may have more soon.

UPDATE: Now back home, and watching Kucinich myself on C-SPAN. He's been reading for hours, and may have hours ahead still. As mentioned on the air, I was consulted for these Articles of Impeachment and submitted a number of suggestions and material concerning impeachable offenses related to election tampering by George W. Bush and his agents. Don't know whether those articles are still in the final version. We shall see. But I wanted to be sure to disclose that.

No doubt we'll be talking about this tomorrow on the PBC Show (which I'm Guest Hosting all week). We're trying to get Kucinich for tomorrow's show...if he still has any voice left.

FURTHER UPDATE: Looks like the election-related Articles of Impeachment made it into the final version, including a mention of GOP "voter fraud" sheister Mark F. "Thor" Hearne of front-group American Center for Voting Rights (ACVR). Nice to see Hearne get the recognition on the floor of the U.S. Congress that he so richly deserves.

STILL MORE: Reuters coverage notes Kucinich "defied his party leadership" in filing. AP incorrectly writes:

Kucinich introduced a resolution last year to impeach Vice President Dick Cheney. That resolution was killed, but only after Republicans initially voted in favor of taking up the measure to force a debate.

In fact, his Articles of Impeachment against Dick Cheney were not "killed," they were sent to the House Judiciary Committee, where they remain without action having been taken on them by the Dem leadership, despite best efforts by folks like Rep. Robert Wexler (D-FL), and others.

POST-ADJOURNMENT UPDATE: Just prior to midnight ET, Kucinich finally finished reading the list of High Crimes and Misdemeanors. Equal Justice Society writes:

"We've waited seven years to find one Member of Congress brave enough to stand up for our Constitution, for which generations of Americans have fought and died," said Bob Fertik, President of Democrats.com. "We are thrilled and honored that Dennis Kucinich has chosen to be that one genuine patriot. We congratulate him on his historic leadership, and pledge to do everything in our power to persuade Congress to adopt all 35 Articles and put George W. Bush on trial before the Senate of the United States, exactly as the Founding Fathers wanted."

"Some might question why Congressman Kucinich has done this now," continued Fertik. "My question is why 434 other Congress Members have not done it before. The Republican War on Voting continues apace.

In addition to the recent, outrageously bad decision by the Supreme Court to approve Indiana's draconian polling place Photo ID restrictions, sure to keep thousands of legal voters from even being able to cast votes in tomorrow's important Primary Election --- despite the state's inability to offer up a single instance of in-person polling place voter impersonation that's ever occurred during the state's entire history (as we've covered here, here and here, for example) --- another 1.1 million voters have now been purged from the voting rolls altogether, reports Bev Harris of Black Box Voting, as based on the Hoosier State's own data.

Moreover, the state will use unverifiable touch-screen style voting systems across the state. One widely used system, made by MicroVote, will be used despite having been decertified, and two other systems, made by ES&S and Diebold, have been found vulnerable to undetectable vote-flipping viruses by several reputable universities.

Art Levine at The American Prospect has a new must read piece titled, “The Republican War on Voting: Using the Department of Justice, friendly governors, and its usual propaganda outlets, the GOP has propagated the myth of voter fraud to purge the rolls of non-Republicans.” Here's a small taste of it...

"Sharrard's cautionary tone was a response to the Republican Party's ongoing nationwide campaign to suppress the low-income minority vote by propagating the myth of voter fraud. Using various tactics --- including media smears, bogus lawsuits, restrictive new voting laws and policies, and flimsy prosecutions --- Republican operatives, election officials, and the GOP-controlled Justice Department have limited voting access and gone after voter-registration groups such as ACORN..."

"Unfortunately, progressives have tended to pay more attention to Election Day dirty tricks and to electronic voting machines than to a more systemic threat: the Republican campaign to suppress the votes of low-income, young, and minority voters through restrictive legislation and rulings, all based on the mythic specter of voter fraud..."

"Unfortunately, the public hasn't heard just how nonexistent the voter fraud epidemic actually is. While progressives have successfully challenged some of the most restrictive laws in court, they're still playing catch-up when it comes to combating the glib sound bites of voter-fraud alarmists. The insidious nexus between phony GOP charges of "voter fraud" and the U.S. Attorney Purge scandal will finally be explored in a Senate Hearing on "In-Person Voter Fraud: Myth and Trigger for Disenfranchisement?" this Wednesday in Sen. Dianne Feinstein's (D-CA) Rules Committee. The complete witness list and press release from Feinstein's office, announcing the hearings, is posted at the end of this article.

Witnesses will include, among others, former NM U.S. Attorney David Iglesias, believed to have been fired for his unwillingness to bring phony voter fraud charges in the state despite pressure from folks such as Sen. Pete Domenici (R-NM), Rep. Heather Wilson (R-NM), and a representative of Republican operative Thor Hearne's now-defunct "American Center for Voting Rights," (ACVR) which The BRAD BLOG originally outed as a White House/GOP front group in a long series of investigative reports dating back to 2005, which began just after the supposedly non-partisan group (co-founded by two very high level White House/GOP operatives) first appeared on the scene...

Cites 'Widespread Reports' of Problems During Today's Primary, as Registration Issues in State After State Begin to Emerge

More voter registration problems. This time in Louisiana during today's Democratic Party Primary. From the Obama campaign website just after 7pm ET tonight...

BATON ROUGE, LA— The Obama campaign submitted an urgent request for assistance to the Secretary of State’s Division of Elections today, after receiving widespread reports from Democrats across Louisiana who reported that they were not allowed to vote because their party affiliation had been switched. Hundreds of Louisiana democrats went to the polls to vote in today’s presidential primary and found that they were now on registration lists as Independent or Unaffiliated voters.

For what it's worth, Obama reportedly won today's primary, but problems with voter registration rolls are quickly emerging this year as a huge problem in state after state. Our reporting from just the last week reveals problem after problem...

Georgia: Widespread bottlenecks for voters as problems occur with Diebold's new e-pollbook system and the state's new Photo ID restrictions. Voters waited in line for up to two hours in some places.

New Mexico: 17,000 (11%) forced to vote on provisional ballots in Democratic Caucus as previously registered Democrats find they are no longer on voter rolls recently privatized by voting machine company ES&S.

Arizona: We've begun receiving reports from voters and local officials of polling places where some 40% of voters were forced to vote on provisionals, after state registration system outsourced to ES&S. [UPDATE: One such report is now published here, from a poll worker who reports that of 1291 ballots cast at her polling place, 540 --- some 41% --- were forced to vote provisionally.]

California: Various reports of voters registered for one party to find they were switched to another, or not registered at all. Confusion about how to handle non-partisan voters in Los Angeles County leads to nearly 100,000 votes which may not be counted properly.

Many states are just now fully implementing new, statewide, computerized registration rolls as mandated by the disastrous Help America Vote Act (HAVA) of 2002. The systems are being outsourced to private companies in many states, and more and more Election Days seem to be turning into Beta Tests for the new systems...

Sources Suggest John Conyers May Move to Compel Testimony on Ohio Voter Suppression from Ohio Vote Suppressor J. Kenneth Blackwell...

Last week, Reps. John Conyers (D-MI) and Jerrold Nadler (D-NY), both of the U.S. House Judiciary Committee, sent a letter to the former Ohio Secretary of State and Co-Chair of the state's Bush/Cheney '04 campaign committee, J. Kenneth Blackwell, inviting him to appear next week at a subcommittee oversight hearing on voter suppression issues.

To the surprise of almost nobody, Blackwell has refused the invitation to testify, claiming his "schedule [would] not permit" him to attend the hearings.

The snub, according to both the following report from Jon Craig at the Cincinnati Enquirer and additional indications given to The BRAD BLOG by a Judiciary staffer other than the one quoted by Craig, may lead to an escalation of the longtime standoff between Conyers and Blackwell. A congressional subpoena requiring an appearance by the controversial former SoS, who presided over one of the worst-run Presidential Elections in American history, may well be in the offing.

As Craig reports today at the Enquirer's political blog...

Blackwell, a Republican from Cincinnati, said he received the invitation, "however, my schedule will not permit me to attend the hearings."

Jonathan Godfrey, a Conyers spokesman, said Blackwell has not responded and could be subpoenaed if he doesn't appear voluntarily.

"I don't think it's unlikely," Godfrey said today of a subpoena.

Though our own Judiciary source spoke to the same point, if not quite as directly, the comments above from Godfrey offer an additional indication that we may be headed to a showdown.

Such a subpoena would require a majority vote of the committee, which likely wouldn't come in time for the hearings currently scheduled for next Friday, according to Craig's report.

End of Year Letter Describes Plan to Identify, Challenge Voters in 2008...

"To date, the Kansas GOP has identified and caged more voters in the last 11 months than the previous two years!" brags Kansas GOP chairman Kris Kobach in his end-of-year letter.

Blue Tide Rising has the scoop, along with details on what "vote caging" is, for those who don't know by now. We should note, however, it's not immediately clear from Kobach's letter what exactly he means by his use of the term, and if he's referring to the illegal type of caging or not.

In any case, it's clear that the undemocratic (small "d") practice of working to keep Democratic (large "D") voters off the rolls, through any means necessary, in order to keep them from voting, through any means necessary, has been mainlined as perhaps the top strategy for the GOP in 2008. Even Bush's Dept. of Justice, under the hand of John "Minorities Die First" Tanner, has now been officially mobilized to direct such practices on behalf of the Republican States of America.

PBS Explores Many Of The Ways Republicans And The DoJ Are Working To Disenfranchise Democratic Leaning Voters

Will The 2008 Vote Be Fair? That was the topic addressed by host David Brancaccio and former Justice Department official David Becker on NOW last Friday. Part I (at left, 10:01) begins with a discussion of Photo ID laws to prevent the "invented problem" of voter fraud. The discussion continues at the 6:15 mark on the topics of voter caging and voter purging --- when the DoJ requires jurisdictions to purge their voter rolls when they do not match census estimates.

Part II (at right, 9:50) begins with Becker explaining how the Bush 43 Justice Department has subverted its traditional mission: "During about a five year span, not one single case was brought on behalf of African Americans in the Voting Section of the Civil Rights Division". Becker goes on to state that policies were established that favored Republicans and disfavored Democrats in an effort to "gam[e] the system" to retain power.

Next, Brancaccio and Becker explore how the U.S. Attorney scandal fits in to the bigger picture. Becker: "The DoJ, especially under Alberto Gonzales, was being used as an arm of the right wing of the Republican Party to effectuate partisan gains in elections". Finally, the program concludes with a discussion on voting machines and Florida's 13th District.

I am no longer a felon.

In brief, I became known to some as the "Diebold Whistleblower" when, in January of 2004, I stole and exposed legal documents [PDF] proving that Diebold Election Systems, Inc. was using and planned to continue using illegal, uncertified software in their California voting machines. (By the way, Diebold recently changed its name to Premier Election Solutions, but don't let that fool you; it's still the same bunch of idiots.) Details about my case can be found here and here [PDF].

The documents I stole were covered under attorney-client privilege, so my theft was a serious crime. In February of 2006 I was charged with three felonies. On November 20, 2006, I plead guilty to one felony count of unauthorized access to a computer, and in exchange for my guilty plea and a restitution payment of $10,000 to the law firm from which I stole the documents, the law firm promised they wouldn't bring a civil suit against me, and I was put on felony probation instead of being sent to jail. The term of probation was to be at least one year, and as much as three years.

Now, one year after my guilty plea, because I've stayed out of trouble and because I'm a first offender, the judge has reduced my felony to a misdemeanor. Sometime in 2008, my lawyers will petition the court to have my misdemeanor expunged.

The bad part is that the most troublesome aspect of my probation is still in force. Before I can accept a job at which I would use a computer networked to one or more other computers (basically any job for which I'd be qualified), any potential employer must write to the judge in my case, tell him that they know about my conviction and that they still want to hire me, and then we have to wait until the judge responds with a "yes" or a "no" before I can accept the job and start work (and then only if the judge says "yes"). So as you can see, employers will be falling all over themselves to hire me.

Yeah, right.

Meanwhile, my wife (an actor, filmmaker and writer) certainly hasn't lost her sense of humor. She had been calling me Felonious Punk, but now that I'm no longer a felon, she's switched to Mister Meanor. Ain't it great being married to a comedy writer?

To be clear, breaking attorney-client privilege is a very serious crime, and I accept responsibility for what I did. I'm still being punished for it, and so far the punishment has cost my wife and me over $210,000 - and counting. $210,000 is an enormous amount of money to us. My wife and I have paid and are continuing to pay a very high price for my crime.

But, as we're not Republicans, we might have expected that.

Which got me thinking about other crimes in America that have recently been committed or alleged, and what's happened to those involved. Among the first of many, Lewis "Scooter" Libby comes to mind...

'Please Send an E-Mail Explaining What Caging Is,' Requests Watergate Investigative Reporter During Online Chat

Apparently, one of the requirements for working as a reporter at the Washington Post is that you must remain as out of touch as possible with anything that matters.

According to ThinkProgress today, Watergate's investigative genius, Bob Woodward, smartly meets the requirements...

Earlier this week, Washington Post investigative reporters Bob Woodward and Jeff Leen hosted an online chat at washingtonpost.com. One of the participants asked Woodward and Leen how pervasive the voter suppression tactic known as "caging" is. The investigative reporters had no idea what it was:

Washington, D.C.: Don't you have a duty to report criminal activity to the appropriate authorities?

How pervasive is "caging"?

Bob Woodward and Jeff Leen: We publish what we can find and document. Many times over the years government authorities have pursued the information we have dug up and launched their own investigations. But we're trying to serve the readers, and we do not act as police or prosecutors. And please send us an e-mail explaing [sic] what "caging" is.

Woodward and Leen aren't the only Washington Post reporters who are clueless about caging. In a washingtonpost.com online chat with congressional reporter Jonathan Weisman in May, a questioner asked "why Congress didn't jump on Monica Goodling's testimony about caging." Weisman's response: "So what is this caging thing?"

So for all those Washington Post reporters out there, let's go over the facts again...

Measure, Co-Sponsored by 13 Dems, Would Prohibit 'Voter Supression' Tactic as Used in Florida in 2004 by Former Rove Associate, Interim US Attorney Tim Griffin...

Thirteen Democratic Senators have introduced a bill that would outlaw "voter caging," the practice of sending mail marked "Do Not Forward" to a targeted list of voters in hopes of using the returned mailings as a basis to challenge the right of the voters to vote.

The tactic was used by Republican operatives in both the 2000 and 2004 election, despite the Republican party having agreed in two consent decrees in 1981 and 1986 to end the practice.

A press release from Sen. John Kerry's (D-MA) office announcing the new bill is posted in full below.

"The practice of 'caging' is reprehensible and has absolutely no place in our democracy," Kerry says in the statement. "Here in America, every citizen, regardless of race, gender, religion or sexual orientation has the right to cast his or her vote. These are the very foundations of our democracy and this bill will ensure that we protect fundamental freedoms for millions of voters across our country."

The press release goes on to refer to evidence, much of it reported over the years here at The BRAD BLOG, of GOP vote caging that took place in important swing states such as Florida, Ohio, and Pennsylvania during the 2004 election. Kerry's statement also points out the re-emergence of the topic earlier this year, after former DoJ staffer Monica Goodling testified to a Congressional panel that information concerning the involvement of former Karl Rove associate and GOP opposition researcher Tim Griffin in voter caging had not been fully disclosed during previous Congressional testimony.

Goodling's revelations led to Griffin's sudden (and teary) resignation from his post as interim US Attorney in Arkansas, where he had been appointed by the DoJ under new provisions in the PATRIOT Act allowing such appointments without congressional approval.

The controversial practice of vote caging has been used primarily to target minority voters; evidence has shown that some who ended up on the caging lists were military personnel who were unable to return the mailings because they were deployed in Iraq and Afghanistan.

A DoJ investigation into Griffin's, and the GOP's, 2004 vote caging activities was then demanded by several U.S. senators last June. The American mainstream media have given little coverage to the issue of caging, despite original reporting from Greg Palast and the BBC prior to the 2004 Presidential Election.

In addition to Kerry, the original co-sponsors of the legislation include Senators Patrick J. Leahy (D-Vt.), Dianne Feinstein (D-Calif.), Russ Feingold (D-Wis.), Bill Nelson (D-Fla.), Sherrod Brown (D-Ohio), Amy Klobuchar (D-Minn.), Hillary Rodham Clinton (D-N.Y.), Sheldon Whitehouse (D-R.I.), Bob Menendez (D-N.J.), Barack Obama (D-Ill.), Charles Schumer (D-N.Y.), and Chris Dodd (D-Conn.)

UPDATE: Here's the actual bill [PDF]. Looks good from a quick read, though the part that allows the U.S. Elections Assistance Commission (EAC) --- a four-member commission appointed by the President, and which has proven tremendously inept and compromised in all manner of things --- to add new reasons why voters may be challenged is a concern. The EAC shouldn't be entrusted with anything, much less deciding criteria for challenging voters' right to vote. But that's just our knee-jerk opinion.
