GOP operative Caroline Hunter could face disbarment, according to first in series of investigative reports at RAW STORY

[Updated below with details on the second part of Jacobson's series, just posted at RAW STORY, in which he ties together Hunter's EAC appointment and dubious tenure, representing the RNC's nefarious "voter fraud" fraudster wing (which is to say, pretty much the entire RNC these days!) The second in the series offers important info and a good reminder of the names you'll be seeing again soon, singing the same old phony, discredited "voter fraud" songs once again as November nears, as sure as the sun rises in the East.]

Brad Jacobson has filed the first in a series of exclusives at RAW STORY concerning GOP operative and Bush-appointed FEC commissioner Caroline Hunter. [Disclosure: Jacobson has blogged at The BRAD BLOG in the past.] Here's the lede for his first excellent investigative report yesterday:

Caroline Hunter, a Bush-appointed Federal Election Commissioner who remains in office, provided misleading statements under oath in an effort to conceal Republican National Committee involvement in vote suppression activities during the 2004 presidential election, a Raw Story investigation has found.

Legal experts say Hunter's submission of such statements under oath is a serious ethical and professional breach which could warrant a bar review and potential disbarment. At the time, Hunter was serving as deputy counsel to the Republican National Committee.

The report goes on to detail how Hunter --- who, as The BRAD BLOG has highlighted over the years, had previously been allowed to serve as a commissioner on the U.S. Election Assistance Commission (EAC) --- deceptively misrepresented the facts, on behalf of the RNC, in a 2004 voter caging hearing in federal court.

Jacobson quotes election law experts, including two long-time former DoJ Voting Section attorneys, who argue that while the way she couched her sworn testimony may "shield her from perjury charges," the statements she gave may "still pose ethical problems that potentially could result in her disbarment."...

Justice slowly returns after the reign of John 'Minorities Die First' Tanner, and under a new Administration

While criticism of Obama and Democrats is as easy as it is appropriate (as well as frequently engaged in here), their failures on the marquee items --- Afghanistan, health care, torture accountability, etc., ya know, the items Fox "News" and the other wingnuts like to talk about --- tend to obscure the very real differences between the current administration and the former one across a broader, and much less sexy (by cable news standards), level. That's just one of the reasons I reject the far too lazy "Democrats are just the same as Republicans" knee-jerkisms.

While on the big ticket items, as noted above, there is far less difference in real world results than all of us would like, but below the radar, in executive departments and policies, the difference has been, at times, and in some areas, like night and day.

Desi Doyen and I have made this point on a number of occasions in our Green News Reports --- most recently in last Thursday's edition, highlighting new, important and aggressive policy changes and initiatives at the EPA, federal Bureau of Land Management (BLM) and the Dept. of Interior.

Now, some important changes at the DoJ's Civil Rights Division, and of particular note to long time readers of The BRAD BLOG, its Voting Rights Division, are beginning to show real change and significantly for the better, whether you hear about it on Fox and CNN and MSNBC or not.

Adam Serwer of The American Prospect highlighted some of that positive change late last week on the heels of an upheaval at the DoJ's Voting Rights Division over which The BRAD BLOG played a very direct and significant role in 2007....

Says Republicans likely tempted to 'keep qualified minority voters from casting their ballots'...

On the road and short on time, so forgive the lack of background... Politico tells the story --- though they fail to use the word "caging" because, well, it doesn't make the GOP look so great, and that's what the main interest of Politico seems to be in just about everything they do. They do, however, liberally use the Orwellian phrase "ballot security" instead, as the GOP no doubt appreciates.

These grafs from Politico, summarizing the RNC's rejected argument for moving to throw away the national consent decree they were forced to sign in the 80's, after getting busted caging minority voters from the voter rolls (illegally suppressing their vote) are rather amusing...

For various reasons, now seems a good moment to mention that The BRAD BLOG was honored this year with a prestigious Project Censored 2010 award for our coverage of the mysterious death of the GOP's IT guru Mike Connell. Connell, for those unfamiliar with the story (see background links at bottom of this article) was in the process of testifying about his rumored role in helping the GOP carry out fraud in Ohio's '04 Presidential Election when he was then reportedly threatened by Karl Rove. Weeks later he suddenly plunged to his death in a single-engine plane crash just before Christmas last year as he was preparing to land near Akron, on his way home from one of his frequent trips to D.C..

My colleagues Mark Crispin Miller and Larisa Alexandrovna and Muriel Kane were also honored by PC for their own coverage of the story.

Project Censored, based out of Sonoma State University, has been highlighting overlooked stories each year since 1976, and was recognized by Walter Cronkite as "one of the organizations that we should listen to, to be assured our newspaper and our broadcasting outlets are practicing thorough and ethical journalism."

In addition to our "Excellence in Investigative Journalism" award from PC this year, as highlighted in their annual "Top 25 Censored Stories for 2010," I was also asked to write a chapter on problems faced by voters in Election 2008 for this year's book, Censored 2010: The Top 25 Censored Stories of 2008-09.

On the eve of the Presidential election, facing an historic defeat, the Republican National Committee quietly filed a motion to dissolve an existing consent decree in which they’d agreed not to engage in voter caging or other types of voter intimidation. Since 1982, the RNC has been restricted from conducting so-called “ballot-security” measures that have historically been used to deter thousands of Americans—largely low-income and minority citizens—from voting. Now, the RNC wants to be free of these restrictions. A hearing on the RNC motion is scheduled for next Tuesday in the U.S. District Court for New Jersey.

The case began in the early 1980s when the Democratic National Committee sued the RNC for voter suppression tactics that targeted about 45,000 people in low-income and minority areas. The RNC subjected minority voters in New Jersey to misleading election notices, the intimidating placement of off-duty police around polling places, and the unlawful practice of “voter caging” whereby unfounded voter challenge lists are compiled from returned mass direct mailings.

The case, DNC v. RNC, resulted in a 1982 decree in which the RNC agreed not to engage in voter caging and intimidation activities or to target minority voters.

Despite the consent decree, the RNC began using similar tricks in Louisiana in 1986. Under the guise of fraud prevention, the RNC facilitated voter caging programs and other tactics. Commenting on the program, Kris Wolfe, the Midwest RNC political director, sent a memo to Lanny Griffith, the Southern RNC political director, saying “I would guess this program will eliminate at least 60,000 to 80,000 folks from the rolls…If it’s a close race…this could keep the black vote down considerably.” The DNC filed a contempt motion to reopen the case and enjoin the RNC from conducting the Louisiana programs. Once again, the RNC voluntarily agreed to a consent decree rather than fight the claims in court. The result was a 1986 decree [PDF] in which the RNC agreed not to do any ballot security programs anywhere in the country without prior court approval.

More than 20 years later, on November 3, 2008, the RNC moved to terminate the 1982 and 1986 consent decrees. The RNC claims the consent decrees hamstring their efforts to combat voter fraud, despite the fact that voter fraud is less common than death by lightning.

Well, they got the Supreme Court. Now's as good a time as any to get "official" permission to suppress the vote again. Beats winning by actually getting more votes than the other guys, I guess.

A draft summary of what I see as the most important, most doable, federal election reform priorities for 2009...

Okay, so I've been asked on several occasions, since the election last year, what I regard as the top priorities for election reform in the U.S. of A. In hopes of keeping it simple, stupid, at least until I hear opinions on these back from you folks, here is a summary list of the most important, and most eminently-doable-at-the-federal-level reforms as I see it.

I welcome your thoughts, recommended changes, additions, etc. For the moment, this is not meant as a comprehensive list of all needed reforms, particularly at the various local levels. But it's meant as a list of the big ones, as I seem them, and the ones for which I believe we could actually find a consensus in this Congress sooner rather than later. Nor is this meant as whitepaper with arguments and details for each item. But hopefully most regular readers of The BRAD BLOG will understand what these reforms entail and why they are necessary, as written in this summarized, simple list.

After hearing from you all, I may post an updated version later and/or set these up on their own page, in order track legislation for each of them as they roll (or don't) through Congress. Here's the list...

A deal was struck last evening in Colorado with the Secretary of State. 20,000 voters who were illegally purged from the state’s voter rolls will now be allowed to vote using provisional ballots and those ballots will get priority handling and a presumption of validity by Colorado counties.

The Reform Institute, a non-partisan public policy organization, today released a checklist to assist voters in casting their ballots. The checklist provides helpful tips for voters, especially those going to the polls for the first time, to facilitate a voting process free of complications....

After all these years, believe it or not, it was my first appearance on Amy Goodman's Democracy Now! this morning. I was happy to appear along with my friend Harvey Wasserman of the great Columbus Free Press to discuss our many concerns about Election Day 2008, touch-screen vote-flipping, voter roll purging, and the woeful effort by the DNC and Obama Campaign to take steps to correct these enormous problems. So happy, in fact, that I almost didn't mind waking up at 4am to do the show. Almost. I hope you'll not mind the fuzzy webcam I had to use from my dark, pre-dawn cave this morning during my appearance.

Even as Democrats Stay Mostly Silent While Thousands Are Illegally Purged from Voter Rolls...

Rightwinger Laura Ingraham ably filled in for Bill O'Reilly in the "No Spin Zone" this week, by seeing her argument dismantled by constitutional attorney, prosecutor, and former (Republican-appointed) special counsel to the U.S. Senate Judiciary Committee, John Flannery on Fox "News."

Ingraham just couldn't believe there would be "all these reports" on the news about "massive voter fraud going on" all over the country, led by ACORN, if they weren't all true! (As we showed both here and at UK's Guardian, it's not true. It's a GOP hoax. More at our special coverage page here.)

Despite being in way over her head, having fallen for the hoax, Ingraham, naturally, played the loyal dead-ender and stuck to her empty guns. (Gosh, we hope there are no typos on Ingraham's own driver's license or voter registration, or she might find herself purged from the voting rolls entirely this November, as they're doing in Florida and so many other state, not mentioned on Fox "News," or even by the Democrats.)

With 17 Days To Go, Myriad Voting Obstacles Faced by Tens of Thousands in Dozens of States
As Fox 'News' Discusses Just One Issue (and It's Completely Phony)...

See below for a rather breathtaking "Round-up of Problems Facing Voters Nationwide", such as registration backlogs, illegal voting roll purges, deceptive practices and dirty tricks, etc., now plaguing American voters across the country with just 17 days left before our country's biggest election ever.

All of that, while Fox "News" (whose asked me to come on live tomorrow, Sunday, at 2:40pm PT, btw, along with my old friend John Fund "for balance") continues to misreport, alarm and deceive their viewers in regard to the GOP's phony ACORN "voter fraud" fraud. Unfortunately, it's not just Fox who is irresponsibly and dangerously misreporting that scam --- though they seem to have made a small cottage industry out of it of late --- CNN and MSNBC have been filed loads of equally inaccurate and misleading reports on it as well.

But take a look at the "Round-up" below, sent this afternoon via email by the 866ourvote.org Election Protection coalition of non-partisan election watchdogs. And keep in mind that their summary below doesn't even mention the myriad electronic voting issues we've been reporting here of late --- touch-screen votes flipping, paper ballot electronic tabulators that can't count correctly or that add thousands of "phantom votes" or that drop thousands of real ones etc. --- cropping up, yet again, across the country...

We've been reporting on the GOP's October "Surprise" over the last few days (challenges to Democratic voter registrations in a number of states, and, perhaps more notably, their bogus PR campaign to charge that ACORN, a community organization that heroically registers millions of low-income voters who nobody else bothers to, is committing "voter fraud." See here, here and here, for example.)

But the November Surprise, as we've been trying to warn for many months (if not years), will undoubtedly be the thousands who show up to the polls to vote on November 4th, only to find out that they have somehow "fallen off" the voter rolls.

We've urged folks to check their registrations, even if they recently voted in a primary election, to make sure they haven't been purged (info on how to do that quickly in all 50 states, right here).

Late last month, CBS News reported on voter purges occurring in at least 19 states across the country, many of them swing states, naturally.

Today, the New York Times has published a scathing report, based on a detailed investigation revealing that "Tens of thousands of eligible voters in at least six swing states have been removed from the rolls or have been blocked from registering in ways that appear to violate federal law."

U.S. District Judge Donald Molloy spanked the Montana GOP's Executive Director Jake Eaton for his unsubstantiated (and since-withdrawn) challenge to 6,000 voters in Democratic-leaning counties yesterday, solely on the basis that they'd filed change of address forms within the last 18 months.

"In his zeal to protect what he sees as Montana's fragile democracy from these transient hordes," the Judge wrote in his order, in response to state Dems and even the Obama campaign who stepped up to challenge the out-and-out attempt at voter suppression, "Eaton ignored the very law that answers his challenges."

“One can imagine the mischief an immature political operative could inject into an election cycle were he to use the statutes, not for their intended purpose of protecting the integrity of the people's democracy, but rather to execute a tawdry political ploy," Malloy wrote.


"The timing of these challenges is so transparent that it defies common sense to believe the purpose is anything but political chicanery," he added before noting that the challenges clearly violate federal law, since they come so close before an election, and focused only on counties where Democratic-leaning voters live.

When we covered the Montana GOP's waving the white flag of surrender yesterday, in light of actually being challenged (for a change) by Democrats, we also noted that we hoped they would not drop their lawsuit, even as the bully-boy Republicans had decided to cut and run...

Faced With a Lawsuit by State Dems, the Republicans Wave White Flag of Surrender...

Last Friday, we told you about the bogus challenges --- 6,000 of them --- made by the Montana GOP against voters in six Democratic-leaning counties in the state, based solely on the fact that the voters had filed change of address forms with the U.S. Postal Service within the last 18 months. The GOP claimed, with a straight face, they were fighting "voter fraud", even though there was indications of no such fraud, and the result was little more than chaos at the election offices, just 30 days out from a major election.

One of the GOP's challenged voters turned out to be an Army Reservist who would be unable to verify his authenticity --- and thus would lose his right to vote under the challenge --- since he was in New Jersey, about to ship out for his second tour of duty in Iraq.

Well, we've got some good news on this story, for a welcome change...
