On today's BradCast we try to make sense of today's whiplash of dramatic breaking news --- first from a federal judge then from three federal agencies --- concerning the controversial Dakota Access Pipeline, before trying to make sense of still more breaking news concerning this November's elections. First up: An Obama-appointed federal District Court judge in D.C. hands down his ruling [PDF] denying a preliminary injunction that would have blocked construction of the Dakota Access Pipeline, as sought on Standing Rock Sioux sacred lands near their tribal reservation in North Dakota. Moments later, the U.S. Departments of Justice, Army and Interior issue a remarkable joint statement calling for a halt of the U.S. Army Corps of Engineers-approved construction at one federally controlled waterway and for a voluntary halt by the Dallas-based pipeline company on private lands within 20 miles.

We break down both the court's legal opinion and the federal government's encouraging directive, explaining the reasons behind both, as protests by thousands of native Americans continue to grow each day near the confluence of the Missouri and Cannonball Rivers in the southern part of ND.

Then, new polls find Hillary Clinton's lead over Donald Trump shrinking or disappearing fairly dramatically in four different key swing states. And the parties challenging the state of Texas' unlawful Photo ID voting restriction seek emergency court relief after state officials (including its indicted Attorney General) attempt to undermine a court-ordered agreement that is supposed to allow registered voters to vote, even without the strict Photo ID mandated by the illegal statute enacted by state Republicans.

In the meantime, a new study reveals, yet again, that the only type of fraud that could possibly be prevented by Photo ID laws remains virtually nonexistent in the U.S., while another major new study offers empirical historical evidence documenting how such laws drastically and disproportionately reduce minority and Democratic-leaning voter turnout.

Finally: Minnesota Democrats file suit at the state Supreme Court to have Donald Trump removed from the Presidential ballot, charging that Republicans failed to follow state law in their nomination process...

As some progressive Democrats freak out about Hillary Clinton's chances against Donald Trump, we're joined on today's BradCast by historian, author and broadcaster Jon Wiener to discuss his recent article detailing why he believes both math and history suggest Trump will be simply unable to win the Presidency this November. [Audio link at end of article.]

Wiener is a longtime friend and colleague at KPFK/Pacifica Radio here in Los Angeles, where he hosts the 4 O'Clock Report (airing right after The BradCast) on Wednesdays. His piece at The Nation, where he is Contributing Editor and host of the Start Making Sense podcast, is headlined "Relax, Donald Trump Can't Win". But is he right about that?

"My goal was to take a step back, to try to get a sense of the realities of things separate from our passions and our fears," he tells me, while explaining his case and the critical electoral math that undergirds it. Essentially, he argues, Trump must find millions of more Republican votes than Mitt Romney was able to scrape up in 2012. "It's very much of an uphill climb for [Trump] to find another 6 or 7 or 8 or 10 million people," particularly with the broad baggage that he has already accrued during the primary.

"There are very few people who switch from one party to another between elections," the UC Irvine history professor and author of How We Forgot the Cold War and Gimme Some Truth: The John Lennon FBI Files (and many others) explains. "Trump does claim that he's brought millions and millions of people into the primaries. But the people who looked at this closely discovered that Trump's voters in the primaries were Republican voters in the last general election. They're already committed Republicans. These are not new, first-time, never-before, non-voters --- these are Republicans. These aren't going to increase the Republican total. They've already been counted as Republicans in past elections."

So, even presuming his math is correct, what of a number of critical points that his analysis seems to simply overlook, such as voter suppression, other forms of election fraud, more "scandal" (phony or otherwise) for the presumptive Democratic nominee, and the possibility of Trump becoming a more disciplined candidate? Not to mention so many of the recent failures of pundits, pollsters and political scientists --- on which his case rests --- on everything from the GOP primary election itself to the recent right-wing populist victory in the UK's Brexit referendum?

On today's BradCast (link to complete audio below), Republican and Democratic leadership strike a deal to avoid defaulting on U.S. loan payments and to keep the government open for two years. But at what cost?

Financial journalist David Dayen of Salon joins us to explain both the grand deal and its cost to both Republicans and Democrats (though, arguably, much more to Democrats.)

"In general what this whole thing does is prevent a bunch of hostage-taking," on the part of Republicans, Dayen explains. "I think that is the real problem that the House Freedom Caucus [formerly the 'Tea Party Caucus'] has with it." Other than that, as he breaks it down for us, Republicans and war hawks seem to get a much better deal out of the bargain.

Democrats, while getting some much needed relief to arbitrary spending caps on several social programs, ultimately pay a price for cuts to Medicare and Social Security in this agreement, says Dayen. While Republicans, on the other hand, receive a huge $32 billion "slush fund" above and beyond anything Democrats get, in order to pay for more militarism under the bogus guise of "Overseas Contingency Operations".

"When we have homeless people that need shelter or poor people that need food for the food stamp program, then the answer is 'We're broke! We cannot pay for that! We're selling out our children's future! There's no way we can scrounge up any more money out of the couch cushions!," Dayen explains on today's show. "But when this little kitty that Pentagon generals want to use to protect their favorite program or build more weapons of any kind --- that we have plenty of money for, and if you don't like it you hate the troops and you're un-American."

All of that and much more detail to help you understand what's really going on in this deal and on one crucial point concerning the nation's debt ceiling that Dayen describes as "a total failure...by the leadership of the Democratic Party."

Today's BradCast is packed with news from top to bottom. Please buckle up before listening.

First, Big Oil's deceptive scam in California (as discussed on yesterday's show) has succeeded, for now, as Dems pull landmark legislation that would have called for a 50% cut in petroleum usage in the state.

Then, new polling finds Bernie Sanders overtaking Hillary Clinton now in Iowa, as well as New Hampshire, while the party's internecine battle over more debates continues. On the GOP side, candidates not named Trump are flailing as they desperately try to get attention. It's not working --- neither is their lost hopes of scuttling the Iran peace plan.

Next, author and national security correspondent Shane Harris joins us to discuss his disturbing new exclusive at The Daily Beast on 50 U.S. intelligence analysts now reportedly charging that the U.S. has been "cooking" its intel on ISIS.

The still-unnamed military intelligence analysts working for CENTCOM, as Harris explains, are reportedly seeing some of their own reports manipulated by higher-ups. "Key pieces of [their analyses] that they feel are very important [are being] taken out, not given the proper context, [and] in some cases making it look like ISIS and al Qaeda are weaker than these analysts actually believe they are."

So are these charges akin to the way intel on Iraq and WMD was manipulated by the Bush Administration in the 2002/2003 lead-up to war, as revealed by the notorious Downing Street Memos ("the intelligence and facts were being fixed around the policy")? Or are these claims more akin to the hyperventilation over unsubstantiated allegations from the Right concerning Benghazi?

Harris tells me his reporting suggests it is more likely the former than the latter, though it remains unclear who is behind the alleged manipulation of intel and how high up it might go, even if proven true. "What I think is notable is that these 50 --- actually 52 --- professionals who are doing this every day, to go against their bosses, to take this to the IG is a very bold move. They feel very strongly that they have a case," he explains. "I've never seen anything like this. Usually whistle-blowers are in ones and twos, but for a group of people en masse to complain like this is certainly unique in my experience as a reporter."

We discuss who may be behind the alleged "cooking" of the intel and whether President Obama or the White House is somehow directing all of this as the Bush/Cheney Administration was doing in the case of the manipulated intel on Iraq. We've got a big BradCast today, with on-the-ground reports from Ferguson, the huge Bernie Sanders rally in Los Angeles and an extended portion of an exclusive interview with Sanders himself.

First, we check in with Cassandra Fairbanks from our affiliate Sputnik News. She's in Ferguson covering the protests of the police killing of Michael Brown one year after his death and the birth of the Black Lives Matter movement.

Fairbanks was, incredibly, arrested yesterday while covering one of the demonstrations as a journalist. "They started arresting everyone," she tells me in detailing the incident. "I said, 'You know I'm press, and [the police officer] was like, 'I don't care, you're going to jail.' It was arrest first, ask questions later."

She also reports that white, militant rightwing protesters, openly carrying semi-automatic weapons in Ferguson, are being left alone by the St. Louis County police while local black protesters are receiving an entirely different treatment for the mere suspicion of being armed.

Then, 'feeling the Bern' in L.A. after 2016 Democratic Presidential candidate Bernie Sanders drew some 28,000 supporters to the L.A. Memorial Sports Arena out here last night, following only slightly smaller crowds over the weekend in Portland and Seattle where he also faced a small, but intense protest from self-proclaimed members of the Black Lives Matter movement.

We detail how Sanders' campaign appears to have deftly adjusted course in the wake of that and a similar protest in Phoenix last month, but how big questions about his foreign policy positions still linger for many progressives. (Our recent interview with author and peace activist David Swanson on that latter issue is back here.)

Former BradCast associate producer Margot Paez interviews Sanders supporters at the raucus L.A. event on the foreign policy questions, and then Nicole Sandler, of our affiliate RadioOrNot.com, presses Sanders himself on the matter in an exclusive interview!

"If you have an aggressive foreign policy, if you think the United States should have ground troops in the Middle East, if you think we should be engaged in perpetual warfare, well, then you're going to have a larger military budget," Sanders tells Sandler. "Needless to say, that's not my view. I think organizations like ISIS and al Qaeda, very dangerous organizations, have to be combated and have to be defeated. But it can't be the United States alone," he says.

He discusses, if somewhat vaguely, his position on aiding partners in the Middle East and argues that "we can make judicious cuts in military spending without harming our ability to defend ourselves."

While the "news" networks covered Donald Trump and his comments about John McCain all weekend, we cover a bit of what they did not on today's BradCast.

First, the climate crisis comes home, as two different climate change-related disasters on California and Arizona freeways over the weekend (one drought related, one flood related) were averted --- just barely.

Then, we're joined by Dr. Yosef Brody, president of Psychologists for Social Responsibility to discuss the disturbing new independent 542-page report [PDF] commissioned by the American Psychological Association (APA), confirming that top officials at the APA colluded with the Bush Administration to approve CIA and Dept. of Defense torture techniques after 9/11. The APA then spent the next decade covering it up and smearing the whistleblowers at Brody's organization.

The findings of the new report, and the scandal in its wake, has touched off a shakeup at the top echelons of the organization. The report by a former federal prosecutor reveals "a complete and utter failure of psychological ethics," Brody tells me. "What it's saying is that what we critics have suspected for about a decade now --- that senior [APA] staff have been currying favor with the Pentagon and the CIA, effectively facilitating torture. And to top it off, they've engaged in this very sophisticated, decade-long coverup."

It was all done, he explains, to protect the Bush Administration from legal liability for war crimes, allowing them to describe their "enhanced interrogation techniques," with the blessing of the APA, as "safe, legal, ethical and effective", when they were anything but.

"This is really about a culture of corruption at the top of the largest organization of psychologists in the world," says Brody, about the APA's complicity. "We're talking about war crimes here, ultimately. And we're talking about a health professional association!"

Then, some politics: First, #BlackLivesMatter protesters disrupt Democratic Presidential candidates Martin O'Malley and Bernie Sanders at the progressive Netroots Nation conference over the weekend. And then, can Al Franken be blamed for Donald Trump's controversial comments about the war record of John McCain? Maybe. I explain all of that on today's BradCast!...

Investigative journalist Tim Shorrock joins me on today's BradCast to discuss his disturbing new article at The Nation on "How Private Contractors Have Created a Shadow NSA: A new cybersecurity elite moves between government and private practice, taking state secrets with them."

It's an issue, as I note during the show, that is particularly troubling giving the history of my family and me being targeted by defense contractors in years past.

Shorrock, author of the book Spies for Hire: The Secret World of Intelligence Outsourcing, describes the unprecedented privatization of our national security apparatus and how "the public is badly misled by the media" during debates about intelligence policies when "former" intelligence officials are presented to the public as experts without disclosure of their continuing financial ties to the industry.

Plus: As the Republican Party continues to make itself irrelevant, progressive ideas are quickly becoming mainstream ideas and Democrats like Hillary Clinton and Bernie Sanders are eager to capitalize on it. And, speaking of irrelevance, GOP 2016 candidate Rick Santorum attacks the Pope(!) for daring to speak up about saving humanity by taking action on global warming...

Rep. Hank Johnson (D-GA-4) returned to The BradCast today to take a bit of a victory lap after President Obama's Executive Order this week restricting the flow of heavy armaments from the Dept. of Defense to state and local police via the Pentagon's 1033 program.

Johnson spoke with us most recently last summer, after Ferguson blew up, and as he was preparing to file his "Stop Militarization Law Enforcement Act of 2015" [PDF]. Long before that, he had been working to roll back the obscene militarization of our local police. So he was justifiably happy about this week's development, even while explaining that its still important to pass his legislation because Executive Orders are easily undone by Congress and Republicans are, somewhat schizophrenically, in the process of actually trying to expand the 1033 program.

Then we cover a spate of new voting laws working their way through statehouses around the country from TX to OH to NH to FL to VT to MD. While most off the new laws in Republican states are predictably restrictive and in Democratic states more expansive, there is one pleasantly surprising exception to that rule this week.

Also, millions of spiders falling from the skies in Australia! And Desi Doyen joins for the latest Green News Report, which actually includes a some encouraging good for a change!...

Most of the attention that will be paid today to this interview by NBC's Savannah Guthrie will, no doubt, focus on Sen. Rand Paul's dismissive and somewhat condescending treatment of the female Today anchor. It does echo, after all, a similarly condescending and arrogant tone he struck last February during an interview with CNBC's Kelly Evans when he, literally, "shushed" her and told her to "calm down a bit", as she asked him uncomfortable questions.

But what caught my eyes and ears in this latest video (posted below) was something else entirely. And it's something which reflects far more poorly on Guthrie and the corporate media in general than it does on the junior Senator from Kentucky and now 2016 Republican Presidential candidate.

While it's true Paul appears to have trouble dealing respectfully with female interviewers and is now wildly reversing many of his previously strongly held foreign policy positions in hopes of wooing GOP voters, it's the mindset behind Guthrie's opening question which disturbs me far more. And it's one that we've seen before in the supposedly "mainstream" media...

Attorneys for U.S. Congressman Mark Veasey (D-TX) and other plaintiffs have filed an Emergency Application[PDF] with the U.S. Supreme Court, seeking to restore a lower court ruling that struck down the law last week as intentionally discriminatory and an unconstitutional poll tax. That initial U.S. District Court ruling was subsequently stayed by the 5th Circuit Court of Appeals earlier this week.

Veasey's application was followed by the filing of another Emergency Application [PDF] by the United States Department of Justice (DoJ). Both were filed with Justice Antonin Scalia who oversees the 5th Circuit. Scalia has instructed the DoJ to respond by 5p ET on Thursday.

Both applications to SCOTUS were filed in the case of Veasey v. Perry in which a U.S. District Court, after a full trial on the merits, imposed a permanent injunction, preventing the State of Texas from implementing the nation's strictest photo ID law, Senate Bill 14 (SB 14).

The District Court determined that, if implemented, SB 14 could disenfranchise more than 600,000 registered Texas voters who are disproportionately black and Hispanic. The District Court not only ruled that SB 14 violated the U.S. Constitution, the Voting Rights Act (VRA) and amounted to an unconstitutional poll tax, but expressly found that it was passed as the result of deliberate and willful racial discrimination.

The emergency petitions ask that the Supreme Court lift the U.S. 5th Circuit's 11th hour stay of the injunction so as to prevent electoral chaos and confusion in the rapidly approaching November election. In the first petition, the Veasey plaintiffs argue that what the 5th Circuit did in this case --- stay a permanent injunction that was issued on the basis of a District Court finding of intentional discrimination after a full trial on the merits --- was "virtually unheard of" in the annals of American jurisprudence.

Plaintiffs contend that the 5th Circuit misapplied a leading Supreme Court case, Purcell v. Gonzalez [PDF] (2006) pertaining to the issuance of injunctions on the eve of a pending election. That case does not, as the 5th Circuit ruled, mandate a per se rule that always precludes changing a law immediately prior to an election. The DoJ contends that no such per se "rule exists, and the court of appeals clearly and demonstrably erred in failing to apply the established stay factors."

Instead, plaintiffs forcefully argue, "The Purcell principle", mandates that an appellate court give deference to the factual findings of the District Court. The 5th Circuit, they add, erred by ignoring the requirement of Purcell that Texas prove it would likely succeed on an appeal. The 5th Circuit also erred, they say, because it failed to balance the state's allegations about possible confusion that might ensue from implementing pre-SB 14 law against the "actual" confusion, chaos and mass disenfranchisement that the District Court, based upon uncontested evidence, concluded would occur if SB 14 is enforced in the November 4th election (early voting begins in TX on October 20th).

"Imagine that a state passed a law, six months before an election, stating that 'Negroes cannot vote,'" the plaintiffs write. "It would be ludicrous for an appellate court to turn around and stay that injunction because of some per se rule that election laws can never change immediately prior to elections"...
