Today on The BradCast, voters are fighting to cast their vote, as voting machines, election officials and GOP suppression efforts continue to work against them. [Audio link to show is posted below.]

The RNC may now be facing another 8 years of court-ordered restrictions against targeting minority voters, as the DNC files to have a federal Consent Decree from the early 80s extended, charging that the RNC and Trump campaign have colluded to unlawfully suppress the vote through so-called "ballot security" schemes and other intimidation tactics.

In the meantime, confidence in accurate election results is plummetting nationally and voter suppression seems to be working against voters in North Carolina, where early voting has been shortened in many counties and some voters --- including a 100-year old African-American woman --- are finding themselves threatened with being purged from the rolls after being challenged by Republican "caging lists".

In Wisconsin, Democratic lawmakers are begging the U.S. Dept. of Justice to send poll monitors after the state's GOP Photo ID voting restrictions are said to be resulting in havoc, confusion and disenfranchisement.

In Texas, Georgia, North Carolina and Illinois (so far) 100% unverifiable Direct Recording Electronic (DRE, touch-screen style) voting systems are reportedly flipping votes from R to D and from D to R and, once again, election officials are blaming voters, rather than themselves.

Also today: Militarized troops in North Dakota clear out Dakota Access Pipeline protesters near the Standing Rock Sioux reservation and the owners of the pipeline are revealed to be big Trump funders while the GOP nominee is revealed to have large stock holdings in the companies that own it; The Yale Record does "not" endorse Hillary Clinton and neither does Libertarian Party Veep nominee Gov. William Weld (wink); and Desi Doyen joins us to "blame the cows", among other things, in our the latest Green News Report...

On today's BradCast, as a major, mysterious automated Distributed Denial of Service (DDoS) attack took huge Internet sites like Twitter, Netflix and Amazon offline for hours today, Democrats and Republicans, including the President, continue to mislead the public about the vulnerability of our voting, tabulation and voter registration systems. [Audio link to show posted below.]

Just weeks ago, as you'll recall, the U.S. Departments of Justice and Homeland Security were warning of the vulnerability of U.S. election systems to intrusion, manipulation and attack from outsiders (and all but ignoring the more direct threat from election insiders). Now, as Donald Trump has ramped up his claims that the election is being "rigged", Democratic and Republican officials alike are claiming the opposite is true, that "there's no way to rig an election in a country this big". They are either misinformed or lying. Take your pick. Either way, they are misinforming the American people. I explain in detail on today's show.

Speaking of disrupting the election...

• "Unnamed intelligence officials" float yet another warning of how bad actors could cause havoc during the elections in November. (And recent evidence suggests that route would be quite easy.)
• A federal court ordered Ohio this week to allow millions of unlawfully purged voters to be allowed to cast a provisional ballot this November, after the state's Republican Sec. of State Jon Husted (who also claimed this week that the election can't be rigged) fought an earlier court order to restore those voters to the rolls;
• Republicans in Tarrant County, Texas may have violated a federal court order by targeting Democratic polling places with an "EMERGENCY VOTER FRAUD ALERT";
• The state of Utah (Utah!) has been moved into the toss-up category in the Presidential contest;
• Early voting numbers look promising for Democrats;
Evidence that Donald Trump loved both Bill and Hillary Clinton very recently...at least until he ran for President, started losing "big league" and decided she was a "nasty woman";
• And, finally, the GOP Presidential nominee offered a little noticed admission during the final debate that Democrats have been right all along the necessity of regulations on businesses.

The insane 2016 Presidential campaign took a decidedly dark turn on Sunday night. We cover all of that darkness and more on today's BradCast. [Link to audio posted below.]

After a weekend of seeming implosion by the GOP nominee and the Republican Party on the heels of the release of a 2005 'hot mic' video tape in which Donald Trump is seen and heard lewdly boasting about sexually assaulting married women and others, he lashed out at Hillary and Bill Clinton on Sunday night, with a press conference (of sorts) featuring women allegedly assaulted by the former President during the 80s and 90s.

All of that and more came up during the 2nd Presidential Debate held on Sunday night at Washington University in St. Louis, Missouri. I'm joined on today's show for coverage, analysis and insight on what is almost certainly one of the darkest chapters in modern U.S. Presidential political history by former CNN journalist and communications strategist Jacki Schechner and progressive policy advocate Dave Johnson, Senior Fellow at People's Action (formerly: Campaign for America's Future.)

"I feel like there's this feeling of that old story of the frog that's getting warmer and warmer and warmer. Well, we're boiling. And everybody is suddenly noticing that the water's boiling right now," Johnson says in response to my question about how America and the Republican Party have arrived at this point (which I'm more than happy to blame, in no small part, on the corporate media and its decades long failure to report what has been going on in our politics over the last several Presidential Administrations as anything much more than both-sides-do-it politics-as-usual). "This has been coming for a long time. Donald Trump is the Republican Party right now. He's nothing more than the manifestation of something that's been building up and building up, and now we're at a reckoning point," he says.

Schechner notes: "While we think, in the moment, that, 'this will be the straw that breaks the camel's back', the camel gets up again on Monday morning and keeps on trotting. I don't know if it's because of the nature of where we are societally, or if it's just that we've gotten so disgusted with politics, that we're so deep in the mud we can't even see where the mud begins, but we're totally desensitized to where this has gone and where the Republican Party has taken us."

As we struggle to try and make sense of Sunday's debate, Trump's behavior, and where all of this can possibly go from here, Schechner observes: "Trump has been this person his whole life. The Republican Party broke him, they bought him. Clinton herself is a flawed candidate, [but] she's not a sociopath. The problem is that she has to figure out a way to combat him and not get down in the dirt with him, and at the same time mitigate the damage that exists, based on her own somewhat flawed political past."

Yeesh. Lots to talk about and lots to cover on today's BradCast...

On today's BradCast, with just one month to go before Election Day, the fight to vote continues in key swing states like Wisconsin, Ohio and Florida, where millions have been displaced due to Hurricane Matthew on the final weekend before the voter registration deadline.

As the deadly storm sweeps up the Florida coast, knocking out power and leading to evacuations across the state, Florida Gov. Rick Scott (R) refuses to extend the state's voter registration deadline, despite major registration drives planned for this weekend forced to be cancelled due to the state emergency and (perhaps because of) the fact that 50,000 voter registered during the same last minute time-frame in 2012. (Meanwhile, in GOP-leaning South Carolina, Republican Gov. Nikki Hailey has extended the deadline in her state.)

In Wisconsin, voter suppression continues as the state's lie to a federal court about the availability of Photo IDs at DMVs continues to disenfranchise 90-year old women and many others, and, thanks to a new law by state Republicans, thousands of absentee ballots are now at risk of being tossed altogether in the Badger State.

In Ohio, absentee ballots and provisionals are being tossed out for technical reasons in urban areas but not rural areas, and a federal appeals court has, once again, declined to take action. All of that while Trump and Republicans continue to lie about non-citizens voting and as the U.S. Dept. of Justice, for the first time in 50 years, will be unable to deploy hundreds of polling place monitors in states with a history of racial discrimination, thanks to the 2013 gutting of the federal Voting Rights Act by the U.S. Supreme Court.

Finally, in 2008, young Jewish voters worked to turn out their elderly Jewish grandparents for Barack Obama in Florida. In 2016, as a new video illustrates, the tables have somewhat turned...

On today's BradCast, the savior of the working class and "Great Negotiator" refuses to even sit down with union workers at his own property in Las Vegas, even as his party comes apart at the seams and the South-Eastern U.S. buckles up for another deadly storm. [Audio link posted at bottom of article.]

In advance of tonight's Vice Presidential debate, we speak with Bethany Khan of the UNITE HERE Culinary Workers Union Local 226 in Nevada, where workers at the Trump Hotel Las Vegas voted to unionize last December. Nonetheless, the Trump Organizations has refused, to date, to even begin negotiations with some 500 now-unionized workers at his 1,200-room, 64-story five-star luxury tower in Sin City. The union is therefore calling for a North American boycott of all Trump properties (hotels, casinos, golf courses, etc.), using the hashtag #BoycottTrump.

Khan explains the action and how the GOP nominee for President has been using every available tool to challenge the lawful union vote, despite claims to represent the working class in the course of his campaign.

"Mr. Trump and his company is legally required to bargain with the Culinary Union and with the workers. The workers are fighting for fair wages, job security, good health benefits," she tells me. "They filed a series of objections --- the way the vote was counted, or who voted --- a host of things to try and tie this up in court. This practice of expansive litigation is one the union workers have beat --- soundly --- and we won. So there are no more objections they can file on the election. The hotel is certified as a union hotel. It's a union property. The only thing that's missing is a union contract."

While the Culinary Workers have endorsed Hillary Clinton, Khan says their organizing campaign started "before Donald Trump announced he was running for President," but adds that "The path to the White House goes through the Las Vegas Strip."

"There are 550 workers in his hotel here in Nevada. They're working people, living paycheck to paycheck. Culinary Union members comprise a majority of the middle class in Nevada. Mr. Trump, who says he wants to make America great again, has a great opportunity to start here in Las Vegas with his workers and give them a contract."

On today's BradCast, the public reaction to Donald Trump and Hillary Clinton's performance at the first Presidential debate --- from polls, betting markets, newspapers and listener callers (lots of them!) [Audio link for show posted below.]

After some breaking news today (on the elementary school shooting in South Carolina and the Congressional override of Obama's veto of a bill allowing 9/11 victims to sue Saudi Arabia), and a story on the "not a terrorist" lawyer dressed in Nazi paraphernalia who injured 9 in Houston this week with legally purchased semi-automatic weapons (including a sub-machine gun and 2,600 rounds of ammo), we turn to the fallout from Monday's "Trumpwreck" of a Presidential debate.

The face-off broke the all-time viewer ratings record for a Presidential debate and early indications suggest the GOP nominee is likely to take a big hit in the polls (here's one in which he came in third in a two-person debate!), though there remain two more debates and a number of other reasons for Democrats to not rest easy just yet.

Also, another major Right-leaning newspaper endorses the Democratic Presidential candidate for the first time in their 126-year history and then callers ring in --- and boy howdy, do they! --- with their thoughts on what the world witnessed from Hofstra University on Monday night...

Then: as we struggle (along with the rest of the media) with the difficulty of how to appropriately and effectively and accurately cover the dangerous threat to our nation and world known as Donald Trump, David Farenthold offers a new scoop at Washington Post on how the GOP Presidential nominee unlawfully used his supposed charitable foundation (comprised of other people's money) for "self-dealing" --- essentially, as a slush fund to get his businesses out of legal trouble.

On today's BradCast, yes, Donald Trump even lied about 9/11. And, speaking of lies, Big Oil has been using a loophole in U.S. federal law to to skirt environmental concerns and receive quick approval for dirty, dangerous new pipelines.

First, as the media continue to ignore one of the worst and most expensive environmental disasters in U.S. history last month, Trump was busy lying about 9/11, even on the 15th anniversary of the attacks. He lied about why he received taxpayer money after the tragedy and suggested he personally removed rubble. Imagine, just imagine, what the media would have done to Hillary Clinton (appropriately) had she falsely suggested anything even close.

The corporate media's false equivalency between the two candidates continues, as facts concerning stuff like Colin Powell's very specific directions to Clinton on how to use a private email address as Secretary of State are overlooked, and as both national and state polling continues to tighten in the bargain.

Then, speaking of issues ignored by the corporate media, investigative environmental journalist Steve Horn of DeSmogBlog joins us to discuss the little-known federal permitting policy called "Nationwide Permit 12" --- a loophole in federal law increasingly used by the oil industry to fast-track federal approval for major pipeline infrastructure projects like the Dakota Access pipeline in North Dakota, and as a way to skirt more stringent federal environmental review in the process.

"Nationwide Permit 12, before the past three or four years, was generally and exclusively used for small projects, usually 1/2 an acre in size and smaller," Horn tells me. "It wasn't really until the Keystone XL debate, and in particular the southern leg of it, where the industry saw Nationwide Permit 12 as a convenient way to split up its pipelines into many, many, many pieces. Sometimes, in the case of Keystone XL, it was some 2000 segments that they called 'single and complete projects'."

"You can call it a loophole, you can call it a fast-track trick, a maneuver. For all intents and purposes, it's like the pipeline industry's equivalent of a tax loophole. And, looking at what billionaires do, it serves the equivalent for the pipeline industry," he explains. Given those in the fossil industry who are now publicly supporting the scam --- including the industry billionaire who Trump has said he may tap as his Secretary of the Dept. of Energy --- Horn's analogy is disturbingly on point. The good news, however (and we could use some today!): the scam is now under federal review after its use to approve construction of the Dakota Access Pipeline. That controversial project, which, as of Friday, was at least temporarily halted by the Obama Administration, may finally "have been a tipping point for use of Nationwide Permit 12," Horn notes.

Finally, some listener mail on a recent program seems to blame voters for the failure of politicians. We discuss.

Also: Texas undermines court-ordered remedy to unlawful Photo ID law, new studies reveal (again) how such laws undermine democracy...

On today's BradCast we try to make sense of today's whiplash of dramatic breaking news --- first from a federal judge then from three federal agencies --- concerning the controversial Dakota Access Pipeline, before trying to make sense of still more breaking news concerning this November's elections. [Audio link to show posted below.]

First up: An Obama-appointed federal District Court judge in D.C. hands down his ruling [PDF] denying a preliminary injunction that would have blocked construction of the Dakota Access Pipeline, as sought on Standing Rock Sioux sacred lands near their tribal reservation in North Dakota. Moments later, the U.S. Departments of Justice, Army and Interior issue a remarkable joint statement calling for a halt of the U.S. Army Corps of Engineers-approved construction at one federally controlled waterway and for a voluntary halt by the Dallas-based pipeline company on private lands within 20 miles.

We break down both the court's legal opinion and the federal government's encouraging directive, explaining the reasons behind both, as protests by thousands of native Americans continue to grow each day near the confluence of the Missouri and Cannonball Rivers in the southern part of ND.

Then, new polls find Hillary Clinton's lead over Donald Trump shrinking or disappearing fairly dramatically in four different key swing states. And the parties challenging the state of Texas' unlawful Photo ID voting restriction seek emergency court relief after state officials (including its indicted Attorney General) attempt to undermine a court-ordered agreement that is supposed to allow registered voters to vote, even without the strict Photo ID mandated by the illegal statute enacted by state Republicans.

In the meantime, a new study reveals, yet again, that the only type of fraud that could possibly be prevented by Photo ID laws remains virtually nonexistent in the U.S., while another major new study offers empirical historical evidence documenting how such laws drastically and disproportionately reduce minority and Democratic-leaning voter turnout.

Finally: Minnesota Democrats file suit at the state Supreme Court to have Donald Trump removed from the Presidential ballot, charging that Republicans failed to follow state law in their nomination process...

On today's BradCast: As several polls tighten in advance of the Presidential election, the FBI issues a new warning to states about voting system intrusion and last minute battles continue in federal courts over voting rights access to the polls.

First up, a new report today from investigative journalist Michael Isikoff warns of recent intrusions, believe to be by foreign entities, into voter registration systems in both Illinois and Arizona. The report cites an "FBI Flash" warning [PDF] from its Cyber Division, recently issued to state election officials in hopes of warding off similar intrusions to electronic registration and voting systems in advance of the November election.

The latest news on the completely foreseeable vulnerabilities in our voting and registration systems underscores (yet again) what we've been warning about for so many years at both The BRAD BLOG and The BradCast. Unfortunately, as usual, reporting on this issue from mainstream corporate media comes too late to make much of a difference before the next election, after which the warnings are likely to be all but forgotten...until just before the next election.

Then, BradBlog.com's long-time legal analyst, attorney Ernest A. Canning joins us for an update on the roller coaster-like voting rights battles still waging in federal courts across the country, including the latest disturbing news on Photo ID voting restrictions in Wisconsin and why something known as "The Purcell Principle" will, once again, play a key role in all of those legal fights this year.

Canning, who also wrote about the just the latest example of GOP "voter fraud" hypocrisy over the weekend, summarizes the latest dispositions in a number of key court fights against racially discriminatory Photo ID voting restrictions in Wisconsin, Texas and North Carolina, and related legal battles over access to the polls in states such as Kansas, Arizona and the swing-state of Ohio. All of those cases are likely to have an impact on results up and down the ballot this year.

Guest: Carl Takei of ACLU's National Prison Project...

Shockingly good news on today's BradCast, following today's remarkable announcement by the U.S. Dept. of Justice that they are working to end the federal government's "use of privately operated prisons".

After that, you may want to pop up some popcorn to best enjoy the rest of today's program. [Audio link to complete program is posted below.]

First up today, Deputy Attorney General Sally Yates issued a memo, as Washington Post reported, instructing federal officials "to either decline to renew the contracts for private prison operators when they expire or 'substantially reduce' the contracts’ scope. The goal, Yates wrote, is 'reducing --- and ultimately ending --- our use of privately operated prisons.'

Wow. Her memo goes on to cite a recent DoJ Inspector General's report finding that privately run prisons do not provide same level of service, "do not save substantially on costs" and "do not maintain the same level of safety and security" as those run by the federal government's Bureau of Prisons.

I am joined by Carl Takei, staff attorney for the ACLU's National Prison Project, for both an explanation and a bit of a victory lap after his organization and others have spent decades taking on the private, for-profit prison industry. Takei details what the announcement means, why it has finally come about now, and how the ACLU and others --- including investigative reporters, the Bernie Sanders campaign, and eventually the Hillary Clinton campaign --- have long argued precisely what the DoJ has admitted today.

"Handing control of prisons over to for-profit companies is a recipe for abuse, neglect, and misconduct because their primary duty is to their shareholders. They have to deliver value to their shareholders by skimming a profit off of whatever payments the government gives them to run the system," Takei tells me.

"In the 1990s, when the Bureau of Prisons first started this experiment with private prisons, the argument was they could provide incarceration more cheaply and that the innovations of the free market would somehow make things better. In fact, it turned out to be far worse. Because the major way that you can make money off incarceration is by cutting expenses," he says. "Some of the biggest expenses are security staff, medical staff, and providing medical services. Anywhere that the company starts cutting back its expenditures, it ends up harming the people inside."

He goes on to offer some startling examples of both that and of some of the easily-disproven responses and claims of the for-profit, private prison industry lobby.

Next, we look at how the coming and/or current GOP Civil War is shaping up not as a battle of ideas for the party's future, but as a wingnut street-fight over whose false version of 'reality' will win out. It's getting quite ugly. But also, at least for those of us on the outside, kinda hilarious in several regards.

Then, Desi Doyen joins us for the latest Green News Report, with "some news that blows" and, finally, we close with the NYC Parks Department hilariously short response to the growing erection of naked Donald Trump statues around the city. You're welcome.

It's a very 'green' show on The BradCast today, on a number of levels, from marijuana policy to the Green Party Presidential candidate's position on environmental issues, to another rather disturbing Green News Report.

But first up today, some news about 'third-party' Presidential candidate troubles getting on the ballot and being kept out of Presidential debates, and a Republican governor who has now vetoed a law that would have added millions of voters to the rolls in his state.

Then, Michael Collins, Deputy Director for the Drug Policy Alliance's Office of National Affairs in Washington D.C., joins us to discuss the recent announcement by the U.S. Drug Enforcement Agency (DEA) that it will not reclassify marijuana from its current 'Schedule I' narcotic status --- which, like heroin means that it's classified as having "no accepted medical use" --- despite some 25 states which currently allow its sale and use for either medicinal or recreational purposes.

Collins explains what that classification actually means and how rescheduling it as a Schedule II drug wouldn't have been much more than a "symbolic victory" for proponents, particularly "in terms of prosecutions --- people getting arrested, the racial disparities we see because of the war on marijuana --- that would not have disappeared had the DEA rescheduled marijuana."

He goes on to describe the DEA as a "rogue agency", "rotten to the core", and long working against President Obama's "steps to unwind the war on drugs". "They're still fighting the drug war of Ronald Reagan and Richard Nixon," he tells me, in opposition to the advocacy of a number of elected Democratic (and even Republican) officials in Congress who were furious at the federal agency's decision.

"I think the DEA gets its science from the same people as climate change denialists," Collins quips. "To say that marijuana has no recognized medicinal value contradicts decades of scientific research and is a huge slap in the face to the thousands of people who use medical marijuana every day to alleviate their illnesses."

It's not all bad news, however. Collins notes that the DEA has announced they will allow an expansion of federal marijuana research facilities, ending what had been a monopoly, with just one facility in Mississippi, and that states are moving forward nonetheless, with expansive pot initiatives on the ballot in at least six states (California, Arizona, Maine, Nevada and Massachusetts) this November. "The question isn't 'Should we legalize marijuana?', but more 'When should we legalize marijuana?' The end is nigh," he tells me.

On today's BradCast we'd be delighted to NOT cover Donald Trump. But, frankly, as annoying as it is, that would be journalistic malpractice for a number of reasons. We discuss the journalists' dilemma in covering Election 2016, and try our best to otherwise focus today on substance that both matters and is otherwise being ignored by the corporate media amidst the madness. [Audio link is posted below.]

To that end, the U.S. Dept. of Justice investigation of the Baltimore Police Department in the wake of the 2015 Freddie Gray killing sets off troubling, if all too familiar, alarm bells. Nonetheless, the findings represent yet another success of the Black Lives Matter movement.

Then Carroll Muffett of the Center for International Environmental Law (CIEL) joins us to discuss startling new revelations from their "Smoke & Fumes" investigation detailing a treasure trove of old tobacco industry documents illustrating that Big Oil did not, in fact, model their decades of science denial after Big Tobacco. As it turns out, it was Big Tobacco who lifted their playbook from Big Oil!

Over the past year we've covered the explosive discovery of company documents revealing that Exxon knew of the dangers of man-made climate change from the burning of fossil fuels as early as the 1970s, and began secretly funding climate science denial organizations not long thereafter. But CIEL's new investigation now details how some 100 recently-noticed documents unearthed from among 14 million at the Tobacco Archives (a public University of California website database of industry documents made available via U.S. smoking and health litigation) offer jaw-dropping revelations suggesting Big Oil's anti-science scam actually began as long ago as the late 1940s. That work resulted in collusion with the tobacco industry in the 50s, to seemingly help avoid accountability and legislation --- no matter the cost to the public --- that might cut into profits for both industries.

"The [tobacco industry's] 'Smoke and Fumes Committee' had its genesis in the oil industry's efforts to respond to bad press, bad science, and the risk of regulations resulting from the L.A. smog crisis of the late 1940s and early 1950s," Muffett explains. "So, in late 1946, a group of oil industry executives came together and decided that they needed to create a joint effort to fund pollution science, and then combine that pollution science with an active PR effort that was designed to shape the public's opinion on the science related to environmental issues and air pollution issues."

"The tobacco companies themselves, when they were looking at how to develop their own deception campaigns around smoking, looked again and again and again to the oil industry for people, for models, and even for advice," he tells me, describing what has been found in the documents so far. "The links between the industries were far more extensive than we ever anticipated. What was truly novel in what we found was that it's not that Oil is the new Tobacco but that Tobacco was at one time the new Oil."

We go on to discuss how the recent discoveries are likely to effect ongoing investigation and litigation into ExxonMobil's deceitful practices by more than a dozen state Attorneys General; the "completely unprecedented" nature of U.S. House Republicans on the Science Committee attempting to intimidate those AGs and environmental groups with subpoenas; and the accompanying irony of the fossil fuel industry attempting to hide behind constitutional First Amendment protections for fraudulent practices (a tactic which failed when Big Tobacco used a similar defense during litigation in the 80s and 90s.)
