Computer Programmer-Turned-Congressional Challenger's Accusations Reported in Detail, Including New Points in the Mysterious Death of Case Investigator Raymond Lemme
Feeney's Camp Refuses to Answer Allegations or Take Lie Detector Test, But Manages to Smear Curtis Anyway...
By Brad Friedman on 9/25/2006 11:56am PT

Bill Stone of the Tampa Bay Scene writes a devasting and detailed cover story in this week's issue, on the allegations of computer programmer Clint Curtis that Congressman Tom Feeney (R-FL) asked him to create vote-rigging software when they both worked for the same firm in Oviedo, Florida back in 2000.

-- PDF version of the article here: Tampa Bay Scene's posted version is in the PDF of the entire issue of this week's paper.
-- Plain HTML version of the article here: They've given us the go ahead to post an HTML version of the piece in full.
(NOTE: Some graphic photos are included with the article!)

Stone's report covers much of the ground we've detailed extensively at BRAD BLOG over the past two years since we first broke the story in December of 2004. Nonetheless, he brings a great deal of that reporting together in one easy-to-read article, and also brings us up to date on the latest shenanigans of Feeney, who finds himself facing Curtis this year, mano-a-mano, in the election for the U.S. House in Florida's 24th Congressional district.

Hardcore readers of The BRAD BLOG will be familiar with much of the story. Indeed, Stone credits us with a great deal of his sourcing, as we spoke to him for several hours at length during our recent summer travels around the country. His article, however, includes new details to chew on.

In particular, Stone hits on a fresh point or two in regard to the death of Raymond Lemme, the investigator from the Florida Inspector General's office --- the first official that Curtis had informed of his allegations against Feeney.

As well, Feeney's camp now has a new slur word they're shamelessly attempting --- without evidence, as usual --- to use to smear Curtis...

DC Ethics Watchdog Group Names Florida Congressman Once Again in its Second Annual List of Congressional Rapscallions!
By Brad Friedman on 9/20/2006 10:44am PT

For the second year in a row, DC ethics watchdog group Citizens for Responsiblity and Ethics in Washington (CREW) --- the folks who filed successful ethics charges in the House against former Republican Majority Leader Tom Delay --- have issued their "Most Corrupt Members of Congress" report.

And once again our old friend, the corrupt Florida congressman Tom Feeney, is right up there near the top! Congratulations, Tom!

What may be most impressive is that Feeney, amongst other bad seeds like the disgraced Tom DeLay and Bob Ney, is neither in jail or even under indictment! Yet! No easy feat for someone as sleazy as Mr. Feeney! You'd have to be the craziest man in America to think you could get away with it! But (so far) Feeney has!

The indifference to the Rule of Law and our American Values and Constitution doesn't stop with Tom himself though! Just take a look at what Feeney's own chief of staff, Jason Roe, and his wife Patty are up to --- apparently with Feeney's help --- according to this report last week from Harper's!

The CREW list, which includes both Republicans and Democrats (though mostly Republicans), singles out Feeney for his years-long record of corruption, obfuscation, ethics violations and broken rules in accepting lobbyist and foreign-agent paid travel, holidays and more!

While we know that Feeney has already been accused by computer programmer Clint Curtis of asking him to create vote-rigging software back in 2000 and other skullduggery (Curtis has given sworn video-taped congressional testimony and has passed a lie-detector test in regard to those charges,) CREW continues to track some of Feeney's greatest Congressional Corruption Hits, from golf in Scotland with Abramoff to trips bought and paid for by foreign-agents. Take a look...

Princeton Professor Says Key To Gain Entry To Memory Card Is Standard Key Found Anywhere
By John Gideon on 9/18/2006 9:14am PT

Guest Blogged by John Gideon

The UK's SC News reported today that Princeton's Professor Felten discovered that the key to gain entry to the memory card slot on the Diebold AccuVote TS is the same key that you may have to open your desk drawer, filing cabinet or even a hotel mini-bar [emphasis added]:

"The access panel door on a Diebold AccuVote-TS voting machine - the door that protects the memory card that stores the votes and is the main barrier to the injection of a virus - can be opened with a standard key that is widely available on the internet," Ed Felten, professor of computer science and public affairs at Princeton University, said today on his "Freedom to Tinker" blog.

Felten said he became aware of the problem when, after performing a demonstration concerning the security flaws of Diebold machines, Princeton staff member Chris Tengi noticed the key that came with the voting machine was the same one he had at home.

"This seemed like a freakish coincidence - until we learned how common these keys are," Felten said. "Chris' key was left over from a previous job, maybe 15 years ago. He said the key opened either a file cabinet or the access panel on an old VAX computer. A little research revealed that the exact same key is used widely in office furniture, electronic equipment, jukeboxes and hotel mini-bars. It's a standard part, and like most standard parts, it's easily purchased on the internet."

Avi Rubin, Johns-Hopkins University Professor and computer scientist, points out in his blog this morning:

"This example serves to illustrate to even non-technical people the public relations tactics of the vendor and its supporters. Was it really too difficult for them to design a more secure key? Who do they think they are fooling when they say that someone would have to pick the lock to access the memory cards?"

So we now have a key that can be obtained from nearly anywhere and a "secret" password [1111] that everyone knows, and Diebold's David Bear says if proper access controls are maintained at the polling place there should be no problems. Perhaps Bear is talking about someone looking over the voter's shoulder to ensure they don't spend two minutes hacking into the machine?

All of this comes on the heels of the report from Princeton University, thanks to The BRAD BLOG, that was first reported here.

As well, it comes on the heels of the challenge to the Busby/Bilbray special U.S. House election in June in San Diego when these Diebold voting machines were sent home overnight --- in violation of both state and federal law --- for "sleepovers" with poll workers for days and weeks prior to the election. Here's a video that we missed at the time: Poll workers, on May 30th, taking home their pre-programmed, election-ready Diebold voting machines to store in their houses and cars 7 days prior to the June 6th election!

Any of them could easily have opened the "secure" systems with a mini-bar key, or, as the Princeton folks demonstrated on FOX "News" last week, they could have picked the lock themselves in 10 seconds. Of course, as we now know, it would have taken them less than a minute thereafter to insert a vote-flipping virus on the machines which could then affect every other machine used in the race.

Lead Sponsor, Author of Help America Vote Act to Serve Jail Time, Says Report
Last Remaining Abramoff Golf Junketeer Not (Yet) Facing Criminal Charges? Congressman Tom Feeney...
By Brad Friedman on 9/14/2006 7:41pm PT

We've long been describing Bob Ney as the "Soon-to-be-Indicted Bob Ney". It looks like that day is finally here.

The New York Times is reporting that Ney, the leader sponsor and author of the Help America Vote Act (HAVA) is headed to jail...

WASHINGTON – Rep. Bob Ney, R-Ohio, has agreed to plead guilty to federal criminal charges related to his dealings with the corrupt lobbyist Jack Abramoff, lawyers and others with knowledge of the investigation said Thursday.

A guilty plea would make Ney, a six-term congressman, the first member of Congress to confess to criminal charges in the Abramoff investigation, which has focused on the actions of several current and former Republican lawmakers who had been close to the former lobbyist.

People with detailed knowledge of the investigation said Ney had entered an in-patient facility in recent days for treatment of alcoholism, making it uncertain whether he would appear at a court hearing to announce the plea.

We've also long reported on Ney's "good luck" in winning $34,000 at a London casino owned by some good friends...at the exact same moment he owed exactly that much in credit card bills. Says The Times...

Another person familiar with the department’s investigation said that at least one of the criminal charges in Ney’s guilty plea would involve the accuracy of his claim in a House financial disclosure statement that he won $34,000 in a private London casino during a trip in 2003.

The casino winnings had also been under scrutiny by the Justice Department in part because the amount of the winnings coincided to a surprising degree with the amount of debt outstanding on Ney’s credit cards.

With both Ney and former Republican Majority Leader, Tom DeLay (R-TX) now facing indictments, that means there is only one remaining congress member who went on Jack Abramoff's golf junkets to St. Andrews, Scotland who has yet to be served with criminal charges: Rep. Tom Feeney (R-FL)

Feeney is currently facing a challenge for his seat by Clint Curtis, the man who has sworn in affidavit, video-taped congressional testimony and polygraph test that Feeney asked him to create vote-rigging software when they both worked at the same computer firm in Florida in 2000 (where Feeney was general counsel and registered lobbyist, even while he was also serving as Speaker of the Florida House).

Anyway, now that Ney is apparently going to jail for his Abramoff-related crimes, can someone other than The BRAD BLOG please look into the hornet's nest surrounding the passage of HAVA, as aided and abetted by Abramoff's old lobbying firm, Greenburg Traurig, and Ney's former chief-of-staff-turned-Diebold-lobbyist, David DeStefano? Pretty please? Here's a nice place to get you started!

Jonathan Allen Has The Details At The Hill
By Winter Patriot on 9/12/2006 9:32pm PT

Jonathan Allen: Most RSC members enjoy pork

Rep. Tom Feeney (R-Fla.) is one of the House’s harshest critics of pork-barrel spending. A member of the conservative Republican Study Committee, he was one of 20 lawmakers who voted 19 times in May and June to strike earmarks from appropriations bills. He refers to himself as Tom “Pork Buster” Feeney.

But Feeney’s antipathy toward lawmakers’ pet projects has not extended into his own district, which is due to receive $500,000 in earmarks in the Labor-HHS-Education spending bill, including $250,000 for the Arnold Palmer Hospital in Orlando.

Feeney, 48, a close ally of the religious right who considers yoga a threat to our country and has been accused of commissioning an electronic voting computer program that could rig an election, faces a slightly different issue. His hair looks, well, pubic. As in seventh grade discussions of "secondary sexual characteristics" pubic. He's not necessarily doomed, however, to resemble an adolescent groin, says Maysonave: "He could do a few things to convey more experience. Add a little gray to his temples. Maybe wear some subtle, wire-framed glasses."

And if he doesn't actually need glasses?

"Well," she says, "that's not really the issue, is it?"

The BRAD BLOG has reported on Curtis and his accusations against Feeney many times --- but we've never heard that one!!
By Winter Patriot on 9/12/2006 4:45am PT

Guest blogged by Winter Patriot

Here's Scott Maxwell of the Orlando Sentinel, from his blog, with my emphasis:

I just sat in on some of Tom Feeney's pitch to the Sentinel's ed board for why he should be re-elected. (I just silently observe in these things.)

The board first wanted to know about what we've written much about here already --- his strategy to paint Democratic Clint Curtis as a loony tune. Feeney's response was basically what I've said before --that he tried to ignore Curtis, but that Curtis has accused him "of murder, putting scorpions in his glove box, killing his dog ... and knowing about the 9/11 attacks not only before they happened, but before President Bush was elected."

The board seemed to still have some concerns about this strategy and his use of accusations of mental illness as an attack. But they didn't get too much more into it. I imagine they will when/if Curtis comes before the board. (And by the way, Curtis says he never accused Feeney of everything Feeney says.)

As reported extensively at The BRAD BLOG during the past two years, Clint Curtis has leveled several specific accusations at Tom Feeney. The chief allegation is that Feeney requested Curtis to design a software vote-rigging prototype (a computer program which appeared to be a simple vote-counter but which was in fact something else). Curtis has taken --- and passed --- a polygraph test in support of his allegations. Feeney has not indicated any willingness to go near a polygraph.

The Orlando Sentinel has noticed the "Clint Curtis Is Crazy" campaign being run by Tom Feeney. It's hard not to notice, I'd say, when a three-ring binder full of stories about Clint Curtis lands in your lap.

Scott Maxwell, whose reporting we were fortunate to encounter just the other day, chips in with a line-item from his blog:

*Tom Feeney's campaign sent over its, um, background on Democratic opponent Clint Curtis. It's about 100 pages ... and in a three-ring binder.

There's quite a bit more more detail from Robert Perez in a piece called Congressional race gets 'crazy' fast which begins like this:

Election Nullification Rejected! As Plaintiffs Seek to Prevent National Use of the 'Constitution as a Weapon'!
Jurisdictional Issue, Previously Used to Dismiss Case, to be Challenged on Appeal!
By Emily Levy on 9/8/2006 10:50am PT

Guest blogged by Emily Levy

The BRAD BLOG has learned that the plaintiffs in the Busby/Bilbray CA-50 election contest will be appealing the recent dismissal of the case by a San Diego judge. The appeal will be filed in California's 4th District court. Briefs are now being prepared and funds being collected for what may be a rather expensive appeal. Notice of appeal may be filed as soon as today.

Donations to the appeal can be made via Velvet Revolution.

The appeal is a rejection of Judge Yuri Hofmann’s August 29 ruling which echoed GOP claims that the U.S. House of Representatives, not the state courts or voters, have the power to determine the outcome of elections of members of Congress. In California’s 50th Congressional district in San Diego County, Republican candidate Brian Bilbray was announced to be the winner of the June 6 special election, flown to Washington and sworn in before all the votes were counted or the election certified. That, after reports were initially broken, and well circulated by The BRAD BLOG revealing that the Diebold voting machines used in the elelection were sent home with poll workers for overnight "sleepovers" in the days and weeks preceding the "bellwether" U.S. House special election.

Those sleepovers, in which election works had unsupervised access to the highly hackable, programmed, election-ready voting systems, were in contravention of both state and federal laws and led to a filing of an election contest in early July.

Says attorney Paul Lehto, who argued the plaintiffs' case in Hofmann’s court...

Says Seminole Chronicle is 'dumbass paper' to Seminole Chronicle editor!
Reveals plans to smear Clint Curtis as 'having mental problems'
By Winter Patriot on 9/8/2006 3:00am PT

Guest blogged by Winter Patriot

Late Tuesday night, after the election returns from Florida showed a landslide win for Clint Curtis over Andy Michaud in the 24th congressional district's Democratic primary, I heard a fascinating story from Ace Reporter and Managing Editor Alex Babcock of Oviedo, Florida's Seminole Chronicle. The Chronicle is Feeney's "hometown paper" which both the corrupt Republican congressman, and Yang Enterprises Inc. (YEI) --- the company he used to lobby for, even while he was speaker of the Florida House! --- threatened with a lawsuit after the paper dared to report on Curtis' sworn, video-taped testimony to members of the U.S. House Judiciary Committee.

Curtis had testified that Feeney asked him to create a prototype of electronic vote-rigging software when they were both employed by YEI as The BRAD BLOG originally broke back in December of 2004. Curtis, of course, is now the Democratic candidate challenging Feeney for the U.S. House seat in Florida's 24th congressional district.

Babcock's remarkable account of the "jubilant" Election Night conversation, witnessed by at least three other parties, went as follows...

The Chronicle had endorsed a candidate for City Council, who won. So [Chronicle reporter] Michelle [Yoffee-Beard] and I were at a victory party at a restaurant called Toucan Willie's, in Oviedo.

Tom Feeney stopped by for a few minutes to congratulate Keith Britton and have a beer. Britton is a Republican candidate challenging another Republican for a City Council seat in Oviedo.

Michelle asked Feeney why he would prepare a flattering depiction of Curtis in a campaign advertisement that reached voters before the Democratic primary.

"You'll find out," he said with a smirk.

Wow! Craziest Man In America! That's quite a distinction. There are some pretty crazy men in America these days, as if you haven't already noticed. And it's odd that Tom Feeney should award this title to Clint Curtis, because ...

I never even knew Clint Curtis was a little bit crazy! Did you?

Well apparently he is, because Tom Feeney certainly wouldn't say so if he wasn't.

The Orlando Sentinel jumped all over the story of Clint Curtis, his apparent victory in last night's Democratic primary, and the epic battle "between Good and Evil" which it sets up in Florida's 24th Congressional disctict.

See? Here's their coverage!, and this is --- literally --- the bottom line:

And in U.S. House District 24, Clint Curtis, 47, a computer consultant from Titusville, held a 64 percent to 36 percent lead over veterinarian Andy Michaud, 47, of Winter Park for the right to face two-term Republican Tom Feeney of Oviedo.

Have you voted yet? (Yes, it matters.)
By Dan Field on 9/4/2006 10:43pm PT

Guest Blogged By Dan Field

We're all on pins and needles here at Clint Curtis for Congress as the election rolls upon us. For those who haven't been following the race, election fraud whistleblower Clint Curtis --- who says he was asked to deliver a computer program to U.S. Congressman Tom Feeney to flip the vote in Florida --- hopes to run against Feeney himself in the general election in November. But to do that, he has to defeat Democratic rival Andy Michaud.

The interesting wrinkle? Michaud has been virtually a complete no-show on the campaign trail! In fact, many newspaper columnists have simply written him off. He hasn't appeared at any events in weeks and didn't even bother to show up for a 10-minute televised debate with Curtis on the local NBC affiliate!

So it would appear that Curtis has the Democratic nomination in the bag, right?

Well, this is Florida we're talking about, so who knows what sort of chicanery could happen.
