UPDATE: The Maddow Blog posts a coda to this story, along with an anti-Semitic flyer that was circulated by opponents in Memphis during Rep. Steve Cohen (D-TN)'s 2008 campaign there. The blog reports that "Mr. Cohen is his state's first Jewish member of Congress, and that he has faced prejudice for it in his political career. 'Memphis Congressman Steve Cohen and the JEWS HATE Jesus,' read one flyer circulated by a black minister during the 2008 campaign."

Follow @WikiLeaks on Twitter? If so, the U.S. government wants your details, and is trying to get at it through an extraordinary legal procedure.

Last month, in covering the landmark appellate court decision, United States vs. Warshak [PDF], which invalidated provisions of the 1986 Stored Communications Act to the extent that the Act permitted the government, without a warrant, in violation of the Fourth Amendment right against unreasonable search and seizure without probable cause, to obtain electronic communications from an ISP (Internet Service Provider), we cautioned that it was unclear whether our courts would arrive at the same conclusion when the government invokes claims of "national security" issues.

That question is about to be tested as the Eric Holder Department of Justice has obtained what Salon's Glenn Greenwald described as a "sweeping" District Court order seeking --- in relation to WikiLeaks' Twitter account --- "all mailing addresses and billing information known for the user, all connection records and session times, all IP addresses used to access Twitter, all known email accounts, as well as the 'means and source of payment,' including banking records and credit cards." ...

The ignorance on display in this CNN interview segment concerning Wikileaks and Julian Assange yesterday is simply astonishing.

I'd expect the misinformed idiocy and/or out and out lying from one of the guests, former Bush Admin Homeland Security Advisor (now a paid CNN contributor) Fran Townsend. But the amount of ignorance about the profession of journalism, on display from CNN's very own journalist here, Jessica Yellin, almost defies words. Happily, Salon's Glenn Greenwald, a Constitutional attorney and actual journalist was the other guest on hand to help straighten both of these women out.

Watch the video, be amazed, and then I'll have a few more words on it below, as it mirrors another recent --- and embarrassing --- WikiLeaks-related segment on CNN, which we critically covered before later receiving a response from both CNN and host Don Lemon...

The week before last, we took CNN and host Don Lemon to task for a WikiLeaks segment in which, among other problems, they started off with a package that compared Assange to Bonnie & Clyde and other criminals who did things like, ya know, actually commit crimes, like killing people and stuff --- none of which either Assange or WikiLeaks has done. Not by a long shot. CNN's on-screen chyron for the segment was, shamefully, "ASSANGE: JOURNALIST OR TERRORIST" (no question mark even included)...

Not much of a "slippery slope" here, right?...

Of course, one would think that conservatives would be up in arms about such blatant (and stupid) assaults on at least the spirit of the U.S. Constitution's first amendment. However, fake "conservatives" of the Fox "News", Sarah Palin, Sen. Mitch McConnell, Rep. Peter King, Sen. Joe Lieberman seem to have no such concerns. They'd prefer, it seems, to see censorship of the media and/or the targeting of a man --- even for assassination --- who has been charged with breaking no U.S. laws.

Unfortunately, the new batch of elected officials heading to D.C. in January look to be just as confused about who and what they are supposed to be defending...

Take a look at the short CNN video interview below with 27-year CIA analyst Ray McGovern on WikiLeaks and its founder Julian Assange. It's astonishing and disturbingly telling.

McGovern, as we noted on Friday, is one of a number of high-level intelligence whistleblowers and former government officials who signed a very strong statement in support of WikiLeaks and Assange last week. Other signatories of the statement include Pentagon Papers' whistleblower Daniel Ellsberg and the FBI's 9/11 whistleblower and TIME 2002 Person of the Year, Coleen Rowley.

McGovern, who was formerly personally responsible for giving Presidential Daily Briefings to both George H.W. Bush and Bill Clinton has, for years, been an outspoken opponent of the Bush Administration's unprecedented secrecy regime. He's perhaps best known for his remarkable 2006 confrontation with Don Rumsfeld, calling him directly out as a liar for tying Iraq to WMD and al-Qaeda.

It's embarrassing enough, in the below, to see CNN shamefully use the chyron "ASSANGE: JOURNALIST OR TERRORIST", since Assange has not been charged with anything remotely akin to "terrorism", nor has he like, ya know, a terrorist, either killed someone, tried to kill someone, or even advocated killing anybody --- unlike many of those who have advocated killing him.

But in the exchange that follows, as posted yesterday, note the telling positions expressed by CNN's Don Lemon about not only his, but CNN's apparent regard for WikiLeaks' founder Julian Assange as "a pariah". He seems genuinely taken aback at the notion that, as McGovern tells him, CNN "should be following his example."

Watch the whole thing, please, for other important points and CNN embarrassments, but the section I mention above is transcribed below the video, along with one point on which McGovern appears to be wrong...

I received an email this afternoon from a PR person for CNN, letting me know about their new "Tea Party Documentary" to air tonight, as based on the work of one of their reporters who, she says, has "followed the movement for the past 18 months" in order to offer what is described as "an hour of revealing interviews from their leadership and fascinating profiles of the impact of their energy on the 2010 midterms, their financial supporters and their campaigns."

The documentary, the PR rep's original email went on to say, comes after their reporter "spent considerable time with Lisa Murkowski, Christine O'Donnell, in California with Sal Russo of the Tea Party Express (rode the bus), Dick Armey with FreedomWorks, etc."

You may recall a few weeks ago that CNN ran another documentary with a similar theme, called Right on the Edge following the work of Rightwing media activists. (That one resulted in Republican scam-artist and federal criminal James O'Keefe making an ass of himself, as well as possibly violating the requirements of his federal probation, as we detailed at the time.)

As CNN has yet to run even one such documentary on non-Rightwing media activists or on the non-Rightwing politicians who have struggled over those same 18 months to clean up the unprecedented disaster they were left with when the Bush regime came to a close, I thought I'd point that out --- in my own, snarky-ish (me? snarky?) way --- to the PR person in respones to her email.

The email exchange that ensued follows below, as posted with her permission. I have removed her name as I feel she was only doing her job here, and she appeared to both appreciate the message I was hoping to send, and offered to pass it along to the folks who actually help with programming decisions at CNN...

CNN's Sr. National Editor Dave Schechter had this to say about The BRAD BLOG on their "Election Center" page yesterday, in regard to our coverage of election integrity [emphasis added]...

And also, "needless to say", no matter what the voting machine manufacturers have to say --- and no matter whether their systems are secure (they're not) or accurate --- there remains no way for us, we, the people, to actually know that, particularly on 100% unverifiable DRE (Direct Recording Electronic, usually touch-screen) voting systems, since it remains impossible for anybody, including the companies, to produce a single piece of evidence to prove that even one vote, ever cast on any of them during an election, for any candidate or initiative on the ballot, has ever been recorded as per the voter's intent.

Our thanks to CNN's Schechter for the kind notice, and we hope our squeaky wheels bring some much-needed grease to our ridiculously perilous and undemocratic system of concealed vote counting in this nation.

CORRECTION: I had originally misspelled Dave Schechter's name in the above article. A fine thanks for his kind words, eh? Anyway, now corrected with my apologies for the error.

Convicted federal criminal and Rightwing dirty-trickster James O'Keefe appears to have flagrantly run afoul of the rule of law yet again. This time, he appears to have violated and/or conspired to violate Maryland's Wiretapping and Electronic Surveillance Act. It would not be the first instance of him having done so.

The apparent violation(s) of state felony laws, revealed today as part of what is being reported as O'Keefe's "botched" attempt to "punk CNN", comes on the heels of O'Keefe's previous apparent violations of the very same laws in MD, though law enforcement officials have yet to hold him accountable, to date, for those previous offenses.

Documents and other material produced by CNN today suggest that O'Keefe secretly, and illegally, taped phone calls he had with CNN's investigative journalist Abbie Boudreau, and conspired to secretly video tape her in a compromising situation, also in violation of MD law.

O'Keefe, who is currently on probation after pleading guilty to a federal misdemeanor following another botched scheme in Louisiana earlier this year, seems to have broken similar laws last year in a number of states, including Maryland, where he secretly video taped employees at the offices of the community organization ACORN in Baltimore. Despite requests to MD law enforcement by a non-profit watchdog organization for a criminal investigation into the previous apparent violations of the state's felony wiretap laws --- and despite recognition of the "possible" violation of those laws in a number of law enforcement investigations elsewhere --- no action has been taken to date by state officials...

One of the basic axioms of law is that fraud vitiates consent. One of the foundational principles of democratic governance is that legitimacy rests on the informed consent of the governed. Come November, those principles will be tested in California.

Billionaire Meg Whitman, a former EBay CEO who surpassed the $100 million mark in campaign spending nearly a month prior to the traditional Labor Day kickoff of the Fall campaign, who, by Sept. 16, had donated a record-smashing $119 million of her own funds to her campaign, who refused to meet with former California Democratic Governor Jerry Brown and Republican State Insurance Commissioner Steve Poisner in a pre-primary debate, has knowingly sought to fill the gaping knowledge deficit created by the corporate media's gross neglect of its fourth estate responsibilities with disinformation about Brown, her Democratic opponent.

When confronted by an analysis which exposed a powerful but deliberately deceptive ad (video below) which shows former President Bill Clinton accusing Brown of lying about his tax record based on a CNN report which is now known to be erroneous, Whitman's spokesperson, Darrell Ng dismissed the idea of pulling the deceptive ad as "ridiculous"...

I appeared earlier this afternoon on RT (formerly "Russia Today"), an English-language Russian news service seen in the U.S. and elsewhere.

Despite yesterday's six-months-late admission from the New York Times that they were repeatedly bamboozled by the Rightwing con-artists who produced deceptively edited hit videos in order to take down ACORN (which they successfully did), U.S. television --- including those so-called "liberal" bastions like CNN and MSNBC --- don't seem to much care that the entire thing was a hoax from the jump. At least they've yet to cover it, while RT has done so with at least three live hits over the past 24 hours.

Once again, RT seems to have more interest in issues that actually effect Americans than American broadcast news outlets do. Here's my choppy web-cam appearance earlier today.

Yesterday, my colleague and friend David Swanson was also a guest on RT to discuss the ACORN issue, as was nationally syndicated radio host Thom Hartmann. Both of those short segments are posted below and well worth watching...

As mentioned yesterday, on Monday night, wingnut propagandist Andrew Breitbart tweeted to me...

...in reply to The BRAD BLOG's recent series of articles highlighting, among other things, how he lied, along with his accused federal felon employee James O'Keefe, in order to sell their phony ACORN hit videos to gullible media --- and how the New York Times, and so many others, fell for it hook, line, and not-yet-retracted sinker.

But, as it turns out, evidence from Breitbart's own Sept. 21, 2009 Washington Times column reveals that Breitbart did, in fact, not tell the "truth every step of way." In fact, he out and out lied while selling O'Keefe's all together phony misrepresentation (some might call it a lie) that he "dressed as a pimp" while "asking for - and getting - help for various illegal activities," as Breitbart inaccurately reported in his column.

Breitbart's promotion of those videos, as published on his own BigGovernment.com website, with the spectacular, media-friendly marquee selling point of low-level ACORN workers so stupid that they couldn't even spot a skinny white kid as a phony "pimp," kick-started the sting video campaign that was built and sold on an utter lie.

More evidence has been published today at Media Matters highlighting the effectiveness of that lie, and how media outlets from one side of the country to the other --- not just the New York Times as we've shown --- were utterly bamboozled and played for chumps by Breitbart and O'Keefe's phony scheme.

Furthermore, when confronted with the lies --- yes, lies --- in his column, while on the air live last night, Breitbart chose to do what he always does...lie about them...

Josh Marshall at TPM: "Sen. John Ensign goes on CNN to demagogue the terrorism issue and gets ambushed with a series of questions he's never answered about his affair and the ethics investigation surrounding his and his parents efforts to cover it up with lobbying infractions and pay-offs ... Truly must-see."

Brad at The BRAD BLOG: There must be some confusion here. CNN is asking actual and persistently dogged and tough questions of a high-ranking public official, a member of Congress no less, live on TV and everything, like actual journalists or something. And the guy isn't even a Democrat! What the?!...

"Biased thermometers" are to blame for scientific data documenting a precipitous rise in global temperatures, according to Marc Morano.

Morano was Rush Limbaugh's former producer and a columnist at the rightwing "news" site, Cybercast News Service, before becoming denialist-extraordinaire Sen. James Inhofe (R-OK)'s top aide on the U.S. Senate Committee on Environmental and Public Works. In 2003, Inhofe described global warming as "the greatest hoax ever perpetrated on the American people," a statement which he stills stands by today.

Morano now runs the climate denialist website ClimateDepot.com and is, essentially, the very heart of the entire climate change denialist echosphere.

On CNN on Thursday, he debated with James Balog, photographer and former "climate change skeptic" with a degree in geomorphology....
