We really should have taken some time off this past summer, cause it looks like we may not get a good break anytime soon. It may be a much busier November, December and even January than we'd like.

Rachel Maddow highlights what we regard as our personal nightmare scenario: "Almost every legitimately contested, legitimately interesting race in the country --- is tied, right now, with less than three weeks to go"...

Ugh.

"With this many top of the ticket races tied, turnout will be everything," Maddow explains. "So now's the part where we watch for the ways that people will try to stop voters from turning out or from having their votes counted, by hook or by crook. ... Right now, big picture, three weeks out: this is a tie game. Close enough to be fascinating, but also close enough to be stolen"...

Oh, what fun. This, of course, is just one of the reasons why it's important that you help support and fund the work we do here at The BRAD BLOG. We're up against the unaccountable hoodlums and thugs like the far rightwing U.S. Chamber of Commerce, the largest lobbying organization in the world. So we must be doing something right.

And there is no tactic too dirty for the slimeballs at the Chamber, as we're reminded again in a new report by Gary Ruskin released Wednesday by the Institute of Public Accuracy titled "Spooky Business: Corporate Espionage Against Nonprofit Organizations" [PDF].

Today on my KPFK/Pacifica Radio show --- after breaking the news about the newly elected Pope --- I interviewed Eugene Iredale, attorney of the former San Diego ACORN worker Juan Carlos Vera who received a $100,000 settlement from Rightwing con-artist James O'Keefe last week. (Vera also received $50,000 from O'Keefe's former partner Hannah Giles in a separate settlement last summer.)

Vera's California Invasion of Privacy Act lawsuit, filed in 2010, stemmed from O'Keefe and Giles' surreptitious wiretapping of a "confidential" conversation with Vera. The conversation (during which Vera played along to learn about the duo's pretend plot to smuggle underage prostitutes into the country, so he could turn them in to law enforcement) was then deceptively edited for misleading use in the infamous ACORN "pimp" hoax tapes published by Andrew Breitbart and blatantly misreported by New York Times, et al.

Iredale discussed O'Keefe's illegalities at the center of the suit; why other ACORN workers hadn't similarly sued the three con-artists; why Breitbart was not included in Vera's suit; why he didn't also sue for defamation; whether these settlements can be seen as a "victory"; and much more.

He had described media coverage of the settlement agreement as "lies and lies and more lies from journafascists" and attempted to taunt the media to "have the guts" to allow him to tell his side of the story. We took him up on that offer and invited him to appear on The BradCast today, live! Which is impossible to deceptively edit! (You're welcome, Jimmy!) But until late last night he didn't "have the guts" to even respond to my generous invitation.

After a second invite last night, however, I finally heard back from him...

Pretend journalist and Republican activist Hannah Giles agreed to pay $50,000 to former San Diego ACORN worker Juan Carlos Vera as a part of a legal settlement struck last summer in response to an invasion of privacy lawsuit filed against her and her former partner James O'Keefe, Vera's attorney Eugene Iredale has confirmed to The BRAD BLOG.

Last week, in a scoop by the website Wonkette, it was disclosed that O'Keefe, a federal criminal and professional liar, agreed to pay $100,000 in his own legal settlement with the same former ACORN employee, after heading up the scheme to secretly videotape him in violation of California's Invasion of Privacy Act (Cal. Penal Code § 632).

O'Keefe and Giles' illicit taping of Vera was carried out as part of the deceptively edited series of hit videos released by the pair in 2009. The tapes were published, and paid for, by the late con-man Andrew Breitbart. Vera had been portrayed in the misleading video as having been willing to help the pair smuggle underage prostitutes into the United States across the Mexican border. In fact, Vera had played along with the duo's ridiculous proposed scheme only long enough to collect information from O'Keefe and Giles (and take their photographs), before contacting law enforcement immediately after the secretly video-taped meeting.

Giles played the role of a prostitute in the ACORN "pimp" hoax videos. O'Keefe played her boyfriend. O'Keefe did not play the part of a "pimp", as he had knowingly misrepresented in both the videos and to the public, and as repeatedly misreported by the bulk of the mainstream media at the time, and even still today.

During the course of Vera's lawsuit, it was revealed that Breitbart, who died in March of 2012, had agreed to pay the pair some $120,000 for their hoax tapes in $5,000 monthly installments to each. O'Keefe ended up collecting $65,000 before he was terminated around the time of his CNN "Sex Boat" scandal in September of 2010. Giles' payments, on the other hand, were reduced from $5,000 month to $3,000 at some point, before being terminated for what she described, according to Vera's attorney, as "a conflict of visions".

Accordingly, Giles only ended up collecting $32,000 from Breitbart, but thanks to the settlement last Summer, she was forced to hand all of that, plus $18,000 more, over to Vera.

Despite the real facts of the Vera case being known since at least April of 2010 --- when a criminal investigation by the California Attorney General found "no criminality" by Vera or any of the other ACORN employees seen in the videos --- the original stories on the hoax videos remain published on the Breitbart website without correction, as we noted in our detailed report on O'Keefe's settlement with Vera last week.

As we reported once again at the time, every official law enforcement investigation on the matter --- including those by the former MA Attorney General [PDF], by the Kings County, NY District Attorney, and by the CA Attorney General --- determined that there were no violations of law performed by any ACORN worker as seen in any of the several surreptitiously taped videos. Each official investigation found that the tapes were "highly" and "deceptively" edited to present a false case against ACORN.

O'Keefe had attempted to fight for dismissal of Vera's July 2010 lawsuit but lost in court on every attempt to do so. While it took O'Keefe until this past week to see the writing on the wall and finally agree to settle with Vera, Giles was smart enough to settle her own part of the lawsuit with Vera last Summer. Giles' settlement agreement had been reported by Dave Maass of the San Diego City Beat at the time, but the conditions of that settlement and Giles' agreement to pay out $50,000 to the former ACORN worker had not been known.

Asked during his sworn deposition why he didn't attempt to confirm the false story given to him by Vera before publishing his videos tapes, O'Keefe, who still pretends to be a "journalist", explained: "I did want to follow up. I just didn't end up following up"...

Appearing on MSNBC's The Ed Show on Friday night, Eugene Iredale, the attorney for former San Diego ACORN worker Juan Carlos Vera, made short work of the chiseling claim made by federal criminal and professional liar James O'Keefe, that he had agreed to pay Vera $100,000 simply to bring to a close a "ridiculous lawsuit."

"If he wants to get out of the settlement and wants to fight us in court," Iredale told host Ed Schultz in response to O'Keefe's fundraising bluster, "we're ready any time. We can go right now!"

O'Keefe agreed last week to settle the lawsuit filed by Vera in July of 2010 against him and his partner Hannah Giles. Vera had been fired by ACORN after deceptively edited video tapes of him, secretly recorded by O'Keefe and his partner Hannah Giles, were published by Andrew Breitbart in 2009. While the edited tapes made it appear as though Vera, whose English is poor, was interested in cooperating in a scheme to smuggle underage prostitutes across the Mexican border, in reality, Vera had played along with the pair in order to gain information, including taking their photos, and then immediately notified law enforcement about the ridiculous scheme O'Keefe and Giles were proposing.

After word of the settlement with Vera leaked to Wonkette's Matthew Phelan and Liz Farkas last week, O'Keefe took to Twitter to play the victim, describing his payout to Vera as the necessary result of a "nuisance lawsuit".

"Sadly, this is the cost of exposing the truth," he explained to his gullible fundraising base in a statement posted to his ironically named Project Veritas website late last week. "That's why so few people do it. There are liability issues inherent in undercover journalism."

Many of those paying attention to this long shameful saga would be right in responding in turn: "Um, what 'journalism'"?!

O'Keefe continued his post-settlement Twitter tantrum to describe media coverage of his settlement agreement as "lies and lies and more lies from journafascists," taunting them to "have the guts" to allow him to respond on TV.

The BRAD BLOG's Brad Friedman responded to O'Keefe in turn with an invitation to appear live with him on his KPFK/Pacfica Radio show this coming Wednesday, at which time he could, among other things, explain how deceptively edited videotapes deserve to be labeled "journalism" or why he describes Vera's complaint as "meritless accusations". O'Keefe has yet to respond to the invitation...

Of course, we've highlighted O'Keefe's lies about releasing full, unedited videos, from which he creates his doctored and deceptively edited video propaganda, many times.

For example, despite his fundraising pleas to the contrary, it took a deal for criminal immunity from the California Attorney General in 2010 before O'Keefe finally agreed to turn over the raw, unedited videos from his phony 2009 ACORN "Pimp" Hoax to law enforcement. (The AG's investigation determined that the only violations of criminal law seen on the tapes were O'Keefe's.)

The screenshot from his dishonest fundraising plea at the top of this article was published after he and his co-conspirators trumped up secretly video taped "voter fraud" incidents during last year's New Hampshire Primary.

As we reported in great detail at the time, even while attempting to raise money on his fake "voter fraud investigation" --- which led to the Republican Mayor of Manchester calling for O'Keefe and his gang to be "arrested and prosecuted to the fullest extent of the law" --- O'Keefe lied about the release of what he claimed were the full, unedited tapes from that particular scam. They weren't. James O'Keefe had lied then, just as he did about the ACORN tapes, just as he has done, according to law enforcement, in the Virginia case.

James O'Keefe is a professional liar. That's how he makes a living. Alert the media.

A man originally reported to have been working for the Republican Party of Virginia was arrested by the Rockingham County, VA Sheriff's office on Thursday and charged with attempting to destroy voter registration forms by tossing them into a dumpster behind a shopping center in Harrisonburg, VA.

"Prosecutors charged him with four counts of destruction of voter registration applications, eight counts of failing to disclose voter registration applications and one count of obstruction of justice," according to a report late Thursday afternoon from TPM's Ryan Reilly. More charges could be forthcoming, according to officials.

But there is more to the story, as evidence emerges to document that it ties in to a still-expanding nationwide GOP Voter Registration Fraud Scandal that The BRAD BLOG first began reporting in late September, after we'd learned that the Republican Party of Florida had turned in more than 100 allegedly fraudulent and otherwise suspect voter registration forms in Palm Beach County. The story has continued to widen ever since, to a dozen Florida counties and several other states, now including Virginia, and even to the upper-echelons of the Republican Party itself.

The man arrested today was 23-year old Colin Small of Phoenixville, PA. As it turns out, he does not only work for the VA Republican Party. According to an online profile, he appears to be working for the Republican National Committee and, prior to that, served as an Intern for Congressman Mike Kelly (R-PA) in the U.S. House of Representatives.

Joseph Tanfani at the Los Angeles Times is reporting that Small was "working as a supervisor as part of a registration operation in eight swing states financed by the Republican National Committee."

He was first hired, says Tanfani, by Strategic Allied Consulting, the firm owned by the disgraced GOP operative and paid Mitt Romney political consultant, Nathan Sproul. Even before this year's registration fraud scandal which began with Strategic in Florida, Sproul's companies have long been accused of, though never charged with, destroying Democratic voter registrations in election after election and state after state, going back to at least 2004. Despite that, Sproul was hired by the Bush/Cheney campaign in 2004, by the McCain/Palin Campaign in 2008, and by Romney during the Republican Primary cycle.

Sproul's company, Strategic Allied Consulting, was hired by the RNC in August for more than $3 million, reportedly as its sole voter registration company this cycle. His company was said to have been fired by the RNC and five different battleground state Republican parties several weeks ago, after fraudulent voter registrations began to emerge across Florida. Some of those questionable applications included address changes for existing voters, such that FL election officials told The BRAD BLOG they worry voters could find themselves disenfranchised come Election Day. In Florida, as in many states, provisional ballots cast at precincts other than where voters are officially registered will not be counted. So changing the addresses on voter registrations without voters' knowledge is a serious crime with potentially very serious consequences.

Reilly's report at TPM says that Small "worked for PinPoint, a company hired to register voters on behalf of the Republican Party of Virginia." In fact, PinPoint Staffing placed ads to hire workers for Strategic Allied Consulting in FL, VA and a number of other states, though The BRAD BLOG has learned that the company removed many of those ads once the scandal began to break in FL. They have since modified some of their newer ads to hide their ties to the Republican Party.

In response to queries we sent to Sproul late Thursday, his crisis spokesperson, David Leibowitz, attempted to distance his client from the arrest of the Republican Party worker in Virginia, claiming that "the only connection between Sproul and Pinpoint is that Nathan has, on occasion, used Pinpoint to hire some workers."

It was PinPoint Staffing, in fact, which reportedly hired the man Strategic blamed for the fraudulent registration forms turned in originally in Palm Beach. But while PinPoint continues to seek workers for GOP-related efforts around the country, and as Sproul's operations continue in "as many as 30 states", it is the Republican National Committee's response to the entire affair, including to the arrest today, that may be the most troubling...

From Palm Beach to Richmond, from Las Vegas to Portland, it's not a coincidence, it's a coordinated GOP scheme intended to keep Obama supporters from signing up to vote.

While a major element of the Republican National Committee's strategy to game the 2012 elections by affecting who gets to vote and who does not has been cut off at the knees in the wake of a criminal election fraud complaint and other late developments in the still-widening GOP Voter Registration Fraud Scandal, a disturbing and abhorrent nationwide GOP voter registration strategy may have also been revealed by it.

The coordinated strategy, as evidenced by recent video documentation emerging from a number of key states, includes registration workers screening out Democratic-leaning voters from registration drives in order to keep them from registering. The way it's done: lying to potential registrants about a "voter survey," rather than disclosing that workers are actually there to register voters --- but only Republican-leaning ones. The deceptive tactic has so far been seen this year in several of the five battleground states where the RNC's controversial, and potentially criminal, $3 million registration program was scuttled late last week after fraudulent registration forms were discovered to have been turned in by a shady firm hired by the RNC to sign up Republican voters in Florida and four other states.

The BRAD BLOG has also collected evidence suggesting that the dishonest registration tactic also appears to be in use in states where the RNC's firm, Strategic Allied Consulting, is not said to be operating, suggesting that the practice is not just one used by the discredited firm, but, rather, a nationwide voter scheme by the GOP.

Questions about the legality of the tactic are emerging as well, though the deplorable ethics of the practice, legal or otherwise, would seem to be beyond dispute.

Election officials in the five states where Strategic was paid some $3 million by the RNC to do voter registration, Florida, North Carolina, Virginia, Colorado, and Nevada, are now said to be in the process of scrambling to review tens of thousands of new and updated voter registration forms submitted by state Republican Parties, as collected by the firm owned by Nathan Sproul, a long-time, notorious GOP operative and paid political consultant of Mitt Romney's campaign. But the disturbing, and seemingly coordinated, tactic of registration workers instructed to misrepresent themselves in order to screen out potential Democratic voters is coming to light as a separate element of the GOP Voter Registration Fraud Scandal.

To date, The BRAD BLOG has documented instances of the phony "polling" tactic being used by Republican voter registration workers in Colorado, Virginia, Nevada, Oregon, and, in years past, Tennessee and Minnesota. Our suspicion at the moment: What we have been able to discover to date is just the tip of the iceberg...

The state of Florida and it's Secretary of State Ken Detzner (R) are knowingly violating Section 5 of the Voting Rights Act in their attempted purge of "potential non-citizens" from the Sunshine State voting rolls, according to a new federal lawsuit [PDF] filed by the ACLU and the Lawyers' Committee for Civil Rights Under Law.

The complaint follows on the heels of a May 31, 2012 two-page letter submitted to FL election officials by T. Christian Herren, the chief lawyer of the U.S. Justice Department's Voting Rights Division. In his letter, Herren opined that the state's voter roll purge is in violation of Section 5 --- at least in the 6 Florida counties "covered" by that section --- because the state has not sought preclearance from either the DOJ or a federal court, as required by that section of the 40-year old federal law.

Additionally, the DOJ notes in its letter, the purge, coming as it does within the 90 days before Florida's federal primary election, is also in violation of the National Voter Registration Act (NVRA) which covers the entire state.

In response, FL State Department spokesman Chris Cates initially said they would continue the purge nonetheless, as they were "firmly committed to doing the right thing and preventing ineligible voters from being able to cast a ballot." In his official response to the DOJ a few days later, Detzner all but challenged the feds to bring a suit in order to stop the state from continuing their efforts.

Of the original 180,000 names identified by the state as potential non-citizens, out of some 11.3 million registered voters in the state of Florida, 2,700 were sent to county election officials with instructions to notify those voters that they had just 30 days to prove their citizenship or be removed from the rolls. As reported by the Christian Science Monitor, "Before heeding DOJ’s order to stop the purge" county election officials had identified just four noncitizens who "may have voted in past elections, making them potentially guilty of voter fraud," while clearing hundreds of voters who had, in fact, been legally registered voters. Hundreds of others may have been removed from the rolls, despite being legally registered citizen voters.

As The BRAD BLOG previously reported, Herren had demanded that FL officials "advise whether the State intends to cease the practice," but stopped short of issuing an actual "order" that FL immediately cease and desist. Such an order would have to come by way of an injunction issued by a U.S. District Court. The ACLU lawsuit now seeks that injunction even though, according to the Miami Herald, county elections supervisors across the state, led by Leon County's Ion Sancho, are now refusing to carry out a purge which Sancho describes as "illegal."

The ACLU lawsuit alleges facts that suggest the FL GOP is relying upon a FL Department of Highway Safety and Motor Vehicles (DMV) database that it knows cannot provide an accurate basis for establishing non-citizenship until 2017.

Unfortunately, this year's purge in Florida continues a tradition that has been affecting legal voters in Florida --- and, along with them, the rest of the nation --- cycle after cycle since at least the 2000 election...

After well over a year of political, if not all out civil war in Wisconsin in the wake of the state's Republican Gov. Scott Walker and the majority-GOP legislature unilaterally stripping many of the state's citizens of their rights to collectively bargain, Walker's fate is finally up for grabs today, along with that of his Lt. Governor Rebecca Kleefisch and the political balance of the state Senate via the seats of four Republican state Senators.

A Democratic win in just one of those Senate seats will return the majority in that body to the Democrats, making remarkably extreme actions like those we've seen over the past two years in the Badger State much more difficult to accomplish no matter who wins today's gubernatorial race.

But we'll see what happens today, tonight and, under several foreboding scenarios, over the next several weeks and/or months as the citizens of the state exercise some direct and wonderful democracy today at the ballot box --- or, at least, at the computerized tabulators.

Aside from expectedly heavy turnout being reported across the state (and particularly in Milwaukee), and races that are thought to be exceedingly tight, here are a few morning news items out of Wisconsin which may (or may not) turn out to have much more relevance in the near future, depending on how things go in the next several hours...
