A finding by the "highest court" in Germany has found electronic voting to be unconstitutional...

It took only four years, since e-voting was first deployed widely in Germany, for the country, and its highest court, to find that secret vote counting was unacceptable in a democracy, while the political-structure, media-structure and judicial-structure in the U.S. still remain largely clueless, or otherwise uninterested in either transparency or democracy.

Congratulations are due to our German EI advocacy brethren (as well as those in Holland who figured it out long before Americans did, as well):

Yesterday, the California Secretary of State released a letter [PDF] to the U.S. Election Assistance Commission (EAC) and a report of their findings with regards to the problem discovered in early December, in Humboldt Co., with disappearing ballots on the Diebold GEMS v. 1.18.19 voting system.

The letter actually challenges the EAC to take action in "requiring that, for every voting system certified by the EAC, the voting system vendor report any and all flaws and problems with the system to the EAC and to the elections officials in the states where the system is used when such flaws are discovered." And Secretary Bowen has taken the action herself by sponsoring legislation in California that will do what she has challenged the EAC to do.

The report is amazing in that it reveals why our voting systems are failing. The issues with the GEMS software go much deeper than just the fact that the system may lose votes. The state also found readily apparent violations of the federal voting system standards. These violations seem to have been ignored by federal test labs, by the National Assoc. of State Election Directors (NASED), and their consultants who qualified the voting system for use, and by-passed CA Secretaries of State and their consultants.

The big question is, will the EAC, staffed by people who were involved in the original NASED "rubber-stamp" of GEMS 1.18.19, take any action? Will they post the letter and report it in their "clearinghouse?" We certainly hope so. The present CA Secretary of State, Debra Bowen, and her staff deserve congratulations and appreciation for a job well done so far. It will be interesting to hear what follow-up actions will now be taken on the federal and state levels....

The "one and only true party of the people" hoping to "rebuild...from the grassroots up," according to an email from its new chairman Michael Steele, seems to be having trouble doing anything differently from the old GOP party. At least if the latest fund raising letter from Steele, charging "liberal Democrat comedian Al Franken" as "stealing Norm Coleman's U.S. Senate seat in Minnesota," is any indication.

On the same day that former Senator Coleman rested his so-far failed case in his election contest in St. Paul against apparent Senator-elect Al Franken, the new GOP chair sent a missive to supporters, begging for money, using the same old failed tactics of the RNC of old; namely, lying to supporters about facts, offering specious, unsupported allegations of Democrats "stealing" elections (despite all evidence to the contrary), making liberal use of the word "liberal," and referring to Democratic party members as "Democrat" party members.

Steele's shameless email (posted in full at the end of this article) echoes the RNC's so-far failed conspiracy-theory strategy to "win" the Senate seat, as previously used by the Coleman camp, the Republican Senatorial Campaign Committee (RSCC), the Republican National Lawyer's Association (RNLA), and GOP propagandists from Hannity to Rush to the wingnut blogosphere which dutifully repeat all of their tin-foil hattery, and/or supply it to them in the first place...

New York is the last state in the nation to have a non-computerized, transparent voting system. We still use immutable, theft-deterring mechanical lever machines to count our votes. (* - Please seen bottom of this article for a quick explanation of how lever machines work, for those who may not know.)

New Yorkers are fighting to keep their current voting system, notwithstanding that New York's legislature passed a law in 2005 that says we should give up our observable, reliable levers in exchange for unreliable, concealed software-based vote counting machines. Nearly 1,800 New Yorkers have signed a petition, and three counties (Dutchess, Ulster, and Columbia, all PDFs), have passed resolutions to save New York's lever voting system.

The Association of Towns (half of New York's entire population lives in towns) recently passed a resolution to save the levers [PDF], and Nassau, Greene, and other counties are presently considering similar action to retain New York's lever voting system.

Moreover, reliable sources have confirmed for me that neither the Governor nor the Attorney General nor the State Legislature that passed the "Election Reform and Modernization Act" (ERMA) want to replace the levers anymore either (what politician would want to be responsible for choosing to cut essential programs for hungry children or the elderly, just to be able to replace our superior and affordable voting system with budget-breaking computers that are notoriously corruptible and defective?). But the State Legislature has not repealed ERMA and the Attorney General, to date, has supported the State (not the citizens).

So what is driving New York State to stick with a law that so many in New York believe to be such a bad idea? As a New Yorker who has been talking to many election commissioners, legislators and citizens, I was surprised to learn how many people believe the "Help America Vote Act" (HAVA) actually banned lever machines.

I read HAVA. It clearly does not ban levers. I recently discovered what has helped fuel this misinformed opinion in part: it is the discredited position of the discredited U.S. Election Assistance Commission (EAC), as detailed in a newly-unearthed document prepared for the state of Pennsylvania, at their request, in regard to the legality of lever voting machines.

Although the agency is not a court of law, and not even an agency deserving of deference for its opinions --- its allegiance has clearly been shown to be not with either voters or democracy --- the "HAVA-banned-levers" rumor was given the imprimatur of the EAC through this little-noticed document...

In a primer on how to conduct an interview relying almost solely on Republican talking points, PBS NewsHour anchor Judy Woodruff discussed the new budget plan with White House Budget Director Peter Orszag on Wednesday night.

Woodruff's first question isn't necessarily a Republican talking point, but it might as well be.

Seriously, members of the mainstream media need to stop acting like they suddenly have the vapors over big government spending. The Republicans weren't the only ones to preside over the most reckless spending in our government's history over the last eight years, on a war of choice and tax cuts for the wealthiest Americans in an environment of profligate deregulation and zero investment in infrastructure and our citizens' future. Mainstream news outlets and their anchors and talking heads watched it all unfold while expressing little or no concern at the time.

Woodruff's second question is like a GOP talking-point smorgasbord...

On Day 1 of the Coleman/Franken U.S. Senate election contest in Minnesota, the Coleman team was busted doctoring evidence.

Earlier this week, the Coleman camp was busted having withheld notes from Franken's team, and today, the end of Week 5, "all hell just broke loose in the Minnesota courtroom," according to TPM's Eric Kleefeld, when it was revealed that Coleman's team has also been hiding a witness, as revealed by secret email!

"Al Franken's lawyers [caught] Team Coleman in the act of yet more concealing of evidence --- and they've now made a motion to totally strike the Coleman camp's claims about double-counting of ballots, which the Coleman camp has hoped to use to subtract over 100 votes from Franken's lead."

Add to that what attorney Ernest Canning guest blogged here last week, explaining how Coleman's attorneys need to be sanctioned for having moved to un-count 933 ballots they'd previously signed a stipulation for, agreeing they were legitimately added to the total.

Just imagine what this case would look like by now, had Franken --- or any Democrat, anywhere, anytime --- been busted doing any of those things in regard to an election or an election contest.

UPDATE 3/3/09: Coleman fined for the incident. Slap on wrist includes stern warning that case could be dismissed if it happens again, according to the Star-Tribune:

Only in America can elected officials go on TV and confess to felonies (including torture and warrantless spying, not to mention aggressive war) and the resulting debate focus around the question of whether investigating the "possibility" of wrong-doing would be too radical. This week a coalition of dozens of human rights groups including the Center for Constitutional Rights, the National Lawyers Guild, and the Society of American Law Teachers released a statement, as drafted by The Robert Jackson Steering Committee, cutting to the chase.

It reads in its entirety:

I wrote this statement with some helpful tweaks from colleagues and have been screaming the same basic message for about three years, but I sense more than ever right now that more ears are open to it.

While actually enforcing laws and "getting tough on crime" is now considered the radical leftist position and a "truth" commission the reasonable compromise, it is clear that a bipartisan commission would create the bipartisan bickering our elected officials are so eager to avoid. It would also, in Senator Patrick Leahy's view, investigate the complicity of Democrats as well as Republicans in the crimes of the past 8 years, thus guaranteeing that neither Democrats nor Republicans will support it.

If Congress can't take the heat and won't even enforce its own subpoenas, it should leave well enough alone. Statutes of limitations are running out fast, and we don't have time for another commission. If President Obama wants to distance himself from enforcing the law, he can do what he is supposed to do and leave the matter in the hands of Eric Holder. And if Attorney General Holder wants distance he can do what is required and appoint a truly independent prosecutor. Doing so would please the following organizations. Rush Holt (D-NJ), which would federally institutionalize secret software for vote counting, and the requirement of non-disclosure agreements for those who are lucky enough to be allowed permission to examine it...

Last week, we analyzed the latest draft version [PDF] of Holt's soon-to-be-introduced "Voter Confidence and Increased Accessibility Act" bill in depth. We detailed the dangers of its provisions allowing for secret software --- which even he and his office admit have been included in the bill because Capitol Hill lobbyists from "the proprietary software industry...won" the battle over full software and hardware disclosure --- along with Holt's continued insistence on allowing for the use of unreliable, unverifiable touch-screen voting devices.

Neither Salon's nor RAW STORY's coverage made it completely clear whether the Senators are discussing an idea that is different from Leahy's previously-floated "Truth Commission" --- where immunity would be granted to many who testify, in questionable exchange for making "the truth" known --- though this investigation does seem to be distinct from that one. We'll try to keep our eye out for Leahy's press release today, in case it offers some clarity. [Update: See details of Leahy's announcement added at bottom of article.]

One point from Salon, also worth highlighting, is that the tenacious Sen. Whitehouse seems keen on using this investigation to help disprove the often asserted notion that the Bush, um, "enhanced interrogation" policies saved lives, despite the lack of evidence supporting that wishful thinking, and the growing body of evidence and testimony --- from those who actually know --- which plainly disputes it.

Retired Maj. Gen. Tony Taguba, who led the investigation of prisoner abuse at Abu Ghraib, is quoted from a recent interview as disputing those who have claimed --- from the comfort of their keyboards --- that torture saved lives: "Some of those activities were actually not effective and those who thought so were in the academic or pristine settings of their offices," Taguba told Salon. "What would they know?"

Whitehouse adds: "It is important to prove the point, because they keep saying, 'We saved lives. We interrupted plans. We did this, that and the other.'...Well, when you drill down, there is never a fact there. It turns into fog and evasion."

Again, with Whitehouse on both the Senate Judiciary and Intelligence Committees, with access to much more information than has been made public to date, he oughta know. At least slightly more so than the Wingnuts who rule the public airwaves and, with it, the public "debate" on these issues to date.

UPDATE 1:34pm PT: On the Senate floor today, Leahy announced his plans for a hearing next Wednesday, March 4th at 10am ET (including a live webcast), called "Getting to the Truth Through a Nonpartisan Commission of Inquiry."
