I don’t want to give the wrong impression. All nations possess a legitimate need to gather intelligence. There have been large numbers of extraordinarily dedicated CIA employees, like Ray McGovern and Valerie Plame Wilson, who have sought to protect this nation from harm. But there is the dark side of the agency, a covert branch which has engaged in deception, intrigue, torture and assassinations, all designed to destabilize democratic governments in order to advance and consolidate the power and influence of a US-based, multi-national corporate empire.

In Part I of this five-part series, I described how the George W. Bush administration did not wait for legal "permission" from its Department of Justice before embarking on its plan to use torture as means of forcing confessions and other information from detainees. In "Prosecute or Perish" I stressed that the current torture scandal is the product of a half-century of CIA torture; that by failing to prosecute those who tortured in our name in the same manner that we prosecuted the Japanese officers who waterboarded my father during World War II, we not only will expose our nation to the charge of hypocrisy but will endanger the very survival of our constitutional democracy and the rule of law.

As I noted in Part I, we cannot move forward unless we honestly examine our past --- which, in this instance, mandates a careful look at the origins of the CIA...

Dark Beginnings

In a sense, it may be said that the CIA was a stepchild of Nazi Germany. As noted by Joseph Trento in Prelude to Terror (2006), its founder, Allen Dulles, had done business with the Nazis before World War II. Dulles served in the O.S.S. in Bern, Switzerland. From 1945 to 1947, preceding the creation of the CIA, Dulles ran his own private and entirely illegal intelligence service in which he “began a massive ex-Nazi recruitment* campaign, using a State Department refugee office as a front.” The recruitment campaign, Prof. Alfred McCoy observed, in A Question of Torture (2006), entailed more than the use of war criminals as spies. It included German scientists “who had directed Nazi experiments into human physiology and psychology” and whose early research would lay the ground work for CIA torture techniques…

During a news conference yesterday (video here courtesy of TheUptake.org) Marc Elias, representing Sen.-elect Al Franken in the election contest brought by former Sen. Norm Coleman, announced the filing of Franken's brief [PDF] responding to Coleman's appeal [PDF] of the decision by the tri-partisan, three-judge election contest panel's ruling which found: "Franken received the highest number of lawfully cast ballots in the November 4, 2008 general election for United States Senator and is entitled to receive the certificate of election."

Noting that, because of its ability to make credibility determinations, a trial court's factual findings are entitled to "great deference" in an appeal, Elias observed that Coleman had a "heavy burden" in showing that the three-judge panel erred on the facts and the law. He says it's a burden the Coleman team has not met in their appellate arguments. Elias noted that the legal contentions made in Coleman's opening brief were "virtually identical" to those that were made and rejected by the three-judge panel.

We discussed Coleman's arguments, and the three-judge panel's rejection of them, last month in 'For Coleman, the End is Near...'. As our legal analysis detailed, we agree with Elias' May 11, 2009 assertion that the Coleman legal challenge is "without merit."

For example, per Elias, Coleman attorney Ben Ginsberg continues to tell the media that 4,400 uncounted absentee ballots were improperly rejected, but as we observed...

So, it's been about 16 hours since we covered indie journalist/historian/blogger Andy Worthington's detailed report on the the reported suicide of the man who falsely "confessed," during torture, to a false tie between Iraq and al-Qaeda. The forced confession was subsequently used by the Bush Administration (Bush himself, as well as Powell and others) as justification for the war on Iraq. That, despite the fact that Ibn al-Shaykh al-Libi recanted his story not long thereafter, as long and widely reported.

As of this moment, not a single mainstream U.S. newspaper or broadcast outlet has reported on the story. Is it not notable? Or are our newspapers just dead set on ensuring their irrelevance by continuing to not report on news that actually matters, no matter how widely it's being reported in other parts of the world?

A search of "al-Libi" at Google News, at this moment, lists five stories in all, with The BRAD BLOG's coverage as the top story on the matter. The one, late, mainstream-ish entry is the coverage, finally, from Reuters filed one hour ago. And it's pathetic. Simply pathetic...

Recently, TPM asked their readers for casting suggestions for the upcoming biopic on Jack Abramoff, where Kevin Spacey is reportedly already booked to play the disgraced GOP uber-lobbyist:

They sought casting suggestions for 11 of the key players in the Abramoff scandals, sure to show up in the film. The resultant "Dream Team" of excellent choices for each were revealed last week.

But, amazingly, the TPM casting call overlooked one of the key players in the Abramoff scandal, our old friend, the disgraced now-former Republican Congressman from Florida, Tom Feeney, aka "Representative #3" in one of the key filings in the Abramoff affair. In 2003, Feeney accompanied Jack on the third lobbyist-funded junket to play golf in Scotland following trips with the disgraced now-former Rep. Tom Delay (R-TX) in 2000 and the disgraced now-former Rep. Bob Ney (R-OH) in 2002.

The TPM oversight must be corrected immediately. And, of course, I can think of just one person who'd be perfect --- for so many reasons --- to play the role of Feeney in the upcoming Abramoff film...

British journalist and historian Andy Worthington, an expert and author on Guantanamo, reports that the man who had supplied a key false tie between Iraq and al-Qaeda --- after being tortured in Egypt, where he had been rendered by the U.S. --- has died in a Libyan prison. "Dead of suicide in his cell," according to a Libyan newspaper.

Worthington has excellent coverage of the story tonight, which, he says, is "ablaze" in the Arabic media, but so far unreported in all but one English language outlet.

"This news resolves, in the grimmest way possible," Worthington writes, "questions that have long been asked about the whereabouts of Ibn al-Shaykh al-Libi, perhaps the most famous of 'America's Disappeared' - prisoners seized in the 'War on Terror,' who were rendered not to Guantánamo but to secret prisons run by the CIA or to the custody of governments in third countries - often their own - where, it was presumed, they would never be seen or heard from again."

The "emir" of a terrorist training camp in Afghanistan, al-Libi "was one of hundreds of prisoners seized by Pakistani forces in December 2001, crossing from Afghanistan into Pakistan. Most of these men ended up in Guantánamo after being handed over (or sold) to US forces by their Pakistani allies, but al-Libi was, notoriously, rendered to Egypt by the CIA to be tortured on behalf of the US government."

Worthington reports:

Worthington concludes: "The most important question that needs asking just now, of course, is whether it was possible for al-Libi to commit suicide in a Libyan jail, or whether he was murdered. I doubt that we will ever find out the truth...Whatever al-Libi’s actual crimes, his use as a tool in a program of 'extraordinary rendition' and torture, exploited shamelessly not to foil future terrorist plots but to yield false information about al-Qaeda and Saddam Hussein, remains a low point in a 'War on Terror' that has few redeeming features."

UPDATE: 16 hours later, and virtually zero coverage of this story in the U.S. corporate mainstream MSM. Amazing. Details now here... [That report has now also been updated to include a few U.S. outlets finally jumping in to the story, 24 hours later.]

Can't tell you how sick I am of the GOP's ACORN nonsense, having long ago exhausted myself in debunking the entire GOP scam to try and use the group as a stalking horse to support their own insidious efforts at imposing polling place Photo ID restrictions in hopes of doing nothing more than keeping 20 to 30 million legal, largely Democratic-leaning voters from being able to cast their legal votes, because they don't own the type of ID that would be required to vote under these draconian, unnecessary, Jim Crow disenfranchisement laws.

But, as a quick perusal of recent 'Daily Voting News' articles will show, efforts are still being doubled, and redoubled, by the GOP in state legislatures across the country in hopes of passing such restrictions into law. It seems these laws, meant to combat non-existent "voter fraud," are the Republicans' last, best hope to be able to actually "win" elections at all these days.

So, with all of that in mind...

Our observation on the final item above: Looks like those old "Liberal Media" are still partying like it's 1999 2007. Color us shocked. Shocked!

Sen. Lindsey Graham (R-SC): "My hope is that our Democratic colleagues - if you start listening to the bloggers - if we're going to let the bloggers run the country, then the country's best days are behind us."

Out of touch much, Senator? We suspect if the bloggers actually did run the country, we'd be much better off (if only because you'd be out of office.)

But perhaps Graham is confusing responsible, educated "bloggers" with the right-wingnut "bloggers" he's likely more familiar with. For example, here's the very popular (on the Right) Dijon deranged wingnut "Gateway Pundit," Jim Hoft, with his insightful perspective on the important news of the day yesterday:

If that's who you meant by "bloggers," Senator --- and we're ashamed that Hoft represents our former hometown of St. Louis, MO --- we might agree with you.

Truth and justice are essential components of democracy and the rule of law. We cannot move forward unless we honestly examine our past. Accuracy is vital to every decision we make, be it impeachment, prosecution or a restoration of our nation’s honor and integrity.

This is the first in a five-part series of articles which will strive to correct misperceptions arising from the erroneous blending of military and CIA torture. This task has become especially relevant now that the Justice Department's the Office of Legal Counsel (OLC), the very section which had issued the torture memos, tasked by former Attorney General Michael Mukasey with investigating itself, has now released a recommendation that none of the authors of the torture memos be prosecuted. This recommendation stands in stark contrast to our nation's post-World War II decision to prosecute German judges for war crimes at Nuremberg.

Part I addresses the relatively public involvement of the U.S. military and private contractors at Guantanamo, Afghanistan and Iraq. It will dispel the notion that the Bush White House sought out independent legal opinions from the OLC before deciding to torture.

Part II will discuss the CIA's dark beginnings, including its recruitment of former Nazis, its devotion to covert "psychological operations" as a founding principle, the experiments on unwitting subjects that were part of a maniacal quest to crack the code of human consciousness, and the scientific studies that led to KUBARK, the CIA's torture manual.

Part III provides a vital historical account of CIA torture applied by surrogates in developing nations as a component of empire, an account that belies the suggestion made by the The New York Times that CIA torture first arose as an aftermath of 9/11.

Part's IV and V will address the CIA's involvement in extraordinary rendition and an ultra-secret system of “black-sites” into which “ghost detainees” would disappear. It will show how the techniques used on "ghost detainees" are the culmination of a half-century of CIA research and practices...

Yet another state backs the conservative, Constitutional principle of equal protection under the law for all, as Maine's Gov. John Baldacci signs the legislature's newly approved bill, allowing for marriage equality in the state.

Said Baldacci upon signing:

Maine's recognition of equal justice for all, follows Vermont whose legislature last month over-rode a gubernatorial veto to pass a marriage equality law. Prior to that, same sex marriages were recognized as Constitutionally protected by Supreme Courts in Iowa, Massachusetts, Connecticut and California. In all of the state Supreme Court decisions, it was a Republican-appointee who wrote the majority opinion.

California's court finding has since been overturned by Prop 8, the constitutionality of which is currently being challenged. For the moment then, five states in the union now protect the right of same sex couples to enjoy the same rights that couples of opposite sexes enjoy.

I have been known to quote long-dead men in my past writings. Whether eloquently expressed thoughts by our founding fathers, or those artfully expressed by ancient Greek thinkers, these quotes have always done a better job starting or ending my thoughts - that tend to be expressed in long winding sentences. For this piece I am going to break with tradition and start with an appropriate quote from a living current senator, John Kerry: "It's a sad day when you have members of Congress who are literally criminals go undisciplined by their colleagues. No wonder people look at Washington and know this city is broken."

The people do indeed look at Washington and know that this city is 'badly' broken, Senator Kerry. The public confidence in our Congress has been declining drastically. Recent poll results highlight how the American people's trust in their Congress has hit rock bottom. A survey of progressive blogs easily confirms the rage rightfully directed at our Congress for abdicating its role of oversight and accountability. Activists scream about promised hearings that never took place - without explanation. They express outrage when investigations are dropped without any justification. And they genuinely wonder out loud why, especially after they helped secure a major victory for the Democrats. The same Democrats who had for years pointed fingers at their big bad Republican majority colleagues as the main impediment preventing them from fulfilling what was expected of them.

The recent stunning but not unexpected revelations regarding Jane Harman (D-CA) by the Congressional Quarterly provide us with a little glimpse into one of the main reasons behind the steady decline in the integrity of Congress. But the story is almost dead - ready to bite the dust, thanks to our mainstream media's insistence on burying 'real' issues or stories that delve deep into the causes of our nation's continuous downward slide. In this particular case, the 'thank you' should also be extended to certain blogosphere propagandists who, blinded by their partisanship, myopic in their assessments, and ignorant in their knowledge of the inner workings of our late Congress and intelligence agencies, helped in the post-burial cremation of this case.

Ironically but understandably, the Harman case has become one of rare unequivocal bipartisanship, when no one from either side of the partisan aisle utters a word. How many House or Senate Republicans have you heard screaming, or even better, calling for an investigation? The right wing remains silent. Some may have their hand, directly or indirectly, in the same AIPAC cookie jar. Others may still feel the heavy baggage of their own party's tainted colleagues; after all, they have had their share of Abramoffs, Hasterts and the like, silently lurking in the background, albeit dimmer every day. Some on the left, after an initial silence that easily could have been mistaken for shock, are jumping from one foot to the other, like a cat on a hot tin roof, making one excuse after another; playing the 'victims of Executive Branch eavesdropping' card, the same very 'evil doing' they happened to support vehemently. Some have been dialing their trusted guardian angels within the mainstream media and certain fairly visible alternative outlets. They need no longer worry, since these guardian angels seem to have blacked out the story, and have done so without the apparent need for much arm twisting...
