Following the discovery of hundreds of ballots deleted by Diebold's paper ballot op-scan system in Humboldt County, CA, the county's election chief Carolyn Crnich has finally decided to dump Diebold all together. That's the good news.

The bad news, as longtime local election integrity advocate Dave Berman detailed this week, is that Crnich has decided to jump out of the frying pan, and into the fire with a different op-scan system, made by a different private vendor, using similarly secret software, with many of the same problems found in the crappy Diebold system she's finally tossing over the side.

A spokesman for Hart InterCivic, the private Austin, TX company which makes the paper ballot op-scan system Crnich is hoping to use, defended the county's planned move, though he had to make some erroneous claims to The BRAD BLOG in order to do so...

MN Supremes: Count the Incorrectly Rejected Absentee Ballots

[UPDATED at end of article with today's (Friday's) latest numbers.]

As thousands of challenged ballots from both Sen. Norm Coleman (R) and challenger Al Franken (D) are being decided by the bi-partisan state canvassing board in the U.S. Senate race in MN, AP says it's currently a 2 vote race, out of 2.9 million ballots cast, in favor of Franken.

That said, as all of the challenged ballots are finally counted over the next several days (and weeks), the lead could go back and forth a bit each night. The Star-Tribune, which puts today's margin at 5 votes in favor of Coleman, currently projects that Franken will ultimately win by 89 votes...

Constitutional Law Professor Charges Citizenry With Responsibility for Bringing Accountability...

As Jon Ponder noted here on Tuesday, a bi-partisan U.S. Senate panel has found [PDF] that George W. Bush was responsible for approving War Crimes (torture and abuse) at the Abu Ghraib prison in Iraq, Dick Cheney admitted in a recent interview to helping to approve War Crimes (torture and abuse) in interrogations, and the corporate media --- with the lone exception of MSNBC --- have been virtually as silent on what may be the most offensive crimes ever committed by an Executive Branch in the U.S. as they were during the lead-up to and follow-through on the War on Iraq, when those same officials sent our nation into war on the basis of demonstrable lies.


George Washington University's highly-respected constitutional law professor Jonathon Turley, noting the War Crimes now known and admitted to by Bush and Cheney, asked Keith Olbermann Tuesday night, "If someone commits a crime and everyone's around to see it and does nothing, is it still a crime?"

During the discussion, Turley mentioned --- no less than three different times --- that it'll be up to the citizens whether or not any action is actually taken to prosecute those who committed these crimes.

But is there any real basis --- in 2008 --- for his well-meaning argument? Not bloody likely...

Pennsylvania voters challenging the continued use of unverifiable electronic voting machines in their state won another major round on Tuesday when the Pennsylvania Supreme Court issued a ruling allowing their case to proceed toward trial. The state's highest court, in a one-sentence order, denied the Pennsylvania Secretary of State's petition seeking permission to appeal a lower court ruling decided in the voters' favor.

In April 2007, the Commonwealth Court of Pennsylvania had ruled that voters have a right under the Pennsylvania Constitution to reliable and secure voting systems and can challenge the use of electronic voting machines "that provide no way for Electors to know whether their votes will be recognized" through voter verification or independent audit. Following that ruling, Pennsylvania Secretary of State Pedro Cortés filed his petition before the Pennsylvania Supreme Court and further proceedings in the case, Banfield v. Cortés, had been suspended pending the outcome of the petition. The order issued on Tuesday gives a green light for the voters to pursue their claims.

So When Will the White Supremacist Speak?

This is really bad:

Barack Obama's choice of a prominent evangelical minister to deliver the invocation at his inauguration is a conciliatory gesture toward social conservatives who opposed him in November, but it is drawing fierce challenges from a gay rights movement that --- in the wake of a gay marriage ban in California --- is looking for a fight.

Rick Warren, the senior pastor of Saddleback Church in southern California, opposes abortion rights but has taken more liberal stances on the government role in fighting poverty, and backed away from other evangelicals' staunch support for economic conservatism. But it's his support for the California constitutional amendment to ban same-sex marriage that drew the most heated criticism from Democrats Wednesday.

After the debacle of Prop 8 --- which Obama never mentioned on a public platform during the campaign and has not addressed since Election Day --- this is a kick in the gut to every gay American. Here's a quick look at Warren's positions from Right Wing Watch:

If something happens in Washington and no one reports it, does it actually happen?

As much as we'd like to believe that more Americans are getting their news from blogs, the reality is that print media --- news magazines and newspapers; and television news broadcasts are where most people get their information. With the news publishing industry being right up there with the auto industry in terms of being on the ropes, those with the loudest voices are the ones who will control the agenda. In this age of cost-cutting, newspapers are cutting their Washington bureaus, as the New York Times reports:

The times may be news-rich, but newspapers are cash-poor, facing their direst financial straits since the Depression. Racing to cut costs as they lose revenue, most have decided that their future lies in local news, not national or international events. That has put a bull's-eye on expensive Washington bureaus.

Most papers, even those in big cities, have wagered their survival on local news, printing far fewer reports from Washington, Beijing or Baghdad, and relying more on news agencies for those articles. A survey of newspaper editors released in July by the Pew Research Center found that 57 percent said they published less national news than they did three years earlier, while 62 percent said they printed more community-level news.

Just what Americans need --- an excuse to be even more narrowly-focused and provincial than we are.

The problem with the decline in Washington news bureaus is that it gives even more clout to the Washington pundit corps that even as the economy continues to collapse, even as GM and Chrysler close factories and talk merger while Washington fiddles, even as the upcoming Alt-A mortgage adjustments loom ahead of us in March, even as Iraq threatens to explode again, Greece erupts in unrest, and the Bushistas continue to steal as much of the Treasury as they can on the way out the door, has decided to party like it's 1993. They smell blood in the Blagojevic waters and if there is less actual news reporting, they control the agenda. This is how we end up with Time Magazine deciding that photos from 1980 of Barack Obama with a doobie constitute news just as worthy of reporting as the fact that the American era is over. Because when the feces hit the fan, the corporations that control the media want to make sure that the mobs with pitchforks and shovels decide their problems are because Barack Obama experimented with drugs in college, not because their public faces gave a criminal Bush administration a free pass for eight years.

Hillsborough Co Florida outgoing election chief, Buddy Johnson, wanted $2.3M from the county to cover election cost overruns from the Nov. election. Stupidly Johnson did not bother showing up to appear before the county supervisors so they could ask him questions. The supervisors took his no-show as an insult and they have deferred any decision until they can review the election office's records.

Meanwhile the Maryland Board of Public Works has approved a contract between the state and Premier/Diebold for $974,000 for six months to cover municipal elections within the state. That contract could add up to $1.4M if two three month options are exercised. All of this even though the state is scrapping their paperless DREs at the end of next year in place of a paper based system.

And, after the reports of Diebold accuracy failures in Humboldt Co., California, the county has decided to scrap their present system and replace it with machines provided by Hart Intercivic. The selection of Hart is a bit strange in light of the fact that Hart has removed themselves from all EAC certification testing. They will not, in the future, have a voting system that has been tested to the voting system standards and certified by the EAC....

Counter Charges for 'False Arrest' Still to Come...

It's been more than a full month since the November 13th arrest of Broward County, FL's election integrity advocate Ellen Brodsky and the state has still failed to file formal charges or supply her with discovery documents.

As The BRAD BLOG reported in detail following the arrest, Brodsky was taken into custody, seemingly at the behest of her opponent in the election, after attempting to oversee the public counting of ballots for the election in which she ran as a candidate for Supervisor of Elections.

The arrest for "disorderly conduct" (according to police records) was caught on tape and posted here last week. The tape shows fairly clearly that there was no such disorderly conduct by Brodsky, despite the order for the arrest having apparently been issued by the office of the current Broward Supervisor of Elections, Dr. Brenda Snipes.

Today's South Florida Sun-Sentinel picks up the story with an update noting that Brodsky, a month since her arrest, has been forced to seek a judge's order demanding that prosecutors explain why she was arrested in the first place.

The BRAD BLOG has also obtained a copy of a motion to compel discovery exhibits, which have similarly not been given to her, as filed by Brodksy's attorney earlier this month.

According to the Sun-Sentinel:

Ellen Brodsky has asked a judge to order prosecutors to explain why she was arrested at the election office warehouse.
...
The case is open but no charges have been filed, State Attorney's Office spokesman Ron Ishoy said Tuesday.
...
Her lawyer, Tanner Andrews, denies wrongdoing. He wants to know what exactly his client is accused of doing and who made the accusation on Nov. 13.

"Why they arrested her would be a really good start," he said.

Journalist Muntadar al-Zeidi, the new hero in Iraq, much of the Muslim world, and even among many in this country, is facing less than friendly treatment from the Iraqi military and, according to some news reports, the U.S. forces overseeing his custody...

The Iraqi journalist who hurled his shoes at US President George W. Bush has a broken arm and ribs after being struck by Iraqi security agents, his brother told AFP on Tuesday.

Durgham Zaidi was unable to say whether his brother Muntazer had sustained the injuries while being overpowered during Sunday's protest against Bush's visit to Baghdad or while in custody later.

He said he had been told that his brother was being held by Iraqi forces in the heavily fortified Green Zone compound in central Baghdad where the US embassy and most government offices are housed.

"He has got a broken arm and ribs, and cuts to his eye and arm," said Durgham.

And yes, as we noted in our coverage on Sunday, White House spokeswoman Dana Perino did, in fact, receive both a literal and symbolic black eye during the melee following the shoe toss. In what would be dismissed as ridiculous heavy-handed Hollywood symbolism, had it been featured in a movie, Perino actually received a black-eye when she was hit during the fracas, in the eye, with a microphone...

The myth of the "liberal media" has become such an article of faith these days that attempting to refute it is futile. But if evidence against liberal bias were being collected, on top of the pile would go the scant coverage the liberal media are giving two stories about the approval of torture and prisoner abuse by the conservatives currently holding the offices of president and vice president of the United States.

Earlier this month, a bipartisan U.S. Senate committee put the blame for the abuse of prisoners at Abu Ghraib prison squarely at the top of the chain of command. Here's Andrew Sullivan:

In 1993, when he served as chairman of the Joint Chiefs of Staff under Pres. Clinton, Colin Powell was a leading advocate of the military's "Don't Ask, Don't Tell" (DADT) policy that essentially allowed gay people to serve only if they agreed to stay in the closet. Now, in an interview with Fareed Zakaria on CNN, he says it's time for the policy to be reviewed.

Another check of the accuracy of Diebold/Premier voting machines has found that they fail in that department. While performing a state mandated audit Montgomery Co, Ohio, elections officials found that a memory card from one DRE voting machine read five more votes when read a second time during the audit. The county and state are investigating.

What does Diebold/Premier have to say? "We have not seen this particular condition anywhere else in Ohio or anywhere else in the country," according to spokesman Chris Riggall. Clearly Riggall is joking. Of course they haven't seen this condition in Ohio because Ohio has not done these audits in the past and the lack of audits across most of the rest of the country would ensure that no problems would have been found in the past.

Where there are audits that may have found this condition, the condition is ignored or just shrugged-off. What they ignore is that there is a federal law that dictates accuracy of voting systems and even the loss of these 5 ballots in a county that saw over 280,000 ballots cast is a violation of that law. ...

Staged Legacy Visit 'Marred' by Actual Event, Expression of Truth

Unlike the previous video, this one is real, as the line between satire and Bush's 'Presidency' grows increasingly impossible to discern in his waning days, and as his final visit to Iraq becomes as embarrassing as his first (when he delivered a fake turkey to the troops).

From NYTimes:

BAGHDAD "” President Bush flew to Iraq on Sunday, his fourth and final trip, to highlight the recently completed security agreement between the United States and the country that occupied the bulk of his presidency and will to a large extent define his legacy.

But his appearance at a news conference here was interrupted by a man, apparently a journalist, who leaped to his feet and threw one shoe at the president, who ducked and narrowly missed being struck. Chaos ensued. He threw a second shoe, which also narrowly missed Mr. Bush. The man was roughly 12 feet from the lecturn in the center of two rows of chairs, about two feet from a pool of reporters. A scrum of security agents descended on the man and wrestled him, first to the floor and then out of the ornate room where the news conference was taking place.

TV news coverage has noted that throwing shoes is one of the culture's greatest insults. So is calling someone a "dog." Unlike hundreds of thousands of Iraqis killed by Bush's attacks over the last 5 years, however, he was able to survive this one with his life, and even make a joke about it...

The president was uninjured and brushed off the incident. "All I can report is it is a size 10," he said jokingly. An Iraqi accompanying the pool of reporters, colleague said the man had shouted, "This is a farewell kiss, dog."

UPDATE: The video of both shoes dropping follows below. Also, MSNBC reports that WH Spokesliar Dana Perino may have ended up with a black eye. Both a literal, and an unbelievably symbolic one at the same time...
