In a move that could set a disastrous precedent, the Republican Governor and Democratic Secretary of State of Mississippi have come together to ask that a federal judge rule that the state legislature must enact a voter ID law.

Also, Florida activists are now looking into other counties beside Sarasota and they are finding plenty of questionable results:

"We’re inviting Charlotte County voters who experienced a problem voting in the November 2006 election to attend a public forum next Wednesday evening, July 11,” explained Kitty Garber, Florida Fair Election Center’s Research Director. “For example, did your vote vanish from the review screen? Did you have trouble getting your vote to register? Did the machine fail while you were voting? Did any of your friends and neighbors have the same problem? If you had a problem voting, we hope you will attend to share your voting experience with us.”

Bergen Co. NJ has reported that their Sequoia DRE voting machines required $44,000 worth of electricity for their monthly battery charge last year. The county is now spending $42,000 to install air conditioning in the warehouse where their 1,200 machines are stored. “Red-Team” security checks are underway in California where teams of “hackers” are testing the security of all voting systems used in the state....

Today brings us a few articles and opinion pieces. We have opinion pieces from Nancy Tobi, Bev Harris and Howard Stanislevic. There isn’t much to pass on that is real news. Maybe that’s a good thing because most of what is reported by the Main Stream Media (MSM) is only reported when there is a real election problem and many of those are ignored. Why, for instance, has the MSM totally ignored the ES&S source code escrow issue and their arrogant letter to the California Secretary of State’s office? Not one word has been printed by the MSM on this issue that could bring into question whether many state’s election laws are being followed by the vendors....

Yesterday I mentioned that Maryland chief election official, Linda Lamone, had been caught with her picture on a Diebold brochure touting the company’s electronic poll book product. I asked, “What are the odds that Diebold will pull back the brochures to help Lamone out of a fix?” Well, the odds turned out to be 100 percent. Lamone asked Diebold to stop distributing the brochure and Diebold says they will comply. ...

The inside Maryland media has finally discovered what was reported outside of Maryland earlier this week; the state’s election director may have a conflict of interest issue and there is no doubt that she suffers from poor decision making. Linda Lamone, Maryland’s top election official allowed her picture, and a statement of questionable quality, to be used in a brochure that Diebold is using to promote their electronic poll book product. While Lamone discusses how great the product is, she conveniently forgets that the system failed miserably when used in the state primary last September. She claims that she sees nothing wrong with allowing Diebold to use this promotion, after all she is a lawyer and she reviewed the brochure before it was printed. The Governor and some state legislators from both parties seem to disagree with Lamone. What are the odds that Diebold will pull back the brochures to help Lamone out of a fix? ...

ES&S seems to have complied with the demand from the California SoS’s office that they provide their source code as part of the state’s “Top-to-Bottom Review” of all voting systems used in the state. I say “seems to” because ES&S delivered source code but would not let the state have the code that is sitting in escrow, per state law, for exactly the purpose of a review of their voting system. This is a growing story with a lot of unanswered questions. Also, is it not enough that we have given a few corporations too much involvement in our voting process (with more to come if S-1487 is signed into law)? Now Salt Lake Co. Utah is actually discussing allowing companies to advertise at the polls in exchange for providing a minimum of five uniform dressed “volunteers” as poll workers. I can see it now, a banner running across the DRE screen announcing, “Today’s election is brought to you by WalMart”...

HR-811 update: Contact was finally made with someone on the staff of the House Admin. Committee who knows the status of HR-811. The question asked concerned a deletion of language that was put into the bill during committee deliberation but was removed after the bill was voted out of committee. The specific language was the “Capuano Amendment” and concerned emergency paper ballots. The staff member reports that the language was removed from the bill due to some discussion by members of the committee. The language, or some facsimile, that “captures the intent of Mr. Holt and Mr. Capuano” will be reinserted into the bill by a manager’s amendment prior to the bill going to the floor. So, the bill voted on by members of the House of Representatives and passed out of committee is not the existing bill and no one knows what the real bill looks like at this time and no one knows what HR-811 will look like when it is finally sent to the floor for a vote. And Congress wonders why their popularity is less than that of the President; or do they care?...

Today finds what amounts to three days worth of opinions, columns and editorials. Some voters in Georgia are using their state mandated voter ID cards for more than just voting. It seems that it has become a free piece of identification for cashing checks and some voters have more than one of the cards. Over half of the counties in Utah have passed resolutions against HR-811. They incorrectly state that the bill will cost the counties millions. In response to this at least one local activist incorrectly states that passage of HR-811 will save the county money by it’s use of a paper-based voting system. Nothing in the bill will force the county to use anything but voting machines with a different voter verified paper record printer. ...

Remember Arthur Anderson, the man who ran for Palm Beach Co, Florida, Election Supervisor on a promise that he would give the voters a voter verified paper trail? He is also the man who ran from that promise just as soon as he was elected and took office. In fact he has gone so far to protect the county's paperless Direct Recording Electronic (DRE) voting machines that his office lied in an estimate of how much it would cost for elections if the county went to a paper ballot-based optical-scan system. In the estimate to the county, Anderson tripled the cost of printing each paper ballot to $1.25 from the actual $.40 per ballot. The difference in the estimate? $2.2 million. And in California the SoS has announced that ES&S is not cooperating in her “top-to-bottom” review of the state’s voting systems. It seems that ES&S has refused to turn over their source code for review. ...

In the New York state legislature it is coming down to crunch time for legislation to be finalized and passed. It is also a period of great concern for New York’s election integrity community. As the New York Times reports this morning:

“Microsoft, for example, is lobbying legislators to change the laws that govern the electronic voting machines that will soon be in use around the state, thanks to a 2005 law that ballot-integrity experts have hailed as one of the toughest in the nation.

The software company wants to change a rule known as “third-party escrowing,” under which the underlying software codes used by voting machines can be inspected by a third party in the event of tampering or hacking. The voting-machine vendors vying for the state’s business all use Microsoft’s operating software. But Microsoft wants to keep that software’s underlying codes secret.

“This change would remove the ability of citizens to independently review source code in the event of election problems,” said Bo Lipari, the executive director of New Yorkers for Verified Voting, which opposes the amendment.”

In his “S.1487: A Deconstruction” Robert Bancroft points out;

One cannot help but notice a pattern in the fiscal priorities set by this bill.
• Money to help States develop training programs: none
• Money to help States establish early voting programs: none
• Money to help States perform rigorous audits: none
• Money for the Commission to give to manufacturers for research: $4,000,000
• Money for States to give to manufacturers for machines: $600,000,000
The bill is quick to clarify that the $600 million grant in no way prevents States from also tapping the $650 million granted by HAVA. That puts the total amount of American taxpayer dollars siphoned off to voting-machine manufacturers at $1.25 billion. Are the authors certain that the American people agree with these priorities? Even after handing so much of our money over to these business interests, the bill still does not provide the one thing we have requested: a paper ballot.

Ohio’s Secretary of State, Jennifer Brunner, has announced a plan to hire a firm to determine whether her state’s voting machines work, are secure, and can function under heavy volume. This is pretty much the same thing being done in California. Why don’t the two states join forces and save the taxpayer some money by sharing the costs?

Also, in a decision that I’m sure pleased Sen. Diane Feinstein and other protectors of corporate secrets over voters, an appellate court in Florida found that Christine Jennings has no right to examine programming source code that ran the machines that undervoted in her race last Nov.

In his WebLog New Yorkers for Verified Voting’s Bo Lipari relates:

The 800 pound gorilla of software development has moved forcefully into New York State, supported by voting machine vendors using Microsoft Windows in their touch screen voting machines and other systems. Over the last two months Microsoft and a cadre of high paid lobbyists have been working a full-court press in Albany in an attempt to bring about a serious weakening of New York State election law. This back door effort by private corporations to weaken public protections is about to bear fruit.

These are the same lobbyists who left a closed door meeting with Senator Feinstein with a satisfied smile on their faces just before her corporate protecting election legislation, S-1487, was completed and filed.
