The Constitutional Crisis in D.C. continues to heat up on today's BradCast, following Monday's directive from the White House that former White House Counsel Don McGahn should defy a lawful Congressional subpoena to appear for testimony before the U.S. House Judiciary Committee on Tuesday, and Monday's ruling by a U.S. District Court judge that Donald Trump's accounting firm, Mazars USA, must turn over financial documents from Trump within the next week, as subpoenaed by Congress. And we've got a new case of GOP election fraud tossed into the mix with everything else today, as well. [Audio link to today's full show is posted below.]

McGahn did not appear Tuesday morning at the Judiciary Committee, defying his subpoena and prompting a public upbraiding from the panel's Democratic Chair Jerry Nadler who declared "our subpoenas are not optional" and vowed the Committee would hear McGahn's testimony "even if we have to go to court to secure it." Nadler added that Democrats will not be deterred from their Constitutionally mandated oversight investigations and "will hold this President accountable, one way or the other."

The "other" way, of course, is via an official impeachment inquiry in the House, which is now being sought by more and more House members, including several both in Democratic leadership and serving on the Judiciary Committee, which would take the lead in such an inquiry. Proponents of an impeachment inquiry now reportedly includes Chairman Nadler himself. He is said to have made the case to House Speaker Nancy Pelosi on Monday night, while she reportedly maintains that such an inquiry would hold up both legislation as well as other investigations in the House. Nonetheless, calls for impeachment proceedings from House Democrats are getting louder and appear more inevitable with each passing day and each defied subpoena, even with court rulings favoring Democrats to date. That could change as Trump takes his cases to Courts of Appeal or the GOP's stolen U.S. Supreme Court, as the Administration clearly hopes.

But, even conservative Republican Rep. Justin Amash (MI) is sticking to his guns following his weekend Twitter thread in which he declared the redacted report from Special Counsel Robert Mueller reveals that Trump "engaged in impeachable conduct," displaying a "pattern of behavior that meet[s] the threshold for impeachment." Amash pushed back against his fellow Republican critics in a new Twitter thread on Monday. The founding House Freedom Caucus member shot down a number of limp and uninformed defenses and excuses offered by Trump, his Attorney General Bill Barr and other apologists who wrongly claim the President could not have obstructive justice --- despite the mountain of evidence presented by Mueller of repeated instances --- because there was no "underlying crime" that Trump was attempting to obstruct. All of that, as Amash explains, is simply false from top to bottom.

Also today, more breaking news of yet another case of Republican absentee ballot election fraud, this time in Florida. The latest incident comes on the heels of a GOP absentee ballot fraud scandal that resulted in North Carolina calling a do-over election for this September after the State Board of Elections refused to certify last November's tainted contest in the 9th Congressional District. The newly exposed case was from earlier in 2018, in Miami, where a WhatsApp chat log obtained by the Miami New Times appears to reveal campaign supporters and organizers for a Republican running for a seat on the Miami-Dade's County Commission describing the theft and destruction of absentee ballots cast for their opponents. The incident offers yet more evidence that voting by mail --- unless absolutely necessary --- remains a terrible idea, as we have long argued (despite many Democrats, including lots of friends, readers and listeners in Oregon and other states with all Vote-by-Mail elections, who feel quite differently about it.)

They were just baby steps. Though perhaps notable ones. Time will tell. But Thursday may prove to be a landmark in a potential and greatly-overdue claw back of Congressional powers ceded long ago --- long before Trump --- to the Executive branch. Whether the actions taken by Congress (including no small number of Republicans) on three separate issues today signal a sea change in the way Congress regards its own Constitutionally co-equal mandates and powers remains to be seen. But their rebukes of President Trump were surprisingly clear. Three different Congressional votes on three different matters covered on today's BradCast underscore this issue. [Audio link to show follows below.]

1) On Wednesday night, the GOP-controlled Senate voted once again in support of a resolution to end financial and military support to the U.S.-enabled, Saudi-led war on Yemen that has resulted in an unparalleled humanitarian crisis. The effort amounts to the first Congressional rebuke of a President under the War Powers Resolution since its adoption in 1973. But the invocation of a resolution under the legislation which cedes Congress' sole Constitutional power to declare war may not be enough to prevent the Trump Administration's promised veto and continued support of war-making with the murderous Saudi regime and its Crown Prince Mohammad bin Salman.

2) On Thursday morning, the Democratic led U.S. House voted unanimously(!), 420 to 0, on a resolution to demand the public release of the final report by Special Counsel Robert Mueller, whenever that may happen, after it's delivered to Attorney General William Barr. The statute guiding the duties of the Special Counsel was adopted by Congress in 1999, but mandates only that the Special Counsel deliver a "confidential" report to the AG. Congress failed to specify whether that report must ever be released to the full Congress, much less the public.

3) After recent passage in the Democratically controlled House, the U.S. Senate on Thursday voted 59-41 --- including all Democrats and 12 Republicans --- to reject Trump's "National Emergency" declaration to steal money appropriated by Congress to the military in order to build his southern border wall. It's the first time since the National Emergencies Act of 1973 that Congress has exercised its option to try and block such a declaration. The effort comes after a week of intense lobbying of Senate Republicans by the White House to block the resolution, and by Senate Republicans to convince Trump to accept a compromise alternative or face an embarrassing rejection from his own party. Nonetheless, Trump has vowed to veto the resolution and there are not currently the two-thirds of members in each chamber to override Trump's veto. The matter will most likely be settled in court and, as we argue today, very likely in favor of the President, given the way the Act was written (also ceding more Congressional powers to the Executive Branch.)

If the nation is lucky, however, today could mark a turning point after decades of Congress giving away its powers. But our nation hasn't been very lucky of late.

  • Trump wreaks absolute havoc at the NATO summit in Brussels, makes ridiculous demands that lead to an emergency meeting of our allies, and then declares he's fixed it all. He hasn't. But, let's pretend, as he claimed, that NATO is now a "fine-tuned machine". (Does that claim ring a bell?) We offer a fact-check on Trump's actual ridiculous claims and the realities behind them;
  • Back at home, Trump-fueled chaos similarly breaks out at a joint hearing of the U.S. House Oversight and Judiciary Committees during public testimony by longtime top FBI counter-intelligence official Peter Strzok, whose private text messages to his girlfriend, another FBI agent, have been cause for Trump, the GOP and rightwing media to pretend that Special Counsel Robert Mueller's investigation was somehow part of a long "deep state" plot by the FBI to prevent Trump from being elected. Except he was elected. (Some plot!) And Mueller's probe has since resulted in dozens of indictments and guilty pleas from many top Trump campaign and White House officials. But we can keep pretending; In some remarkable audio from the insane hearing in the House today today, Strzok strikes back and helps reveal the Republican House witch-hunt against the Special Counsel for much of what it really is.
  • Speaking of reality, new data out from the U.S. Bureau of Labor Statistics and elsewhere reveals that not only have the Trump/GOP tax cuts from last December not resulted in increased pay for the "forgotten men and women" of the middle-class, as they'd promised, but workers are now actually making less than they did before the massive, deficit-blowing cuts which have resulted only in record profits for corporations and the already-wealthy;

On today's BradCast, it's like deja vu all over again. But with a Commander-in-Chief who is completely clueless about any of it and powerful adversaries who claim they are prepared to shoot back. [Audio link to show follows below.]

The President of the United States has no idea what he's doing, and is simply making up policy from minute to minute, according to a Washington Post report last night, detailing how White House aides are forced to scramble each day to either explain Donald Trump's actions "or clean them up."

"There is no proactive strategic thinking," one staffer told the paper. Another senior administration official conceded that aides are often forced to "reverse-engineer a policy process to match whatever the President said" on any given day. That may be workable, sort of, when it comes to something like Trump's announcement today that, after years of bashing the Trans-Pacific Partnership and pulling the U.S. out of it shortly after taking office, he is now considering rejoining the TPP after all.

But when it comes to sending the U.S. to war, Trump's erratic behavior poses a very serious danger. To that end --- as Trump has flip-flopped over the past week between demanding the U.S. pull its troops out of Syria within 48 hours, to publicly warning Syria's main ally Russia to "get ready" for incoming missiles, to reversing positions yet again to declare a U.S. attack on the war-torn nation "could be very soon or not soon at all" --- his Defense Secretary Gen. James Mattis was busy conceding to lawmakers in the U.S. House on Thursday that the Pentagon lacks evidence of the alleged chemical attack in over the weekend, reportedly carried out by the Syrian government against its own citizens in one of the last rebel-held areas near Damascus.

While noting that he "believe[s] there was a chemical attack," Mattis told lawmakers on Capitol Hill today "we're looking for the actual evidence" and admitted that even if inspectors from the international Organization for the Prohibition of Chemical Weapons (OPCW) get access to the site of the alleged attack, "we will not know who did it. They can only say that they found evidence or did not."

It's not the first time that Mattis has conceded we've attacked Syria in response to purported chemical attacks for which the U.S. had "no evidence".

Nonetheless, the media continue to report the weekend attack in Syria --- said to have killed more than 40 civilians with some form of poison gas --- as having been carried out by the regime of Syrian President Bashar al-Assad. Even as Mattis was admitting the lack of evidence the U.S. has to support the charge, NBC News was busy reporting breathlessly and unskeptically, in an eerie echo of the run-up to the U.S. war(s) against Iraq, on claims from two unnamed "U.S. officials" citing "blood and urine samples from last Saturday's deadly attack in Syria that have tested positive for chemical weapons." It's like deja vu all over again, but with a clueless President and powerful countries like Russia and Iran already having warned that they are prepared to retaliate against any attack against the Syrian government by the U.S. or its allies.

In not-entirely-unrelated news today, as Trump continues to lie about "voter fraud" in the 2016 election (and about everything else), an alarming new study from Politico finds that voters with less access to local news voted in larger numbers for Trump in 2016 than they did for Mitt Romney in 2012. At the same time, the study reveals, those with more access to such news sources voted in higher proportion for Hillary Clinton.

The findings come as the rightwing Sinclair Broadcasting Group, the nation's largest owner of local TV news outlets, attempts to receive FCC approval to buy up enough local stations to reach some 72% of American households. While public push-back against the effort builds, the pro-Trump broadcast behemoth is revealed to be using the public airwaves at their own currently-owned stations (and websites) to lie about the mounting criticism against their practices.

Finally, Desi Doyen joins us for the latest Green News Report on Shell's recently revealed decades long knowledge that their products cause global warming, and the mountain of scandal that continues to engulf Trump's embattled EPA Administrator Scott Pruitt...

Guest: Carroll Muffett of Center for International Environmental Law...

We unpack alotta long cons on today's BradCast, some of them decades in the making. Among them: Trump's new position on U.S. war in places like Syria, versus his position before he became President; GOP House Speaker Paul Ryan's position on deficit spending before he and Congressional Republicans exploded the deficit and he announced on Wednesday he's retiring from the U.S. House; And, Royal Dutch Shell's position on the dangers of global warming before a new, recently revealed treasure trove of internal company documents going back to the 50's revealed their real position on the matter. First up today, Donald Trump prepares to go to war in Syria and, despite mercilessly criticizing previous Presidents for revealing their intentions before taking military action, does exactly the same today on Twitter, in order to give a warning to Syria's top ally, Russia. That, despite unanswered questions about who was actually behind a recent reported chemical attack in a rebel-held town in the war-torn nation, the U.S. Congress' failure to authorize any such military action, as per the Constitution, and the threat that both Russia and Iran say they will target a response to efforts by the U.S. and its allies in the region like Israel.

Next, U.S. House Speaker Paul Ryan decides to call it quits, rather than risk losing his re-election bid this November in a predicted "blue wave", just after a new report from the non-partisan Congressional Budget Office (CBO) projects trillion dollar budget deficits as far as the eye can see, thanks to the GOP/Trump tax cuts and their recent spending bill. So much for the long-time, so-called "budget hawk" that Ryan (and Trump) pretended to be, while spending years attempting to gut Medicare, Medicaid and Social Security for Americans.

Then, we're joined by CARROLL MUFFETT, President and CEO of the Center for International Environmental Law to discuss a remarkable trove of recently unearthed internal documents from Royal Dutch Shell, revealing that the oil giant, just like Exxon and Mobil Oil before them, have known for decades about the threat of global warming caused by the burning of fossil fuels.

Muffett describes the newly unearthed documents, as detailed in their jaw-dropping new report, "A Crack in the Shell" [PDF], which shows that, as long ago as 1958(!), Shell was well aware of the dangerous consequences of carbon dioxide in the atmosphere caused by the burning of oil. And, as early as 1962, as the documents reveal, even urged internally "a "serious consideration of the maximum utilization of solar energy".

"The earliest document that we have with respect to Shell," he tells me, "was a report for the oil industry's Smoke and Fumes Committee that was reporting on research that the industry was funding into a variety of air pollutants. And even in 1958, one of those air pollutants was the pollution of the atmosphere by carbon from fossil sources."

"By 1962, we can demonstrate that Shell's chief geologist was very explicitly acknowledging the links between Shell's products and carbon dioxide from fossil fuels, and the potential for global warming," says Muffett. "So much so, that this scientist even highlighted the recommendations of other scientists that the switch to solar energy should begin as soon as possible."

Despite their scientific knowledge, as Muffett details today, the company eventually joined others in downplaying the threat of man-made climate change and now, according to the longtime attorney and leader in the newly emerging field of legal responses to global climate change, may face increased exposure for their part in our ever-worsening climate crisis.

"We see a remarkable transformation that goes on between 1988 and 1991, where the company is acknowledging these risks, and then by the mid-90s, Shell is, as with other oil companies, actively promoting uncertainty, and the need for inaction instead of action, in the face of mounting evidence," he explains, adding: "What we can now show, and this is very legally relevant, is that for decades, Shell was aware of those risks, and it continued to take those risks on the assumption that, ultimately, it would be consumers and governments that bore the cost, rather than Shell itself."

Finally today, a renewed bi-partisan effort emerges in the U.S. Senate to protect Special Counsel Robert Mueller from being fired by the President. But, with GOP leaders like Mitch McConnell in the Senate and Ryan still in the House, the legislation may not get very far, even as Trump continues to fume --- and lie --- about the ongoing probe.
