On today's BradCast, I’m in for Brad and Desi today – Angie Coiro, of In Deep with Angie Coiro.

My guests are AMBER McKINNEY, from Law360, discussing the DACA ruling from the 9th circuit and Trump’s latest royal edicts on immigration; and D.D. GUTTENPLAN, editor-at-large at The Nation, and author of the new book The Next Republic: The Rise of a New Radical Majority.

Of course, we have to start off with a lovely story: the Wall Street Journal reports that Donald Trump's been caught red-handed, connected directly to the hush money sent to former mistresses.

Then it's onto the two ongoing big stories: horrific fires in Northern and Southern California, and the elections grinding on in Florida, Arizona, and Georgia. Both the NAACP and a passel of retired generals have weighed in against GOP interference.

Guest: Karen McKim of Wisconsin Election Integrity...

On today's BradCast: The three stories we cover at the top of today's show --- another long-range missile launch by North Korea, GOP tax cuts for the wealthy moving forward in Congress, and a Trump-appointed federal judge who just decided in favor of Trump (and seemingly, against the rule of law) in an unprecedented battle for leadership of a federal agency --- all underscore the importance of the rest of today's disturbing program. [Audio link to full show is posted below.]

An effort just before the Thanksgiving holiday by citizen volunteers at WisconsinElectionIntegrity.org (WIE) finds that inaccurate results were certified in Wisconsin's 2016 Presidential election, which Donald Trump is said to have won by just 22,000 votes over Hillary Clinton, out of some 3 million ballots cast.

Wisconsin was one of three states, along with Michigan and Pennsylvania, where Green Party candidate Jill Stein had filed for "recounts" and forensic audits of voting systems, after the Clinton Campaign declined to heed the pleas for such an audit by computer scientists and voting systems experts who begged her campaign to do so. Stein's post-election effort was largely stymied by Team Trump and various statutes in each of those states. A statewide tally was allowed to move forward in Wisconsin, however only about half of the state's ballots were hand-counted, as municipalities were allowed to carry out their choice of either manual- or machine-tallied "recounts".

After finding an alarming number of uncounted ballots in Racine County precincts during last year's machine "recount" (see documentary filmmaker Lulu Friesdat's alarming coverage of election officials refusing to hand-tally clearly valid votes there during Stein's attempted "recount") the volunteers at WIE filed, and paid for, a public records request to examine the hand-marked paper ballots in a number of those wards.

Recently, they were allowed to review those ballots and, as they feared, many perfectly valid votes had gone uncounted by the optical-scan systems both during the original Election Night tally and the so-called "recount" in counties that used the same faulty computer scanners for the second count, after they had similarly mistallied ballots on Election Night.

I'm joined on today's show by longtime election integrity advocate and WIE's statewide coordinator KAREN McKIM to discuss the group's findings, revealing that the ballot scanning computers used in some 57 municipalities across the state had failed to tally anywhere from 2% to 6% of the ballots with valid Presidential votes in each of the Racine precincts they were allowed to examine a week or so ago. In other WI cities which chose to count by hand during Stein's "recount", McKim tells me, those same scanners had originally missed anywhere from 9% to 30% of valid Presidential votes! All of that in a state which Donald Trump is said to have won last year by less than 1%.

"They were ignored by the voting system entirely," says McKim, "and that's what made the miscount - or should have made the miscount obvious to the election officials even before they certified. You could look at those election results that the voting machines spit out on their face and you could see that hundreds of votes were just missing. If you compared the total number of ballots cast to the total number of presidential votes counted, you should have known --- they should have known --- that two percent of the voters didn't go to the polls so that they could cast a blank ballot. The miscounts were obvious at the time of the canvas, and the county officials did nothing about it."

Nearly a year after the election, in late September of this year, the state Election Commission finally decertified the 20-year old Optech Eagle computer tabulators, after finding that the systems fail to tally votes at all if the "wrong" type of ink is used to make selections by the voter. The same systems are still used, according to Verified Voting, in other states, such as Indiana, Massachusetts and Virginia, and may be used again in Wisconsin next year, as the state decertification allows municipalities to wait until after the November 2018 mid-term elections to replace them.

McKim, however, tells me that those faulty machines don't necessarily explain "the really widely varying error rates from precinct to precinct. ... Why the city of Racine machines were missing more votes than the suburban machines? I don't know. You'd really have to do a forensic investigation to figure that out." But, of course, Stein was not allowed such an investigation in any of the states where she sought them.

If it weren't for Stein's attempted audit, she says, the problems may have gone completely ignored. "The poll workers noticed the missing votes when they closed the polls that night. They noted it on their inspector's reports. The municipal canvas looked at it, and I talked to the Municipal Clerk, and she said, 'I didn't know what we were supposed to do about this, so I certified it and sent it to the County Clerk.' And then the County Clerk looked at those results. She too --- and again, you could not ignore a miscount of that size --- and she just said, 'Well, it's the municipality's job to send me the accurate results. Whatever they send me, it's not my job to correct it.'"

"There is not a county in the state of Wisconsin where the county election officials check accuracy of the vote totals. They all just certify by looking at the computer tape and saying, 'Oh, look who won.'"

McKim, who is a retired quality-assurance manager, says "Every other manager that uses computers, from your grocery store to the bank to the city treasurers, they all know and accept that their computers are going to miscount from time to time. So they have routine procedures in place to check and correct before it's too late. Election administrators are the only computer-dependent managers we allow to get away with not checking the computer output for accuracy. It's insane."

"The county canvass procedures clearly allowed massive miscounts, obvious miscounts, just to go undetected and uncorrected. And that's unacceptable," she added, going on to detail what the group plans to do next, and how computer tabulation systems other than the Optech Eagle, "new or old", should never be trusted for use without citizen oversight.

Corporate media falls for 'Trump pivot' again. Callers ring on on that, VA finally decertifying touch-screen voting systems, and much more...

On today's BradCast, the corporate media fall for it again. They always do. [Audio link to full show follows below.]

Over the past several days, following Donald Trump's agreement last week with the Democratic Congressional leadership to extend the nation's debt ceiling (to pay our bills!) and continuing funding the government for another three months, the corporate media have been falling over themselves to declare "Trump the Independent" (AP)! A President who is "upending 150 years of two-party rule" (NYTimes) and out-Bull Moosing even Theodore Roosevelt as a "populist dealmaker able to cut through the mores of Washington to get things done" (WaPo), as he finally carves out a "bi-partisan path" forward!

We open the phone lines today to tons of callers to see if they're buying that ridiculous narrative from an easily-played corporate media any more than I am.

Also today, as we try to begin catching up with some important news that has otherwise gotten washed away in recent days by Hurricanes Irma and Harvey, the Virginia Board of Elections has finally decertified the easily-manipulated, oft-failed, 100% unverifiable touch-screen voting systems used in some 22 voting jurisdictions in the state. The race is now on, in advance of their gubernatorial election this November, to replace them with verifiable paper ballots systems.

Then, after more calls on that as well, Desi Doyen joins us for the latest Green News Report, with the continuing aftermath of the devastating and deadly Irma disaster, and a few folks who are pushing back against climate change denialism from several different surprising places...

During the process of building support for turning my novel Cassandra, Chanting into a movie (working title Ballot Holes), several have asked me why I published Cassandra anonymously in 2008. In Cassandra, I imagined foreign powers infiltrating voting machine companies to steal a presidential election…not because they care who won, but because they know this is the clearest shot at undermining American democracy.

In Greek mythology, as I detail in the book, Cassandra was the Trojan beauty with the gift of prophecy. She was eventually cursed by Apollo to make certain that her prophesies would fall only on deaf ears. (More about the novel, Cassandra, below. Read The BRAD BLOG's 2008 review by Ellen Theisen here.)

The decision to publish near-future prophecy anonymously was not hard at the time. As an insider at a voting machine company and someone who is critical of the federal Election Assistance Commission (EAC), I didn't want the challenges with respect to EAC certification to become more difficult. The EAC creates the rules by which electronic voting and tabulation systems must comply in order to be used in states which require federally certified machines. In some cases, the rules are onerous and do not result in better voting systems. At the time, I was an executive and major shareholder in the Populex Corporation. We had developed a voting system that allowed voters to use a computer to mark a paper ballot, to then be tabulated by an optical-scan system, or even by hand. (Similar so-called "Ballot Marking Devices" or BMDs are currently in development in places like Los Angeles County in California.)

Complying with the EAC rules (and they change them from time to time) is a very expensive proposition. A book about the dangers posed by our then current (and, mostly still-in-use) electronic voting systems, many of which had previously received EAC approval, might have been seen as a slight to the EAC. Although our company had received EAC approval, it was best not to do anything that they might consider tweaking them...

The Peach State faces yet another contested election following more than a decade of election failures, vulnerabilities and repeated warnings...

"I worry that what we have here in Georgia is the Titanic Effect," Georgia Tech Computer Scientist Richard DeMillo observed, regarding the myriad security issues revealed during the course of last month's U.S. House Special Election in Georgia's 6th Congressional District.

"Georgia officials are convinced the state's election system cannot be breached. Shades of the 'unsinkable ship'. They have neglected to give us life boats...a fail-safe system designed so that in case of a catastrophe Georgia voters can easily verify that reported vote totals match voter intent. It is the sort of common-sense approach that first-year engineering students learn. Other states have that capability. Inexplicably, Georgia does not," DeMillo said in a statement quoted in support of a legal challenge filed contesting the 100% unverifiable results of the June 20 contest.

The computer scientist's concerns are hardly the first expressed about Georgia's absurd voting system. In fact, they cap well over a decade of chilling revelations, shocking vulnerabilities and dire warnings issued from the community of experts who have examined the Peach State's voting system, including a number of those who installed it in the first place back in 2002.

For election integrity advocates, the allegations set forth in the July 3 complaint (Curling II) --- filed by the Coalition for Good Governance and a multi-partisan (Republican, Democratic and Constitution Parties) group of electors --- should be enough to make their hair stand on end. That's especially true as it relates to official intransigence and even outright hostility towards computer scientists and researchers who revealed critical vulnerabilities within the state's 100% unverifiable and Orwellian-named Diebold "AccuVote" TS touch-screen voting and tabulation system.

Curling I involved an earlier unsuccessful effort, filed just prior to the election, to secure a temporary restraining order that would have compelled Georgia to use paper ballots during what had become the most expensive U.S. House race in American history.

With the exception of a relatively small number of verifiable paper absentee ballots, Georgia 6th Congressional District electors were forced to cast their votes into electronic black holes. The result: an "election" in which Republican Karen Handel reportedly defeated Democrat Jon Ossoff 51.9% to 48.1%, despite almost all pre-election polls predicting an Ossof win, with some surveys finding the Democrat with a 7 point lead over his Republican opponent. The touch-screen "victory" for Handel, the state's former Secretary of State, is now being contested in Curling II precisely because the reported results were produced by a wildly vulnerable and 100% unverifiable e-vote tabulation system.

As Brad Friedman accurately reported in his first BradCast following Election Day, the results "may be absolutely right or completely wrong...Nobody knows for certain either way...[What we] do know, according to the state's reported results, [is] that Democrat Jon Ossoff defeated Republican Karen Handel in GA-06 by a nearly 2 to 1 margin on the only verifiable ballots used in the race, the paper absentee mail-in ballots"...

There are several basic election integrity truths that have escaped the attention of most Americans, even as they confront the scope of alleged Russian cyber intrusions into America's disparately run, local elections systems.

[Despite repeated assurances from U.S. officials that hackers didn't go so far as to alter vote counts, Department of Homeland Security officials concede that they failed to run an audit in order to determine whether the 2016 vote count had been manipulated by anyone, be they hackers, foreign or domestic, from Russia or anywhere else, or by election insiders whose direct access could facilitate a malicious, or even accidental, manipulation of vote totals. The mainstream U.S. media has also raised concerns that the United States, under the Donald Trump administration, is not doing enough to prevent hacking or manipulation of the 2018 and 2020 elections.]

The first basic election integrity truth is that, as The BRAD BLOG reported in 2009, following a stark presentation by a U.S. intelligence officer to the nation's only federal agency devoted to overseeing the use of electronic voting and tabulation systems, all electronically stored and/or processed data --- registration records, poll books, ballot definition scripts and, most importantly, computerized vote tabulators --- are vulnerable to malicious cyber intrusions.

"I follow the vote," CIA cybersecurity expert Steven Stigall warned members of the U.S. Election Assistance Commission (EAC) in a 2009 field hearing in Florida. "And wherever the vote becomes an electron and touches a computer, that’s an opportunity for a malicious actor potentially to…make bad things happen."

The second basic truth is that election system vulnerability is not confined only to malicious hackers, who may or may not be Russian. All electronic vote tabulation systems are vulnerable to election insider manipulation.

The third is that paper registration forms, poll books and hand-marked paper ballots are not, in and of themselves, vulnerable to electronic manipulation. (Paper ballots, of course, are not entirely risk free. Even before the advent of e-voting, there had been cases of ballot box stuffing. But it was the advent of central computerized/electronic tabulation that created a vulnerability to wholesale electoral theft by a "conspiracy" as large as one person, with little possibility of detection.)

The fourth is that the only way to ensure a transparent and verifiable count, one that can be overseen and confirmed the public, is to deploy what Brad Friedman aptly describes as "Democracy's Gold Standard": hand-marked paper ballots, publicly hand-counted with the verifiable results posted at each precinct on Election Night before ballots are moved to any other location.

The fifth is that the core issue in election integrity is not whether a given result is or is not the product of election fraud. Instead, as recently observed by Austria's Supreme Court, the issue is whether election officials have complied with procedures that are designed to ensure the integrity of a transparent and verifiable result.

Unfortunately, these basic democracy-sustaining truths, which have been judicially recognized in other nations, have been largely ignored by the U.S. mainstream media, the political leadership of both major U.S. political parties, and, critically, by our courts --- a point that truly came into focus with respect to the recent U.S. House Special Election in Georgia's 6th Congressional District...

On today's BradCast, the release of a leaked NSA analysis of alleged cyberattacks on voter registration systems and attempted intrusions into the computers of local elections officials just before last year's Presidential election underscore, once again, just about every warning regarding U.S. electronic voting, computer tabulation and voter registration systems that we've been yelling about for some 15 years on both The BradCast and at The BRAD BLOG. [Audio link to full show follows below.]

Today, we break down the specific details found in the leaked NSA documents published by The Intercept on Monday, how they highlight a much broader problem with the U.S. electoral system, and what the answer, at long last, must ultimately be in response to concerns about manipulated election results, no matter who the alleged or attempted culprit. (In this case, the U.S. intelligence services blame Russian military intelligence, which they deny. Either way, as detailed on today's show, it doesn't actually matter!)

On a not-at-all unrelated note, we are then joined by Marilyn Marks of the Rocky Mountain Foundation to discuss her lawsuit, filed with members of Georgians for Verified Voting, demanding hand-counted paper ballots for all voters in the upcoming, highly contested U.S. House Special Election runoff in Georgia's 6th Congressional District between Democrat Jon Ossoff and Republican Karen Handel.

Marks, a former Republican mayoral candidate turned long-time Election Integrity expert, details some of the many concerns spelled out in her suit (Complaint here [PDF], TRO Motion here [PDF]) regarding the state of GA's 100% unverifiable Diebold touch-screen voting systems, and the known cyberhacks, e-pollbook thefts and computer tabulator failures that have already plagued the most expensive U.S. House race in history, where early voting is already underway in advance of the bellwether June 20 contest.

"There were so many things that have happened since March 1st," Marks explains, describing many of the problems that have already undermined this election. "As you've pointed out, these systems --- when you say they are 'unverifiable', what people need to understand by that, of course, is that there is no way to assure that the voter's intent is recorded. We know what the machines want to report. But there is no way to know what the voter intended to vote. We do know that with the evidence of a paper ballot. So, that is what we are telling the court, that this system has gone through so many problems. It was unverifiable to begin with. And now we have seen the instances of several problems, just in the last 60 days, that tell us there is no way that the Sec. of State and the county election officials should assume that the system is safe to vote on. They must presume the system is unsafe."

The plaintiffs request, she says, "is a simple one. And that is: let voters vote on paper ballots."

"The only practical answer is to go to paper ballots [and] hand count them," Marks tells me. "It would be very easy to do. We've had a professional estimate how long it would take --- less than an hour per precinct. It would actually be faster, cheaper, more efficient and far more transparent to vote on paper ballots in this simple election than it is to use the machines." Indeed, with just one contest on most of the ballots in this Special Election, hand-counting would amount to little more than separating ballots into two stacks, one for each candidate, and then counting each stack. It is what we have long described as "Democracy's Gold Standard."

Marks goes on to cite the concerns illustrated, once again, by yesterday's leaked NSA documents and argues: "You talk to any computer scientist, regardless of what party they are, you talk to any voting systems expert, I don't think you'll find a single expert, a single computer scientist who would say these machines even approach the point of being safe to vote on. And it has nothing to do with their politics."

"We must have transparent elections where the public can oversee the counting of the ballots. And in Georgia, there is no oversight. No one --- not the election official, not the public, not the campaign, not the candidate --- no one can figure out whether or not the ballots are counted right."

But does her lawsuit have a chance this late in the game, with early voting already under way? Tune in for her response to that and much more, including her thoughts on how GA's Sec. of State Brian Kemp, also a Republican, has responded so far to both Marks' complaint, and an earlier request, prior to the GA-06 primary, from dozens of the world's top computer security and electronic voting systems experts.

Yes, elections still matter. But, as computer security expert Bruce Schneier told The Intercept yesterday: "To the extent the elections are vulnerable to hacking, we risk the legitimacy of the voting process, even if there is no actual hacking at the time. It's not just that it has to be fair, it has to be demonstrably fair, so that the loser says, 'Yep, I lost fair and square.' If you can't do that, you're screwed."

We're screwed.

Yemen raid debacle; Drumbeat for war in Iran; DeVos confirmed; Dakota Access approved; Repubs move to scrap U.S. election protection agency...

On today's BradCast: If those friendly to America are rising up against Donald Trump's disastrous Presidency, imagine what our actual enemies think! Well, we don't have to imagine quite as much as of today, even as Republicans in Congress continue their work to undermine American democracy. [Audio link to full show follows below.]

Donald Trump's Yemen raid last week --- the first special ops mission he approved after becoming President --- was an unmitigated disaster during which a U.S. Navy SEAL was killed along with a number civilians, including an 8-year old American girl. The target was reportedly meant to be the leader of al-Qaeda in the Arabian Peninsula, who is still alive and well and mocking Trump this week, even as White House Press Secretary Sean Spicer ridiculously declared the failed mission "a successful operation by all standards."

Also mocking Trump today is the Supreme Leader of Iran, who thanked the new President for "showing the real face of America" after Trump banned Iranian travelers and put the country "on notice" in a Tweet last week, threatening military action and emboldening Iran's hardliners in the process of an increasing alarming drumbeat toward war. (Corporate media chasing all of Trump's idiotic statements may want to start paying much closer attention to this. Please?)

Back at home, the President's wildly controversial and wholly unqualified nominee for Education Secretary, billionaire Betsy DeVos, became the first cabinet nominee in history to be approved by the U.S. Senate after a tie vote in which the Vice President had to cast the decisive vote. At least this time the Democrats finally stood unified in voting against DeVos, along with two Republican Senators who joined them.

In the meantime, while The Netherlands announces that, due to hacking fears, they will do away with computer tabulation machines in favor of hand-marked, hand-counted paper ballots ("Democracy's Gold Standard") for their upcoming election, Republicans in the U.S. House moved to abolish the U.S. Election Assistance Commission (EAC), the only federal agency tasked with setting standards for our nation's oft-failed, easily-hacked electronic voting and tabulation systems.

As explained in detail on today program, the EAC has been a disaster on several levels since its creation following the 2000 Presidential election debacle in Florida. Among countless BradBlog.com stories highlighting their failures over the years, was our 2006 exclusive on the un-aired network interview with the EAC's first Chair, the Bush-appointed Rev. DeForest Soaries. He described the agency in the interview as a "charade" and warned that our computerized voting and tabulation system is "ripe for stealing elections and for fraud." (Also, as mentioned today, see the chapter I contributed with Michael Richardson and John Gideon to Mark Crispin Miller's Loser Take All, revealing how, in 2004, Nevada's then Sec. of State, now U.S. Senator Dean Heller illegally certified and lied about his state's touch-screen voting systems, which are still in use today, with an assist from the corrupt EAC.)

Nonetheless, despite its many failures, the answer to the EAC's problems is not to abolish the agency, but to fund it properly and make it work. That the GOP is prepared to eliminate it entirely --- even amidst Trump's false claims of millions of fraudulent votes cast in the 2016 election --- is quite telling.

It's another very busy day today on The BradCast with terror attacks in Europe, the Electoral College vote in the U.S., and our continuing attempt to figure out if the votes in Election 2016 were actually tallied as per voter intent. [Audio link to show posted below.]

Despite thousands of protesters at state capitols around the nation today, there were only a few defectors (so-called "faithless electors") for both for Donald Trump and Hillary Clinton, as the Electoral College finally cast its votes today in 50 states and the District of Columbia. As of airtime, despite receiving a almost 3 million fewer votes than Clinton nationally, Trump had just received the requisite 270 votes, a majority of the Electoral College, needed to win the Presidency today. Presuming all state totals are certified by the U.S. Congress on January 6th (and I see no reason they wouldn't be), Trump will be sworn in as the 45th President of the United States on January 20th.

In the meantime, late last week, we learned that the U.S. Election Assistance Commission (EAC) --- the federal agency responsible for certifying the accuracy and security of electronic voting and tabulation systems used across the U.S. --- was, itself, recently hacked, with about 100 user names and passwords put up for sale on the black market. The well known vulnerability exploited was one that experts say could have been easily patched (it has now been) and would have allowed access to a database of vulnerabilities in the nation's voting and tabulation systems.

The Commission might have patched its own system earlier, but its Commissioners were very busy before the election and after, ensuring the nation (in an op-ed that was incorrect and misleading on innumerable levels) that "election officials have been working to secure our voting systems for years," so concerns about any such manipulation of results "are overstated".

Then, my guests today are Lulu Friesdat, filmmaker of the award-winning election integrity documentary Holler Back: [not] Voting in American Town (which I am in, but it is excellent anyway) and longtime election integrity advocate Emily Levy of RecountNow.org. Both are just back from attempting to help oversee the statewide Presidential election "recount" in Wisconsin, as requested (and paid for) by Green Party candidate Jill Stein.

Friesdat shares her short, disturbing new video released on Friday, revealing what appear to be machine mistallies noted by observers during the statewide "recount" of ballots by computer optical-scanners in Racine County, WI, and a stymied attempt by one observer there, Liz Whitlock, to get a hand-count of the paper ballots in question. Citing the 5% error rate by the machines that observers tallied in one small precinct in WI, Friesdat notes: "A similar error rate applied across all of Wisconsin’s 2,976,150 votes --- could produce an error of 140,000 votes. Trump won Wisconsin by 22,000 votes."

Levy explains a troubling report from the attempted Presidential "recount" in Nevada (yes, there was one there too!), as filed by independent candidate "Rocky" De La Fuente. There, in the state said to have been won by Hillary Clinton, Clark County Clerk Joe Gloria appears to have admitted to secretly "recounting" votes prior to the lawful, public count of votes cast on the county's absentee paper ballots and completely unverifiable touch-screen voting systems. (In the 2004 Presidential "recount" in Ohio, two election officials were convicted and sentenced to the max for doing something similar in that state.)

As both explain on today's program, the long list of failures in the "recount" cases (and they describe many more such failures) have left both Friesdat and Levy even more concerned about the accuracy, security, reliability and ability to oversee our own election system than they were even prior to Election 2016. So, what can we all do about it? How can the system be improved to allow more transparency and oversight? We discuss all of that on today's show as well --- and it starts with you...

Please read the cover story of Politico Magazine today headlined "How to Hack an Election in 7 Minutes". Ben Wofford's excellent, comprehensive feature summarizes a great deal of almost 15 years of our work here at The BRAD BLOG. He focuses his piece on the core of computer science and cybersecurity experts initially working out of Princeton University back in 2005 or so, who have, since that time, gone on to publicly hack virtually every electronic voting system and tabulator still in use around the country (and even, looking forward, hacking at least one planned Internet Voting scheme.)

We've covered and/or broke the news about many of those landmark exploits, both here and on the radio, going back through 2005 or so. I don't have time to collect all the links here at the moment, but it's very nice to see so many of them rounded up so thoroughly in Wofford's piece.

The 8,500+ word article is far too detailed to adequately summarize, or even quote from in detail here. So please go pour a tall drink or cup of coffee (you may need several, there's a lot there) and go read about the "parabola of havoc and mismanagement that has been the fifteen-year nightmare of state and local officials", as he accurately describes it, following the horrifically misguided and ill-advised move to computerized voting and tabulation systems following the 2000 election. I suspect we've filed almost as many articles on this topic as Wofford has words in today's piece!

But there's one element of his piece I want to ring in on specifically, as I think it represents something a bit more encouraging from the computer scientists who are discussed in the report than I have seen over the years...

MSM, Repubs and Dems finally decide e-voting and tabulation a concern...

On today's BradCast, we examine charges made by Donald Trump of a rigged November election, the case made by Bernie Sanders supporters that Hillary Clinton may have won the primary due to election fraud, and the mainstream corporate media finally deciding that, yes, hacked voting and tabulation systems really are a threat to American elections. [Link to audio of today's program follows below.]

It's fun (not really) to see corporate media outlets --- once again on the eve a major election --- suddenly very worried about so much of what we have been reporting (see, literally, thousands of stories at The BRAD BLOG and on The BradCast) about the vulnerability of the U.S. electoral system. We've been warning of exactly that for more than a decade.

The recent concerns follow the hack of DNC emails, said by Dems to have been carried out by Russian intelligence agencies, months of charges of "election fraud!" from Sanders supporters, and now new charges from Trump and friends that the Presidential Election will be stolen by Dems this November by electronic voting machines or voter fraud (or whatever the hell he and his supporters are now sputtering.)

It might all have been more fun had all of the above noticed these concerns years ago, rather than right after what some believe is a stolen election and right before one that some believe could be stolen. Ya know, back when there would have been time to move to transparent voting and counting systems instead.

Nonetheless, with those real concerns --- from all sides --- of hacked, stolen, manipulated or just plain erroneously reported election results, I note that "concerns" are not proof of fraud. So, today, we examine the various arguments, including some detailed thoughts --- both critical and complimentary --- on a new 100-page draft report [PDF] by Election Justice USA, titled "Democracy Lost: A Report on the Fatally Flawed 2016 Democratic Primaries".

Their report (and others making similar charges in recent months) details what EJUSA believes to be proof and/or evidence of fraud that benefited Hillary Clinton during the primary. In stark summary (much more detail offered on today's show itself!), the group's evidence of voter registration fraud in some locations is disturbing, if not completely unlike what we've seen in previous elections. But, I am somewhat less moved by their evidence of electronic voting and tabulation manipulation, as based largely on analysis of disparities between Exit Polling and reported election results. I try and explain why I am not particularly persuaded by studies of Exit Polls in regard to U.S. elections, and why, frankly, my response to their report would be similar whether they found proof of fraud or proof of zero fraud in the election. In both cases I would say what I have been saying for years: We need publicly hand-counted, hand-marked, paper-ballots in this country in order to have real confidence in results. (That is what I've long described as Democracy's Gold Standard.)

Short of that, with computerized voting and counting systems that are difficult, if not impossible for the public to oversee, confidence in U.S. elections will continue to erode whether fraud or error actually exists in the results or not. That, in and of itself, as I have shouted for years, continues to present a grave threat to America's system of representative democracy.

Guest: Lawrence Norden, co-author of Brennan Center's disturbing study
PLUS: Walker drops out, Fiorina moves up...

We've got a lot to cover on today's BradCast (in addition to welcoming about our newest affiliate partner, WLRI 93FM in Lancaster, PA!)

First, some Presidential politics, including the late breaking news of Republican superstar and Wisconsin Gov. Scott Walker plummeting to the bottom of the 2016 GOP race for President and then promptly dropping out. At the same time, failed businesswoman and successful fantasist Carly Fiorina has surged in to 2nd place nationallly, even as Fox "News", of all outlets, challenges her on her pretend memories of a deceptively edited Planned Parenthood smear video.

Then, Volkswagen admits that their cars were built to hoax emissions testing by only kicking in pollution controls when the cars' computers sensed that they were undergoing emissions tests!

That, sadly enough, is meant to take us to our main story today, the new report from Brennan Center for Justice warning that "America's Voting Systems are at Risk" [PDF]. My guest is Lawrence Norden, co-author of the new report with Christopher Famighetti, explaining how the electronic voting systems in at least 43 states are more than a decade old and could fail entirely at any moment.

"The biggest finding is that, in the vast majority of the country, machines are at or rapidly approaching the ends of their life spans, and that, right now anyway, in most places, there aren't plans or budgets to replace them," Norden explains. "With older machines also comes just a difficulty in finding replacement parts. They're often running on very old software which creates security vulnerabilities --- so there are a lot of reasons that we need to start taking this more seriously."

Those failing machines, he goes on to tell me, resulted in some 500-700,000 votes being lost in last year's election alone, thanks to long lines that occur when these machines fail to work at all on Election Day. There is also a racial disparity to go along with those numbers, as Norden details, because "wealthier counties are in a position to replace their equipment that is aging, and those that don't have those resources are not."

While the report is expansive, well-researched and, justifiably, received a decent amount of attention from mainstream media sources upon its release last week, I share my concern with Norden that, while the study covers so much of what we've known for years (and have reported, virtually non-stop, for more than a decade both here at The BRAD BLOG and on The BradCast), the study's recommendations to replace old electronic systems with new electronic systems that will have many of the same problems is quite troubling. Nowhere in the report are overseeable, fully transparent hand-marked, hand-counted paper ballot systems discussed, despite such systems being regarded by many as Democracy's Gold Standard.

I also share my concerns with Norden about the report's timing, coming out right now when it is largely too late to replace voting systems --- at least with new electronic systems --- before voting begins in the 2016 cycle.

Norden, who I've had lively debates with in the past on related issues, says the Center's report is "not favoring any kind of technology," even if it is clear that they are calling for computer technology over more transparent and overseeable hand-counted systems. "I'm not crazy about the idea of having people just vote on paper without some kind of notification of potential errors," he argues, "notification that their vote won't be read."

He also argues, in making his case that computers are "more accurate" than hand-counts, that "a lot of vote-by-mail is not counted", mostly due to voter error.

GUEST: Computer security expert Jeremy Epstein of Verified Voting...

Today we covered two stories I've been trying to get to for a while on The BradCast, and they're both related.

The first is the story of the state lottery insider who hacked the system to "win" a $14 million jackpot --- begging the question: if a state run lottery with a multi-million dollar security system can't protect against insider manipulation, how can a local election official do it, particularly with Internet Voting systems that partisans and profiteers continue to push for?

The second also relates to the first. Computer science and security expert Jeremy Epstein of Virginia Verified Voting joins me to discuss the immediate decertification of 1/5 of Virginia's voting systems after a state analysis found what many of us had been warning about for years: the AVS WINVote system is so simple to hack that, Epstein says, if it hadn't already been hacked in the decade its been in use there, "it was only because no one tried."

Democrat Derek Cressman fights for sunshine among a weak slate of candidates to oversee elections in nation's most populous state...

He makes a very cute campaign video. Please watch it above. It's quite clever. But it would be nice if California Secretary of State candidate Derek Cressman, one of two Democratic candidates vying for the job in the upcoming June 3rd primary, had a better understanding of the electronic voting systems he'd be overseeing as SoS.

I had originally intended to run the video above, because it's smart and fun, along with a throw-away remark expressing the wish that Cressman understood more about the very technical concerns about the security and verifiable of e-voting system --- particularly since the way CA deals with them has such a sweeping effect on the same systems as used across the country.

As a former Common Cause executive, Cressman has made his important fight to overturn the Supreme Court's abhorrent Citizens United ruling central to his campaign, as highlighted in the animated campaign video above. That's fine, but the office of Sec. of State, particularly in CA, requires much more.

Rather than offer that throw-away remark, however, I thought I'd see if Cressman had learned more about electronic voting systems since he and I briefly chatted in person at an event last summer, just as he was originally entering the race.

According to comments he sent in response to a recent query from The BRAD BLOG, while Cressman's general knowledge of the systems seems to have improved since we last spoke, and while he remains an ardent opponent of the madness of Internet Voting and some of the most unsecure methods of precinct-based voting, his understanding of the concerns about the vulnerability of e-voting remains troubling --- at least for a Sec. of State candidate in the nation's most populous state...
