In Stark Contrast to Current EAC Chair, Rev. DeForest Soaries Blasts White House, Congress in Transcript of Unaired Interview from Major Broadcast Network!

The BRAD BLOG has obtained an EXCLUSIVE partial transcript from a recent, unaired interview by a major broadcast network with former U.S. Elections Assistance Commission (EAC) chair Rev. DeForest Soaries.

Soaries was appointed by George W. Bush as the first chair of the commission created by the federal Help America Vote Act (HAVA) in the wake of the 2000 Presidential Election Debacle. In the interview, available here for the first time, Soaries excoriates both Congress and the White House, referring to their dedication to reforming American election issues as “a charade” and “a travesty,” and says the system now in place is “ripe for stealing elections and for fraud.”

Having resigned from the commission in April of 2005, Soaries goes on to explain that he believes he was “deceived” by both the White House and Congress, and that neither were ever “really serious about election reform.”

The explosive comments are the latest evidence highlighting serious deficiencies in the federal body, created by HAVA for oversight of elections systems, including new electronic voting devices, and standards for the use and security of those systems.

In the unaired interview, conducted last August, Soaries says there are “no standards” for voting systems and that Congress and the White House “made things worse through the passage of the Help America Vote Act.”

Due to underfunding and lack of attention to the EAC and the Election Reform it was supposed to oversee, Soaries says we now have an “inability to trust the technology that we use” to count votes in our American democracy, even as “we’re spending a billion dollars a week in Iraq.”

“We know more today about how to build a machine to take pictures of rocks on Mars than we know about how to build a machine to safeguard the American right to vote,” complained Soaries in the interview.

On Electronic Voting System standards — which HAVA mandated would be created by the EAC — Soaries blasts both the White House and Congress for failing to supply them with the needed resources to complete the mandate, both for the federal government and the states that were relying on them to do so.

“[T]he states were forced to comply and they were asking us for guidance. We were ill-equipped to provide guidance. We didn’t begin our work until January 2004 and we spent the first three months of our work looking for office space. Here we were, the first federal commission, responsible for implementing federal law in the area of election administration and for the first three months we didn’t even have an address. And we physically had to walk around Washington DC looking for office space. This was a travesty. I was basically deceived by the leaders of the House, the Senate and the White House.

“Someone has got to be able to say, no one in America should use machine ‘A’ ever again,” he says, in reference to the EAC’s failure to decertify electronic voting systems even after they have been proven to be easily vulnerable to hackers and tampering.

“And if it’s not EAC,” he continued, “it’s got to be someone. Someone in America has got to hold America accountable for protecting the most fundamental right in a democracy and that is the right to vote.

The straightforward comments from the EAC’s first chair are in stark contrast to the actions of his Bush-appointed replacement, the current EAC head, Paul DeGregorio. The outgoing chair, DeGregorio, whose term has now ended, made news several days ago when it was discovered he had allowed the commission to withhold the release of a May 2006 report revealing claims of epidemic “Voter Fraud” — as made by GOP operatives in order to push an agenda calling for restrictive, unconstitutional Photo ID laws at polling polaces — are wholly unfounded.

Where Soaries was disappointed at the lack of interest by officials for true reform by the EAC during his tenure, his successor appears to have been using the post as an arm of the White House to continue its manipulation and perversion of the American electoral system.

Rev. DeForest Soaries, Former U.S. Elections Assistance Commission Chair

“I resigned, effective April 30th, 2005 after having served through the 2004 elections and concluding that neither the White House nor the Congress was really serious about election reform.

“Florida 2000, the whole world watched America express embarrassment over the status of the Election Assistance Administration and by November 2004, we had not only not made significant changes but in many ways, had made things worse through the passage of the Help America Vote Act.

“After Florida 2000, the politicians were all on the soap box promising the country that we would ‘repair’ the problem and the problem was much more than hanging chads and lever machines. For instance, the Help America Vote Act mandates that an electronic voting machine be in every precinct in the country and that mandate preceded the funding of research necessary to ensure that there is some prototype or standard for such machines. If every home were mandated to have a microwave without the prerequisite kinds of safety standards for microwaves, it would be considered scandalous. But we know more today about how to build a machine to take pictures of rocks on Mars than we know about how to build a machine to safeguard the American right to vote.

“There is no prototype. There are no standards. There is no scientific research that would guarantee any election district that there’s a machine that can be used to answer these very serious questions. And so, my sense is that the politicians in Washington have concluded that the system can’t be all that bad because, after all, it produced them. And as long as an elected official is an elected official, then whatever machine was used, whatever device was used to elect him or her, seems to be adequate. But there’s an erosion of voting rights implicit in our inability to trust the technology that we use and if we were another country being analyzed by America, we would conclude that this country is ripe for stealing elections and for fraud.

“What was ironic that was each of us accepted our appointments knowing that EAC had no statutory authority to regulate. But what we were told was that EAC would have sufficient money to do research. And while regulatory authority was not present, we felt that if we could do the proper research, no state would be caught dead using equipment that didn’t meet up to the standards that our research proved were acceptable standards. Well, in the absence of regulatory authority and in the absence of money to do the research, we were basically asked to make bricks without straw.

“Well, the states were forced to comply and they were asking us for guidance. We were ill-equipped to provide guidance. And I decided that it just made more sense to spend my time watching my sons play basketball than to participate in this charade.

“While we’re spending a billion dollars a week in Iraq, we’re told at EAC, by both the White House and the Congress, here is how much we’re going to give you. You tell us what you’re going to do with it. They never asked us the question, what would it really take to lead election reform in this country. How much money should the country really spend not only on buying new equipment, but on doing the proper research before using that equipment and how much will it cost over the long haul to keep that equipment up to date and to repair such equipment. Those questions were not asked. So in my view, it was a just a charade that I would chose not to participate in.

“Most people who really know, like election officials. They pray on election day that the election is not close. Because if an election is not close, then the flaws are hidden. But it’s when you have this perfect storm of equipment failures like Florida and a close election where there’s a call for recounts and an inability to determine who won right away, that’s when the glaring issues emerge and when election officials begin biting their nails.

“Either EAC or some agency must have the capacity to hold the entire system, elections officials, public officials and the manufacturers of voting equipment accountable. Where there’s no accountability, then you’re open for fraud and for inefficiency. EAC has regulatory authority over the National Voting Rights Act but that’s a small piece of the voting process. Someone has got to be able to say, no one in America should use machine ‘A’ ever again. And if it’s not EAC, it’s got to be someone. Someone in America has got to hold America accountable for protecting the most fundamental right in a democracy and that is the right to vote.”

    While I don’t have any reason to doubt Reverend Soaries sincerity, like so many enablers of the Republican regime, his resignation would have been a much more powerful weapon for change in October of 2004 than it was in April of 2005.

    I guess it’s better late than never for those who held “party” over “country” to come around.

    He’s also one of those die hards who believe “the system is broken” rather than “the system is being gamed by the Republicans.”

    Not that any of this surprises those of us who are (or have been) regular readers here at Brad blog. This is just one of many topics that we’ve been griping about since the first ‘election’. I guess it does me good to see that there are Still angry and concerned citizens out there. Maybe it was the loooong period without internet connection, maybe it was the incredibly corrupt and apathetic town I just moved out of…but I’ve really been feeling like voting in this next election seems hopeless and pointless. What do you folks think? Have we made any progress? Is election reform possible in any real form? Would it make a difference?

    Would Soaries come forward and say WHICH network it was that killed his interview with them?

    Any lawyers out there on why Americans can’t bring a “class-action” lawsuit against the network? What they did by suppressing this story is a breach of the public trust of everyone who is registered to vote. It actually has inflicted injury and damages upon us (especially as taxpayers are paying big bucks for these vote-stealing machines).

    The objective of the study is to calculate a range of probabilities of the Democrats winning a specified number of the 58 elections, assuming various undecided voter allocations. The Democrats need to capture 15 GOP-held seats to gain House control.

    SIMULATION OBJECTIVE:
    Calculate a 25-scenario probability matrix based on
    a) 5 scenarios of undecided voters allocated to the Democrats and
    b) 5 scenarios of the number of captured GOP seats

    This is the KEY result:
    Even with the VERY CONSERVATIVE ASSUMPTION that the Dems will win just 50% of the undecided vote, there is a virtual 100% probability that they would WIN AT LEAST 30 seats, TEN MORE SEATS seats than are needed for a House MAJORITY.

    In a published study, challengers won the undecided vote in 82% of over 150 elections in which the incumbent also ran.

    In the MOST LIKELY SCENARIO (Democrats win 60% of the undecided vote), the Democrats are expected to win 32 of the 58 GOP-held seats. The probability is 99% that they will win 30 or more. Therefore, in order to retain the House, the GOP will have to steal a MINIMUM of 30 elections.

There is definitely something wrong here, and the existence of our democracy as we have know it is in grave danger. Don’t use these machines, use paper, at the very least we will have paper to be counted, if they let us count them. But vote all the same, we can’t let them scare us from voting.     Never say Die! I guess until your gratefully dead.
    Lets start using our angry energy and make some noise to our elected officials. Really, find out where your representatives offices are and stop in telling them exactly how mad you are and WHY!!!!! I went to a meet and greet last night with the gov. and I asked where he stood on voter verified paper ballots. Needless to say Blah, blah blah, money was about the response. So I then said, well what about for this election some emergency paper ballots because…………and he kinda listened, but said it’s really up to the counties at this point. So when the deal was over my friend and I were talking to the party leader in our county about the insane state of these god damn machines. I think we connected with him because he said he’d talk to our county comissioners (luckily same party) to the them to tell our election director to have at least half as many voters-emergency paper ballots available. We made sure he understood they were not to be provisional ballots, because they don’t get counted quite often.
    I’m gonna follow up, but I felt like finally some reponse. So take heart and get active!!!!!!!!!!

    Someone, somehow must find out which media outlet quashed this interview and expose them. Remember, the coverup gets more attention than the evil deed. I disagree that this will negatively effect voter turnout. It should energize the opposition to turn out in even bigger numbers. With the fix likely in, it is imperative that we turn out in droves and beat these crooks with such overwhelming numbers as to make fraud effective. I hope there is EXIT POLLING EVERYWHERE ON ELECTION DAY AS WELL. Exit polling is essential this time to add credibility to any challenge of unfairness.

    Thanks for keeping us posted on the polling situation, and please, keep it up till election day. Of course, they don’t need to steal all of these district elections, just half of ’em, which I have no doubt they will do. Calling all hackers for democracy! Dooo something! Don’t let ’em hack us!!! If it’s possible to hack so the Dem wins with 100% of the vote, that would be cool. Or better yet, the Green. That would force ’em to come up with a way to have free fair elections (how bout a pen marking a paper ballot? What a progressive idea!), and that’s what we want. I trust the people. I don’t trust my government; especially now!

    The only way I can see to fix it is to hack right back. I understand that lawbreaking isn’t in our natural make-up, like it is in that of the fascists; nevertheless, civil disobedience is in order here. I’d certainly do it if I knew anything about hacking… And I hope all y’all are ready to march in the cold and the rain; thousands strong if need be; to protest our election results…

    hubba hubba #26: Don’t worry about using blogs as sources, use blogs as sources for citable INFORMATION. Most good blogs (and this is definitely one) expect (sometimes demand) that their posters put up links to primary research or evidence. Use THAT evidence.

    We are using the blogs to create a communications framework that bypasses the mainstream media to DISSEMINATE NECESSARY INFORMATION. Only DailyKos and some of the other “mainstream blogs” are actually trying to BE content and control or limit the flow of information or discussion.

    As for Democrats not buying newspapers, it must be happening, because our local mainstream media and Republican appeaser rag (THE OREGONIAN) is suffering terribly and literally GIVING AWAY subscription.

    One of the first new House acts must be a strong vote for honest elections.

    The house should not seat those members in districts where fraudulent vote totals are suspected. Democrat or Republican. The FBI should be directed to investigate immediately, with all available resources. A special committee should be established by the speaker. The committee should report back to the full house, every 10 days, of the progress that has been made.

    The overwhelming stench of fixed elections can be dealt with, up front, by not seating the members.

So that would be the Republican House, controlled by Republican Dennis Hassert, and voting lock-step for its own REPUBLICAN PARTY without regard for the Constitution or Bill of Rights (as it has for the last 6 years).

    We will get no satisfaction from this congress. AFTER January, if we control the House, then that’s a whole different kettle of fish.

    As a professional academic, I have told Brad that we all read the blogs … but we pretend we don’t. Brad is on his way to winning a Pulitzer Prize (I may even have had a few former students at Columbia who we can get on board) if (sigh) he would stop posting the nutsy conspiracy theories of others about 9/11. Hear me, Brad? One conspiracy theory at a time, okay? And Hubba Hubba, if you were my student (where are you, BTB) you could use Brad’s blog as a source.
