Arizona's Scam Photo ID Laws Meet Similar Fate as Court Imposes Injunction for '06 Election!
And in Missouri, the Democracy-Haters Appeal the Overturned Laws to the State Supreme Court...

Restrictive and disenfranchising laws for Photo ID requirements at the polls are being pushed all over the country as part of a nationally orchestrated GOP scam that's been underway since at least the first few hours after the 2004 Election.

(For more details, see this series of BRAD BLOG articles exposing the phony GOP front group at the epicenter of this national effort. They are the "non-partisan" and ironically-named "American Center for Voting Rights". We discovered their onerous, ongoing scam early in their attempt to pull off this nationwide hoax with the direct aid and comfort of now-disgraced Rep. Bob Ney of Ohio, and others even higher-up in the GOP.)

This week, news on the Photo ID scam front from Georgia, Arizona and Missouri, where the laws have been repeatedly struck down by courts as blatantly unconstitutional. Yet the democracy-haters in favor of these laws continue to leverage big-time GOP resources in their never-ending search for legal forums with friendly judges. If that doesn't work, as in Georgia, they're prepared to use the laws anyway, even if they've already been ordered not to.

The Associated Press is reporting that voters in Georgia have received letters stating they must show a photo ID to cast a ballot on Nov. 7th. In fact, that letter is wrong and the courts found it was wrong before many of the letters went into the mail...

It's A Double-Whammy --- And Just In Time For The Primaries!!

Election integrity advocates in Arizona got a double-whammy Tuesday --- just in time for their primaries!

First we have some bad news from Erica Meltzer of the Arizona Daily Star in Tucson:
Backup verifying of votes unlikely: Hand-recount procedures not cleared for touch screens

The hand recount that was supposed to guarantee the integrity of the touch-screen voting machines being used in today's election probably won't be done because the secretary of state didn't submit its procedures for federal review until Thursday.

The widespread use of electronic voting machines to comply with the Help America Vote Act raised concerns among some political activists that the machines could be used to tamper with election results.

In response to those concerns, the Legislature passed a bill requiring a random recount of 2 percent of all precincts, and the Pima County Board of Supervisors said it would require a 100 percent hand recount.

The Justice Department signed off on the bill last month, but the secretary of state didn't submit procedures for the recount until late Thursday.

What??? Late Thursday? To get the recount procedures approved for use when?

Salon's Election Integrity Coverage Takes A Turn For The Better
but it couldn't have got much worse!

Art Levine's new piece at Salon raises their election integrity bar quite a bit --- not a difficult task considering where that bar has been lately.

Prior to the 2004 "election", Salon's coverage was generally quite good; since then it's been dismal, thanks mostly to some outrageous smear pieces from Farhad Manjoo. In fact, Salon's coverage has been so dreadful that the site has been referred to in some quarters as "Saloon", which of course rhymes with "buffoon", which gives me a good way to remember "Manjoo", whose name just wouldn't stick in my frozen brain any other way.

But let's not dwell on those sad times.

Levine's article, "Salon's shameful six", looks at six states --- Arizona, Indiana, California, Missouri, Ohio and Florida --- where vote suppression could cause serious problems in 2006.

If you're not a Salon subscriber, you'll have to watch a short ad to read the whole article. I did; it was well worth the time and effort. But just in case you don't believe me, we have a few short excerpts, below the fold.

Today the Arizona Daily Star printed their awaited opinion piece that has three members of the county government responding to questions that were compiled by the paper's staff from their readers' responses to the paper's ill-researched editorial of earlier in the week.

Responding to the Letter To The Editor comments and questions were County Administrator Chuck Huckelberry, who allowed the county to spend over a million dollars to buy new Diebold TSx machines. Also responding are Elections Director Brad Nelson and John H. Moffatt, of the county's Office of Strategic Technology Planning. Both are proponents of the Diebold TSx. And, by the way the questions/concerns were answered, both seem willing to do nearly anything to ensure Diebold gets the Pima Co. taxpayers' money...

A vigilant BRAD BLOG reader (here's a tip of the hat to sorseress) has sent me a very interesting editorial from Tucson, and asked me what I thought. What an invitation! I've been following the discussion, but I'm no expert, especially compared to Brad --- not to mention some of his readers! So I figured I'd post a link and quote some quotes and share some of my reactions, and ask you whether or not you agree.

I'm especially serious about this next bit: your opinions --- pro or con --- are most welcome in the "comments" section of this thread.

OK? Here's the editorial, from the Arizona Daily Star and azstarnet.com:

Touch-screen voting machine needs an OK

Our view: Supervisors should approve use of the new equipment for the Sept. 12 primary, barring demonstrable flaws.

I suppose everything hinges on what you mean by "demonstrable" ... and what you mean by "flaw" ...

So here are my questions: Demonstrable flaws in what? How many flaws? How serious do they have to be? And how do they have to be demonstrated?

In my nearly frozen opinion, one serious security flaw should be enough to disquailfy any machines and/or any vendors from consideration. And I would like the flaws to be demonstrated elsewhere, please! After all, isn't it easier to learn your lessons the easy way --- by watching what happens when somebody else makes a mistake?

But let's not get ahead of ourselves here: that's just the headline: Here's the bulk of the editorial:

The Pima County Board of Supervisors should approve the use of touch-screen voting machines for the Sept. 12 primary election.

On June 6, the five-member board approved buying — but not using — 409 Diebold Elections Systems machines. The county bought one machine for each precinct because it had to spend $2 million in federal money to be in compliance with the Help America Vote Act.

So far the Board seems quite sensible; they had to spend the money so they spent it, but they didn't actually have to use the machines, so they haven't ... so far!

The Diebold product was purchased at the Arizona secretary of state's insistence because the county uses the company's fill-in-the-bubble optical scanners.

Aha! I know this story. This is the one about the man who dove headfirst into the quicksand because he had accidentally touched the sand with his toe!

I've seen this movie before. The poor fellow dies. Such a shame!

Law Guarantees VVPAT, Hand Audits, and Durable Paper Ballots
New Law Now Only Requires Governor's Signature

Late last night the Arizona Legislature took the steps necessary to pass legislation that will guarantee the voters in the state have more transparency and auditability in their elections. The bill passed the House of Representatives 51-0 then immediately went to the Senate who passed it 25-3.

I received an email that originated from Arizona state Representative Ted Downing last night that says:

Dear Fellow Patriots,

SB1557 passed the House of Representatives with a 51-0 vote! Then, it immediately passed the Senate 25 to 3! It is now on its way to our Good Governor’s desk. As planned, it includes the Paton Amendment that I helped draft (see Star description below). Karen Osborn, the Maricopa County Elections Director calls this one of the most significant election reform bills in decades.
This election reform bill is the result of three years of working with the Pima County Democratic Party and the great work of Dr. Tom Ryan, Bill Risner, Esq., our current and former Pima County Democratic Party Chairs, and many, many more dedicated individuals. I want to specially thank each and every one of you for your dedication, your hard work, and your support in working for election integrity.

Now focus on the Governor to make certain that she signs it right away. I am confident she will. It will become law upon her signature, since it contains an emergency provision. We still must await Department of Justice approval which should be expedited because of the emergency provision. At that point, hand counts will no longer be illegal and we will have a first-level audit of the election system. This is, however, just the beginning.

Politics is a team effort. As hard as it may be for many to accept, the East-Mesa Republican Senator Karen Johnson merits thank you emails, (kjohnson@azleg.gov), as does Karen Osborne, kosborne@risc.maricopa.gov (602) 506-7960, and yes, Brad Nelson, brad.nelson@pima.gov (520) 631-3939. Even Rep. Russell Pearce (rpearce@azleg.gov) should be thanked, yes, that’s right and I know its hard, but he fought to assure that our elections are fair. We will continue to disagree on almost every other issue, but he wants a fair count.

I hope each PC will take the time next year to come up to visit the Legislature and witness your legislature at work. Those of you who have tell me that it is not what they imagined.

You are true patriots for protecting our system of government just as those brave men and women did at the founding of this great nation. Thank you and bless you.

Motion Demands Preliminary Injunction, Alleges E-Machines Are Not Secure, Not Fully Accessible to Disabled Voters

A group of Arizona voters have filed a Motion for Preliminary Injunction against Sec. of State Jan Brewer to halt the purchase of electronic touch-screen voting systems in the state made by both Diebold, Inc. and Sequoia Voting Systems.

The voters announced today that the motion was being filed in time to stop the use of the Diebold TSx and Sequoia Edge II systems in the state's upcoming 2006 elections, due to security, verifiability, and disability access problems with these systems.

In addition to the litany of security issues concerning Diebold's TSx, details from the most severe one to date were just revealed publicly last Friday with more chilling details filed in the Oakland Tribune by Ian Hoffman today, the suit also contends the machines, being purchased and implemented in many Arizona counties for the first time this year, are accessible only for a small number of voters with disabilities.

Indeed, on Monday, Diebold issued a press release about new disabled-accessible features that the company is now making available for their line of touch-screen voting machines. The press release can be seen as a tacit agreement, of sorts, that those systems had not been previously accessible to all disabled voters as required by the federal Help America Vote Act (HAVA)?

State Election Director Appears on Radio Show ONLY if Brad is Not Allowed to Ask Questions...
PLUS: Brad Invites AZ SoS Jan Brewer to a Public Debate in Support of our Troops and Democracy on the Homefront!

Our Electoral System is supposed to be open and transparent and accurate. Our democracy is worth fighting for and, if you believe the politicians in D.C., worth sending our troops to fight and die in order to spread around the world. The Help America Vote Act (HAVA) amongst other things, is supposed to help disabled voters vote in private and on their own. All of these things, I believe Arizona's Secretary of State, Jan Brewer would probably agree with. And yet, she seems to have a very different belief about how to ensure the integrity of our democracy at home and how disabled voters should be treated.

Therefore, I am inviting her to a public debate on the matter. I will travel to Arizona on a date of her choosing to accommodate her schedule. Tickets can be sold to the events, and all proceeds will go towards supporting our troops from the Iraq and Afghanistan Wars for a charity which builds accessible housing for the most severely disabled of them. More on that below.

I appeared on the Jay Lawrence Show over the weekend on KTAR Newsradio 620 in Phoenix. (Link to full audio from the show at bottom of this article.)

Lawrence, and the entire station, are very rightwing. Nonetheless, to his credit, Lawrence is very concerned about the non-partisan crisis in our 2006 Electoral System vis a vis the proliferation of Electronic Voting Machines in the wake of the HAVA. This was my second time appearing on his show.

This time around, he attempted to invite his friend Jan Brewer to join us for a discussion on these important matters. Brewer has recently come under fire for her decision to bring Diebold systems into the state even after they were proven to be hackable in Leon County, Florida late last year. They were then confirmed to be even more unsecure than previously realized by an independent study [PDF] commissioned by CA Sec. of State Bruce McPherson (a big Diebold supporter himself) after the security vulnerability was discovered in Leon County.

I went to a speech Jan Brewer made, and brought up the question of these machines and Diebold. And Jan --- who I've known for years and love dearly --- was almost angry about you, Brad. About BRAD BLOG, about the attacks on Diebold Electronic Voting..."

Of course, Brewer, despite many previous appearances on Lawrence's show, turned down the invitation to show up and discuss the matters along with me. She did, however, send a spokesperson instead who agreed to appear only if he would be allowed to do so without being questioned by me.

So at the bottom of the hour, after I'd been on for the first part by myself with Lawrence, SoS spokesman/attorney --- and, I've since learned, State Elections Director --- Joe Kanefield came on for a few minutes while I was made to sit on hold. Kanefield to tell several untruths to Lawrence and his listeners, to suggest that I have been "spinning" these issues, and then he scrammed before I was allowed to come back on the air to question or challenge his assertions "face to face."

During his drive-by appearance, Kanefield said that he's "absolutely confident" that Arizona's untested voting systems are "rock solid". But for an idea of just some of the misinformation and untruths that he gave to Lawrence and his listeners (while I was unable to respond) consider this exchange concerning the Leon County hack, and the statement The BRAD BLOG was able to receive from the Leon County Election Director, Ion Sancho himself, in response to it...

Pima County Election Director Brad Nelson Is Sorry...
Local TV News Covers Tirade, New Diebold Touch-Screen Voting Machine Controversy in State

Tuscon Arizona's local NBC TV news affiliate ran a story Wednesday night on the raging controversy across the state concerning Sec. of State Jan Brewer's recent agreement to allow hackable Diebold touch-screen voting machines into the state.

Their report (linked below) included a snippet of the video that The BRAD BLOG ran as an Exclusive at the end of February featuring Pima County, AZ Election Director, Brad Nelson freaking out and verbally assaulting Election Integrity Advocate, John Brakey --- on video --- during a public local precinct council meeting.

Nelson, the station reports, has apparently apologized for his tirade. Brakey is also interviewed in the new report on Pima County being "pushed into a national controversy."

Their coverage of "both sides" of the story led last Wednesday's 6 O'Clock newscast in Tuscon.

MORAL: Always bring a video camera (or audio recording device) when meeting public Elections Officials. They often don't fare well under the harsh light of actual public scrutiny, and footage of such encounters may help your local TV affiliate suddenly become interested in reporting on the story.

Pima County Election Director Brad Nelson Launches Outburst Towards Election Reform Advocate in Response to Question About New Touch-Screen Voting Machines
Letter Calls for Censure of Official as Onlookers Stunned by Encounter, Feared Violence Would Break Out...

The battle between Election Officials and Election Integrity Advocates has been simmering and intensifying for some time. Last week, in Arizona, one such confrontation boiled over briefly into an outburst at a public meeting which was documented on video tape. In what could be a preview for the Electoral Integrity fight still to come, Pima County, Arizona's Election Director Brad Nelson went into a short tirade last Tuesday as the video camera rolled during a local Democratic precinct council meeting in the state's 26th Legislative District.

The BRAD BLOG has obtained the exclusive video of the event which reveals the Republican Nelson flying off the handle and shouting as he confronts Election Integrity Advocate, John Brakey, "nose to nose" during a question about Diebold's DRE (touch-screen) voting machines. Before Brakey was able to get to his main question concerning Nelson's plans for Logic and Accuracy testing on the machines, he was interupted by Nelson's outburst over whether or not he had, in fact, signed a contract for use of the new voting machines in the county.

Diebold's hackable touch-screen machines have been recently approved for first-time use in the state by Arizona's Secretary of State Jan Brewer.

Ironically enough --- especially in light of this new video --- Brewer herself recently referred to election integrity advocates as "anarchists" in an interview with the Arizona Star after demonstrators concerned about Diebold interrupted her re-election campaign announcement just after the first of this year.

While Nelson's confrontational rant was just short of anarchic, it certainly sent a shockwave of concern throughout the room of stunned onlookers.

One of the witnesses present, Rev. Gerry Straatemeier, described the "intimidating behavior" displayed in the incident as "completely out of line for a public official". Straatemeier was so troubled by the display that she sent an open letter to the Pima County Board of Supervisors calling for Nelson to be censured for the behavior. In the letter (posted in full at the end of this item, along with a text transcript of the event) Straatemeier says, "I really thought he was going to land a blow on Mr. Brakey and I was scared to death."

In the video, Nelson charges towards the camera at one point --- which Brakey was standing near --- coming so close that it's impossible to see anything but his chest in full camera's full frame.

Straatemeier, in her letter, suggests the tirade was an attempt to intimidate Brakey --- and other election integrity advocates --- from further inquiry into the controversial Diebold touch-screen voting equipment now coming into Arizona despite a Dept. of Homeland Security warning that their tabulator software is hackable, a non-partisan GAO report confirming the failures and loss of ballots via electronic voting, and a recent independent analysis [PDF] commissioned by the Sec. of State of California which warns about the hackable "interpreted code" used in Diebold voting machines despite a ban on such code by the federal Help America Vote Act (HAVA) guidelines.

As we reported in May of last year, Brakey has for some time been closely investigating a number of troubling anomalies in recent Arizona elections. His intensive work auditing his own precinct in Pima County, where he says evidence suggest fraud occurred in the 2004 election, was covered in detail last year by The Tuscon Weekly. That work has brought him in contact many times in the past with Nelson --- without incident apparently, until last week.

Last Tuesday, as the following video shows, the simmering frustration and growing anger roiling up between many Election Officials and Election Reformers, has finally begun to make its way to the surface and into the public eye...
