TALLAHASSEE — A new pitch for John McCain's presidential campaign aimed at older Democratic voters is causing complaints by Democrats and concern by elections officials.
The piece, paid for by the Republican National Committee and authorized by McCain, tells voters it is seeking to double-check their "unconfirmed" party affiliations while asking for money. A letter signed by McCain tells the Democrats: "We have you registered as a Republican."
"I was a little bit shocked and a little bit surprised," said recipient Bill Smith, 81, of Tampa, who calls himself a lifelong Democrat and has been registered at his current address since 2000.

The RNC declined to discuss the mailer, which Democrats said has landed in five counties: Duval, Hillsborough, Collier, Miami-Dade and Escambia.
The article goes on to note that FL's Republican SoS Kurt Browning believes the mailing is "confusing" and "unfortunate", but does not note whether or not he plans to do anything about it. We're not holding our breath. Neither are we holding it for Democrats down there to do much about it either.
The mailings sent to registered Democrats appear to be classic "caging" letters, marked as "Do Not Forward", so that they will then be returned to the GOP if there is any problem with delivery. Those returned letters will likely then be used as a basis to challenge the legitimacy of those particular voters on Election Day....
I've been quite critical of the Obama/DNC plan (or lack thereof) for "election protection" this year, noting that it looks, smells and sounds a lot like a slightly beefed-up version of the Kerry/DNC "we'll have thousands of lawyers in place on Election Day should anything go wrong."
On Election Day, of course, if DNC lawyers are still trying to keep up with what's going on, it's already game over. While for years Osama Bin Laden and Muslim extremists had supposedly declared war on the U.S., as the legend goes, America paid little attention until it was too late. So it is with the raging Republican War on Democracy, where proactive steps are necessary (beginning long ago, but we'll take what we can get at this point) to join the war and push back against the GOP's assault on the most democratic of all values, the right to freely cast one's vote, to have that vote counted, and to have it counted accurately.
Back in 2006, after speaking to a group of DNC election attorneys in Chicago, I wrote about the "Dysfunction at the DNC" and the persistent cluelessness they had displayed at the time concerning a number of very real threats to our electoral system. While Obama has certainly displayed a tendency to understand at least some of the issues at stake --- far more so than his '04 counterpart --- the party, from every sign I'm able to get, remains out of touch with the serious threats they face: from the massive front-end disenfranchisement efforts, about which they are at least somewhat aware, to the back-end disenfranchisement efforts via manipulation and/or often-undiscoverable "tabulation error" of completely un-transparent electronic voting systems used in virtually every county, in every state in the union.
So we may be grasping for any optimistic straw we can find here, but at least today we have one such sign of proactivity from the Obama/DNC that we can tell you about...

To understand how Team McCain intends to get away with stealing this election, we must recall how Team Bush got away with it four years ago. (Those aren't two different teams.)
The plan for stealing this contest has everything to do with the ostensibly surprising choice of Sarah Palin as McCain's VP.
'There Are Too Many Problems, and They Keep Happening,' Notes County Supervisor After Voting to Approve the Hand-Audit Canvass, Even Following Discovery of Missing Ballot Bag Seals...
Following up on the arrest last week of Pima County (Tuscon), Arizona, election integrity advocate John Brakey... You'll recall, he was arrested after noticing that some 7 out of 10 bags of ballots being counted during a post-election audit last week were missing their proper security seals.
As an election observer representing both the Libertarian and Democratic parties during the hand-count audit of a Sept. 2nd state Primary, Brakey began to ask questions about the bags --- which had supposedly been chosen at random the day before --- prompting Pima's Brad "Election Director Gone Wild" Nelson to call the sheriff on him.
Despite the missing seals (which even Nelson admitted to himself, as seen in the Channel 9-KGUN video report we posted with our original coverage of the incident), the Pima County Board of Supervisors went ahead and certified the election canvass anyway, "over the objections of activists who wanted the county to wait until an additional hand audit could be conducted over the weekend," according to the Arizona Daily Star.
"The supervisors said they were very concerned about persistent problems in the Division of Elections, but they could not legally postpone the canvass," the paper reported over the weekend. That, despite a news conference that Brakey and the other activists held late in the week to call for a new audit, using properly sealed ballots, "and focusing on contested supervisor races, of which there were three."
They have also called for the removal of the beleaguered, hot-headed and perhaps even criminal Nelson, after years of problems and obstructions from the Pima Election Director. According to the Daily Star, at least one of the Supervisors agrees it's time for Nelson to to be removed...
I've been getting panicked email and phone calls, and everything else, since a caller to the Thom Hartmann Program yesterday mentioned receiving an Absentee Ballot Request form in the mail from the McCain campaign. Apparently, the caller from Wisconsin was a Democrat, suspected foul play (and not without reason!) and was followed by several other callers and emailers reporting the same in that state and others around the country.
Lee Rayburn, who was guest hosting for Thom, called me just after he got off the air yesterday to let me know what was going on, and to forward some of the emails he had been receiving so I could check them out to figure out what was going on. In fact, I had already received some of those McCain Absentee Ballot Request forms from others in the days preceding yesterday's show.
Well, with panic among Dems (understandably) reaching a fevered pitch by last night, claims of "massive Republican vote caging" going on, as based on these mailings, he asked me to come on today and explain what I was able to learn about the situation. (Audio of interview posted below.)
As discussed during my appearance with Lee on Thom's show this morning, in this case at least, those mailers seem to be generally on the up and up. While it appears to be a massive and very aggressive GOTV effort from the McCain campaign --- even targeting Democrats in places they consider "swing states," like Wisconsin --- there doesn't seem to be anything nefarious going on with these particular mailings. At least so far as I've been able to tell...
On Tuesday, while the corporate media was helping along John McCain's faux controversy over lipstick and farm animals, and while Republicans were otherwise preparing to celebrate 9/11 on Thursday, a group of so-called "third-party" Presidential candidates gathered for a news conference at the National Press Club, as sponsored by Congressman Ron Paul (R-TX)'s CampaignForLiberty.org. Paul's introductory statement, endorsing third-party candidates as a whole, is here.
Paul recently announced his refusal to endorse his party's nominee, John McCain, despite their personal entreaties. The entire press conference is on video here.
The three candidates who did show, all spoke to various aspects of the detrimental nature of the dangerous two-party duopoly the country is currently saddled with, thanks in no small part to the corporate media's unwavering support thereof. (See this condescending coverage from WaPo clown Dana Milbank, whose never run for even dog catcher, as far as I know, much less President on a national party ticket, by way of just one such example.)
Only McKinney spoke directly to the issues surrounding Election Integrity. She is, to my knowledge, the only Presidential candidate of any party this year, to speak substantively to the most important matter underscoring every freedom we have and every serious issue we face in this nation.
She begins her remarks by pointing out: "What has not been mentioned this morning, and has rarely been mentioned throughout this presidential election season, is the issue of election integrity." She speaks rather eloquently both about "massive disenfranchisement" and "manipulation of electronic voting machines." None of the candidates, including McKinney, have yet signed the StandingForVoters.org pledge to challenge any questionable election results and not concede until every vote is counted, and counted accurately. Several weeks ago at the UK's Guardian, I wrote about rightwing democracy-hater Paul Weyrich and his 1980 speech to 15,000 preachers in Dallas (with Ronald Reagan and Jerry Falwell also on the bill), in which he called for massive vote suppression. The comments, from one of the "Conservative" Movement's "founding fathers" and a Godfather of the Republicans' now-peaking, long-waged voter suppression scheme, are worth getting out there again and again --- particularly right now. The video of Weyrich's 1980 comments (:40 seconds) is at right and the text is below...
"Now many of our Christians have what I call the goo-goo syndrome - good government. They want everybody to vote. I don't want everybody to vote. Elections are not won by a majority of people, they never have been from the beginning of our country and they are not now. As a matter of fact, our leverage in the elections quite candidly goes up as the voting populace goes down."
As mentioned previously, Weyrich continues as a regular consultant to the top-tier GOP power-brokers to this day, and last night the man who so eloquently elaborated the Republican Rosetta Stone of voter disenfranchisement was honored "for Life, Work and Service" at a D.C. shindig that raised "over $330,000...for the Free Congress Foundation."
"The highlight of the evening included an historic 21 gun salute video," a press release issued this afternoon (posted in full below) crows. That salute "included 30 of the country's top leaders such as author and columnist, George Will; national talk show host and author Hugh Hewitt, Senate Republican Leader Mitch McConnell (R - KY), Former Speaker of the House, Newt Gingrich; Ken Blackwell, 2008 Vice-Chairman of the Republican Convention Platform Committee and Former Ohio Secretary of State; Marion Edwyn Harrison, Esq., Free Congress Foundation; Phyllis Schlafly of Eagle Forum; Jerry Falwell, Jr., Liberty University; Rep. Though comments as seen in the video above ought to make this man a pariah to any democracy-loving American citizen, he continues to be anything but to the GOP movement which has mainstreamed this guy, and his loathing for American values, and turned him into a movement demigod...
D.C. election officials blamed a defective computer memory cartridge yesterday for producing what appeared to be thousands of write-in votes that officials say did not exist.
The glitch caused initially inaccurate results in several contests, including two high-profile council races, and created a chaotic scene at Board of Elections and Ethics headquarters Tuesday night. Even with an extremely low turnout, there was no clarity well after midnight, when 50 people, among them candidates and their attorneys, crowded into the election board lobby and demanded answers from officials.
These are voting machines made by Sequoia Voting Systems, whose systems have failed in many recent elections. Their Edge touch-screen system, with its Verivote paper-trail printer, was featured in a video released this week by the UC Santa Barbra Computer Security Group. The video from the scientists at UCSB offers step-by-step instructions on how a single person can hack such a voting system, in about two-seconds, resulting in a county-wide flipped election that even a full post-election hand count of the systems paper trails would not reveal.
It has been pointed out on one of my mailing lists that this same issue may have taken place in Alameda Co, CA, in Feb. 2008.
UPDATE: As expected Sequoia Voting Systems has now made a statement that their investigation shows that the problem was user error or --- in a fresh new excuse for the company --- possibly even "static discharge". The Washington Post reports:

Three recent stories have come to light about the Republican Party's latest and sometimes illegal efforts at voter disenfranchisement. Unfortunately, these three stories are only the very tip of an enormous iceberg.

First, Michigan... We've learned from the Michigan Messenger that James Carabelli, the Republican Party commissioner for Macomb County, is "planning to use a list of foreclosed homes to block people from voting in the upcoming election as part of the state GOP's effort to challenge some voters on Election Day."
Carabelli, as quoted in the Messenger, says, "We will have a list of foreclosed homes and will make sure people aren't voting from those addresses."
But J. Gerald Hebert, a former voting rights litigator for the U.S. Justice Department and currently the Executive Director and Director of Litigation for Campaign Legal Center, says the practice is simply illegal...
Experts from CA's 'Top-to-Bottom Review' of E-Voting Systems Demonstrate How to Insert Virus, Access Machines Without Disturbing 'Security Seals' in Hack Which Would Not Be Discovered Even in 100% Audit of 'Paper Trails'

The Computer Security Group at the University of California Santa Barbara (UCSB) has released a short, chilling video demonstrating how a single person can hack an election on a touch-screen voting system --- even one with a so-called "Voter Verifiable Paper Trail" (VVPAT) added to it --- in such a way that it is highly unlikely that the manipulation would ever be detected by either the public or election officials.
The video which shows "just examples of the different ways in which the system can be compromised" is the latest in a similar string of such demonstrations that have been released over the last two years, all showing how easily electronic voting systems can be tampered with, often undetectably.
In the UCSB video posted below, the hack of Sequoia voting system being prepared for use in an entire county, is done in approximately 3 seconds, by a single person with simple insider access and a $10 USB thumb drive. Every machine used in the county, in such a case, would be effected. Moreover, the viral hack would not be discovered by pre-election "Logic and Accuracy" testing --- in cases were election officials actually bother to perform such tests prior to elections --- nor would it likely be discovered even in the event of a complete, 100% post-election audit of the touch-screen "paper-trail" records.
The hack demonstration, prepared by the UCSB scientists as part of California's 2007 Top-to-Bottom Review" of all of the state's e-voting systems, also reveals how so-called "security seals" placed on such machines after they've been programmed for an election, can be easily defeated without detection...
After months of pressure from state election officials, voting rights groups, veteran’s organizations, members of the US Senate, and citizens, the Dept. of Veterans Affairs has decided that it will be alright for veterans who live in VA facilities or are patients in VA facilities to be visited by non-partisan folks who want to help them register to vote. Unfortunately this decision comes just a month from the voter registration deadlines in most states. Now those groups who have fought hard to get permission to register veterans need to go do the job.
Ohio is becoming a battle ground for voter registrations. Secretary of State Jennifer Brunner is going to battle against the state legislature over a law that was passed in 2006 that allows counties to remove voters from the rolls if election notices sent by the counties to the voters are returned for any reason. This is a violation of state law and federal law and the US Constitution according to her lawyers. Any voter removed from the rolls must be given due process. ...
Pima County (Tucson), Arizona Election Integrity advocate and expert John Brakey was arrested last night while performing his job as an election supervisor, on behalf of both the Democratic and Libertarian parties, during a post-election hand-count audit of ballots.
Brakey becomes the latest in a growing string of EI advocates to be arrested and/or barred from observing (Brakey was lucky enough to merit both "honors" apparently) while attempting to assure accuracy, fairness, and transparency in voting and in the reporting of election results on behalf of citizens.
The problem erupted after Brakey had noticed a number of ballot bags being counted in the post-election audit were missing their proper security seals. He began to ask questions about those bags, which eventually led to his arrest at the demand of Pima County's Brad "Election Director Gone Wild" Nelson, a man with whom Brakey has had a number of unfortunate (for Nelson) run-ins over the years.
After news of his arrest, "the county elections building was swarming with television news crews," according to a report by Election Defense Alliance (EDA), of which Brakey is a member. Indeed, KGUN's video report on the incident is very good, as the Tucson media --- given Brakey's success in lawsuits and legislation over the years on behalf of voters --- has come to see him as a reliable source on such matters...
Holly Lowder Had Taken Up Residence With Contractor Who Provided Registration Roll Software to the State

Last night we offered the quick skinny on the abrupt resignation of Colorado's state Election Director, Holly Lowder, just 60 days out from what promises to be one of the largest and most important --- and potentially closest --- elections in the state's history.
We summarized some of the dizzying background on the exceptionally embarrassing and dysfunctional state of certification, decertification and recertification of e-voting systems in the Centennial State over the last two years, under current Sec. of State, Republican Mike Coffman (who is overseeing his own election for the U.S. House this November), and in previous years under two former Republican SoS' (one of whom was promoted by George W. Bush to do the same lousy job of e-vote testing for the U.S. Election Assistance Commission).
We also suggested, based on information from sources in the states, that the old euphemism about "election officials being in bed with voting vendors" may well become more than just a euphemism when the full explanation for Lowder's sudden departure became known.
And today, as we'd hinted last night, some of that information has now become known...
Readers will recall that as of yesterday Palm Beach Co Florida officials had lost well over 3,000 ballots sometime between the primary election and an election recount. Earlier today there were announcements that over 2700 ballots had been found. Late this afternoon the officials were supposed to meet to announce whether they had found all of the missing ballots and why those ballots went missing in the first place.
Were the ballots run through the high-speed optical scan machines during the recount and did the machines pick-up two or more ballots at a time thus not counting all of the ballots? Or, were the ballots in bins that were never counted?
The media is not clear on this issue yet so we are going to have to wait to find this out. If the machines were, in fact, grabbing two or more ballots at a time jurisdictions around the country need to be made aware of this possibility.
Meanwhile a report from Broward Co of the result of their state-mandated audit is a bit troubling. The county appears to have hand-counted one race on ballots from 16 precincts. The media is reporting that nine of the precincts hand-count matches the machine results. Seven precincts resembled original results by 95 percent or more. That is a huge number and should raise red flags.
Instead one official said, “When you're dealing with people and paper, that's the best you're going to get.” How about agreeing 100% and you keep counting until you are sure that the people and paper are not the problem and then you find out what problem the machines had?...
The news from Palm Beach Co Florida is not getting any better. The official recount is complete as required by the state. By state law they have exactly one week to count ballots, rectify any problems, do any required recounts, and certify that everything is correct. Of course that is all without any court orders and it looks more and more like this election will be going to the courts.
The original election evening count seems to have been 102,523 and the final recount total was 99,045. The only race that was recounted was a race for a judicial seat and the winner flipped from one candidate to another from the original to the final recount. The original difference was 17 votes and the final was 60 votes.
The big question is what happened to over 3,400 ballots. The losing candidate will be going to court to ask that question among others. And now any candidate in any other race who lost by less than 3,400 votes is also being encouraged to go to court and demand a recount or re-election.
There is a lot wrong with this situation. The state is wrong in forcing a quick handling of the ballots. No wonder mistakes are made and more seem to be made in Florida than most other states. A complete investigation must be held inside the county to figure out what happened and why it happened. Was it administration issues or the voting system? And why did members of the county canvassing board sign an official document that had no final numbers on it? The voters need to know that and they need to know before November....
