Guest: Election integrity advocate John Brakey; Also: Conyers resigns, Farenthold skates, RNC and Trump go all-in for Roy Moore...
By Brad Friedman on 12/5/2017 6:55pm PT

On today's BradCast: If Donald Trump and fellow Republicans have their way, an accused child molester will become the next U.S. Senator from Alabama. But, in advance of next Tuesday's election, election integrity advocates are fighting to assure the possibility of oversight of the state's computerized election results. [Audio link to show is posted below.]

But first up today, new wildfires exploded across parts of Southern California on Tuesday, in Ventura County and near Los Angeles, mirroring some of record fires that engulfed Northern California win country in October. Those fires killed more than 40 people and destroyed thousands of structures. While no deaths have yet been reported in the new blazes, tens of thousands of residents were forced to flee in the middle of the night and scores of houses have burned with thousands remaining threatened, as dry conditions and record winds are predicted to continue for several days.

Meanwhile, in Congress, allegations of sexual harassment continue to take a toll, as civil rights champion Rep. John Conyers (D-MI), the longest serving member in the U.S. House, announced his resignation on Tuesday, following multiple allegations against him. On the other side of the aisle, Rep. Blake Farenthold (R-TX) says he will repay the $84,000 Congress paid out to settle a 2014 sexual harassment claim against him. Unlike in Conyers' case, no members of Farenthold's own party caucus have publicly called on him to resign.

And, following Donald Trump's full-throated endorsement of Alabama's Republican U.S. Senate nominee Roy Moore on Monday, the Republican National Committee has now restored funding and other resources for Moore, after previously pulling support in response to well-sourced allegations of sexual impropriety with a number of teenage girls, as young as 14, when he was a prosecutor in his 30s. Sitting GOP Senators --- like Utah's Orrin Hatch and Majority Leader Mitch McConnell --- have also walked back their initial condemnations of Moore, particularly as final passage of a massive Republican redistribution of wealth from the middle-class to the rich still relies on a thin partisan majority in the U.S. Senate. That, even as new evidence emerges to buttress the allegations against Moore.

Then, in advance of that December 12th U.S. Senate Special Election between Moore and Democrat Doug Jones next Tuesday in Alabama, election integrity advocates are eying concerns about the state's paper ballot computer tabulators.

I'm joined today by longtime election integrity champion JOHN BRAKEY of AUDIT-AZ to discuss his lawsuit and other efforts to force Alabama election officials to turn on digital "ballot imaging" functionality for all ballots on the state's computer ballot scanners, most of which offer the feature. Brakey explains how such images, in lieu of actual human examination of hand-marked paper ballots, can be helpful for public attempts at oversight of results following next week's race, particularly given the historic obstacles citizens have been met with in attempting to verify computer tabulated results.

(See, by way of just one example, my recent interview with Wisconsin's Karen McKim, whose public records request finally allowed, just weeks ago, a multi-partisan group of observers to examine paper ballots from the 2016 President election. That audit of several precincts in Racine County, paid for by the residents themselves, revealed up to 6% of perfectly valid Presidential votes went untallied, thanks to flawed optical scan systems used across the state on Election Night and, in much of the state, even during even during Green Party candidate Jill Stein's attempted "recount". Other wards which tallied by hand instead during that "recount" discovered as many as 30% of valid votes went untallied originally!)

Brakey explains that some 80% of Alabama counties now use newer digital scanners which would allow ballot images to be retained and shared with citizens to examine after the election, to help ensure an accurate count. But, he tells me, relaying his recent conversations with the state's Election Director, "the reality is that it doesn't work unless you turn that feature on." Right now, he says, it is only turned on for write-in votes only. Brakey charges, however, that automatically deleting images that are taken of every ballot as they are tallied by the digital systems, is a violation of federal law. "It's a federal election, and under federal law, you must save everything for 22 months," he says. He is heading to Alabama today and says he will file suit to force the state to retain all such images.

Why not just fight to view the actual paper ballots? Brakey explains: "You cannot get at the original ballots. They will not let you touch them. In order to get to them, you have to prove fraud first. And how are you going to prove fraud if you can't get to the ballots? That's the Catch-22. The ballot images are a tool to get us to the originals."

You can watch the colorful and inspirational Brakey in the film Fatally Flawed, documenting his years-long transpartisan fight in Tucson, Arizona, in hopes of examining the ballots from and verifying results of a controversial 2006 election. And you can donate to help Brakey's fight for Ballot Images in Alabama (and elsewhere) right here.

By Brad Friedman on 12/4/2017 5:58pm PT

On today's BradCast: The GOP rammed the largest tax increase in American history through the U.S. Senate in the middle of the night last Friday, and we open the phones to try to figure out what the alleged Trump/Russia "collusion" is actually supposed to be. [Audio link to show follows below.]

After several important breaking news items (Trump's unprecedented reversal of National Monument declarations in Utah by Presidents Obama and Clinton; His stolen U.S. Supreme Court allows his Muslim travel ban to be enforced, even while it's being challenged in lower courts; His new, full-throated endorsement of alleged Republican child molester Roy Moore in next week's U.S. Senate special election against Democrat Doug Jones in Alabama), we're back to the GOP "tax cut" hustle and the Special Counsel investigation of Team Trump.

First, on taxes, details on the thousands of corporate lobbyists (more than 6,000 of them!) who crawled out of the swamp to help write what will be the largest tax increase in U.S. history, as billions, if not trillions in wealth is set to be redistributed from the poor and middle class to the wealthy and already-wildly profitable corporations. The GOP and Donald Trump have been using a dubious list of "economists" to lie about and help jam through their scheme, which was passed by the U.S. Senate just before 2am on Friday night/Saturday morning, just hours after the 500-page final bill had finally been released to Democrats.

Then, we open up the phone lines for callers to answer my question about the alleged Trump/Russia "collusion", following the guilty plea on Friday by Trump's disgraced former National Security Adviser Michael Flynn for lying to the F.B.I.

While Trump's attempted obstruction of that investigation is quite clear (despite his personal lawyers absurd claims), as is the fact that members of his Campaign and Administration lied to federal law enforcement officials, which also unlawful, evidence of the originally alleged "collusion" on the 2016 election remains elusive.

Why all the lying by Team Trump? What are they attempting to hide? As much as I'd be delighted for all of this to bring down a wildly lawless and anti-American Administration, of course, I still remain unclear on what the initial crime actually was, or is even alleged to have been. So, at risk of being called "obtuse", I ask callers today about what that actual, specific original crime is --- before all of the obstruction and lying --- that is seemingly being hidden by Team Trump, alleged by Democrats and probed by Special Counsel Robert Mueller.

We open the phone lines for callers to explain it all...if they can...

CA GOP could be left with zero U.S. House Reps after 2018...
UPDATE: 13 of 14 CA Congressional Repubs voted 'yes' on final version of tax bill...
By Ernest A. Canning on 12/4/2017 9:41am PT

A month ago, the notion that every one of California's fourteen (14) Congressional Republicans could be voted out of office in 2018 would have been dismissed as little more than a utopian dream for the Democratic Party.

If we've learned anything, however, from November's "Tidal Wave" off-year elections, which saw a diverse group of Democrats defeating Republicans in deep red districts in Virginia and elsewhere, it's that no Republican seat should be considered an absolute lock in 2018.

That proved to be the case in another special election, a week or so later, when a 26-year-old lesbian, Democrat Allison Ikley-Freeman narrowly defeated an incumbent Republican state senator in a "deep red" Oklahoma district that Trump carried in 2016 by nearly 40%.

There are a multitude of factors, some unique to California, that suggest that no Golden State Republican --- not even House Majority Leader, Kevin McCarthy (R-Bakersfield) who trounced his 2016 Democratic opponent by nearly 39 percentage points --- should take their seat in the state's 53-member U.S. House delegation for granted...

By Brad Friedman on 12/1/2017 6:28pm PT

On today's BradCast, there are two major stories to cover. Both huge. But the one that is receiving less coverage than it needs, is the one likely to upset American life as we know it for decades.

First today, Donald Trump's former National Security Adviser, Gen. Michael Flynn, pleaded guilty to one count of lying to F.B.I investigators about conversations he had with Russia's U.S. Ambassador concerning sanctions against Russia and a U.N. vote regarding Israel during Trump's transition to office, among other things.

He is being offered leniency by Special Counsel Robert Mueller in exchange for his cooperation in the on-going Trump/Russia probe. The White House spent the day downplaying the charges, though reports and court documents filed on Friday indicate the President's Son-in-Law and senior adviser Jared Kushner could be among those now in the sites of federal investigators. Flynn is the fourth member of Team Trump to be charged by the Special Counsel and the first to have served during the Administration itself.

As that played out on Friday, Senate Republicans continued to push their massive $1.5 trillion tax scam through Congress, which, as we discuss today, is much more than just a massive tax cut for corporations, donors and the wealthiest U.S. citizens. The bill has also become a catch-all for long-sought, far right-wing causes, such as establishing rights for fetuses and repealing a 60-year old ban on partisan political activity by tax-exempt religious organizations.

In addition to offering windfalls for the rich, while increasing taxes on most of the middle-class, the far-reaching legislation will also curb the ability for states and cities to provide basic needs to residents, while otherwise undermining the economic system on a generational scale by removing deductions for state and local taxes, higher education and much more.

Perhaps most disturbingly, as experts and lawmakers admit, the scheme will blow such an enormous hole in the long-term national debt that, as Republicans have made clear, additional massive cuts to social safety-net programs such as Medicare, Medicaid and Social Security will be next on their agenda. In all, the massive redistribution of wealth from low- and middle-income Americans to the richest elite in the country will serve to cripple generations of younger Americans.

But, yes, Michael Flynn was charged with a crime on Friday and may now sing on the President and his team. The White House is likely unhappy about that, even if Republicans in Congress are unlikely to mind the distraction at all, as they push their generational tax scam over the finish line.

Finally today, speaking of paying a price for generations to come, Desi Doyen joins us for the latest Green News Report...

Guest: Karen McKim of Wisconsin Election Integrity...
By Brad Friedman on 11/28/2017 6:55pm PT

On today's BradCast: The three stories we cover at the top of today's show --- another long-range missile launch by North Korea, GOP tax cuts for the wealthy moving forward in Congress, and a Trump-appointed federal judge who just decided in favor of Trump (and seemingly, against the rule of law) in an unprecedented battle for leadership of a federal agency --- all underscore the importance of the rest of today's disturbing program. [Audio link to full show is posted below.]

An effort just before the Thanksgiving holiday by citizen volunteers at WisconsinElectionIntegrity.org (WIE) finds that inaccurate results were certified in Wisconsin's 2016 Presidential election, which Donald Trump is said to have won by just 22,000 votes over Hillary Clinton, out of some 3 million ballots cast.

Wisconsin was one of three states, along with Michigan and Pennsylvania, where Green Party candidate Jill Stein had filed for "recounts" and forensic audits of voting systems, after the Clinton Campaign declined to heed the pleas for such an audit by computer scientists and voting systems experts who begged her campaign to do so. Stein's post-election effort was largely stymied by Team Trump and various statutes in each of those states. A statewide tally was allowed to move forward in Wisconsin, however only about half of the state's ballots were hand-counted, as municipalities were allowed to carry out their choice of either manual- or machine-tallied "recounts".

After finding an alarming number of uncounted ballots in Racine County precincts during last year's machine "recount" (see documentary filmmaker Lulu Friesdat's alarming coverage of election officials refusing to hand-tally clearly valid votes there during Stein's attempted "recount") the volunteers at WIE filed, and paid for, a public records request to examine the hand-marked paper ballots in a number of those wards.

Recently, they were allowed to review those ballots and, as they feared, many perfectly valid votes had gone uncounted by the optical-scan systems both during the original Election Night tally and the so-called "recount" in counties that used the same faulty computer scanners for the second count, after they had similarly mistallied ballots on Election Night.

I'm joined on today's show by longtime election integrity advocate and WIE's statewide coordinator KAREN McKIM to discuss the group's findings, revealing that the ballot scanning computers used in some 57 municipalities across the state had failed to tally anywhere from 2% to 6% of the ballots with valid Presidential votes in each of the Racine precincts they were allowed to examine a week or so ago. In other WI cities which chose to count by hand during Stein's "recount", McKim tells me, those same scanners had originally missed anywhere from 9% to 30% of valid Presidential votes! All of that in a state which Donald Trump is said to have won last year by less than 1%.

"They were ignored by the voting system entirely," says McKim, "and that's what made the miscount - or should have made the miscount obvious to the election officials even before they certified. You could look at those election results that the voting machines spit out on their face and you could see that hundreds of votes were just missing. If you compared the total number of ballots cast to the total number of presidential votes counted, you should have known --- they should have known --- that two percent of the voters didn't go to the polls so that they could cast a blank ballot. The miscounts were obvious at the time of the canvas, and the county officials did nothing about it."

Nearly a year after the election, in late September of this year, the state Election Commission finally decertified the 20-year old Optech Eagle computer tabulators, after finding that the systems fail to tally votes at all if the "wrong" type of ink is used to make selections by the voter. The same systems are still used, according to Verified Voting, in other states, such as Indiana, Massachusetts and Virginia, and may be used again in Wisconsin next year, as the state decertification allows municipalities to wait until after the November 2018 mid-term elections to replace them.

McKim, however, tells me that those faulty machines don't necessarily explain "the really widely varying error rates from precinct to precinct. ... Why the city of Racine machines were missing more votes than the suburban machines? I don't know. You'd really have to do a forensic investigation to figure that out." But, of course, Stein was not allowed such an investigation in any of the states where she sought them.

If it weren't for Stein's attempted audit, she says, the problems may have gone completely ignored. "The poll workers noticed the missing votes when they closed the polls that night. They noted it on their inspector's reports. The municipal canvas looked at it, and I talked to the Municipal Clerk, and she said, 'I didn't know what we were supposed to do about this, so I certified it and sent it to the County Clerk.' And then the County Clerk looked at those results. She too --- and again, you could not ignore a miscount of that size --- and she just said, 'Well, it's the municipality's job to send me the accurate results. Whatever they send me, it's not my job to correct it.'"

"There is not a county in the state of Wisconsin where the county election officials check accuracy of the vote totals. They all just certify by looking at the computer tape and saying, 'Oh, look who won.'"

McKim, who is a retired quality-assurance manager, says "Every other manager that uses computers, from your grocery store to the bank to the city treasurers, they all know and accept that their computers are going to miscount from time to time. So they have routine procedures in place to check and correct before it's too late. Election administrators are the only computer-dependent managers we allow to get away with not checking the computer output for accuracy. It's insane."

"The county canvass procedures clearly allowed massive miscounts, obvious miscounts, just to go undetected and uncorrected. And that's unacceptable," she added, going on to detail what the group plans to do next, and how computer tabulation systems other than the Optech Eagle, "new or old", should never be trusted for use without citizen oversight.

We also discuss what such oversight should look like, if public Election Night hand-counts are possible in Wisconsin, how citizens elsewhere can carry out similar audits, and much more during today's show...

Guest: Former Obama tax policy advisor Seth Hanlon on GOP tax cuts; Also: Trump endorses accused child molester for U.S. Senate; Trump's FCC announces plans to kill landmark 'Net Neutrality' protections...
By Brad Friedman on 11/21/2017 6:19pm PT

On today's BradCast: If you're still clinging to the idea that elections don't really matter and the incredibly lazy assertion that "there's no difference between the two major parties", today's show may help you reassess those ill-considered, self-defeating, knee-jerk notions. [Audio link to show is posted below.]

First up, the President of the United States, Donald Trump, explains why he believes it would be better to have an accused child molester, Alabama's Republican U.S. Senate nominee, Roy Moore, in the U.S. Senate, than to see the Democratic candidate Doug Jones elected on December 12. His argument today that Moore "totally denies" the charges of sexual improprieties with teenagers as young as 14 (sourced to more than 30 people) is part of his Administration's desperate attempt to pass their massive tax cuts for the rich, at all costs, through a very slim GOP majority in the U.S. Senate. That majority would get slimmer still if Jones is elected. So bring on the pedophiles!

We're joined today by SETH HANLON, President Obama's former Special Assistant for Economic and Tax Policy, to explain how the GOP's proposed tax scheme is being rushed through the Senate during the holidays, in hopes that voters don't notice that it will actually raise taxes for some 82 million middle-income Americans, while keeping permanent tax cuts in place for the wealthy. And, as bad as that sounds, other provisions are even worse and will result in an increase of $1.5 trillion to the federal deficit, the loss of health care coverage for some 13 million Americans, and an immediate $25 billion cut to Medicare, among other nightmares.

"The number one thing" that people need to known about this bill, Hanlon tells me, "is that this thing is happening now. This bill could be law by the end of next week. It might take longer than that, but they are trying to jam it through the Senate, which is the key to all this, next week. There are reasons why they are doing that so fast. Sunlight's the best disinfectant and they do not want people to scrutinize this bill to find out what's in it, to understand the ramifications. So they are trying to get it through as fast as they possibly can."

"If you want to see what's really happening with this bill, you look at what's permanent in it. A lot of it is just temporary, but there's really only three parts that are permanent. Number 1 is a massive tax cut for corporations. Number 2 is a hidden tax increase on basically every single American household. Number 3 is an attack on the Affordable Care Act. They're repealing a key part of Obamacare, the ACA, and it's been estimated to result in 13 million without health insurance, and premiums increasing for people who buy them through marketplaces by 10 percent."

"This is a permanent tax cut for corporations, paid for with a permanent tax increase on individuals and by fewer people having health care," Hanlon, now a Senior Fellow at Center for American Progress, explains. He also speaks to whether the ACA provision is included only as a bargaining chip, whether the Obama Administration used similar tactics to get legislation through Congress, and whether there is any evidence that tax cuts of this sort "pay for themselves", as Trump's Treasury Secretary Steve Mnuchin (pictured above with his new wife and new money) and his Economic Policy Adviser Gary Cohn, among others, have asserted in the desperate effort to pass what would be the only major legislation to be adopted under Trump during his first year of office.

But, if all of that doesn't underscore the difference between Republicans, who support the scheme, and Democrats who virulently oppose it, Trump's Chair of the Federal Communications Commission, Ajit Pai, announced today that the FCC's 3 to 2 Republican majority will vote next month to kill landmark Net Neutrality protections instituted during the Obama Administration. We explain what that means, and how it is likely to result in higher prices for customers and content providers (like BradBlog.com and The BradCast) and slower Internet speeds for sites and consumers who don't pay up tolls to Internet provider behemoths like AT&T and Comcast for access to the "fast lane" on the information super-highway. It will be, as one of the two Democratic commissioners on the FCC said in a statement today, a "green light to our nation's largest broadband providers to engage in anti-consumer practices, including blocking, slowing down traffic, and paid prioritization of online applications and services."

Also today, Trump's DHS announced their intention to deport tens of thousands of Haitians who came to the U.S. legally after the devastating 2010 earthquake (along with their U.S. born citizen children?), and an Obama appointed federal judge has permanently blocked the Trump DoJ's attempt to unlawfully withhold federal funding to so-called "sanctuary cities".

Finally, Desi Doyen joins us for the latest Green News Report with very cool news for electric vehicle fans and some encouraging news for breathers and voters alike in Virginia (which, once again, underscores that, yes, elections matter and yes, there is a difference between the two major parties, whether you like it or not.) And we've also got some good news for endangered elephants, but some bad news for endangered lions in today's report...

When needed to prevent catastrophe and preserve the rule of law, impeachment is both a necessity and a superior political strategy...
By Ernest A. Canning on 11/18/2017 2:44pm PT

Earlier this month, billionaire Democratic Party donor Tom Steyer unleashed his $10 million nationwide "Need To Impeach" campaign (1-minute video ad is posted below). He recently purchased another $10 million in ad time, bringing the campaign total to $20 million.

In targeting Donald Trump for accountability, according to the Los Angeles Times, Steyer "raised the ire of both President Trump and the president's Democratic nemesis, House Minority Leader Nancy Pelosi."

"The president," the Times reported, "lashed out at Steyer in a tweet, deriding him as 'wacky & totally unhinged'." Trump also appears to have managed to convince Fox "News" to stop running the ad on his favorite channel, which claimed it was banning the spot "due to the strong negative reaction...by our viewers."

Trump's distain for the ad is understandable. Pelosi's opposition, however, while consistent with her historical record, should be regarded as unacceptable.

Avoiding real accountability for this President --- and calling on others in her party to do the same --- is deeply flawed and misguided political calculus, calling to mind the admonition of Edmund Burke: "The only thing necessary for the triumph of evil is for good men to do nothing".

In this case, impeachment is needed to preserve the rule of law and prevent a humanitarian catastrophe. Contrary to Pelosi's calculations, it is both a necessity and good political strategy...

Guest: John Ziegler of 'A Voice for All Georgia'; Also: Keystone Pipeline oil spill in SD; Tax bill passed by U.S. House; Menendez mistrial in NJ; Moore tanking in AL...
By Brad Friedman on 11/16/2017 6:05pm PT

On today's BradCast, we head back to Georgia on today's show, to cover the recall effort that is now under way against the state's top election official. But first... [Audio link to show follow below.]

We've got a lot of breaking news as we go to air, including a new spill of some 210,00 gallons of dirty tar sands oil in South Dakota on the Keystone Pipeline. Details were scarce as we went to air, and that number is based on pipeline owner TransCanada's own estimate, but the new spill is likely to affect Nebraska's upcoming decision on the proposed route for TransCanada's controversial KeystoneXL pipeline, which was previously rejected by President Obama, but later approved by President Trump.

The Republican tax cut plan narrowly passed today in the U.S. House on a nearly-party line vote. The scheme, according to non-partisan analysts, would add $1.5 trillion to the national deficit and cut taxes for corporations and the wealthy, while actually resulting in a tax increase for many low- and middle-income Americans. Passage of the unpopular measure is still far from certain, meanwhile, in the U.S. Senate.

Also today, a mistrial was declared in the federal bribery trial against New Jersey's Democratic US Senator Bob Menendez, after the jury was found to be hopelessly deadlocked, with 10 jurors insisting on full acquittal on all charges and two favoring conviction.

The situation for Senate Republicans has not improved following allegations of sexual assault on several teenagers by Roy Moore, Alabama's GOP nominee for next month's US Senate Special Election. An internal GOP poll, according to Politico, finds Moore's numbers tanking against Democratic challenger Doug Jones since the charges came to light. Moore had been up by 16 points in the poll last month. He is now said to be trailing Jones by 12!

And, next door in Georgia, following a massive, covered-up security breach on the state's election server last year, a US House Special Election with questionable results earlier this year in GA's 6th Congressional District, a multi-partisan lawsuit filed to challenge those results and force the state to move away from its wildly-hackable, 100% unverifiable, 15-year old Diebold touch-screen voting systems, and recent blockbuster news revealing that the election server in question was "wiped clean" in the middle of the lawsuit (which the Republican state AG's office now refuses to defend), an official recall petition effort is now underway to demand the removal from office of GA's Republican Sec. of State Brian Kemp.

We're joined today by JOHN ZIEGLER, chair of A Voice for All Georgia, the organization heading up a herculean effort to gather the more than 778,000 signatures of registered GA voters that are required to trigger a recall election (which, he tells me, would be run on the very same 100% unverifiable touch-screen voting systems at the heart of this entire mess!)

Ziegler explains why his group has launched the effort, the obstacles created by the state for successfully obtaining what would be the first recall anywhere in the country of a sitting Sec. of State, and how folks both inside and out of Georgia can help with what HuffPo recently described as "The Biggest Story Nobody's Talking About".

"Kemp and other individuals associated with him have mislabeled our group," Ziegler tells me. "A Voice For All Georgia is a non-partisan group. We have Democrats, we have Republicans, we have Constitutionalists, we have Tea Party members, we have independents. The thing I found very refreshing is that we all share the same common goal, we want to have a secure vote, and we want to have a fair vote, and we want to make sure that all votes count.

"Whether it's gender, ethnicity, religion, values, or beliefs, we all have different opinions, but we've all united together to believe that there should be [a] secure vote, which, in our opinion is to have paper ballots and to have it hand-counted," he says.

Finally, Desi Doyen joins us for a very busy Green News Report, and an update on Thursday's Keystone Pipeline oil spill...

Guest: Ross Morales Rocketto of 'Run for Something'; Also: Another mass shooting at an elementary school...
By Brad Friedman on 11/14/2017 6:21pm PT

On today's BradCast: Have you ever considered running for office? If so, and if you're a progressive, you probably couldn't come up with a better year to it than in the upcoming 2018 mid-term elections! And my guest on today's show says he'd love to help you do it! [Audio link to show follows below.]

But, first up today: It was another day in America, so another mass shooting. We cover today's breaking news out of Northern California where 4 were killed and 10 shot by a gunman who was eventually shot by police in a very rural and economically depressed part of the state. The shooter reportedly fired, sometimes randomly, at some seven different scenes and targeted an elementary school before he was finally taken down. While still officially unidentified as of airtime, the gunman is said to have had a history of domestic violence and neighbors who complained that he was threatening and had recently been heard firing off large magazines of gunfire in recent days. Despite his record, however, he was somehow able to legally obtain the semi-automatic rifle and two hand guns found with him after he was killed.

Republican elected officials who represent the area offered "prayers", as usual, in the wake of this latest shooting. Democratic Gubernatorial hopefuls in the state vowed to take action to help curb American's continuing gun epidemic.

In not-unrelated news, it happens to be "National Run for Office Day", as declared by a host of progressive organizations. To help celebrate, we're joined today by ROSS MORALES ROCKETTO, co-founder of Run for Something, a national progressive organization dedicated to helping first- and second-time progressive grassroots candidates --- particularly millennials, women and people of color --- step up and run for state and local offices.

The group, "born of the tears of the 2016 election", hopes to run more than 1,000 candidates across the country next year, for everything from state representative to city council to local library boards and Boards of Education. They also saw at least 32 of their endorsed candidates win races in last week's 2017 off-year elections, including a number of stunning underdog Democratic victories by first time candidates against long-entrenched Republican office holders.

Rocketto explains how and why he formed the group along with a former Hillary Clinton Campaign staffer; how they determine which candidates to endorse and help; what is needed to run and win a successful grassroots progressive campaign; and how you --- yes, YOU! --- may wish to consider visiting their webpage and getting started to run for something yourself in 2018!

"What we're really trying to do is recruit and support the next generation of progressive Democrats running down-ticket," he tells me. "We think that 2018, for example, is going to be the year of the down-ballot candidates. We know that only 5% of state legislators across the country are millennial, and the millennial generation is going to be the largest voting bloc in the next set of presidential elections. That's what we're setting out to do specifically in 2018."

"We've been hearing from people all across the country that in this particular moment, they want to make a difference in their communities. And, honestly, one of the best ways and the most effective ways to make a difference in your community is to run for office locally," Rocketto says. "The things that impacts people's lives the most on a day-to -day basis tend to be at that local level. And that's what's been so powerful about the stories that we hear from our candidates that are running."

He goes on to cite stories of some of them, like 22-year old Heather Ward in Pennsylvania, who ran and won last week for school board "in a district that is largely Republican" to become the youngest ever to serve on the board, and transgender candidate Danica Roem who unseated a virulent homophobe in Virginia's House of Delegates. We also discuss other progressive groups similarly working to recruit grassroots candidates, like Bernie Sanders' Our Revolution, which supported a 30-year old Marine vet Lee Carter, who unseated the GOP House Majority Whip in Virginia while running as a Democratic Socialist.

Also on today's program: Late updates on Alabama's disastrous GOP nominee for U.S. Senate, Roy Moore following new allegations yesterday of a violent sexual assault against a minor; Several hearings held today in the U.S. House and Senate; and Desi Doyen joins us for the latest Green News Report...

And even some real news about some fake news...
By Brad Friedman on 11/10/2017 6:14pm PT

On today's BradCast, our fight against fake news --- and helping the electorate to understand which news is real and which news is fake --- continues! [Audio link to today's real show is posted below.]

Alabama's Republican U.S. Senate nominee Roy Moore continues to deny Thursday's explosive and detailed investigative report from the Washington Post, charging that when the controversial far rightwing religious zealot was a 32-year old Assistant District Attorney he sexually molested a 14-year old girl. She, like three other teens he also is said to have pursued around the same time, have all gone on record, by name, with their claims.

Despite those blockbuster charges detailed by some 30 sources in WaPo's coverage, and (somewhat cowardly) calls from Republican U.S. Senators for Moore to drop out of the upcoming U.S. Senate Special Election against Democratic candidate and former U.S. Attorney Doug Jones on December 12, most GOP officials in the state of Alabama still appear, embarrassingly enough, to support Moore. Some refuse to believe the allegations at all and others don't seem to care, even if the charges are true and amount to a sex crime against a minor. One statewide elected official (AL State Auditor Jim Ziegler) went so far as to cite the bible in support of the alleged pedophilia, and another elected official (AL State Rep. Ed Henry) actually called (twice) for charges to be brought against the victims themselves.

Nonetheless, despite ongoing "conventional wisdom" that a Democrat couldn't possibly win an Alabama U.S. Senate seat, new polling taken the day the story broke shows the race between Moore and Jones is now in a dead heat. And that's data from before, as the pollster notes, the news about Moore "had a chance to fully sink in."

Then, Donald Trump's so-called "Election Integrity" Commission headed up by top GOP "voter fraud" fraudster and KS Sec. of State Kris Kobach continues to face huge problems. After eight lawsuits have previously been filed against the sham commission, on Thursday, a ninth was filed. That one by one of the Democratic Commissioners on the panel itself!

Finally today, a number of totally fake news stories (about Tuesday's election and Hillary Clinton among other things) became popular via social media this week. We debunk several of them with the help of the Associated Press fact-checkers, included several items of fake news about the American economy and trade with Japan that the President of the United States himself spread during his ongoing Asian tour.

Enjoy! (And my huge thanks to those of you who stop by our donation page to help us continue to do our work over your public airwaves every day! Please consider helping us to continue to do so, if you haven't already!)

Guest: Marilyn Marks, Republican election integrity advocate of Coalition for Good Governance and Georgia election lawsuit plaintiff...
By Brad Friedman on 11/2/2017 6:21pm PT

The fallout --- and disturbing mysteries --- following a lawsuit filed in Georgia after its U.S. House Special Election last June get curiouser and curiouser, as we learned late last night that the state Attorney General's office has now quit its defense of the Secretary of State and the state's other top election official defendants in the case. We discuss all of those bombshells and still-dropping shoes with one of the plaintiffs in the lawsuit on today's BradCast. [Audio link to today's must-listen show follows below.]

We've been covering this entire mess for months now (years, really), but particularly since the lawsuit [PDF] was filed in July, after the somewhat surprising results from June's U.S. House Special Election in Georgia's 6th Congressional District, where GA's former Republican Sec. of State Karen Handel reportedly defeated Democratic candidate Jon Ossoff, but only on the state's 100% unverifiable Diebold touch-screen voting systems. (He defeated her nearly 2 to 1 on the only verifiable ballots in the race, the mail-in paper votes. Everything else regarding the results is unverifiable speculation.)

Late last week, we learned via Frank Bajak at the Associated Press, that technicians at Kennesaw State University's Center for Elections, which has been contracted to program all of Georgia's computer voting and tabulation systems systems for some 15 years, "wiped clean" the election server that was used to program the elections, ballots and tabulators, just days after the suit was filed in July. Its two backup servers were also subsequently wiped and "degaussed three times" in August, the day after the suit was moved from state to federal court.

GA's chief election official, Republican Sec. of State Brian Kemp, claims he knew nothing of the server deletions until AP's report last week. Previously, a huge fan of the Center for Elections at Kennesaw, Kemp cited the "gross incompetence" and "undeniable ineptitude" of the folks at KSU for whatever happened. Nobody has yet to take credit, however, for giving the instructions to delete the servers which held critical evidence that plaintiffs had hoped to have forensically investigated as part of the lawsuit. And then yesterday, in another flip-flop, Kemp called the entire matter "#fakenews".

All of that is disturbing on its own, but even more so in light of revelations earlier this year that the election server in question --- which stored personal data for all of GA's 6.7 million voters and the electronic ballot programming and administrative passwords for the state's voting and tabulation systems --- was left completely accessible online, no password necessary, for at least 6 months. Kennesaw was notified about the vulnerability by a data security researcher in August of 2016 (months before last year's Presidential election), but they failed to secure the server until after Politico's Kim Zetter revealed the vulnerability just prior to the GA-06 U.S. House race this year. (Samantha Bee's Full Frontal covered much of the story up to this point on her show last night, posted here.)

Then, on Wednesday evening, AP's Bajak offered another bombshell in reporting that the Republican state Attorney General's office, which had been defending Kemp, Kennesaw and the state Elections Board in the matter, has now pulled out from defending them. The reasons offered by the state AG and Kemp's campaign for Governor (he's running in 2018) have conflicted with each other or with known evidence obtained during the multi-partisan lawsuit, which a Kemp campaign spokesperson describes to AP yesterday as "a tasteless nothingburger cooked up by liberal activists who know their lawsuit is nothing short of stupid."

One of those "liberal activist" plaintiffs, Republican MARILYN MARKS, a longtime Election Integrity advocate and Executive Director of the Coalition for Good Governance, joins me today to try and help us all figure out just what the hell is actually going on in this increasingly disturbing case.

Marks confirms that nobody still knows who ordered the server deletion, nor why the state AG has dropped out of the case. "It's an enormous mystery, and the mysteries continue to increase every day," she says.

"I think that Brian Kemp is --- and rightfully so --- getting a black eye here," Marks tells me. "What he has done is shameful. There's no way to explain it. So I'm sure his defenders and campaign managers are doing everything they can to go on the offensive and try to make other people look like they are to blame, and that their candidate is innocent. But I think when people step back and say, wait a minute, if they erased the servers --- and they did it twice --- they did it for some reason. And it wasn't because our lawsuit was stupid."

She goes on to explain the "number of conflicting stories that Brian Kemp's people are telling" about when and why the compromised servers were deleted and why the AG's office is no longer willing to defend the case. She also details whether any of the information plaintiffs had hoped to examine from the servers might still be available in what is believed to be a partial copy of the servers obtained by the FBI when they came in to examine the reported data breach that occurred earlier this year, when the servers were discovered to have been left vulnerable online.

Marks' appearance on today's show comes just days before Georgia voters head to the polls for municipal elections being held next Tuesday, which will also be overseen by Kemp, programmed by Kennesaw, and run on the same wildly-hackable, 100% unverifiable touch-screen voting and tabulation systems that lead to this entire mess in the first place. She recently wrote [PDF] to Kemp and other election officials to ask them to make paper ballots available to voters since, as she tells me today, if the system was contaminated during the months it had been left vulnerable on the Internet, "They wouldn't have had time, even within the last year, to have cleaned up everything. Because, as you know, that malware can travel down to the memory cards, the voting machines, the optical scanners, and the jump servers down in the counties. Things could have traveled there in the last six months, year, two years --- and there's been no effort to try to disinfect all of the various components. I mean, there are 27,000 of these touch-screen voting machines in Georgia. There's no way that they should be in use when we know that this system was subject to a high degree of risk."

There is much more today in my conversation with Marks than I can adequately summarize here. So please give today's show a listen for the full story --- or, as much as we know about it to date --- along with many other mind-blowing details.

Also on today's show, a few other items, including Trump's non-scientist nominee for the USDA's chief scientist post, rightwing talk radio host Sam Clovis, withdrawing his nomination after becoming entangled in the Special Counsel's investigation of Team Trump (as you might have been able to predict, had you listened to Tuesday's BradCast with guest Marcy Wheeler); Clovis' fellow climate science denier Rep. Lamar Smith (R-TX), chair of the U.S. House Science Committee announcing he will not run for re-election; and, in the latest Green News Report, Desi Doyen reports on, among many other things, EPA chief Scott Pruitt removing all of the scientists from the EPA's scientific advisory panels...

Highlights unprotected, now-deleted server, lawsuit after GA-06, calls for hand-marked paper ballots to replace state's 100% unverifiable Diebold touch-screen voting systems...
By Brad Friedman on 11/2/2017 11:47am PT

We have been covering, in some detail of late, the disturbing case of the election server in the state of Georgia being "wiped clean", as AP was first to report, just days after the filing of a lawsuit [PDF] following concerns about the veracity of election results in the highly-contested June U.S. House Special Election in GA's 6th Congressional District, as well as last year's Presidential race in the state.

The deletion of the server and its two backups, remains a bit of a mystery for the moment, in that we still do not know who ordered it or why. And, last night, AP followed up with a new report that the state Attorney General who had previously served as the attorney in the case for defendant Brian Kemp, GA's Republican Secretary of State, has quit the case for some unknown reason.

All of that comes on the heels of revelations by Kim Zetter at Politico that the server itself, run by Kennesaw State University's Center for Elections, which has been contracted for some 15 years to program all of Georgia's 100% unverifiable Diebold touch-screen voting and tabulator systems, was left open and completely vulnerable on the Internet for at least six months, as of August 2016, when Kennesaw was initially warned about it by data researcher Logan Lamb. Nonetheless, Kennesaw did nothing to protect that server from outside manipulation, even after beingn warned that the personal voter registration data for 6.7 million GA voters was available to anyone, along with the ballot definition programming files for the state's easily-hacked voting machines and the administrative passwords to access all of those systems!

We'll be discussing these new details and more on today's BradCast with one of the plaintiffs in the lawsuit. But I was really happy to see Samantha Bee's Full Frontal last night cover the issue as well, along with the desperate need for hand-marked paper ballots in the state of Georgia! (And everywhere else!) So I want to post it in full here.

Here's Sam Bee's segment, which, I suspect, long-time BRAD BLOG readers and BradCast listeners will particularly appreciate...

Guest: Garland Favorito of VoterGA; Also: Special Counsel Mueller unseals Team Trump indictments. One pleads guilty, two plead not guilty...
By Brad Friedman on 10/30/2017 6:55pm PT

On today's BradCast: The first indictments by Special Counsel Robert Mueller are unsealed, and we continue to stay on the disturbing case of the state of Georgia's "wiped" election server as revealed late last week. [Audio link to show follows below.]

First up, two Trump Campaign officials pleaded not guilty and one plead guilty, to indictments unsealed on Monday stemming from the Special Counsel's investigation of Team Trump and charges of "collusion" between them and Russia during the 2016 Presidential election. We detail the facts as layed out by the 12-count federal indictment against former Trump Campaign chairman and CEO Paul Manafort and his associate Rick Gates charging that Manafort received some $75 million in income via his work for now-ousted Ukrainian President Victor Yanukovych and the political party which supported him. Both are allies of Russia.

The charges do not include any "collusion" between Manafort/Gates and Russia on behalf of the Trump Campaign, but detail how Manafort, aided by Gates, hid his income from federal officials, failed to register as a Foreign Agent related to his lobbying work in the U.S., and otherwise attempted to launder some $18 million from their many offshore accounts through various schemes in the U.S.

Pleading guilty, according to indictment documents released by the Special Counsel, was George Papadopoulos, an unpaid foreign policy adviser to the Trump Campaign, who allegedly lied to federal investigators about his contacts with an unnamed "professor" said to have told him about "dirt" that Russia supposedly had regarding Hillary Clinton from "thousands of emails" that the US Intelligence Community later said were hacked by Russian agents. Papadopoulos is now cooperating with federal prosecutors.

The White House denies that any of the charges implicate the President or his Campaign. The DNC argues otherwise.

Then, picking up on the disturbing breaking news late last week that officials in Georgia "wiped clean" the Election Server used to program both last year's Presidential Election in the state and this year's U.S. House Special Election in June, we speak with GARLAND FAVORITO of VoterGA.org

The server wipe, confirmed via internal emails, came just days after a bi-partisan lawsuit [PDF] had been filed in July regarding the results of those elections, which were carried out on the state's 100% unverifiable touch-screen voting systems, and after the systems had been programmed via the server that we learned earlier this year had been left completely vulnerable on the Internet for at least 6 months, beginning as early as August of 2016.

The vulnerable server was used to store personal voter registration data for 6.7 million GA voters, as well as ballot programming definition files for the state's computer voting and tabulation systems, and administrative passwords to access those systems. It was first discovered as freely accessible via the Internet by a data security researcher who informed officials at the Kennesaw State University Center for Elections, which has been contracted to handle all of Georgia's elections systems for the past 15 years. The Center left the system up and completely vulnerable during last year's Presidential election and until just prior to the June special election.

Favorito explains the latest developments in that case, as well as his group's new statistical analysis, published a week before the news of the wiped server (and its two backup servers) became public. The report explains what the group sees anomalous election results in the Special U.S. House Election in Georgia's 6th Congressional District in June. The longtime Election Integrity advocate and IT expert details the 72-page report's analysis, concluding that it is "statistically improbable that the reported results are correct" and that they are more likely explained by the manipulation of GA-06 results at the state level, possibly by "external or internal" hackers with free access to the unprotected and now-deleted server.

His conclusion, he explains, is based on analysis of results finding that the Democrat Jon Ossoff soundly defeated Republican Karen Handel by a nearly 2 to 1 margin in the only publicly verifiable results (the mail-in paper ballots) even with a Republican-leaning mail-in electorate. Yet, the Democrat still managed to "lose" somehow, according to the state's highly-vulnerable, easily hackable, unverifiable touch-screen voting and tabulation systems used for early in-person and election day voting.

"The nutshell, the bottom line of it," Favorito tells me, "is that we found that it is statistically improbable that these 6th District runoff results could be correct. And if they are not correct, that means there had to either be some kind of tampering or fraud involved."

We discuss all of that today, including whether GA's Republican Sec. of State Brian Kemp's claims that he knew nothing about the server wipe should be trusted, and whether its still possible to piece together what may have happened in the recent U.S. House race, now that the server at Kennesaw has been mysteriously, if thoroughly, deleted.

All of this comes just days before voters in GA head back to the polls for next Tuesday's municipal elections in Atlanta and elsewhere, which are set to be run on the very same hackable, vulnerable and 100% unverifiable systems...

Also: New details in the mystery of Georgia's 'wiped' election server...
By Brad Friedman on 10/27/2017 5:53pm PT

On today's BradCast: Who ordered the state of Georgia's election server to be completely destroyed amidst a federal lawsuit filed in July? And working to mitigate the "clear and present danger" President Donald J. Trump poses to the nation and the world. [Audio link follows below.]

First up today, a number of follow-up details, for now, on the story we reported yesterday in depth about the state election server computer that was mysteriously "wiped clean" in Georgia, just after a lawsuit was filed questioning whether results were electronically manipulated in some fashion during last year's Presidential election and this year's U.S. House Special Election in the state's 6th Congressional District.

Both contests were run on Georgia's easily-hacked, 100% unverifiable Diebold touch-screen systems and computer tabulators, and programmed by Kennesaw State University's Center for Elections. As AP reported on Thursday, the Center, after 15 years handling all programming for the state's elections, has now completely deleted the server that had been used for programming, including its two back-up servers. Questions remain as to whether the FBI might have an "image" copy of that server, officials are calling for a criminal investigation, and nobody yet knows who ordered the computer hard drives to be completely wiped and "degaussed three times".

We also share a terrific related listener email, and detail some of the terrible reporting on this matter by at least one corporate outlet (which we were able to get them to, at least partially, correct last night.) But, we hope to have much more on this story on our next BradCast.

Then, among the other stories covered on today's program...

  • The American Legion is calling on Trump to protect veterans by vetoing legislation passed this week that will prevent Americans from being able to file class-action lawsuits against big banks and other corporate institutions for fraudulent and deceptive practices;
  • A Military Times poll finds Trump is very unpopular among military officers, though somewhat more popular among enlisted troops;
  • Defense Sec. James Mattis is wildly popular among everybody in the military, though he may be less so, of late, with the Commander-in-Chief. Mattis has been speaking with troops in South Korea and calling for diplomatic solutions in the very dangerous, potentially-nuclear standoff between Trump and North Korea;
  • Democrats in the U.S. Senate introduce legislation to keep Trump from launching a pre-emptive strike, "nuclear or conventional", with North Korea, in hopes of forcing him to follow the Constitution as per the founders, who specifically granted Congress the exclusive right and duty of declaring war against another nation;
  • Trump responds to the $10 million NeedToImpeach.com campaign launched by Tom Steyer, by describing the California activist billionaire as "wacky" and "totally unhinged" in response to the campaign's ad describing the President as "a clear and present danger";
  • And, speaking of "wacky" and "unhinged", Roy Moore --- the twice-disgraced, far-right Republican former Alabama Supreme Court Justice who Trump is supporting in Alabama's U.S. Senate special election coming up in December --- explains why he believes the U.S. Supreme Court's Obergefell ruling that legalized same-sex marriage is "even worse" than the Court's infamous 1857 Dredd Scott opinion which essentially legalized slavery across the U.S. and helped lead the country into the Civil War...

By Brad Friedman on 10/26/2017 6:13pm PT

On today's BradCast: It often feels like we're fighting to save whatever little is left of representative American democracy. Today is certainly one of those days. [Audio link to full show follows below.]

First up today, Associated Press reports that the computer server at Kennesaw State University's Center for Elections in Georgia was "wiped clean" in early July, just days after the state's contentious June 20 Special Election Runoff for the U.S. House Seat in GA's 6th Congressional District, and as a federal lawsuit [PDF] was filed to challenge the results of that election.

Kennesaw's Center has been contracted by the state for some 15 years to program virtually all aspects of Georgia's elections, including their electronic pollbook voter registration databases and the highly hackable and 100% unverifiable Diebold touch-screen voting systems and electronic tabulators used across the entire state.

The complete deletion of information on the server in July --- and, reportedly, two backups of that server in August --- is particularly disturbing given questions about the accuracy of the reported results in the race, said to have been won by Georgia's former Republican Sec. of State Karen Handel over Democrat Jon Ossoff. Some of the concerns were detailed in the ongoing lawsuit filed by a number of plaintiffs, including Republican election integrity advocate Marilyn Marks of the Coalition of Good Governance. (We discussed that suit with Marks on The BradCast in July and concerns revealed about the results of the April Primary with VoterGA's Garland Favorito in May. We hope to speak with both of them on the show again very soon.)

The federal complaint had sought a forensic analysis of the Kennesaw server to determine whether it may have been manipulated in some way. AP reports: "Wiping the server clean 'forestalls any forensic investigation at all,' said Richard DeMillo, a Georgia Tech computer scientist who has closely followed the case. 'People who have nothing to hide don't behave this way.'" Marks is quoted in the same report noting: "I don't think you could find a voting systems expert who would think the deletion of the server data was anything less than insidious and highly suspicious."

The server was discovered by a data security researcher to have been left online and unprotected --- exposing personal voter records, voting system programming files and administrative system passwords --- in August of 2016. Yet, GA's Secretary of State, Republican Brian Kemp (who is running for Governor in 2018), claims to have not been notified, and the server was left unprotected through both the 2016 Presidential election, as well as this year's special U.S. House race. The personal information of some 6.7 million voters, ballot definition files used on voting machines and tabulators, as well as system passwords used by election officials to access those systems were reportedly left vulnerable to manipulation for at least six months, if not longer. (We reported on that aspect of this mess in June of this year.)

Today we discuss the alarming new AP report and what it means, following our own months of coverage of related concerns about the GA-06 special election, failures during tabulation, many questions from Election Integrity advocates about its reported results and, of course, our years (nearly 15 of them) warning about exactly such a situation as this.

Then, speaking of a "rigged" democracy, we're joined by Maplight's Dark Money Watch journalists MARGARET SESSA-HAWKINS and ANDREW PEREZ to discuss their new reporting on federal 'disclosure' documents revealing that millions of dollars were spent to support the Republican U.S. Senate effort to block President Obama's nominee to the U.S. Supreme Court, Merrick Garland, and the subsequent effort to confirm the nomination of President Trump's nominee to that same seat, Neil Gorsuch. The two reporters detail their findings including that, of the $17 million in "dark money" raised and spent on both efforts, a single donation for $17.9 million, from an unknown source to the rightwing Judicial Crisis Network, may have accounted for most, if not all of that effort.

Finally, Desi Doyen joins us for the latest Green News Report on concerns about two dodgy contracts for $500 million to purportedly help rebuild Puerto Rico's power grid; a new report by the non-partisan Government Accountability Office (GAO) on the $350 BILLION U.S. tax-payer dollars spent on climate-related disasters over the past decade, and much MUCH more!...
