It was a dark day on Wednesday, but there were a few rays of light that managed to shine through anyway on today's BradCast. [Audio link to show follows below.]

We'll start here with the grim news. Pipe bombs were discovered to have been sent to perceived political enemies targeted by Donald Trump, including former President Obama, Hillary Clinton, former CIA Director John Brennan, former Attorney General Eric Holder, Congresswoman Maxine Waters and CNN. The explosive devices each appear to have been sent by the same person and follow on a similar one sent to Democratic Party funder George Soros earlier this week. All the intended targets have been widely derided for months, if not years, by Trump, Fox "News" and their many Republican followers.

Thankfully, nobody was hurt. But, as discussed today, the biggest surprise may be how long it has taken for something like this to happen, given the President of the United States --- and his fellow Republicans --- targeting their opponents and the corporate media as the "enemy of the people" with increasingly vitriolic attacks as the midterms approach.

Next up: Tens of thousands of voter registrations were recently rejected by Shelby County (Memphis), Tennessee election officials, with thousands more not yet even processed, even as Early Voting began in the state last week, and the November 6th midterms are now less than two weeks away. Moreover, many of those rejected voters haven't been notified and given a chance to cure the problem, in the very Democratic-leaning, majority-minority county.

The non-partisan Tennessee Black Voter Project, which submitted some 36,000 registration applications in recent months, has threatened the County with legal action. In turn, the County's Republican-led Board of Elections has blamed the Project for turning in a "staggering" number of registrations, many allegedly with what they claim to be errors or missing information. (The group is required to turn in ALL registration forms collected, whether or not they contain either major or minor errors when filled in by prospective voters.)

We're joined today by Shelby County Democratic Party Chair COREY STRONG to explain the hurdles that voting rights advocates there are now actively attempting to overcome, and the history of voter suppression that, he explains, African-American voters in Memphis continue to face this year.

He charges that local officials are disenfranchising minority voters. "We have a history of our Election Commission in Shelby County not necessarily taking it upon themselves to really uphold the values of fair and just elections," he tells me. "If all of the issues end up affecting one side --- the Democratic, urban, poor, minority voters --- then you have to start asking questions, and somebody's got to be held accountable."

The battle on behalf of Shelby County voters comes amidst a reportedly very tight U.S. Senate race between popular Democratic former Governor Phil Bredesen and Republican Rep. Marsha Blackburn, in the contest to fill the U.S. Senate of retiring GOP Sen. Bob Corker. The strongly "blue" county (which went to Clinton by 30 points in 2016 in a state that went to Trump by 25 points) is "very pivotal to statewide elections," Strong explains. In this case, it's central to the state's Senate race as well as Democratic hopes of gaining control of the upper chamber and Republican efforts to hold on to their thin majority.

Strong also discusses concerns about problems during Early Voting, the failure and dangers of electronic pollbooks used across state, and the 100% unverifiable touchscreen voting systems that voters in Memphis are still forced to use to cast their votes at the polling place

But, as noted, we do have a few rays of encouraging news on today's show as well!

On Wednesday, a federal judge ordered an injunction on Georgia's rejection of absentee ballots from disproportionately African-American voters. The rejections are said to be based on ballot signatures that allegedly do not match ones voters' signatures on file. The court found [PDF] voters were being disenfranchised by the scheme that allowed partisan, non-handwriting expert election officials to discard ballots without allowing voters an opportunity to cure any suspected problems on their mail-in ballot envelopes. According to several voting rights groups who sued Republican Sec. of State and gubernatorial candidate Brian Kemp, today's ruling is a big victory amid Kemp's tight race for Governor against African-American Democrat Stacey Abrams.

And, in a bit more good news today, the New York Attorney General, following a three-year investigation, has filed suit against ExxonMobil for an alleged "longstanding fraudulent scheme" to defraud shareholders by publicly downplaying --- and spending millions to deny and confuse the public about --- the serious risks that climate change poses to the company's bottom line. The suit could cost the company hundreds of millions, if not more, and expose Exxon to additional litigation elsewhere. According to the complaint, while publicly claiming concern about global warming as caused by their products in recent years, the company “employed internal practices that were inconsistent with its representations, were undisclosed to investors, and exposed the company to greater risk from climate change regulation than investors were led to believe"...

Among the many stories covered on today's BradCast, with vigor and no small amount of occasional vitriol. [Audio link to show follows below.]...

  • The catastrophic and climate change-fueled Hurricane Michael made landfall in Florida on Wednesday as a deadly and unprecedented Category 4, the strongest ever to strike the Panhandle since record keeping began in 1851;
  • In not unrelated news, another major coal company, one of the nation's oldest, declares bankruptcy. It's the fourth to do so in the past three years;
  • ExxonMobil gets some great publicity from Bloomberg by spending just $1 million (which they generated every two minutes in 2017) in pretending to support a carbon tax scheme (that would benefit them anyway);
  • The U.S. Supreme Court allows a lower court's voter ID ruling to stand in North Dakota, despite the fact that the rule is a change from voting laws used during the April primary and is now likely to result in the disenfranchisement of thousands of Native Americans in a state where Democratic Sen. Heidi Heitkamp faces re-election after winning by just 3,000 votes in 2012. (Here's the ridiculous effort that thousands of Native Americans without a residential address, as now required by ND law to vote, must now go through to get one registered somehow before November 6th.);
  • A state court in Missouri blocks part of their new voter ID law for being "contradictory and misleading" and "impermissibly infring[ing] on a citizen's right to vote" in the state where Democratic Sen. Claire McCaskill is in a very close re-election battle. Her opponent, Republican Attorney General Josh Hawley is defending the law and is likely to seek an appeal from a higher state court;
  • After Georgia's Republican Sec. of State Brian Kemp was found to have purged hundreds of thousands of voters from the rolls over the past several years, AP finds that some 53,000 voter registrations are currently in a suspended state due to GA's "exact match" rule, which allows election officials to block registrants whose names aren't listed identically to the way they are on found on file at either the state's Department of Driver Services or the Social Security Administration. A missing hyphen or a typo by officials entering a name into one of the databases is enough to result in a suspension which, the AP finds, is disproportionately keeping black voters off the rolls. 70% of those blocked are African-Americans, even though GA’s population is just 32% black. Kemp is currently running for Governor against Stacey Abrams who, if successful on November 6th, would become the nation's first African-American female Governor;
  • Some listener mail on a recent show regarding West Virginia's Sen. Joe Manchin, who voted in favor of Brett Kavanaugh's confirmation to the U.S. Supreme Court last weekend, as the coal state Democrat faces re-election after WV voted for Trump by 42 points in 2016;
  • And, finally, a viral musical ditty to close us out today on the "very scary time for young men," as Donald Trump appallingly described it, following the multiple credible allegations of sexual assault by now-Supreme Court Justice Kavanaugh...

On today's BradCast, what else? The FBI's sham "investigation" of Kavanaugh and news of great note regarding the November midterm elections. [Audio link to show follows below.]

The FBI's supplemental background report on U.S. Supreme Court nominee Brett Kavanaugh was released on Thursday morning. Just one copy was made available to U.S. Senators only. It received much criticism from Senate Democrats and much approval from Senate Republicans who couldn't even have possibly read it by the time they were lauding it. The release comes on the heels of the National Council of Churches calling for Kavanaugh's nomination to be withdrawn "immediately", and more than 2,400 law professors (and counting) signing onto a statement seeking the same. Nonetheless, even before the "White House Whitewash" of a report was even released, Republicans scheduled a final floor vote on the confirmation of the most partisan, dishonest nominee the nation has likely ever seen.

Even 98-year old retired Justice John Paul Stevens, appointed by Republican President Gerald Ford and who lauded Kavanaugh in a 2014 book, announced he is now opposing his confirmation following his angry and partisan testimony last week in the Senate Judiciary Committee in response to multiple sexual assault allegations. Justice Steven suggested --- as the churches and law professors did --- that Kavanaugh has proven he lacks the appropriate judicial temperament for a lifetime appointment on the U.S. Supreme Court.

But, even with hundreds of anti-Kavanaugh protesters descending on the Senate today, the only thing that ultimately matters will be the votes of five undecided U.S. Senators. One of them, Democratic Sen. Heidi Heitkamp, who faces a tight re-election contest in Trump-leaning North Dakota in November, announced on Thursday she is a "No" on Kavanaugh. The others, Jeff Flake (R-AZ), Susan Collins (R-ME), Lisa Murkowski (R-AK) and Joe Manchin (D-WV) have yet to commit, though Flake and Collins said on Thursday they found the FBI investigation --- which failed to interview dozens of witnesses, including Kavanaugh himself and his first accuser Dr. Christine Blasey Ford --- to offer no new corroboration to the allegations against the nominee. Collins says she found it to be "very thorough". Manchin, who, according to polling, is comfortably ahead of his Republican opponent this November --- even in state Trump won by 42 points in 2016 --- is reportedly "leaning 'Yes'" on Kavanaugh.

If all Dems vote against and just two Republicans join them, the confirmation will be killed. The first procedural vote, to invoke cloture and move to the final vote, is scheduled for tomorrow.

In the meantime, the divisive issue has helped fuel enthusiasm for the crucial November midterms by both Democrats and Republicans, according to new polling, which also finds younger voters far less likely to vote this year, sadly. The Democrats' hoped-for "blue wave" may rest on turnout of young voters, and may not be quite as certain as many believe, particularly with obstacles preventing voters from registering (the deadline for doing so comes up this weekend in many key states), from voting and from having votes verifiably counted as cast.

While last week's National Voter Registration Day was an unexpected success, thousands of citizens who registered to vote in Texas via the non-profit Vote.org will not be added to the rolls, according to a new report. That could be troubling news for a number of races in the Lone Star state, not the least of which is the contest between GOP Senator Ted Cruz and his surging Democratic challenger Beto O'Rourke.

The Toddler-in-Chief gives us all more fodder than we can stand for a news review: telling Vietnam vets they can’t tell the difference between napalm and Agent Orange; doubling down on pulling security clearances, because anyone dared challenge his authority to do so (those puny blowhards in the military and from the CIA!); and blaming everyone but himself for the skyrocketing price tag of his vanity parade. He showed us! He'll go to Paris and look at their parade, and buy himself some new fighter jets.

Then it's 'GAIUS PUBLIUS' - or rather, THOMAS NEUBURGER, who’s now publishing his commentaries under his real name. You may know his prolific work at Down with Tyranny. He's asked some provocative questions about unions vs. liberals, and how the Democrats fit into that picture. Just as we were speaking, word came down about Trump threatening to pull Bruce Ohr's security clearance. He had some choice words about that, too.

Finally: how arts groups and independent performers are navigating the dual challenge of diminishing funding and politically divided audiences. DAVID GANS is an itinerant independent musician; MEREDITH HAGEDORN founded the small, eclectic Dragon Theatre in a Silicon Valley suburb; and RONIT WIDMANN-LEVY is Director of Arts and Culture at the Oshman Family JCC , a multiple-venue events space. They all face different hurdles keeping their art vibrant.

On today's BradCast: It's kind of amazing that Trump's wildly corrupt Interior Dept. Secretary Ryan Zinke is still in office. Now that the EPA's Scott Pruitt is gone, and Interior just accidentally released a whole bunch of revealing information, maybe Zinke is a bit closer to the exit door. [Audio link to show follows below.]

But first up today, results from Tennessee's primary elections on Thursday, and the outlook for November in the key U.S. Senate race to replace the state's outgoing Republican Sen. Bob Corker. Popular former Democratic Governor Phil Bredesen is now set to face off against the very Trumpy GOP nominee Rep. Marsha Blackburn in a race is central to Democrats' chances of winning back a majority in the upper chamber of Congress in this year's midterms.

Following up our preview yesterday of next week's important U.S. House Special Election in Ohio's 12th Congressional District --- where Democratic candidate Danny O'Connor could very well flip that seat from "red" to "blue" on Tuesday --- our stable genius President tweeted out an endorsement yesterday for a Republican who is not even running in the race.

Also today, some encouraging news out of Texas, where the corporate owners and manager of the Arkema Chemical plant near Houston were indicted on Friday, following the "reckless" release of toxins into the air during an explosion at the plant amid Hurricane Harvey flooding last year.

Then, we're joined by AARON WEISS, Media Director of the Center for Western Priorities (and host of its Go West, Young Podcast), to explain the "monumental" screw-up last month when the U.S. Department of Interior accidentally released unredacted documents regarding the agency's deliberations over the unprecedented lifting of federal protections for a huge portion of the Grand Staircase-Escalante monument in Utah.

"We'd always suspected that the outcome was preordained. But this really makes it crystal clear that the fix was in from the beginning," Weiss tells me, detailing the Department's subsequent redactions in the documents, revealing what Zinke's agency hoped the public wouldn't find out. Namely, that priceless archaeological treasures, native American relics, and a huge tourist and recreational industry benefiting the local economies, are now endangered by the unprecedented closure of nearly half of the Grand Staircase and some 85% of Bears Ears monument (also in Utah). The two monuments are the first to be scaled back in response to Donald Trump's executive order calling for the review of some 27 national monuments established by previous Presidents.

Weiss explains the how the screw-up came about in response to Freedom of Information Act (FOIA) requests: "Under the Freedom of Information Act, you're allowed to redact certain things. But then you also have this very broad exception, it's called the 'B-5 deliberative process exemption.' And it's supposed to be so that officials can discuss policy options candidly. But oftentimes we see that B5 redaction being used as what's called the 'because I want to' redaction. And that's exactly what happened here, because they wanted to redact stuff that didn't look good for them, they called that stuff 'deliberative'. even though many of these sections were not discussing policy options, they were just basic facts."

"If you look at what got mistakenly unredacted in just this one document, and think about the tens of thousands of other pages already released and yet to be released, it does raise huge questions about the way they're abusing that B5 deliberative exemption."

He goes on to offer an update on the several legal challenges facing the unprecedented closures by the Trump Administration, and how the unredacted revelations underscore Team Trump's pretty clear aim of aiding their friends in the fossil fuel extraction industry at the expense of all others. Weiss also highlights a newly emerging scandal regarding what appears to be a wildly corrupt development deal in Zinke's hometown of Whitefish, Montana, involving the Secretary, his wife, and the CEO of oil services giant Halliburton.

Finally today, we share a portion of a short video rant unleashed yesterday by Ring of Fire co-host Farron Cousins, regarding concerns about election system security and hacking in the upcoming election. In the clip, he argues that these worries might have been avoided entirely had both Democrats and Republicans listened "to people like Brad Friedman at The BRAD BLOG" who have been warning about these concerns "for more than 14 years". "If we would have listened to them years ago," Cousins argues, "we wouldn't even be having this conversation today." [Fact-check: Mostly true!]

Important U.S. House Special Election next Tuesday in Columbus, OH; Trump, GOP Congress lying about election security; Admin announces deadly scheme to rollback mileage, air quality standards; More...

On today's BradCast, if you're waiting for the government to save us by protecting elections --- or anything else --- that's not going to happen. But you can save us, as I explain today. [Audio link to show follows below.]

First up today, voters in Tennessee head to the polls for their midterm primaries (yes, on a Thursday! --- perhaps that's one of the reasons the state has among the lowest turnout rates in the country?), as voters elsewhere are preparing for next Tuesday's primaries in Kansas, Missouri, Michigan and Washington.

Also next Tuesday will be the final major U.S. House Special Election of the year before the midterms. The race is in Ohio's 12th Congressional District, a normally very "red" district centered in Columbus, where Republican Troy Balderson had, as recently as last month, been favored by some 10 points over Democrat Danny O'Connor. The race, however, has now become a dead heat, according to new polling from Monmouth and others. So, we have a few very specific and important thoughts for our friends and listeners in Columbus (on WGRN 94.1FM!) today regarding that contest. In short, as I explain: this long-held Republican seat --- in a district which both Romney and Trump reportedly won by some 10 points --- is now flippable, but it will require all hands on deck to do it next week (yes, including independent and Green Party voters!)

In the meantime, Donald Trump's White House paraded out a bunch of their top intelligence community officials to try and convince us all that they give a damn about election security before the November midterms. Don't believe them for a second. I explain why. Similarly, do not believe the Republicans in Congress who now pretend that they give a damn about election security, since, on Wednesday, they proved once again they do not. Every Republican Senator present, with the exception of TN's Bob Corker, voted against an appropriations amendment to give $250 million for additional election security to states. All Democrats voted in favor of the amendment, which received a majority 50-47 vote. But that wasn't enough to overcome the 60 vote filibuster threshold (which Republicans could have waived). That, on the same day the GOP-majority Senate easily approved a $717 billion defense authorization package --- in case you're wondering where their priorities really are.

As explained in an impassioned rant today, in response to all of the above, it's unclear that more money thrown at our computerized election systems would even result in more secure elections or those that Americans can have confidence in. When it comes to our elections and our democracy, and so much more, one thing is clear: "We are not going to be protected by Congress, or the White House, no matter who is in charge of either. The government is not going to save us here. We are going to save us here. We are the only chance that we have."

I offer a number of ways for folks to do exactly that on today's show, which I hope you'll share loudly and broadly. [Update: Desi has transcribed a bit of today's rant for easier sharing right here.]

Speaking of, as we warned on a recent BradCast, the Trump Administration has now formally announced their new scheme today to roll back automobile fuel-efficiency standards that had previously been worked out in an agreement between the Obama Administration, automakers and states like California who have stricter air quality standards than the federal government's. Trump's EPA, however, is hoping to block those new standards --- which experts say will save 40,000 lives per year thanks to cleaner air --- in favor of dirtier air more costly gas mileage for consumers. The Administration justifies the change with a dubious assertion that 1,000 lives per year will be saved, because it will be cheaper for Americans to purchase newer, safer cars --- never mind the higher fuel costs (approximately $170 billion over all) they'll have to pay.

The Administration which pretends to believe in "states' rights" is also moving with their newly proposed regulation to block California's legal right under the federal Clean Air Act to determine their own air quality and mileage standards. The state, and 16 others, have already filed suit against the proposed regulation. A public comment period is now open in response to the measure at this Regulations.gov docket page.

Today's news roundup includes this eternal riddle: is the tendency to be loathsome genetic? C.f. Trump, Trump Jr.: a deconstruction of yet another lying tweet, this time about market growth. Hint: again, TrumpCo trumpets financial news that only benefits the very few.

More news: Facebook's market drop sets a record – in fact, there’s so much going on with Facebook it's sprinkled throughout the show. A nod to an excellent Charles Pierce column in Esquire. And something small but wonderful on the medical marijuana front: a jury in Dublin Georgia solemnly listened to the case against Javonnie McCoy, who admitted he had marijuana for personal medical use. And yes, that's against the law. And the jurors shrugged and sent him home anyway. Seems they couldn’t get a head of steam up about a nice guy who wasn’t hurting anyone.

GARY FERGUSON, author of Land On Fire, joined me to tie the California conflagrations to global warming. This is a twofer: I include an earlier conversation I had with him on In Deep, explaining how the costs of a regional disaster become everyone's financial problem.
