Last Friday night on MSNBC, Rachel Maddow proudly, and justifiably, crowed about the ratings success of last Monday new NBC News documentary, Hubris: Selling the Iraq War, as narrated by her and based on the 2007 book by David Corn and Michael Isikoff.

"First I want to say thank you, if you tuned in this past Monday to watch the new MSNBC documentary about how the last administration tricked the U.S. into the Iraq War," she said. The film garnered the highest ratings of any documentary in the history of the channel.

"The success is really exciting. It means there will be more of where that came from in coming months and years," Maddow explained before announcing that the film will re-air on Friday, March 15th at 9pm ET. (You can watch the entire documentary online before that right here, if you like.)

Congratulations are certainly due. While there were several new revelations in the film, much of the story of the string of blatant lies and scams culled together to hoax the country into war had already been known to those of us news geeks who follow this stuff too closely. Nonetheless, it was very helpful, and an excellent reminder, to see the entire case laid out in a single, simple, watchable presentation. We're delighted to hear it was a ratings success.

Revisiting that disaster also helped encourage The BRAD BLOG to examine several still-existing loose ends --- beyond the fact that, shamefully, nobody in the Bush Administration has ever been brought to account in any way for what happened, including what are clearly a series of very serious war crimes. Among the points we've been looking into, in the wake of the Hubris documentary, is the questions of whether or not Colin Powell "knowingly lied" in his presentation of what turned out to be blatantly false evidence for the case against Saddam Hussein and Iraq, when the then-Secretary of State spoke to the U.N. Security Council on February 5, 2003 and helped turn the tide of public opinion in favor of an invasion.

Powell's Chief of Staff at the time, Col. Lawrence Wilkerson, admits during the film that he and Powell "did participate in a hoax." But, in a statement in response to our request for comment, Wilkerson vigorously denied that either he or his boss knowingly did so. He sent his statement after we'd published anti-war author and activist David Swanson's critique of the Hubris film, on the day after it initially aired. In the critique, Swanson cites his own 2011 essay which offers evidence to argue that Powell "knowingly lied" during his presentation to the U.N. (Both Swanson and 27-year Sr. CIA analyst Ray McGovern, who was cited in Wilkerson's response, each replied to him in turn. You can read all of their responses here.)

While Swanson "applauded" the MSNBC documentary for helping to "prolong Americans' awareness of the lies that destroyed Iraq," he also offered a number of pointed critiques for the cable news channel itself. His observations are on-point in both regards, and help to raise a suggestion for an important and necessary follow-up documentary that, we suspect, would likely garner ratings at least as high as those earned for Hubris.

After all, though Hubris:Selling the Iraq War focused on the lies told by the Bush Administration in the run-up to war, unfortunately, they were not the only ones "selling the Iraq War"...

As our government was making a fraudulent case to attack Iraq in 2002-2003, the MSNBC television network was doing everything it could to help, including booting Phil Donahue and Jeff Cohen off the air.

The Donahue Show was deemed likely to be insufficiently war-boosting and was thus removed 10 years ago next week --- and 10 days after the largest antiwar (or anything else) demonstrations in the history of the world --- as a preemptive strike against the voices of honest peaceful people.

From there, MSNBC proceeded to support the war with mild critiques around the edges, and to white-out the idea of impeachment or accountability.

But now MSNBC has seen its way clear to airing a documentary about the fraudulent case it assisted in, a documentary titled Hubris. This short film (which aired between 9 and 10 p.m. ET Monday night, but with roughly half of those minutes occupied by commercials --- watch the entire documentary now online here) pointed out the role of the New York Times in defrauding the public, but not MSNBC's role.

Yet, my primary response to that is joy rather than disgust. It is now cool to acknowledge war lies. Truth-tellers, including truth-tellers rarely presented with a corporate microphone, made that happen...

David Corn at Mother Jones offers a preview of some of the new information coming Monday, in Hubris: Selling the Iraq War, an MSNBC documentary based on the book of a similar name by Corn and Michael Isikoff.

The film, to be narrated by Rachel Maddow, is said, like the book, to detail the inside story of how America and the world were knowingly scammed by the Bush Administration into invading Iraq ten years ago next month, leading to, as Corn describes it, "a nine-year war resulting in 4,486 dead American troops, 32,226 service members wounded, and over 100,000 dead Iraqi civilians."

"The tab for the war topped $3 trillion," he adds, even though "it turned out there were no weapons of mass destruction and no significant operational ties between Saddam's regime and Al Qaeda. That is, the two main assertions used by Bush and his crew to justify the war were not true."

The facts of how the nation was conned into going to war, Maddow has argued over the past week while promoting and previewing the new film, are important to understand in order to avoid the same thing happening again. "If what we went through 10 years ago did not change us as a nation --- if we do not understand what happened and adapt to resist it --- then history says we are doomed to repeat it," she says.

Maddow says the documentary will likely ruffle many political feathers, and Corn offers a few of the new nuggets of new information on the scam that have been revealed since the publication of his and Isikoff's 2007 book that will be presented in the MSNBC film on Monday, Presidents Day. How far to the Right has the Republican Party gone over the past few years? So far that they now seem to even consider Karl Rove a traitor to their cause.

As evidence, take a look at these headlines from Rightwing sites taking Rove to the woodshed this week in response to his recently announced plan to form the "Conservative Victory Project" Super PAC to keep "Tea Party" candidates who Rove feels can't win general elections, from winning Republican U.S. Senate primaries in the first place...

That's some serious blow-back from Rove's own base --- or what used to be his base. Yes, the hard right Brain of Bush is now far "to the Left" of his own party. Oh, well. Win by the sword, etc...

Calls GOP's 'massive fraud' assertions 'laughable'...

FL's former Republican Gov. Charlie Crist says the GOP's suggestion "that there's some massive fraud going on" by Florida voters is "laughable".

Rachel Maddow's entire intro and interview with Crist last night is very much worth watching, and so we'll post both at the bottom of this article. But one point in particular during the interview with the Republican-turned-independent needs to be highlighted here.

Longtime readers of The BRAD BLOG will recall that it was the progressive Crist who, during his time as Governor in the Sunshine State, among other things, restored voting rights for former felons in the state, expanded early voting hours and even banned all 100% unverifiable touch-screen voting systems for use other than as disabled-accessible voting systems for those who might wish to use them (in order to meet the disability voting requirements in the horrible federal Help America Vote Act of 2002).

The contrast couldn't be more stark from his successor, the reprehensible current Governor Rick Scott, who spent much of this past election year rolling back Crist's improvement to the voting system, in an attempt to keep legal, Democratic-leaning voters from being able to cast their vote at all, as even other Republican officials in the state are now beginning to admit out loud.

In the following, powerful clip from Maddow's full interview last night, she asks Crist, as the former Republican Governor of Florida, about the ridiculously transparent claims by the GOP that restrictions on voter registration, the right to vote by former felons, and the shortening of early voting is "only about voter fraud" and "voting integrity."

"Is it clear to you that is just bunk?," she asks Crist who replies directly in turn: "It's crystal clear to me. You couldn't be more right, in my humble opinion. And, you know, we can say this about all these road bloacks that are put in the way of people exercising their right to vote, and we saw it in a dramatic fashion this last Election Day in Florida"...

While we've been watching the situation, and talking about it on radio over the past week, here at The BRAD BLOG we've yet to have time to cover what's going on in Arizona --- most acutely in Maricopa County (Phoenix) --- where some half a million ballots remain untallied a week after the election when many Hispanic voters who thought they were registered to vote, were directed to cast a provisional ballot instead...for some reason.

Under Arizona law, those voters have until Wednesday to show up to the County Clerk's office with ID to prove they are who they said they were when they cast their ballots last week. The approximately 486,405 uncounted ballots across the state include 307,620 early ballots and 178,785 provisionals. That's 1 out of 4 ballots cast across the state still not included in the results, to date.

In the bargain, a whole bunch of Arizona races --- including their U.S. Senate race, a number of U.S. House races, and several state and local races --- remain officially "undecided" at the moment and/or could see their currently announced "winners" become losers.

The DoJ's Civil Rights Division, according to TPM, may, or may not, be keeping their eyes on the situation there.

The Hispanic community in the state, thankfully, is not taking this one sitting down...especially not after standing in line for hours just to cast their vote, or, in this case, provisional ballots that may or may not be counted. They have been surrounding the Maricopa County Clerk's office in a 24 hour vigil, and phone-banking to call those who were forced to vote provisionally, to let them know they need to get back to the Clerk's office ASAP to try and assure their vote actually gets counted.

This is among the darkest sides of the GOP's War on Democracy that we've been covering all year (for many years, actually) and the shameful battle continues at this hour. We may have more details in the days ahead (on this, and other uncounted ballots and undecided races in other states as well), but, for now, Rachel Maddow did a great overview on MSNBC last night, of the assault on democracy currently being played out in Arizona...

Problem no better in OH...

South Florida, this weekend, 2012...

This is just shameful. Embarrassing for the entire nation. Again. How FL Governor Rick Scott and Ken Detzner, both Republicans, sleep at night I cannot imagine. That, even after both of their Republican predecessors, Governors Charlie Crist and Jeb Bush had the decency to extend early voting hours when lines began snaking around the block in previous years (and we've never had much good to say about Jeb Bush's administration of elections!)

Scott cut Early Voting from 14 days in 2008 to just 8 days this year in the Sunshine State because, apparently, there was just too damned much voting and democracy and stuff going on in 2008.

As Scott refuses to budge, despite the hours-long lines to vote --- as much as 6 hours in many places --- Democrats have been forced to go to court to sue for expanded Early Voting hours at the last minute, as Lizette Alvarez details at New York Times. A judge has already granted four additional hours in one county, after Early Voting had to be temporarily stopped there for a number of hours due to a suspicious object, which had to be detonated by the bomb squad, was left at one of the polling place. But, ultimately, the suits will most likely be too little, too late at this point.

This all comes on the heels of Scott severely restricting voter registration drives, attempting to even further restrict Early Voting hours, and falsely attempting to purge legitimate voters over the past year and, as we noted yesterday, even purging active duty military voters from the rolls in the bargain.

Last night, in a special Saturday broadcast, MNSBC's Rachel Maddow detailed this weekend's Florida disgrace...


Be sure to notice the scenes --- documented in photo after photo, at Early Voting polling place after polling place in the video above --- of lines around the block with people trying to do nothing more than simply cast their vote in the Presidential Election in Florida. Imagine how many voters saw those lines and simply decided not to bother, or were too elderly or infirm to be able to stand there for six hours.

Well, at least it's not like Florida is a state with a history of close elections, or one that's expected to be close at all this year. Most importantly, remember: "We are the world's greatest democracy", right?

Oh...and as Ari Berman has been reporting from on the ground, in Ohio, where Republican Sec. of State Jon Husted has similarly attempted to restrict as much Early Voting as possible, the problems at this hour are not much better.

No doubt during this election cycle, like every election cycle over the past forty years, we'll hear from the GOP about "tax and spend" Democrats.

Even though it doesn't detail how every Republican since Reagan has combined massive, unpaid-for tax cuts for the wealthy with runaway, unpaid-for military spending --- creating a great excuse to destroy the New Deal safety net, in order to slash their runaway deficit-spending --- this chart is, nonetheless rather revealing...

None of that, of course, has kept the bulk of the "Lamestream Media" from repeating the myth of Republicans as "fiscal conservatives," a concept this site has spent many years attempting to debunk. Last night, MSNBC's Rachel Maddow did exactly the same thing when it came to the claim that Mitt Romney's newly chosen Veep pick, Paul Ryan, is a "fiscal conservative."

To borrow from CNN's Soledad O'Brien yesterday, "I understand that this is a Republican talking point because I've heard it repeated over and over again" --- in this case by the Beltway Media --- but "you can't just repeat it and make it true."

Maddow dispatches with the "Ryan as 'fiscal conservative'" nonsense in the unforgiving video below, in which she notes:

If we really are going to be stuck with Paul Ryan as the face of Republicanism for a long time, and if the term "fiscal conservative" is supposed to mean anything, we should get clear there may be a lot of great stuff to say about this guy, but "fiscally conservative" is not one of the things you really can say about him. ... If that counts as fiscal conservative for you, you don't speak English

We covered this on yesterday's Green News Report, but, frankly, it deserves much more of a spotlight here.

Over the weekend, UC Berkley physicist Richard Muller penned an op-ed for the New York Times on the new findings of his Berkley Earth Surface Temperatures (BEST) study. The op-ed is titled "The Conversion of a Climate-Change Skeptic".

Ironically enough, Muller's study, which turned him into a believer, was funded, in no small part, by the climate change denying, oil and chemical magnate Koch Brothers.

Muller was, until his scientific study brought him to his recent science-based epiphany, a favorite of the Climate Change Denial Industry, which is also funded, in no small part, by the Koch boys. So his "total turnaround" as he describes it, "in such a short time," is nothing short of remarkable. As an added benefit, it has, as Desi noted in yesterday's GNR, been driving the fossil fuel propagandists crazy in the bargain...albeit that's a pretty short drive...

His bombshell op-ed begins this way...

CALL me a converted skeptic. Three years ago I identified problems in previous climate studies that, in my mind, threw doubt on the very existence of global warming. Last year, following an intensive research effort involving a dozen scientists, I concluded that global warming was real and that the prior estimates of the rate of warming were correct. I’m now going a step further: Humans are almost entirely the cause.

My total turnaround, in such a short time, is the result of careful and objective analysis by the Berkeley Earth Surface Temperature project, which I founded with my daughter Elizabeth. Our results show that the average temperature of the earth’s land has risen by two and a half degrees Fahrenheit over the past 250 years, including an increase of one and a half degrees over the most recent 50 years. Moreover, it appears likely that essentially all of this increase results from the human emission of greenhouse gases.

The ACLU attorneys representing the petitioners in League of Women Voters of Minnesota v. Ritchie [PDF] (Ritchie), which is scheduled to be heard by the MN Supreme Court on July 17, 2012, have set forth powerful arguments why the Court should remove a polling place photo ID initiative from the November 2012 ballot.

The MN Constitution mandates that a ballot question must truthfully inform voters of what it is they are voting on. The ACLU, following the same format it applied when it successfully prevented a similar photo ID initiative from being placed on the November 2012 ballot in MO, sets forth specific examples of how the ballot question, as enacted by MN's GOP-controlled state legislature, falls well short of that standard.

The ACLU argument may well succeed before the MN Supreme Court. However, as reflected by polls suggesting nearly 80% of Minnesotans support the adoption of photo ID restrictions, there is a very real prospect that the ACLU's legal objections will neither be heard nor understood in the utterly deceived court of public opinion...

Reports by the Miami Herald and by Democracy Now report that the U.S. Department of Justice (DOJ) has "ordered Florida...to end a controversial voter purge that's primarily targeted Latino, Democratic and independent-minded voters" (see video below) may not be technically accurate.

Both refer to the two-page letter submitted by T. Christian Herren, the chief lawyer of the DOJ's Voting Rights Division, to FL officials which suggested that the purge, ordered by Republican Gov. Rick Scott under the unsubstantiated pretense that the state had thousands of non-citizens registered to vote, violated Section 5 of the Voting Rights Act because FL had not sought preclearance for the new voter roll purge either from the DOJ or a federal court. Herren, as the Miami Herald article observed, demanded that FL officials "advise whether the State intends to cease the practice," but stopped short of issuing an actual "order" that FL immediately cease and desist.

Election officials across the state have confirmed that the Governor's purge list includes hundreds, if not thousands, of legally registered U.S. citizens who are improperly identified as "non-citizens" to be removed from the rolls.

Only five of Florida's 67 counties are "covered jurisdictions" under Section 5 of the Voting Rights Act. That means that while Supervisors of Elections in some counties had vowed not to carry out Scott's purge, others, like Seminal County's Republican Supervisor of Elections Mike Ertel, signified their intent to carry out what amounts to a new form of GOP "caging lists" in which those voters who do not respond to official letters in a designated fashion are automatically purged from the eligible voter rolls. On Friday, an attorney from the Florida State Association of Supervisors of Elections, representing all 67 counties, sent a memo to officials recommending they do not carry out the scrub as called for by the state.

The DOJ letter to FL also noted that the voter roll purge across the entire state appears to be in violation of the National Voter Registration Act (NVRA), which bans the removal of voters from the rolls in the 90 days prior to a federal election. Florida is set to hold its federal primary election on August 14th, making May 16th the last legal day for the type of voter roll maintenance the state now claims to be carrying out.

Even assuming that Herren's letter to the state amounts to a DOJ "order," it may not be enough to stop what The Advancement Project estimated in its May 17 letter to Herren [PDF] could ultimately produce an illegal purge of as many as 180,000 otherwise eligible voters based on a flawed, eleventh hour pre-election effort to match voter rolls against the FL driver's license data base.

After receiving the letter from the DOJ, Florida Dept. of State Spokesperson Chris Cates said they intended to continue with their purge anyway. "Bottom line is," Cates told Think Progress, "we are firmly committed to doing the right thing and preventing ineligible voters from being able to cast a ballot."

The purge has already ensnared U.S. citizens like Bill Internicola, the 91-year old, Brooklyn-born, World War II veteran and Bronze Star recipient who fought in the Battle of the Bulge and Archibald Bowyer, another 91-year old WWII vet who has been citizen since the age of 2, and who received his letter from the state warning he would be purged just as his wife had died.

Cates has marginalized such incidents as "a handful of people [who] have been inconvenienced.”

To halt the purge, groups like the ACLU and the DOJ may need to initiate a federal lawsuit in which they seek yet another preliminary injunction, like the one issued late Thursday by U.S. District Court Judge Robert L. Hinkle in League of Women Voters v. Browning [PDF]. That ruling, as we reported on Thursday, spoke to a different aspect of this year's GOP voter suppression effort in FL. Hinkle's ruling ordered an official federal injunction on the draconian restrictions imposed on voter registration workers by the FL GOP, which had earlier led to groups like the League of Women Voters of Florida being forced to cancel their voter registration drives for the first time in some 70 years.

Florida has until June 6th to official respond to the U.S. Dept. of Justice.

As I'm on the road and largely off the grid this week, I was about to post the following video from last night's Rachel Maddow Show, thanking her for covering so much of what we've been covering here at The BRAD BLOG, for so long, in one nice long top-of-show segment.

I'm still going to do that, but below that, I'm happy to post a press release just sent out by the non-partisan Brennan Center for Justice at NYU, breaking the news that a federal judge has issued a preliminary injunction blocking the "key provisions of a restrictive voting law in Florida today." The Brennan Center describes the ruling as "a breakthrough victory for Florida voters and voting rights advocates nationwide."

The new law, H.B. 1355, had included onerous criminal restrictions on third-party voter registration workers. The new rules were so onerous, in fact, that the League of Women Voters of Florida was forced to call off their registration drive in the state for the first time in 70 years. In the wake of the FL GOP's new law, high school teachers had been charged with crimes for registering their own students to vote, and a registration worker had received a threatening letter from the Sec. of State for turning in voter registrations one hour late after a holiday weekend.

U.S. District Court Judge Robert L. Hinkle blocked most of the FL law's new registration requirements today, finding they accomplished little more than suppressing the registration of new voters without serving any legitimate state interest. "If the goal is to discourage voter-registration drives and thus also to make it harder for new voters to register, this may work," wrote Hinkle in his frequently scathing decision [PDF].

The Brennan Center quotes from Hinkle's ruling this way: "Together speech and voting are constitutional rights of special significance; they are the rights most protective of all others, joined in this respect by the ability to vindicate one's rights in a federal court. … [W]hen a plaintiff loses an opportunity to register a voter, the opportunity is gone forever ... And allowing responsible organizations to conduct voter-registration drives --- thus making it easier for citizens to register and vote --- promotes democracy."

It's very good news, as once again another law passed by the GOP with the intention of nothing more than suppressing the vote of largely Democratic-leaning voters is found to be in violation of the Constitution and/or federal law, as has been the case with almost every single one of these GOP-passed laws over the past year --- at least when someone (too often not the U.S. Dept. of Justice, unfortunately) bothers to go to court to challenge them.

Yesterday, at Rolling Stone, Ari Berman had calculated that some 35,000 Florida voters stand to be purged this year if the Republicans' new voter suppression efforts there are carried out in full.

As to Rachel Maddow last night, here's some of the very important coverage she offered at the top of the show, including details on the state of Florida's current effort to purge thousands of legal voters from the rolls by claiming, inaccurately, that they are non-citizens. (NOTE: That effort is a separate voter suppression measure by Republicans in the state of Florida, and is not related to today's federal court ruling blocking the earlier voter suppression measure by Republicans in the state of Florida)...
