Guest: Law professor Peter Shane on lack of 'institutional penalty' for GOP theft of SCOTUS; Also: House GOP makes healthcare bill even crueler...
By Brad Friedman on 3/21/2017 5:52pm PT

On today's BradCast: Donald Trump's U.S. Supreme Court nominee faced questions all day in the U.S. Senate Judiciary Committee. But what the hell is Judge Neil Gorsuch even doing there at all? And doesn't normal coverage of the hearings do little more than normalize a decidedly abnormal situation? [Audio link to show follows below.]

Donald Trump's selection to fill the seat left vacant by the death of Justice Antonin Scalia more than a year ago, represents nothing less than a stolen seat on a stolen U.S. Supreme Court. If he is confirmed, Republicans are likely to be rewarded for their theft with a majority on the high court for another generation, following their unprecedented refusal to even hold hearings for Barack Obama's nominee for the seat, Judge Merrick Garland.

I've been wrestling with how to cover this week's hearings, which I consider to be illegitimate (and that is true even setting aside the disturbing matter of Trump as President!) Professor Peter M. Shane of Ohio State University's Moritz College of Law joins me to try and help make sense of the situation. His recent piece at the American Constitutional Society, cited by the New York Times today, details how neither Democrats nor corporate media, to date, seem to have figured out how to issue any kind of institutional penalty for the GOP's blatant, brazen and unheard of theft.

Shane explains that, historically, despite Republican assertions to the contrary, "there is no close precedent" in history for what the GOP has done here. "The reason that they didn't want Judge Garland to become Justice Garland was, of course, the fear that they would be losing what had been a secure 5-4 conservative majority on the court. But they also didn't want to give him a hearing because they knew, if they gave him a hearing, that Judge Garland would appear to be so thoughtful, so reasonable, so accomplished and balanced a person, that it would be politically much more difficult to vote 'no'. Nobody in the Senate is constitutionally obligated to vote in favor of Judge Garland, it would just be hard to explain why [they didn't.]"

So they stole the seat instead, by refusing to even hold a hearing, much less a vote. As to the Democrats' lack of an organized response, such as a promise to filibuster Judge Gorsuch (or any other Trump nominee other than Garland), despite the threat of the GOP doing away with the filibuster for SCOTUS nominees, Shane observes: "It seems to me that the Democrats very frequently anticipate the political defeat that lies ahead, and just keep their powder dry for a fight that never happens." He argues Dems are likely "worried about political blowback for being a fierce party of resistance," adding: "That's what the Republicans have been, increasingly, since 1980. If they've paid a penalty for it, I haven't noticed."

Also on today's program: While Congressional hearings have taken over the beginning of the week, House Republicans are making last minute changes to their scheme to replace the Affordable Care Act, by making it still crueler for millions of Americans (but with even more kickbacks for wealthy ones!) in hopes of wheeling and dealing for enough votes to squeek by with passage in the U.S. House, where they plan to ram the bill through for a full floor vote this week before tossing it to the Senate.

Finally: A majority of Americans are unable to name even a single SCOTUS Justice, and the tax-payer cost for Trump's constant weekend vacations could cover four federal programs for the arts, the elderly, the jobless and the homeless that his budget proposal hopes to slash entirely...

Guest: Marcy Wheeler on the public testimony from FBI, NSA chiefs in the U.S. House Intel Committee, and the many still-unanswered questions...
By Brad Friedman on 3/20/2017 6:13pm PT

On today's BradCast, FBI Director James Comey and NSA chief Mike Rogers testified for more than five hours today before the U.S. House Intelligence Committee, confirming the existence of an FBI counterintelligence probe into alleged Russian interference in the 2016 U.S. Presidential election, and batting down charges by President Trump that then-President Obama wiretapped Trump Tower before leaving office. [Audio link to show follows below.]

We're joined by national security journalist Marcy Wheeler of Emptywheel.com for analysis of today's long-awaited public hearing, with a focus on the many still-unanswered questions surrounding the charges of collusion between Trump and Russia and of the leaked classified information documenting a phone conversation between Trump's National Security Advisor Mike Flynn and the Russian ambassador to the U.S. Why was Flynn's part of the conversation captured and transcribed by the Intel Community in the first place, before the content of that discussion, concerning sanctions against the former Soviet Union, was leaked to media? Why wasn't Flynn's side of the discussion "masked" or "minimized", as many Americans believe is the case when it comes to the capture of information from U.S. persons during foreign counterintelligence investigations?

"Since 2008," she explains, "it's been permissible for the FBI, in whatever intercepts they get directly, to be able to go back in and look up stuff without distinction of whether the somebody is a US person or a foreigner. This is why the Republicans are so buggy about this."

"What many people are discovering, for the first time, is that the FBI can do backdoor searches. It means they do not need a warrant...where some analyst in the FBI or the NSA has decided someone is of foreign intelligence interest. The FBI doesn't need a warrant for that at all. They access that stuff without any criminal evidence against Americans. If they get a tip on you, they can look you up by your name, just on that tip alone."

Wheeler goes on to detail the legal statutes on that, the lack of public evidence concerning the alleged "cutout" between stolen DNC emails and WikiLeaks, why it took so long for Comey to inform Congress about his investigation at all (he said it's been under way since last July), questions about whether Trump and others in his Administration are susceptible to compromise by foreign agents, and whether or not she has confidence in the Congressional and FBI investigations into all of these matters.

Also today: Trump's approval rating hits a new low, and a federal appellate court protects a Constitutional right in Mississippi by blocking another GOP attempt to close the state's last remaining abortion clinic...

52 years following LBJ's Voting Rights Act speech, and four since the VRA was gutted by SCOTUS, two recent cases prove it's still much needed...
By Brad Friedman on 3/16/2017 6:24pm PT

On today's BradCast, it was another bad day in court for Donald Trump, a disturbing day in the nation (and around the world) for those who care about science, the arts, the war ravaged and the poor, and a pretty encouraging week for those voters who actually give a damn about racial discrimination at the polling place. [Audio link to show is posted below.]

Donald Trump's second attempt at a travel ban is, so far, not faring much better than his first one. Two federal courts have now blocked his newer Executive Order attempting to block Muslims and refugees from entering the country.

In the meantime, Trump finally released his alarming budget proposal, detailing draconian cuts to science, the arts, and policies that assist and aid the poor, in order to pay for a massive $54 billion increase in military spending and the border wall between the U.S. and Mexico. The cuts, if they were to be enacted, are far worse than you might have imagined, and even more drastic than many Congressional Republicans --- and even some in Trump's own Administration --- had been calling for. We detail the cruel mess and some of the responses, including one from the Corporation for Public Broadcast (for which each American pays just $1.35 per year), and who, along with the National Endowment for the Arts and organizations which help the poor and hungry across the globe, would be wiped out by Trump's "American First: Budget Blueprint to Make American Great Again".

Then, on the 52nd anniversary of President Lyndon B. Johnson's historic 1965 introduction of the Voting Rights Act in Congress following the Bloody Sunday march in Selma, Alabama --- and four years since the U.S. Supreme Court gutted that landmark voting law in 2013 --- several court cases over the past week have, once again, found racial discrimination at the polling place by elected officials. We cover two such cases today, one that unlawfully purged African-American voters in a rural Georgia county before a white man unseated a black incumbent mayor in 2015, and the other, with far-reaching implications, in Texas, where a 2 to 1 appellate court ruling finds the state intentionally discriminated against Hispanic voters when drawing up its 2011 Congressional redistricting maps. That ruling (with a remarkable dissent) could result in the state being required to once again obtain federal pre-clearance under the VRA before enacting any new voting laws in the future.

Finally, we close with an amusing --- and telling --- look at what Fox "News" considers to be "anti-Trump media bias"...

Guest: Slate's Mark Joseph Stern, reporting from the U.S. District Court hearing, says DoJ and state of Texas have 'really bungled this one'
Also: Mike Pence used a private email server for sensitive state business --- and got hacked. Lock him up!...
By Brad Friedman on 3/3/2017 6:22pm PT

The hypocrisy gets thicker by the moment. On today's BradCast, Vice President Mike Pence used private email for state business while serving as Indiana's Governor. And, down in Texas, the U.S. Department of Justice, after switching sides in a long running voting rights case, bombs out, according to our guest who was in the courtroom for a remarkable hearing this week. [Audio link to show posted at end of this article.]

Yes, VP Pence has been discovered to have used a private email server for state business as Governor of Indiana, even while running for Vice President and mercilessly criticizing Hillary Clinton for having done the same while Secretary of State. Unlike Clinton's email account, Pence's was actually hacked. That news follows a similar report that Trump's EPA Administrator, Scott Pruitt, also used a private email server for state business while serving as Oklahoma's Attorney General --- and lied to Congress about it.

Then, we're joined by Slate legal reporter Mark Joseph Stern with his amazing report out of Texas, where he was in a federal courtroom this past week, to witness the latest hearing in the long-running case against the state's racially discriminatory Photo ID voting law. The hearing, he explains, was remarkable on a number of fronts. Not the least of which is the fact that, after years of successfully challenging the state Republicans' racist law side-by-side with private litigants, the U.S. Dept. of Justice, now under the control of Donald Trump's Attorney General Jeff Sessions, has switched sides in the case to join with Texas!

The result, as Stern details, was encouraging, gob-smacking and, at times, hilarious. After the state's law, denying access to the polls for those without very specific types of state-issued IDs, has been found racially discriminatory in court after court for years (including by the most conservative U.S. Appeals Court in the land), the only real question now before the U.S. District Court Judge is whether or not Texas enacted their voting restriction with a discriminatory intent. If the law is found (again) to have been purposely designed to discriminate against racial minorities, the state could find themselves back under the Voting Rights Act's pre-clearance regime, requiring federal approval for any new laws related to elections.

The DoJ, now standing with Texas in their call for the case to be dismissed, offered an argument that the Judge didn't appear to be buying, Stern reports --- largely because the argument seemed to make no sense at all. Their argument, in short, is that the state legislature is working on a new version of the same law. Therefore, their intent while creating the previous version should no longer matter nor be held against them as a violation of the law or Constitution. At the same time, the state attempted to offer evidence that they failed to offer during the original trial, which turned out not to be actual evidence at all. Suffice to say, amidst a mountain of real evidence against them, the DoJ and Texas arguments "crashed and burned," says Stern, adding that "t was almost painful to watch!"

This case, "goes way beyond Texas," he notes, citing some of the responses from a plaintiff attorney for the NAACP after the hearing, and a Democrat that the state's attorney inexplicably tried to blame for the law. "This is sort of testing the waters for many other states, even possibly for a national voter ID bill governing all federal elections. This is just the start. So we're really at the threshold of this battle, even though it feels like we've been waging it forever."

There is a lot more in today's interview. Please tune in for it. Trust me. It's a very nice way to end this week.

Guest host Angie Coiro with guests: RJ Eskow; Attorney Jim Brosnahan; Heather 'Digby' Parton; Dave Johnson...
By Angie Coiro on 2/27/2017 5:50pm PT

On today's BradCast, I'll be your guest host, Angie Coiro. Would you like to sit at the bar? Maybe not a bad idea.

Have you had the Trump/Russia links up to here? You have a friend in RJ Eskow, host of The Zero Hour. He's not convinced; he advises skepticism and clear thinking when it comes to sorting the proven from the unproven.

With people fleeing America over the northern border in fear, with at least one report of a man who killed himself rather than be forced back into Mexico, with an Oscar-nominated cinematographer kept out of the US, and a Holocaust scholar from France almost deported --- it's time to take a long look at sanctuary cities, emboldened local police forces, and how to stay focused on resistance. Heralded civil rights attorney/activist Jim Brosnahan of Morrison & Forster in San Francisco, and Heather "Digby" Parton of Hullabaloo take on the many facets of that disaster.

Finally, Dave Johnson of Seeing the Forest and The Campaign for America's Future deconstructs Trump's promised tax cuts, and their connection to failing infrastructure.

Guest host Angie Coiro with Scott Dworkin on #TrumpLeaks; Jonathan Martin on breaking away from Dems; Joel Baum on transgender kids...
By Angie Coiro on 2/24/2017 6:08pm PT

On today's BradCast, guested hosted by me, Angie Coiro, Donald Trump lies at CPAC and Sean Spicer excludes journos from hearing White House news --- just another day with the Trump administration. [Audio link posted below.]

Guest Scott Dworkin of The Democratic Coalition Against Trump tackles the massive tangle that is the Trump family's business relationship with Russia. He saves the best for last: why he thinks the FBI's James Comey will ultimately weigh in on the side of justice.

Then, sociology professor Jonathan Martin makes the case that yes, we should look at a third-party break with Democrats.

Gender Spectrum's Joel Baum joins us to talk about supporting transgender children and teens under an administration that works to take their rights away --- and what parents, teachers, and other loving adults can do.

Then, what went down as journalists from established news organs first had to sign up for a White House press gathering, then one by one got turned away. And, finally, a spotlight on Steve Bannon's appearance at CPAC, and his alleged script for "The Singularity: Resistance Is Futile." (Not. Kidding.)

Guest host Angie Coiro with guest Peter Montgomery of Right Wing Watch...
By Angie Coiro on 2/23/2017 7:58pm PT

On today's BradCast, guest hosted by moi, Angie Coiro, we dive down the rabbit hole into the alternate reality that is CPAC.

My guest is Peter Montgomery, Senior Fellow at Right Wing Watch. Going beyond the highlights, he checks out some of the lower-profile breakout sessions. And he proves he's got the "FAKE NEWS!" shout down hard.

A review of the news includes the bizarre taped exchange between a terrorism expert and a guy in White House obsessed with Twitter - no, not him. Another one.

The Anne Frank Center has pretty much had it with Trump and his surrogates giving lip service to uprooting antisemitism - and their executive director isn't hiding it.

Finally, how today's activists hitting the streets can learn from the pros: veterans of MLK marches and voter suppression court battles share their street-tested wisdom.

Guest: Attorney Mark Joseph Stern of Slate...
By Brad Friedman on 2/22/2017 5:08pm PT

On today's BradCast, as dark as yesterday's show was, today is somewhat the opposite, with a whole bunch of encouraging news from the courts and the people across these United States. [Audio link to show follows below.]

Attorney and legal journalist Mark Joseph Stern of Slate joins us to break down the full 4th Circuit Court of Appeals' potentially landmark decision upholding the state of Maryland's ban on semi-automatic "weapons of war" and the U.S. Supreme Court's ruling today on a race-based death penalty case out of Texas.

On MD's ban on military-style assault weapons, enacted by the legislature following the 2012 Sandyhook Elementary school massacre, the full court's majority ruling, including a number of Republican-appointed judges, soundly rejected the opponents argument that, as Stern says, "once enough people own a certain type of gun, the 2nd Amendment magically begins to protect it." He explains what may happen next with this case as it moves toward the Supreme Court and offers his thoughts on why GOPers and the NRA are suddenly unconcerned with their "states rights" arguments when it comes to guns.

On the SCOTUS death penalty case, granting a repreive, for now, to a Texas man on death row since 1997, Stern explains how the case underscores that "people who are sentenced to death in this country get the worst lawyers sometimes...It's really quite shocking." Incredibly enough, Chief Justice John Roberts eloquently agreed --- at least in this case.

And more encouraging news also covered today...

  • A federal court in Texas blocks the state's attempt to defund Planned Parenthood;
  • North Carolina's Democratic governor moves to withdraw the state's appeal to SCOTUS, filed by his Republican predecessor seeking to overturn a federal appeals court finding that the state's election reform law unconstitutionally discriminated against African-Americans "with surgical precision";
  • An FEC commissioner refuses to back down in the face of legal threats from Koch Brothers'' funded group after her demand to see Trump's alleged evidence of thousands of illegal votes cast in New Hampshire's 2016 Presidential election;
  • Another new poll finds Trump's approval ratings "sinking like a rock";
  • A Muslim group raises $90 thousand (so far) to help repair the desecrated Jewish cemetery in St. Louis, MO;
  • A people continue to exercise democracy, whether Republicans and Donald Trump like it or not, by showing up in huge numbers at Congress member town halls across the country...

Guest: Maria Castro of People United for Justice | Plus: Senate confirms Price in middle of night, Racists celebrate Sessions as new A.G....
By Brad Friedman on 2/10/2017 6:09pm PT

On today's BradCast, Trump took a serious thumping from a federal appeals court this week, but his other Executive Orders on immigration move forward nonetheless, resulting, for a start, in the heart-breaking deportation of an undocumented married mother of two young U.S. born children on Thursday. [Link to full audio posted below.]

Today we cover both Trump's embarassing smack-down by the 9th U.S. Circuit Court of Appeals late yesterday, and the real life effect of his extreme immigration policies. For the latter, we are joined by Maria Castro, a 23-year old organizer with People United for Justice. She was was arrested in Phoenix this week along with other supporters of 36-year old Guadalupe Garcia de Rayos, who was deported to Mexico on Thursday, after coming to the U.S. when she was 14 years old.

Castro, an American-born citizen, describes how she and her family find themselves in a similar situation with her own undocumented immigrant mother who originally came here 24 years ago on a legal visa, but is now at risk of deportation. She discusses her arrest and efforts to help Garcia de Rayos who had been dutifully meeting with officials from the federal Immigration and Customs Enforcement (ICE) agency every six months since her 2008 arrest during a raid at her workplace in Mesa, Arizona. Garcia de Rayos she was convicted of a 6th-degree felony for using a fraudulent Social Security number so she could work (and pay into benefits that she would likely never receive back.)

During our conversation, Castro, who successfully worked to defeat controversial Maricopa County (Phoenix) Sheriff Joe Arpaio last November, describes the mixed feelings of the community as he lost while Trump won. We also discuss the mood in the community among those now threatened by Trump's policies, how they plan to fight it (along with your support), and her criticism of Phoenix Mayor Greg Stanton, who has been outspoken against the Garcia de Rayos deportation, even while, Castro charges, helping to facilitate it in a number of ways.

"My mother is undocumented," Castro tells me, adding that even a jay-walking ticket could now result in her being sent away. "Anything could happen. Any type of interaction with law enforcement could lead to her deportation. She was deported (over a decade ago) and she fought her way back to us. I was 12 years old and my little sister was in kindergarten. We needed our mom, and she made it happen."

As to going public with her name on the record, she tells me: "I have faith in my community and in the resistance, and the work that we do. I feel that the more I lean on my community, the more people I have to support me, the better. For us, for me, what we need to do as a community and community organizers, is we need to start to come together. We can no longer sit in our homes and watch TV and share things on Facebook."

I hope you'll tune in for today's interview. I think it's important to hear.

Finally, in the middle of the night last night (2:30am), Republicans in the U.S. Senate, on a party-line vote, confirmed Rep. Tom Price (R-GA), Trump's nominee to head Health and Human Services, despite a long list of corruption allegations concerning insider stock trading and more, and racists across the country celebrated the confirmation this week of new U.S. Attorney General Jeff Sessions.

Guest: Michael Slater of Project Vote on 'voter fraud' lies and fighting back; Also: Sessions confirmed as AG; Should Manchin be primaried?; And, helping Dems to NOT fall for Trump's SCOTUS bait...
By Brad Friedman on 2/9/2017 5:58pm PT

Today on The BradCast, a story out of France today, discussed at top of show, proves that things could be much, much worse. That said, with things as bad as they are, we discuss what needs to be done to restore sanity to Congress and how to save the Supreme Court, the right to vote, the truth, and everything else that is supposed to come with "democracy". [Audio link to show is posted below.]

Among the stories covered on today's show...

• Civil rights opponent Jeff Sessions of Alabama was confirmed last night as the U.S. Attorney General largely on party lines, save for West Virginia's Democratic Senator Joe Manchin who voted for him. Should Manchin be primaried? Or is the fight for a Democratic majority as a check against Trump and the GOP more important? (I welcome your short and sweet comments on that for possible use on air! Email me, if you like: BradCast - at - BradBlog.com)

• Then, are Democrats taking the bait by taking the side of Trump's stolen Supreme Court nominee Neal Gorsuch, who claims to be "disheartened" by Trump's recent attacks against a federal judge? Answer: Yes, they are. But you can help stop that.

• Next, after new Attorney General Sessions takes office and immediately lies about violent crime statistics, what would he be willing to lie about next in order to make it harder for Democratic-leaning Americans to vote? Michael Slater, President and Executive Director of Project Vote joins us to discuss not only the "voter fraud" myths being perpetuated by Trump, but how American voters need to start working NOW on how to prevent (more) voter suppression and assure the right to vote.

While Slater tells me he believes the media are getting much better in their response to GOP "voter fraud" lies, he warns that Democrats still need a lot of help and organizations when it comes to keeping their eye on the ball. "The Democrats have never been as supportive of voting rights, and put as much energy into expanding voting rights, as we have seen the Republicans in their efforts to restrict voting rights," he notes, during our, at times, chilling, but hopefully enlightening conversation.

• Finally, Desi Doyen joins us for the latest Green News Report, as news breaks that the 3-judge panel on the 9th Circuit Court of Appeals has unanimously rejected Trump's bid to restore his stayed Executive Order banning immigrants, travelers and refugees from seven majority-Muslim countries...

All of that and much more on today's BradCast!...

On today's BradCast: The full letter and the full story behind the letter from Martin Luther King's widow, Coretta Scott King, that resulted in Senate Republicans voting to force Sen. Elizabeth Warren (D-MA) to sit down and shut up for the duration of debate over Donald Trump's objectionable nominee for Attorney General, Sen. Jefferson Beauregard Sessions III (R-AL). [Audio link to show follows below.]

We detail Sessions' failed 1985 "voter fraud" prosecution/harassment of black civil rights workers in Monroe, Alabama which resulted in the Senate's rare, bi-partisan 1986 rejection of Sessions for a federal judgeship under Ronald Reagan and why the fight for the right to vote matters as much now as it did back then...

Guest: Jess Hanson of National Immigration Law Center; Plus: IG launches probe of Trump order; Impeachment getting popular quickly; U.S. Capitol phones are jammed; And other encouraging signs of hope...
By Brad Friedman on 2/3/2017 6:23pm PT

On today's BradCast: The 'Muslim Ban', one week after it was ordered, is even worse than it initially appeared. But, despite the chaos and heartbreak, the response from Americans and those around the world, is heartening. [Audio link to show is posted below.]

Chaos continues in the wake of Trump's executive order banning most travel from 7 majority-Muslim countries. And there were reportedly audible gasps in a federal courtroom in Virginia on Friday, as a U.S. Government attorney revealed that some 100,000 legal visas had been rescinded in the week since Donald Trump's order was signed. (A State Department official later claimed the number was really 'only' about 60,000.)

Jess Hanson of the National Immigration Law Center joins us to describe the continuing crises as "terrifying", as her organization works to assist green card holders who are still being prevented from entering or returning to the U.S., immigrants and other legal visa holders still being detained without legal representation or blocked from traveling here despite federal court orders, and those who are otherwise unconstitutionally losing their rights under the order.

"There have been a lot of organizing efforts with volunteer attorneys on the ground, in U.S. airports, and a massive effort to try to communicate with people who are traveling to the U.S. who are in this situation, to let an attorney on the ground know what airport they're arriving to so that if the individual is allowed to board their flight, when they land in the United States, there is an attorney waiting for them," she explains. But, she adds, "not everyone has the opportunity or resources to find a U.S. attorney before they leave their country of origin" and "a lot of these cases of detention and not allowing someone to speak with an attorney are simply slipping through the cracks."

"Tens of thousands of people...their family, their friends, whatever reason they were going to come to the United States or return to the United States, that has a ripple effect. It's affecting all of us," Hanson tells me. "It's easy to dehumanize numbers --- 'Oh yeah, 60,000 out of 11 million, that's just a drop in the bucket'. But 60,000 or 100,000, whatever the numbers are, that's a lot of people, and it's having global --- honestly global --- effects."

We discuss all of that, as well as the other immigration-related Executive Orders receiving much less coverage since Trump's ban was enacted. Hanson also details a number of ways that you can help.

Also today: The Dept. of Homeland Security's Office of the Inspector General announces a probe into the Trump Administration's disastrous implementation of the ban; A large swath of Americans already want to see the wildly unpopular Trump impeached; GOP Senators are apologizing to our allies for Trump; Phones are ringing off the hook at the U.S. Capitol; And we share a few more signs of hope and encouragement (and even some laughs!) from both home and abroad after just two weeks(!) of this insanely inept and calamitous Administration.

Listeners call in with opinions for and against what will likely result in dishonest, hypocritical Republicans invoking 'the nuclear option'...
By Brad Friedman on 2/1/2017 5:52pm PT

On today's BradCast, history and democracy need heroes right about now. Senate Democrats have the option to fight back against Trump's nominee to the GOP's stolen U.S. Supreme Court, or they can become collaborators and enablers of the Republican theft and be voted out of office in response. [Audio link to show follows below.]

In 2016, Senate Republicans stole the U.S. Supreme Court by refusing to hold a hearing, much less a vote, on Barack Obama's centrist (arguably, too centrist) nominee Judge Merrick Garland following the death of Justice Antonin Scalia. Now that Donald Trump has announced his own nomination for the stolen seat, Judge Neil Gorsuch, history --- and democracy --- demands that Democrats filibuster any nominee other than Garland, even if it leads (as it will) to the "nuclear option" in which Senate Republicans do away the filibuster rule, as Trump has now called for.

We explain why all of this matters on today's show, detailing the GOP's extraordinarily dishonest and hypocritical action and rhetoric on this point from Republican Majority Leader Sen. Mitch McConnell, Sen. Orrin Hatch, Sen. John McCain and others.

Most importantly, we call for listeners to demand their U.S. Senators prevent the Court from being further stolen during Trump's Chaos Presidency. (You can reach your Senators' D.C. offices by calling them at: 202-224-3121). We strongly support Oregon Senator Jeff Merkley's call for exactly this, hope you do too, and hope you'll let your Senators know you will work and donate and vote against them if they fail to protect the Court.

We also take listener calls today from those who both agree and disagree with the above strategy to defend democracy.

Also today, in very related news, orders have reportedly been sent to the Army Corp of Engineers to allow construction of the final section of the Dakota Access Pipeline in North Dakota; Senate Republicans break the rules in order to jam several Trump cabinet nominees through committee, despite their alleged financial improprieties and lying to Congress about them; And several Dems join Republicans to confirm ExxonMobil CEO Rex Tillerson as the next Secretary of State.

Finally, Desi Doyen joins us for the latest Green News Report, as Trump and the GOP Congress move with lightning speed to gut decades of environmental protections, and the state of California pushes back...
