On the stump this week for Republican candidates, NJ's Gov. Chris Christie said GOP governors need to win this year, so they can be in control of the "voting mechanisms" during what he believes might be his own run for President in 2016. He cited three races in particular, in three states that would be crucial to him as the GOP nominee, as reported by New Jersey's The Record...

Great questions, Governor Christie! Let's take a crack at offering some answers for ya...

We really should have taken some time off this past summer, cause it looks like we may not get a good break anytime soon. It may be a much busier November, December and even January than we'd like.

Rachel Maddow highlights what we regard as our personal nightmare scenario: "Almost every legitimately contested, legitimately interesting race in the country --- is tied, right now, with less than three weeks to go"...

Ugh.

"With this many top of the ticket races tied, turnout will be everything," Maddow explains. "So now's the part where we watch for the ways that people will try to stop voters from turning out or from having their votes counted, by hook or by crook. ... Right now, big picture, three weeks out: this is a tie game. Close enough to be fascinating, but also close enough to be stolen"...

KPFK/Pacifica Radio is on fund drive of late, but with all the breaking election news this week, I couldn't stand to not do a fresh BradCast for my syndicated network affiliates who deserve better than a "Best Of" on a week like this one, as Election Day draws near.

So, since it appears this year's election is likely to be decided in the courts, before we even get to Election Day, here's our non-KPFK "Special Election Coverage Edition" for the affiliates and for you, as produced here at The BRAD BLOG World News Headquarters, rather than at the radio station as it is usually done.

No guests, no callers, just me, lots of information and rants, and an occasionally thought or question from my producer Desi Doyen. Given all of that, and the news this week and last (particularly from SCOTUS), the result may be somewhere between a radio broadcast and a primal scream. But many of my shows seem to amount to that these days.

We covered, among other things, the new GAO report confirming Photo ID voting restrictions depress turnout of African-American and younger voters; SCOTUS overturning appellate courts to allow GOP voter suppression laws in NC and in OH, with a decision on WI's voter suppression law not far behind (thanks to the federal judge who lied about it); Federal court striking down VA's gerrymandered Congressional map (for now); the GOP Attorney General candidate in AR caught committing voter fraud and, a lot of unusually good (and very welcome!) news in our latest Green News Report!

Late on Wednesday afternoon, the U.S. Supreme Court reversed [PDF] the 4th Circuit Court of Appeals ruling that had blocked two elements of North Carolina's massive new voter suppression law. Justice Ruth Bader Ginsburg dissented in an opinion joined by Justice Sonia Sotomayor.

"The order isn't a permanent reversal," notes election law expert Justin Levitt, "it's a stay awaiting the disposition of a petition for certiorari, if one is filed. But it's enough to put the state's law back in effect this November."

"The nation's worst voter suppression law since the Jim Crow era," as we described the law when state Republicans enacted it within hours after SCOTUS had gutted a key portion of the Voting Rights Act, will now be in full effect for this year's November general election, despite having been shown to have disenfranchised hundreds of voters during the state's primary earlier this year. There was no debate or time allowed for public comment before the law --- which shortens early voting hours, ends same-day registration, implements disenfranchising polling place Photo ID restrictions (in 2016) and much more --- was passed by the GOP-majority in the NC legislature last year.

Barring a further hearing by the Court, their response to NC's emergency appeal reverses the 4th Circuit Court of Appeals' ruling that had restored both same-day registration and the counting of provisional ballots cast in the wrong precinct. All of the law's other provisions had already been approved for use this year by a George W. Bush-appointed U.S. District Court judge last month, pending a full trial on the merits of the law scheduled for next summer....

I missed this Washington Post article when it first came out late last year. But thanks to too-occasional BRAD BLOG and Washington Monthly contributor D.R. Tucker, I was glad to catch it over the weekend.

It's based on a study by University of Massachusetts at Boston sociologist Keith Bentele and political scientist Erin O'Brien. They looked at restrictive voting statutes enacted over the past several years in all 50 states and the "dominant explanations (and accusations) advanced by both the right and left" in regard to legislation such as polling place Photo ID rules, stricter registration requirements, and other such restrictions on the basic right to vote.

What they found will absolutely NOT stun you in the least...

A bit of encouraging voting news came out of North Carolina on Wednesday, believe it or not. We'll see how long it lasts.

By way of a 2-1 decision and a lengthy Opinion [PDF] on Wednesday, a three-judge panel on the U.S. 4th Circuit Court of Appeal ordered U.S. District Court Judge Thomas J. Schroeder, a George W. Bush appointee, to issue a preliminary injunction to prevent the State of North Carolina from implementing two provisions of a sweeping election "reform" bill.

The court sharply criticized the lower court's ruling that previously allowed the law to move forward as is, despite the likelihood of a disproportionate effect on minority voters in the Tar Heel State.

The BRAD BLOG described the bill in question, when it was passed by the GOP legislature last year, as "the nation's worst voter suppression law since the Jim Crow era." The law includes virtually every restriction on voting --- shortening early voting hours, ending same-day registration, implementation of disenfranchising polling place Photo ID restrictions and much more --- ever attempted by Republicans across the country over the past decade. The legislation was, quite literally, rammed through the state's Republican-controlled legislature, with no period for public comment or debate, just one day after a sharply-divided U.S. Supreme Court gutted the heart of the Voting Rights Act in the Summer of 2013.

The majority opinion at the 4th Circuit was highly critical of Schroeder's analysis in the case. They described it as "flawed," containing "grave errors" and "plainly wrong" on the law. The court found that the District Court judge abused his discretion in refusing to issue a preliminary injunction that would prevent implementation of two provisions of the state's H.B. 589.

In their decision, the three-judge panel's majority also offered significant interpretations of Section 2 of the Voting Rights Act (VRA), that, if ultimately upheld, could minimize the damage wrought by the gutting of Section 5 by the U.S. Supreme Court last year...

UC Irvine law professor Rick Hasen says this development, which he describes as coming from the "Irony Dept", is just "too delicious".

Leslie Rutledge, the Republican candidate for Attorney General in Arkansas, has been discovered to have been registered to vote in multiple states in addition to Arkansas, and even voted by absentee ballot in Arkansas' general election in November of 2008 --- after she had registered to vote in Washington D.C. [PDF] in July of the same year.

According to the Arkansas Democrat-Gazette, Rutledge has now been removed from Arkansas' voting rolls by the Pulaski County Clerk, after he confirmed that she was registered to vote in D.C., and possibly Virginia. The removal from the rolls may also lead to her ineligibility to be elected to office.

Rutledge's Arkansas absentee ballot request form for the 2008 general election is here [PDF]. And, indeed, her subsequent voter registration form from Virginia is here [PDF].

"For the AG candidate of the party who likes to scream about voter fraud to be registered in two (or three) places at once is ironic and amusing on its own," writes Matt Campbell of Arkansas' "Blue Hog Report", which was on this story from the jump.

"However, the bigger implication is Article 19, section 3, of the Arkansas Constitution," he adds, which states: "No persons shall be elected to, or appointed to fill a vacancy in, any office who does not possess the qualifications of an elector." If Rutledge is not registered in Arkansas, she no longer "possess[es] the qualifications of an elector."

But, believe it or not, none of that is the actual ironic part that Hasen was referring to in his piece on this today. Yes, it gets even more ironic!...

Last night, some silly Rightwing dude calling himself "Geraint Roberts" on Facebook, posted a comment on an item on BRAD BLOG's Facebook page, in which he purported to ask "Questions for American Leftists on the subject of voter ID".

As is our usual, courteous custom (when time allows), we quickly answered his questions.

As most of his "questions" are the same talking points we've seen of late, used by tons of either duped or disingenuous Rightwingers in hopes of justifying GOP voter suppression with polling place Photo ID restrictions, you may find both his questions and our brief answers to them, as posted in full below, interesting and/or helpful...

Yes, Ohio Republicans are still barred from limiting the early voting period and still required to restore the days and hours they had, yet again, tried to cut off. At least they are barred, again, for now.

On Wednesday, a unanimous three-judge panel of the U.S. 6th Circuit Court of Appeal issued a 50-page ruling [PDF] in which it upheld a lower court's preliminary injunction from three weeks ago that prevented Ohio’s Republican Secretary of State John Husted from implementing a Feb. 19, 2014 GOP-engineered statute, and his own further Directive, which would have drastically reduced the number of early voting days and hours and eliminated same-day registration and voting during the first five days of a previously established 35-day period of early voting in the Buckeye State.

Reflecting the fact that he anticipated an adverse ruling, Ohio's Republican Attorney General Michael DeWine filed an Emergency Appeal for a Rehearing [PDF] by the full 6th Circuit, on the very same day the three-judge panel handed down their decision. His appeal presents essentially the same arguments that have now, repeatedly, been rejected by the courts, first in a 2012 case, Obama for America v. Husted, and now, again, in Ohio State Conference of the NAACP v. Husted...

Well, this is an interesting turn of events. It includes a bizarre twist that even we would not have foreseen, involving a Republican operative who is now threatening legal action against us for reporting (accurately) on his companies' relationship to voter registration fraud and deceptive voter registration practices during the 2012 election and in previous cycles.

Remember that massive, multi-state GOP voter registration fraud scandal just before the 2012 election? The one that started in Palm Beach, Florida, spread to several different counties, then several different states? The scandal resulted in the Republican National Committee firing the Arizona firm they had secretly hired for millions of dollars to carry out voter registration drives and get-out-the-vote efforts in a bunch of key swing-states, including Florida, North Carolina, Virginia, Nevada and Colorado in advance of the Presidential Election.

The firm at the center of the RNC scandal was named Strategic Allied Consulting. It was created and run by Nathan Sproul, a notorious Arizona-based Republican operative with a checkered past, who ran Republican voter registration drives and other on-the-ground GOP activist campaigns. Sproul's name was not used in the legal filings which created Strategic Allied Consulting in advance of the 2012 election, due to his various companies facing voter registration fraud allegations and criminal investigations in a number of states going back as far as the 2004 Presidential election. Because of that unfairly tarnished background, Sproul claimed when the 2012 scandal first surfaced, the RNC didn't want his fingerprints on the operation. The RNC was dodgy about the issue, but fired Sproul and his firm in several states once the scandal came to light, despite having paid millions of dollars for the effort.

The BRAD BLOG broke a number of stories related to the RNC scandal at the time, including details on the very first reports of "hundreds" of fraudulent registration forms turned in to the Palm Beach County, FL Supervisor of Elections after they were collected by Sproul's workers and turned in by the local Republican Party.

In the same series of articles, we also exposed the deceptive (and perhaps illegal) registration scheme employed by Sproul's firms in states where they operated. The scheme involved registration workers trained to pretend to be pollsters asking voters who they planned to support in the Presidential election. If they answered the question correctly (Romney) Sproul's workers would help them register to vote. If the unsuspecting citizen answered the "survey" question incorrectly (Obama), the workers would wish them a nice day, and then move on to the next target.

As we documented with video, email and other records at the time, including admissions by Sproul himself, his firm used this same deceptive tactic in state after state and in a number of recent election cycles.

Now, a two-year Florida Department of Law Enforcement (FDLE) investigation has finally wrapped up into the 2012 allegations in that state. It has led to yet another arrest of one of Sproul's workers, found no evidence of conspiracy by the company in that state, confirmed The BRAD BLOG's reporting on their deceptive registration technique, and sent Sproul scurrying to threaten us via email (posted below) with a lawsuit...for something...

Wisconsin's Republican Gov. Scott Walker notched a huge victory today at the U.S. 7th Circuit Court of Appeals. The ruling could very well result in the controversial Governor's re-election this November --- at the expense of untold thousands of legally registered voters who may now not be able to vote at all this year.

This morning, a three-judge panel heard Walker's appeal to the federal ruling that previously struck down his Photo ID voting restriction law. By afternoon, almost immediately following the hearing, the three GOP-appointed federal judges (a Reagan appointee, and two George W. Bush appointees) restored the restrictive voting measure [PDF] in advance of the November general election.

As reported by the Journal Sentinel:

Even before the ruling came down, reports from the courtroom earlier today had suggested that it wasn't looking good for those fighting for voting rights there, and that the judges might even order the previously struck-down law to be implemented before this year's mid-term elections, where Walker faces a neck-and-neck re-election contest with his Democratic opponent, Mary Burke.

Instituting the law at this late date, the plaintiffs argued, would cause extraordinary confusion. "I think it would be extremely irresponsible for a court to do something that would so change the landscape not only for the (state Division of Motor Vehicles) but for election officials," Larry Dupuis, legal director of the American Civil Liberties Union of Wisconsin told the Journal Sentinel after today's hearing.

UC Irvine election law professor Rick Hasen noted the same earlier today, before the ruling had come down, explaining why it would be "a very bad idea" to implement this law "just before the election."

Making matters worse, and more confusing for voters and elections officials, the WI GOP's Photo ID voting restriction covers absentee ballots as well as polling place voting, unlike most similar laws enacted by Republicans in other states, where only in-person voting is effected. But, according to the Journal-Sentinel (in a report now replaced online by an updated version on the court's late ruling), the fact that thousands of absentee ballots have already gone out to voters this year without an explanation on them that Photo ID needs to be supplied when they are returned, could result in even more disenfranchisement in the Badger State...

This statement from the ACLU follows today's federal court ruling [PDF] restoring Early Voting hours --- yet again --- in Ohio in advance of the November mid-term elections:

The ruling includes a temporary injunction on the Republican-enacted state law and on additional new restrictions on voting hours implemented by its Republican Sec. of State John Husted, finding the regulations are in violation of both the Equal Protection Clause of the U.S. Constitution's 14th Amendment, as well as Section 2 of the Voting Rights Act which bars racially discriminatory voting laws in all 50 states.

"Ohio keeps trying to cut early voting and the federal courts keep striking the cuts down," writes The Nation's Ari Berman in response to today's ruling.

It's true. This has been going on for years. State Republicans, whether in the form of the legislature or their Republican Sec. of State in Ohio, keep attempting to make it harder to vote, and the federal court keeps ruling those attempts to be in violation of federal law. It has happened over and over again over the past several years.

Berman notes, in regards to today's ruling, that "In 2012, 157,000 Ohioans cast ballots during early voting hours eliminated by the Ohio GOP" and that African-American voters in the state "voted early in person at a rate over twenty times greater than white voters," according to the Lawyers' Committee for Civil Rights.

The expansion of early voting in Ohio was implemented following the disastrous 2004 elections there when many voters --- largely in minority areas --- were forced to wait for 6 hours or more to cast a vote under restrictions implemented by then partisan Sec. of State and co-chair of Bush/Cheney '04 Inc., J. Kenneth Blackwell. The last ballot cast in the Buckeye State that year, when the state's electoral votes would determine the Presidency, was around 2am on Wednesday morning at Kenyon College, where some students had waited on line as much as 10 hours to vote.

The new GOP restrictions cut many of the additional voting opportunities instituted in 2005, which had otherwise led to a fairly smooth election under Democratic Sec. of State Jennifer Brunner in 2008, as she described to us during an exclusive interview in 2012.

Early Absentee voting numbers had doubled between 2004 and 2008 after the expansion of voting hours, as a quick glance at the numbers starkly demonstrates...

I was joined on this week's KPFK/Pacifica Radio BradCast by Rep. Hank Johnson (D-GA), to discuss his "Stop Militarizing Law Enforcement Act" [PDF] which he plans to introduce when the U.S. House returns from their endless recess in September.

He's been at work on the bill long before the local "RoboCops" hit the streets when Ferguson, Missouri blew up recently after the police killing of Michael Brown. As Johnson described the legislation in his March 2014 USA Today op-ed, presciently headlined "Small town American shouldn't resemble a war zone", the bill would "ban MRAPs, other armored personnel carriers, drones, assault weapons and aircraft" from being transferred to local police departments under the Pentagon's "1033 Program" and "ensure that the Department of Defense undertakes an annual accounting of what's been transferred, by whom and to whom to prevent military items from being auctioned on eBay or sold to friends."

"My main hope is to stop the flow of this military grade equipment to local law enforcement agencies throughout America," Johnson told me during our interview today. "We've been flooding the streets with this surplus military weaponry, and I think the situation in Ferguson exemplifies what happens when you have too much powerful equipment in the hands of folks who don't have the judgment or the training to utilize it properly."

But has the horse already left the barn on this issue? And does the Congressman stand a chance of getting his bill through our broken U.S. Congress, even with some apparent bi-partisan support for curbing police militarization from folks like Republican 2016 Presidential hopeful Sen. Rand Paul, who recently called for the same in a Time magazine op-ed? You'll have to listen below to hear Johnson's thoughts on those questions.

After the Congressman left, I discussed a few other related items, such as the voter registration drive now taking place in Ferguson, and took a bunch of calls on all of the above, including at least one amazing one, in which the caller named "Al" insisted that "minorities are in worse shape than they've ever been" in this country. He says that "since 1965 we have been going down hill as a nation." Hmm... I wonder what might have happened during that year to make him feel that way?

Who said anything about "register[ing] Democratic voters"?

"Voter registration for #Ferguson residents is at the QT & the crime scene. SIGN UP. Get on the juries, choose your leaders," tweeted attorney and activist @ReignOfApril. "Voter Registration is a brilliant way to honor #MichaelBrown's memory. It's a positive reaction to horrible situation," wrote @Koursey in reply.

While the city of Ferguson is two-thirds African-American, the vast majority of their police force and almost all local elected officials are not.

"Though whites make up just 29% of the city's residents," reports MSNBC's Zachary Roth, "five of Ferguson's six city council members are white, as is Mayor James Knowles. And six of the local school board's seven members are white."

"We warned people about these kinds of things," John Gaskin of the Missouri NAACP told Roth. "Who hires the police officers? The police chief. Who hires the police chief? The mayor. Who hires the mayor? Who elects the council folks?"

As the Times' Lapidos goes on to note, "Mr. Sharpton did not say that the residents of Ferguson should vote for Democrats; he said they should vote, full stop." She adds: "Isn't it telling that both Mr. Wills and Mr. McLaughlin make no distinction between voter registration and Democratic registration?"

For the record, Ferguson's local elections are nonpartisan.

(Separately, kudos to the Times' Lapidos for describing those two websites for what they are, "right-wing", rather than usual "conservative". It must not have been easy to get that past the Times' editors, even though it's completely accurate. Or maybe the paper has changed their previously unhelpful style rules under their new Executive Editor Dean Baquet, along with this one. Either way, truth in reporting there is accurate, a great change of pace and far more helpful to the electorate.)
