Last night, on Bill "Paul Revere" O'Reilly's show on Fox "News," Karl Rove said he planned to refuse to testify before the U.S. House Judiciary Committee next Monday, as required by the new Congressional subpoena he was served on Monday.

Mr. "Revere" noted, at the end of the interview, that he offered Rove the opportunity to not discuss the issue on the program. "I told Mr. Rove, 'Look, if you don't want to talk about this tonight, you don't have to,'" the hard-nosed, fair and objective, no-spin "newsman" said.

Offering further to further aide and abet Rove in dodging the rule of law and a Congressional subpoena, the courageous O'Reilly told Rove, "If you need a place to hide out, we have it here at the Factor." Impressive stuff. Video via RAW STORY...

Conyers Subpoenas Karl Rove: "It's Time to Talk"

(Washington, D.C.) --- Today, House Judiciary Committee Chairman John Conyers, Jr. issued a subpoena to Karl Rove requiring him to testify regarding his role in the Bush Administration's politicization of the Department of Justice, including the US Attorney firings and the prosecution of former Alabama Governor Don Siegelman. The subpoena was issued pursuant to authority granted in H.R. 5 (111th Congress), and calls for Mr. Rove to appear at deposition on Monday, February 2, 2009. Mr. Rove has previously refused to appear in response to a Judiciary Committee subpoena, claiming that even former presidential advisers cannot be compelled to testify before Congress. That "absolute immunity" position was supported by then-President Bush, but it has been rejected by U.S. District Judge John Bates and President Obama has previously dismissed the claim as "completely misguided."

"I have said many times that I will carry this investigation forward to its conclusion, whether in Congress or in court, and today's action is an important step along the way," said Mr. Conyers. Noting that the change in administration may impact the legal arguments available to Mr. Rove in this long-running dispute, Mr. Conyers added "Change has come to Washington, and I hope Karl Rove is ready for it. After two years of stonewalling, it's time for him to talk."

Her words are more impressive when read, than when seen in the video, I think. Nonetheless, both seem to reveal a Pelosi at a bit of a crossroads. Perhaps. Could the woman who took impeachment "off the table" be ready to now move in a different direction?

In a Sunday morning interview with Fox' Chris Wallace, Speaker of the House Nancy Pelosi signaled that she's open to backing prosecutions of Bush administration officials that may arise from congressional hearings.

"I think we have to learn from the past and we cannot let the politicizing of, for example, the Justice Department to go unreviewed," said Pelosi, . "The past is prologue, we learn from it... I want to see the truth come forth."
...
"I think you look at each item and see what is a violation of the law and do we even have a right to ignore it," Pelosi said. "We have a contempt of Congress against members of the executive branch who withheld information from us."

The words that impress me most there: "You look at each item and see what is a violation of law and do we even have a right to ignore it."

As usual, BRAD BLOG readers were right in overwhelmingly determining, in our poll just after the New Year, that Senate Majority Leader Harry Reid would fold on his previous rhetoric promising to disallow the seating of anybody appointed by Gov. Rod Blagojevich to replace Barack Obama in the U.S. Senate. Roland Burris was sworn in as the newest U.S. Senator just minutes ago, as Reid and his fellow Dems stood in the background applauding.

Of course, as it turned out, it wasn't a difficult poll question to answer, given both the laws concerning such appointments, and the historical record of Reid's inability to either stick to his guns in any fight (ever) or, perhaps even more disturbingly, his failure to have even the slightest clue of when and with whom such battles should be picked.

Presuming Obama makes smart decisions at the White House (and that's certainly no safe assumption), there will only be so much he'll be able to accomplish --- ultimately, particularly after whatever honeymoon he's allowed is gone --- as long as Reid remains Majority Leader in the Senate, and Nancy Pelosi and Steny Hoyer are Speaker and Majority Leader, respectively, in the U.S. House.

They are all three dinosaur fossils of a failed era, have a record of miserable incompetence and need to be replaced. The only question is will it be before or after a thumping in the midterm 2010 elections.

[UPDATE 1/8/09: Oops! The article discussed below is indeed from Wednesday, but from a Wednesday in 2007! March 14th to be precise. I'll not out the colleague who sent it to me, who similarly thought it was published yesterday. But I'll thank the commenter who finally noticed the date on the Reuters article, re-remind myself of the the dangers of "road blogging" too quickly, and otherwise make myself feel better by noting that my originally expressed caution about getting too optimistic at this point was apparently well placed. As another commenter then noted, the original bill in question was later blocked in the Senate by an unknown, likely-Republican, Senator. Let's hope the Ds now have enough votes and control of the Senate to avoid the same fate for these bills that need to be passed now in the new Congress. And my apologies for the false-positive alarm. - BF]

Excellent provision in MN law requires election challenges settled before U.S. Congress is given jurisdiction over Senate seat

The state canvassing board in Minnesota has now certified Al Franken (D) as the winner over incumbent Sen. Norm Coleman (R) in the race for the U.S. Senate. Barring a successful legal challenge, which has now been filed by Coleman, Franken will have won the seat by an astoundingly close 225 votes, out of some 2.9 million cast.

But there's still a chance, albeit a slim one, for Coleman to reverse his fate. A very good provision in MN's law --- not found in most other states --- may delay Franken's seating, meaning he will not be sworn in with rest of Congress at the beginning of the new session slated to start tomorrow. Ultimately, however, the provisions should ensure that whoever is eventually sworn in to serve as the state's Senator will not be forced to serve under a cloud.

The voters of MN deserve that much, no matter how long it takes, and thankfully, like its hand-count laws, the state's provision requiring the completion of legal challenges before final certification is sent to Congress by the Sec. of State, is a model for the nation.

Would that all of the other states in the union had such a provision...

My column this week at the UK's Guardian seems to have provoked some impassioned comments in return.

Before the editors had at it, it was titled in full: "Democrats to the Blogosphere: Thanks for Everything, Now Go Away".

And, by way of value-added content here, these were the first two grafs of the piece before they were excised for length reasons on the published final product...

The Bush administration and Republicans in Congress stored up plenty of good will over the last eight years...for a Democratic sweep on November 4th. But it wasn't necessarily enough good will to lead Progressives to look the other way when Barack Obama and the Democratic leadership start snubbing those who brung 'em to the dance --- and both of them are getting a good start at it right out of the box.

Barrack Obama promised "change", but didn't necessarily explain "change from what". Somehow, many of those who supported and voted for him got the notion that his calls for "change" meant change from the old politics of both the failed Republican and Democratic party leadership. I don't know where they got that idea

Now go read the Guardian column which, largely, picks up after the above. Your comments there, and/or here, always welcome, of course.

Patty Sharaf's explosive, new election integrity film, Murder, Spies & Voting Lies: The Clint Curtis Story, has been named "Best Documentary" at this year's New Jersey Film Festival! Congrats to Patty and crew!

That's the second such award for an election integrity documentary (both featuring yours truly, so clearly, we'd expect no less!) recently, as the San Diego Film Festival's "Best Doc" award went to David Earnhardt's Uncounted: The New Math of American Elections in late September.

MSVL has received some great press of late, even as I haven't had time to cover it. Most recently, Epoch Times called it "a great entertaining thriller," and said it was "alarming" and "outrageous." And Meet the Bloggers reviewed the film as "truly one of the scariest movies I've seen in a very long time" and called it "gripping." (Other recent reviews here and here.)

FL's 24th District 'Vote-Rigging' Congressman, Election Integrity Enemy, Finally Defeated...

Republican Congressman Tom Feeney, rated by nonprofit watchdog group Citizens for Responsibility and Ethics in Washington (C.R.E.W.) as one of the "most corrupt members of Congress" for three years straight, has been defeated in Florida's 24th district. Regular readers of The BRAD BLOG readers know Feeney as the man who allegedly asked computer programmer Clint Curtis to write vote-flipping software in 2000 and escaped all accountability in an investigation stacked with Jeb Bush loyalists. (Full Curtis/Feeney scandal story summarized here, indexed in full here, new documentary film about the terrifying story here.)

According to the official FL Sec State website, as of 9:25 PM Eastern time, Feeney is losing to his Democratic challenger, Suzanne Kosmas by 19 percentage points--59% Kosmas, 40% Feeney. While we here at The BRAD BLOG are of course saddened that it was not Clint Curtis himself --- who left the Republican party after his dealings with Feeney and ran as a Democrat to unseat him in '06 and again in '08 when he lost in the primary --- who finally ended Feeney's ruinous reign, hey, any way we can get rid of Feeney, we'll take it. Of course, Kosmas is a corporate blue dog Dem with ethics issues of here own, as we've discussed here previously, but at this point we'll take the lesser of two evils and happily discharge Mr. Feeney. Here are your walking papers, sir. Job poorly done. Now Go Away. Hopefully to jail. Until then, we're sure he'll land in a cush lobbyist gig within a week.

In other great news, Congressman Robert Wexler is projected to win Florida's 19th district handily with 69% of the vote. Wexler, one of the few Congressional Democrats with teeth, has been a proponent of impeachment and accountability for the Bush administration. His return to Congress to finish his work is a very good thing indeed.

This week, Broward County, Florida, Elections Supervisor Brenda Snipes said, with a straight face, "No one could have anticipated that this election would be so historic and draw as much attention as it has," and defended her choice to oppose expanding early voting hours next week due to "logistical problems."

In addition to the problems in Florida, there are now reports that longtime GOP "voter fraud" hoaxster Pat Rogers (also known for his involvement in the U.S., Attorney Purge Scandal for the bogus "voter fraud" allegations he filed in 2004, and as a board member of the now-defunct and fully-debunked GOP astro-turf group, "American Center for Voting Rights," or ACVR), is apparently using private investigators to intimidate voters in New Mexico.

Hopefully, soon will come the GOP's ACORN "voter fraud" fraud backlash, though I realize that's still very much a hope given the continuous rightwing media's full-throated reporting attempt to punk American democracy in regards this issue.

Palm Beach Post, thankfully, bothered to do some actual reporting yesterday, and led with the following good news:

Republican National Committee officials are turning up the heat on a left-leaning organization linked with Sen. Barack Obama that tried to register "Mickey Mouse" to vote this summer, but state officials say accusations of voter fraud in Florida are mostly unfounded.

The story goes on to quote FL Secretary of State Kurt Browning who says: "'we have not seen a persistent problem across the state of Florida' with registration fraud by ACORN or other groups."

And FL's Republican Governor Charlie Crist who says: "There's some who sort of enjoy chaos. That's kind of what's going on more than fraud."

Bingo, Charlie. And rather ironic, given the outrageous statement John McCain made during last night's debate; the GOP's own far-worse-than-ACORN's record of registration form problems in California; Crist's own record of voter purges in his own state; and the Republican Party's dismal history of trying to use ACORN at the last minute, just before elections, in order to wreak the "chaos" that Crist was referring to...

The Hill reports today that defense attorneys for Congressman Rick Renzi (R-AZ) have filed a motion to dismiss 35 charges of corruption stemming from a sweetheart real estate deal, claiming the federal government secretly and illegally wiretapped Renzi's cell phone.
