Former federal prosecutor Elizabeth de la Vega, author of United States v. George W. Bush et al, sends us the following comments on the resignation of Alberto Gonzales...

“With the departures of Karl Rove, and now Alberto Gonzales, the administration is apparently cutting off its arms and legs to save itself. But this approach does not --- and should not --- work when the source of the disease is in the head, a fact that President Bush has vividly demonstrated this morning when he defiantly accused Congress of dragging Gonzales’s ‘good name through the mud.’ Having used Gonzales as the executioner of the administration’s unprecedented and shameful policies with regard to torture, illegal detention, and politicization of the Justice Department, the President now seeks to politicize Gonzales’s flight from the scene of the crime by blaming the Democrats. We can only hope that Congress will not be intimidated by this shameless, and very tiresome, refrain.”

Ditto. A fish rots from the head down.

UPDATE: One additional thought. Gonzales finally resigned once his potential impeachment by the Democrats seemed where all of this might be heading. We might suggest the same outcome --- resignation --- would be likely for George W. Bush and/or Dick Cheney, once they began to see impeachment as likely, giving them both the chance to claim they were being good guys by 'stepping aside for the good of the country.' What say we give them that out? Dems ought to reconsider their Constitutional duty of bringing accountability to the Executive Branch for the many demonstrated acts of High Crimes and Misdemeanors.

U.S. Attorney Gen. Alberto Gonzales has resigned.

Word of the resignation, which was submitted to George W. Bush last Friday has been leaked to the press, apparently by officials at Bush's vacation home in Texas:

Mr. Gonzales, who had rebuffed calls to resign, submitted his resignation to President Bush by telephone on Friday, the official said. His decision was not immediately announced, the official added, until after the president invited him and his wife to lunch at his ranch [sic] near [Crawford, Texas].

Mr. Bush has not yet chosen a replacement but will not leave the position open long, the official said, speaking on condition of anonymity because the Attorney General's resignation had not yet been made public.

In a series of congressional hearings earlier this year, Gonzales appeared to have perjured himself on multiple occasions. His dissembling and supposedly poor memory about his own actions related to the firing of nine U.S. attorneys and on other matters outraged members of Congress in both parties, some of whom were reportedly considering a move to impeach him this fall.

During a press conference earlier this month, Bush dismissed the idea of firing Gonzales, charging that Congress had found no wrong-doing. "Why would I hold someone accountable whose done nothing wrong?" Bush asked in response to a reporter's question.

Speaking of impeachment, early speculation suggests Bush might nominate DHS Sec. Michael Chertoff, a former judge, as Gonzales's replacement. Chertoff first achieved national notoriety by appearing on cable shows as a virulent anti-Clinton, pro-impeachment talking head in the 1990s. His chief qualification to be attorney general is his status as one of a very few loyal Bush cronies who has won Senate approval in the recent past and therefore could win approval now.

Another name in the mix earlier this year was that of former Bush solicitor general Ted Olson. Olson has even closer ties to the right-wing conspiracies a decade ago. A longtime friend of Clinton prosecutor Ken Starr, Olson served as the de facto chief operating officer of the Arkansas Project, a smear campaign against the Clintons that was funded by Pittsburgh millionaire Richard Melon Scaiffe and was operated out of the offices of the American Spectator magazine. Olson also successfully argued Bush v. Gore at the Supreme Court, for which he was rewarded with the post of solicitor general.

UPDATE: Joe Scarborough, former Republican Congressman turned MSNBC commentator, said of Gonzales moments ago on the cable news channel that Gonzales "has done a terrible job. His position was based on loyalty, not on competence."

"The question is," Scarborough said, "will this president have the courage to appoint someone [to replace him] based on integrity and competence, rather than loyalty."

Speech to VFW Today May Be His Lowest Moment Yet - And That Is Saying a Lot

When you hear the sound bites from George W. Bush's speech to the Veterans of Foreign Wars today in which he compares his botched war in Iraq to the Vietnam war, think about what he was doing while thousands of U.S. soldiers were wounded and killed in the mud of Southeast Asia.

As is well known, rather than serving in Vietnam, George W. Bush spent the war years in a cushy assignment to the "Champagne Unit" of the Texas Air National Guard. There are witnesses from that era who say Bush's main preoccupations then were doing drugs, chasing women and driving drunk. There are also rumors he seriously damaged a fighter jet while taxiing it on a runway.

Conversely, no witnesses have ever been found who can verify that he completed his service with honor --- and there is circumstantial evidence that he did not. Around the time he was in the TNG, the Pentagon began requiring drug testing of all military pilots. The record indicates that Bush never submitted to a physical after the drug testing was required — and thus was never honorably discharged.

Today, in what may be his most astoundingly outrageous speech to date, Bush had the temerity to lecture the American people about lessons the country should have learned from Vietnam:

"Three decades later, there is a legitimate debate about how we got into the Vietnam War and how we left... Whatever your position in that debate, one unmistakable legacy of Vietnam is that the price of America's withdrawal was paid by millions of innocent citizens whose agonies would add to our vocabulary new terms like 'boat people,' 're-education camps,' and 'killing fields.'"

And:

"Here at home, some can argue our withdrawal from Vietnam carried no price to American credibility, but the terrorists see things differently."

Just when you think there is nowhere lower Bush can go to try to fool people into supporting his illegal and misbegotten war, he finds a way to make us even more disgusted with him, the people who work for him and their rank incompetence --- as well as with our leaders who insist on allowing him to remain in office.

Update: Flip-flop alert: In 2004, Bush bristled at comparisons between Iraq and Vietnam: "I think the analogy is false. I also happen to think that analogy sends the wrong message to our troops, and sends the wrong message to the enemy."

"ES&S sold nearly 1,000 voting machines in California without telling the counties that bought them that they had never been certified for use in this state," CA Secretary of State Debra Bowen announced in a statement released moments ago. (Complete statement now posted at end of article).

"Given that each machine costs about $5,000, it appears ES&S has taken $5 million out of the pockets of several California counties, that were simply trying to follow the law and equip their polling places with certified voting machines."

"Not only did ES&S sell machines to California counties that weren’t state certified, it’s clear the machines weren’t even federally certified when the company delivered them to California,” Bowen continued in the no-holds-barred statement. "While ES&S may not like California law, I expect the company to follow the law and not trample over it by selling uncertified voting equipment in this state."

She went on to add that she intends "to go after the company for the full $9.72 million in penalties allowable by law, along with the original $5 million the company took from counties’ pockets."

She ain't kidding! ES&S, the country's largest distributor of voting machines, looks to be in a lot of trouble in California.

Earlier we reported that a public notice from the CA Secretary of State's office was posted this morning by Thad Hall of CalTech announcing that the company "has violated" CA Elections Code by modifying "hundreds of units of a version of the AutoMARK ballot marking device" without certification or permission of the Secretary of State...

Finally! Someone in the mainstream media asks the question that's been answered long ago. At least to those paying attention.

Kudos to Steven Harmon of the MediaNews Sacramento Bureau for finally discussing it out loud in the several mainstream California media outlets that ran his excellent story over the weekend.

Please go read it.

And feel free to laugh out loud at the embarrassing comments by Steve Weir, Registrar of Voters for Contra Costa, CA, and President of the CA Association of Clerks and Elections (CACEO), when he says: "Is the relationship between clerks and vendors an indication of something?...Is it pervasive and nefarious? I don't see it."

Though in the next breath Weir says: "It's been a tight-knit community for years and years, and that relationship might have been too close." Oh, do ya think?

Then comes the following guffaw, courtesy of Sequoia's professional liar/damage control expert/document doctorer, Michelle Shafer, when she says: "There's nothing odd about our relations with our customers...We support conferences and educational events that election officials and staffs attend. Without this support and sponsorship, it would be very hard for these organizations to conduct conferences or have meaningful programming."

(Please note, Shafer is now also the lead lobbyist for the Electronic Technology Council (ETC), the desperate voting machine company trade group.)

Andrew Gumbel, author of Steal This Vote, gets it absolutely right in reply when he says: "[The voting machine companies] went about selling their machines by schmoozing people into believing this would be a great American solution...Now, after they bought into this, county registrars can't tell if the system doesn't work, because it suits them so well from a bureaucratic point of view. They spent a lot of money and don't want to admit they were wrong."

Bingo.

I know it seems difficult to believe, but the first sign we've yet to be able to find publicly of a public official finally considering holding a voting machine company accountable for years of fraud and lying about their equipment, may come out of --- of all places --- Riverside County, CA!

Buried at the bottom of a report in yesterday's Press-Enterprise there is an interesting indication that County Supervisor Bob Buster, one of the most ardent supporters, previously, of touch-screen voting systems made by Sequoia, may be coming around to face reality, and may even be preparing to hold the company accountable for some of the millions of wasted county tax dollars...

Po', po' Diebold. Being unAmerican pays well only up to a point, we guess, as the company's stock once again begins to tumble today after a key analyst cuts his rating for the once-great "security" company, citing "possible legislative concerns in the company's voting machines business."

And even as the company continues to misrepresent its products, on its own website, via knowing lies (otherwise known as fraud).

After the voting machine company's spectacular failure over the weekend at the GOP Straw Poll in Iowa --- where anywhere from 10.5% to 32% of the ballots had to be counted by hand after Diebold's machines failed --- it's little surprise that things are coming apart for the company again. The question, however, is how much farther it still has to go and what the hell the company can possibly do about it at this point.

"Investors could increasingly sour on the stock if Diebold does not try to sell the unit," reports Forbes this afternoon as the stock fell some 4.5% to $47.60 today on heavy trading, after falling at least that much since a high near $54 last Thursday.

Good luck selling that clunker of a division, boys. Liabilities much?

The company, which is already under investigation by the SEC, as we reported exactly one year ago today, reportedly for misstatements of revenue concerning its voting machine business, might face even more difficulties once its investors come to fully understand the depth of the fraud which the company seems to still be perpetuating.

Here's just one fresh example of the company's continuing lies, as found on the Diebold Election Systems, Inc., FAQ page on its own website today.

The company claims, incorrectly, that its touch-screen voting systems "insure ballot anonymity" by scrambling "the order of cast ballots"...

That is, of course, a complete and utter lie. At least according to the computer scientists at University of California who studied the matter in CA SoS Debra Bowen's recent "Top-to-Bottom Review" and found precisely the opposite to be true...

Plans to Spend More Time with Family...

Buried in a newly published profile in the Wall St. Journal comes word that Karl Rove is resigning as head of the White House political office effective August 31.

Rove says he is giving up his powerful position in order to spend more time with his family:

"There's always something that can keep you here, and as much as I'd like to be here, I've got to do this for the sake of my family," Mr. Rove says. His son attends college in San Antonio, and he and his wife, Darby, plan to spend much of their time at their home in nearby Ingram, in the Texas Hill Country.

Rove insists his exit has nothing to do with the multitude of investigations into suspicious Bush administration activities that all seem to lead to his doorstep:

"[I'm] not going to stay or leave based on whether it pleases the mob." He also knows he'll continue to be a target, even from afar, since belief in his influence over every Administration decision has become, well, faith-based.

As to the timing of his departure, Rove offers a bit of his signature plausible implausibility. He says his decision now was prompted by a demand from White House chief of staff Josh Bolten that staffers who stay on past the summer break must commit to serving Bush through the end of his term. That may sound reasonable on the surface but in fact the idea that Bolten could tell Rove when to come and go is not credible.

Whatever his excuse, Rove's departure will increase speculation that investigators are closing in him over his role in the illegal firing of U.S. attorneys for political purposes, vote caging schemes by the Bush-Cheney 2004 campaign, which he directed, or other as-yet unrevealed activities.

Asked 'How Many Dead Americans is Saddam Worth?'

That was then, this is now, we suppose.

Dick Cheney, in 1994 (see short video at right), said "we got it right" by deciding not to invade Iraq after the liberation of Kuwait in '91, since "for the 146 Americans killed in action, and for their families --- it wasn't a cheap war."

"[I]n an effort to get Saddam Hussein, [the question for the President] was how many additional dead Americans is Saddam worth?" Cheney is seen answering the question at the time: "Our judgment was, not very many, and I think we got it right."

Apparently, the worth of Saddam has increased since '94, to at least 4,000 dead Americans and still counting.

But, as we said, that was then, and this is now. So flip-floppery doesn't matter, even though he predicted back then that "if we'd gone to Baghdad we would have been all alone. There wouldn't have been anybody else with us...It's a quagmire if you go that far and try to take over Iraq."

Smart guy. He should have listened to him.

Progressive Democrats of Los Angeles Lobby for Accountability in Meeting with Chairman of House Oversight Committee...

Marcy Winograd, former Democratic candidate for the U.S. House and President of the Progressive Democrats of Los Angeles (PDLA), sent the following e-mail missive to PDLA members earlier today describing a meeting on Tuesday with Rep. Henry Waxman (D-CA), the chairman of the House Oversight Committee.

The conversation regarding Impeachment, the Congressman's views on same, and the arguments made by the activists in favor of it are interesting and offer some insight into both Waxman's thinking at this moment and, undoubtedly, that of many other House Democrats who clearly are seeing things differently from inside the Beltway than those of us outside of it.

We can only hope that all U.S. House and Senate members are getting such an earful now that they're on recess and back in their home districts. Here's Winograd's instructive report in full...

Waxman Says He Will Keep an Open Mind on Impeachment

Congressman Waxman, Chair of the House Oversight Committee, told an impeachment
delegation meeting with him in his Los Angeles office, Tues., Aug. 7, 2007, that he would mull over his constituents' articulate arguments, watch the Bill Moyers' interview on impeachment, and weigh whether there was sufficient evidence to, not just impeach, but convict Bush and Cheney. Waxman told the delegation it was not enough to believe Bush and Cheney were responsible for high crimes; his decision to support or co-sponsor an impeachment resolution must be predicated on the knowledge that there is overwhelming evidence for a conviction.

Progressive Democrats of Los Angeles, California's 41st Assembly District Delegates, the Los Angeles National Impeachment Center, and the LA Green Party participated in the office delegation, while a group of impeachment supporters rallied outside, holding Impeachment is Patriotic signs and a huge banner that read Impeachment is on Our Table.

Inside, the 14 impeachment lobbyists meeting with Waxman offered multiple arguments...
