With the latest KPFK/Pacifica Radio fund drive behind us, it was great to be back on the air live today with The BradCast!

Just in time for Election Day next week, we got everybody up to date on all of the terrible SCOTUS rulings in regard to GOP voter suppression from over the past several weeks --- in OH, NC, WI and TX (and an important Photo ID ruling by the state Supreme Court in AR) --- for those who may have missed our coverage during the fund drive. Now it's up to the voters to try like hell not to be disenfranchised, particularly in TX, where it won't be easy this year.

On the stump this week for Republican candidates, NJ's Gov. Chris Christie said GOP governors need to win this year, so they can be in control of the "voting mechanisms" during what he believes might be his own run for President in 2016. He cited three races in particular, in three states that would be crucial to him as the GOP nominee, as reported by New Jersey's The Record...

Governor Christie pushed further into the contentious debate over voting rights than ever before, saying Tuesday that Republicans need to win gubernatorial races this year so that they're the ones controlling "voting mechanisms" going into the next presidential election.

Republican governors are facing intense fights in the courts over laws they pushed that require specific identification in order to vote and that reduce early voting opportunities. Critics say those laws sharply curtail the numbers of poor and minority voters, who would likely vote for Democrats. Christie - who vetoed a bill to extend early voting in New Jersey - is campaigning for many of those governors now as he considers a run for president in 2016.

Christie stressed the need to keep Republicans in charge of states - and overseeing state-level voting regulations - ahead of the next presidential election.

"Would you rather have Rick Scott in Florida overseeing the voting mechanism, or Charlie Crist? Would you rather have Scott Walker in Wisconsin overseeing the voting mechanism, or would you rather have Mary Burke? Who would you rather have in Ohio, John Kasich or Ed FitzGerald?" he asked.

Great questions, Governor Christie! Let's take a crack at offering some answers for ya...

Appellate judges do not challenge lower court findings, but worry about 'confusion', SCOTUS precedent on late voting law changes

This is not unexpected, though its still disturbing to those concerned about voting rights and the possibility that more than half a million legally registered voters in Texas may not be allowed to vote in this November's election.

A three judge panel on the 5th Circuit Court of Appeals has, for now, blocked the U.S. District Court's ruling last week in Texas, issued after a full trial on the merits of the law, which had struck down state Republicans' polling place Photo ID voting restriction after finding it deliberately discriminatory and a violation of the U.S. Constitution and federal Voting Rights Act.

Following Tuesday's order by the 5th Circuit [PDF] reversing the lower court ruling, for now, the plaintiffs challenging the state statute said, almost immediately, that they plan to file an emergency appeal with the U.S. Supreme Court to put the law back on hold before the November elections.

Voting rights proponents worry that, if the Court holds true to its recent rulings in voting rights cases in NC, in OH and, most recently, in WI, they are likely to allow TX' discriminatory law to stay in place this November, pending a full hearing on the merits at a later date.

There is, however, some important differences in the TX case than in those other three, which we'll explain in a moment.

Texas had appealed the initial 147-page ruling [PDF] by U.S. District Court Judge Nelva Gonazles Ramos, issued last week, which found that the Texas Photo ID voting statue, SB 14, "creates an unconstitutional burden on the right to vote, has an impermissible discriminatory effect against Hispanics and African-Americans, and was imposed with an unconstitutional discriminatory purpose." She also determined that the state requirement that voters produce one of a few very specific types of state-issued Photo ID when voting at the polling place amounted to an "unconstitutional poll tax", since all such ID requires at least some payment by voters...

KPFK/Pacifica Radio is on fund drive of late, but with all the breaking election news this week, I couldn't stand to not do a fresh BradCast for my syndicated network affiliates who deserve better than a "Best Of" on a week like this one, as Election Day draws near.

So, since it appears this year's election is likely to be decided in the courts, before we even get to Election Day, here's our non-KPFK "Special Election Coverage Edition" for the affiliates and for you, as produced here at The BRAD BLOG World News Headquarters, rather than at the radio station as it is usually done.

No guests, no callers, just me, lots of information and rants, and an occasionally thought or question from my producer Desi Doyen. Given all of that, and the news this week and last (particularly from SCOTUS), the result may be somewhere between a radio broadcast and a primal scream. But many of my shows seem to amount to that these days.

We covered, among other things, the new GAO report confirming Photo ID voting restrictions depress turnout of African-American and younger voters; SCOTUS overturning appellate courts to allow GOP voter suppression laws in NC and in OH, with a decision on WI's voter suppression law not far behind (thanks to the federal judge who lied about it); Federal court striking down VA's gerrymandered Congressional map (for now); the GOP Attorney General candidate in AR caught committing voter fraud and, a lot of unusually good (and very welcome!) news in our latest Green News Report!

'Nation's worst voter suppression law' disenfranchised hundreds in state primary; Will have full trial on merits next summer...

Late on Wednesday afternoon, the U.S. Supreme Court reversed [PDF] the 4th Circuit Court of Appeals ruling that had blocked two elements of North Carolina's massive new voter suppression law. Justice Ruth Bader Ginsburg dissented in an opinion joined by Justice Sonia Sotomayor.

"The order isn't a permanent reversal," notes election law expert Justin Levitt, "it's a stay awaiting the disposition of a petition for certiorari, if one is filed. But it's enough to put the state's law back in effect this November."

"The nation's worst voter suppression law since the Jim Crow era," as we described the law when state Republicans enacted it within hours after SCOTUS had gutted a key portion of the Voting Rights Act, will now be in full effect for this year's November general election, despite having been shown to have disenfranchised hundreds of voters during the state's primary earlier this year. There was no debate or time allowed for public comment before the law --- which shortens early voting hours, ends same-day registration, implements disenfranchising polling place Photo ID restrictions (in 2016) and much more --- was passed by the GOP-majority in the NC legislature last year.

Barring a further hearing by the Court, their response to NC's emergency appeal reverses the 4th Circuit Court of Appeals' ruling that had restored both same-day registration and the counting of provisional ballots cast in the wrong precinct. All of the law's other provisions had already been approved for use this year by a George W. Bush-appointed U.S. District Court judge last month, pending a full trial on the merits of the law scheduled for next summer....

Bad news for voters in the Buckeye State. Good news for partisan Republicans who prefer to win elections by making it more difficult for voters to vote.

In a 5 to 4 decision, the Rightwingers on the U.S. Supreme Court have now overturned the 6th Circuit's earlier ruling that had blocked Ohio Republicans' attempt to limit early voting by shortening the Early Voting period by one week, eliminating the week where voters could both register and vote on the same day, and by doing away with Sunday voting before the election...

Via SCOTUSBlog comes this Supreme Court order staying the district court's order preventing various cutbacks in early voting (including a cutback from 35 to 28 days, and elimination of one of the two early voting days on a Sunday, a day African-American churches had been using for "Souls to the Polls" voter drives). [It is not clear from earlier orders which Sunday might be eliminated.]

Although the order is "temporary" in the sense that it will be in place pending a ruling on a cert. petition ultimately to be filed by Ohio in the Supreme Court, that won't happen before this election, and so for this election the new shorter voting period is in effect --- and not the old rules put back in place by the district court and affirmed by the 6th Circuit.

That the Court divided 5-4 along liberal conservative lines is no surprise...

Please note: We don't necessarily agree or disagree with his analysis, at this time. But you can read it and decide for yourself.

The GOP in Ohio has been attempting to shorten and otherwise restrict Early Voting in the state ever since reforms put in place in 2005 --- in response to the embarrassingly disastrous 2004 Presidential Election there --- worked well enough that most of the problems voter had voting had disappeared by 2008. As we have documented over the years, every time they tried to limit those successful reforms, the courts had blocked them from doing so. They did so again this year, until today's 5 to 4 ruling by the Supremes.

It should also be noted that it is, arguably, because John Kerry failed to keep his promise and fight to make sure every vote was counted in Ohio's contested 2004 election, that the U.S. Supreme Court has now gone so hard to the right, with the addition of Justices Roberts and Alito during George W. Bush's second term.

With today's SCOTUS ruling, and the bad news from the partisans on the 7th Circuit concerning WI Republicans' draconian Photo ID voting restrictions, as our legal analyst Ernie Canning detailed this morning, it seems many of this year's most important elections may be won, or lost, in the courts --- before Election Day even gets here.

Repubs file 'Emergency Petition for Rehearing' before full court...

Yes, Ohio Republicans are still barred from limiting the early voting period and still required to restore the days and hours they had, yet again, tried to cut off. At least they are barred, again, for now.

On Wednesday, a unanimous three-judge panel of the U.S. 6th Circuit Court of Appeal issued a 50-page ruling [PDF] in which it upheld a lower court's preliminary injunction from three weeks ago that prevented Ohio’s Republican Secretary of State John Husted from implementing a Feb. 19, 2014 GOP-engineered statute, and his own further Directive, which would have drastically reduced the number of early voting days and hours and eliminated same-day registration and voting during the first five days of a previously established 35-day period of early voting in the Buckeye State.

Reflecting the fact that he anticipated an adverse ruling, Ohio's Republican Attorney General Michael DeWine filed an Emergency Appeal for a Rehearing [PDF] by the full 6th Circuit, on the very same day the three-judge panel handed down their decision. His appeal presents essentially the same arguments that have now, repeatedly, been rejected by the courts, first in a 2012 case, Obama for America v. Husted, and now, again, in Ohio State Conference of the NAACP v. Husted...

Restores evening hours, 'Souls to the Polls' Sunday, and 'Golden Week', allowing both registration and same-day voting...

This statement from the ACLU follows today's federal court ruling [PDF] restoring Early Voting hours --- yet again --- in Ohio in advance of the November mid-term elections:

COLUMBUS, Ohio -- A federal judge today ruled that cuts to early voting in Ohio must be restored in time for the November election. The American Civil Liberties Union is challenging a state law and directives that have dramatically slashed early voting opportunities in Ohio. The ACLU was in court last month to ask the judge to restore the cuts prior to full trial, in time for the midterm election.

"This ruling will safeguard the vote for thousands of Ohioans during the midterm election," said Dale Ho, director of the ACLU's Voting Rights Project. "If these cuts had been allowed to remain in place, many voters would have lost a critical opportunity to participate in our democratic process this November. This is a huge victory for Ohio voters and for all those who believe in protecting the integrity of our elections."

Today's ruling restores the first week of early voting, often referred to as "Golden Week," in which voters are able to register and cast a ballot on the same day. It also restores evening early voting, as well as multiple Sundays.

The ruling includes a temporary injunction on the Republican-enacted state law and on additional new restrictions on voting hours implemented by its Republican Sec. of State John Husted, finding the regulations are in violation of both the Equal Protection Clause of the U.S. Constitution's 14th Amendment, as well as Section 2 of the Voting Rights Act which bars racially discriminatory voting laws in all 50 states.

"Ohio keeps trying to cut early voting and the federal courts keep striking the cuts down," writes The Nation's Ari Berman in response to today's ruling.

It's true. This has been going on for years. State Republicans, whether in the form of the legislature or their Republican Sec. of State in Ohio, keep attempting to make it harder to vote, and the federal court keeps ruling those attempts to be in violation of federal law. It has happened over and over again over the past several years.

Berman notes, in regards to today's ruling, that "In 2012, 157,000 Ohioans cast ballots during early voting hours eliminated by the Ohio GOP" and that African-American voters in the state "voted early in person at a rate over twenty times greater than white voters," according to the Lawyers' Committee for Civil Rights.

The expansion of early voting in Ohio was implemented following the disastrous 2004 elections there when many voters --- largely in minority areas --- were forced to wait for 6 hours or more to cast a vote under restrictions implemented by then partisan Sec. of State and co-chair of Bush/Cheney '04 Inc., J. Kenneth Blackwell. The last ballot cast in the Buckeye State that year, when the state's electoral votes would determine the Presidency, was around 2am on Wednesday morning at Kenyon College, where some students had waited on line as much as 10 hours to vote.

The new GOP restrictions cut many of the additional voting opportunities instituted in 2005, which had otherwise led to a fairly smooth election under Democratic Sec. of State Jennifer Brunner in 2008, as she described to us during an exclusive interview in 2012.

Early Absentee voting numbers had doubled between 2004 and 2008 after the expansion of voting hours, as a quick glance at the numbers starkly demonstrates...

Dick and Dubya are back in the news! Now I wonder how that might have happened. On the upside, it allowed me to play some clips on this week's show that I first put together for a show back in 2006 (or earlier?)

Apparently, swinging and missing on three separate occasions is not enough to get either Ohio's Republican Governor John Kasich or its Republican Secretary of State John Husted to walk away from the plate.

After U.S. District Court Judge Peter Economus issued an August 2012 preliminary injunction that forced the Buckeye State to restore early voting for the three days preceding the November 2012 Presidential Election, Husted found it necessary to apologize to the court for what appeared to be a contemptuous directive to the state's 88 county Boards of Election that they not establish hours for voting on those days, pending the state's appeal of the preliminary injunction. Strike one!

In early October 2012, a unanimous three judge panel of the U.S. 6th Circuit Court of Appeal ruled against Husted, expressly sustaining every aspect of Judge Economus' August 2012 decision. Strike two!

That same month, the U.S. Supreme Court summarily rejected Husted's request for an emergency stay. Strike three!

Undaunted, in Feb. 2014 Gov. Kasich signed into law a new elections bill that failed to correct the previous disparate deadlines for in-person voting, allowing military voters to vote on the last days before the election, but nobody else. Husted then issued a directive that provided for early voting between 8:00 a.m. and 4 p.m. on Saturday, Nov. 1, 2014, but failed to provide for any voting hours on either Sunday, Nov. 2 or Monday, Nov. 3 --- despite the still-existing law allowing military members to cast their vote those days.

As it happens, African-American churches have traditionally used early voting on the Sunday before elections as "Souls to the Polls" day to help get out the vote. In turn, Republicans in Ohio have been working hard to end early voting on the Sunday before election day.

In his original 2012 ruling, Judge Economus held that all Ohio voters had a "constitutionally protected right to participate in the 2012 election --- and all elections --- on an equal basis." That is why he declared the effort to limit early voting to only active duty military members on the weekend before the election to be an unconstitutional violation of the Equal Protection Clause of the U.S. Constitution.

This year's latest gambit led to the issuance last week of a Permanent Injunction [PDF] on the Republican scheme, pursuant to which Judge Economus has ordered the recalcitrant Ohio Secretary of State [emphasis added] "to set uniform and suitable in-person early voting hours for all eligible voters for the three days preceding all future elections." Strike four?

Amusingly, rather than attempting to violate the court order this time around, SoS Husted is pretending that all of this is simply what he wanted all along, declaring in a statement (via the "Election Law Blog"), issued after losing again in court last week: "I am pleased that the federal court has affirmed what I have long advocated --- that all voters, no matter where they live, should have the same opportunity to vote. Thankfully, uniformity and equality won the day."

Also, up is down, black is white, and John Husted is a great champion of voting rights.
