The Secret Koch Brothers Tapes...

By Brad Friedman on 4/29/2006 10:00pm PT

WASHINGTON A blistering comedy "tribute" to President Bush by Comedy Central's faux talk show host Stephen Colbert at the White House Correspondent Dinner Saturday night left George and Laura Bush unsmiling at its close.

Earlier, the president had delivered his talk to the 2700 attendees, including many celebrities and top officials, with the help of a Bush impersonator.

Colbert, who spoke in the guise of his talk show character, who ostensibly supports the president strongly, urged the Bush to ignore his low approval ratings, saying they were based on reality, "and reality has a well-known liberal bias."
...
He attacked those in the press who claim that the shake-up at the White House was merely re-arranging the deck chairs on the Titanic. "This administration is soaring, not sinking," he said. "They are re-arranging the deck chairs--on the Hindenburg."
...
He also reflected on the good old days, when the media was still swallowing the WMD story.

Addressing the reporters, he said, "You should spend more time with your families, write that novel you've always wanted to write. You know, the one about the fearless reporter who stands up to the administration. You know-- fiction."
...
As he walked from the podium, the president and First Lady gave Colbert quick nods, unsmiling, and left immediately.

Crooks & Liars has the second half of the video (wherein Bush pats Colbert on the shoulder on the way out without saying a word.) We'll see if we can get the whole thing soon.

We Have a Suggestion for a Rock the Prosecutors May Wish to Look Under...
By Brad Friedman on 4/29/2006 7:21pm PT

Washington Post is reporting today...

Federal prosecutors signaled this week that they have decided to pursue a wide range of allegations about dealings between Rep. Robert W. Ney (R-Ohio) and lobbyist Jack Abramoff, rather than bringing a narrowly focused bribery case against the congressman.

As long as the investigation is widening into Ney's wrongdoing with Abramoff and friends, might we suggest the prosecutors look into this part of it.

Thanks!

Strikes Agreement With Prosecutor, Pleads 'Not Guilty' to Fraud
By Brad Friedman on 4/28/2006 4:08pm PT
"Drug use, some might say, is destroying this country. And we have laws against selling drugs, pushing drugs, using drugs, importing drugs. ... And so if people are violating the law by doing drugs, they ought to be accused and they ought to be convicted and they ought to be sent up."
-- Rush Limbaugh, Oct. 5, 1995

Rush Limbaugh today became the latest in a long line of arrested Republicans smiling for their mugshots, though he made a deal to avoid being "sent up" unlike the little people who can't afford the expensive attorneys that he can. From AP...

WEST PALM BEACH, Fla. --- Rush Limbaugh was arrested Friday on prescription drug charges, with his attorney saying he has reached a deal with prosecutors that will eventually see the charges dismissed if he continues treatment for drug addiction.

The subject of a three-year investigation by prosecutors, Limbaugh turned himself in to authorities on a warrant charging him with fraud to conceal information to obtain prescriptions, said Teri Barbera, a spokeswoman for the Palm Beach County Jail.

It's not about the sex drugs, it's about the lying.

Additional coverage:
-- RAW STORY...
-- CBS News...
-- Sun-Sentinel...

Prosecutors alleged that Limbaugh violated the state's "doctor shopping" law by getting four doctors to write overlapping prescriptions and failing to tell them about each other.
...
Prosecutors previously were investigating prescriptions that Limbaugh received from Florida and California doctors between March 2003 and September 2003, when he allegedly picked up 1,733 hydrocodone, 90 OxyContin, 50 Xanax and 40 time-release morphine pills.

In 2003, Wilma Cline, Limbaugh's former housekeeper and her handyman husband, David, gave the Palm Beach County State Attorney's Office copies of e-mails and taped phone messages documenting what they allege became Limbaugh's 30-pill-a-day drug habit.

It looks like old Rush is gonna have to think about much more than just Florida drug rehab programs at this point! Sounds like he needs to be, to use his words, "convicted" and "sent up". That might be rehab for us all!

EXCLUSIVE DETAILS: Complete lawsuit, Timeline from House Members...
Alleges Violation of U.S. Constitution Which Requires Both Chambers Must Pass Law Before Signing by President
By Brad Friedman on 4/27/2006 2:17pm PT

"Schoolhouse Rock has taught generations of Americans how a bill becomes a law," says Rep. " said Rep. Fortney "Pete" Stark (D-CA), the ranking Democrat on the U.S. House Ways and Means Health Subcommittee in a press release just issued by 11 U.S. Congressmen.

"As most school children can attest," Stark says, "a bill is just a bill on Capitol Hill until it passes both the House and Senate in identical form and is signed by the President ? or Congress overrides his veto. I'm sorry we've had to resort to this lawsuit, but I am committed to protecting our democracy."

11 ranking Members of the United States House of Representatives will be filing a law suit in U.S. District court on Friday, The BRAD BLOG has learned, seeking a permanent injunction of "Deficit Reduction Act" which George W. Bush signed into law on February 8th of this year, despite its not having passed both houses of Congress.

The BRAD BLOG has obtained an exclusive copy of the suit to be filed tomorrow by Congressman John Conyers (D-MI) and 10 other Democratic law makers, as well as a timeline of the events in the matter as compiled by the House members.

-- COMPLAINT IN FULL [WORD format].
-- Timeline of the events [WORD format].

"On February, 8 at 3:43 p.m.," the complaint alleges, Bush signed a bill that "never was passed by the United States House of Representatives."

The difference in the language of the House and Senate bills, is a clause requiring Medicare to cover rent for "certain durable medical equipment." The version of the bill pased by the House requires payments for 36 months. The Senate version requires payments for only 13 months.

The difference in the cost of the federal outlays for the two different versions is said to be approximately $2 billion.

The two houses of Congress were never able to pass a joint version of the bill, and yet, House Speaker Dennis Hastert (R-IL) and President Pro Tem of the United States Senate, Ted Stevens (R-AK), "signed a statement attesting that the bill signed by the President had been passed by both the United States House and the United States Senate."

"Once again the Administration is playing fast and loose with the Constitution," Conyers says in a Press Release (posted in full at the end of this article).

"Anyone who has passed the sixth grade knows that before a bill can become a law, both Houses of Congress must approve it. That the Bush Administration is now saying otherwise underscores the Constitutional crisis we are facing in this country."

Several other members were equally clear in the press release which excoriates the Bush Administration for yet another Constitutional transgression.

Says Rep. Bennie Thompson (D-MS), Ranking Member of the Homeland Security Committee in the release: "Time and time again the President has sought to discard the Constitution as if it were an old shoe."

Congressman Charles Rangel (D-NY), Ranking Member of the Ways and Means Committee is quoted as saying, "the Constitution is clear --- legislation signed by the President must be passed by both the House and the Senate. In allowing the President to sign a bill that was not passed by the House, Congressional Republicans made a mockery of the legislative process."

The "FACTS" section of the complaint explains the matter quite clearly...

Director of Elections Sends Letter Authorizing Measure in Light of Latest Failure by Electronic Voting Machine Vendor
Says Company's Performance in Most Recent - of Many Similar Incidences Around the Country - is 'Completely Unacceptable and Disturbing'
By Brad Friedman on 4/27/2006 11:46am PT

On Monday, Texas Director of Elections Ann McGeehan sent a letter to all state Election Officials authorizing them to create "emergency paper ballots" in light of statewide failures by Election System & Software, Inc. (ES&S) to provide ballots in time for the state's upcoming May 13 Runoff Elections, The BRAD BLOG has learned.

Early voting begins on Monday for those elections and counties across the state do not yet have ballots and, in many cases, programming for their optical-scan and touch-screen voting machines. ES&S has contracts with more than 140 Texas counties.

McGeehan has instructed officials to create and number their own paper ballots, secure boxes to store them in, and hire additional workers to manually hand count ballots as an emergency procedure to deal with the rapidly deteriorating situation.

The letter from McGeehan (posted in full exclusively at the end of this article) --- which does not mention ES&S by name, but refers to the Omaha, Nebraska-based company only as "a certified voting systems vendor" --- was sent in response to complaints from officials around the state that "programming media or, in some cases, your ballots" had not been received yet by officials.

In a statement to the San Antonio's Express-News this morning, Bexar County Judge Nelson Wolff says, "It sure is exasperating...We are looking at avenues to hold them responsible for this." Bexar County is just one of more than 140 in Texas with whom ES&S has contracts.

"They made their priorities," Wolff says, "and I think Texas certainly wasn't one of them."

The BRAD BLOG has also received statements from officials in other states who were still more direct in expressing their frustration with the company's business practices now being described by some as including "coercion" and "threats."

This most recent embarrassment for ES&S, the country's largest Electronic Voting Machine Vendor, is just the latest in what has now become an epidemic string of failures to meet contractual obligations in scores of states and counties across the country. The BRAD BLOG has reported on many of these troubling problems in a long series of articles in hopes of connecting the dots of those failures to illustrate and warn of the rapidly approaching E-Voting train wreck.

So far, both the mainstream corporate media, as well as many elections officials across the country have --- to the delight of ES&S --- failed to notice the remarkably clear pattern of delinquency and failure the company has demonstrated time and again across the nation in recent weeks and months.

Texas was plagued, during their recent March 7th Primary Election, by a host of failures in voting equipment made by both ES&S and Hart InterCivic, another voting machine vendor certified to do business in the state. Those failures on Election Day led to a statewide Election Contest filed by a former Republican Supreme Court Justice after tabulators failed and electronic ballots were misprogrammed and miscounted.

In Jefferson County, TX officials threatened to withhold payment after the debacle until their machines were fixed by ES&S. The company, however, answered by reportedly refusing to program the machines at all for the state's upcoming Runoff Elections unless payment was made in full. The county, in a bind, was forced to comply with the strong-arm tactics.

And now, with new elections just weeks away, officials all over the state are finding themselves --- like many other states across the country --- without the promised ballots from ES&S and scrambling for alternative solutions. Election Director McGeehan describes the situation as "completely unacceptable." Writing in her letter to Election Officials, she says:

We recognize that this kind of service from a certified voting systems vendors [sic] is completely unacceptable and disturbing. We will be pursuing all appropriate remedies from a state level that are available to us.

In the letter, McGeehan goes on to explain that officials should crate "emergency paper ballots" by either creating their own, or using "PDF format to print copies of the ballot" in cases were "proofs" had been previously supplied by ES&S.

Instructions are included for number and initializing thousands of ballots by hand:

After you print a copy of the ballot, you will need to put a ballot number at the top of the ballot beginning with the next ballot number of the last number of your original ballot order. In other words, if you ordered 15,000 ballots numbered 1-15,000, any ballots you create would be numbered beginning with the number 15,001. You will need to put your initials on the back of the ballot so you can determine it was an official ballot provided by you.

Further, officials are instructed that they may have to manually hand count ballots that would otherwise be counted by either optical-scan systems or recorded by touch-screen voting machines.

They are also told to create boxes for the ballot storage and find people to count them. McGeehan writes...

As Posted by Fox 'News'!
By Brad Friedman on 4/26/2006 7:21pm PT

Fox "News", of all sites, posts the full lyrics to Neil Young's "Let's Impeach the President" tune to be released this Friday online along with his Living With War album.

[See BRAD BLOG's (p)review of the album as posted last weekend.]

Says Roger Friedman at Fox about the album; "[It's] an incendiary, moving, totally American document of peaceful protest that is going to make a lot of people crazy one way or another."

He calls it "serious and searing" and an "extraordinary and eye opening new recording."

About "Let's Impeach the President," Friedman describes it as "a melodic, rocking, campfire ode" and "the catchiest protest song since Country Joe and the Fish's anti-Vietnam ditty, 'I Feel Like I'm Fixin' to Die.'"

Enough hype for ya? Okay, then...

Here, for the first time, the lyrics to Neil Young's "Let's Impeach the President":

Let's impeach the president for lying
And leading our country into war
Abusing all the power that we gave him
And shipping all our money out the door
He's the man who hired all the criminals
The White House shadows who hide behind closed doors
And bend the facts to fit with their new stories
Of why we have to send our men to war

Let's impeach the president for spying
On citizens inside their own homes
Breaking every law in the country
By tapping our computers and telephones
What if Al Qaeda blew up the levees
Would New Orleans have been safer that way
Sheltered by our government's protection
Or was someone just not home that day?

Let's impeach the president
For hijacking our religion and using it to get elected
Dividing our country into colors
And still leaving black people neglected
Thank god he's racking down on steroids
Since he sold his old baseball team
There's lot of people looking at big trouble
But of course the president is clean
Thank God

While waiting for Friday, be sure to check out Op-Critical's new protest songs (and video contest), which RAW STORY covered a day or two ago, along with Justice Through Music's collection of protest tunes to hold you over.

UPDATE 4/28/06: The complete album --- as well as the single "Let's Impeach the President --- is now released online for your listening pleasure...

(The BRAD BLOG Makes it Into Song!)
By Brad Friedman on 4/26/2006 12:34pm PT

BRAD BLOG reader and kick-ass blues man Shannon Williford (that's him at right) sends us a rockin' blues ditty titled simply "Election Reform".

While we're fairly certain it's the first blues tune to include the word "blogs" in the lyrics, we're damn near positive it's the first one to include the words "BradBlog.com" in it. And even "VotersUnite.org" (shout out to our pal John Gideon!) makes the cut for that matter. And others as well!

Shannon posted the lyrics, some observations on playing this song around Nashville and a few other thoughts on the current state of anti-establishment music in this comment on our Neil Young Living With War album review.

The tune certainly makes me smile. Hope it does the same for you. Turn up the speakers and...Give it a listen!

Hello 20's?
By Brad Friedman on 4/24/2006 3:34pm PT

We've truly enjoyed watching the contortions of Bush's GOP dead-enders who spin each and every new poll showing Bush at his lowest approval ratings yet, by trying to say that the numbers have "bottomed out", "can't get any lower" and therefore "have nowhere to go but up."

We (not so) respectfully disagree.

On the heels of last week's Fox News Poll showing Bush at 33% (which also revealed Republican voters as desperately out of touch with mainstream America,) followed by today's CNN/Opinion Research Corporation poll just out showing Bush at an all-new new low of 32% with Republican support dropping off precipitously, we see no reason why numbers in the 20's (and falling) shouldn't be far behind.

Do you?

We Believe the Sharp Columnist Knows the Answer...
By Brad Friedman on 4/24/2006 10:25am PT

Ralph De La Cruz writes today in his South Florida Sun-Sentinel column titled "Could a sharp eighth grader swing Florida election?":

Tallahassee· There's always a word or phrase.

Something that captures the mood of the moment. The ear, if not the imagination, of a legislative session.

Last year it was "living will." Or, depending on your take on the Terri Schiavo case, perhaps it was "judicial tyranny."

This year, it may be "transparency."

That word has been surfacing a lot in Tallahassee. Unfortunately, it's not coming from the Capitol.

It's become the favored word of Leon County Supervisor of Elections Ion Sancho, who's become a lightning rod for concerns about electronic voting machines.
...
Now, it's already bad enough to consider that our voting systems can be corrupted by a sharp eighth grader who might be able to access an elections office.

Think of what a savvy, committed adult could do.

As Mr. De La Cruz writes for a South Florida paper, and includes his email address and phone number at the bottom of his column, perhaps a few of you may wish to thank him for his coverage of Ion's story, and suggest to him that he cover Clint Curtis' story in a future column as well.

After all, in Curtis' affidavit, he says he was told that the vote-rigging prototype Rep. Tom Feeney (R-FL) asked him to create was meant "to control the vote in South Florida."

For those unfamiliar with Curtis' amazing story, a good primer is always available at this address: www.BradBlog.com/ClintCurtisSummary.htm.

While we're on the topic, please remember that Curtis is now running for Congress against Feeney and his massive DeLay/Abramoff/Top-Tier-GOP Money Machine and your support is needed if he is to stand a chance of beating Feeney in the very "conservative" district which Feeney carved out for himself when he was Florida House Speaker. See below for more details on how you can help him take on one of Congress' most corrupt Friends-of-the-Bushes...

(Okay, it was lunch, but the title didn't scan as well that way)
By Brad Friedman on 4/23/2006 5:23pm PT

Russ Feingold blew through town this weekend, and called on a few bloggers to meet him for lunch.

I'm happy to report that upon introducing myself, he informed me that he's well familiar with The BRAD BLOG. On the other hand, he's a very good politician, so I'd have said the same thing to me too ;-)

I'll mention up front, that of the current cadre of '08 Democratic Presidential contenders --- which, of course, he claims not to be thinking about --- he's just about the only one I'd seriously consider supporting at this time (though I'd certainly be open to the idea of Al Gore if he jumped back in, and Wes Clark hasn't yet done anything to piss me off yet, but barring any other fresh ideas, I'd likely be forced to go the third-party route as usual. But I digress...)

Feingold, in person, is as affable and charming and smart and impressive as he is on TV. Probably more so (especially after his BRAD BLOG compliments. I'm a cheap date!)

I had two major points that I was curious about and hoped to get a sense of from him during our meeting. 1) Why he chose not to tell any of his Dem colleagues about his Censure Resolution condemning Bush's warrantless domestic spying program before announcing it on This Week and then introducing it in the Senate the following day and 2) If he understood the extent of the havoc being wreaked on our country and democracy in the wake of the Help America Vote Act (HAVA).

I was able to get fairly informative answers to both questions...

By Brad Friedman on 4/22/2006 10:17pm PT

"These machines are a problem. This is not some Internet conspiracy; this is a serious problem that faces American democracy. These machines are not reliable and they shouldn't be used. We should not be using machines in this country where the results of the vote can't be verified after the fact. Period. Any machines."
-- DNC Chair, Gov. Howard Dean, 4/19/06

David Grossman (formerly of MediaMatters.org, currently of PoliticsTV.com) attended a breakfast with Howard Dean the other day. He asked Dean about his concern over Electronic Voting Machines. Dean's answer was interesting (transcript of complete answer is below.)

While I'm encouraged somewhat by Dean's response --- he seems to have a general grasp of the concerns --- it seems to me that he's still vastly "misunderestimating" the disastrous situation now afoot in the country in the wake of the Help America Vote Act (HAVA). He just doesn't yet seem to grasp the seriousness of the situation and the extent of the problems and dangers posed to our democracy.

To that end --- in case there are any of Howard Dean's peeps reading this --- I will make the same offer I've previously made to people close to John Kerry, Wes Clark and, personally today, to Russ Feingold (more on that later). Namely, I'll be happy to brief Dean and/or his staffers by phone, in person, or any other way they might like to full explain what we are now dealing with in this country, and how incredibly important it is that they pay attention and take action now. They may feel free to contact me here, if interested in taking me up on the offer.

Dean also speaks, in his full response, about his experience a year or so ago in 2004 hacking a Diebold GEMS central tabulator with "someone" on "live TV". That "someone" was Bev Harris of BlackBoxVoting.org and the live TV was a CNBC's Topic A with Tina Brown which Dean was Guest Hosting. The clip of him hacking the machines with Harris is right here. He added, in his response, that he didn't know for sure, but it "could have been a program that was elaborately programmed to fool me into thinking I was doing something I really wasn't doing."

No, Dr. Dean. It wasn't anything of the kind. We'll assume you were kidding. But what you did on live TV was exploit a vulnerability allowing a malicious user to hack the Diebold GEMS central tabulator, in about 30 seconds, to change the reported results of a Diebold election.

That is, of course, precisely what the United States Computer Emergency Readiness Team (US-CERT, a branch of the U.S. Dept. of Homeland Security) warned about in a "Cyber Security Bulletin", as published prior to the 2004 Election.

Of course, nobody reported the US-CERT "Cyber Security Bulletin", originally posted on August 31, 2004, anywhere in the media until The BRAD BLOG did so more than a year later on September 15, 2005. As far as we know, nobody in the Corporate Mainstream Media has bothered to report on the warning even since then.

Those Identified in Survey as Independent Voters Vastly Agree with Democrats, Not Republicans, as GOP Voters Continue Their Move to the Extreme Political Margins
By Brad Friedman on 4/21/2006 1:01pm PT

According to a BRAD BLOG analysis of the Fox "News"/Opinion Dynamics poll [PDF] released yesterday, which showed George W. Bush's latest approval rating at an all-time low of 33%, respondents in the poll who identified themselves as Republican are revealed by the survey time and again to be completely out of touch with mainstream American voters.

A review of the 13 questions asked in the survey where Republican majority responses differed completely from Democratic majority responses to the same question, finds that those identifying themselves as Independents agreed with the Democratic majority opinion nearly 100% of the time.

For example, on the question "Do you think it is appropriate for retired military generals to openly criticize Secretary of Defense Donald Rumsfeld during wartime or not?," 71% of Democratic respondents said YES and just 24% said NO.

On the other hand, Republicans had the opposite opinion - YES: 36% and NO: 62%.

Breaking the tie then, were those identified as Independents who agreed with the Democrats on the matter by answering YES: 64% and NO: 32%.

In virtually every single case where Republican majority opinion disagreed with Democratic majority opinion, the Independents agreed with the Democrats --- suggesting that Republican voters, even in (or especially in) a Fox "News" poll are completely out of touch and out of step with mainstream America.

The only minor exception was on the question: "Do you think Donald Rumsfeld should resign as secretary of defense?" Democrats said YES: 57% and NO: 22%. Republicans said YES: 18% and NO: 67%. The tie was broken by Independents barely breaking in Republican favor with responses YES: 41% and NO: 42%.

The poll, however, has a margin of error of plus/minus 3% points. So the response from Independents wasn't conclusive as to whether they agreed more with Dems or Reps on that one question only.

After five years of malicious propaganda by Republican opinion-leaders attempting to paint Democrats as "out of touch with mainstream America," it's interesting to find that the Republicans' own Fox "News" Poll reveals that it is the GOP --- not the Dems --- who now seem to be on the "kook fringe" of American political public opinion.
