[UPDATED a number of times at bottom of article, with more extraordinary photos and videos of devastating "hype" in NY, MA, NC and VT leading their governor to declare Sunday that the state has "a full-blown flooding catastrophe on our hands." ||| To date, at least 45 are now dead in 13 states in 3rd deadliest U.S. storm in more than 30 years.]

* * *

Setting aside that at this time following 2005's Hurricane Katrina --- the morning after --- most in the media were breathing a sigh of relief that New Orleans had "dodged a bullet", one wonders if the folks in Wilmington, Vermont today...

...or in the Catskills of New York...

...are inclined to agree with insightful media critic Howard Kurtz' assessment that Irene amounted to little more than "A Hurricane of Hype":

National news organizations morphed into local eyewitness-news operations, going wall to wall for days with dire warnings about what would turn out to be a Category 1 hurricane, the lowest possible ranking.

Um, surely Howard knows that category rankings for hurricanes refer to wind speed and velocity, not the amount of moisture in the storm or the possibilities of life-threatening floods that may accompany it, along with the storm surge to follow, right? Surely he has many reliable sources that have explained that to him by now, doesn't he?

Does anyone seriously believe the hurricane would have drawn the same level of coverage if it had been bearing down on, say, Ft. Lauderdale?

Dunno, Howard. Would a storm bearing down on Ft. Lauderdale have some 65 million people in its path, as Irene had? Please, Howard, have some apples with your oranges...

Prosser says hands on Bradley's neck just 'total reflex'...
By Brad Friedman on 8/26/2011 3:56pm PT

The Republican special prosecutor recently appointed to investigate allegations by WI Supreme Court Justice Ann Walsh Bradley that her fellow anger-management challenged Justice David Prosser had placed her in a "choke-hold" during recent deliberations over the anti-union legislation of Prosser's former colleague Gov. Scott Walker.

See Milwaukee's Journal-Sentinel coverage of this news yesterday for the complete, insane details.

In a terse announcement from the prosecutor, Sauk County District Attorney Patricia Barrett would say only that she had "determined that no criminal charges will be filed against either Justice Bradley or Justice Prosser for the incident on June 13, 2011."

The letter notes that Barrett reviewed transcribed reports from law enforcement officials given to her after Dane County Democratic District Attorney Ismael Ozanne recused himself from the case, as the matter over which the Supreme Dispute took place was a lawsuit he had brought charging that the anti-union bill in question was passed by Republican legislators in violation of the state's open meetings law. The newly-assigned prosecutor also reviewed an audiotape interview with Prosser who was, apparently, the only one who had a taped interview. In addition to Bradley, four of the other Justices were said to have been witness to the fracas.

According to the Journal-Sentinel, "Barrett declined to say whether she had rejected charges because no criminal conduct had occurred or because no crime could be proven to a jury. She would say only that a case must meet both those standards before a prosecutor could bring charges"...

In a written statement following word that there would be no criminal charges, Prosser said Bradley "made the decision to sensationalize an incident that occurred at the Supreme Court." He said he "was confident the truth would come out and it did. I am gratified that the prosecutor found these scurrilous charges were without merit."

That is not, of course, what the prosecutor actually stated that she found...

By Brad Friedman on 8/26/2011 11:50am PT

I'd returned to NYU from my parents' home in St. Louis a few weeks earlier than usual in the late Summer of 1985 to produce and direct a play I'd written, PUCK: A Power Play --- about two hockey players in the desert, naturally --- so we'd be able to open during the first week of classes.

We were forced to postpone opening weekend thanks to Hurricane Gloria, the last hurricane, prior to this weekend's Irene, to have drawn a bead on New York City.

"Play Canceled Due to Hurricane" seemed as unthinkably bizarre at the time, to someone like me from the Midwest, anyway, as "Play Canceled Due to Volcano" or "Play Canceled Due to Plague of Locusts."

It was in the pre-Katrina, pre-Ike, pre-Tuscaloosa, pre-Joplin, pre-100 year flood, fire, and drought days, however. So while the city took things relatively seriously, I suspect its nothing like what's going on there this weekend.

Gloria ended up taking a right turn at the last minute, and little more than the barest drizzle ended up hitting the empty streets of Manhattan that weekend, though I remember well the big white Xs taped across virtually every window in town --- NYC's version of "boarding" things up.

Here's hoping Irene changes her mind as Gloria did 26 years ago(!), in the Summer of 1985. And here's hoping our friends on the entire Eastern Seaboard stay safe, smart, and dry over the next few days.

You can always open the play next weekend instead. We did. And lived to tell the tale.

...But who's counting?

Plus there were show tunes! From Fiddler on the Roof! Cause it's kind of Jewishy.

No doubt, the cowardly Israeli people were buoyed today by Glenn Beck's "Restoring Courage" rally near the Temple Mount and Western Wall in Jerusalem.

Glenn who? Some guy who used to be on TV here in the U.S. At one point, it seems, he actually mattered to some people in this country. Those were the days, eh?

* * *

UPDATE: Though Beck's folks said the event was sold out, Ami Kaufman, who covered it for Israeli oulet +972 offers coverage and photos suggesting otherwise. Writes Kaufman: "It must have been pretty rough for Glenn Beck to see this"...

Kaufman adds: "After months of preparations, hours of television and radio talk all geared up for the big day, tons of merchandise manufactured, Glenn Beck could just about muster over a thousand people at his 'Restoring Courage' last night in Jerusalem. ... I can't help but think that this flop might be a lethal blow for this guy."

Sitting in for Lawrence O'Donnell on MSNBC's The Last Word, Chris Hayes' coverage tonight (video posted below) highlights another hilarious passage from Beck's rally in the Holy Land: "O, Israel, hear the words of my mouth!" :-) ...

What the hell is the matter with Mississippi and their elections all of a sudden?!

You'll recall that two weeks ago, e-voting system failures --- such as machines that wouldn't boot up at all and votes that were counted twice --- created chaos during Mississippi's state primaries, leading one official to declare days afterward, as they were all struggling to sort out results of several close elections: "At this point there is no election...Everyone is baffled."

Then, last week, we reported on the Jones County, MS election clerk who asked for, and received permission from, the county Board of Supervisors to remove the so-called "paper trail" printers from his county's 100% unverifiable Diebold touch-screen voting machines because, as he told the board reportedly (with a straight face), "the voting machines record every vote and there is no way for them to be tampered with."

(That Jones County Circuit Clerk, Bart Gavin, has still not replied to our request for comment hoping to determine whether he's just hopelessly clueless, or something worse.)

And now comes this, from Rankin County, MS in advance of today's Democratic gubernatorial run-off election...

See ThinkProgress for more detail on this, but I just wanted to flag this moment as I find it exceedingly creepy, and suspect this is more often than not the way these things happen. The quick handshake, wink, nod and walk away --- Bank of America, in the form of a top national executive, pledges the corporation's fealty to a Presidential candidate.

No need to discuss what the quid pro quo will be. No need for Perry to even acknowledge it out loud. It's just a 5 second investment by BofA almost certain to pay off should Perry be victorious. Really creepy...

But, ya know, what's the big deal? As Gov. Rick Perry's current main competitor for the GOP Presidential nomination, Gov. Mitt Romney explained recently, "Corporations are people, my friend."

Wisconsin's old State Elections Board website (http://elections.state.wi.us/) appears to have been "hacked by Sovalye"...

[Hat-tip Election Integrity advocates Jeannie Dean, Neal Schulz and the folks at the Facebook Election Integrity group.]

[Update 7:19p CT: It looks as if officials have now restored the site. Sort of. Hat-tip again to Neal Schulz.]

The State Elections Board was replaced by the WI Government Accountability Board (G.A.B.) in 2008 as the state's top election authority, combining responsibilities of both the Elections Board and the State Ethics Board into the agency. The G.A.B.'s website (http://gab.wi.gov/) does not appear to be hacked. For now.

Of course, that's just a website, not an actual election or e-voting database. So just because the state's Elections Board website proved to be insecure and was hacked does not mean their actual elections are vulnerable to hacking in any way, shape or form, right? That, even though the state, shamefully, does not bother to check even a single ballot to make sure it has been tallied accurately during an election by its computer op-scanners made by Diebold, Sequoia, and ES&S.

Why worry?

The BRAD BLOG has been warning about the manipulation of e-voting systems for years, along with members of the world's computer science and cyber security communities, and even the CIA, as our own Ernie Canning noted just last week. And yet, our nation continues to use the same vulnerable e-voting systems to tally our elections, rather than bothering to count them with our own, far more reliable and verifiable, hands and eyes, as per Democracy's Gold Standard.

I could link back to all sorts of e-voting hacks we've reported on over the years here, like this one from Princeton in 2006 or this one from the U. of MI in 2010 or this bone-chilling warning from the CIA in 2009, but they'll mostly likely just be ignored. Again.

Instead, we'll just tease you for now with news of yet another new e-voting hack --- perhaps the most disturbing one yet in a number of ways --- that we'll be reporting on very soon. Let's call that one a special delivery for election officials like Jones County, MS, Circuit Clerk Bart Gavin, who reportedly told his county Board of Supervisors this past week that the Diebold touch-screen voting machines used by the entire county "record every vote and there is no way for them to be tampered with."

Really, Bart? You're gonna stick with that, are ya?

The Jones County, Mississippi, slogan is "A Great Place to Live." While this may or may not be true, and I've never been there, it's clearly not a great place to vote. At least if voting in a way that is verifiably accurate for the citizenry is something one might care about. A remarkable statement by the county's Circuit Clerk, and a unanimous decision in support of it by the County's Board of Supervisors this week, has made that as clear as can be.

You may recall that just last week, e-voting system failures --- such as e-voting machines that wouldn't start up at all and votes that were counted twice --- led to chaos and uncertain results in Mississippi's state primaries, leading one official to declare days afterward, as they were all struggling to sort out results of several close elections: "At this point there is no election...Everyone is baffled."

Against that backdrop then, behold what Jones County, MS, Circuit Clerk Bart Gavin is now calling for --- and receiving unanimous approval from the Jones County Board of Supervisors for(!) --- as irresponsibly reported without even a hint of fact-checking by Laurel Leader-Call reporter Charlotte Graham under the laughably misleading headline, "Improving the voting process" [emphasis added]...

The OC Weekly's Matt Coker picked up on my Monday report describing my experience over the weekend at the Orange County Registrar's booth at the Orange County Fair wherein my attempt to try out their 100% unverifiable Hart Intercivic electronic voting system, um, didn't work out too well.

Coker's amusing take on the apparent system failure that occurred while I was testing it out with assistance from employees of the OC Registrar's office is described as "akin to making an illegal U-turn in front of a motorcycle cop. ... or letting it slip to 'Woodstein' that Tricky Dick audio taped everything in the Oval Office."

His coverage is much briefer than mine. So if you've yet to read my account of what happened and want a more-to-the-point version, please see Coker's piece.

For the record, for those who've asked, no, I've yet to hear back from either OC Registrar of Voters Neal Kelley or from anyone at CA Sec. of State Debra Bowen's office about what happened on Sunday. I've contacted all them via email, with a link to my original article, seeking comment. If I hear back from any of them substantively, of course, I'll let you know.

(While his state continues to face record losses from record heat and drought as long ago predicted by the scientists whom Perry knows more than.)
By Brad Friedman on 8/17/2011 1:03pm PT

Via AP...

"I think we're seeing almost weekly, or even daily, scientists that are coming forward and questioning the original idea that manmade global warming is what is causing the climate to change," the Texas governor said on the first stop of a two-day trip to the first-in-the-nation primary state [New Hampshire].

You "think" wrong, Governor.

He said some want billions or trillions of taxpayer dollars spent to address the issue, but he added: "I don't think from my perspective that I want to be engaged in spending that much money on still a scientific theory that has not been proven and from my perspective is more and more being put into question."

At the same time, officials currently estimate that the record heat and record drought that Texas is now facing --- just as the scientists Perry "thinks" he knows better than had long ago predicted --- will cost the state more than $20 billion in record losses to crops, livestock and more. That price tag could rise, as today's remarkable predictions from the National Weather Service report there is "no end in sight" for the crisis in Texas at this time.

Money spent to help avert the worsening crisis that Texas is already facing is a bad idea, according to what Perry "thinks". Even if what he "thinks" runs counter to, as the AP story accurately notes, the actually-informed opinions of "an overwhelming majority of scientists that pollution released from the burning of fossil fuels is heating up the planet."

On the other hand, money spent by Perry in support of the 100% evidence-free "theory" that there is a giant invisible bearded floating man in the sky who should be worshipped by his constituents on complete "faith", is apparently no problem.

It's remarkable how many GOP officials and sycophants seem to know more about climate science --- and the extraordinary body of data meticulously gathered by thousands of climate scientists, in dozens of disciplines, over many decades --- than actual climate scientists do.

For those who may be dumb enough to agree with the remarkably dumb Perry, just one question: If you get cancer, will you be going to see an Oncologist for diagnosis and treatment? Or will you go find out what the Governor of Texas or Rush Limbaugh or the U.S. Chamber of Commerice or the Koch Brothers "think" about your cancer instead?

State Senate Dems reportedly win both contests today, 5 overall, compared to 4 wins by GOP...
By Brad Friedman on 8/16/2011 9:12pm PT

The final round of state Senate recalls in Wisconsin, brought on in response to anti-union legislation by Gov. Scott Walker and state Republicans, have completed today. AP is reporting tonight that the two Democrats up for recall in the state's 12th and 22nd have each retained their seats. TPM has the numbers by district here.

By way of reminder, in Wisconsin most votes are cast by hand-marked paper ballot though tallied secretly by optical-scanners made by Diebold, Sequoia and ES&S. The state does not examine any optically-scanned ballots to assure the machines have tallied accurately after they've already been scanned, other than in the even of a recount if permission is granted by the courts to hand-count ballots. I'm told, but haven't been able to confirm today, that some of the municipalities in the two districts where elections were held today, may have been hand-counting ballots, though centrally, after they've been transported, rather than at the precincts. Given there was only one single race on the ballot today and hand-counting would consist largely of making two separate piles, it seems as if it would have been cheaper and easier (and certainly more reliable and transparent) to hand-count all of the ballots in these recounts. But, sadly, that's not the case. So we're forced to rely, in most cases, on the oft-failed, easily-manipulated computer-reported results from the Badger State. Mack Trucks, if you will, used to deliver pizzas.

Once again, election watchdog Election Defense Alliance (EDA) and a number of other organizations were carrying out Exit Polls at the several sites today, as one of the few weapons left to help avoid and/or ferret out potential election fraud or vote tabulation error. I spoke with EDA's National Coordinator Sally Castleman earlier this evening, and --- unlike during the July primaries and during last week's GOP recalls, no problems have been reported by the Exit Poll teams at the wards.

By way of another reminder, problems with vote tabulation often do not come to light until days, or even longer, after elections. So far, however, there have been pleasantly few reports of problems that I've heard about or been able to find today. There was this odd incident at a Kenosha ward and at another ward there where they reportedly ran out of ballots for a short time (is that report accurate, where it says the County "printed up 300 additional ballots" in a pinch? They can print up ballots just like that??) as turnout was reportedly heavy in most areas today, said to have been on par with a gubernatorial election. That's some good news to report at this hour. If anything changes, of course, we'll let you know.

If the largely unverified results stand as currently reported, there will have been 5 wins total for Democrats --- 2 tonight, 2 last Tuesday, and 1 in July --- in these state Senate recalls. Republicans will have won just 4 of the races, all last week, and will have lost 2 seats, while the Democrats lost none.

Despite their victories, however, the Dems will have fallen one short of re-taking the majority in the state Senate, where the GOP will still enjoy a slim 17-16 advantage. One moderate Republican, however, state Senator Dale Schultz, who voted against the GOP anti-union agenda, may well serve as a firewall against continued radical Republicanism in the state. Nonetheless, after last week's recalls of 6 Republicans, where Democrats picked up 2 seats from the Republicans, the GOP sent out statements declaring "victory" in Wisconsin.

Until Walker's own recall election, which could happen early next year if Democrats are able to gather enough signatures beginning in November, we may be done with the wild string of elections in Wisconsin...at least for now.

I'm not sure what's more obnoxious, the way the Republican Party itself ignores and belittles their own 2012 Presidential candidate Rep. Ron Paul --- who reportedly finished a very close second to Rep. Michele Bachmann, who is receiving tons of attention, in the hopelessly gamed Iowa Straw Poll over the weekend --- or the way the mainstream corporate media ignores and belittles him.

I suppose if Paul wasn't belittled by these jerks he'd get no media attention whatsoever.

No matter your personal or political feelings about Paul, the way he is treated by the establishment elite, the way they, not voters determine who will or won't be a "viable" candidate, is appalling in my opinion.

Jon Stewart, appropriately, let 'em all have it for that last night, asking incredulously: "How did libertarian Ron Paul become the 13th floor in a hotel?!"...
