And what the "probable cause" addresses is whether or not there is any reason to believe the person on the other end of a line is really al queda.
Remember they held many, many folks on the "enemy combatant" jacket and then just dropped it.
Padilla is an example. They had no damn probable cause at all ... and completely changed the "facts".
A court will make them show a reasonable expectation that a terrorist is calling a professor, a travel agent, a person with relatives in Pakistan, Iraq, Iran, or whereever, before they allow a warrant for a "search" (spying, eavesdropping).
Think about how the fools are being fooled, and think about how the courts look at it.
And then you know why the neoCon fascist regime bypassed the courts.

I saw Wayne Madsen on C-SPAN totally demolishing this guy....
This idiot, Hayden claimed that the NSA "spying would have prevented 9-11" yet he later confirms in the same paragraph that Mohammed Atta & all the terrorists were identified beforehand....including the fact that they bought strippers, which Madsen was tough on him to point out......and they didn't do a damn thing about it!!!!
But of course, Hayden then says "I don't know what you're talking about!!" and turns his tail and runs... just like another desperate neocon from the wrong side of the track....

Hayden got demolished by nearly every reporter that asked him a question. A few of them he just flat out ignored and moved on to the next question. If he's the best they got, I can't wait to hear what the rest of them have to say.

Jeff
The reason they're in power at all is because our system of congress is currently useless, every one of them including pelosi is in bed with special interests somewhere.
They're all so fucking useless, that they didn't even notice the illegal spying!!!!
I just talked to my own congressman, and he thought I meant that they should be impeached over the war and disagreed.
WTF? This is my congressman Cannon, he's not perfect but I thought *at LEAST* he would be aware of all the news!!!!!!

My wife had to hold me back from kicking in the TV the other night when this son of a bitch stood up there and said: "If we had this before 9/11 we could have prevented it!"
WTF?????????? They had this program in operation for 7 months prior to 9/11 and totaly ignored the daily breifing in august of that same year which told everything that would happen.
Of course there is lots of info and analysis out there that seems to show they actualy planned it all in the first place!
IMPEACH the whole F***ing lot!!!!!

They actually CAN bleat out disinformation about the Constitution and get away with it. Sickening. In a sense, "Nobody knows the 4th Amendment better than we do" is true. How many people will call him on his lie? Out of those, how many will be heard?

I remember 9/11 and I remember being crushed that this was happening. I cannot remember a day in recent history that I was as depressed as I was that day. If this is the doings of the neocons there will be hell to pay, mark my words.

I remember it too - Had a heavy duty construction meeting involving a very large job I was working on. People had come from around the country to attend. Very little got done and we adjourned it for a week since no-one was on track to get anything done.
I turned on the morning news and within about 5 minutes they cut to NY with the first tower already burning. Lots of confusion as to what was going on. Reporters were saying it was a small private plane that had hit.
Then the Second plane hit - oh my god, how can this be happening?
Much more confusion, reporters were asking what could be wrong with the air traffic control system.
I was 1/2 hour late to work watching things unfold.
Was totaly shocked whn I heard later that the towers had fallen. That seemed impossible!
I remembered back in the 50's or 60's when the airliner crashed into the empire state building and the building held up fine despite the damage.
This is where I put on my tin foil hat!

Brad - You call your credibility into question when you get Hayden's prior and current positions wrong, and that undermines your impact.
He was DIRNSA - count the stars, NEVER a deputy - that's always a civilian. He's now deputy intelligence czar, maybe as reward (or blackmail??) for trashing the Constitution, 4th amendment and FISA. You don't help make things right when you get them wrong.

Until Brad states otherwise I'll give him the benefit of the doubt. Perhaps his headline came from the logo in the TV screen shot which states "Deputy Director..."
Or it could be that he is extremely tired with all he's been doing lately.

Friends...Bush himself said on more than one occasion, before his cover was blown by The New York Times, that "(spying) requires a warrant." He didn't agree with someone else who said that, he said it himself. He volunteered the opinion.
He said this while the NSA was in fact spying WITHOUT SEEKING WARRANTS. In other words, he lied through his teeth. From an impeachment standpoint, this shows not only that he broke the law, but that he knew he was breaking the law when he did it, otherwise he'd have given himself wiggle room in his earlier statements.

Jeez, save benefits of the doubt for areas of doubt. Go look for yourself, don't take my sayso, Brad's or anyone elses. You could have had knowledge in the time it took you to invent doubts. Try www.nsa.gov or if that's disconcerting, google deputy director hayden or dirnsa hayden.
Fatigue's a bitch, but it doesn't excuse Brad, Duhbya, you or me. Uh pardon me, I was fatigued I misunderstood the Constitution and the law, and now we're making Orwell look like a piker. NOT.

Cliff - Thanks for the correction. It has been made to both the headline and in the article.
NOTE: The error was mine, not Guest Blogger David Edwards. I had tweaked his original item, and made the mis-identification of Hayden's official title. It's now corrected.

Brad - Thumbs up, thanks for the response.
In Hayden's press club meeting he was pointing up at Duhbya and Gonzales for his authorization. In Duhbya's comments the other day he seemed to be pointing down at Hayden. Duhbya was explaining his management style by saying he asked for what could be Constitutionally done, and then accepted the recommendation. Think that might make the potential fall guy, uh General, start to feel a little nervous?

Let me get this straight: The president says the president is above the law during a vague war, the "War on Terror" (is that a REAL war???), but he is the one who started the "war", based on lies, so HE could be above the law!!! Isn't that it in a nutshell? Which idiots are falling for this?
Now, he's on a PR media campaign, telling us right to our faces, that he's above the law! If he gets away with this precedent, then he can break any subsequent laws he wishes!!! This NSA thing is a test, and if he's allowed to do this, then it follows that he can do anything.
AND HE'S ON TV TELLING US RIGHT TO OUR DUMB FACES!!!!!!!! HE'S NOT EVEN TRYING TO KEEP IT A SECRET!!!!!!!!!!!!
He's on TV saying, "I'm above the law, and what are you gonna do about it???"

Will you provide a link to show "pelosi is in bed with special interests somewhere"? Otherwise it is just another useless attack on the minority party which has no power to stop the madness and impeach.
Again, a clue, the majority party is the one that has the responsibility to oversee and impeach. To dump that on the minority party is like beating the homeless for not having a home. It is unjust.
Accountability is the application of justice. To be used properly it holds accountable those who use, misuse, or fail to use their power. That would be the republicans.

The -real- problem is we only have '2 parties' to chose from.. And over time, 90% of them are all the same rich folks from "good breeding" who just want the perks of being in Government (the power, the lauding by people kissing your ass to try and manipulate you, the knowing people are trying to manipulate you and the false sense of importance that brings, etc etc etc).
When Dems are against equal rights (the whole homosexual marriage issue, and others).. when Dems sign on to bills that fuck the masses in favor of corperat profits (Bankruptcy bill).. when Dems fail to do the "right thing" and shine a bright light on corruption (they need to be suggesting Impeachment EVERY DAY, filing the motions, etc).. then Dems become just as bad as Repugs.. When Dems sit back and care more about 'being re-elected' than upholding their promises in the first place, Dems are no longer the "party in the right"..
While Dredd may be correct in that the "minority party is powerless", that's beside the point.. The POINT is, they are the "minority party" because there aren't any "honest politicians" out there that WILL do what they say they will, who DO fight for their constituents and not special interests (let's be clear.. corperate interests.. not "special".. grouping them together is to try and simplify the argument, and broaden the net used to drag people into a bad light)..
Hell, I remeber being told in SCHOOL that we have a "two party system".. yet, I've not seen anything in our Constitution that says that. It's a myth that has been perpitrated on us by "the powers that be" so they can keep us locked up in their obfuscated mess.
Perhaps it's time to "do away with parties" in our system.. Let individuals all appeal to the masses on "some set of issues", perhaps release a full docket of what they plan on doing while in office.. i.e. "lower taxes" or "reduce poverty by redistributing wealth" or "increasing oversight on corperate profits" or "pushing legislation that ENCOURAGES job retention instead of out-sourcing".. etc etc. We need to get rid of these Republicans and Republicrats and get some people in office who are there to be a "government of the people, by the people, FOR the people"..
Which means, all this crap we have now has to be UNDONE.. We have to start from scratch, tear down the institutions and fill them up with NEW PEOPLE. Perhaps it's time to put term limits on Congress as well.. say 3 4-yr terms? Let people get in, push for changes they think will help, then get out? No more being the unchallenged encumbant for 30 years? Perhaps make it so no one that is sitting on a Board for some company can be in office? -ANY- public office? Take your pick.. either make lots of money on the Board, or serve your country.. but you don't get to make policy that will make you richer..
We're here because of HOW we run politics.. We're here because of our LACK of intervention, our lack of concern.. and that lack of concern is driven by "30 second sound bites" offered by corperations trying to get you to consume.. That mentality isn't conducive to "gathering facts" or "taking time to care".. in fact, it's exactly COUNTER to "thinking".. that's why companies use it.
Our lack of oversight has caused us to let corperations drive the mentality of this country into the toilet.. If we hope to fix our country, save our freedoms and Constitution, we need to punch corperations in the face, put them back in their boxes, and make sure they fully understand that they are NOT "people", they don't have the rights of "people", and "people" refuse to let them take advantage of them any longer. Greedy corrupt people are drawn to corperations because it let's them be psychotic vicariously. They have a "justification" for shitting on people, their profits. We need to shut that down if we hope to survive as a species, and as a free people.
It's the same psychotic mentality that has spoiled-never-had-to-suffer-consequences-rich-boy Shrubby out there feeling he's "above the law".. NONE of those kinds of people should be "making the rules", they never feel those rules apply to them, just to those they "manage". I believe the term is narcissism?

Whoever said we could only have two parties? If there's one thing that the last five years have made clear, it's that two parties in this country aren't enough to ensure good government.
If I agree with the trolls on anything, it's that Democrats are their own worst enemies. But the current administration is worse. Somewhere along the line, though, somebody decided there was no third or fourth choice. So...are we stuck?
Other countries don't believe that. They manage to conduct fair elections, avoid starting wars, maintain the respect of their neighbors, keep their budgets under control, and practice civility in their political discourse, with three, four, or even five parties. Would someone please tell me who it was that decided we must settle for two lousy ones?

The Stockholm Syndrome is when a captive audience, such as hostages, come out in favor of their captors (link here).
Blaming democrats for the crimes of the republican controlled administration and congress that has taken American government hostage is a symptom of the said syndrome.
Chris Mathews of MSNBC Hardball has this psychological disease.
If we have more than two parties, which I welcome, the principle holds. If we blame the minority for the wrongs of the majority we have a symptom.
