As Washington State's Democratic Senator Maria Cantwell suggested last week, the phony GOP uproar over Rep. Deb Haaland (D-NM)'s nomination by Joe Biden to become the first Native American Secretary of the U.S. Interior Department is a 'proxy fight' over something else entirely. It might be over the dim future for fossil fuels. It might be over the fact that Haaland would be the first indigenous cabinet member for any Presidential Administration in U.S. history. Or it might be the fact that the GOP, without any real governing philosophy or values, is simply flailing to find relevance. We discuss all of the above with our guest on today's BradCast.  [Audio link to full show is posted below summary.]

But first up today, some late breaking news following on our conversation on yesterday's show with Dr. Karl Krupp of the University of Arizona's Zuckerman College of Public Health. He argued that, while COVID numbers have (thankfully) fallen precipitously in recent weeks from our horrifically deadly surge in the Fall, we may now be on the verge of "screwing it up all over again." Both he and top federal officials at the CDC see the previously-declining numbers beginning to plateau and/or tick back up in recent days, as states and cities are, once again, prematurely lifting restrictions.

Late news today both supports his worry on one hand, and somewhat mitigates it, a little bit anyway, on the other.  This afternoon President Biden announced that he has helped to broker a deal between Johnson & Johnson and Merck, the two pharmaceutical giants, to speed manufacture of J&J's newly-approved one-dose vaccine. Aided by his implementation of the Defense Production Act, he declared on Tuesday, the two companies, along with Pfizer and Moderna, will create enough vaccine for every American adult by the end of May. That is two months earlier than the Administration previously projected.

While that is certainly encouraging news, it is somewhat blunted by the idiot Governor of Texas, Greg Abbott's announcement today that, in direct contravention of warnings from scientists and federal health officials, the Lone Star State is immediately ending its statewide ask mandate and allowing all businesses to reopen to 100% capacity again. That, even as TX is still seeing about 7,600 new cases each day and averaged 227 COVID-19 deaths a day over the past week.

As Dr. Krupp warned on this program yesterday, we could see new record highs in the near future if we begin "screwing it up all over again". Both he and I, hoped his fears would be wrong. We'll find out soon enough.

In the meantime, Republicans continue to slow-walk top appointments to the Biden Administration, including his new head of Health and Human Services, despite the historic (and once again worsening) pandemic we are still battling.  Clearly, Republicans don't care. But what they do care about is fossil fuel production by the companies which fund their campaigns. To that end, last week's confirmation hearings for Rep. Haaland in the U.S. Senate's Energy and Natural Resource Committee were both revealing and maddening, especially for those in the Native American community.

Members of Indian Country have been watching her grilling in dismay and occasional fury as the first Native American nominated to head up any Cabinet level federal agency was falsely derided during her confirmation hearings last week as a "radical," largely by white, male GOP Senators who are, themselves, radically out of touch with even their own constituents' desire for more renewable energy and less fossil fuel development. Louisiana's Sen. John Kennedy went so far as to deride Haaland as a "neo-socialist, left-of-Lenin whack job" (before attacking Biden's now-abandoned nominee to head the Office of Management and Budget, Neera Tanden, for posting mean tweets some years ago.)

But are the almost-certainly futile attacks on the New Mexico Congresswoman about more than her not-radical-in-the-slightest position on fossil fuels? We're joined today by journalist, activist, and artist JULIAN BRAVE NOISECATVice President of Policy & Strategy at Data for Progress, as well as a member of the Canim Lake Band Tsq'escen and descendant of the Lil'Wat Nation of Mount Currie. We discuss what lies behind the pathetic pushback against Haaland's nomination and why it is such a monumental moment for so many Native Americans around the nation.

NoiseCat has recently written about the pointless and embarrassing attacks on Haaland in her confirmation hearings at both The Nation and Washington Post, where he charged that  "Republicans’ depiction of the first Native American ever nominated to the Cabinet as a 'radical' threat to a Western 'way of life' revealed something about the conservative id: a deep-seated fear that when the dispossessed finally attain a small measure of power, we will turn around and do to them what their governments and ancestors did to us."

We discuss all of that and more today with NoiseCat, who explains the horrendous historic role that Interior has held in the genocidal treatment of American Indians, and the important mission that it now carries out for all Americans, but especially those in the West. (It is also home to the Bureau of Indian Affairs.) "Never before in the history of Interior have we had a Native person on the other side of the desk," he tells me. "And I think Native tribes are very hopeful we can make some further headway in correcting the nation-to-nation relationship between the United States and its first peoples."

He also explains, by the way, why "Republicans might actually be burning their own wagon" in attacking Haaland.

Finally, Desi Doyen joins us for our latest Green News Report, as hundreds of thousands in Abbott's "free" Texas are still fighting to obtain water, two weeks after a winter storm knocked out power and water in the Lone Star State; the battle for water for thousands in Jackson, Mississippi after the same storm; and the natural gas industry's desperate attempt to keep their aging empire from collapse...

Plummeting COVID rates and FDA approval of a brand new, one-shot vaccine seem like very good news! And it is...if it weren't for our propensity to screw it all up again, as our guest on today's BradCast explains. [Audio link to today's full show is posted below this summary.]

But first, in other good/bad news reports today, the former conservative President was found guilty of corruption and sentenced to a year in prison on Monday! The bad news is that it wasn't our former "conservative" President, but French President Nicolas Sarkozy. Still, it does suggest that modern, civilized democracies can hold even the most powerful to account. We'll see if the U.S. justice system learns anything from that example.

In the meantime, we clearly have yet to learn the lesson about the need to modernize our critical infrastructure --- or of the dangers of deregulating, privatizing, and profiteering from essential services such as power and water. The shameful, widespread outages in Texas from a winter storm two weeks ago offered a fresh reminder about that, even as hundreds of thousands in Houston remain under boil water orders today.  But, much less noticed and reported on than the mess in Texas is the fact that tens of thousands are still without clean water --- or even any water at all --- in much of Jackson, Mississippi, where decades of failure to invest in the city's antiquated water system has now left much of it without water at all for the past two weeks. As it turns out, however, the areas of Jackson without water just happen to be the predominately black areas of the state's 80% African-American capital city.

Long overdue improvements to critical infrastructure could finally begin in some states and cities with the passage of President Biden's wildly popular American Rescue Plan. The U.S. House passed the $1.9 trillion package --- which includes $1,400 individual checks and hundreds of billions in relief to families, businesses, schools, unemployed workers, as well as cash-strapped cities and states --- late last Friday night. The House version also a includes the very popular $15/hour minimum wage mandate, even though the Senate Parliamentarian declared last week that the provision could not be included for passage under Senate Budget Reconciliation rules. Those rules would allow the package to be adopted by a simple majority vote in the Senate this week, rather than the 60 votes currently needed for passage under the Senate's archaic, undemocratic, Jim Crow-era filibuster rules.

Despite the popularity of the package (76% approval over all, including 60% of Republican voters), there were zero votes for passage by GOPers in the gerrymandered House. Republicans in the Senate are believed likely to similarly ignore the preferences of a majority of their own voters. That, even though the measure enjoys bi-partisan approval by voters and the package also includes tens of billions of dollars to speed distribution of COVID vaccines.

Speaking of which, a third vaccine received FDA approval over the weekend, and millions of doses are now said to be on on their way to distribution points.  The first single-dose vaccine to be granted FDA emergency use authorization for COVID-19 is Johnson & Johnson's. It is said to be highly effective and requires only regular refrigeration for storage, as opposed to sub-freezers. So, in theory, it is much easier to get out and into people's arms quickly. But is it as effective as Pfizer and Moderna's vaccine? And does it matter one way or another? We discuss that with our guest today as well.

As COVID infection, hospitalization and death rates have been plummeting in recent weeks, epidemiologists have become worried. There are signs that the precipitous drop after the horrendously deadly autumn surge last year has begun to plateau at similarly high rates to those we saw just before that surge. But now, there are much more transmissible variants emerging. At the same time, states and cities are beginning to lift restrictions again --- just as they did before last year's surge that quickly propelled deaths to more than 500,000 in the U.S.

We're joined today for some very helpful insight on both the vaccines and concerns about the current rate of spread, by DR. KARL KRUPP of University of Arizona's Zuckerman College of Public Health. In short, Krupp warns, "we're screwing it up all over again."

"To be quite blunt about it" Krupp tells me, citing those who ignored warnings from public health authorities about reopening schools and businesses before Thanksgiving last year, "It's funny how short of a memory we have. We're just approaching where we were in the middle of October.  We're just coming back from where we went the first time we did everything wrong. And the question is, are we going to do everything wrong this time?"

His answer is not necessarily encouraging, as he predicts that we could very well see not only a fourth surge, but one that is even higher than what devastated the nation late last year.

As to the vaccines, we talk about the fact that Johnson & Johnson's, while only requiring a single dose, is said to be only 66% effective against the virus, as compared to the 94 and 95% rates of the Pfizer and Moderna vaccines. Though the newest vaccine to obtain FDA approval also is said to be 85% effective against severe cases and, to date, 100% effective in preventing hospitalization and death.

But, if given a choice, wouldn't it be smarter to take the Pfizer or Moderna versions? Krupp is sympathetic to those concerns, but argues that Americans should take any vaccine they can get as quickly as possible right now. He explains why. He also answers a bunch of questions about whether those who have been vaccinated can still become infected or infect others and discusses concerns that minority communities are currently being vaccinated at far lower rates.

He also offers his predictions as to when life might actually return to normal, and when it will return to mostly normal --- or at least something that feels much more like the Before Times. Please tune in for today's very insightful --- and hopefully helpful! --- conversation...

On today's BradCast: Impeachment may be broken, but accountability is still coming. [Audio link to full show is posted at end of summary.]

But, first up: Record low temperatures continued to batter dozens of states and knock out power to millions of customers in several of them. But it is residents of the great state of Texas who are paying the highest price for their government's utter failure to keep the lights...and the heat...and the water on...throughout this foreseeable and deadly cold snap. No, it's not the renewable energy sources like wind power that has failed --- as Fox "News" is frantically misinforming their viewers today --- it's the fossil fuel industry and the state's disastrously unregulated and privatized power infrastructure that has helped create the mess in Texas. Our own Desi Doyen explains.

Then, in a refreshing bit of encouraging news today, Congressman Bennie Thompson (D-MS) has filed a civil federal lawsuit against Donald Trump in response to the deadly attempted insurrection at the U.S. Capitol on January 6th, incited by the disgraced former President. The suit, filed on Thompson's behalf by the NAACP on Tuesday, also names Rudy Giuliani and the rightwing extremist groups Proud Boys and Oath Keepers as defendants. It seeks both punitive and compensatory damages for the assault on Thompson's place of work that left the 72-year old Chair of the House Homeland Security Committee hiding on the floor of the U.S. House for hours and in dangerously close contact with colleagues, two of whom tested positive for COVID in the days that followed. The complaint is believed likely just the first of a potential wave of similar litigation in response to the unprecedented attack on the Capitol which killed at least five people, and which a bipartisan 57-43 majority of U.S. Senators over the weekend at his Impeachment Trial found Trump guilty of having incited.

But guilty or not, the Impeachment process, for a second time in the Trump Presidency, ultimately fell short of the high Constitutional bar of a two-thirds vote needed for conviction, begging the question as to whether the founders misjudged what might be needed by Congress to hold a scofflaw President to account.

We're joined today once again by Constitutional legal scholar JOHN BONIFAZ, Co-Founder and President of the non-partisan governmental accountability group Free Speech for People, and co-author of the 2018 book The Constitution Demands It: The Case for the Impeachment of Donald Trump.

Our wide-ranging conversation on various paths towards accountability for the 45th President includes discussion of Rep. Thompson's lawsuit; Section 3 of the 14th Amendment and how it might be invoked to prevent Trump from running for future office; and as well as criminal statutes which could be invoked against Trump under the leadership of Joe Biden's Attorney General-designate Merrick Garland. On the day after the January 6 insurrection, FSFP joined a coalition of groups calling for Garland to stand up a task force upon his confirmation to pull together all of the disparate investigations into the matter.

Central to any such accountability, however, Bonifaz argues today, is the need for an important reform in the U.S. Senate and accountability for members who serve both there and in the U.S. House. He argues that the failure to convict Trump at his second Impeachment Trial "demonstrates that those who are sworn to take the oath to preserve, protect and defend the Constitution in the U.S. Senate are not up to the task --- at least for the 43 members of the Sedition Caucus, who are every bit as guilty as Donald Trump for voting to acquit him despite the overwhelming evidence that Donald Trump incited this insurrection and was guilty as charged."

He faults "those in power who are not abiding by their oaths" who have allowed Presidents to "assume the powers of a king". To begin reform of Congress, Bonifaz explains, we must start with reform of our electoral system as Democrats have proposed in their critical H.R.1. and S1 bills called the "For the People Act". But to see that through Congress --- and so many other necessary reforms --- we will have to do away with the legislative filibuster, he says.

"The filibuster, as we know, requires a 60 percent majority in the U.S. Senate for anything to pass, and that's contrary to any basic principle of small-d democracy," Bonifaz tells me. "That's a first order of business for those in the U.S. Senate and, frankly, those in the White House who are pledging to protect and defend our democracy. We need to eliminate the filibuster, and we need get on to the business of responding to these voter suppression efforts throughout the country that we now see in state legislatures to try to roll us back and disenfranchise millions of voters."

Of course, Democrats could do that without Republicans at all, with their newly-won Senate majority, but for Democratic Senators Joe Manchin of West Virginia and Kyrsten Sinema of Arizona who have each pledged to protect the filibuster. Even those obstacles however, as Bonifaz explains, are not insurmountable if pressure is applied by Democratic leadership in the Senate and the White House...and if pressure is applied by we, the people on them to do so.

With the "Jim Crow relic" filibuster out of the way, says Bonifaz, the Senate would also be able to invoke Section 3 of the 14th Amendment to prevent Trump from being allowed to hold federal office in the future. The post-Civil War Amendment blocks those who have engaged in rebellion or insurrection against the U.S. Government from becoming candidates for public office. "This is a critical next step needed to ensure that this lawless ex-President is disqualified from running for office again," Bonifaz asserts, detailing how the provision would work with a simple resolution adopted by both the Senate and House.

On today's BradCast: On the same day that news broke that Fulton County (Atlanta), Georgia's newly elected prosecutor has opened a criminal investigation into Donald Trump's apparent attempt to steal the 2020 Presidential election in her state, the U.S. House Impeachment Managers began their not-unrelated and rather damning opening argument against the disgraced former President in his historic second U.S. Senate Impeachment Trial. And though it was not necessarily surprising, it was still stunning to see that Fox "News" didn't even bother to carry some of the most disturbing and chilling testimony and video presented on Wednesday. [Audio link to show follows below summary.]

Our special, seat-of-our-pants coverage continues today, as Democrats from the House laid out what certainly came across as a compelling, seemingly air-tight, point-by-point case against Trump. They detailed, through his own repeated tweets and media statements, all the way back to last Summer, how he cultivated and prepared his supporters for his false claim that, if he lost the election, it could only be due to massive election fraud.

While the Article of Impeachment itself, for "Incitement of Insurrection" at the U.S. Capitol on January 6th, focuses largely on that day's deadly attack by his MAGA Mob, Trump had laid the groundwork for the assault for months. The House Managers offered a meticulous presentation of tweets and media statements from the then-President, detailing how he used his various platforms to gin up false outrage about a "stolen election", both before and after the election itself. That, despite a lack of evidence to support his claims and his carefully orchestrated attack on the last day possible to prevent the final certification of Joe Biden's decisive Electoral College victory.

Lead Impeachment Manager Jamie Raskin (MD), describing Trump as "the Inciter-in-Chief," charged that his scheme was "the greatest betrayal of the Presidential Oath in the history of the United States." The entire team of Managers spelled out exactly how Trump "praised, supported and cultivated" the eventual violence that resulted in five deaths that day, including a Capitol Police officer, two officer suicides in the days that followed, and well over 100 serious injuries to police attempting to protect the Capitol and the hundreds of lawmakers inside.

"For months," Rep. Eric Swalwell (CA) explained during his presentation, "Trump assembled the logs and the kindling" to convince his supporters that the election would be rigged, "so if he lost, his supporters would be ready to light the match."  And they were --- especially after Trump "doused the flames with kerosene" once he lost the election and eventually ran out of non-violent option to overturn it.

Unfolding, appropriately enough, like a violent crime prosecution, the Managers detailed how Trump ignored more than 60 court challenges he lost (several of which were at the hands of federal judges he himself had appointed); pressured and threatened election officials in several states to change results in his favor; attacked Senators and members of the House for failing to take action on his behalf; pressured the Dept. of Justice to bring fraudulent fraud cases; and even used his platforms to repeatedly attack his own Vice President Mike Pence for refusing to try and steal the election for him.

By the time his supporters were primed to storm the Capitol on January 6, as previously unseen video and federal charging documents reveal, many in Trump's mob were focused on the assassinations of Pence and House Speaker Nancy Pelosi, among others. Chilling surveillance footage of fleeing lawmakers and courageous, quick-thinking law enforcement officials also reveals how close the insurrectionist mob actually came to being able to do so. It's miraculous that there weren't even more deaths.

Underscoring the entire case, however, is the fact that none of it --- none of the violence, none of the death --- would have occurred, had not Trump incited it and then failed to stop it. All of it. On purpose. Unapologetically, even now.

We're joined today for insight on today's historic proceedings and how Trump's defense team can possibly respond to it, by LISA GRAVES of True North Research. With her experience as a former Deputy Asst. Attorney General at the U.S. Justice Dept., a former Chief Counsel in the U.S. Senate, and a former Deputy Chief for the U.S. Court system, she brings a broad and helpful perspective to all of this.

Among the points discussed today, in addition to her general opinion of the case to date by the House Managers: How this Impeachment Trial differs both from Trump's first one and Bill Clinton's; Whether she would like to see witnesses called during this trial and, if so, who?; How much of this matter should be seen as "Kabuki Theater" given the general belief (true or not) that there are unlikely to be 17 Republican Senators willing to vote for conviction, as needed; Whether this Impeachment Trial helps or hurts the odds of criminal charges being brought against Trump in the future for this matter; And what she might expect from Trump's defense attorneys in response.

"I think it's vital that, under our Constitution, these proceedings take place even if there are members of that body who do not have the courage -- the moral courage --- or the devotion to our Constitution to do the right thing, based on the evidence that's been presented so far, to convict Donald Trump," Graves tells me. "I think there should be accountability for members based on how they vote in this trial. And people should be held to account for whether they are willing to speak up against this unprecedented assault on our democracy, on our legislative branch of government, on the rule of law, and on the very notion of how you determine elections are valid, which is the certification process that every single state engaged in."

"So, I think it's an important thing historically," she argues. "It's important for our Constitution. It's important for the people, regardless of the outcome."

On today's BradCast Special Coverage: There have only been three Presidents during the 243-year history of the United States who have been Impeached, for a total of four Presidential impeachments. Donald Trump has been impeached twice. He alone makes up a full half of all of the Presidential Impeachments in the history of our nation. That will be a scar and mark of shame that will never be removed from his pathetic legacy, no matter what happens in his historic second Impeachment Trial in the US Senate, which began in earnest today....sort of. [Audio link to show follows below summary.]

Democratic House Impeachment Managers on Tuesday were forced to make the case for the Constitutionality of holding an Impeachment Trial for a President who is already out of office. Frankly, it's a ridiculous case to have to make, as we discussed on yesterday's show and again today. Of course an impeached, former official can be tried by the U.S. Senate after leaving office. It's been done several times in our nation's history, and legal scholars from both the Right and Left have argued as much in recent days in response to the disingenuous case made against it by Trump's defense attorneys and his sycophantic Republican supporters in the Senate.

Nonetheless, lead Impeachment Manager Rep. Jaime Raskin (MD) opened the argument on this point on Tuesday, with a compelling narrative that there is no "January Exception" to the Constitution's impeachment clause. If there was, he argued, Presidents leaving office would have impunity to cause any amount of mayhem during their final weeks in office. Raskin's presentation began with a stunning, riveting and chilling video juxtaposing Trump's January 6th rally comments to his supporters at the White House, instructing them to "fight like hell" before directing them to the U.S. Capitol, along with previously unseen video clips of his supporters subsequent attack on the U.S. Capitol on January 6th. The montage showed Congress being interrupted by the violent insurrectionists, with lawmakers sent scurrying for their lives during the Joint Session to certify the 2020 Electoral College results from last November's Presidential Election victory by Joe Biden...

Raskin's presentation was followed with ones from Managers Joe Neguse (CO) and David Cicilline (RI) who offered historical, Constitutional and legal background in support of their case, before Raskin returned to close the argument with a heartbreaking personal tale of his --- and his family's --- experience during the January 6th attack at the Capitol. We share extended excerpts from his presentation and video.

Next, Trump's team of defense attorneys offered their own case, beginning with a rambling, disjointed, confusing, often political case by lead defense attorney Bruce Castor (famous for having refused to charge Bill Cosby while a prosecutor in Pennsylvania), before an angry, confusing, and even-more-political and partisan case was made by attorney David Schoen (who had previously represented convicted felon and Trump pal Roger Stone, and was set to defend convicted sex trafficker Jeffrey Epstein before he committed suicide in prison.)

Castor made no case at all about the Constitutionality of the proceedings, and even appeared to threaten at least one Republican Senator before arguing that a trial to determine if Trump should be allowed to hold future office was not necessary, since "smart" voters had already done a very good job of voting Trump out of office by themselves. (Begging the question of whether Castor will be allowed by Trump to return tomorrow!) Schoen eventually seemed to make a case against the Constitutionality of the trial, but his argument was so quickly read, and included so many arcane Constitutional and historical references, it was virtually impossible to follow or make sense of.

No worries, however. His case --- any case at all, apparently --- was good enough to win the votes of 44 Republicans Senators when the resolution to dismiss the trial was ultimately defeated at the end of the day by a 56-44 vote. All Democrats and six Republicans (Collins, Cassidy, Murkowski, Romney, Sasse and Toomey) voted to allow the trial to proceed. Opening arguments for the actual substance of the article of impeachment for "Incitement of Insurrection" begin on Wednesday.

Finally, in our closing few minutes today, we switch gears (mostly) for a quick report on two disturbing, and somewhat related developments. The first story regards an apparent hacker or intruder who was able to use remote access software several days ago, to dangerously increase sodium hydroxide (sometimes known as lye) levels at a water treatment plant in Oldsmar, Florida, near Tampa. Luckily the incident was noticed --- live, as it was happening --- by an alert operator at the plant who saw the manipulation on his monitor before drinking water was actually poisoned.

And, in somewhat related news, we learned over the weekend that top officials at the U.S. Election Assistance Commission (EAC) --- the federal agency responsible for certifying computer voting and tabulation systems --- quietly changed a provision in new security standards for voting systems to allow wireless modems and chips in such systems. The change comes after years of work on the new draft standards by cybersecurity and voting systems experts who strongly urged against allowing remote access hardware, which can be used to hack election results, in such systems.

Whether they are used to manipulate results or not obviously makes no difference to those who are concerned that results might have been changed by hackers, as today's Impeachment Trial should, once again, underscore.

We hope to have more information in the future on this, but the newly modified standards --- known as the Voluntary Voting System Guidelines (VVSG) --- are now much more friendly to private voting system vendors (and hackers) and are set to be approved by the Commission tomorrow (Wednesday). The EAC has long been captured by private voting system vendors, and appears to be doing their bidding once again.

The Election Integrity advocates at Free Speech for People have set up a petition that they are asking voters to sign in hopes of encouraging EAC leadership to return to the safer, modem-free standards before they are officially adopted and used by many states across the country...

On January 3rd --- three days before Trump's violent insurrection at the U.S. Capitol --- John McCain's 2008 campaign chair Steve Schmidt argued "The die is cast for the Republican Party. It will be destroyed on January 6th." His brief but prophetic Twitter thread went on to argue that his former Party would not be able to survive its factionalism and "the poisonous fruit from four years of collaboration and complicity with Trump's insanity, illiberalism and incompetence are ready for harvest." He ended the thread charging: "There are only two sides in American politics now. There is the American side and the Autocratic side. May God help us all if we falter, flag or fail in defense of American democracy." Schmidt's prediction, as we discuss on today's BradCast, appears spot on. Among the stories, many of which appear to buttress Schmidt's case, covered on today's program....

  • The Pentagon's Joint Chiefs of Staff issued an unprecedented statement to the military (and the nation), condemning the "violence, sedition and insurrection" at the U.S. Capitol last week, reminding them of their duty to defend the Constitutional process, and made clear that "President-elect Biden will be inaugurated and will become our 46th Commander in Chief" next week.
  • In the wake of that deadly, Trump-incited coup attempt, many major corporations have announced they will be withholding millions in campaign funding to Republicans who voted against affirming Joe Biden's Electoral College victory last week. Some will also be withholding funding from Democrats...for apparently no sensible reason at all. (Not that we're against it.)
  • If the news of losing their funding from major corporations wasn't bad enough for Republicans, their biggest funder, billionaire Sheldon Adelson, died on Tuesday. We suspect GOPers will keep kissing up to his widow, however, in hopes of continuing to rake in Adelson's corporate campaign cash.
  • How upside-down has the nation become in the Trump Era? We have to laud Liz Cheney (Liz Cheney!) today for coming out in favor of the Article of Impeachment [PDF] Democrats are now moving through the House, charging Donald Trump with "Incitement of Insurrection". Even soon-to-be-former Republican Senate Majority Leader Mitch McConnell, reportedly, is not opposing it and is even said to be "pleased" about it.
  • House Minority Leader Kevin McCarthy (R-CA) is not nearly as clever as McConnell, as several stories we cover today make all too clear. Among them, on Monday, following a conversation with the President, McCarthy told his House GOP Conference, according to Fox "News", that Trump acknowledged he bears some blame for what happened last Wednesday, when his supporters attacked the Capitol following his remarks to them, falsely claiming that the election was stolen and they must "fight" to save the nation. McCarthy's thanks for passing on that message from Trump? Today in Texas, Trump said he takes no responsibility at all for the riot. "People thought that what I said was totally appropriate," Trump told media, "Everybody to the ‘t’ thought it was totally appropriate.”
  • Among those who didn't find it "totally appropriate," New Jersey's former Republican Governor and longtime Trump buddy Chris Christie, who said "if incitement to insurrection" isn't grounds for impeachment, "I don't know what is." Maryland's current Republican Governor Larry Hogan echoed the sentiment, agreeing that Trump has "blood on his hands" for the riot that resulted in the deaths of at least five people, including a police officer last week. "He was responsible for inciting this riotous mob. This was an insurrection. They stormed the Capitol and threatened to kill the Vice President and put the lives of people in danger and he had a huge role to play in that," said Hogan, a likely 2024 Presidential hopeful.
  • But it may have been California's former Republican Governor Arnold Schwarzenegger whose remarks --- as someone who grew up in Austria in the shadow of WWII --- were the most profound and even, somehow, encouraging. We share his full, emotional, must listen statement posted online over the weekend, comparing the Nazi's Kristallnacht to last week's violent, failed coup.
  • Finally, news breaks that Michigan's former Republican Governor Rick Snyder and other former state officials are about to be criminally charged for their parts in the Flint lead water poisoning disaster, which leads us to Desi Doyen and our latest Green News Report, with bad news for the planet as usual, but a bit of welcome schadenfreude concerning the fossil fuel industry and the fates of those toxic political appointees who worked in the Trump Administration...

I'll try to keep my BradCast summary as short and sweet as possible, as tonight's Presidential Debate in Cleveland begins shortly --- with full special coverage of it on tomorrow's program! [Audio link to today's full show is posted below.]

Among the stories covered today, beginning with some good news and slowly sliding downhill from there...

  • At around 7 points, Joe Biden's current lead in the national polling average against Donald Trump is the largest since Bill Clinton's re-election in 1996. But don't get too excited just yet. We don't run national elections. We run 50 state-by-state elections and it's the Electoral College votes of each of those states that matters, not the popular vote...except for this year, when the popular vote actually could end up making a huge difference in who becomes the next President. I explain why;
  • Biden's pre-election polling lead in the crucial battleground state of Pennsylvania, according to a new WaPo/ABC News poll, is now at a substantive 9 points. With the poll's margin of error factored in, however, it could be a much tighter race that that number suggests in Biden's birth state, which is being seen of late, by both campaigns, as the potential tipping point state for the Electoral College this year. But the news is much more good than bad for Biden in the key battleground, in that he is outperforming Hillary Clinton's 2016 lead over Trump in the noteworthy Dem-leaning parts of the state, and has substantially cut into Trump's 2016 margins in the Republican regions of the state and among voters (for example, white without college degrees) that Trump would need to repeat his very narrow reported victory in the Keystone State four years ago;
  • There are, however, many "X Factors" this year that should prevent anyone from thinking they know anything about how all of this could ultimately play out based on either national or battleground state polling numbers --- from the pandemic and the unprecedented number of absentee ballots this year, to the US Postal Service slowdowns, to new, unverifiable touchscreen voting systems in many locations, to the GOP's stolen U.S. Supreme Court and how those "Radicals in Robes" could still help game the system between now and Election Day (and in the days after), particularly if Republicans are able to steal an even larger the majority by ramming Trump's SCOTUS nominee Amy Coney Barrett onto the Court before Election Day, as Senate Republicans currently intend;
  • One of those "X Factors," for example, is playing out right now in New York City today, where the Board of Elections has an apparent disaster on its hands after their vendor sent out tens of thousands of mail-in ballots with the wrong names and addresses printed on the accompanying return envelopes. The BOE claims they will make good on the problem by getting corrected envelopes to voters in time to vote, but once again, chaos reigns for voters in Brooklyn, who are asked by the BOE to contact Apply4Absentee@boe.nyc or call 1-866-VOTE-NYC if they received an absentee ballot with the incorrect name or address on the return envelope;
  • Meanwhile, ballot battles continue in both state and federal courts regarding, among other things, how long after Election Day that mail ballots in swingstates like Pennsylvania, Wisconsin, Michigan and North Carolina may arrive at County headquarters to still be included in the final results. We're joined today by BRAD BLOG's long-serving legal analyst ERNEST A. CANNING to discuss some of those cases and how the U.S. Supreme Court's so-called "Purcell Principle" may serve to overturn (or uphold) rulings in both lower federal courts and in state Supreme Courts. Canning also offers some thoughts on Trump's nomination of Barrett to SCOTUS and how the latest Federalist Society-backed judge to be packed onto the high court illustrates the sweeping lurch to the radical right on our federal court system over the past 40 years;
  • Finally, we close with Desi Doyen and our latest Green News Report. The news she's got today is pretty grim...but don't blame Desi. There ain't much good news out there to work with these days...
