Among the stories covered on today's program, as we try to get back up to speed...

  • More than 2,000 were reportedly wounded and over 50 killed as Israel opened fire on protesters in Gaza today during the "festive" opening ceremony for the controversial U.S. embassy Donald Trump moved from Tel Aviv to Jerusalem. Much of the Muslim and Arab world condemned the attacks on the unarmed Palestinian protesters, but so so did the European Union, the United Nations, Russia and many others.
  • Back in the U.S., a new analysis from Washington Post finds that an administrative error led to at least 26 Democratic leaning voters being assigned to the wrong legislative district during last November's House of Delegates election in Virginia. The race in Newport News between Democrat Shelly Simonds and Republican David Yancey in HD-94, was judged to be a tie after a "recount", which was subsequently broken by a random drawing giving the seat to Yancey and allowing the GOP to retain control of the House. That failure, and similarly mis-assigned voters in yet another highly gerrymandered district in Fredericksburg, prevented what should, in retrospect, have been a Democratic takeover of the state's House in 2017 amidst a "Blue Wave" that otherwise managed to flip 15 seats from R to D.
  • Also today, a new report on what was reportedly a foreign-sourced cyberattack on Election Night two weeks ago in Knox County, Tennessee is troubling on a number of levels, though not necessary the one being reported by some media outlets citing a Ukrainian IP address used in the denial of service attack which was also sourced to countries on every continent except for Antarctica. We discuss what is known and still isn't, following the attack which took down the web-based election night results page for an hour after the close of polls two weeks ago, including one race said to have been decided by just 17 votes on the county's 100% unverifiable Direct Recording Electronic voting systems...

On today's BradCast: Rudy Giuliani works his magic as he settles in as the newest attorney on Donald Trump's personal legal defense team --- and it appears to have exploded spectacularly. And Ohio's Sec. of State and two largest counties are slapped with an election transparency lawsuit just days before next Tuesday's primary in the Buckeye State. [Audio link to show is posted below.]

First up: On Wednesday night, the former NYC Mayor stunned Sean Hannity of Fox "News" when he told him on air that Trump reimbursed his embattled "fixer" and personal lawyer Michael Cohen for the $130,000 in hush money paid to Stormy Daniels just days before the 2016 Presidential election. The payment, which Trump had long denied making himself, was meant to cover up an alleged affair Trump had with the porn star. Then, on Thursday morning, Giuliani dug the hole deeper by making clear, once again on Fox "News", that the payment was meant to protect Trump's candidacy.

All of which means that Trump is likely in even more --- and perhaps even criminal --- trouble, regarding serious campaign finance violations which Giuliani seems to have thought he was helping Trump avoid. We discuss and try to clarify the President's newly revealed legal peril on that front today, even as Trump (or his attorneys) took to Twitter to reverse his own previous denials by admitting that he did, in fact, reimburse Cohen for the payments to Daniels.

As Politico's Jack Shafer wryly tweeted today: "Having Giuliani in the mix is almost like having a second Trump."

Then, as we try to stay focused amidst all the noise, we're joined by election transparency expert JOHN BRAKEY and longtime election attorney CHRIS SAUTTER, both of Americans United for Democracy, Integrity and Transparency in Elections (AUDIT USA) about their lawsuit just filed in Ohio in advance of the state's 2018 mid-term primary next Tuesday.

The suit echoes a similar one filed last December in Alabama before that state's much-watched U.S. Senate Special Election between Democrat Doug Jones and Republican Roy Moore. (That suit was successful in a lower court, before the state's woeful Sec. of State John Merrill convinced their Supreme Court to stay the ruling at the last minute.) The new complaint seeks to force Ohio's Secretary of State Jon Husted and its two most-populous counties, Cuyahoga (Cleveland) and Franklin (Columbus), to retain digital ballot images created by the counties' computer scanners as hand-marked paper ballots are initially scanned during tabulation.

Those images, as Brakey explains, allow the public to safely examine the accuracy of election results without disturbing the original paper ballots and, according to Sautter (and several court rulings in other states), complies with federal election law requiring the retention of all election materials for 22 months after federal elections.

The pair detail why preventing the destruction of the images in question is at the center of the multi-partisan suit filed in Ohio, and why they plan to continue pressing election officials in Ohio and in many other states and counties around the country to ensure that digital ballot scanners are set to retain all such images for public oversight after Election Day.

Finally, Desi Doyen joins us for the latest Green News Report with still more bad news for corrupt EPA chief Scott Pruitt and for the planet itself, but also with a bit of good news for NYC, Hawaii, and even one of China's major cities...

On today's BradCast: After a months-long drought of one of our favorite guests, legal journalist MARK JOSEPH STERN of Slate returns today! And we make up for the deficit with a legal lightning round on a number of big cases being heard this and in recent weeks at the U.S. Supreme Court, as well as a number of important cases from elsewhere around the country.

Among the cases covered with Stern today: The years-long challenge to Texas Republicans' racial gerrymandering of Congressional and statehouse districts, which were struck down as unlawful by several lower courts, and Donald Trump's controversial anti-Muslim travel ban(s), which were also blocked by lower courts. The U.S. Supremes, however, may be on the verge of restoring both laws, according to Stern, despite previous findings of unconstitutionality. We also discuss the pending fate of two separate challenges to partisan gerrymandering heard recently by SCOTUS.

In both cases, Stern notes, referring to the stolen GOP majority on the Court after Obama's nominee Merrick Garland was blocked for a year, before Trump appointed Justice Neil Gorsuch: "I hope against hope that my predictions are wrong, but Republicans stole this seat for a reason."

But that's not all! We also hit several other important recent cases from federal courts around the country, which prove to offer a bit more encouraging news. Stern details the "complete train wreck" seen in a federal court in Kansas earlier this month, as their Sec. of State and top-shelf GOP "voter fraud" fraudster Kris Kobach disastrously attempted to defend his "proof of citizenship" voter registration law at trial. Kobach's humiliating effort resulted in a George W. Bush-appointed federal judge slapping him with the second of two contempt of court sanctions during the long case, and may signal, as Stern posits, the near end of the Republican Party's years-long disingenuous claims about a "voter fraud" epidemic.

"Kobach had committed a major self-own," Stern tells me. "He had gone into that trial thinking he was going to prove once and for all that 'voter fraud' was real, and he left that trial having inadvertently proved that it wasn't. He undermined all of the evidence that he had worked so hard to build up."

That, as one of Kobach's longtime colleagues in the long GOP "voter fraud" con, J. Christian Adams, finds himself as the defendant in a new lawsuit filed in Virginia by a number of U.S. citizens who were inaccurately accused by Adam's group, the Public Interest Legal Foundation (PILF), in error-riddled reports titled "Alien Invasion of Virginia" and "Alien Invasion II", of committing voter fraud. Adams is accused by the lawful voters of violations of the Constitution, the Voting Rights Act, and even the Ku Klux Klan Act of 1871.

"It's satisfying to see these guys have to answer in court for all that they've said and done for so long, and it's great to see the victims of their slander fighting back in such a powerful way," Stern argues.

We finish up our legal lightening round today with a case decided last week by the Supreme Court, in which Justice Gorsuch, who enjoys the seat stolen for him by Senate Republicans last year, actually joined the Court's four liberal Justices in striking down a law that allows the deportation of immigrants accused of "violent crimes". While Stern applauds Gorscuh joining the liberal justices in this case, given the vague statutory language used for defining "violent crimes", he also cautions that Gorsuch's interest here may signal a broader, more disturbing scheme down the road by Trump's far rightwing appointee.

Also today: The Trump Administration doesn't appear to do any vetting of any of their nominees for any office, it seems. Last week, Elizabeth Anne Pierce, a corporate member of a public commission created by Trump's FCC Chair Ajit Pai, purportedly to help expand broadband Internet access, was arrested on allegations of fraud to the tune of $250 million for forging signatures on contracts on behalf of her startup high-speed fiber-optic company. And, on Capitol Hill today, Navy Admiral Ronny Jackson, Trump's personal physician turned nominee to head the Dept. of Veterans Affairs, comes under fire from Senators of both parties, regarding his complete lack of experience for such a role, but also for reports of fostering a "hostile work environment", "excessive drinking on the job" and "improperly dispensing meds" among other things. In the bargain, today at the White House, Trump appeared to begin the process of throwing Jackson --- who he reportedly had to convince to accept the nomination to head the VA and its 360,000 employees --- under the nearest bus.

On today's BradCast: The allegation made by adult film actress Stormy Daniels that someone associated with Donald Trump physically threatened her, appears to track quite well with decades of similar allegations made by those who Trump, at one point, believed to have cross him. [Audio link to today's show follows below.]

During her 60 Minutes interview with Anderson Cooper on Sunday night, adult film actress Stephanie Clifford, a.k.a. Stormy Daniels, claimed she was physically threatened in 2011 in a Las Vegas parking lot, in front of her young daughter, by someone warning her to not to speak publicly about the sexual tryst she says she had with Donald Trump back in 2006. Immediately after the interview aired, an attorney for Michael Cohen (Trump's personal lawyer, fixer, and business partner) sent a "cease and desist" letter to Daniels' attorney, demanding she retract the "false and defamatory" claims made on the program, charging that Cohen "was responsible" in some way for the alleged threat. The attorney charged that Daniels' claims accusing Cohen "of criminal conduct" were "false", "libel[ous]" and "defamatory".

The only problem: Daniels didn't actually tie Cohen to the story about the thug who, she says, threatened her in 2011!

Cohen formed the LLC created to pay $130,000 in hush money to Daniels just weeks before the 2016 Presidential election, though he says he did not do so on behalf of Trump or the Trump Organization, that he was never reimbursed for the payment (which would be a violation of federal campaign finance law, if it was meant to help Trump win the election as Paul S. Ryan of Common Cause told us in January, just after he filed his complaints with the FEC and DoJ), and that, in any event, the tryst between Trump and Daniels never happened at all.

But, whether Daniels' tied Cohen to the alleged 2001 threat or not, it's hardly the first time the Trump Organization --- and Donald Trump specifically --- has been accused of physical threats against his perceived adversaries.

We're joined today by BuzzFeed investigative journalist and renowned "FOIA terrorist" JASON LEOPOLD to discuss three different incidents, revealed via Freedom of Information Act (FOIA) request documents he obtained from the FBI and other law enforcement agencies last year, detailing physical threats said to have been made against Trump business associates in the 80s, 90s and 2000s.

The details of the three different alleged incidents are chilling, including one terrifying and profane phone threat to an attorney, made on the day Trump's Casino business declared bankruptcy, from a payphone outside the Ed Sullivan Theater on the very same day that Trump was appearing on The Late Show with David Letterman, which is shot there. As Leopold explains, the incidents which he reported on exclusively last year at BuzzFeed, came immediately to mind upon hearing Daniels recount her own frightening tale on 60 Minutes.

Then, we open up the phone lines to hear from listeners on all of the above, as well as a number of other stories that we also cover on today's program, including: Saturday's massive March for Our Lives rallies for gun safety reform, as led by the students of Parkland, Florida's Marjory Stoneman Douglas High School and supported by Pope Francis; the Trump Administration's announcement that they plan to expel 60 Russian diplomats in response to the poisoning of a former Russian intelligence agent in Britain; and the Sunday announcement that, despite reports to the contrary last week, Fox "News" wingnut attorneys Joe diGenova and his wife Victoria Toensing will not, in fact, be joining Trump's personal defense team responding the investigation of Special Counsel Robert Mueller after all (precisely as predicted by Friday's guest on The BradCast, Marcy Wheeler!)...

On today's BradCast: What happens when the President of the United States blocks you on Twitter? How about when the President blocks a journalist? Does that violate an American's First Amendment free speech rights or Constitutional protections granted to the press? Our guest today thinks so, and is one of seven plaintiffs now suing Donald J. Trump in federal court for having blocked them on the social media platform from viewing or replying to his tweets or participating in discussion about them on the site. [Audio link to show follows below.]

But, first up today, a few breaking news items, beginning with the fifth package bomb to explode in Texas this month, as an apparent "serial bomber" continues to terrorize the Austin community in what may be a deadly spree targeting minorities in the area. Today, Donald Trump and his White House finally made their very first comments on the bombings, that have, so far, killed two and seriously injured several others.

Then, there was another school shooting today, the 17th since the beginning of the year, this time at a high school in Maryland where, just last week, many of its students participated in a national walkout to demand reform of our nation's gun laws. The shooter in today's incident is now dead after a school resource officer fired on him (though it remains unclear if the 17-year old student shot himself and if one of the victims may have been shot by the officer.) The two student victims, a 16-year old female and 14-year old male remain in the hospital. The girl is reportedly in critical condition.

But, we also have some encouraging news on that front out of Florida, where a recent gun safety reform package was adopted by the state in the wake of the Parkland, FL massacre at Marjory Stoneman Douglas High School. The new measure allows, among other things, law enforcement officials with a court order to temporarily seize weaponry from those judged to be a threat to themselves or others. The first such court order was granted last week in Broward County, resulting in four firearms and 267 rounds of ammo being taken from a 56-year old man who, under a separate state law, was involuntarily institutionalized by police after what the judge described as a series of delusional episodes by the man. Naturally, right-wingers are both freaking out about it and not informing their audience about why those steps were actually taken.

Next: My guest today, REBECCA BUCKWALTER-POZA, judicial affairs editor at Daily Kos and a contributor to Democracy Journal, is one of seven plaintiffs now suing Donald J. Trump in federal court for having blocked them on Twitter from viewing or replying to his tweets or participating in discussion about them on the site. The attorney and journalist turned plaintiff joins us today to discuss her lawsuit and the recent hearing in federal court on the landmark case.

As Buckwalter-Poza, who is still blocked by Trump on the social media platform, explains: "It turns out the President really doesn't like it when you suggest that Russia was involved in the 2016 election. He tweeted something about having won the White House, and I all I did was quote that and say, 'To be fair, you didn't win it --- Russia won it for you.'" She says there were "no obscenities, no threats, absolutely nothing more than a reference to Russia's involvement in the election."

As part of its defense case, the U.S. Department of Justice (yes, we, the tax-payers, are footing the bill to defend Trump in this case!) has admitted that plaintiffs were blocked for no other reason than they were critical of the President. "They've conceded that it's 'viewpoint discrimination', which is the legal term for when you are, in this case, blocking someone from Twitter because you don't like what they're saying. There's no other justification. It's just the content. It's a criticism. That definitely violates my First Amendment rights," she argues.

Explaining how she sees those rights as being violated, Buckwalter-Poza tells me: "As a journalist, there's the immediate fact of not being able to follow Trump, not being able to engage other people, not being able to respond. To put it into First Amendment terms, though, I have a right to be part of this public forum, to engage other people, and to have my point of view be heard. And I have a right to try and catch the President's attention. Unfortunately, in this case I did, but his response was to block me instead of to respond."

I can attest to the difficulties in covering stories when the focus of the story blocks you on Twitter, as I reported last week regarding recent false comments about torture made by Rep. Liz Cheney (R-WY), who now apparently blocks me on Twitter for reasons unknown, and an incident at the end of last year which resulted in Alabama's Sec. of State John Merrill blocking me as well, after I politely corrected [PDF] his inaccurate statements about the state's computerized vote tabulation systems.

After a recent hearing with an apparently very well-informed federal judge, Buckwalter-Poza says the case could now result in a settlement. But that still remains to be seen.

Finally, Desi Doyen joins us for the latest Green News Report on the first day of spring, as extreme winter weather continues to pummel the nation, including with what could be a fifth back-to-back Nor'easter for the East Coast over the weekend (they are currently facing their fourth), and as the Trump Administration continues to make "climate change" disappear, even from FEMA's natural disaster recovery plans...

On today's BradCast: As the White House implosion continues at the end of one of its most chaotic weeks to date, Trump declares a trade war! [Audio link to show is posted below.]

Well, huge tariffs on imported steel and aluminum, anyway, (those are taxes on the American people, Mr. President), which will almost certainly lead to international trade wars with friend and foes alike, raise the cost of many consumer goods and, yes, kill American jobs.

The proposed tariff scheme has already led to an internal White House war with Trump's lead economic advisor threatening to resign if they are implemented, Congressional Republicans furious about the plan, close allies such as Canada and the EU threatening to retaliate against the U.S., the entirety of the fossil fuel industry (from oil to natural gas to coal) declaring that jobs will be lost and prices will rise, and even Trump's own Defense Secretary advising that the measure, which President Chaos is hoping to pull off on "national security" grounds, will have a "negative impact on our key allies". Other than that, the idea is going over very well.

At the same time, there was another school shooting by a 19-year old on Friday, this time at Central Michigan University; Texas sees huge early voting turnout in advance of Tuesday's 2018 mid-term primary elections (even beating turnout for the 2016 Presidential primaries!); New polling finds the Affordable Care Act (Obamacare) and Medicaid with record high approval ratings; and the state of Georgia is finally moving away from their 14-year old 100% unverifiable Diebold touch-screen voting systems...to new, similarly unverifiable computer-printed "paper ballot" systems.

(The GA legislature is moving a measure forward to fund new "Ballot Marking Devices" or "BMDs", which are, essentially, very expensive computerized "electronic pencils" that allow voters to use a touch-screen to print out a non-human readable barcode on a piece of paper, which is then tallied by a computer scanner. Or, the computer may print human-readable vote selections on paper which may or may not actually be verified by the voter to reflect their intent before being tallied by a computer. After an election, it'll be impossible to know if any of those so-called ballot cards actually reflect voter intent. That's why election integrity advocates oppose the new "bad to worse" scheme quickly moving forward in GA!)

Then, Desi Doyen joins us for the latest Green News Report as Trump's EPA chief Scott Pruitt cites the bible as his excuse for polluting the planet and killing children with fossil fuel exploitation and dangerous chemicals. (Hope Pope Francis doesn't find out!)

And we close today with some listener mail and some very good news from the American Cancer Society that they are finally recommending electronic cigarettes and vaping devices for smoking cessation. (Hope the supposedly anti-tobacco Democrats who are helping to kill people by making it more difficult to vape don't find out!)

After yet another exhausting and harrowing week in Donald Trump's America, as the Doomsday Clock inches closer to midnight, we try to lighten things up a bit, at least comparatively, on today's BradCast --- even if it's not always easy. [Audio link to show follows below.]

Among the many stories covered on today's program...

  • A few words about Donald Trump's reported attempt to fire Special Counsel Robert Mueller last June before chickening out, which the President describes today as "fake news";
  • Republicans are now, literally, trying to block democracy by preventing elections from happening at all. Gov. Scott Walker in Wisconsin and the GOP-controlled Alabama state legislature provide just the two latest examples;
  • Kansas' failed Governor Sam Brownback has, apparently, failed up, with an appointment by the Trump Administration, confirmed this past week by the U.S. Senate, after Vice President Mike Pence was brought in to break the tie vote in Brownback's favor;
  • Speaking of failures in the state of Kansas, their Secretary of State Kris Kobach, a long-time GOP "voter fraud" fraudster and now candidate for Governor, enjoys still more shame and ignominy this week, as it was discovered that he exposed private information, including the last four digits of social security numbers for thousands of state officials and employees --- including his own! --- on an unprotected Internet page;
  • The Guggenheim Museum declines to loan a valuable Vincent van Gogh painting to Donald and Melania Trump for use in their White House residence, but offers a solid gold alternative that seems perfect for the first family;
  • And, speaking of the first family, Trump's recently reported hatred of sharks --- revealed by adult film actress Stormy Daniels in the wake of revelations of her alleged affair with Donald Trump and $130,000 hush-money payoff just before the 2016 election --- has resulted in an outpouring of donations to shark charities across the nation and the world! See? Donald Trump can do some good in this world after all!

In wake of President's reported 'shithole countries' comment, the GOP's toxic, racist policies are laid bare in the U.S. and across the globe...

On today's BradCast: Buckle up, and maybe take a few pre-emptive antibiotics just for safety. [Audio link to show follows below.]

We begin with a few responses to the racist President of the United States Donald Trump's reported description of Haiti, El Salvador and Africa nations as "shithole countries". As a measure of just how appalling the comments were, we actually declare George W. Bush no longer the "Worst President Ever", before turning to outraged responses from right-wingers Glenn Beck and Frank Luntz, of all people, to help underscore both how offensive and, frankly, inaccurate Trump's comments were.

But, as several have noted, while Trump's remarks are disturbing, the fact that his racism is embodied within his policies --- on immigration, policing, and much more, including voting and elections --- is far more troubling. That racism and dishonesty was on display in the sham Presidential Commission created by Trump, supposedly to root out the millions of illegal votes he falsely claims were cast against him when he lost the popular vote by millions to Hillary Clinton in 2016.

But his bogus Commission, headed up by disgraced GOP "voter fraud" fraudster and Kansas Secretary of State Kris Kobach, was abruptly shut down last week after facing an onslaught of legal challenges and finding none of the supposed voter fraud they had set out to highlight. After the Commission's ignominious closure, Kobach claimed he would be advising the Dept. of Homeland Security who, he said, would be taking the Commission's data and preliminary findings to continue the investigation. While worrying a number of voting rights advocates, those claims too have so far proven to be false, according to statements from DHS and legal documents filed by the DoJ in response to lawsuits.

Meanwhile, Trump's poisonous racism and failed Presidency is having ripple effects across the globe, and not just with those nations he is said to have described as "shitholes". The U.N. and the Vatican have now condemned his remarks, he has been forced to cancel a planned trip to Great Britain (which, naturally, he has lied about) and, following the recent resignation of the U.S. Ambassador to Panama who says he can no longer justify serving under this Administration, Trump's newly appointed Ambassador to the Netherlands, Pete Hoekstra, has been mercilessly called out by the Dutch in recent days for multiple lies.

Hoekstra, a former Republican Congressman from Michigan and immigrant from the Netherlands, had recently denied having made wholly discredited racist charges, in 2015, claiming Muslim immigrants were burning Dutch politicians to death and creating so-called "no-go zones" in the Netherlands. After he charged a Dutch journalist with reporting "fake news" for asking him about his fully-documented and video-taped false claims (and then claiming in the same interview he hadn't charged the journalist with reporting "fake news") the new Ambassador's first press conference this week in The Hague did not go well, to say the least. On Friday, Hoekstra was finally forced to admit his 2015 comments were wrong, though his shame appears to not yet be over.

All of which underscores that while Donald Trump may be the highest profile symptom of a very sick Republican Party, he is but a small part of a very widely spread disease that has poisoned his party and has made America anything but "great again" in the eyes of the world...

On today's BradCast, we take a deep dive into the insane state of play in the final days before voters finally head to the polls in Alabama for the U.S. Senate special election between the Republican, twice-removed-from-the-bench judge Roy Moore and Democratic former US Attorney Doug Jones.

But first, a few quick news items today, including an update on the still-out-of-control Southern California wildfires; The mostly-failed terror bombing by an alleged ISIS sympathizer in the subway near Times Square today; news in the case of three white rightwing "militiamen" on trial for an alleged scheme to bomb a community of Muslim Somali refugees in Kansas. Their motion seeks to get more Trump-supporters from elsewhere in the state on their terror trial jury; New details on the school shooting (by another white guy) in New Mexico last week that took three lives, including that of the shooter. Despite FBI investigators interviewing the man last year after he is said to have left online comments seeking information on weapons to use in a mass shooting, he was able to legally purchase a semi-automatic pistol and high-capacity magazines last month anyway.

And then it's onto our deep dive into "deep red" Alabama and the state of the important Moore/Jones U.S. Senate election before Election Day on Tuesday. Among the issues covered on that front today:

  • Election Integrity advocates obtained a big win on Monday morning, when receiving an order [PDF] from a state court requiring state election officials retain digital ballot images created by computer scanners tabulating the paper ballots used across much of the state. (My interview last week with John Brakey, the election integrity advocate who organized the court action, explaining why its necessary, is here.)
    UPDATE 12/12/2017: After a private ex parte motion (meaning, the opposition was not present) later in the day, by the defendants, AL's Sec. of State and State Election Director, the Alabama Supreme Court stayed the earlier Circuit Court ruling and set a hearing on the matter for later this month. That, effectively, means that ballot images will not be preserved after all. More on this remarkable late ruling on today's BradCast...
  • Some last minute news on the anti-gay, anti-Muslim Moore, who has been accused by 9 different women of inappropriate sexual contact with them when they were teenagers (including one who was 14-years old at the time), on his belief that Constitutional Amendments which came after the ten in the Bill of Rights --- including those that ended slavery and gave voting rights to African-Americans and woman --- somehow violated the intentions of the nation's Founders;
  • New polling from Fox "News" claiming to find the Democrat Jones up by 10 points over Moore on the eve of the election, and another new poll from Emerson finding Moore up over Jones by 9 points;
  • How the entire race will come down to turnout, particularly in the African-American community, and whether they are allowed to vote and to have their votes counted as cast, given the state's Photo ID voting restrictions and other practices which Republican state lawmakers have been caught admitting to having designed specifically to suppress black and Latino voting;
  • AL's senior Senator Richard Shelby, a fellow Republican, announces he could not vote for Moore, based on the allegations against him;
  • And, finally, a remarkable focus group led by Republican pollster Frank Luntz for VICE News with so-called "conservative" Alabamians explaining why they plan to vote for Moore despite the allegations by nine different women against him...

Guest: Legal reporter Mark Joseph Stern; Also: Fires worsen in and near L.A.; Franken may be forced, by Democrats, to resign...

On today's BradCast: Another day, still more chaos in these United States, threatening to all but drown out two major civil and privacy rights cases heard this week by the U.S. Supreme Court and covered in detail on today's show. [Audio link to full show is posted below.]

But first, Desi Doyen joins us for an update on the out-of-control wildfires in and around Los Angeles today, threatening tens of thousands of structures and many more residents, who have been forced to flee several large blazes fueled by dry conditions and record winds. Also in danger: Animals, priceless works of art and one of Rupert Murdoch's mansions.

Next, calls from fellow Democrats for Sen. Al Franken to resign blew up on Wednesday in the U.S. Senate, after another unnamed woman reportedly stepped forward to claim the Minnesota Senator tried to kiss her after a radio program back in 2006. Franken denies the claim and calls it "preposterous", but may be forced to resign anyway on Thursday, less than one week before Republicans in Alabama may elect Roy Moore, an accused child molester, to the same U.S. Senate. Desi has a few choice thoughts on the Franken matter as well.

Then, we're joined by Slate legal reporter MARK JOSEPH STERN, to discuss two important cases heard at the U.S. Supreme Court this week. Stern, who was at the Court during oral arguments for both, explains what is at stake in each, and how the Republicans' blatantly stolen seat occupied by Justice Neil Gorsuch will radically effect each case.

The first, Carpenter v. United States has to do with the U.S. Government's argument that law enforcement has the right to obtain anyone and everyone's cell phone location data, even without obtaining a warrant from a court first, in what appears to be a clear violation of the U.S. Constitution's 4th Amendment privacy rights for freedom from unreasonable search and seizure.

"The case almost sounds too crazy to be true," Stern tells me, detailing the Government's argument that "because customers voluntarily turn over the data to a third party --- their cellphone companies," which keeps records of which cell phone towers are used and by whom, customers "have no right to privacy with regards to that information."

The second, Masterpiece Cakeshop v. Colorado Civil Rights Commission is an even more insane "free speech" and "religious expression" case. It was brought by a virulently anti-gay baker in Colorado who claims his bakery shop has the First Amendment right to discriminate and refuse to sell a cake to two men celebrating their same-sex wedding. The Colorado Civil Rights Commission and the state courts disagreed with the baker, Jack Phillips of Masterpiece Cakeshop, who appealed to the U.S. Supremes. Surprisingly they took up the case after Phillips was also joined by Trump's U.S. Department of Justice over the summer.

Stern details the liberal Justices' skeptical (and even hilarious) questioning of whether Phillips' argument that he is an "artist" exercising creative free speech --- not blatant discrimination --- could also be extended to florists and hair stylists and make-up artists, among many others.

"This is an embarrassment," says Stern. "What happened here is a clear-cut case of discrimination." He also highlights one key irony underscoring the entire case: "The Supreme Court's conservative justices have really been lecturing gay people for years that they should stop turning to the courts to vindicate their rights and, instead, go through the democratic process to secure their equality under law. And here we have a case of gay people doing exactly that. Gay people in Colorado fought long and hard to change the law to protect their right to equal service in public accommodations. They succeeded. And now, those same Supreme Court conservatives who said you have to do this through democracy, are now poised to say, 'Actually you don't get to this,' and nullify the rights that they secured through the democratic process."

Depending on how Justice Kennedy decides in a likely 5 to 4 opinion one way or another --- on a case that would have been a cake walk for civil rights advocates before Republicans stole the Court majority --- what could very well result is legalization of mass discrimination of people of all races, religions and sexual orientations by any and all manner of businesses in the U.S. for decades to come...

On today's BradCast: The GOP rammed the largest tax increase in American history through the U.S. Senate in the middle of the night last Friday, and we open the phones to try to figure out what the alleged Trump/Russia "collusion" is actually supposed to be. [Audio link to show follows below.]

After several important breaking news items (Trump's unprecedented reversal of National Monument declarations in Utah by Presidents Obama and Clinton; His stolen U.S. Supreme Court allows his Muslim travel ban to be enforced, even while it's being challenged in lower courts; His new, full-throated endorsement of alleged Republican child molester Roy Moore in next week's U.S. Senate special election against Democrat Doug Jones in Alabama), we're back to the GOP "tax cut" hustle and the Special Counsel investigation of Team Trump.

First, on taxes, details on the thousands of corporate lobbyists (more than 6,000 of them!) who crawled out of the swamp to help write what will be the largest tax increase in U.S. history, as billions, if not trillions in wealth is set to be redistributed from the poor and middle class to the wealthy and already-wildly profitable corporations. The GOP and Donald Trump have been using a dubious list of "economists" to lie about and help jam through their scheme, which was passed by the U.S. Senate just before 2am on Friday night/Saturday morning, just hours after the 500-page final bill had finally been released to Democrats.

Then, we open up the phone lines for callers to answer my question about the alleged Trump/Russia "collusion", following the guilty plea on Friday by Trump's disgraced former National Security Adviser Michael Flynn for lying to the F.B.I.

While Trump's attempted obstruction of that investigation is quite clear (despite his personal lawyers absurd claims), as is the fact that members of his Campaign and Administration lied to federal law enforcement officials, which also unlawful, evidence of the originally alleged "collusion" on the 2016 election remains elusive.

Why all the lying by Team Trump? What are they attempting to hide? As much as I'd be delighted for all of this to bring down a wildly lawless and anti-American Administration, of course, I still remain unclear on what the initial crime actually was, or is even alleged to have been. On today's BradCast, it's a grim day in the U.S.A. And while that's been happening quite a bit lately, today seems particularly dark. [Audio link to show follows below.]

As the GOP's devastating tax cuts increases for millions of low- and middle-income Americans and seniors move forward in the U.S. Senate, Donald Trump, the President of the United States, tweeted out three different anti-Muslim propaganda videos initially posted by a member of a far-right extremist nationalist party in the UK called Britain First. The disturbing postings by the President of what are being described as "ISIS snuff films", drew worldwide statements of condemnation from conservative British Prime Minister Theresa May and many other members of Parliament, as well as Muslim and Jewish groups in the US, academics and more. But, at least one person, in addition to Britain First, thanked Trump for the postings: David Duke, former Grand Wizard of the KKK. We discuss this rather embarrassing and dispiriting moment in American history.

Then, we take a much-needed shower before heading to Charleston, West Virginia, where the (now, ironically named) Environmental Protection Agency is holding its one and only hearing on EPA Chief Scott Pruitt's plan to kill Obama's Clean Power Plan, a landmark measure meant to curb dangerous greenhouse gases that cause global warming.

Environment reporter EMILY ATKIN of New Republic joins us from WV, after spending the past two days at the forum which she describes as a "tragedy" and a "farce", featuring testimony from coal barons like Robert Murray, CEO of the nation's largest private coal company --- who brought his employees in full mining regalia, hard hats and all, to the hearing room --- as well as from environmentalists who were allowed to testify, but were largely relegated to separate rooms entirely.

Atkin discusses what the hearings suggest about the current EPA, which is now doing the bidding of the fossil fuel industry itself, as well as how industry leaders and Republican officials admit that coal has a bleak future --- thanks to cleaner, cheaper natural gas and renewable energy --- even while lying about it to those directly suffering in Coal Country, like miners and their families.

The miners, she tells me, "completely buy into" the industry's "War on Coal" propaganda. "And that was what I think is the tragedy of the whole thing. They accept that there has been decline in the industry. The miners that I spoke to --- and just the average coal supporting people in West Virginia that I spoke to --- completely attribute it to Obama-era regulations, and completely believe what they're being told by coal executives and Republican politicians, that once [the Clean Power Plan] is gone, everything's going to be okay. And their industry is going to thrive again in the way that it used to. ... It's the hypocrisy of these executives and these politicians who go in front of the miners and tell them everything's going to be okay when, in other settings, they well admit that the decline of coal is happening no matter what."

Atkin describes her brief conversation at the hearing with Murray, and how his own employees there contradicted one of his claims. And she explains how, though Pruitt chose to hold the forum in Charleston in order "to hear from those most impacted" by the Clean Power Plan, there are many others, in non-coal states, that are "equally affected", including those "communities that surround emitting coal plants [and] communities that surround coal ash pits that hold coal's toxic waste that can seep into groundwater and into water systems."

"The fence-line communities that live near producing plants, which often are disproportionately low-income and minority communities, those aren't based in West Virginia. And I would argue that they are just as impacted by the Clean Power Plan as a coal miner. And yet, the EPA doesn't have any scheduled public hearings in any of those areas."

Finally, we're joined by Desi Doyen for the latest Green News Report, with some of the most encouraging news of the day, before a bit of breaking news out of the U.N. on Trump's continuing threats of war against North Korea...

Callers ring in on the controversies plaguing AL's U.S. Senate nominee...

On today's BradCast, we were live today on our flagship station in Los Angeles, after the latest round of fund drives at KPFK/Pacific Radio, and had lots to discuss with callers in the wake of the Roy Moore mess and new developments and allegations. [Audio link to show is posted below.]

Another accuser stepped forward on Monday, charging that Alabama's Republican nominee for the U.S. Senate Special Election, sexually assaulted her when she was a minor, while he was serving as District Attorney in the state. And, even prior to today's new allegations, the news for the GOP Senate was becoming increasingly grim by the hour following the Washington Post's explosive exposé of charges by four different women against Moore published late last week.

A new poll shows Moore's Democratic opponent, former U.S. Attorney Doug Jones, is now up over the controversial GOP candidate by 4 points, just weeks before the December 12th election, in the wake of the initial allegations that Moore sexually pursued four teenagers, one as young as 14 years old, in the late 70s and 80s.

Three Republican U.S. Senators rescinded their endorsements for Moore over the weekend and, on Monday, Senate Majority Leader Mitch McConnell called on him to step aside --- without using the "if true" qualification he'd used previously --- saying that he now believed the women who had accused Moore. McConnel also added he is now seeking a write-in candidate willing to run, since it's too late to remove Moore from the ballot. Sen. Cory Gardner (R-CO) head of the Senate Republicans' campaign committee, called on the Senate to expel the controversial far Rightwing "conservative" "Christian" if he wins. But some Republicans are now calling on Alabama's Governor and legislature to cancel the Special Election to fill the seat vacated by Attorney General Jeff Sessions all together. (Good luck in federal court if they decide to take such an unprecedented move to cancel an election, because it looks like they may lose.)

And, of course, all of that was before yet another woman stepped forward on Monday to say that she was "attacked" by Moore as "a child". The new accuser says she feared Moore was going to rape her when she was 16 and she had to physically fight him off in his car, after she'd received a ride home from Moore, a regular patron at the restaurant where she worked as a waitress while he was a prosecutor in his 30s.

Meanwhile, Moore and his wife both claim the charges against him are all part of a "witch hunt" by media, the Republican establishment and the Democratic party and have said they plan to sue the Washington Post which reported the initial allegations last week.

And even some real news about some fake news...

On today's BradCast, our fight against fake news --- and helping the electorate to understand which news is real and which news is fake --- continues! [Audio link to today's real show is posted below.]

Alabama's Republican U.S. Senate nominee Roy Moore continues to deny Thursday's explosive and detailed investigative report from the Washington Post, charging that when the controversial far rightwing religious zealot was a 32-year old Assistant District Attorney he sexually molested a 14-year old girl. She, like three other teens he also is said to have pursued around the same time, have all gone on record, by name, with their claims.

Despite those blockbuster charges detailed by some 30 sources in WaPo's coverage, and (somewhat cowardly) calls from Republican U.S. Senators for Moore to drop out of the upcoming U.S. Senate Special Election against Democratic candidate and former U.S. Attorney Doug Jones on December 12, most GOP officials in the state of Alabama still appear, embarrassingly enough, to support Moore. Some refuse to believe the allegations at all and others don't seem to care, even if the charges are true and amount to a sex crime against a minor. One statewide elected official (AL State Auditor Jim Ziegler) went so far as to cite the bible in support of the alleged pedophilia, and another elected official (AL State Rep. Ed Henry) actually called (twice) for charges to be brought against the victims themselves.

Nonetheless, despite ongoing "conventional wisdom" that a Democrat couldn't possibly win an Alabama U.S. Senate seat, new polling taken the day the story broke shows the race between Moore and Jones is now in a dead heat. And that's data from before, as the pollster notes, the news about Moore "had a chance to fully sink in."

Then, Donald Trump's so-called "Election Integrity" Commission headed up by top GOP "voter fraud" fraudster and KS Sec. of State Kris Kobach continues to face huge problems. After eight lawsuits have previously been filed against the sham commission, on Thursday, a ninth was filed. That one by one of the Democratic Commissioners on the panel itself!

Finally today, a number of totally fake news stories (about Tuesday's election and Hillary Clinton among other things) became popular via social media this week. We debunk several of them with the help of the Associated Press fact-checkers, included several items of fake news about the American economy and trade with Japan that the President of the United States himself spread during his ongoing Asian tour.
