Good news, bad news, news about shamefully misreported news, and something that's as close to "normal" news as we are able to find these days. All on today's BradCast! [Audio link to full show follows this summary.]

THE GOOD NEWS: After two years and countless shameful losses in federal courts --- including twice at the U.S. Supreme Court --- Republican Alabama lawmakers are finally forced to follow the Constitution and Rule of Law by adding a second U.S. House District where Black voters may be able to elect a representative of their own choosing for the first time in state history. (Similar fights continue, however, in other states, such as South Carolina, Texas, Florida...)

THE BAD NEWS: September heat records around the globe were literally off-the-charts. Or, as climate scientist Zeke Hausfather recently described it, "absolutely gobsmackingly bananas". Is last month's alarming spike, completely blowing away some 80 years of temperature anomalies, temporary or here to stay? We discuss.

THE SHAMEFULLY MISREPORTED NEWS: Yes, the Biden Administration will be building some 17 miles of new border wall in the Texas Rio Grande Valley. No, it's not because Biden has "hypocritically reversed" his position on physical barriers or now agrees with Donald Trump (as Fox "News", Trump and too many actual news outlets have also been misleading reporting today). Rather, it is because the Administration is required to do so under the 2019 appropriations bill passed by Congress during the Trump Administration. Yes, the Biden Administration believes they must follow the Rule of Law, whether they agree with it or not. Crazy. The number of media outlets rewriting their originally misleading stories today would be hilarious, had the initial versions of those stories not been so woefully irresponsible.

SOMETHING CLOSE TO 'NORMAL' NEWS: We'll call it "The Old Normal". A U.S. President who is running for re-election next year sits down for a one-on-one interview with an actual journalists and answers many questions. No threats are issued. Nobody is attacked. In fact, no huge news is broken. But the electorate becomes better informed so they can hopefully cast an educated vote next year. We share the bulk of that interview because few others will bother to do so. And, yes, the perfectly reasonable conversation touches on our ongoing threats to democracy in America and around the world, and what can be done about the menace of looming political violence by rightwing MAGA extremists and their authoritarian cult leader. Seems important.

Guest: AZ GOP State Senator and former Sec. of State Ken Bennett...

It will be a landmark moment for election transparency in Arizona, argues the man who has championed the bill for years, as discussed on today's BradCast. Along the way, the longtime, dyed-in-the-wool progressive and non-partisan election transparency advocate has brought key allies on board, including the state's former Republican Secretary of State and its current Democratic Secretary of State. The big question, now that the bill has passed out of the legislature: Will the state's Democratic Governor sign the bill into law? [Audio link to full show follows this summary.]

John Brakey, of the non-partisan election integrity group AUDIT USA in Tucson, has been a guest on this program many times over the years. He is, perhaps, most famous for revealing that the silly CyberNinjas carrying out a so-called audit of the 2020 Presidential election in Maricopa County (Phoenix) in 2021 were searching for bamboo fibers in ballots in hopes of proving China had somehow stolen the election from Donald Trump in the state. (They didn't. The "audit" would prove, in fact, that Joe Biden beat Trump by an even larger margin than originally reported.) After years of reaching out to lawmakers on all sides of the aisle, Brakey's bill to declare digital ballot images as public records available to all was finally adopted by both chambers of the very Republican Arizona state legislature this week.

Sadly, just three Democrats voted in favor of it in the Senate, even though the state party included a call for such a measure in their party platform years ago. But Brakey was finally able to win over enough support to see the bill sent to the Governor's desk this week, with the support of AZ's new Democratic Sec. of State Adrian Fontes and the state's former Republican Sec. of State, now a state Senator and our guest on today's show, KEN BENNETT [pictured above].

Bennett and Brakey worked closely together to oversee the 2020 audit in Maricopa as Bennett served as a liaison to the state Senate.

For those unaware, digital ballot images are created by most scanners that tabulate ballots across the country. They are, essentially, digital photos of the actual paper ballot cast by the voter when it is scanned. The tabulator then uses those images to tally the voter's selections. The newly adopted bill in AZ, HB2560, would make all of those images available to the public almost immediately after elections. If so, anyone would be able, if they wish, to download them, examine and count the ballots to their heart's content.

As Senator Bennett explains today, the bill also mandates the release of the Cast Vote Record (CVR), a spreadsheet version of every ballot cast and the votes on each ballot, allowing the public to match a digital ballot image to its corresponding row in the CVR to make sure the computer tabulators tallied it as cast by the voter.

In addition to the release of those two sets of records, HB2560 also mandates that a list of all registered voters is made available before the election (those are already public records), and a list of those who voted in the election, greatly increasing transparency and critical public oversight of elections.

"Most of the allegations of impropriety or fraud that I and John Brakey and others have had to deal with over the months and years have to do with three major categories," Bennett tells me today. "One: are there unauthorized voters being allowed to vote in the system?" He says that's what the two voter lists will be able to tell us. "Another general aspect of criticism of the elections --- when certain people lose --- is, 'There had to have been unauthorized ballots injected into the system in favor of someone else.' That's addressed by the fact that there should be one ballot image --- no more, no less --- for everyone who voted. If the ballot images can be shown to match the exact number of voters who voted, then that goes away immediately."

"The third general accusation about stolen or fraudulent elections is that there are either mistakes or intentional manipulation of the machines, or something to transfer votes from one person to another. That is addressed by the Cast Vote Record being comparable to each or every ballot image to make sure they were, in fact, added up correctly."

While hand-counting the original article (as opposed to a digital photo of it), may still, ultimately, be the Gold Standard for democracy, this scheme gets us darn close in many ways. And, arguably, it may be even better in some aspects, in that it allows each and every individual in the state to count the ballots for themself if they wish --- at no cost! Brakey hopes to see a similar regime in every state in the country.

Bennett explains why he believes most Dems in the state legislature opposed HB2560, even though Sec. Fontes spoke passionately in favor of the bill during a legislative hearing earlier this year and, as Bennett notes, "this concept was part of the Arizona State Democrat Party state platform in 2012, no less."

"This is not a Republican idea or a Democrat idea," Bennett contends. "This is an election integrity idea that is supported by Republicans, Democrats and Independents." He is disappointed more Dems did not come on board, but offers an explanation for that on today's show, suggesting it was for political reasons, "rather than the legitimacy of the bill itself."

In fact, Jenny Guzman, Program Director at Common Cause of Arizona, has been whipping against the bill in misleading op-eds and emails to members, derisively referring to it as "the Voter Privacy Violation Act" and falsely claiming it will reveal how voters voted. (We reached out to her for an explanation of her somewhat bizarre critique some time ago, but received no response. A very good rebuttal to her claims is posted here.) While Brakey, Bennett and Fontes worked in a bipartisan fashion to modify the bill to answer to any and all concerns, Guzman has continued to mislead the public about it. Bennett politely described "a couple of her critical claims" as "just not true."

"Voting is a sacred and secret process," argues Bennett. "Once we have disassociated the ballots from any particular voter, the counting of our ballots needs to be a very public process, and it needs to be verifiable by the public." He argues this system will help prevent false claims by election deniers like Kari Lake, 2022's failed GOP candidate for Governor. "When that visual proof is verifiable --- by candidates, by regular citizens, by the media, by universities, by election scrutineers like John Brakey's AUDIT USA group down in Tucson --- all of that can and will be verified."

So, will the state's Democratic Governor Katie Hobbs now sign the bill into law? That is unknown, though Bennett believes "we've got a good chance" given her familiarity with the systems and issues at hand as the state's previous Secretary of State before becoming Governor this year. We'll find out within days. Bennett urges voters, both in AZ and elsewhere, to contact the Governor and let her know your feelings about HB2560 to Engage@AZ.gov or via the Governor's website.

DeSantis' shameful 'voter fraud' round-up; Blistering progressive midterm ads; Disastrous 'conservative' fiscal leadership in U.K., U.S.; Good CO2 emissions news (mostly); Rubio bombs in FL debate with Demings...

It's a grab bag on today's BradCast, as we cover a ton of stuff from around the world and here at home, just over two weeks before another critical Election Day. [Audio link to today's show follows below.]

Among our many stories covered today...

  • With one disgraced, failed Conservative Party Prime Minister after another in Britain since they fell for that whole rightwing BREXIT scam, perhaps the good citizens of the UK might want to consider leadership from amongst the liberal Labour Party instead? Just a thought, but surely they couldn't perform any worse than the Torries, could they Lizz Truss, the third Tory PM to resign amid financial chaos and disgrace in as many years (she lasted just 44 days!) exited stage right today as the financial markets look to downgrade the the UK's credit rating amid continuing fiscal havoc and political uncertainty.

    It's all "self-immolation" and it echoes financial and political chaos repeatedly sown by our own "conservative" party here in the U.S. And yet, for some reason, a majority of the American public reportedly remain disinformed enough to believe, somehow, that Republicans are better on economic issues than Democrats. It's yet another sign of a failed corporate U.S. media, frankly. More thoughts and details in today's actual show, of course.

  • There was better than expected news on global CO2 emissions this week! Despite a temporary return to coal, oil and gas by some in the EU in response to Russia's horrific war on Ukraine, the growth in fossil fuel emissions this year is far lower than previously predicted. This year, according to a new report from the International Energy Agency (IEA), growth in emissions from fossil fuels was just 300 million metric tons, compared to nearly 2 billion tons last year. New renewable energy coming on line from wind and solar and other sources of clean energy, along with the world's move to Electric Vehicles, is helping to counter a temporary return to fossil fuels in some parts of the world. Much of this is attributed to the acceleration of major clean energy policy plans around the world, some in response to Russia's war, but also to nations' effort to meet goals of the Paris Climate Agreement. That would include efforts here at home by Democrats and President Biden who enacted the world's largest single investment in climate --- nearly $400 billion --- in the Inflation Reduction Act, adopted without one Republican vote.
  • With just over two weeks until the critical midterm elections with so much on the ballot, from democracy itself to all manner of Constitutional rights and freedoms, Democrats, progressives and other anti-authoritarians are pushing hard to win over voters. VoteVets, the nation's largest progressive veterans support group, released a blistering ad this week targeting Wisconsin's Republican Senator and insurrection enthusiast Ron Johnson, as a "traitor". And California's Rep. Eric Swalwell released a bone-chilling ad illustrating a dystopian future where police are knocking on doors to round women who've had an illegal abortion.
  • Swalwell's fictional ad is hauntingly echoed by actual video footage obtained and published this week by the Tampa Bay Times in Florida, revealing law enforcement officials rounding up and arresting residents for what even the confused officers describe as "some sort of voter fraud thing". In August, GOP Governor and Presidential hopeful Ron DeSantis --- who is on this year's ballot against Democrat and former Gov. Charlie Crist --- held a dramatic news conference announcing 20 arrests by his new "Office of Election Crimes and Security". As we have since learned, those arrested were former felons who believed their voting rights had been restored after the landslide 65 to 35% passage of a statewide ballot initiative in 2018. But, the initiative had a few exceptions that the former felons weren't told about when they registered and when those registrations were approved by DeSantis' own State Department.

    “Voter fraud?," said one perplexed man as he was told he was being hauled off to jail for voting illegally years earlier. "Y’all said anybody with a felony could vote, man." Other arrestees, nabbed out of the blue at their homes just hours before DeSantis' news conference, were similarly stunned. Local law enforcement officials participating in the arrests also seemed unable to explain exactly why any of this was happening. The majority of the arrestees, according to the paper, were black and/or Democrats, "a throwback to the worst images of the Jim Crow South and a preview of a dystopian future under GOP authoritarianism," writes the Philly Inquirer's Will Bunch today.

    Yes, the authoritarian dystopian future envisioned by Swalwell's fictional video of cops rounding up a woman who had an abortion is shockingly similar to the videos published this week by Tampa Bay Times.

  • Speaking of Florida and dystopia, GOP Sen. Marco Rubio and his Democratic challenger for reelection, Rep. Val Demings, squared off in a debate this week. Among the embarrassing moments for the two-term Republican Senator: his claim that absentee ballot drop-boxes shouldn't be used because someone could "put some explosives in it and blow it up and burn all of those ballots' and his explanation for why he previously claimed, after the 2018 Parkland high school massacre that killed 17, to support a ban on the sale of semi-automatic assault weapons to those under the age of 21 --- but he no longer does. "You've done nothing, nothing to help address gun violence," charged Demings, the former Police Chief of Orland in response. "How long will you watch people being gunned down in first grade, fourth grade, high school, college, church, synagogue, a grocery store, a movie theater, a mall and a night club and do nothing?!”

UT's Sen. Lee in dead heat; Biden Admin begins student loan forgiveness; Biden vows to codify 'Roe' if Dems hold House, increase Senate majority; Also: Trump/Barr's dumb Special Counsel Durham loses another case...

Democratic voters, it seems, are an easily spooked bunch. A few bad polls and some seem ready to all but throw in the towel on the November midterms. But now is not the time for that sort of thinking. As discussed on today's BradCast, there is simply too much at stake this year --- Constitutional freedoms, democracy itself, survival on Planet Earth, just to name a few --- to get sidetracked by despair. To paraphrase Obama, don't boo-hoo! Vote! (And make sure everyone else you know does the same!) [Audio link to full show follows this summary.]

It was always gonna be an uphill fight this year. It still is. But it makes no sense to wallow. It does make sense to get to work. As President Biden correctly noted this afternoon, "Today we face an inflection point, one of those moments that only come around every several generations where there's so much change happening --- technologically, politically, and socially --- that the decisions we make now are going to determine the future of our nation and the future of your generation for the next 30 or more years."

With all of that in mind, these are among the stories covered on today's program...

  • Breaking just before airtime: Special Counsel John Durham --- tapped by Donald Trump and Bill Barr to investigate the investigators who investigated Russia's interference in the 2016 election --- is now 0 for 2 in Court. Igor Danchenko, said to have been a primary source for the so-called "Steel dossier", was charged in Durham's probe with five counts of lying to the FBI. He was acquitted today by a jury on all charges. He was the second to be indicted by Durham and then fully exonerated at trial. Even more humiliating for Durham: he personally handled most of the argument and questioning in court and reportedly ended up being rebuffed by his own witnesses who provided support for the defense. Worse, Danchenko, a Russian citizen living in the U.S., was reportedly "a treasured FBI informant" whose indictment "hurt U.S. national security."
  • Last week we detailed the five U.S. Senate seats that could plausibly be flipped this year from Republican to Democratic (in PA, OH, WI, NC and FL) and the two Democratic seats that could plausibly be won by Republicans (in NV and GA). At the end of yesterday's show, however, we added another to the Plausible Red to Blue list when the "gold standard" Des Moines Register poll over the weekend found Iowa's 89-year old, 7-term Republican Senator Chuck Grassley to be just three points ahead of his Democratic challenger Mike Franken. Today, there's yet another Republican Senate seat said to be in jeopardy --- in deep red Utah of all places! According to two different polls, independent candidate Evan McMullin is said to be in a dead heat with GOP Senator Presidential election theft enthusiast and not Trump "bootlicker" Mike Lee. On Monday, the two sparred in their only debate. It didn't go all that well for Lee.
  • On Monday, the Biden Administration opened its student loan forgiveness program at StudentAid.gov. The process has reportedly already served some 12 million applicants who may be forgiven for as much as $20,000 in debt. The process to apply reportedly takes no more than five minutes. All that is needed is a name, birthdate and social security number. The government will supposedly take care of the rest. At the same time, Republicans are suing to block Biden's program, created via Executive Order. But if they believe it's truly illegal, as Slate's Mark Joseph Stern observes today, they should introduce a bill to force those who received debt forgiveness to pay the money back. Do you think Republicans will do so?
  • On Tuesday, President Biden spoke at a DNC event and vowed to codify the Constitutional rights and freedoms previously guaranteed by Roe v. Wade into federal law as his first order of business in January, after our corrupt, stolen and packed Republican Supreme Court majority took privacy rights and reproductive freedoms away from Americans last June. We share Biden's remarks today. But, in order to enact those protections, as he points out, Dems will need to hold their House majority and pick up at least two more Democratic Senators willing to reform the undemocratic Senate filibuster rule in November. If that happens, not only can abortion and privacy rights be protected by federal law, but voting rights can be expanded and protected, and the corrupt Supreme Court itself can be expanded and un-corrupted. But, again, if that's what you'd like to see, you better to get to work between now and November 8!

Among the stories covered on today's program...

  • Despite a bizarre, very much Nazi-like rally in Ohio held by our former President over the weekend, mainstream corporate media are still pulling their punches in calling out the Republican Party for having gone full bore authoritarian at this point under their far-right MAGA cult leader Donald Trump. Democracy itself is now very much at stake in this nation, and we really need a professional media corps which isn't afraid to start acting like it, calling it out, and reporting it to the American people.
  • While the death and funeral of Queen Elizabeth in Great Britain has received virtual wall-to-wall coverage from outlets such as CNN since her death 11 days ago, three major climate change-fueled hurricanes made landfall over the weekend. Puerto Rico had its power knocked out island-wide by Hurricane Fiona (almost 5 years to the day since Hurricane Maria did the same), with as much as 30 inches of rain falling catastrophically in some areas. In Alaska, remnants of Typhoon Merbok resulted in the state's most intense storm in 50 years, leading to widespread flooding across a thousand miles of coastline. And, in Japan, over the same weekend, Supertyphoon Nanmadol resulted in widespread flooding and power outages, while clocking in as the fourth most intense typhoon to make landfall in the nation's history. As Desi Doyen reports today, all of those storms were super-charged by our warming climate and all seemingly quite newsworthy. Then again, Queen Elizabeth died 11 days ago, so...ya know.
  • As you have heard by now, Ron DeSantis, Florida's ambitious Republican Governor, has taken credit for coercing 48 migrants from Venezuela, who were lawfully seeking asylum in San Antonio, Texas, onto to two chartered private jets to Martha's Vineyard, Massachusetts. Neither the people of Martha's Vineyard, nor even the state's Republican Governor, were notified in advance before the migrants were left stranded. While DeSantis claims the migrants boarded the planes "voluntarily", a brochure, obtained by Popular Information today, citing "Massachusetts Refugee Benefits," appears to have falsely informed the migrants that they would be eligible for "8 months cash assistance," "assistance with housing," "food," "clothing," "transportation to job interviews," "job training," "job placement," "registering children for school," "assistance applying for Social Security cards," and more in MA. That brochure, according to attorneys for 30 of the 48 migrants, is now evidence of a crime --- specifically, as former life-long Republican attorney Keith Barber describes, the federal crime of kidnapping (18 U.S.C. § 1201).
  • So, what will or should be done about DeSantis' apparent political stunt that actually appears to have been a pretty straightforward federal crime? Will he be held accountable by MA's Democratic Attorney General or by the U.S. Dept. of Justice? Callers ring in with their thoughts (several of whom, by the way, support DeSantis' crime!), on today's very lively program!...

Tiny Delaware's huge mistake; Graham's nationwide abortion ban bill; Also: Franken on the illegitimacy of our U.S. Supreme Court...

The three states carrying out the final midterm primary elections of the year on Tuesday offer a great side-by-side comparison of voting systems on today's BradCast, from the very best to the very worst in the nation. Also, Sen. Lindsey Graham offers an example of the GOP's very worst politics, even as it is likely to work out for the very best for Democrats. [Audio link to full show is posted below this summary.]

Among the stories covered on today's program...

  • Why Delaware's so-called "hybrid" Ballot Marking Device (BMD) system made by ES&S and forced on all voters in the state at the polls, places the tiny state in contention for having the very worst voting systems in the country. You'd think they would realize that a 100% unverifiable touchscreen system that prints voters' selections on a paper ballot for them is already a terrible idea. But one that allows the computer to secretly reprint a voter's ballot --- allowing it to add, change or delete votes --- after voters think they've already approved their computer-marked ballot, is unspeakable stupid. That said, the system's "Permission to Cheat" feature is arguably even worse.
  • Contrast DE's voting system with New Hampshire and Rhode Island's fully verifiable hand-marked paper ballot system. They, along with DE are also holding primaries today. But in about 40% of NH towns, they go even further in respecting voters by hand-counting all hand-marked paper ballots at the polling place, in public, as soon as polls close and before ballots are moved anywhere. That would be Democracy's Gold Standard. RI, in the meantime, tallies all ballots by computer, but at least (unlike in DE), they're hand-marked ballots, so can be known to reflect the intent of the voters. Well, most of them, anyway. As discovered during the early voting period in four towns, candidates from 2018 appeared on the 2022 touchscreen ballots for some voters who chose to use the state's new BMD systems, made available at the polls for optional use by disabled voters.
  • Next, a follow-up to our conversation last week with Marilyn Marks, Executive Director of the Coalition for Good Governance, which is suing Georgia and its Sec. of State Brad Raffensperger, hoping to ban the state's 100% unverifiable touchscreen BMD voting systems in favor of hand-marked paper ballots. Marks was on the show to discuss the security camera surveillance video she unearthed in her federal lawsuit last week, revealing a bunch of Team Trump MAGA Republicans being allowed in to the Coffee County, GA election office last year to unlawfully breach the state's Election Management System software made by Dominion. The breach, as we discussed, was covered-up by Raffensperger, even though the Trumpers copied, stole and shared the critical software with others. That makes the 2022 and 2024 elections in the state (and elsewhere, where the same systems are used) uniquely vulnerable to malware and manipulation, given that Coffee County's system is connected to the state system, which programs all of the identical systems that Raffensperger forces every county in the state to use.

    Shortly after Marks' appearance on the show last week, a hearing was held in her federal lawsuit, and the judge inquired as to how the Coffee County breach relates to the plaintiffs' complaint. One of their attorneys, David Cross, gave a brilliant explanation in response (see transcript here, beginning on page 4), ending his remarks on the matter with a fantastic metaphor: "If we're going on a skydiving trip and we saw a bunch of bad actors unpack our parachutes, take them all apart, and then repack them and put them back and we learned that when we were on an airplane and if the pilot said to you, it is probably fine, your parachute is probably fine, just go ahead and jump and we'll find out when you're in the air, no one would jump out of that plane.

    "That is where we are," Cross added. "It is not an exaggeration. We have lots of people who are widely considered bad actors because of the lies that they spread about the 2020 election who had unmitigated access to the election system --- not pieces, not disconnected pieces --- the actual system in practice for the better part of two weeks. And we don't know what all they did. But we do know what they could have done. And it is not satisfactory to tell voters, 'Let's just hope the system works, and we have begun an investigation in the last couple of weeks, let's hope that that doesn't find that the system doesn't work.' That, Your Honor, we don't think is an appropriate way to proceed. And that is why this is so critically important for our claims."

  • In what ought to win an award for worst, most tin-ear politics of the century, so far, Sen. Lindsey Graham (R-SC) introduced a bill today to ban abortion after 15 weeks of pregnancy in all 50 states. States that wish to go further, however, by banning abortions all together, are more than welcome to do so under his nationwide bill. So, this measure --- deceptively being sold by Graham as a "late-term" abortion --- would largely only affect "blue" states where privacy rights and reproductive freedoms are still respected. The bill, which Graham's own Republican Party is already furious about, comes after the GOP's corrupted, stolen and packed (with Graham's help) U.S. Supreme Court overturned Roe v. Wade in June and just weeks after Graham previously said he believes "states should decide the issue of abortion." Turns out that was just another pathetic lie from one of the nation's most pathetic U.S. Senators.
  • Speaking of the corrupted U.S. Supreme Court (and tin-ears), Chief Justice John Roberts offered his first public remarks last Friday since his Court overturned Roe. He blasted those who question the legitimacy of the Court because they disagree with its decisions. "Simply because people disagree with an opinion is not a basis for criticizing the legitimacy of the Court," the Chief Justice said, completely missing the point. Over the weekend, the much-missed former Sen. Al Franken (D-MN) appeared on CNN to debate Roberts' remarks with GOP strategist April Stewart. As you'll hear, it did not go well for Stewart.
