As noted at the top of today's BradCast, it's worth buckling up before listening. [Audio link to show follows below.]

We begin, gently enough, with the news of California's Supreme Court temporarily nixing a billionaire's statewide initiative from this November's ballot which, if adopted, would split the state into three. We explain why the Court removed the measure, for now, thanks to a challenge by an environmental group.

Then, with Donald Trump's own Director of National Intelligence, Dan Coats, warning this past week that "the system is blinking red" in a way that hasn't been seen since just before the 9/11 attacks, the multiple and ever-changing positions by the President of the United States in recent days, regarding whether Russia interfered in the 2016 election and is actively doing so in advance of the 2018 midterms, is all the more head-spinning. Coats was referencing warning signs being reported by U.S. intelligence agencies regarding ongoing attacks and intrusions on America's critical infrastructure --- including our wildly vulnerable electoral systems.

Moreover, new reporting on Trump being read into explicit source details weeks before he was inaugurated in early 2017 regarding Russia's alleged 2016 election intrusion measures, make his ongoing denials, ever-changing positions, and dizzying White House spin to explain them all following Monday's summit with Putin in Helsinki, all the more bewildering. Nonetheless, his own intelligence apparatus and appointees continue to contradict the President, even as the GOP-controlled Congress fails to take any substantive action to either place a check on Trump or even to help protect this November's crucial elections.

At the same time, after the FBI informed Maryland just days ago that its entire election system was being hosted on a private commercial server said to be owned by a Russian oligarch tied to Putin (as discussed in detail on yesterday's BradCast), we learn this week that the top U.S. election system vendor, ES&S, has been lying about remote access software and modems installed, for many years, on systems still used by a majority of U.S. voters.

The new revelations may help explain an exclusive special report published by The BRAD BLOG back in 2011, with an officially-commissioned independent analysis finding that, among other concerns, Venango County, Pennsylvania's ES&S election management system had been accessed by an unknown and unauthorized computer for "several hours" from a remote location. As we reported at the time, ES&S and the County's Board of Commissioners went to considerable lengths, after those revelations, to block a further, independent forensic analysis of the system.

And now, perhaps, we may know why. Kim Zetter reports this week at Vice's Motherboard that the company lied to her and New York Times' fact-checkers earlier this year in advance of her February article at the paper on the inclusion of modems and pcAnywhere remote access software included with the election management systems sold to customers from 2000 to 2006. After previously insisting the company had no "knowledge that our voting systems have ever been sold with remote-access software", ES&S reversed itself in a letter to U.S. Senator Ron Wyden, she reports. But they have refused to respond to the Senator's subsequent follow-up queries or to appear at recent Senate hearings on U.S. election system vulnerabilities.

As Zetter details, pcAnywhere was found to include multiple and serious vulnerabilities over the years, which would have allowed unauthorized intruders to change election results with little chance of detection. Moreover, she explains, many questions remain about why ES&S lied, which jurisdictions around the nation may still feature the same, easily-exploitable flaws, and about electronic voting and tabulation systems manufactured by the nation's other top vendors, believed by expert to likely have included similar remote-access vulnerabilities.

On today's BradCast: Trump gets even uglier as he's forced to back down on his lies about his immigration policies. A few election results out of D.C. and Arkansas. And some thoughts for progressive voters as we barrel towards this November's crucial midterms. [Audio link to show posted below.]

First up: A quick round-up of results and problem reports following primary elections on Tuesday in Washington D.C. (where voters adopted a $15 minimum wage measure for those in the service industry, despite a cynically and wildly misleading "Save Our Tips" campaign funded by the restaurant industry in opposition to Initiative 77) and in Arkansas (where runoffs were held following primaries and a computer tabulation "fiasco" late last month on 100% unverifiable touchscreen voting systems made by ES&S.)

Next: After repeatedly claiming he didn't have the legally authority to keep parents and children together after they were arrested crossing the border, Donald Trump buckled under growing political pressure and signed an executive order on Wednesday to allow parents and children to stay together after being arrested crossing the border.

Many questions (and legal challenges) lie ahead regarding the new policy and what will now happen to those 2,300 children ripped from their parents over the past month following the Administration's chaotic and ill-considered "zero tolerance" policy at the southern border.

We cover a number of related stories to all of that today, as well as some response to our coverage of the issue over the past week. That response includes a bit of a rant in return, regarding the necessity of voting for Democrats this November --- good ones or bad ones --- in service of putting some brakes on the disastrous cruelty and incompetence of Trump/GOP rule in D.C. (Or, for those who prefer the chaos and cruelty of the Trump Administration, and there are many who do, the option to vote for Republicans or stay home entirely in support of still more of it.)

I've got a bit of a rant today (and so does Desi) on the incredibly lazy argument, still heard from some progressives --- even after all that we've seen in the Trump Era --- that "both sides are the same". We've got a few words for those who forward arguments which support that notion, which serves only to perpetuate the worst of the Trump/GOP's inhumane and horrifically destructive policies.

Finally: As a reminder what can happen in a mostly normal, progressive country, Canada, on Tuesday night, ended 90 years of failed prohibition policy, by approving the sale and use of recreational marijuana across the entire country...

On today's BradCast: More disappointing (if not deadly) rulings on voting rights were released on Monday from the U.S. Supreme Court, and callers ring in on the growing outrage of the last few days, thanks to the parent/child separation of Donald Trump's "zero tolerance" policy at the border.

First up today, two long-awaited rulings from the U.S. Supreme Court on partisan gerrymandering were finally handed down on Monday. In both cases, as our guest today, FairVote's DAVID DALEY details, the Court decided to essentially punt the cases back down to lower courts.

Daley, author of RATF**KED: The True Story Behind the Secret Plan to Steal America's Democracy, which details the GOP scheme to implement extreme partisan redistricting following the 2010 census, explains that Wisconsin Republicans will be allowed to keep their wildly unfair state assembly districts for yet another election, and that, in Maryland, where Democrats admit to having gerrymandered a U.S. House district to their own advantage, that gerrymandered district will also stay in place, almost a full decade after being implemented. That, despite lower courts finding those districts to be unlawful and unconstitutional, and other pending cases --- such as the federal court which found all of the U.S. House districts in North Carolina to have been unlawfully gerrymandered by Republicans --- still on hold and awaiting a hearing at SCOTUS.

"That's what's so frustrating and sad about today," Daley tells me. "They had a buffet of statistical standards and evidence that all pointed in the same direction and that revealed exactly what had happened here, and, instead, they ducked." He explains the basis on which the Court punted in both cases and how "Republicans have essentially been able to run out the clock to steal, in some ways, the entire decade of power, especially in state legislatures around the country."

While the "silver lining" on this today is that the Court did not declare, as some had feared, that it was up to legislatures, not courts, to fix the problem that legislatures themselves created, Daley argues that this was a missed opportunity. The Court's swing-vote, Justice Anthony Kennedy, has long suggested he'd be open to finding partisan gerrymandering unconstitutional once and for all. But, once again, in both of today's cases, he ducked. That means --- should the 81-year old Justice (or any of the others) leave the Court before another case comes up to offer a definitive ruling --- things could become much worse, for generations, if Trump is allowed to appoint a replacement.

Then, as even some Republicans (a precious few) begin to finally turn against the Trump Administration's grotesque and inhumane new policy which separates children from their parents after they are detained crossing the southern border with Mexico --- resulting in thousands of kids being locked away in detention centers in just the past few weeks --- how long can Trump continue to falsely blame the Democrats for his own Dept. of Justice's new "zero tolerance" policy?

Trump and his department chiefs continue to double down on his false claim, despite the growing outrage from Americans after disturbing stories, pictures, and sounds of abuse continue to be reported out of these detention centers around the country, with media finally gaining very limited access to them.

We open the phone lines today to callers on all of those issues, as the chilling rise of Trump's GOP-approved authoritarianism in the U.S. continues to stun the nation and the world...

On today's BradCast: The immigration horror stories of children being ripped from their parents and of asylum seekers fleeing domestic abuse in their home countries are beginning to pour in. We speak today to a longtime immigration attorney at the center of a number of landmark rulings, who is now representing the woman from El Salvador whose grant of asylum was unilaterally overturned this week by Attorney General Jeff Sessions. [Link to audio of the show is posted below.]

There are now more than 11,000 children who have been separated from their parents at the southern border being held in detention centers across the country by the U.S. Government. It's unclear whether that number includes the 2,000 kids taken from their parents over a recent six week period, as reported by AP today, under the Trump Administration's new "zero tolerance" policy, which requires criminal, rather than civil, prosecution against those who cross the border unlawfully.

This week, some members of the media finally received a limited first look inside one of the largest such detention centers --- a converted Walmart superstore in Brownsville, TX --- where some 1,500 boys, aged 10 to 17, are being warehoused. They are living five in each room built for four people, are forced to stay inside for 22 hours a day, and are being held, on average, for about 50 days each in the facility, before they are either sent to foster care or reunited with their parents (if those parents can find them within the government system.)

Media reports this week include horrific stories of babies being ripped from their mothers' arms while breastfeeding and parents being told that officials are simply taking their children to bathe them, before they are shipped away to a detention facility. Somehow, Donald Trump and his White House are managing to blame all of this on Democrats, and Attorney General Jeff Sessions is justifying these new Dept. of Justice policies by quoting the bible. We cover some of those nightmarish stories, reports that an outdoor tent city, in sweltering southwest TX near El Paso, is being planned to store more than 400 more children --- who are now being separated from their parents at an alarming rate --- and a confrontation between reporters and Press Secretary Sarah Huckabee Sanders over these matters during a briefing on Thursday.

In a separate, if related issue earlier in the week, Sessions issued a decision, attempting to change decades of U.S. immigration policy regarding asylum claims by immigrants fleeing their home countries on the basis of domestic abuse and gang violence.

We're joined today by KAREN MUSALO, Professor of Law and the Director of the Center for Gender & Refugee Studies at the University of California Hastings College of Law to discuss the Administration's new policy. Musalo represents "A.B.", the El Salvadoran woman whose grant of asylum by the U.S. Immigration Board of Appeals was unilaterally overturned by Sessions on Monday, along with his announcement of the Administration's cruel new policy which declares that domestic abuse will no longer be an allowable basis for asylum seekers.

The longtime immigration rights attorney pushes back today, detailing the disturbing circumstances under which her client, Ms. A.B., fled her home country, explaining several poorly understood aspects of the U.S. Immigration Court system (which is part of the Dept. of Justice, not the federal Judicial branch --- so, judges work for Sessions), and stressing that the Attorney General is misinforming the public by claiming that asylum seekers fleeing domestic violence will no longer be allowed in the country.

"Clearly what the Attorney General is trying to do with issuing this decision is to send a strong message that cases of women fleeing domestic violence or people fleeing gang violence are not legitimate asylum claims," Musalo tells me. "But for those of us who are experts and understand the law, and read his decision closely --- he may want to send that message, and he did in fact reverse a 2014 precedent that clearly stated that survivors of domestic violence were eligible for asylum --- but there's a whole framework of law that has developed in the 38 years since the 1980 Refugee Act was enacted."

She says: "The reason I'm underscoring that point is that I think he's going to try to bully judges and asylum officers into thinking this is the law, there's no way around it, they should deny these cases --- and also, making lawyers think they shouldn't bring cases on behalf of their clients. So I feel it's very important to point out this is what he's trying to do, but that's not how the law is properly interpreted."

Musalo also stresses that, despite reports of an increase in those seeking asylum from Central America due to domestic abuse since the 2014 change in policy, "The number of claims have not skyrocketed as a result of the Obama Administration recognizing domestic violence as a basis of protection. That's simply not true."

"This has really made people rise up and say, "How can it be in the year 2018 that we have an Attorney General who says that you can send a woman to her death, back to a country where the police and the courts just sit by?," Musalo notes, citing Central American countries like El Salvador, Guatemala and Honduras with the "highest homicide rates in the world [and] the highest femicide rates in the world, denoting gender-motivated killings."

Finally today, Stephen Colbert, just before Father's Day, had a few thoughts of his own on CBS' Late Show in response to Sessions' use of a bible passage to justify the Administration's cruel and alarming new policy of separating children from their parents at the border. On today's BradCast: A host of important and troubling news items that you're probably not hearing much about as the corporate media continue their seemingly non-stop focus on investigations into massive Trump corruption. [Audio link to show follows below.]

First, a disturbing move by the Environmental Protection Agency on Tuesday suggests a very dark moment for American democracy as reporters from AP, CNN and elsewhere were blocked from attending a water contamination event held EPA Administrator Scott Pruitt. One AP journalist is said to have been "forcibly removed" from the building. That, just about one week after reports that the Trump Administration is blocking the publication of a major new report finding widespread water contamination across the country. That study is reportedly being withheld because the Administration believes it would be a "public relations nightmare" for the chemical companies involved, if it was released.

Meanwhile, a federal court on Monday found Texas in violation of both the U.S. Constitution and the National Voter Registration Act (NVRA) for refusing to allow residents who update their drivers license online to register to vote at the same time, as required by the 1993 law. The Republican-controlled state appealed the ruling to the rightwing U.S. 5th Circuit Court of Appeals just minutes after it was issued by the U.S. District Court judge, all but assuring the case, originally filed in 2016, will continue beyond this November's mid-terms.

And, speaking of Republicans who don't want certain people to vote, in Florida, John Ward, a GOP candidate for the U.S. House, was caught on videotape arguing that U.S. citizens from Puerto Rico who moved to the Sunshine State following the devastation of Hurricanes Maria and Irma last year, should not be allowed to register to vote in Florida and should go back "where they belong".

Next, we're joined by Slate's fantastic legal reporter MARK JOSEPH STERN to offer clarity on two disturbing, and very important cases this week.

The first is the story of a 24-year old DACA recipient from Seattle who was brought here by his father when he was five years old and detained by the Immigration and Customs Enforcement (ICE) agency last year just after Trump took office. Daniel Ramirez Medina, a "Dreamer" with no criminal record, legally working in the U.S. after twice receiving protected status under the Deferred Action for Childhood Arrivals (DACA) program, was arrested by ICE in February of 2017 when they went to his house to detain his father. ICE subsequently booked Ramirez, lied about him --- blatantly doctoring a document to make it appear Ramirez admitted to being a member of a non-existent gang (he never was) --- in order to remove his protection and begin deportation proceedings.

Last week, U.S. District Judge Ricardo S. Martinez, a George W. Bush appointee, found that ICE repeatedly lied about Ramirez and to the court about their evidence against him. "Judge Martinez is no flaming liberal, but he looked at the evidence before him, and he was clearly disgusted and incensed by what the agency had done," says Stern.

He describes how Ramirez was saved, for now, only due to his protected status under the Obama-era DACA program, which Trump continues to try to kill. "The only reason that this story rose to the top, and that it actually got before a federal judge who could rule on it, is because this guy is lucky enough to have DACA status. So he had this extra layer of protection that most undocumented immigrants don't have." Unfortunately, the dishonest tactics ICE attempted to use against Ramirez are usually successful, Stern says, explaining, "ICE agents do this all the time".

Then, we turn to an outrageous 5 to 4 decision by the stolen, rightwing U.S. Supreme Court this week that demolished the clear, statutory right established by decades-old New Deal-era labor reforms, allowing employees to file collective class-action lawsuits against their employers for wage theft.

As Stern explains, Monday's hypocritical and legally erroneous majority opinion in Epic Systems v. Lewis [PDF], written by the corrupt, self-proclaimed "textualist" Justice Neil Gorsuch (who occupies the seat stolen for him by the GOP Senate after Antonin Scalia's death in early 2016), was blasted by a furious Justice Ruth Bader Ginsburg in her minority opinion, as the ruling, according to Stern, "effectively legalizes low-level wage theft" and is "nothing less than catastrophic for workers across the country."

It's really even worse than you may have heard --- if you even heard anything about it. But, Sterns adds with a glimmer of hope, the law in question that was blatantly misinterpreted by Gorsuch's judicial activism could very easily be amended for clarity in order to reverse this SCOTUS decision. The fix, however, would likely require a Democratic Congress and a cooperative President.

On today's BradCast: We have a lot to catch up from over the weekend, and callers with lots of opinions to go with it. [Audio link to show follows below.]

But, first up today, both a Republican federal court panel and the U.S. Supreme Court both rejected Pennsylvania Republican lawmaker's last ditch attempt to block a new U.S. House map forced upon them by the state Supreme Court in February after the previous map enacted in 2011 was determined to be an unlawful partisan gerrymander in violation of the state's Constitution. Those were the last chances for the state GOP to restore the unlawful maps --- which had given them a 13 to 5 advantage in U.S. House seats over the past three elections --- before the candidate filing deadline for the 2018 primary elections in the largely 50/50 swing-state.

At the same time, voters head to the polls in Illinois on Tuesday for the second primary of the crucial 2018 mid-terms. Among the contested races is a primary challenge by progressive Marie Newman to longtime, very right-wing Democratic Rep. Dan Lipinski in IL's 3rd Congressional district. The race is said to be statistically tied, as Lipinski fights for his political life, and as the winner of Tuesday's primary in the very "blue" area of Chicago will likely go on to win in November, since the GOP, literally, has only a proud neo-Nazi running on the ballot for the Republican nomination.

But concerns about Illinois' computerized voting, tabulation and registration system continue to haunt officials and undermine democracy and voter confidence --- justifiably. The state's voter registration system was breached during the 2016 election, and remains wildly vulnerable along with the state's voting and tabulation systems. Despite purported concerns of "Russian interference", little has changed in any of our nation's easily hacked, oft-failed electoral systems following the 2016 election.

Then: On last Friday's show, we noted that nobody in the Trump Admin had yet been fired that day. But, shortly after airtime, FBI Deputy Director and former Acting Director Andrew McCabe was fired just two days shy of receiving his lifetime pension after 21 years of service to the Bureau.

We discuss the reasons he was said to have been fired and the fact that Attorney General Jeff Sessions (who officially fired him) was supposed to have recused himself from the matter. Nonetheless, Donald Trump rejoiced at the news via Twitter --- since McCabe is a witness against Trump's apparent attempted obstruction of justice in the firing of FBI Director James Comey --- before turning his wrath back against Comey and, for the first time on Twitter, Special Counsel Robert Mueller.

Is a newly emboldened Trump preparing again to fire Mueller? If he does, will Congressional Republicans do anything to block him? And what, for that matter, will the American people do --- if anything --- in response to what many (over-confidently) believe would be a Constitutional crisis? On today's BradCast: Why in the world did 16 U.S. Senate Democrats vote in favor of gutting central provisions of the Dodd-Frank banking reform bill, as originally put in place by Congress after the 2008 global financial meltdown to avoid another such catastrophe? Ironically enough, the new bank deregulation bill was passed on Wednesday with the votes of those Democrats and all of the Senate Republicans on the tenth anniversary of the 2008 collapse. We're joined today by the U.S. Senate Banking Committee's former chief investigator, BARTLETT NAYLOR, who is now Financial Policy Advocate for Public Citizen's Congress Watch division. He explains what this bill will do and how it allows for the same type of dangerous speculation by big Wall Street banks that led to the Great Recession ten years ago.

Naylor says the bill is "going to take the guardrails down" for banks that have less than $250 billion in assets. "This is a class of banks that collectively took some $50 billion of bailout money. A dozen of them have engaged in misconduct and have been sanctioned by regulators int he last three or four years. This class would have included Countrywide, [which] made so many bad loans that it toxified the entire industry. By taking their eyes off this class, it invites another financial calamity."

He also offers his thoughts as to why it is that those 16 Democrats appear so willing to do the bidding of the Big Bank lobby, even as many other Democrats, led by Senators Elizabeth Warren of MA and Sherrod Brown of OH, strongly opposed the measure. "I suspect it's about campaign contributions, but I don't know why any Senator who is up for re-election wants to tell his or her constituents that they're trying to help the banks," Naylor tells me. "They're not trying to help consumers, they're trying to help the banks."

"Labor unions, faith groups, civil rights groups, consumer advocacy groups such as ours," all oppose the bill. "The only people that are supporting this bill are bankers," he argues. Naylor says it could still be stopped before final passage while it is being reconciled with an even more draconian U.S. House version. Donald Trump campaigned on gutting the protections of the Dodd-Frank law, whose provisions remain very popular among voters, adding still more questions as to why those Dems are going along with it, even in an election year.

All of that comes as Trump confirms his appointment of rightwing TV economist Larry Kudlow as his new top economic adviser, despite the fact that Kudlow had insisted the economy was booming under George W. Bush --- ("There's no recession coming," Kudlow wrote at the time. "It's not going to happen.") --- during the very same month in which economists have since concluded the Great Recession actually began.

But, all of those stories, sadly, are not the only disasters to report on today's show. We also cover the horrific pedestrian bridge collapse in Miami and a deadly explosion at yet another chemical plant in Texas today.

And all of that came after the White House announced new sanctions today against Russia, related to allegations of interference in the 2016 election and also for what the Administration describes as a concerted hacking operation targeting critical U.S. infrastructure like the energy grid, water and aviation systems and other key elements of the U.S. economy.

The Kremlin quickly vowed retaliation today in response to the new sanctions. And, while the move suggests somewhat of an about-face for this Administration, there still remains no explanation for why the Dept. of Homeland Security --- as concerned about hacks to our infrastructure as they claim to --- have yet to forensically examine any of the nation's extremely vulnerable computerized voting and tabulation systems (or even count any of the ballots!) for evidence of manipulation during the 2016 Presidential election.

Finally today, after late breaking news that Donald Trump, Jr.'s wife Vanessa is reportedly filing for divorce, Desi Doyen joins us for our latest Green News Report on, among other things, the nomination of Trump's CIA Director Mike Pompeo to become the nation's first climate science denying Secretary of State. On today's BradCast: It was a nail-biter on Tuesday night in the U.S. House Special Election in Pennsylvania's 18th Congressional District between Democrat Conor Lamb and Republican Rick Saccone. And there is much spinning on Wednesday morning. [Audio link to show follows below.]

Lamb has declared victory, (as has the NY Times, while AP still has it as "too close to call") in the district that went to Donald Trump by nearly 20 points in 2016. But Republicans are still holding out hope for a miracle, a "recount" and/or a lawsuit for their candidate who received a full court press from Donald Trump over the past week. That press included a weekend rally with Saccone and new steel tariffs announced by the President just last week, with an eye towards this bellwether race in "Steel Country", just outside of Pittsburgh.

We have full details on where the razor-thin results currently stand (just over 600 votes separate the two candidates, as of air time, in a race with more than 228,000 votes cast) and how such a "recount" would work in the state which still, shamefully, forces the vast majority of its voters to vote on 100% unverifiable touch-screen voting systems.

No matter the final results, Democrats are ebullient about what this huge "red to blue" swing may bode for their chances of taking back the House in November's crucial 2018 mid-term elections, even as GOPers from PA to Capitol Hill to the White House are offering some pretty remarkable spin in response.

Meanwhile on Wednesday, tens of thousands of students took to the streets from coast-to-coast with a massive school walkout to rally for gun safety legislation one month after the massacre which took the lives of 17 at Marjory Stoneman Douglas High School in Parkland, Florida. The students stood up, even as a cowardly President Trump continues to retreat from earlier promises on reforms, while trying to spin his own personal fears of the powerful gun lobbyists at the NRA.

Then, speaking of failed spin, a spokesman for the U.S. Immigration and Customs Enforcement (ICE) agency resigns in the wake of being asked to lie about claims recently made by Attorney General Jeff Sessions and Donald Trump regarding an ICE raid in Northern California

Finally today, as the Administration continues to misrepresent the threat to the U.S. posed by immigrants, three American rightwingers are arrested for the bombing of a Muslim mosque in Minnesota last year, and for an attempted bombing of an abortion clinic in Illinois...

On today's BradCast: Never mind Russia. Is it even possible for Democrats to overcome the systemic structural disadvantages Republicans have put in place in virtually every aspect of U.S. elections? We've got both encouraging and not-so-encouraging news in that regard on today's show. [Audio link to show posted below.]

Now that both the U.S. intelligence community and Democrats --- and even a few Republicans --- have finally begun to figure out that Election Integrity requires, at a bare minimum, a paper ballot for every vote cast, how long will it take them to figure out that those ballots need to be hand-marked (not computer-marked) and, preferably hand-counted, so that the American public can truly begin to restore confidence in election results and know that their votes actually matter? There is some --- precious little, but some --- encouraging news out of Pennsylvania today on that front, and even from the U.S. Senate Intelligence Committee.

The Governor in PA, a state which still hates its voters so much that it forces the vast majority of them to vote on 100% unverifiable touch-screen voting systems, has decreed that any new voting systems purchased to replace the old ones, must have some form of "paper trail" or "paper record" or "paper backup". That's a very low bar, but better --- for the most part --- than the current 100% unverifiable touch-screen systems used across the state. Yet, the Democratic Governor, Tom Wolf, has yet to propose any new funding to purchase those new systems. So, like PA votes, they remain vapor ware for the moment.

At the same time, Sen. Mark Warner of Virginia, Ranking Democrat on the U.S. Senate Intelligence Committee, seems to have noticed the cost of trying to secure elections (like "the Dutch elections, where they hand-counted all the ballots") versus the price of one single F-35. Hand-counts, like those carried out by the Dutch, is, in truth, a pretty inexpensive deterrent against foreign manipulation of our computer tabulation systems, if our elected officials were truly concerned about it. (It would also help to deter the much greater threat of domestic manipulation, by the way!)

But, even if we had a hand-marked paper ballot for every vote cast and even if we counted them all by hand, publicly at the precincts, before ballots were moved anywhere (as per Democracy's Gold Standard), Democrats would still have a mountain to overcome this year in the shape of the GOP's systemic partisan gerrymandering of state legislative districts and U.S. House seats.

To that end, we've got some similarly-qualified encouraging news out of Pennsylvania as well today, where the state Supreme Court recently ordered new U.S. House maps to be drawn in time for the upcoming May primary elections in the commonwealth, after finding the ones drawn by Republicans following the 2010 census were in violation of the state constitution's right to a fair vote. The battle over those new maps --- which have given the GOP a 13 to 5 advantage in U.S. House seats in the largely 50/50 state over the last three elections, where Dems outnumber Republicans --- is now moving forward on a very tight court-ordered deadline.

Meanwhile, similarly partisan gerrymandering by the GOP in Wisconsin, North Carolina, and many other swing-states continues, thanks in no small part to the U.S. Supreme Court delaying lower federal rulings that determined Republicans had unconstitutionally given themselves a steep enough advantage on district maps that they were able to retain huge majorities in state legislatures and the U.S. House, despite being consistently out-voted by Democrats.

We're joined today by FairVote gerrymandering expert DAVID DALEY, former Editor-in-Chief at Salon and author of RATF**KED: The True Story Behind the Secret Plan to Steal America's Democracy. We discuss the gerrymandered state of play as the 2018 primaries are now just weeks away in many states, and as the dam seems to be bursting in both state and federal courts --- finally! --- against partisan gerrymandering.

"The courts have been consistently outraged by what the Republicans pulled off in 2010, 2011," Daley says. "The problem is, here we are in 2018, we've been using these unconstitutional maps now this entire decade. There is no sense we're going to have new maps in most of these states, with the possible exception of Pennsylvania, in time for the 2018 election. We may well have the fourth of five elections in all of these states held on unconstitutional maps."

By way of one example, Daley notes: "In 2012, 52% of Pennsylvanian voters vote for Barack Obama, 51% of them vote for Democratic members of the U.S House. Republicans however, take 13 of the18 seats that year --- 71% of them! Democrats get 28% of the seats, even with more votes."

We also discuss the new documents he recently uncovered, published in a new Salon exclusive, detailing the fascinating story of how the Republicans' so-called REDMAP scheme to take over state legislatures and redistrict the nation with a wildly partisan advantage, first came about prior to the 2010 election and U.S. Census.

Among the questions we discuss: Is it even possible for Democrats to overcome that structural disadvantage in the 2018 mid-terms without the U.S. Supreme Court finding partisan gerrymandering to be unlawful? Are state court cases, like the one in PA, the answer instead? And can any of this be done in time for the 2020 elections, after which district maps will be redrawn once again by partisan majorities in state houses for another 10 years?

"There may be a blue wave [in 2018], but there is also a red firewall that stands ready to knock it down," Daley warns. "Democrats are probably going to need two seismic, historic waves in order to have a shot at fair maps in 2021. And it they can't pull that off, and if the courts don't come in and do something in the meantime, the maps that are drawn in 2021 are the ones we are going to live with until 2031."

Also today, in other related news: A second federal court, this time in New York, blocks Trump's attempt to reverse DACA, and one Republican candidate for the U.S. Senate must be a very bad choice...at least according to his own parents!...

On today's BradCast: Several encouraging election-related news items for Democrats and others in the fact-based community, but still more troubling news for American immigrants and their families as DACA recipients are left out of a new Senate deal to keep the government open. [Audio link to show posted at end of article.]

We start with some of the good news for Democrats, as yet another special election on Tuesday has resulted in yet another state legislative seat flipped from "red" to "blue". This time it was a special election for the Missouri House in a district where Trump is said to have won by 28 points in 2016. The stunning victory continues a tidal wave of Republican seats picked up by Democrats since Donald Trump took office last year. There is less good news for Republicans, however, as a holocaust denier and actual member of the American Nazi party is now set to become the GOP's nominee for the U.S. House in Illinois' 3rd Congressional district this fall.

Meanwhile, U.S. Senate leaders Mitch McConnell (R-KY) and Chuck Schumer (D-NY) announced a breakthrough agreement on Wednesday to keep the federal government funded and open in advance of Thursday night's shutdown deadline. The deal, if adopted by both chambers of Congress, would increase both military and domestic spending by some $300 billion, includes additional disaster relief to states rebuilding after last year's hurricanes, funds community health centers for several years, and increases the debt ceiling to avoid a government default, as lost revenue following the GOP's $1.5 trillion tax cut last year means federal borrowing must be increased sooner than previously expected.

The deal, however, does not include protections for "Dreamers", those who immigrated here with their parents years ago, who now face the possibility of mass deportation as early as March 5, after Trump reversed the Obama-era DACA program that had previously protected them. Some progressives and self-identified conservatives in the U.S. House oppose the Senate plan, including House Minority Leader Nancy Pelosi (D-CA) who took to the House floor today for a record 8-hour marathon speech to highlight the DACA issue and contributions made by hundreds of thousands of "Dreamers" who have lived here most of their lives.

Pelosi says she opposes the Senate bill and called on House Speaker Paul Ryan (R-WI) to promise a vote on immigration issues, as McConnell has in the Senate. Freedom Caucus Republicans in the House also claim to be upset by the bill, thanks to its additional new government spending. So, it remains to be seen if today's breakthrough package will make it to the President's desk before the midnight Thursday deadline or not. Either way, it doesn't appear that a fix to DACA will be included, assuring more continued uncertainty for some 800,000 previously protected Dreamers who could soon face deportation.

We're joined today by JESSICA HANSON, attorney at the National Immigration Law Center, to discuss how a recent federal court ruling, temporarily blocking some of Trump's attempted DACA reversal, may effect his March 5 deadline for legislation to protect "Dreamers", as well as the rise of white nativism in the GOP, including Trump and his Chief of Staff John Kelly.

Hanson explains the "temporary reprieve" by a federal court ruling in California that has allowed "individuals who have had DACA previously to renew their DACA grant." But, she says, while NILC recommends such renewals, even where some may have already expired, she notes that those who never had DACA protection are still out in the cold, at the moment, as "the government took the unusual step of seeking to skip the 9th Circuit and instead appeal directly to the Supreme Court" in the ruling.

In response to recent remarks from Kelly, alleging that those not covered by DACA were "too lazy to get off their asses" and that he "doubts very much" Trump will extend the program beyond March 5, Hanson charges: "Those remarks reflect an ongoing, deep, white nativist sentiment with this administration that has shown itself over and over again."

We also discuss a number of other related issues, including Trump's lies about our legal immigration policies, such as the Diversity Lottery and Family Reunification programs that he is now trying to restrict and ties to a DACA deal ("The President has been completely misrepresenting these programs," explains Hanson, who describes it as yet another effort "to make America white again"), and concerns about millions of other American immigrants already being terrorized by detention, deportation and separation from their families, business and lives under Trump's radical anti-immigrant policies.

She joins NILC in decrying today's Senate deal, charging that "it is inexcusable that the Senate leadership has agreed to put immigrant issues aside" and explains that "the mainstream media could do a lot more to lift up these stories" about abuses by Trump's immigration enforcement agencies like ICE and CBP, "because a lot of people don't realize it's happening [and] have no idea that this is going on."

Finally, we finish up with a bit more encouraging election news for those still interested in facts and reality and science, as a record number of scientists are now lined up to run for office in 2018, on the state, local and federal level, in response to the Trump Administration and GOP's increasingly anti-science policies and positions...

Beyond that, on today's program, we've got some encouraging news on voting rights in the state of Florida, believe it or not. A citizen initiative to allow former felons to vote has officially qualified for the state's November ballot, after an herculean effort to gather more than 800,000 qualified signatures by proponents who hope to help re-enfranchise some 1.7 million Floridians who have completed their sentences, many of them years ago.

While the grassroots effort has already been monumental --- as a segment from Sam Bee's Full Frontal highlighted last year --- the measure must still receive more than 60% approval from voters this November in order to amend the state's constitution. More former felons --- who are disproportionately African-American in FL --- are disqualified from voting in the Sunshine State than any other. Only they, Kentucky, Virginia and Iowa currently ban such citizens from voting for life. "Florida accounts for nearly 25 percent, or 1.6 million, of the people who have lost their right to vote" in the U.S., according to the ACLU. "As a result, one in ten Floridians are shut out of our democracy."

But, if it was up to the Trump Administration, there would be many more such felons in FL and everywhere else. We're joined today by criminal justice journalist JUSTIN GEORGE of The Marshall Project, to discuss his recent article looking at "Trump Justice, Year One: The Demolition Derby", in which he examines "nine ways Trump has transformed the landscape of criminal justice, just one tumultuous year into his presidency."

We discuss the many changes made by Trump's Department of Justice and Attorney General Jeff Sessions, as they attempt to "demolish" the legacy of the Obama Administration. From their rhetoric and tone on crime, the "drug war" and immigration, to policy changes on policing, sentencing, mass incarceration, the private prison industry, and in stacking the federal bench with rightwingers, Team Trump is hoping to unwind many of the criminal justice reforms successfully enacted by Obama and his DoJ, particularly in the later years of his Presidency.

But have Trump and Sessions' attempts to rollback Obama's criminal justice legacy, to date, been particularly effective? And, for that matter, why did Obama's efforts at reform come so late in his Presidency?

We cover a lot of ground in my conversation with George today, before somewhat departing from our usual beat to close with a bit of dirty laundry, sleaze, speculation and rumor mongering concerning Donald and Melania Trump --- though we've got a reasonable justification for doing so today...mostly...

On today's BradCast: Donald Trump and his Great American Shitshow continues today, though he has now received a very helpful hand from Congressional Democrats, for reasons that may beggar the imagination. [Audio link to show is posted below.]

First up today, a quick word on the allegations regarding $130k in hush money said, by the Wall Street Journal, to have been paid by Donald Trump to a porn star just before the 2016 election, reportedly to hide a sexual liaison during his marriage with the now-First Lady, and on the sordid sex and blackmail scandal now roiling Missouri's new "family values" Republican governor, Eric Greitens. In normal times, of course, both stories would be huge news everywhere and we'd be discussing impeachment and/or resignation of both men. These days, however, each scandal is barely breaking the national news radar.

Then, more encouraging election news for Democrats this week in Tuesday's special elections around the country, with Dems flipping another long-held Republican seat in a deeply "red' area, this time in the Wisconsin State Senate. The results seem to be freaking out the state's controversial GOP Governor Scott Walker in advance of his own re-election contest later this year and signals a possible Dem takeover of the state Senate in advance of 2020 redistricting!

Next, Congress is on the verge of reauthorizing a warrantless mass surveillance program that civil libertarians on the right and left have long opposed and characterize as a blatant violation of the U.S. Constitution's 4th Amendment privacy protections against unwarranted search and seizure. Last week, after Trump made it clear he had no idea what Section 702 of the FISA Amendments Act actually was --- despite his administrations' long time lobbying of Congress to reauthorize and, indeed, expand it, it for another 6 years --- Republicans in the U.S. House passed it with the help of several Democrats (including House Minority Leader Nancy Pelosi).

This week in the U.S. Senate, a bi-partisan group lead by Senators Rand Paul (R-KY) and Ron Wyden (D-OR) fell one vote shy of blocking the measure through a filibuster. So it now appears the legislation will clear both houses and sent to Trump for his signature.

We're joined today by ELIZABETH GOITEIN, former Dept. of Justice attorney, now co-director of the Liberty and National Security Program at NYU's Brennan Center for Justice, to explain Section 702, the efforts to lobby against its reauthorization, and why it is that many Congressional Democrats are willing to join Republicans in granting the Trump Administration's NSA, DHS, FBI, DOJ, CIA, etc., extraordinary new powers to secretly spy on every American citizen's phone calls and emails without warrant, due diligence or even probable cause.

While the legislation was "driven primarily by Republican leadership," she says, there were "enough Tea Party style Republicans who have really rallied in support of greater privacy protections" that some marginal reforms were added. Though, she explains, they aren't really reforms at all, and the entire dangerous package could not have moved forward had Dems stuck together in opposition.

"It's a failure of Democratic leadership," Goitein tells me. "At the last minute, [Senate Minority Leader] Chuck Schumer said he would vote no on cloture [to end the filibuster] --- but he hedged that and said, 'Amendments should be in order and we should have the chance to look at amendments, but the bill itself is not that bad, it makes improvements to the law'. Which is not true. It actually takes the law backwards. Minority Leader Pelosi in the House did even more damage...coming out in support of the bill and opposing the amendment that would have made these improvement. And then a whole bunch of Democrats went along with her."

Goitein argues "there was a full court press by intelligence officials" to pass this measure. So, even Trump's cluelessness about it was unable to prevent it from moving forward, even as it allows for the emails of two American citizens speaking to each other --- with no foreign target in the mix --- to be indexed, searched and read by the FBI without an order from any court. She explains the horrible details in depth on today's show, and why it has been so difficult to challenge this provision in a court of law.

Finally, nearly every member of the bipartisan National Park Service Advisory Board has resigned en masse this week, citing the Interior Department and its Secretary Ryan Zinke's failure to hold any meetings with the board, as required by law, during the entire first year of Trump's Presidency. The Administration's response to the mass resignation today is almost as disturbing, if not more so, than the resignation itself.
