"We will never surrender," Donald Trump told his brain-poisoned MAGA Mob over the weekend in Valdosta, Georgia after the American people decisively voted for him to lose the 2020 Election. "We will only win. We're gonna win. We always win. Somehow we find a way to win," he declared. Of course, a "win" for Trump, as we detail on today's BradCast, would require the nullification of tens of millions of lawful votes to undermine democracy and the will of the American people in order to steal the election. Trump is all in for that, as he made clear yet again today. [Audio link to full show is posted beneath summary.]

In the meantime, the Trump Campaign lost yet again in court on Tuesday night, as the Nevada Supreme Court agreed with a lower state court that there was no evidence of fraud that could have possibly reversed his loss to Joe Biden in the state by more than 33,000 votes. Team Trump has now lost more than 50 such cases in both state and federal court since Election Day, in no small part because they've failed to present any of evidence of "massive fraud" in any court, despite the false claims made by Trump dozens of times a day since then.

But he continues to try and strong-arm whoever he can --- the GOP leaders of the Michigan legislature, the Republican Governor of Georgia, the Republican leaders of the Pennsylvania House --- in hopes they will abet his unconstitutional coup. His latest "victory" in that Loser's Battle was a letter sent by about 70 members of the Pennsylvania legislature to the state's Congressional delegation to ask them to please disenfranchise every voter in the Keystone State by voting against accepting the state's 20 electors on January 6th. (Mark that day on your calendar, by the way. It's going to be a very long one. I explain why on today's show.) The Republican leader of the state Senate said she feared her house would be "bombed" if she had chosen not to sign the letter. (She didn't, but only because she wasn't given the chance.) Death threats come to all of those Republicans who do not cow to the MAGA Mob, no matter how Trumpy they may otherwise be, no matter how long they have already gamed the system to try and please him.

In Texas, the wildly corrupt, long-ago-indicted Republican Attorney General Ken Paxton, the state's top "law enforcement" official, is already facing state charges for securities fraud felonies and, more recently, eight of his top, very rightwing staffers left the office and informed federal officials that Paxton has been violating the law by using his agency to do favors for a political donor. The FBI is reportedly investigating the charges of bribery and abuse of office. Paxton could probably really use a preemptive pardon and quickly from this outgoing President. This week, he came up with just the ticket that is very likely to win one for him!

Paxton filed a lawsuit on behalf of Texas directly with the U.S. Supreme Court, seeking to toss out the results of the elections in four states --- Michigan, Wisconsin, Pennsylvania and Georgia --- claiming changes to their voting laws due to the COVID pandemic violated the U.S. Constitution. Coincidentally, there are just enough electors in those states that if they weren't allowed to vote, or if they voted for Trump instead, he could "win" the second term that he clearly lost.

We explain the ostensible basis for Paxton's suit today, which relies on a radical reading of the U.S. Constitution to nullify any and all votes cast by voters based on laws or rules or regulations set by state Governors or Secretaries of State or Boards of Elections or even state courts, rather than state legislatures only. Paxton also tosses in some long-ago debunked fraud claims that even the Trump Campaign hasn't tried to argue in their own failed lawsuits (no, there were no "suitcases full of ballots being pulled out from underneath tables" in Atlanta), and some bullshit "commonly accepted statistical tests," just for good measure, claiming, for instance, that the chances Joe Biden could win all four states against a titan of Great Americanism like Donald Trump "is less than one in a quadrillion" according to "expert analysis".

But, in the Trump Era, facts don't matter. Convincing, muscling, threatening, strong-arming Republican stooges into doing his bidding is all that matters, even if those stooges are on Trump's stolen and packed U.S. Supreme Court. All nine Justices unanimously rejected another challenge that sought to toss out only 2.5 million votes in Pennsylvania on Tuesday. Hopefully they see through this similarly transparent attempt to steal the election and/or win Paxton a preemptive pardon for his federal crimes.

Of note, the Texas state Solicitor General, who would normally take the lead on big cases to be argued before SCOTUS, didn't sign Paxton's 154-page complaint [PDF]. Only he and his new chief deputy (the last one left due to concerns about bribes the AG has allegedly taken) and a private, outside attorney were willing to do so. That attorney is presumably being paid by the taxpayer dollars of Texans who already employ hundreds of capable attorneys in the AG's office who wanted nothing to do with this case, apparently.

Nonetheless, the terrified incumbent Republican U.S. Senators in Georgia --- both facing serious challenges from Democrats in two runoff elections on January 5 that will determine control of the U.S. Senate --- issued a statement of support for the Texas Attorney General's attempt to rob Georgia's own voters, even as their own state's Republican Attorney General described the TX complaint as "constitutionally, legally and factually wrong."

In other news today that doesn't concern pathetic simpering Republicans kowtowing to a desperate, wannabe strongman, the comptroller of New York State has announced plans to divest the state's enormous, $226 billion pension fund from the fossil fuel sector, sending shockwaves through Wall Street and a jolt of excitement through the climate movement. Desi Doyen joins us to explain why this is such a big deal.

On today's BradCast, we see some light at the end of America's dark tunnel. [Audio link to full show follows below.]

On Tuesday, the swing-states of both Pennsylvania and Nevada certified Joe Biden's victory over Donald Trump, joining Michigan from Monday. In Arizona, which certifies next week, its very Trumpy Republican Governor Doug Ducey conceded that "Joe Biden did win". And, despite Trump's repeated lie that the stock market would crash if Biden was elected, it continued to soar today, with the Dow closing above 30,000 for the first time. Trump stayed largely inside his White House bunker while continuing to falsely tweet that he won the election, though he did come out long enough to "pardon" a couple of turkeys. He's probably warming up for what is to come during the last desperate days of his failed Presidency.

We're joined today to discuss all of that and much more by Constitutional attorney and election law expert JOHN BONIFAZ, co-founder and President of the nonpartisan, non-profit good government group Free Speech for People (FSFP). His organization won several important victories in key voting rights cases prior to the election. One of them helped extend Arizona's registration deadline during the pandemic, allowing for 35,000 new registrations in the state that Democrats now appear to have won, for the first time in decades, by about 10,000 votes.

Our conversation today focuses largely on accountability, and the need for the President-elect to assure the criminal Administration of the previous four years does not escape it, as the Obama Administration allowed the George W. Bush Administration to do in their ill-considered effort to "look forward not back". Biden has reportedly been uttering similar thoughts of late. Bonifaz argues that would be a fatal mistake. "You can draw a straight line from the decision that President Obama made to only look forward, not to look back at the war crimes, the torture that had taken place during the Bush Administration --- you can draw a straight line from that decision, that strategic error, to the rise of Donald Trump. And I do think that we cannot make that mistake again," he tells me.

Among the areas of accountability that await the outgoing President, as Bonifaz sees it and hopes to ensure with FSFP: Crimes that were not included in Trump's impeachment for attempted extortion of the Ukrainian President (Bonifaz co-wrote a book on those crimes); obstruction of justice and other crimes touched on by Special Counsel Robert Mueller that remain unpunished; horrors carried out by the current administration at our nation's borders, including the "kidnapping" of children; the ongoing attempted coup to overthrow the results of the 2020 election; and even crimes against humanity for Trump's unforgivable failure to help avoid the unnecessary deaths of more than a quarter of a million Americans (to date) thanks to his criminal lies about the COVID pandemic --- just to name a few.

"What we've been left with now, since the election is perhaps the worst abuse of power of them all," explains Bonifaz, who is also founder of the National Voting Rights Institute. "His effort to subvert the Constitution, to disenfranchise millions of voters based on this falsehood that mail-in voting has been fraudulent, and to effectively overturn the Presidential election results, and engage in an attempted coup. All of that is not only an abuse of power, but it's a broad criminal conspiracy for which this President should be held accountable once he is out of office."

We also discuss whether Trump has the Constitutional power to pardon himself for any of those crimes before leaving office, and whether the Republican claims at having newfound concerns about election integrity (based in no small part on years of my own investigative reports, though bastardized by the cretinous lawyers currently representing Trump in his attempt to reverse his reelection loss by both hook and crook), might result in a new reason for hope for the real, decades-old Election Integrity movement. Longtime advocates like Bonifaz and myself have fought for years in that movement against the privatization of our elections by corporate voting system vendors and their proprietary computer voting and tabulation systems. Perhaps after the partisan opportunists have peeled off from the GOP's current false claims about "Dominion!" and "Smartmatic!" and "Hugo Chavez!", we'll find new legitimate allies from the Right.

"We have to reach for the gold standard of election integrity, which are hand-marked paper ballots for all of our jurisdictions across the country, with assistive devices for those who need it," Bonifaz tells me. "But we cannot have the private voting systems industry be in charge of counting our votes, because it leads to this distrust. It leads to this lack of verifiability. The reality here is that because so many people voted by mail this year, we actually had an ability to verify the election even more so than previous cycle. Hand-marked paper ballots are the gold standard."

The unfortunately necessary debunkery of Donald Trump and his GOP's various embarrassingly desperate efforts to steal the election from Joe Biden continues on today's BradCast, even as the U.S. Secretary of State manages to shock with an extraordinarily offense comment and Republicans are now turning on their own in Georgia to appease the soon-to-be-former President. [Audio link to show is posted below this summary.]

Among the too-many stories covered on today's show...

  • Even Fox 'News' is beginning to refuse to air the White House's "voter fraud" BS. It's not the first time Fox has refused to play along with GOP "voter fraud" lies since Election Day;
  • Sec. of State Mike Pompeo makes a wildly unfunny, dangerous and un-American "joke" from the lectern at the Dept. of State about a "smooth transition to a second Trump Administration";
  • Corporate media continue to do a rather competent job of quickly debunking the endless and so-far evidence-free claims being made by duped Trump supporters and shameless Trump attorneys in court regarding "voter fraud". CNN's Donie O'Sullivan deserves special credit for one of his reports taking on Trump supporters directly at a "Stop the Steal" rally in Pennsylvania, with facts to debunk their false conspiracies regarding "Trump ballots being burned in bags" (they weren't), vote totals being inflated overnight for Joe Biden (they weren't), and much more;
  • Separately, CNN also debunks Trump's latest Twitter tantrums regarding his evidence-free claims of fraud in Pennsylvania (no, GOP observers were NOT prevented from watching the ballot count), Nevada (no, 3,000 voters did NOT vote unlawfully from other states), Georgia (no, Trump did not "win on Election Night") and Wisconsin (no, Trump's campaign is not "looking very good" in the state they appear to have lost by more than 20,000 votes);
  • Team Trump files yet another embarrassingly lame lawsuit in Arizona, falsely charging that 180 voters (out of 155,860) who cast Election Day ballots in Maricopa County (Phoenix) improperly had their ballots rejected as overvotes;
  • Short of an unlikely shocker in the still-uncalled Alaska U.S. Senate race, the last chance for Democrats to take back majority control of the U.S. Senate will now be in Georgia's two U.S. Senate runoff elections on January 5th. They will have to win both of them. And now, both of the state's Republican U.S. Senators, Kelly Loeffler (who is running against Rev. Raphael Warnock) and David Perdue (who is running against Jon Ossoff) are sucking up to their demented sore loser President by turning on GA's Republican Sec. of State Brad Raffensperger, hilariously "citing no evidence" in calling for his resignation.

    Longtime listeners of The BradCast will recognize Raffensperger as the corrupt dope who purchased the state's new, wildly-expensive, easily-manipulated, 100% unverifiable computer touchscreen Rube Goldberg voting systems made by Dominion Voting and forced on every county in the state for first time use this year. That, instead of a cheaper, verifiable, hand-marked paper ballot system urged by cybersecurity and voting systems experts alike.

    Republicans have been falsely accusing Dominion in recent days of being controlled by Democrats and responsible for "stealing" the election from Trump in Michigan and Georgia. While there is no evidence to support their claim, I have invited those Republicans worried about Dominion to join me in my call for getting the company out of Georgia's critical U.S. Senate runoffs altogether by turning to all hand-marked paper ballots to be publicly hand-counted in both races. The statewide election will feature just two races, with only two candidates in each, so hand-counting them on Election Night would be very simple and completely transparent.

    While my invitation to Republicans has become quite popular on Twitter, so far they have failed to join the effort to prevent the "Software from hell!" that folks like Eric Trump are pretending to be the cause for his father's humiliating re-election loss. Sad!

    While Raffensperger says he will not resign, a comment from former Republican Sec. of State turned illegitimate Governor Brian Kemp, along with an article from the far-right Federalist, suggests that state Republicans may try and move to ban mail-in voting altogether for the runoffs, despite the spiking deadly pandemic and the requisite reliance on unverifiable Dominion voting systems at the polling place, in hopes of returning to their years-long glory days of GOP voter suppression in the Peach State;

  • Finally, Desi Doyen joins us for our latest Green News Report filled with (almost all) actually good news for a change, in the wake of Joe Biden and Kamala Harris' apparent election victory last week...

On today's BradCast: it's all over but the desperate Donald Trump tantrums. Though don't try and tell our own Desi Doyen that today! [Audio link to show is posted below.]

As the stock market numbers rally on increasingly certain news that Joe Biden will become the next President (despite Trump's lies that the market would crash if the former Veep won), the U.S. coronavirus numbers also continue to skyrocket to all time records (thanks to Trump's disastrous denial and lies there as well.) For today, though, it's the vote count numbers we're again focused on, as Biden will almost certainly be called the unofficial winner in several remaining uncalled states --- including Pennsylvania, Georgia and Nevada --- very soon.

If he takes Pennsylvania alone it's over for Trump. But, as we went to air today, with Biden so far, according to media calls, having won a conservative 253 electoral votes of the 270 he ultimately needs to be declared the President-elect (that 253 total doesn't include Arizona's electors, which both AP and Fox "News" have already called for him), it's now likely that Biden will end up with at least 306 electoral college votes when all is said and done.

At the same time, Trump is filing every unsupported, nonsensical legal lawsuit in every state that his two-bit lawyers can figure out how to spell in hopes that something, anything, will actually help --- or even just turn out to be vaguely true. While the President's supporters in Michigan chant "STOP THE COUNT! STOP THE COUNT!", his equally gullible cult followers in Arizona are busy shouting "COUNT THOSE VOTES! COUNT THOSE VOTES!" That should give you an idea of the ingenously coordinated strategy of Trump and the Republican Party's election law geniuses at this point.

We're joined today by an actual legal professional, University of Kentucky College of Law's election and Constiutional law professor JOSHUA A. DOUGLAS, author of Vote for US: How to Take Back Our Elections and Change the Future of Voting to find out what we must be missing in reviewing Trump's woefully pathetic legal strategy to try and win this election or unring its bell.

"There's not really a coherent legal strategy to speak of. He's throwing as much spaghetti at the wall as he can and seeing what sticks," Douglas confirms. "The real problem I have is we're reporting on these lawsuits as if they have any merit whatsoever. And they don't. I don't think we should even be giving them airtime. Because in my view, the real goal here is to undermine people's faith in the integrity of the election."

"They are making wild allegations of voter fraud, but without having any evidence that it actually occurred. And then they're spreading misinformation on social media about anecdotes that, when you look into them, turn out to be" anything but what they are alleging, he explains.

Nonetheless, we press the good professor for how he would make the case for Trump, were he unfortunate enough to be representing him in this matter, and we discuss the actual looming legal danger awaiting decades of election law precedent at the now packed and stolen U.S. Supreme Court. Will Trump's newest stolen Justice Amy Coney Barrett actually deliver for her President if and when any actionable case on the 2020 election somehow makes its way to SCOTUS? Or will it only be later that she and four other compliant rightwing Justices will decide to undermine the affirmative Right to Vote found in almost every state Constitution?

We discuss all of that and more today, even if none of it seems to help our own Desi Doyen rest any easier about the Presidential election results just yet. (She has very good reason, in the meantime, to be concerned indeed about the results at the Senate and House level.) Nonetheless, we close today with her latest Green News Report with an eye on Hurricane Eta, now aiming for Florida, and what we should expect when it comes to U.S. climate action after the dust settles on the 2020 election...

On the day after what was a harrowing and very very late Election Night for many Democrats, it is now fairly clear, as of today's BradCast, that --- barring some sort of tabulation surprise or failure (they do happen) --- Joe Biden is set to win at least 270 electoral college votes to become the nation's next President. [Audio link to show is posted below.]

This will likely happen even if Biden doesn't end up winning Pennsylvania (or even Georgia or North Carolina) with the many still-untabulated, largely Democratic votes left to count in the state. In Pennsylvania, Wisconsin and Michigan, election officials were barred by gerrymandered, GOP-controlled state legislatures from counting any mail-in ballots until Election Day, so unofficial results on Election Night were much slower coming in. (In Pennsylvania, as we explained with a PA election official last week, it is even worse, because officials in the state are barred from even pre-processing mail-in ballots by opening, verifying them, etc., before Election Day.)

Nonetheless, faced with his likely crushing defeat at the ballot box, Donald Trump did what he does, and precisely what we warned you, very specifically in recent weeks, that he would do. He attempted to gaslight the American people via his Twitter account and a 2:30am "news conference" with supporters at the White House, where he tried to super-spread the lie that counting legally cast ballots after Election Day was somehow "a fraud on our nation" and a "sad" attempt by Democrats to "STEAL the election" from him. After falsely declaring victory, he vowed that "we are going to the Supreme Court" to, presumably, try to stop the counting of votes, though it remains unclear whether he has any cause of action whatsoever to try and do that.

Trump's late-night lie and threat fest did not go over well. Even Republicans of all stripes condemned the remarks --- from Chris Wallace of Fox "News" to Trump's debate prep ally Chris Christie to the RNC's top election attorney Ben Ginsberg --- all of whom declared Trump's announced plans to stop the counting of lawfully cast votes to be shameful, anti-democratic and counter-productive to his case, not to mention an embarrassment to the nation. We share a number of those responses on today's show.

In short, Trump's desperate scheme is unlikely to work, barring evidence of some sort of actual fraud or mistabulation. Before media outlets called both Wisconsin and Michigan for Biden today, Team Trump vowed to seek a "recount" in Wisconsin, and announced plans to file suit in those states and Pennsylvania in hopes of stopping perfectly legal on-going vote tallies. In an effort to recreate the magic of 2000's infamous "Brooks Brothers Riot" in Florida, Trump supporters in Detroit on Wednesday attempted, unsuccessfully, to storm the counting room.

That is by way of contrast with Biden's own late-night statement to supporters on Tuesday night, noting that "it's not my place or Donald Trump's place to declare the winner of this election. It's the voters' place," and that "every vote must be counted." He vowed that "nobody is going to take our democracy away from us, not now, not ever."

We shall see. But it is looking very good for Democrats today, at least on the Presidential level as of air time today. As to their hopes of winning back a much-needed majority in the U.S. Senate, that hope appears dim at this hour, if still a long-shot possibility. Combined with the reported loss, so far, of five Democratic seats in the U.S. House and the results on several ballot initiatives across the nation, it was certainly a confusing verdict from the American people --- presuming the reported, unverified and unofficial results to date prove to be accurate.

What to make of all of this? We are joined today by our old friend and Wisconsin favorite son, progressive journalist JOHN NICHOLS of The Nation and Madison's Capitol Times. As usual, Nichols has helpful insight into all of this, both for progressives and establishment Democrats, as well as a unique perspective from a state which barely went to Donald Trump in 2016 for the first time in decades, and which now appears to have flipped back to Democrats by a similarly small margin. His body of knowledge also comes from a longtime progressive state that took a very similar right turn over the past couple of decades as the nation now appears to have taken, with the rise (and fall) of former Gov. Scott Walker.

"I like the fact that the people [Trump] attacked the most, the people he threatened to send federal forces in to squash their protests and minimize their outcry --- they pushed back against him," Nichols says, noting his optimism after last night. "I see something very positive in that. I would even dare say there was something delicious, or at least appealing in the poetic justice of it." On the other hand, he tells me, noting the "blunt reality" of the situation, "Democrats shouldn't be overly enthusiastic about a situation where, it appears, the prospect they have taken the Presidency without a Senate. Because, I've argued throughout this year, that if Joe Biden is elected President with Mitch McConnell still in charge of the Senate, Joe Biden begins his Presidency as a lame-duck."

On today's BradCast: He wants you to be frightened. He wants to terrorize you. Don't let him. Vote instead. [Audio link to today's show.]

The fact that time is running out for the Trump Crime Family and their decades of fraud in New York --- as Eric also clearly knows --- is probably not helping, but Donald Trump is getting desperate. Hence, his refusal to commit, when when asked about it during a press briefing Wednesday at the White House, to a peaceful transfer of power after this year's Presidential election.

His excuse? "The ballots are a disaster...Get rid of the ballots....The ballots are out of control." While many have been discussing the disturbing options that some Republican controlled states may consider using to override the ballots by having their legislature select Electors to the Electoral College this year in defiance of voters, that's probably not what Trump was talking about yesterday when pretending "the ballots are out of control!"

He has been complaining for months about states that are automatically sending absentee ballots to all active registered voters this year. He is pretending this is "out of control" and a "scam" by Democrats to somehow steal the election. In fact, as we break down on today's show, Trump's complaints are, themselves, a scam.

In short, 5 states (Oregon, Washington, Colorado, Utah and Hawaii) have long sent all voters absentee ballots, whether they request one or not. Of those, only Utah is a so-called "red" state, and none of them are seen as anywhere close to likely to flip their Presidential vote from the way they voted in 2016. So, Trump is almost certainly not complaining about those five states.

But this year, due to the COVID-19 pandemic that Trump failed so disastrously to control, 5 other states (California, Vermont, New Jersey, Montana and Nevada) will also be sending mail-in ballots to all voters. Of those, the first three are very reliably Democratic states in Presidential elections. Trump won Montana by some 20 points in 2016. So, of those five, only Nevada (whose Republican Secretary of State is in charge of the election) could be considered, in any sense, a swing-state --- though it hasn't elected a Republican nominee for President since 2004, and a new Fox "News" poll out this afternoon shows Trump trailing Joe Biden there by 11 points.

If somehow, magically --- due to some imagined massive Democratic fraud --- both Montana and Utah suddenly flipped to Biden this year, but Trump managed to hold all the same other states he won in 2016 (none of which have instituted universal Vote-by-Mail this year), Trump would still win the Electoral College.

So what is he pretending to be so bothered by? Actually, nothing. He is simply desperate to win and, as his chances of doing so are dwindling, he's desperately grasping to pretend there is a massive Democratic scheme to cheat him out of that win with universal Vote-by-Mail. There isn't.

But make no mistake, he will do nearly anything to come up with a way to get a "win" --- as long as it's other people who will risk their lives for it. That, of course, is also why he is hoping to further pack an already stolen, 5 to 3 rightwing U.S. Supreme Court, and why he is signaling that there may not be a peaceful transfer of power in the event that he loses.

Despite his threats, Trump is a coward. Bullies want you to be afraid of them, when, in fact, they are terrified of you. As well he now should be.

This nation is about to be tested in a way that we haven't seen since at least the Civil War. But, as we discuss today --- and in agreement with both Nancy Pelosi's and Bernie Sanders' responses today to Trump's Briefing Room thuggery --- the solution is the vote. An overwhelming landslide of a vote, which is now completely possible if we all step up and do our duty to save this democracy. To paraphrase Barack Obama: Yes, we can!...But will we?

We will find out over the next six weeks...and beyond. We offer both advice and encouragement to that end on today's show.

Also today, just a few more reasons for Trump's increasing panic, in addition to the New York State Attorney General and the Manhattan District Attorney both quickly closing in on Trump Organization crimes in two separate probes: A federal court this week tossed out the Trump/RNC lawsuit in Nevada seeking to block their Vote-by-Mail election, despite legislation adopted by the state legislature and signed by its Governor; And the news that even Texas could now be in play, with a record 1.6 million newly registered voters, Democrats spending millions on TV ads in a state long previously considered to be a Republican state, the Biden Campaign hiring on-the-ground staffers, and CBS' latest Battleground Tracker poll finding Trump leading Biden by just two points in a state that hasn't elected a Democratic nominee for President since 1976. Oh, and Republicans appear so frightened about what could happen if voters are allowed to cast their votes in Texas this year, that a bunch of them are suing their own Republican Governor to roll back his tepid expansion of Early Voting in response to the coronavirus.

Finally, Desi Doyen has quite a bit of "big" and, yes, very good news for us today (for a change) in our latest Green News Report...

Judge blasts new Postal Service mandates as 'intentional effort to disrupt' and delegitimize the 2020 elections and to disenfranchise voters...

On Thursday, by way of a 13-page Order [PDF] issued in State of Washington v. Trump, U.S. District Court Judge Stanley A. Bastian not only enjoined the United States Postal Service (USPS) from continuing to implement the "transformative" nationwide changes to its mail delivery capacities effectuated since July under the direction of Postmaster General Louis DeJoy, but also ordered USPS to "replace, reassemble or reconnect" all of the high-speed sorting and labeling machines that had previously been decommissioned.

In his decision, Judge Bastian found that the 14 State Plaintiffs --- Attorneys General in WA, CO, CT, IL, MD, MI, MN, NV, NM, OR, RI, VT, VA, WI --- "established a likelihood that they will prevail on their claims that the [USPS] and Postmaster General violated 39 U.S.C. §3661". He characterized DeJoy's mandates as an "attack on the Postal Service [that] is likely to irreparably harm the states’ ability to administer the 2020 general election."

As we explained last month when covering the States' complaint, under Section 3661(b), DeJoy had a "non-discretionary duty" to request and obtain an advisory opinion from the Postal Regulatory Commission (PRC) before instituting "a change in the nature of postal services which will generally affect service on a nationwide or a substantially nationwide basis." Under that statute, the PRC cannot issue that advisory opinion "until an opportunity for a hearing on the record...has been afforded to...users of the mail." At that hearing, "an officer of the [PRC]...shall be required to represent the public interest."

DeJoy's failure to comply with those statutory requirements, Judge Bastion noted, "suggests" the USPS "acted ultra vires" --- beyond its power --- when it effectuated DeJoy's "transformative" changes.

The court also found that the Plaintiffs established a likelihood that the USPS "actions have infringed" upon the "States' constitutional right to appoint presidential electors and set the time, place, and manner of elections; that the current changes are the result of an effort by the current Administration to use the [USPS] as a tool in partisan politics, which violates the spirit and purpose of the Postal Reorganization Act and the Postal Accountability and Enhancement Act."

In his written ruling, Judge Bastian blasted the USPS actions, charging they would result in "voter disenfranchisement"...

On today's BradCast: The endless court battles continue as Donald Trump and the Republican Party continue their fight to make voting harder and more dangerous during the worst pandemic in a century. But we've got mostly good news today on those fronts. The news on the climate front today, however, is not nearly as encouraging. [Audio link to full show is posted below summary.]

Among the many election and/or climate-related stories covered on today's show...

  • For the first time in its 175-year history, Scientific American magazine has made a Presidential endorsement. In this case, for Joe Biden. We explain why;
  • That endorsement comes on the heels of another recent endorsement for Biden by the BlueGreen Alliance, a coalition of major labor and environmental groups. It was the first endorsement of any public candidate in the coalition's 14-year history. The group includes the United Steelworkers, the Utility Workers Union of America, the United Association of Plumbers and Pipefitters, and four other unions with the Sierra Club, the League of Conservation Voters and the National Wildlife Federation;
  • Despite record wildfires up and down the West Coast, two hurricanes that slammed the Gulf Coast just over two weeks ago and another one set to do the same over the next 24 hours in a record storm season, network and cable TV outlets have been woeful in their coverage of climate change, which has made all of these emergencies far worse and much more damaging. Several recent Media Matters analyses finds plenty of coverage of the fires across the networks and cable stations, but barely any mention, in the hours of coverage, of why all of this is now happening. That, just weeks out from the most critical election in our nation's history, pitting a climate change denying Republican against a Democrat who is proposing $2 trillion dollars to combat the existential crisis while putting millions back to work creating clean, renewable energy;
  • Good news for election officials and voters alike in the battleground state of Wisconsin on Monday night, as one Justice on the state's rightwing-majority Supreme Court decided to join the court's liberals to put an end to absentee ballot chaos the court created last Friday. Then, a 4 to 3 decision by the court's rightwingers ordered elections officials in the state's nearly 2,000 voting jurisdictions to immediately stop sending out absentee ballots to allow the court more time to decide if the GOP-backed Green Party Presidential ticket should be added to the ballot after the Wisconsin State Election Commission declined to do so weeks earlier. On Monday, one "conservative" joined the liberals in another 4 to 3 ruling that finds the Greens ineligible this year in the Badger State after all. State election officials are greatly relieved, as some 380,000 ballots had already gone out, and there would have been no time to re-design, re-print, re-test and re-mail as many as one million absentee ballots before both state and federal statutory deadlines this week for doing so. Both the Green Party and a separate attempt to qualify for the ballot in WI by rapper Kanye West were aided by Republican lawyers and activists in a state which Trump is said to have won in 2016 by less than one percentage point;
  • Meanwhile, both bad and good news for voters in battleground Ohio. Republicans in the state legislature on Monday voted down a proposal from a bipartisan group of election officials to cover the postage for absentee ballots. One state lawmaker who voted against the proposal (and, thus, in favor of a poll tax) from the comfort of his home during the Controlling Board's virtual online meeting, did so just one hour after reportedly learning he'd tested positive for the coronavirus;
  • In (mostly) better news for voters from the Buckeye State, a Franklin County Court of Common Pleas judge has determined that the use of absentee ballot drop-boxes does not violate state election laws. Last month, OH's Republican Sec. of State Frank LaRose issued a directive that only one secure drop-box could be used, per county, outside of County Boards of Elections. LaRose claimed state law was unclear on the matter and that the state's GOP Attorney General hadn't responded to his request for a legal opinion. So LaRose, citing the Trump Campaign's ongoing suit to block drop-boxes in battleground Pennsylvania, decided the matter on his own. State Dems sued, the state GOP intervened to oppose, and now a judge has decreed that as many drop-boxes as counties which to use is just fine according to state law.

    However, LaRose, who in a parallel case in federal court claims he is not against the use of drop-boxes, so long as the law allows it, has said he will not allow it unless he is actually ordered by the court to do so, and his office suggests they plan to appeal the state judge's ruling. LaRose, sadly, is just another hypocritical, dishonest Republican Sec. of State in Ohio, and another reminder that nobody should simply be "trusted" in an election system from any party. American elections are supposed to be built on public oversight for checks and balances, not on "trust". That public oversight is made more difficult every day by election officials who continue to use computer voting and tabulation systems that are difficult, if not impossible, for the public to oversee;

  • And in the battleground state of Nevada, where Donald Trump held another COVID super-spreader campaign event to help make more of his supporters sick --- and possibly kill them --- on Sunday, the President took to Fox and Friends today to offer a completely farcical claim about how the state's Democratic Gov. Steve Sisolak is "in charge of the ballots" and using that power to rig this year's election. Among the several problems with Trump's pathetic, whiny, evidence-free charge: the state's chief election official is Republican Sec. of State Barbara Cegavske, who oversees and certifies all election results in the state.
  • Finally, Desi Doyen joins us for our latest Green News Report as climate change-fueled Hurricane Sally approaches the Gulf Coast (with several more behind her); record climate change-intensified wildfires rage out of control in the West; Biden blasts Trump as a "climate arsonist"; and Trump tells California officials that, like COVID, climate change will just go away...

Today's BradCast in a nutshell: Elected officials lie, corporate media misinforms, people die. We try again to combat all of the above today. Wish us luck. [Audio link to today's show follow below.]

First up today, Desi Doyen joins us for the latest on the deadly, devastating, climate changed-fueled wildfire infernos wreaking havoc up and down the West Coast and on the new record hurricanes that are heading our way at the same time. With more than 3 million acres now burned, hundreds of structures destroyed in California alone, and at least 35 dead from the record blazes so far, Donald Trump went to the state on Monday and told fire officials not to worry. "It'll start getting cooler. You just watch," the President told California state Natural Resources Agency Secretary Wade Crowfoot, who was urging him to not ignore science and "recognize the changing climate and what it means to our forests." Trump's response: "Well, I don't think science knows, actually."

So, don't worry! Just as Trump repeatedly promised COVID would "just go away," (more than 190,000 Americans have been killed by it since he pulled that phony promise out of his ass), apparently the same is true for our climate crisis! Of course, our corporate media have made it much easier for Trump to misinform the nation with his lies because the corporate media have done --- and are still doing --- an horrendous job of educating the electorate about the real reasons the western fires have become so horrific and why we are now up to "V" in the named storms so far this year, with a month and half still to go in the storm season and two and a half months remaining in the wildfire season.

The media have been similarly disastrous in their education of the electorate when it comes to our woeful election system. Sadly, too many top government officials --- Democratic and Republican ones alike --- share in that blame, as we're reminded in our guest today, JENNY COHN's new short #RemoveTheModems video, warning voters about the modems that are present in voting and tabulation systems in key states --- including battlegrounds Florida, Michigan and Wisconsin --- making our entire electoral system vulnerable to hackers.

Citing the comments from officials back in 2016 falsely telling America that our voting and tabulation systems are "never connected to the Internet" (they are), so can't be hacked (they can), Cohn tells me: "I'm very worried that we're going to be gaslit again in 2020. If the electronic totals somehow favor Trump, we're going to be told to pack up and go home there's nothing to see here, he just won, 'he's a legitimate president', period."

That year, even after Democrats promised "hundreds of attorneys" on the ground to assure a legitimate election (exactly as Joe Biden's campaign did again today), the DNC and Clinton Campaign refused to demand the hand-count of ballots in the three key states (MI, WI and PA) which barely flipped to the Republican candidate for the first time in decades. That, despite the fact that had an average of just two votes been recorded for Clinton instead of Trump in each precinct in those states that year, she, not he, would have won.

"What really concerns me is the blind spot that the Democratic Party seems to have for the electronic component of potential for cheating," says Cohn. She believes, however, that at least Clinton has learned her lesson. Based on a conversation she says she had with the 2016 Democratic candidate recently, Cohen tells me: "I do believe that Hillary Clinton understands it now, and I think she understands the importance of the Democrats not boxing themselves into a corner, where they will look like hypocrites if they need to file an election challenge based on the electronic totals, or any other aspect of the election."

Whether Clinton has enough power to convince the Biden Campaign and the rest of the Party of that, Cohn suggests, is a separate question.

Cohn, an attorney, election security advocate and Twitter activist, is calling for the modems cited in her video to be removed from the systems in states which use them before the November election. As journalist Kim Zetter reported last year, many of the election officials in those states don't even realize when their private election vendor has hooked their systems up to the Internet --- some of them she reports researchers discovered, are on the net all year around!

"I have no doubt that what the Trump team wants to do is win the electronic vote on Election Day, and then try to run out the clock or do something else with the [absentee ballot] signature match, so that we don't get all of them counted," she tells Cohn argues. "Or, if it goes to a recount, it gets shut down prematurely," she says, noting correctly that Vote-by-Mail ballots are also "sent to that electronic management system too."

Cohn also discusses some of her worst fears about this year's elections (and I share some of mine, several of which are similar, especially regarding electronic pollbooks which often have no paper backup) before we take a few phone calls from listeners on the topic, with Election Day now just 50 days away. "It's going to be ugly, no matter what the official result is," she says, noting: "My biggest concern --- the overarching concern that I think we both share --- is that there won't be any transparency about the results, and therefore we'll never really know."

Multi-State legal challenges expose illegality, but it may be too late to fully repair damage even if Trump's Postmaster General is ordered to do so...

Even if several multi-state legal challenges result in a federal court order directing Postmaster General Louis DeJoy to repair the damage wrought by his allegedly "illegal" sabotage of the U.S. Postal Service's mail delivery capabilities, absent significant additional funds, it's unlikely DeJoy could fully comply with that order.

The facts laid out in one of the recently filed cases and echoed in the others, along with subsequent developments, suggest that DeJoy was, at best, disingenuous when, in an August 18 formal statement [PDF], he claimed he was "suspending" his nationwide mail sorting, labeling and delivery changes until after the Nov. 3 Presidential Election.

The complaint describes how, pursuant to an Equipment Reduction Plan [PDF], Defendants removed, dismantled and/or destroyed 671 high-speed sorting and labeling machines that had a combined hundreds of millions of dollars in value. As a result, the States allege, "some major cities have already had their ability to sort mail reduced by hundreds of thousands of pieces of mail per hour." (Emphasis in original text).

On the same day that DeJoy issued his "suspension" statement, emails were submitted by Kevin Couch, the USPS Director of Maintenance Operations, informing Maintenance Managers that, irrespective of instructions from their plant managers, they must not reconnect or reinstall sorting machines that had previously been disconnected absent approval from USPS HQ.

Last Friday, while testifying before the U.S. Senate, DeJoy made it clear that he has "has no intention" of reinstalling the sorting machines, even as he claimed that election related mail would receive top priority from the Postal Service. Contrary to DeJoy's rosy predictions, however, the USPS's own Service Performance memo reflects a significant drop in overall performance which precipitated a USPS warning to 46 states that their deadlines for Vote-by-Mail ballots "might impede the timely delivery of mail-in ballots, possibly disenfranchising millions of voters"

While there's ample reason for a court to order reinstallation, absent significant additional USPS funding, which Trump opposes, it is doubtful that DeJoy could fully undo the damage even if he were ordered to do so.

VOTERS BEWARE: Do not be lulled into a false sense of security by DeJoy's "suspension" of changes at the USPS until after Election Day, or by his unsupported assurance that USPS can timely process and deliver every ballot. The wiser course, as laid out in our previously related article, is to deposit your mail-in ballots in secure, state-supplied drop-boxes (where available) or at designated drop-off locations. Check your local jurisdictions to learn what options may be available where you live. In some jurisdictions, voters can deposit their mail-in ballots at the polls either during early voting or on Election Day. In some jurisdictions, voters can link to election official websites to track the processing of their own ballots as well...

Looks like we gotta lot of fact-checking to do today...

The good news for today's BradCast is that, thanks to so much breaking news on yesterday's show, we've got at least one encouraging new piece of news on a story that we had to bump yesterday regarding Donald Trump's absentee voter fraud felony in the state of Florida. Between that and the false claims made by him and U.S. Attorney General Bill Barr and Arkansas Sen. Tom Cotton (in the pages of the New York Times, shamefully enough) charging that "antifa" is behind the violence seen at some of the mostly peaceful protests across the country over the past week and a half, we've got a lot of fact-checking to do on today's program. [Audio link to full show is at bottom of summary.]

First, Times staffers are livid that that the paper of record gave space to Cotton for an editorial on Wednesday calling for U.S. military troops to be deployed across the country against U.S. citizens under the Insurrection Act. The far-right Republican Senator charged in the piece that "cadres of left-wing radicals like antifa [are] infiltrating protest marches to exploit [George] Floyd's death for their own anarchic purposes." His remarks echo those of Trump, who, on Sunday, declared (falsely) that antifa will be designated as "a Terrorist Organization". In fact, antifa is not an organization. It's a movement of people who oppose fascism and authoritarianism and there is no such federal designation for domestic organizations, even if antifa was one. But the calls of Trump and Barr and Cotton echo what the Times itself described as "misinformation" just two days earlier in an article debunking that myth and several others related to the protest and being circulated widely (and falsely) on social media.

Moreover, the charge that antifa is behind the violence at protests is contradicted by intelligence reports this week from both the FBI and DHS, which find little evidence of antifa involvement, but seem to find plenty of evidence that rightwing white nationalist groups have organized to instigate chaos at otherwise peaceful demonstration around the nation. Continuing video tape evidence of police violently abusing peaceful protesters, including on Wednesday night after many of the demonstrations had otherwise calmed down, doesn't help either. But this week Twitter reported they'd shut down a European white nationalist group posting as "@ANTIFA_US" and tweeting out, for example, messages with a brown raised first emoji and declaring: "Tonight's the night, Comrades. Tonight we say 'F--- The City' and we move into the residential areas... the white hoods.... and we take what's ours."

While that account has been shut down, the white nationalists on the street have not all been. We still do not know the identity of the white man with full face gas mask (pictured above) and a black umbrella, who strolled down the sidewalk in front of the Minneapolis AutoZone last week with a hammer by his side, casually smashing each window of the store. Protesters tried to stop him and to identify him before he slipped away, leading Minnesota Attorney General Keith Ellison to post the video of the man on Twitter, along with the remark: "This man doesn't look like any civil rights protester I have ever seen. Looks like a provocateur. Can anyone ID him?"

And yesterday, in Las Vegas, AP reported on terrorism charges filed against three Nevada men with ties to a rightwing extremist group. They were arrested on Saturday heading to a protest on the Strip after "filling gas cans at a parking lot and making Molotov cocktails in glass bottles," according to the criminal complaint obtained by AP. Two of the men, according to an informant, "discussed causing an incident to incite chaos and possibly a riot, in response to the death" of George Floyd. They are all said to be members of the anti-government "boogaloo" movement, advocating for a new civil war.

It seems its easier to find strawmen to blame for years of systemic racism rather than take responsibility for it. That seems to be what Trump, Barr, Cotton, Fox "News" and all the rest of those looking for someone else to blame for Floyd's death and the resulting outrage seem to be doing. It doesn't seem to be working. But that won't stop them from trying to play a whole bunch of folks just months before the next Presidential election.

Speaking of...as we reported several weeks ago, Donald Trump --- who has been making myriad false claims about absentee voter fraud for weeks now --- is, himself, a voter fraud criminal after illegally voting in Florida this year, by absentee ballot, despite having no lawful permanent residence in the state.

While he claimed late last year to have moved his permanent residence from New York to his Mar-a-Lago club in Palm Beach, his original 1993 agreement with the city when he purchased the property and turned it from a single-family residence into a commercial club, required that nobody could actually live there. So, yes, that is voter fraud, and people in Florida have been charged and even jailed for much lesser infractions of the Sunshine State's elections code.

Yesterday, the Washington Post reported another noteworthy point or two on this story, with yet another update to it today. On Wednesday, the paper reported that Trump, when he filed his Florida voter registration [PDF], listed the White House at 1600 Pennsylvania Ave. as his "legal residence". That means his legal residence is not in Florida and he is, therefore, not allowed to vote there. A month later it appears he tried again, this time specifying Mar-a-Lago's address as his "legal residence." It's unknown what happened in the 31 days between the first and second registration, but maybe Florida generously granted him a mulligan. Of course, that still doesn't make his declared residence at his commercial property in Palm Beach a legal domicile in the state.

Making his case even worse, on Monday, during his infamous phone call with the nation's Governors (in which he described peaceful protesters as "terrorists" and instructed the Governors to "dominate" them or he would send in U.S. troops to do so), he stated: "I live in Manhattan". Oops. That prompted Democratic election attorney Marc Elias to tweet: "Sounds like New York may have a good claim for taxes. And Florida for voter fraud."

And, on that point, the Post updated its story today with the news that a Florida resident has now filed a formal election fraud complaint against Trump, which is what we've been calling for weeks! Under Florida law, the state is now required to investigate the complaint. And because it's a violation of state, not federal, law there is nothing to my knowledge that should prevent the President from being charged with felony voter fraud there. He did it. He should be charged with fraud.

When we painstakingly detailed the voter fraud by former GOP superstar Ann Coulter more than a decade ago after she illegally lied about her address in Palm Beach on her registration application and then unlawfully voted at a precinct she was not entitled to vote in, the state slow-walked their investigation until the statute of limitations ran out. (She also got a helping hand from a former FBI boyfriend). We'll hope that Florida Law Enforcement doesn't try something similar here. Though it would be much harder to do in this instance, given that the crime happened just months ago in this case.

Guest: Former insurance exec Richard 'RJ' Eskow; Also: More Early Voting probs for L.A. County's new, unverifiable e-voting systems...

On today's BradCast: A former insurance exec says Medicare for All is better than even the best union healthcare plans, more problems with L.A. County's new, unverifiable touchscreen voting systems ahead of next Tuesday's Super Tuesday, and Desi Doyen "celebrates" another birthday...

First up, financial markets continued to plummet on Tuesday after a senior official at the Centers for Disease Control and Prevention (CDC) --- which Donald Trump has been gutting and/or attempting to gut since taking office --- announced Americans should prepare for the spread of the Coronavirus, declaring "It's not so much a question of if this will happen any more, but ... when this will happen and how many people in this country will have severe illness."

At the same time, with that cheery news, the Democratic Presidential primary campaign moves forward after Bernie Sanders' landslide win at the Nevada Caucuses on Saturday, with many members of the Party establishment concerned about the likelihood of his nomination. One of their concerns is Sanders' decades-long campaign to establish healthcare as a right, not a privilege, in the U.S., as illustrated by his Medicare for All (M4A) proposal. That plan, and its end to private health insurance in the U.S., was the source of concern by leadership of NV's powerful Culinary Union before the caucuses last week. Its members, however, according to Entrance Polling, were strong supporters of Sanders, a longtime champion for the labor movement, on caucus day nonetheless.

At issue with Sanders' (and Elizabeth Warren's) M4A proposal is the fear of the loss of top-flight, hard-earned health care benefits for the Culinary Union workers. The union has negotiated one of the nation's best health care programs, with leadership worried about losing those benefits under M4A. It's a fear shared by many Americans who are nervous about the prospect of losing their existing private health care coverage, while being misinformed about how the program would actually work.

RICHARD "RJ" ESKOW, however, a former insurance executive turned political columnist, policy analyst and host of The Zero Hour, argues this week in an detailed analysis at The Intercept that, while the Culinary Union's plan is top notch, Medicare For All would actually be even better for them in many ways. He joins us today to explain why he finds that not only those union members would be better off under Sanders' plan if passed as currently proposed, but so would all Americans.

Eskow details his analysis of that union's very good health plan --- which, he tells me, "makes it a perfect test case, in a sense, for comparing Medicare For All to the best plans --- and how M4A would still be better. "My hat's off to the Culinary Union and to the workers, who went on strike and fought for years to get this plan, in the current environment we have now. It's just about as good a plan as you're going to see," Eskow says. "It's well ahead of most other plans, private insurance plans, private employer plans, whether they are union or otherwise. It's really one of the best." Nonetheless, he argues, after detailing all of the excellent benefits for those workers, "Medicare For All gives better benefits."

He also goes on to answer many questions that skeptics and/or critics of universal single-payer coverage --- from both the Left and the Right --- likely have.

Also today, we look forward, again, toward the crucial South Carolina Democratic Presidential Primary on Saturday and concerns about the state's new, 100% unverifiable touchscreen voting systems that all voters will be forced to use at the polls (despite myriad failed elections on similar equipment made by the same vendor, ES&S, the nation's largest.) And I've got a correction about a point I made on this topic on yesterday's show.

Then, we look again at more failures already revealing themselves here in L.A. County in advance of the March 3rd Super Tuesday Primary --- just three days after South Carolina --- in California and more than a dozen other states. Problems with L.A.'s brand-new, 100% unverifiable, $300,000,000 touchscreen voting systems surfaced over the weekend on the first day of Early Voting last Saturday, when several Voting Centers in the County were unable to open for hours, as equipment problems left workers unable to set up the new, complicated, Internet-connected computer pollbooks and voting systems.

Those problems continued on Monday, as reported by CBS2-LA's David Goldstein last night. He followed up his earlier investigative report on the new systems several weeks ago (in which I was featured) with another report on Monday night, finding Voting Centers still down in some areas, with one poll worker seen examining the system's user manual for clues and another bemoaning the idle voting systems: "They're not working because the router....we're waiting for AT&T to come," she says.

Oh, brother. 1,000 of these new Voting Centers with all new equipment, replacing 5,000 community precincts used for decades in L.A., are all supposed to be up and running by next Tuesday. Though, even if the new VSAP ("Voting Solutions for All People") systems work as designed, the results of next Tuesday's election will still be 100% unverifiable after the polls close.

Also: Super Tuesday Early Voting began this weekend on L.A. County's new, unverifiable touchscreen vote systems. How do you think it went?...

On today's BradCast: A look at what happened over the weekend in Nevada, and a look ahead at wait awaits in South Carolina on Saturday, Super Tuesday three days later, and yes, even beyond. [Audio link to show is posted below.]

So, the Caucuses in Nevada over the weekend went only slightly better when it came to reporting results than the Iowa Caucuses two weeks ago. But, because Bernie Sanders appears to have won in a rout there, the corporate media declared as much and didn't seem to be bothered, or even much notice, that it took another three days before all results were actually in. (Proving once again that corporate media is interested in headlines, not about making sure that voters see their votes counted accurately.)

We cover the reported results out of NV today, beginning with Sanders' landslide victory there, and the fight for runners-up, with Joe Biden coming in second over Pete Buttigieg, followed by Elizabeth Warren in fourth place. She was followed in turn by Tom Steyer and then Amy Klobuchar.

But the night belonged to Bernie. He received well over twice the number of votes than his nearest competitor (Biden) in NV. Buttigieg challenged the reported results from the Saturday caucuses and attacked Sanders during his post-caucus remarks to supporters in a way that Republicans should be very happy about (and in a way that Sanders would have been justifiably excoriated for, had he done anything similar in either 2016 or in this year's cycle.) We explain all of that on today's show.

We also look forward to this Saturday's important Primary in South Carolina and to Super Tuesday in 14 states just three days later on March 3rd. In SC, Biden's once seemingly-insurmountable lead in pre-election polling appears to be slipping, even as he retains a small edge over Sanders there, according to NBC/Marist, as of today.

At the same time, the national polls are seeing some movement as well, with Warren surging into second place behind Sanders and ahead of Biden in a new CBS/YouGov poll out today, reflecting what many regard as her strong debate performance last Wednesday. Their performance, however, was not reflected in the NV Caucuses given, that most caucus-goers had already voted before the debate in Early Voting (which was used for the first time there this year.)

So, with Sanders the front-runner at the moment, having won the popular vote in each of the first three primary/caucus states, members of the "Democratic Establishment" and their media supporters appear to be, well, freaking out a little bit. We play some of that freak out and discuss.

For the moment, however, all eyes are now on South Carolina, where voters across the entire state will be forced to vote on brand-new, 100% unverifiable touchscreen Ballot Marking Devices (BMDs). The new systems, made by Election Systems and Software, Inc., replace the state's old 100% unverifiable touchscreen Direct Recording Electronic (DRE) systems, also made by ES&S. Their systems have failed in election after election over the past decade in the Palmetto State and elsewhere. But, of course, even if they work as designed this Saturday in the SC Primary, it will still be 100% impossible to know after polls close if any ballot cast on the expensive devices actually reflect the intent of any voter.

That's just one of the problems --- though, one of the biggest --- with BMD voting systems. In Los Angeles County --- which has more registered voters in it than the entire state of South Carolina has people --- the Early Voting period for the March 3rd Super Tuesday primary (which will be held in 14 states) began on Saturday. We've been covering L.A. County's brand-new, $300,000,000 touchscreen BMD voting system for some time (about a decade in fact), warning about many of its failures and potential failures.

So, how do you think the first day of Early Voting went in L.A.? According to this report, and some of our own reporting as well, it did not go well, with officials unable to start up the new e-voting systems at all for several hours in a number of locations, some locations where the equipment didn't even arrive in time for Saturday's Early Voting, and an absense of the paper write-in ballots that were supposed to be available at every polling site as the first "condition" in the CA Sec. of State's recent "conditional certification" [PDF] of L.A.'s new "Voting Solutions for All People" (VSAP) touchscreen system.

In the hours just before former Republican and current billionaire Michael Bloomberg makes his bought-and-paid-for debut on the Democratic debate stage in Las Vegas, our guest on today's BradCast has a bit of a disturbing scoop about Bloomberg's past comparisons between the AARP and the NRA! [Audio link to full show follows below.]

But, first up first up today, some good news from the courts on voting rights in two different key Presidential battleground states! In Florida, a federal appeals on Wednesday sided with ex-felons suing the state to block a law that prevented many of them from having their voting rights restored after the landslide passage of state constitutional Amendment 4 in 2018. After the landmark measure passed with big bi-partisan support to restore voting rights to some 1.5 million former felons (including 1 of 4 African-American men in the state) upon completion of their sentences, the state's new Republican Governor and GOP legislature muscled through legislation to block those former felons from voting until all court fees and fines have been paid off.

Today's federal appeals court ruling blocks that voter suppression measure, finding that "denying access to the franchise to those genuinely unable to pay solely on a account of wealth" is a violation of the U.S. Constitution's Equal Protection clause.

There is similarly good news today from the state Court of Appeals in North Carolina, which ruled the Photo ID voting restrictions enacted by Republicans (a measure vetoed by the state's Democratic Governor last year, but overridden by the gerrymandered GOP majorities in both statehouse chambers) disproportionately disenfranchises poor and minority voters.

Despite little or no evidence of polling place impersonation --- the only type of voter fraud such laws could possibly prevent --- the NC GOP has been trying since at least 2013 to impose such discriminatory voting restrictions in the Tar Heel state. Their most notorious attempt, in 2013, was eventually nixed by a federal court which found the law was specifically designed to "target African-Americans with almost surgical precision" and to "impose cures for problems that did not exist." Another similar ruling recently against the state's new measure by a federal court, blocked the law from taking effect before NC's March 3rd Primaries. The new state appeals court decision is likely to also bar the measure until after the 2020 general election in one of the nation's most closely divided battleground states.

Then, it's on to electoral politics, with still more new national polling today showing Bernie Sanders vaulting into double-digit leads over all of his Democratic Presidential rivals. And while Sanders is frequently dismissed by corporate media, even as the front-runner (as we demonstrate again today), an even more curious case of the erasure of Elizabeth Warren by corporate media has made itself maddeningly clear in a new NBC/Wall Street Journal poll out this week.

We explain how Warren was disappeared, in part, from a key question in that poll, despite placing third in the national delegate race to date and largely tying for second or third place in most of the recent national surveys. That, while candidates like Amy Klobuchar and Pete Buttigieg continue to receive a great deal of media attention while still polling only in single digits nationally.

Meanwhile, having no trouble at all receiving national coverage of late, is former Republican, recently-declared Democrat, and longtime billionaire Michael Bloomberg. While Sanders has skyrocketed in polling, Joe Biden has taken a dive, and Bloomberg appears to be surging at his expense. That is thanks, in no small part, to the former NYC Mayor's unprecedented blanketing of the national airwaves with his political propaganda ads. With his late polling surges, Bloomberg will appear, for the first time, on the Democratic debate stage tonight in Las Vegas before this Saturday's Nevada Caucuses (where he isn't even on the ballot.)

We are joined today by investigative financial journalist, author and Executive Editor of The American Prospect, DAVID DAYEN, who has been covering Bloomberg's long and disturbing record quite closely. Earlier this week, Dayen detailed how Bloomberg's life and career mirrors Donald Trump's in a number of disturbing ways, while cautioning about the dangers to both democracy and the Democratic Party itself of the "plutocrat-on-plutocrat election" that would be in store if Bloomberg wins the nomination.

"This is a hostile take-over of the Democratic Party. Much like Trump was a hostile take-over of the Republican Party," Dayen argues today. "I'm worried about the shell-shocked nature of the Democratic electorate that has given up on democracy and thinks the only way to beat their plutocrat is with our plutocrat. That concerns me for more reasons than just the Bloomberg nomination. It concerns me that people are so despondent that they think democracy doesn't work anymore. That leads us down a very dark road."

Dayen also has a scoop today, as published with Alexander Sammon at The Prospect, on Bloomberg's recent history of comparing the American Association of Retired Persons (AARP) to the National Rifle Association (NRA), as part of his "decade-long history of promoting cuts to the social safety net" in his advocacy to slash Social Security, Medicare and Medicaid as deficit reduction measures.

All of which raises serious questions about what the Democratic electorate must be thinking in their current, apparently growing support for Bloomberg to become the Party's standard-bearer in 2020. Dayen has many thoughts on that, as do I on today's program...

Prez issues crony pardons; Calls for Barr resignation grow, DoJ crisis worsens; Bloomberg, Sanders rising; NV Caucus meltdown worries...

We've got a lot to catch up on on today's BradCast after a long holiday weekend, as the crisis of rot and corruption inside the once-revered U.S. Dept. of Justice continues to metastasize under Donald Trump and Attorney General Bill Barr; as billionaire Michael Bloomberg buys his way into shaking up the 2020 Democratic Presidential race; as the Nevada Caucuses may be heading toward another embarrassing meltdown this weekend; and as our ongoing, literal planetary meltdown continues. Among the stories covered on today's packed program...

  • Amid an already deepening crisis at the Justice Dept., Trump went on a "clemency spree" on Tuesday, issuing pardons to a long list of crooks, cronies and n'er do wells --- many of them personal friends of the Prez, natch --- from former Illinois Gov. Rod Blagojevich (who attempted to sell a U.S. Senate seat), to Rudy Giuliani pal and former NYPD Commission Bernie Kerik (who lied to the Dept. of Homeland Security), to the former owner of the San Francisco 49ers (who bribed a Louisiana Governor for a riverboat casino gambling license.) Those are just some of the liars, tax frauds and scam artists like Trump who received get-out-of-jail free cards today, in hopes, we surmise, that someone may do the same for Trump some day, once the law finally catches up with him. And it will;
  • With the American system of justice now in full and active breach at the DoJ under Barr's corrupt leadership, the calls for his resignation have grown impossible to ignore in the wake of his unprecedented overruling of career line prosecutors' recommendations for criminal sentencing of longtime Trump confidante Roger Stone and former National Security Advisor Michael Flynn (among other wildly corrupt actions he's taken of late and since taking office last year.)

    Former Deputy Attorney General Donald Ayer, appointed by George H.W. Bush, describes "Bill Barr's America" as "a banana republic where all are subject to the whims of a dictatorial president and his henchmen," in a new Atlantic op-ed while calling for a "public uprising demanding that Bill Barr resign immediately, or failing that, be impeached."

    More than 2,000(!) former DoJ officials, both Democratic and Republican, have now signed on to a Sunday public letter declaring Trump and Barr "have openly and repeatedly flouted" the concept of equal justice in the U.S., and demanding Barr step down, citing "damage" that Barr's actions "have done to the Department of Justice's reputation for integrity and the rule of law."

    And, in the wake of all of this --- and the President's continuing Twitter attacks on the U.S. District Court Judge overseeing Roger Stone's case and upcoming sentencing --- the Federal Judges Association, a group of more than 1,000 jurists, has now called an "emergency meeting" for Wednesday to discuss related issues that, according to its President, George W. Bush-appointed U.S. District Judge Cynthia Rufe, "could not wait" until the group's spring conference scheduled for April;

  • Meanwhile, the Democratic and democratic efforts to replace Trump in November's election continue apace, as Nevada Democrats address security concerns about their upcoming Saturday caucuses by switching to electronic voters! (Okay, that one's from The Onion, but still, it shouldn't be long);
  • The Dominican Republic sets an example that Americans might want to pay attention to, by suspending their weekend election just a few hours after polls opened due to failed electronic voting systems. (Who could have seen that coming?);
  • Billionaire Michael Bloomberg turned Presidential candidate turned self-declared reformed racist and misogynist, buys his way onto Wednesday's Democratic Presidential Debate stage in Las Vegas, even though he will not be on the ballot at Saturday's caucus there. Bloomberg, it was announced on Tuesday, will appear at the forum, after qualifying in several national polls, including a second place finish in a new NPR/PBS/Marist national poll and a virtual tie for second with Joe Biden in a new NBC News/WSJ survey. In both of those national polls, Biden has plummeted and current front-runner Bernie Sanders has taken double-digit leads over his nearest competitor;
  • But, according to news reports from Washington Post, Politico and others over the weekend, the Nevada Caucuses could be a "complete disaster" mirroring Iowa's just two weeks ago. Under-trained caucus leaders, a lack of communication between the state party and the candidates' campaigns about the complicated process, and the use of an iPad "Caucus Calculator" could lead to a meltdown, many fear. If the hours-long lines at last weekend's Early Voting sites are any indication, state Dems may, once again, be in way over the heads. But we'll see;
  • In slightly brighter primary news, late last week California Governor Gavin Newsom signed a last-minute bill into law that will allow Golden State voters to change party registration up to and on Election Day itself. That seemingly very smart move may help the state avoid some, if not all, of the expected confusion and potential meltdowns at their own March 3rd Super Tuesday primary in the state with the most Democratic delegates at stake (415 of them) in this year's nominating contest;
  • Finally, Desi Doyen joins us for our latest Green News Report, as Antarctica breaks another stunning heat record, Mississippi gets swamped, Trump's EPA allows the return of toxic mercury even though the Obama-era regulation was a tremendous success and the utility industry doesn't even want him to, and some very big news from CNBC's Wall Street guru Jim Cramer declaring fossil fuels "over!"...
