We've been telling you for years on The BradCast that most rightwingers who claim to be "Constitutional Conservatives" --- such as the corrupted bunch now packed onto the Republican U.S. Supreme Court supermajority --- are nothing of the sort. Today's oral argument at SCOTUS, on whether Donald Trump must be disqualified from the 2024 ballot under the very clear text of the Constitution's "Insurrectionist Disqualification Clause", appear set to prove that point yet again. [Audio link to full program is posted below this summary.]

In December, the SCOTUS Appears Set to Ignore Text of Constitution's 'Insurrectionist' Clause: 'BradCast' 2/8/2024 found Trump had violated Section 3 of the 14th Amendment, which bars from office public officials who, after taking an oath to support the Constitution, "have engaged in insurrection or rebellion against the same". The mandate applies, according to the actual text of the clause, to "any office, civil or military, under the United States, or under any State". The Colorado Supremes compiled an airtight, 200+ page ruling [PDF] that was both "textualist" (adhering to the simple text of the clause) and "originalist" (carefully hewing to the original intent of its post-Civil War framers) in order to appeal to the legal principles supposedly most important to the Republican majority at SCOTUS.

The CO court, finding that Trump had indeed "engaged in insurrection" and was thus barred from holding the office of President of the United States, disqualified him from the state's 2024 Presidential ballot. Trump appealed their ruling to the U.S. Supreme Court, which heard the case on Thursday. (Transcript, audio)

While we can't know for certain from questions asked at the hearing, the Justices appear set to simply ignore the clear meaning of the text of 14.3 in order to allow Trump to run for President this year. Arguments put forward today for doing so --- some of them preposterous and in direct conflict with the framer's intent, according to the Congressional Record at the time the 14th Amendment was adopted --- include that the President is not an officer of the United States; that 14.3 bars insurrectionists from holding office, but not from running for office; and that the clause, unlike every other section of the 14th Amendment, is not "self-executing". Rather, Congress must create legislation before it can be used against a federal official. (Never mind its history over the past 150 years or so.)

We're joined today to somehow make sense of all of this by former U.S. Deputy Asst. Attorney General LISA GRAVES, now of True North Research, and retired attorney KEITH BARBER, who writes on legal and Constitutional matters as 'KeithDB' at Daily Kos. They both joined us just after Trump filed his appeal to the High Court earlier this year and do so again today to discuss how it all appears to be working out for him.

A fair amount of time during Thursday's hearing was spent on the argument that Section 3 allows Congress, by a two-thirds majority vote in each chamber, to waive disqualification for insurrectionists. Thus, the argument goes, Trump can still run for President, even if he cannot "hold" the position if elected. That's because Congress could, ya never know, decide to grant him amnesty after he is elected and before he is sworn in to office.

Graves characterizes the argument as "absurd", describing it as "counter to the plain-language, commonsense argument on its face." It could also, as the attorney for the challengers (a group of Republican and independent voters), noted today, result in the same Congressional chaos on January 6, 2025 that we saw in 2021. If Trump were to win, but Congress fail to grant him an insurrectionist's waiver, he would be barred, according to 14.3, from actually being sworn in to office. SCOTUS seems to be begging for this scenario based on much of today's questioning.

Barber suggests it is likely "that challenges are raised in the electoral certification process" if Trump wins in November, "saying that Trump is not eligible for the office, and any Electoral College votes for him must not be counted for that reason."

"The meaning" of Section 3 of the 14th "could not be clearer in the intent of the drafters," argues Graves. "These supposed 'originalists,' these supposed 'strict constructionists' claim to be so devoted to it when striking down access to abortion, marriage equality, our ability to regulate corporations. But here, suddenly they're confused. It's not confusing if you look at the history and read it."

Indeed, the Justices --- including at least two of the Court's liberals --- appear set to come up with a reason or set of reasons that the Constitution doesn't say what it actually says. Why, for example, does Section 3 --- unlike the other sections of the landmark 14th Amendment, such as the requirement for Due Process under the law for all U.S. persons --- suddenly require a law to be written by Congress before it can be executed? (But only against Trump, apparently. It's been used without issue many times in the past.) "In this case, it's because the Supreme Court needed it to be," says Barber, a former lifelong Republican. "I don't have a better explanation than that."

"Are we living under the Constitution or not?," asks Graves. "It seems we are, only to the extent that this faction of the Court wants to impose it. And when it doesn't, it does not apply."

We discuss much more on all of this today's, including why Clarence Thomas (and, perhaps three other Justices on the Court) have not recused themselves from this case given their extraordinary conflicts of interest; whether there is a "grand bargain" in the works to strike down the CO Supreme Court's mandate while upholding the D.C. Court of Appeals' ruling this week on "Presidential Immunity"; and how the attorneys arguing on behalf of Colorado voters missed the opportunity to underscore that, as bipartisan majorities in both chambers of Congress have already voted, Donald Trump is an insurrectionist.

As noted on today's BradCast, CBS News' legendary radio and TV broadcaster Charles Osgood has passed away at age 91. Other than that, we've got some arguably much brighter news throughout the bulk of today's program. [Audio link to full show follows this summary.]

Among the many stories covered today...

  • Last night, just after midnight, Nikki Haley won every single vote cast in Dixville Notch, New Hampshire, the first town in the state to vote in the state's first-in-the-nation Primary on Tuesday. They had a 100% turnout. Haley won all 6 votes. Donald Trump won 0. We discuss why that matters (and doesn't). Voters across the entire state are voting today on hand-marked paper ballots. In Dixville Notch --- and about 40% of towns in the state --- ballots are publicly hand-counted by human beings after polls close. The rest of the towns, the larger ones in general, are tallied by 15 or 20-year old computerized optical scanners. Though, due to a write-in campaign for Joe Biden in the state, where there is no officially sanctioned Democratic primary, most of those towns will be hand-counting a lot of ballots as well. We'll have full reported results out of NH --- and why they matter (or don't) --- on tomorrow's show, of course.
  • For years, Republicans have been citing evidence of miscounted votes in Prince William County, Virginia as evidence of massive fraud in the 2020 Presidential race. The state's Republican A.G., after taking office in 2022, even filed criminal charges against the County's Registrar. Recently, however, the charges were unceremoniously dropped. And now we learn that, due to largely understandable tabulation errors, Joe Biden should have received 1,648 more votes than he was credited for, and that Donald Trump was given 2,327 votes that he shouldn't have, in a county that Biden won by more than 60,000 votes --- in a state where the Democrat won the Presidential race by some 450,000 votes. Races for U.S. Senate and U.S. House were also affected by the counting errors, though none of errors would reportedly have changed the results of any contest. We explain the whole mess.
  • We've got quite a bit of good news for you today when it comes to redistricting and rolling back GOP racial and partisan gerrymanders! In North Dakota, a federal judge has ordered new state legislative map after Republicans, following the 2020 Census, cracked two Native American reservations into different districts in order to flip both state House and Senate seats from D to R. It worked in 2022. But now, the judge has ordered not only new maps, but also new elections this fall in the districts found to have been in violation of the Voting Rights Act.
  • Louisiana's new Republican Governor approved a new U.S. House map for the state this week, after the GOP state legislature finally adopted it last week, following a federal court order to draw an additional majority-Black voting district in the state. The Republican-controlled legislature previously had just 1 such district out of its 6 Congressional seats, despite African-Americans accounting for nearly a third of the statewide population. GOP lawmakers only agreed to do so after many appeals, and after realizing that if they didn't draw up their own maps, the court would do it for them. The new map will likely result in an additional Democratic member of Congress from the Bayou State next year.
  • And, in Wisconsin last week, voters filed a motion with the state's newly liberal-leaning Supreme Court seeking a new U.S. House map in time for the 2024 elections. Last month, the state's high court agreed with petitioners that the state GOP's state legislative maps for the Assembly and Senate, in place for more than a decade, were unlawful gerrymanders in violation of state Constitutional requirements. The new motion filed last week asks the same Supreme Court to order a new U.S. House map as well, on the same basis that the Justices determined the state legislative districts were unconstitutional. Petitioners argue that the unconstitutional and politically gerrymandered map resulted in Republicans winning 75% of the state’s Congressional seats despite winning just 50% of the statewide vote in the 2022 election. That year, the closely divided, if Dem-leaning Presidential battleground state also re-elected its Democratic Governor in the same statewide election.
  • Finally today, San Diego was deluged on Monday with a year's worth of rain in a matter of three hours, overwhelming infrastructure in the usually mild Southern California city. But, as discussed in our latest Green News Report today with Desi Doyen, it was just one of dozens of cities across the U.S. in recent weeks where infrastructure has been hammered by climate change-fueled extreme Winter weather. Nearly 100 have been killed in the recent storms in a number of states as of airtime. That, as Big Oil gears up a multi-million ad blitz to hoax Americans into supporting fossil fuel friendly candidates in 2024, as the unstoppable transition to clean, renewable energy is finally underway...

The New York Judge in state Attorney General Letitia James' $250 million civil fraud lawsuit against Donald Trump, the Trump Organization, his eldest sons, Don Jr. and Eric, and two top company executives, ruled [PDF] that they all committed years of "persistent and repeated fraud" to the tune of billions of dollars by inflating the value of company assets when applying for bank loans. They also decreased the value of the same properties to receive favorable terms on both insurance and taxes, according to the ruling.

Judge Arthur Engoron found in favor of the state's key contention during the summary judgment phase of the landmark case on Tuesday, before the non-jury trial is slated to begin next Monday. Trump's attorneys had also sought summary judgement, hoping to see the case thrown out entirely. Instead, the key issue has already been decided against them and Engoron, in a brutal ruling, has stripped the former President, his company, his sons and execs, of control over several of his main New York properties. The Trump Organization and its various LLCs were placed into receivership to be controlled by court-appointed officers!

In the massive fraud suit, James seeks to permanently revoke the Trump family's license to do business at all in New York state. The trial, set to begin next week, will now determine the other issues at stake and the full breadth of penalties. Of course, Trump will appeal everything. But, make no mistake, this is a huge verdict against the failed former President and current 2024 GOP frontrunner who, as validated by Judge Engoron today, has built his business empire on decades of fraud and lies.

Among the many other important stories also covered on today's program...

  • Cassidy Hutchinson, star witness at last year's House January 6 Committee hearings and the former top aide to Trump's final Chief of Staff, Mark Meadows, warns that Trump "almost destroyed democracy in one day and he wants to run for President do it again."
  • This week's second GOP Presidential Primary debate, at the Reagan Library here in Southern California, will feature the same candidates as last month's debate in Milwaukee, other than former Arkansas Gov. Asa Hutchinson, who apparently did not meet the RNC's criteria. Trump was also not invited for refusing to sign the party's loyalty pledge, but he had already announced he wouldn't participate in any of their debates.
  • Labor economist Kathryn Anne Edwards offered a must-listen response to Louisiana's loopy U.S. Senator John Kennedy during a Senate subcommittee hearing last week on post-pandemic child care concerns. While Kennedy suggested he really really wanted to help, he had no idea where, oh, where the federal government could possibly find the money to do so. Edwards' straightforward, well-supported answer: Raise taxes on the wealthy that you've been lowering for the past two decades if you really care about children in need.
  • In a related matter on Tuesday, Joe Biden became the first sitting U.S. President, incredibly enough, to join a picket line with striking workers. In this case, he called on striking United Auto Workers members in Detroit to "stick with it," as he rallied workers with UAW President Shawn Fain. On Wednesday, the former President is set to speak at a non-union facility in a "red" county outside of Detroit.
  • California Governor Gavin Newsom signed a bill into law today that doubles the tax on sales of guns and ammunition in the state to help pay for increased school safety measures. While the federal government already charges a 10% tax on guns and ammo, California doubled it with one of their own, becoming the first in the nation to do so.
  • Bona fide good news today from our corrupted, packed and stolen U.S. Supreme Court. They rejected Alabama's attempt --- once again --- to violate the Voting Rights Act with a racially gerrymandered U.S. House map. Last June, in a surprising 5 to 4 ruling, with Chief Justice John Roberts and Justice Brett Kavanaugh joining the Court's three liberals, SCOTUS ordered the state to create a second majority black U.S. House District. Just 1 of 7 districts is currently a majority minority district despite African Americans comprising more than a quarter of the state's population. But Alabama Republicans, blatantly defying the U.S. Supreme Court, redrew their districts without including a second black majority district as mandated. A federal court panel then ordered a Special Master to draw up a new map instead. Alabama tried to stay that decision at SCOTUS, which unanimously rejected the state today in a one sentence ruling. That is good news for voters and bad news for several other GOP-controlled states trying the same gambit to cheat their way to a Republican majority in the House again next year.
  • Speaking of the Republicans' narrow majority in the U.S. House, it appears next to impossible at this hour to believe they will be able to agree amongst themselves on a spending bill to keep the federal government open as of Saturday. At least not without either Democrats saving them and/or House Speaker Kevin McCarthy losing his job as Speaker.
  • New Jersey's Democratic Sen. Bob Menendez, federally indicted for a second time late last week on charges of bribery and corruption, maintains his innocence. But the flood of fellow Democratic U.S. Senators calling for his resignation seems all but unstoppable now, with at least six of them --- including fellow NJ Senator Corey Booker --- calling for Menendez to step down. The charges, by the way, would seem to dramatically undercut Trump/GOP claims that the DoJ has been "weaponized" by Democrats against them.

Guest: Thomas Frank of E&E News; Also: Globe continues to swelter; GOP's climate change 'solution'; Trump loses again in federal court...

Just last week, amid record temperatures, massive flooding and the choking smoke across a dozen states from hundreds of wildfires, U.S. House "Freedom Caucus" Chair Rep. Scott Perry (R-PA), partying like it's 1999, declared during a Congressional hearing that climate change is "a problem that doesn't exist." Today's BradCast, demonstrable scientific facts, and the insurance industry running for the exits from Ron DeSantis' Florida, all beg to differ. [Audio link to full show follows below this summary.]

First up, it was another humiliating loss for the disgraced former President in court today, as a federal judge soundly rejected Donald Trump's effort to move Alvin Bragg's 34 felony count indictment in New York from state to federal court. The judge found in his order that, "Hush money paid to an adult film star is not related to a President’s official acts. It does not reflect in any way the color of the President’s official duties." Thus, the criminal case against Trump will remain in state court and Trump will not be allowed to have the Dept. of Justice substituted as defendant instead of him. He will have to answer for his own acts of fraud in paying out nearly half a million dollars --- while serving in the White House --- in hopes of covering up his payoffs to a porn star to help him win the 2016 election.

Beyond that, no more Trump news for today! (You're welcome!) Though we've got a lot of consequences from our worsening climate crisis which may or may not be more welcome.

A few House Republicans, of late, are pretending they are not climate crisis deniers anymore. Their plan: Hugely increase the production of the fossil fuels that are responsible for global heating, but plant a whole bunch of trees --- a trillion of them, in fact (which would require a space as large as the continental U.S.) --- to make balance it all out. Or something. The ridiculous plan, of course, wouldn't even come close to working. We discuss.

Then, after a quick spin around the nation and globe today, through hundreds of shattered heat records and sweltering cities and tourist attractions throughout Europe and the U.S. over the past several weeks (with no end in sight), we land back in Florida, where the insurance industry continues to head for the doors. Last week it was Farmers. This week, AAA. There are no climate denialists, as it turns out, in the insurance actuarial business.

Premiums for homeowners insurance have risen about 7% over the past year nationwide, on average. But they have spiked some 40% in Ron DeSantis' Florida as ocean temps in the south of the state reach bathwater temps of over 90 degrees. All a recipe for hurricane disaster as this year's storm season is barely underway.

We're joined today by Pulitzer Prize finalist THOMAS FRANK, climate impacts reporter for E&E News, where he focuses on disasters, disaster recovery and federal efforts by FEMA and other federal agencies to serve as a backstop to the growing number of billion dollar disasters across the nation.

We spoke with Frank last year, just after Hurricane Ian devastated parts of Florida, including parts inland where few even bother to buy flood insurance. Even if they want to now, it's nearly impossible for many to afford it.

"The recent news involving Farmers, one of the nation's largest insurance companies, and AAA, is the opposite of what the Governor and the State Legislature envisioned happening when they had a special session back in December and enacted a couple of laws aimed at bringing insurers back. Those are very bad signals," Frank explains, detailing why the state's insurance market continues to collapse, along with fears that the housing market itself may not be far behind.

But the DeSantis denial continues. Last week, the Florida Governor and 2024 GOP hopeful invoked what one media wag describes as his "wish upon a star" strategy. DeSantis claimed insurance companies would soon return to the state. "I think they're gonna wait through this hurricane season," he told rightwing radio host Howie Carr, before adding, "Knock on wood we won't have a big storm this summer."

It's not only Florida, of course, though it is a canary in the national coal mine. The climate crisis --- created by the burning of fossil fuels --- is flashing bright red warning signs everywhere at this point, even as the fossil fuel industry and mostly Republican politicians they have bought off, continue to shamefully ignore, obfuscate and lie about it as long as they can.

"The phrase you use, 'canary in the coal mine' is completely appropriate," Frank tells me. Florida, he says, is "a canary in the coal mine for hurricane-prone states. California is the canary in the coal mine for wildfire-prone states. People in Colorado, Oregon and Washington should be watching California. It's a similar scenario unfolding there."

"What you're starting to see happen is the insurance industry is becoming aware of climate risks, and they're starting to incorporate that into their prices. If someone has to pay $7,000 for their home on the coast of Florida, maybe that is what they should pay," he argues. "The reality is that the insurance industry --- I know a lot of people hate it --- but one thing it does very well is it prices risk. That's all it does. When the insurance industry starts increasing your premiums, they're not doing it because they just want to scam you, they're doing it because that's what their actuaries and algorithms think the risk is to your home."

"You see that happening in a lot of states," says Frank, recent adjustments to premium pricing in parts of Colorado. "You are building in a wildfire zone. Colorado had a couple of very bad wildfires in the past year. So insurers start raising their rates, they start leaving the state, cancelling policies, non-renewing policies. It's happening in more and more states. It's a trend that is not going to be reversed."

Sounds like a very real problem. Then again, we could just start planting a lot of trees, knock on wood, and hope for the best...

We've got a grab bag of items on today's BradCast, as the critical midterm elections loom and a potentially catastrophic storm threatens the Sunshine State. [Audio link to full show is posted below this summary.]

Among the potpourri of news on today's program...

  • Some listener mail in response to yesterday's lively call-in show focused on expansion of the Supreme Court and the necessity of electing Democrats this November in hopes of saving American democracy.
  • NASA scientists successfully fired a vending machine sized projectile last November toward a 560-foot wide moonlet orbiting around an asteroid traveling at thousands of miles per hour nearly 7 million miles away. They hit it on their first try. But, other than that, when it comes to things like our climate crisis and fighting infectious diseases here on Earth, scientists don't anything about anything and should be completely ignored, right?
  • Texas' top law enforcement official, Republican Attorney General Ken Paxton, was indicted for securities fraud felonies seven years ago. He has been dodging a trial for those crimes ever since. In the meantime, he's facing a whistleblower lawsuit from former top deputies charging he abused his office and a criminal probe by the FBI regarding similar allegations. On Monday, his state Senator wife Angela (the one he was cheating on with a girlfriend who was given a job by one of his wealthy donors), served as a getaway driver for Paxton after he ran out of the house and fled by to dodge a process server attempting to serve the state's top attorney with two subpoenas. Cause that's what "the rule of law" looks like in the Lone Star State. Paxton will face Democratic A.G. nominee Rochelle Garza during his reelection contest this November.
  • False claims of fraud in the 2020 election and threats against poll workers by Donald Trump and his flying MAGA monkey are resulting in a surprising number of folks signing up to be poll workers on both the Left and the Right. That's actually a very good thing! But many more poll workers are still needed to help protect democracy this year! Please contact your local elections office to consider becoming one!
  • And, speaking of protecting democracy, last week, the House passed a bipartisan bill to update the Electoral Count Act of 1887. That is the arcane and confusingly written law that Trump and the MAGA monkeys tried to exploit in hopes of stealing the 2020 Presidential election on January 6, 2021. A similar bipartisan bill to the one passed by the House with little GOP support is now quickly moving through the U.S. Senate. And today, republican Senate minority leader Mitch McConnell came out in support of it. That means the measure is likely to get the 10 Republican votes needed to overcome a filibuster in the undemocratic upper chamber. This much-needed reform to help prevent just one of the ways that Republicans could steal the 2024 Presidential election may see passage in the full Senate before the end of this year.
