Despite having their own 100-foot buffer zone of protection at the Court, the U.S. Supreme Court Justices unanimously struck down Massachusetts' state-wide 35-foot buffer around reproductive healthcare clinics in this country with their McCullen v Coakley decision today.

They have just announced that it is 'Open Season' on reproductive healthcare clinics in this country.

According to SCOTUS blog, where the decision was being reported live, the issue is about restricting free speech in public spaces: "A state can go beyond narrow laws that block obstructions to clinics, and more broadly ban abortion protests, only if it builds a record showing that the narrower measures don't work." (More at scotusblog.com)

I am a long-time clinic defense escort volunteer in cities from Los Angeles to Chicago to New York. The idea that the people standing outside clinics screaming and yelling, chasing people into the streets, surrounding medical transport vehicles and threatening staff are there for First Amendment expression reasons would be laughable if the potential for violence wasn't so real. They show up to intimidate patients and companions and terrorize communities.

More than 300 acts of violence were committed against reproductive healthcare clinics just between 2010 and 2012. That includes eight murders and seventeen attempted murders since 1991. More than 80% of facilities have called the police and National Abortion Federation members overwhelmingly report that buffer zones prevent violence and make staff and patients feel safer.

Apparently intimidation and terrorizing those seeking legal medical procedures is now an important First Amendment expression of "free speech", according to the Supreme Court Justices. The Court has weighed the safety of healthcare providers and American citizens against potential violence and has decided they aren't worried...

The case against Wisconsin Gov. Scott Walker (R), charging that he ran a "criminal scheme" by coordinating his 2012 recall election campaign with about a dozen "outside" groups, is about much more than just Walker and his corruption.

On this week's BradCast on KPFK/Pacifica Radio, I spoke with Brendan Fischer, general counsel at the Center for Media and Democracy about what could be the very last piece of campaign finance law to fall in the wake of 2010's Citizens United and 2014's McCutcheon rulings by the U.S. Supreme Court. Depending on how the challenge against the case against Walker goes, there may be nothing left that keeps candidate campaigns from putting unlimited, undisclosed millions to work in buying our elections. In short, as I discussed with Fischer, democracy could well become even more hosed than it already is in this country. Who knew that was even possible, at this point?

First use of new GOP voting restriction in the state, while state Republicans offered $1,000 reward for evidence of voter fraud...

It was Primary Day in Alabama on Tuesday and the first time since passage of the law that the state's Republican-enacted polling place Photo ID restriction on voting has been in place. Sure enough, the voter suppression law was successful, as voters were immediately disenfranchised by the new restriction, according to Zach Roth at MSNBC...

Willie Mims, 93, showed up to vote at his polling place in Escambia County Tuesday morning for Alabama's primary elections. Mims, who is African-American, no longer drives, doesn't have a license, and has no other form of ID. As a result, he was turned away without voting. Mims wasn't even offered the chance to cast a provisional ballot, as the law requires in that situation.

Mims, as he explains in the video below, first voted back during WWII. He says he's voted in almost every election since then. Until now...

As we noted last night, the global warming deniers were sure to start firing on all carbon-emitting pistons this week in response to the Obama EPA's landmark announcement today of proposed new rules to decrease harmful, climate-destabilizing CO2 pollution from existing dirty power plants, as per the U.S. Supreme Court-mandated enforcement of the Clean Air Act.

The deniers haven't disappointed.

The following quotes come from a press release sent out this morning from the fossil fuel industry-funded "Heartland Institute," which pretends to offer science-based arguments in support of their "mission...to discover, develop, and promote free-market solutions to social and economic problems."

In fact, the group serves as little more than a mouthpiece for Big Carbon and the modern Republican Party which, largely thanks to Citizens United in 2010, now eschews the use of actual science in the public sphere.

Despite their ironic "non-profit" status --- enjoying government subsidies for promoting "free-market solutions" --- the Heartland Institute is also little more than an arm of the Republican Party. In one of the responses to today's announcement, the Heartland Institute President argues that "Republicans in the House and Senate are right to oppose EPA's new global warming rules," and "Voters will do well to remember who was on their side during the coming political battles."

In another response, the "non-partisan" group says that challenging the Obama EPA's proposed policy could be great for the GOP. "If done intelligently," Heartland's Science Director(!) Jay Lehr writes, the challenge "could cost [Obama's] party the Senate in the November elections and dramatically increase the Republican majority in the House of Representatives - which will enable the Republicans to stymie any further legislative action by the president for the remainder of his term."

Now that's some good Science Directing! And some good non-partisanship! Of course, this is also the same group that purchased billboards comparing those who believe in science to "The Unabomber" and Charles Manson, so it's not as though anybody would take these folks seriously, right? Wrong. They are consistently featured and quoted by theoretically legitimate mainstream media outlets in coverage of the pretend "global warming debate".

Here then, in no particular order, are the top 7 most amusing responses from the Heartland Institute's "experts", as released this morning in response to today's EPA announcement...

Our too-infrequent guest blogger D.R. Tucker is now working the weekend shift at Washington Monthly's excellent "Political Animal" blog and, as expected, he's out of the gate like a lion on the climate crisis and the pre-wrangling over the Obama EPA's proposed landmark guidelines for restrictions on CO2 emissions by dirty coal-fired power plants (ya know, the rules they're required by law, under the 1970 Clean Air Act, according to the U.S. Supreme Court, to put in place.)

Over just this weekend, D.R. has published a number of sharp articles there on the topic, including "It's On: You can already hear the denialists screaming. And scheming."; "The Short-Timers"; "(Dirty) Power Concedes Nothing Without a Demand"; and the ingeniously-named "If You Like Your Planet, You Can Keep Your Planet" (in which he quotes The BRAD BLOG at some length, from this recent piece).

You should read them all if you'd like to be smarter about actual facts in regard to climate change, the GOP denial industry (which will certainly be kicking into the highest of dudgeon once again this week), and the clear and present danger we now face thanks to run-away, human-caused CO2 emissions and the global warming it is causing.

But it was the following exchange in the comments section of the "If You Like Your Planet..." piece --- specifically the last line by commenter "Virginia" --- which made me smile...

10th Circuit stays order compelling EAC to add 'Proof of Citizenship' requirement to federal voter registration form...

Early last week, with little attention in the media, the U.S. 10th Circuit Court of Appeal applied the brakes, for now, to one of the newest voter suppression schemes on the bleeding front edge of the GOP's ongoing War on Voting.

The insidious new Republican scheme, if it manages to overcome continuing challenges in court, such as the stay and appeal it now faces in the 10th Circuit, could result in thousands of otherwise eligible voters in Kansas and Arizona (and elsewhere, if the effort is allowed to move forward in KS and AZ) unable to even register to vote, much less cast a ballot on Election Day.

An investigative report by the Arizona Republic last year found the evidence for the purported basis of the new law --- claims by Republicans that non-citizens are casting ballots in the state --- to be "nearly non-existent".

Judith Brown Dianis, a civil rights litigator at The Advancement Project, described the nearly decade-long, coordinated, nationwide GOP voter suppression effort as "the largest legislative effort to roll back voting rights since the post-Reconstruction era". While appearing before a U.S. Senate Subcommittee in 2011, she described the effort as one designed to make "it harder to register to vote, harder to cast a ballot and harder to have a vote counted."

One of the primary GOP efforts to make it "harder to cast a ballot" can be found in the spate of polling place Photo ID laws that Republicans have sought to justify on the basis of what amounts to a phantom menace. Cases of in-person voter impersonation --- the only type of voter fraud that can be prevented by Photo ID --- are about as scarce as hen's teeth.

The same can be said about baseless GOP claims of an epidemic of voter fraud in the form of votes cast by non-citizens --- an allegation that is now being used as part of the new Republican ploy to prevent perfectly lawful citizens from even registering to vote...

State Republicans' voter suppression law hitting its target
UPDATED: Media coverage finally results in voting ID for Ruby Barber...

Here is just one more of the hundreds of thousands of reasons that have led the U.S. Dept. of Justice to file suit against Texas Republicans' polling place Photo ID restriction law.

The same law had been previously blocked by the DoJ and again by a federal court under the federal Voting Rights Act, after the state's own data showed the law discriminated against racial minorities and others, while failing to deter actual voter fraud in the state.

But, literally minutes after SCOTUS gutted the heart of the Voting Rights Act last Summer, the section which was used to strike down the law previously, Texas Republicans announced their intention to re-enact the law which, of course, they knew to be discriminatory.

As the Waco Tribune reports, 92-year old Ruby Barber has tried, but has so far failed, to obtain one of those so-called "free" Photo IDs from the Texas Dept. of Public Safety (DPS), now that one is required for her to cast her legal vote this year, as she had for decades, until now, without a problem.

Barber's story is heartbreaking and maddening but, unfortunately, probably not entirely rare. The DoJ estimated, based on the state's supplied data when the federal agency blocked the law in 2012, "the total number of registered voters [in Texas] who lack a driver's license or personal identification card issued by DPS could range from 603,892 to 795,955."

Barber's driver's license expired in 2010 and she's now having difficulty locating "her nearly century-old birth certificate that she'd need to obtain a voter ID under a new state law." As the New York Daily News reports, the details of Barber's story and her fight to try and cast her vote are simply absurd...

Just over a week ago, The BRAD BLOG's legal analyst Ernie Canning posited that the decision by a federal court in Wisconsin to strike down that state's polling place Photo ID law could signal "the beginning of the end" for such disenfranchising, Republican-enacted laws around the nation.

Since that landmark ruling in the Badger State, new signs from top elected Republican officials in Pennsylvania and Iowa, and even in Wisconsin, suggest that the (at least) decade-long GOP "voter fraud" fraud may have finally peaked, and will now begin the inevitably long slide into abandoned, historical shame.

We don't want to be too quick to declare the demise of this insidious attempt at reviving Jim Crow with a sophisticated and nefariously misleading legal patina, but after covering this beat for a decade --- long before much of the general public, much less the Democratic Party itself, seemed to notice --- it seems that the recent landmark court ruling in WI, followed by last week's towel toss in Pennsylvania and embarrassing revelations in Iowa, may be seen in the not-too-distant future as the moment that the GOP "voter fraud" fraud finally began to permanently unravel...

UPDATED: Wisconsin Republicans will appeal to 7th Circuit...

This week's federal court decision to strike down Wisconsin's polling place Photo ID law has national significance and does not bode well for Republicans who have been attempting to advance such electoral schemes in recent years, as based on misleading "facts", wild claims and dishonest interpretations of case law and court precedent.

The court's landmark decision in the Wisconsin case contains a methodology for testing the law's constitutionality that, if applied by other courts in similar federal challenges to similar laws in other states, would likely mark the beginning of the end for Republican-enacted, polling place Photo ID restrictions. We describe that possibility as "likely", given that a careful reading of prior case law suggests that six of the Supreme Court's nine Justices have already subscribed to legal opinions that are consistent with the methodology used by the federal court in Wisconsin.

In late 2011, shortly after the filing of the first of the two federal cases that resulted in this week's ruling finding that Wisconsin's polling place Photo ID law (Act 23) violated both the U.S. Constitution and Section 2 of the Voting Rights Act (VRA), The BRAD BLOG explained why the issues before the federal bench in Wisconsin "could reverse similar laws nationwide."

The 90-page decision and order [PDF] that U.S. District Court Judge Lynn Adelman meticulously crafted, not only after a full trial on the merits, but over a span of more than 3 1/2 months following it, suggests that our earlier prediction may have been an understatement.

In declaring Wisconsin's Republican-enacted Photo ID law unconstitutional and a violation of federal law, Judge Adelman applied a very specific test for the law, one called for by the U.S. Supreme Court back in 2008. That same test, measuring the potential benefits of such laws against their possible harm to voters' rights, if similarly applied elsewhere, would likely invalidate most, if not all of the similar restrictions which have been rammed through numerous GOP-majority state legislatures over the past six years.

While stopping short of describing Republican "justifications" for such laws as a mere pretext for voter suppression, Judge Adelman's decision persuasively finds that the core GOP claims about the supposed need for polling place Photo ID restrictions cannot withstand judicial scrutiny when tested against a fact-based reality in a court of law. The judge found, in no uncertain terms, that such laws are constitutionally infirm because, without legitimate state interests for such restrictions, they serve only to disproportionately disenfranchise the poor, the elderly and minority voters...

As a former Republican, I can't help noticing the dark irony in the abandonment of rogue Nevada rancher Cliven Bundy by Republican politicians and right-wing media figures on the heels of his incendiary comments last week about "the Negro."

Bigotry is never funny, as Los Angeles Clippers owner --- and (contrary to right-wing media misinformation) registered Republican --- Donald Sterling has proven. However, one can't help chuckling over the fact that right-wingers tried to wash their hands of Cliven the Cretinous just a few days after they celebrated a US Supreme Court ruling limiting affirmative-action efforts in higher education.

The two issues are connected, though not in the way one might think...

Finds Republican restrictions on voting violate both the U.S. Constitution and Section 2 of the Voting Rights Act...

Very big news out of a federal court in Wisconsin today, where the state's polling place Photo ID law (Act 23) has now been struck down as both a violation of the federal Constitutional as well as under Section 2 of the Voting Rights Act.

While similar laws, all enacted by Republicans, have been struck down by state courts before --- indeed, Wisconsin's, was already found in violation of the state constitution in state court --- and in federal courts under Section 5 of the Voting Rights Act, today's ruling is the first to strike down such a law under Section 2 of the VRA.

The landmark ruling will almost certainly have national implications for federal challenges in other states against similar restrictions recently enacted by Republicans.

Last summer, the U.S. Supreme Court gutted the heart of the VRA by making Section 5 unenforceable until Congress passes new legislation to determine which jurisdictions must pre-clear new elections laws with the U.S. Dept. of Justice before they are put into effect, due to a history of racial discrimination in elections in those jurisdictions. Section 2, however, bars discrimination in all 50 states, even though, unlike Section 5, it cannot be applied until after the new law in question goes into effect.

Judge Lynn Adelman's ruling [PDF] today, finding WI's version of the law discriminatory and in violation of both Section 2 and the 14th Amendment of the federal Constitution, is likely to have an impact on federal challenges to similar laws in states such as Texas and North Carolina, where federal cases are pending to block similarly discriminatory polling place restrictions.

Moreover, the judge placed the racial and class discrimination and disenfranchisement that would be caused by this law in stark terms, in regard to how many otherwise legal voters in Wisconsin might lose their right to vote, and how such a law might have directly affected the results of the state's 2010 election, had it been place at the time...

A Circuit Court judge has resoundingly rejected Arkansas' new Photo ID restrictions on voting, declaring the law to be "null and void" and in violation of the state's Constitutional right to vote.

Last year, after Republicans took over the Arkansas statehouse for the first time since Reconstruction, they passed an onerous Photo ID restriction law for voting. The Democratic Governor Mike Beebe vetoed the new restrictions, but that veto was subsequently overridden by the Republican legislature.

Pulaski County Circuit Court Judge Timothy Davis Fox' 2-page Summary Judgement [PDF] finds in favor of plaintiffs in the case, the Pulaski County Election Commission and against both the defendant, the Arkansas State Board of Election Commissioners, as well as the Republican Party of Arkansas which intervened on behalf of the Board of Election.

In his Thursday ruling, Fox found the law to be "unconstitutional in that it violates Articles 3, Section 1 and Article 3, Section 2 of the Arkansas Constitution."

Section 1 of Article 3 details the "Qualifications of Electors" in the Arkansas state Constitution, declaring that, "Except as otherwise provided by this Constitution, any person may vote in an election in this state who is: (1) A citizen of the United States; (2) A resident of the State of Arkansas; (3) At least eighteen (18) years of age; and (4) Lawfully registered to vote in the election."

Section 2, on the "Right of Suffrage" states that "Elections shall be free and equal. No power, civil or military, shall ever interfere to prevent the free exercise of the right of suffrage; nor shall any law be enacted whereby such right shall be impaired or forfeited, except for the commission of a felony, upon lawful conviction thereof."

Given the very clear and straightforward language of the state Constitution, this seems to have been a very easy case. Republicans, however, are reportedly preparing to appeal the ruling...
