So much for states' rights from the so-called "conservative" U.S. Supreme Court --- as if 2000's Bush v. Gore didn't already tell you that they, like other "small government Conservatives", were largely full of shit when making that pretend claim...only when convenient to their policy goals, of course...

The Supreme Court reversed a decision by a Montana court supporting a state anti-corruption law passed in 1912 that prohibited corporate influence in state elections, reaffiriming that their Citizens United decision invalidates such restrictions. Montana, supported by 22 states and Sens. John McCain (R-AZ) and Sheldon Whitehouse (D-RI), had argued that their law should be allowed to stand because of the state’s unique history of corruption around its mining industry, which led to its passage by referendum. The court ruled against them 5-4, the same majority that determined Citizens United.

You can read more about the courageous decision earlier this year by the Montana Supreme Court --- the decision struck down today by SCOTUS --- in Ernie Canning's coverage from January. In that case, even the dissenting MT Justice found the U.S. Supreme Court's "entire concept" of corporate personhood to be "offensive."

"Corporations are not persons. Human beings are persons, and it is an affront to the inviolable dignity of our species that courts have created a legal fiction which forces people --- human beings --- to share fundamental, natural rights with soulless creations of government. ... Indeed, it is truly ironic that the death penalty and hell are reserved only to natural persons," wrote the dissenting Justice James C. Nelson who, clearly, disagreed with Citizens United, but dissented in the MT case because he believed --- as SCOTUS affirmed today --- that they, not states, can decide how campaign finance will or won't work for every state in the entire nation.

The 5-4 Citizens United majority has essentially told Montana --- and every other state in the union --- that they may not run their own elections as they wish. Even though Justice Anthony Kennedy had written for the majority in that case that "independent expenditures, including those made by corporations, do not give rise to corruption or the appearance of corruption," the high court today decided not to review the record of corruption --- essentially, mining companies buying up the entire state legislature in MT back at the turn of the 20th century --- which gave rise to the now-dead Montana law.

In Justice Stephen Breyer's dissenting opinion of today's summary reversal (made without even hearing oral arguments), he writes: "[E]ven if I were to accept Citizens United, this Court’s legal conclusion should not bar the Montana Supreme Court’s finding, made on the record before it, that independent expenditures by corporations did in fact lead to corruption or the appearance of corruption in Montana."

"Given the history and political landscape in Montana, that court concluded that the State had a compelling interest in limiting independent expenditures by corporations," Breyer wrote in the dissent (joined by Justices Ginsburg, Sotomayor and Kagan). "Thus, Montana’s experience, like considerable experience elsewhere since the Court’s decision in Citizens United, casts grave doubt on the Court’s supposition that independent expenditures do not corrupt or appear to do so."

Bev Harris of BlackBoxVoting.org sends out the following notice this morning...

Amazingly, Accenture, which sold its crap-on-a-stick high-school sophomoric completely insecure malfunctioning voter registration software to a bunch of states, so unsuccessfully that Colorado refused to pay and others, like Wisconsin and Shelby County, bought out the source code in order to try to bandaid it into a functional system, has decided to issue a cease and desist against Black Box Voting for exposing its flawed software to the public.

Last time a voting system company did a DMCA take-down notice (Diebold, in 2004) it got socked with punitive charges for abusing the Digital Millennium Copyright Act, trying to use it to block distribution of material clearly published in the public interest.

If you want a copy of the voter registration software I posted Thursday, might as well get it right now --- and mirror it, torrent it, dropbox it, or whatever. I'll probably pull it down by June 27, not because their claim is valid, but because there are higher priorities for spending my time during this election season and thanks to Slashdot and some pals in Europe, this software has now been widely mirrored elsewhere.

The full takedown notice is here. The "highly problematic" Accenture voter registration software --- used by TN, WI, PA, CO, KS and others --- is still posted here, as of now if you'd like to download it, poke around into some of the source code, and/or mirror it on your site.

Other than "crap-on-a-stick high-school sophomoric completely insecure [and] malfunctioning", Harris previously described the software this way: "This voter registration and voter history system has been widely criticized --- in Colorado, where it reportedly assigned voters who are Republicans as Democrats, and vice versa, and in Tennessee where it has been proven to lose voter histories."

'For whatever reason,' is not an answer, NPR!...

Perhaps we should call it the David Gregory Technique, since the dreadful Meet the Press host seems to use it, and little more, week in and week out during his usually useless interviews with public officials.

Here's how the David Gregory Technique works: Ask a public official for "your response to that charge?" Get that response. And then move on to the next question. No follow-up. No challenge. It's that simple. Just get their "response" on record --- like an in-person performance of the public official's already-published press release responding, either accurately or not, to the same issue.

Afterword, news consumers are no more informed or enlightened than before going in, other than to become familiar with the political talking points in play, whether they are based in fact or reality or not. Who knows?

Such was the treatment that Florida Gov. Rick Scott (R) enjoyed last week from Michele Martin on the apparently ironically named TELL ME MORE program on National Public Radio concerning his spate of allegedly unlawful, attempted voter suppression programs in the Sunshine State. NBC's David Gregory couldn't have done it better himself...

Last night, The Daily Show destroyed --- destroyed --- Florida Gov. Rick Scott and all of his recent voter suppression schemes in the Sunshine State: onerous restrictions on registration, early voting and his recent attempted voter roll purging in a two-part slam. Here's PART 1...

As a bonus in the must-see PART 2 of this piece, wherein correspondent John Oliver travels down to Florida, you'll also get a few moments which highlight Republican mercenary, hack for hire and esteemed "voter fraud" fraudster (and well-paid liar) John Fund for the dangerous mope that he is...


Two of the best lines from the above: 1) Oliver says to Fund after he claims we must stop voter fraud that we don't know is happening but could be happening: "So voter fraud statistics are limited only as much as your imagination?" 2) Oliver's last line of the piece: The alleged voter fraud scourge "hasn't happened, and it won't happen, and that is why it must be stopped!"

Before, during and after last week's historic Wisconsin recall elections, we detailed why there is reason to be concerned about the computer-reported results of the votes cast across the state, even with the majority of those votes having been cast on paper ballots.

In short, the results are, and will remain, 100% unverified unless someone bothers to get a court order.

As we previously reported...

[T]hose ballots ... are tabulated by computer optical-scan systems like the ones in Palm Beach County, FL, which, in March of this year, had named several losing candidates to be the "winners." And like the ones in New York City which, in 2010, managed to toss out thousands of valid votes, including as many as 70% in one South Bronx precinct. And like the ones in Oakland County, Michigan, where officials found the same machines failed to count the same ballots the same way twice in 2008. And like the ones in Leon County, FL, which, in 2005, were hacked to entirely flip the results of a mock election.

In Palm Beach County, FL, the failure was discovered during a state-mandated, post-election spot check of 2% of the paper ballots. In New York City, it took nearly two years before the failures were discovered after the New York Daily News was able to examine the paper ballots via a public records request. In Oakland County, MI, election officials were lucky enough to discover the failure during pre-election testing. And in Leon County, FL, the hacker --- a computer security expert --- revealed the op-scan system flaw he exploited to flip the results of the election in an Emmy-nominated HBO documentary.

In all cases, it was only a hand examination of the paper ballots that revealed the mistabulations by the op-scanners.

Unfortunately, in Wisconsin, no such post-election hand-examination takes place for any ballots --- at least not without both a recount request and an order from a judge. There are no spot-checks to ensure accuracy, so there is no way to know if the results reported by the computers reflect what the actual voters said in Wisconsin. The reported results are therefore either accurate or they are not. Who knows?

We explained why all of the above means that we cannot know if Republican Scott Walker actually won his gubernatorial recall election anymore than we can know if John Lehman (D) won his challenge against incumbent state Sen. Van Wanggaard (R) in the District 21 state Senate recall on the same day. (If Lehman is certified as the winner, the Democrats will take majority control of the state Senate. Wanggaard should demand a hand count of all ballots. To do so, he needs to file for a recount, and then beg a judge to allow that count to be done by hand, rather by the same machines once again, as is the standard under the WI election code.)

For those who think such concerns are overwrought, if the above instance of op-scan machine failure aren't enough for you, take a look at what happened last week in three different counties in Montana, on the very same day of the recall elections in Wisconsin...

Control of chamber hangs in balance, but all ballots, and current 800-vote margin, completely unverified by human beings...

Late last night we detailed just some of the reasons why it's impossible to know, short of actually counting the paper ballots by hand in Wisconsin, if Republican Gov. Scott Walker actually received more votes than his Democratic challenger Mayor Tom Barrett or not.

Without both a recount request and a court order for the ballots to be hand-counted, rather than machine-counted yet again, the state of Wisconsin does not manually examine any of its paper ballots to ensure that the flawed, oft-failed and easily manipulated computer optical-scan systems and central tabulators tallied any of them as per the voters' intent.

Well, the same concerns hold true this morning for Democrat John Lehman in his important recall challenge to incumbent Republican Sen. Van Wanggaard in the District 21 state Senate race. His declaration of victory late last night is based on the same completely unverified computer tallies as Walker's was earlier in the evening...

"It was a great demonstration of democracy, whether you agree or disagree with the outcome," Huffington Post's political reporter Howard Fineman told Ed Schultz on MSNBC late tonight, while discussing the results of the historic Wisconsin recall elections.

Fineman's comment is either accurate or it is not. Just as the results reported by the computers across the Badger State are either accurate or not. Who knows? Nobody in WI does, and that's exactly the problem.

The early Exit Poll results had reportedly predicted the race between Republican Gov. Scott Walker and Democratic Milwaukee Mayor Tom Barrett a virtual tie, leading media to plan for a long night tonight. A second round of Exit Polls results, however, was said to have given Walker a broader lead over Barrett. Even so, we were told, the race based on the Exit Poll data alone was still "too close to call." Those data were either accurate or they were not.

Of course, the raw, unadjusted Exit Polling data are no longer entrusted to us mere mortals. They can be seen only by members of the mainstream media, and we are simply left to trust them to report it all accurately to us or not. And when, after all, have we not been able to rely on the mainstream media to report everything accurately to us?

But never mind the Exit Polls. We've got real polls, real votes, actual ballots now to tell us who won or lost. If only we'd bother to actually count them...

PLUS: Maddow covers recent GOP voter suppression and fraud...

As I'm on the road and largely off the grid this week, I was about to post the following video from last night's Rachel Maddow Show, thanking her for covering so much of what we've been covering here at The BRAD BLOG, for so long, in one nice long top-of-show segment.

I'm still going to do that, but below that, I'm happy to post a press release just sent out by the non-partisan Brennan Center for Justice at NYU, breaking the news that a federal judge has issued a preliminary injunction blocking the "key provisions of a restrictive voting law in Florida today." The Brennan Center describes the ruling as "a breakthrough victory for Florida voters and voting rights advocates nationwide."

The new law, H.B. 1355, had included onerous criminal restrictions on third-party voter registration workers. The new rules were so onerous, in fact, that the League of Women Voters of Florida was forced to call off their registration drive in the state for the first time in 70 years. In the wake of the FL GOP's new law, high school teachers had been charged with crimes for registering their own students to vote, and a registration worker had received a threatening letter from the Sec. of State for turning in voter registrations one hour late after a holiday weekend.

U.S. District Court Judge Robert L. Hinkle blocked most of the FL law's new registration requirements today, finding they accomplished little more than suppressing the registration of new voters without serving any legitimate state interest. "If the goal is to discourage voter-registration drives and thus also to make it harder for new voters to register, this may work," wrote Hinkle in his frequently scathing decision [PDF].

The Brennan Center quotes from Hinkle's ruling this way: "Together speech and voting are constitutional rights of special significance; they are the rights most protective of all others, joined in this respect by the ability to vindicate one's rights in a federal court. … [W]hen a plaintiff loses an opportunity to register a voter, the opportunity is gone forever ... And allowing responsible organizations to conduct voter-registration drives --- thus making it easier for citizens to register and vote --- promotes democracy."

It's very good news, as once again another law passed by the GOP with the intention of nothing more than suppressing the vote of largely Democratic-leaning voters is found to be in violation of the Constitution and/or federal law, as has been the case with almost every single one of these GOP-passed laws over the past year --- at least when someone (too often not the U.S. Dept. of Justice, unfortunately) bothers to go to court to challenge them.

Yesterday, at Rolling Stone, Ari Berman had calculated that some 35,000 Florida voters stand to be purged this year if the Republicans' new voter suppression efforts there are carried out in full.

As to Rachel Maddow last night, here's some of the very important coverage she offered at the top of the show, including details on the state of Florida's current effort to purge thousands of legal voters from the rolls by claiming, inaccurately, that they are non-citizens. (NOTE: That effort is a separate voter suppression measure by Republicans in the state of Florida, and is not related to today's federal court ruling blocking the earlier voter suppression measure by Republicans in the state of Florida)...

Come November, CA voters may be forced to choose between two Democratic candidates for U.S. Senate...

Recently, The BRAD BLOG criticized the undemocratic features of the new "Top Two" open primary system (aka the "Cajun Primary") in California. The new system, approved via a ballot initiative in 2010, changes the state's primary to system to allow a single, open primary in which the two candidates who receive the highest numbers of votes, go on to face each other in the November general election even if the combined totals of the 'Top Two' do not amount to a majority of votes cast in the primary.

In our critique, we cited the race for the newly created CA-26 Congressional seat where, despite a Democratic Party voter registration advantage, come November, voters may be forced to choose between a 'Tea Party' Republican and a stealth Republican who changed her party registration to independent just days prior to the candidate filing deadline because the two are matched against four Democrats on the June 5 "Top Two" primary ballot.

Our analysis drew criticism in comments from some right-leaning readers claiming our critique was simply a case of sour grapes by a progressive author. But, the state's upcoming U.S. Senate race reveals that the undemocratic potential of the 'Cajun Primary' cuts both ways; that there is a distinct possibility that all Californians, come November, will be forced to choose between the incumbent corporate Democratic Sen. Diane Feinstein, and the Occupy Wall Street-connected, computer scientist David Levitt (see video below), who is also a Democrat...

Were voter registration records modified in preparation to illegally remove them from the rolls?...

Four hundred and eighty-eight voters, all but four lifelong Democrats, and nearly all Black, had their voting history erased by Shelby County (Memphis) election workers, setting them up for purge from the voter list. These selective alterations appear to target the race of US Congressman Steve Cohen (D-TN-09).

To alter voting histories for a selected set of voters, putting them at risk for strategically selected and improper removal from the voting list, is to demean them, to treat them as if they have less worth as human beings than they do. And to demean them is to wrong them. What Shelby County's election staff has done, in altering the records, is morally wrong.

DETAILS ON SHELBY COUNTY VOTER LIST ALTERATIONS

Shelby County voters owe a debt of gratitude to Darrick "D" Harris (no relation). This information has come to light because, when I spoke with Harris by telephone recently, he expressed concern to me about his discovery that his voting history had somehow evaporated.

An active Democratic voter and political consultant, Harris had copies of voter databases containing his own voter history. He knows he votes regularly, but as of Oct. 2011, the voter list reports that he has never voted --- not once!...
