On today's BradCast: Yes, the kids are alright. And, if this past week has been any indication --- along with the results of a fascinating social experiment by my guest today --- they may well save us all. I hope they hurry. [Audio link to today's show follows below.]

First up, however, a boatload of news broke shortly before air today, and we scramble to cover as much of it as we can. Among those stories...

  • New indictments are filed by Robert Mueller's Special Counsel probe against two former Donald Trump campaign officials. His former campaign chair Paul Manafort and his business partner Rick Gates, who also served on the Trump transition team saw 32 counts added to the 17 felony counts leveled against them in October. The new charges relate to some $30 million in money laundering and tax fraud, based on funds said to have been received while Manafort worked for a Russian-backed Ukrainian President prior to joining the Trump campaign;
  • U.S. House Speaker Paul Ryan and the White House have reportedly pushed out, Matthew Masterson, the Republican Chair of the U.S. Election Assistance Commission (EAC) for reasons that remain unknown The EAC, formed by Congress after the 2000 election debacle to help state election officials with e-voting system standards, has failed in many ways over the years, as we discuss (and as we've reported at The BRAD BLOG for many years.) Still, they remain the only federal agency tasked with that role, even while Republicans have been attempting, for years, to shutter the Commission entirely. Masterson, said to be highly regarded by state election officials, was overseeing cyber-security standards for new voting systems before the 2018 mid-terms, in light of concerns of foreign manipulation of U.S. voting, registration and tabulation systems;
  • And, also breaking just before air, Missouri's new "family values" Republican Governor Eric Greitens was indicted late Thursday on a felony charge related to allegations that threatened to blackmail a woman he had tied up and photographed nude in his basement during an affair in 2015, prior to his 2016 election.

Then, with the incredibly impressive students of Marjory Stoneman Douglas High School in Parkland, Florida speaking up, marching, organizing and protesting unapologetically to demand new legislation on guns after a former student killed 17 at their school last week with a legally-purchased semi-automatic AR-15 rifle, President Trump unleashed a Twitter rant on Thursday morning calling for teachers across the country to be armed in response. That call has not gone over well with the Stoneman Douglas students, though many Republican officials and their paymasters at the National Rifle Association (NRA) support the measure to place even more guns into our nations schools.

But, as my guest today, Philadelphia area high school teacher and writer DINA LEYGERMAN argues, the current generation of high schoolers across the country are fierce, a force to be reckoned with and not to be underestimated.

In her recent article headlined "The Teens Will Save Us", Leygerman documents a fascinating social experiment that she has run for a number of years while teaching George Orwell's 1984 to her English class. After similar results of the experiment year after year --- in which, without informing the students, she basically turns her classroom into an Orwellian totalitarian regime over a matter of days, with her as the dictator turning students against each other --- she says that this year, for reasons she discusses, the response by the students was completely different from previous years. The students, she explains, were having none of it, and actually stood up, organized with their classmates and other students in rebellion against her. As she wrote, "For the first time since I've done this experiment, the students 'won.'"

Leygerman joins us for what turns out to be a very hopeful segment, as she explains what happened, why, and how this generation may be very different from the slacker image many have painted them with. "They are participating in marches. They are participating in their student government. They are listening to the news. They're reading the news more, everyday. They are involved. And I think in our current political climate, where everything is so hostile and divisive, they are learning. I walk around and, even in the cafeteria, I'll listen to them talk about DACA, they'll talk about issues that I don't ever remember discussing when I was a kid," she tells me.

It's a fascinating conversation that I hope you'll tune in for. I also get her thoughts on Trump and the NRA's proposal for arming teachers, which she describes as "insane and dangerous" and a "diversion and deflection" from the actual conversation of what should be done about our nation's gun epidemic. Leygerman, who also writes for parenting website Romper, wonders: "Where's the funding coming from? And if it's coming from the government or from the state, why can't we have basic supplies instead?"

Finally, Desi Doyen joins us for the latest Green News Report, as a chemical giant settles a decades-long water contamination lawsuit, global temperatures continue to sky-rocket, sea levels rise at an ever-quickening pace, and another western state becomes the latest to block Donald Trump's scheme to expand off-shore oil drilling...

On today's BradCast: Yet another mind-blowing adventure in attempted election oversight. This time regarding the complete destruction of all paper ballots in the middle of a Florida lawsuit, following an election between two Democrats, one of them a powerful member of Congress. [Audio link to show follows below.]

But first: Deadly and costly disasters, natural and otherwise, top the news headlines on today's program. Among them: the catastrophic Amtrak train derailment on a brand-new line near Seattle, the second straight week for still-raging apocalyptic wildfires in Southern California, and the continuing disaster in Puerto Rico where, three months after Hurricane Maria came ashore, one-third of the island is still without power and the Governor has finally conceded that the official death toll of 64 may be off...by as much as 1,000!

All tolled, hundreds of billions will be needed to rebuild from those deadly disasters, and yet Republicans in Congress are still hoping to pass a $1.5 trillion tax cut, largely for wealthy Americans, before Christmas. Their scheme took a troubling turn over the weekend, as a new provision was added to the legislation during reconciliation of the House- and Senate-passed versions late last week. The new provision, it was revealed by David Sirota at International Business Times, would give special tax breaks to owners of large real estate holding LLC's like President Donald Trump, House Speaker Paul Ryan and, most curiously, Sen. Bob Corker who, on Friday, mysteriously reversed his previous opposition to the bill after the new provision was tacked on, in what many are now calling the #CorkerKickBack.

Then, we're joined by journalist, documentarian and election integrity advocate LULU FRIESDAT to discuss the remarkable turn of events recently revealed in response to multiple public records requests she has made over the past year in hopes of reviewing hand-marked paper ballots from the Democratic primary election last year between Rep. Debbie Wasserman-Schultz and her Bernie Sanders-endorsed challenger Tim Canova.

Just weeks after being forced to step down as chair of the DNC amidst the release of stolen emails from party officials, Wasserman-Schultz soundly defeated Canova in the first primary she'd faced in her six terms as a member of Congress. But, unexplained vote count numbers --- such as hundreds of more voted ballots than voters signed in to the poll books in the 23rd Congressional District race in Broward County, FL --- led to Friesdat's attempt to examine the paper ballots by hand, in hopes of determining if they were tallied correctly by the county's computer tabulators during the August 2016 Democratic primary. Eventually Canova himself filed a lawsuit against the county's Supervisor of Elections Brenda Snipes, after Friesdat says she was continually denied access to the materials.

In November of this year, well over a year after Snipes certified the contest, both were finally invited to inspect the Broward County ballots only to learn upon arrival that all of them had actually been destroyed by the county in the middle of the lawsuit. Only digital images of what were purportedly the original ballots were available for examination, according to Snipes, in what appears to be, according to Politico's survey of election experts, a clear and stunning violation of federal election law requiring all such materials be retained for 22 months after an election.

Friesdat tells me that neither her nor Canova had any idea the ballots were destroyed before showing up to review them. "If you're looking at digital scans, and you don't have the original ballots to turn to, at that point you have no way of verifying that ballots haven't been switched out, that ballots haven't been added, that ballots haven't been taken away --- you don't have any verification that those are the original ballots."

Oddly enough, she explains, "in the very first public records request in November [of 2016], I requested all of the digital ballot scans for the election, and I was told that they didn't have them, that they didn't exist. And then it turned out that they did exist. So the county was duplicitous in regard to that information."

As to what's really going on here, Friesdat demures from speculation, but says, based only on what is already known on the public record, that "according to Politico, seven legal experts that they consulted all agreed that the ballots being destroyed was illegal."

It is of a piece, she observes, with the recent revelations in Racine County, WI, in November of this year, when multi-partisan election transparency advocates were finally allowed to review some of the computer-scanned paper ballots from the 2016 Presidential election. After months of similar public records request, they were allowed to view original paper ballots, only to find that, in the precincts they examined, anywhere from 2 to 6% of perfectly valid Presidential votes had been ignored by the computer tabulators entirely. That, in an election where Trump is said to have pulled off his shocking statewide victory by less than 1%.

"What's going on here is actually just a representative sample of the problems that we have with our elections, and which you have been reporting on for over a decade," Friesdat says. "We're heading into the 2018 primaries. We at least now have a growing understanding and awareness that, in many cases, our election results may or may not be accurate, and that the protocols we are using in order to get those results are not secure." She offers many other troubling observations on all of this during our conversation today.

Finally, four U.S. Senators --- two of whom had previously called for Sen. Al Franken to resign amidst allegations of inappropriate conduct --- are now, according to a new report today, said to be hoping that he might reconsider his previously-announced plans to resign "in the coming weeks", before the Senate Ethics Committee has even investigated the charges against him...

On today's BradCast: The bloodbath for Republicans in Tuesday's off-year elections and a great idea for how Democratic states can take action against real bloodbaths immediately by helping victims of gun violence with a tax against the industry that works around both the 2nd Amendment and federal immunity from lawsuits granted by Congress. One year to the day after Donald Trump was named the winner of the Presidency in 2016 (while losing the national vote by 3 million), we review what appears to be the remarkable 'blue tidal wave' that swept across much of the country in Tuesday's contests in about one-third of the states. From big races to small, from high office to city councils and boards of education, voters turned out in impressive numbers and Democratic candidates reportedly performed very well in the bargain wherever they ran.

Democratic candidate Ralph Northam walloped the Trump-supported GOP candidate Ed Gillespie by some 9 points for Governor in Virginia, a clear rebuke to both the President and the racially-based scare campaign both he and Gillespie ran on. Democrats also won for Lt. Governor (only the second African-American to win statewide since the Civil War) and for Attorney General. In perhaps the biggest surprise in the state, voters also turned out at least 15 Republicans from the state's House of Delegates which, depending on some challenges and "recounts", may result in a stunning Democratic takeover of the state's lower chamber that had a 66 to 34 GOP majority before last night. (VA also moved from 100% unverifiable touch-screen voting systems to optically-scanned hand-marked paper ballots this year. So, at least there will be something to count in "recounts" there this year.) Minorities of all sorts --- including the first openly transgender candidate who replaced a homophobic hard right incumbent --- won in the VA House, where Dems out-voted the GOP by more than 200,000 votes. Nonetheless, thanks to Republican gerrymandering, they may still end up in a slim minority there.

Dems also took over the gubernatorial mansion in NJ from the wildly unpopular Chris Christie and won re-election for mayor in NYC by a landslide. African-American candidates won mayoral victories for the first time in cities from North Carolina to South Carolina to Georgia to Montana to Minnesota. Topeka, KS picked up its first Hispanic mayor and Hoboken, NJ now has its first Sikh mayor. And, in Maine, voters overwhelmingly approved the expansion of Medicaid under the Affordable Care Act, which will result in health care for some 80,000 Mainers if the dumbest Governor in the nation, Paul LePage, stops blocking it. (It is also likely to inspire similar ballot initiatives in 2018 in other states where Republicans are denying federally-funded health care to their own residents.) It also appears that the last Republican-controlled legislature on the West Coast, the Washington state Senate, has fallen to Democratic-control, creating a "Blue Wall" of states in the West from Canada to Mexico. So it was a good day for Dems, and seemingly a very troubling omen for Trump and the GOP in 2018.

Meanwhile, it's been just days since 26 were massacred and 20 others shot by a man with a semi-automatic rifle in Sutherland Springs, TX. But Republicans have already made clear they intend to take no legislative action in response. Our guest today, however, legal reporter MARK JOSEPH STERN of Slate, has a fantastic idea that Democratic-controlled states could implement almost immediately. It's one that works around the NRA's 2nd Amendment challenges, as well as the outrageous federal "Protection of Lawful Commerce in Arms Act" (PLCAA) of 2005, which largely granted total immunity to gun manufacturers and dealers from lawsuits filed by victims.

"PLCAA is an entirely unique law. There is literally nothing else like it in the federal code," Sterns explains. "This law literally erased hundreds of years of laws and statutes, and jury verdicts, and forced all states to comply with this federal statute that basically prevents anybody from successfully suing a gun manufacturer or a gun seller, and gives them complete immunity to be as negligent as they want."

Stern's idea, as he explains, would result in help for victims of gun violence (more than 300 per day across the country) and their families, who often face bankruptcy after such incidents, as gun violence costs some $2.8 billion each year in health care costs alone. The measure would also force the gun industry to finally pay up for at least a small part of the unspeakable damage, pain, suffering and injury that they help to inflict every day on Americans.

State's "need to propose a special tax on the income of gun manufacturers and gun sellers that is high without being exorbitant. Tax their profits at every stage. They make a huge amount of money, so this would not burden them. This would not shutter manufacturers. But it would force them to pay a lot more, millions more, every year in taxes. What the legislature needs to do is take this extra revenue and place it in a fund that is explicitly designated to be paid out to victims of gun violence. When people are shot, and it is not at all their fault, they should be able to draw money from this fund to pay for their medical expenses and other care. There should be no cap, no limit on it. And no one would be able to raise a Constitutional objection. This is perfectly compliant with the Second Amendment and PLCAA."

Many already have similar funds for victims of all sorts, like those harmed by the vaccine industry. This, Stern argues, should be a no-brainer for states like California and, perhaps now, even Virginia.

From North Korea to London to Charlottesville to Florida to Texas to Ohio to California and beyond...

  • Another terror attack in London today and, as Scotland Yard and Prime Minister Theresa May described it, Trump's very "unhelpful" response to it;
  • Speaking of terror, Donald Trump is very quick to comment on alleged Muslim terror attacks, but both he (and the corporate media) are very good at ignoring and/or downplaying domestic acts of terror by white people with guns, including a deadly high school shooting this week in suburban Washington and one of the worst mass murders in a decade this week in suburban Texas.
  • The growing cost to the U.S. economy of Harvey, Irma and other increasingly intense storms (another may hit the U.S. in the coming week) --- and the ever-increasing costs of ignoring climate change altogether;

  • Hundreds of thousands of voter files left unprotected online (again), this time in Alaska;
  • The election office in Ohio largest county, with voted ballots inside, was discovered completely unlocked and vacant, just days before a municipal election;

On today's BradCast, the fallout from the James Comey firing swirl further out of control, as I suspect it will for quite some time, while other disturbing Administration policies move forward with much less focus from either media or Congress. One such policy is Trump's recent Executive Order calling for the dismantling of National Monuments --- "public land grabs" and "outrageous abuses of power", as he has taken to incorrectly describing them --- on behalf of corporate drilling and mining interests. [Audio link to show follows below.]

The madness of King Donald continues to devolve at now breakneck speeds, as the White House and an increasingly enraged Trump continue their unsustainable spinning, flip-flopping and nonsensical rants concerning the President's sudden firing of the FBI Director earlier this week under an obviously phony pretext. The need to create fresh lies to cover up older ones is also creating fresh perils for those foolish enough to enter Trump's orbit, like Deputy Attorney General Rod Rosenstein. So, we've got the latest on all of that, including an interesting suggestion for Comey's permanent replacement, a bit of pushback from his Acting replacement, and some ill-considered admissions about the entire affair by Trump himself.

Meanwhile, as Trump keeps digging, and the media and Congress continue (justifiably) to obsess about and investigate it all, the Administration's other corrupt policy measures move forward with measurably less attention. Among those efforts is the unprecedented attempt to roll back National Monument designations by the three previous Presidents, including the Obama-designated Bears Ears National Monument in southern Utah.

In response to an Executive Order signed in April, U.S. Interior Secretary Ryan Zinke is touring the area this week, where more than 1 million acres of land that is sacred to Native Americans and home to tens of thousands of archaeological sites, including ancient cliff dwellings, are now being reviewed on behalf of Trump, Congressional Republicans and corporate fossil fuel interests.

Joining us today to describe the local, tribal efforts to protect these native public lands --- and the Utah Congressional delegation's efforts to undermine them (literally) --- are Carleton Bowekaty, a Zuni Tribal councilman and co-chair of the Bears Ears Inter-Tribal Coalition, and Matthew Campbell, attorney with the Native American Rights Fund.

They both explain the reasons why the Antiquities Act of 1906 was invoked by President Obama to protect the lands; speak to some recent "extremely offensive" comments by Sen. Orrin Hatch (R-UT); and the absurdity of Trump describing these designation of federal lands as national monuments as "federal land grabs".

Finally today, Desi Doyen joins us for the Green News Report, with news on the Administration's deliberations regarding the landmark UN Paris Climate Agreement, the latest on the nuclear emergency in Washington state, and much more...

Guest: The Intercept's Jon Schwarz...

On today's BradCast, while the U.S. media and public are obsessed by whatever Trump's relationship is or isn't with Russia and his bizarre tweets over the weekend, real policies and federal agencies --- relied upon for decades by millions of Americans --- are about to be gutted by the President and his Republican friends in the U.S. Congress. [Audio link to show follows below.]

Once again today, however, we must lead with more terrorism. And, once again, it's another alleged attack by a white man against someone --- a man of the Sikh faith, in this case --- told by the shooter, to "Go back to your own country!" While the incident, once again, has been ignored by the White House, Donald Trump found time today to sign a new Executive Order being described by critics as "Muslim Ban 2.0". While it's more narrowly tailored than his last one, which was blocked by the federal courts, the new order still provides no evidence that it will actually increase national security in any way.

Then, while Trump was unleashing his latest evidence-free Twitter tantrum over the weekend, charging that President Obama had "wire tapped" his phones at Trump Tower before leaving office, White House budget busters were sharpening their knives with huge planned increases in defense spending to be paid for by draconian slashes to thousands of jobs and billions of dollars at the Environmental Protection Agency (EPA) and the National Oceanic and Atmospheric Administration (NOAA).

But why stop protecting the environment and health of Americans there? Our guest today, Jon Schwarz of The Intercept, joins us to explain how, while much of what Trump said in last week's address to Congress (at least some of the encouraging parts, like his promise to "promote clean air and clean water") can "safely be ignored", at least one point should not be. His comments about Medicaid, relied upon by millions of Americans, should be taken very seriously, Schwarz warns.

"Medicaid is not just healthcare for the poor," he explains. "It also pays the bills for over 60 percent of nursing home residents, and 40 percent of all national long-term care costs." With GOP control of Congress and Trump no longer promising "no cuts to Social Security, Medicare and Medicaid," as he repeatedly did on the campaign trail, Schwarz decodes the President's comments from last week's speech promising to "give our state governors the resources and flexibility they need with Medicaid."

"It truly is awful what the Republicans have planned for Medicaid," Schwarz says, detailing how Trump's language now syncs up almost perfectly with House Speaker Paul Ryan, who has long called for schemes that would gut Medicaid. "The reason that they will go after it first is because the people who are the main recipients are either children, or they are over 65, or they are blind or they are disabled --- they truly are the people with the least ability to fight back. So it makes sense that that's who you want to attack first."

Schwarz explains what replacing the current federally-funded system with "block grants" to states actually means, who it will most harm, and how it will harm them. Medicaid, he says, is "not an incredibly generous program" as is. "But, it is crucial for anyone who has not made a lot of money their whole lives. People don't understand that if Medicaid is cut, old people truly will be dying in the streets. If you're a bit luckier, and you have kids with an extra room, maybe you will be dying on your kids' fold out couch."

As noted during the interview, Schwartz, a former writer for Saturday Night Live, is not particularly funny today. But Americans, particularly younger Americans, who will become the victims of these schemes while they are not paying attention --- unless Republicans can block them --- need to pay attention to what is likely about to happen, if Trump and GOP leadership get their way.
