GUEST: Journalist David Roberts of Vox.com
PLUS: More on concerns about KY election results; NY AG subpoenas ExxonMobil...
By Brad Friedman on 11/5/2015 5:58pm PT

Yes, there is a U.S. House Committee that is even worse than the Benghazi Committee, argues my guest on today's BradCast.

But, first, we follow up yesterday's disturbing show with a few more concerns about the accuracy of the 100% unverified results of Tuesday's Gubernatorial election in Kentucky and state Democrats' ability (or interest) in understanding the dangers of computerized vote tabulation systems. In short, they don't get it. Not by a long shot --- at least if my conversation with folks at the state Democratic Party today are currently any indication.

Next up today, David Roberts of Vox.com joins us to discuss the McCarthyesque behavior of Rep. Lamar Smith (R-TX), Chair of the U.S. House Committee on Science, Space and Technology, as the Republican assault on science continues. Smith, Robert's reports, is wielding unprecedented new subpoena powers in an unyielding attack on scientists and public institutions researching climate change and more.

"In the almost two years since he's run the Science Committee, Lamar Smith has issued more subpoenas than all previous chairs of the committee, going back some fifty years," Roberts explains. "He's newly empowered and he's going nuts with it."

Roberts details three different cases in point, as laid out in his recent article at Vox, including extraordinary demands being made on a number of different, largely unknown scientists, who had the temerity to study and speak out about findings on global warming.

"Our politics are so crazy these days that it's hard to register anything as particularly extreme or outrageous because there's such a flood of extreme, outrageous stuff happening all the time," Roberts tells me. "But, honestly, the head of a Science Committee accusing the head of a government scientific research body of deliberately falsifying data in order to support a political effort to pass climate policy is really a serious accusation. It shouldn't just be part of the daily noise of politics. This is a serious deal."

Roberts says this amounts to little more than an effort to keep scientists from being able to do their work, to frighten them away from reporting their findings and, hopefully, find something --- anything --- that can be taken out of context in hopes of embarrassing them somehow. "Everybody knows why they want" all these personal emails, he tells me. They want to "look for bits and pieces that, if you yank them out of context, look suspicious, and selectively leak those emails to reporters --- who, history shows, will credulously eat it up. For all the incompetence and haplessness of the current GOP right now, one thing they're really good at is they've figured out how the media ecosystem works."

Making the case that this is all worse than what the ridiculous Benghazi Committee is doing, Roberts explains: "[Hillary Clinton], at least, has the power and the resources and the wherewithal to defend herself. But these individual scientists, they don't know anything about politics. They don't know how to play this game. They don't have money for lawyers. So the damage that this threatens to do to the open practice of science in the U.S., I think, is worse than the danger posed by these more high-profile political committees. The damage that they're doing to the practice of science in the U.S. is much deeper and more disturbing than whatever the ebb and flow of who's up and down in electoral politics."

Finally today, some late breaking news on a story we've been following closely for several months now, as New York's Attorney General files subpoenas against ExxonMobil concerning what the company knew about climate change, when they knew it, and how much they may have worked to obscure that information from the public (and their own investors)...

GUEST: Karoli Kuns of CrooksAndLiars.com...
By Brad Friedman on 11/4/2015 5:21pm PT

It is a primal scream of a BradCast today, following what happened --- once again --- on Election Day yesterday. We see, again, the nightmare scenario I've warned about for so many years: a U.S. election where all of the pre-election polls suggest Candidate X is set to win, but Candidate Y ends up winning by a huge margin instead and nobody even bothers to verify that the computer tabulated results accurately reflect the intent of the voters. (Audio link to today's full show is below.)

That's exactly what happened in Kentucky on Tuesday, where Democratic Attorney General Jack Conway was leading by a fair margin (about 3 to 5 points) in almost every pre-election poll in his race for Governor, but then ended up being announced as the loser to 'Tea Party' Republican candidate Matt Bevin by a landslide (almost 9 points) --- according to the state's 100% unverified computer tabulation systems.

As detailed on today's program with my guest Karoli Kuns of Crooks And Liars, there are a number of reasons to question the reported results. Among them, as Kuns points out today at C&L, the Democrats running in the down ballot races --- for Secretary of State, Attorney General (Conway's current job) and even state Auditor --- each reportedly received tens of thousands more votes than Conway did at the top of the ticket!

Bev Harris, of BlackBoxVoting.org, who I spoke with earlier today, described the higher vote totals in the down ballot races as a "significant anomaly". She tells me that, at least until more records are requested and examined, the KY-Gov's race "has to be looked at as a questionable outcome, particularly because of the discrepancies in the down ballot races. More votes in those races and not at the top...that just doesn't happen."

(Here is a link to a helpful Public Records Request toolkit [PDF] from Black Box Voting for those of you who may be interested in helping to try and obtain some transparency in this race, as we also discussed on today's program.)

There are many other reasons for supporters to question the reported results in the KY-Gov's race, as I detail during the show. Of course, the reported results could also be completely accurate. But, without public, human examination of the hand-marked paper ballots (which, thankfully, now actually exist across most of the state!) and other related records, we have yet another unverified, 100% faith-based election to leave supporters wondering if they really won or lost.

We've seen this before, of course. Too many times. We've seen malfunctioning paper ballot op-scan systems report losers as "winners" until a hand-count corrects the record. We've seen how easy it is for hackers to game election equipment. We've seen election insiders, even as recently as last week, breaking in to computerized central tabulators. And we've even seen high-ranking election officials in Kentucky (including County Clerks, Circuit Court Judges and School Superintendents!) convicted for decades of insider election fraud, including the manipulation of electronic voting systems.

We've seen both Democrats and Republicans alike fall victim to similarly anomalous and unverified results. And, while none of it bodes well for 2016 and beyond, neither does it bode well for those immediately and directly impacted by Tuesday's elections --- such as the 400,000 Kentuckyians who stand to lose health care under a new Republican Governor who has vowed to shut down the state's expansion of coverage under ObamaCare by the very popular if term-limited and outgoing Democratic Governor.

Also today: More election results from races around the country, from the attempt to legalize marijuana in Ohio, to campaign finance reform in Maine, to the recall of Koch Brothers-funded school board officials in Colorado...

Guest: Timothy O'Connor of the Environmental Defense Fund...
By Brad Friedman on 9/9/2015 5:41pm PT

On today's BradCast, the facts behind the insanely deceptive political ads blanketing the airwaves in California claiming the state will soon start "rationing gas" and "penalize and fine us if we drive too much or use too much gas".

Attorney Timothy O'Connor, Director of the Environmental Defense Fund's California Climate Initiative joins us to explain the absurd Big Oil-funded DontTakeMyGas.org campaign. You'll be shocked to learn that it's sponsored, to the tune of millions of dollars, by the scam artists of the Western States Petroleum Association (WSPA) in hopes of blocking the state's proposed landmark effort (SB-350) to cut petroleum use by 50% by 2030.

"If other states see California --- the nation's leader in gasoline use --- cutting its consumption and its spending," O'Connor tells me, "I think they're going to want some of that for themselves. And that's where I think WSPA really wants to stop this snowball from growing and taking hold, and really rolling into something pretty big nationally."

Also today: Dick Cheney lies again, this time on the Iran Deal; More follow-up on the anti-gay KY County Clerk; And listener calls on all of the above!...

Guest: Author and Harvard Health Policy Professor Dr. David Hemenway...
By Brad Friedman on 9/8/2015 5:28pm PT

As noted at the top of today's BradCast, our show changed about five different times right up until air, as we attempted to keep up with busy news events on the ground following the Labor Day weekend.

First up, Kim Davis, the Rowan County, Kentucky Clerk who was jailed before the weekend after defying court orders to issue marriage licenses was released [PDF] by the Federal Judge who had found her in contempt last week. Waiting for her with a hero's welcome was a crowd of hundreds fomented by former Arkansas Governor turned GOP Presidential candidate turned Fox 'News' host turned GOP Presidential candidate again turned desperately disingenuous opportunist Mike Huckabee.

But what Huckabee failed to note in his defense of Davis --- as do most of the media covering what's going on down there --- is that Davis was sent to jail not for refusing to defy her own conscience as her supporters claim, but for refusing to allow others who disagreed with her in her own office from acting and following their own conscience...not to mention the rule of law and the U.S. Constitution.

Next up today: As the carnage of gun violence continues from coat to coast following the recent, live on-air shootings in Roanoke, Virginia (include another mass shooting at a school here in California and the critical injury of one of New York Gov. Andrew Cuomo's top legal staffers), we speak to author David Hemenway about solutions, as detailed in his book Private Guns, Public Health.

"People from around the world come and they just cannot understand why the United States allows this to happen --- compared to all the other first world countries and high income countries --- that we are allowing so many Americans to be killed," Hemenway tells me while explaining how our epidemic of gun violence must be regarded as an issue of public health. "First we have to admit we have a problem, and the numbers are just overwhelming."

While he concedes that, no matter what we do, "we are going to have lots and lots of guns in the Unites States," they can and should be made safer. "One of the analogies we make in public health is in the motor vehicle area," Hemenway explains. "Fatalities per mile driven in the United States have fallen over 85% because the cars are so much better, and the roads are so much better. Yes, we ought to look at the individuals [perpetrating the violence] but we can do so much more, so much more cost-effectively, if we also look at the system. Let's make a system where it's hard to make errors, hard to behave inappropriately, and then when still some people do, let's make it that nobody dies."

"For example, we'd like manufacturers to do a better job about making child-proof guns --- which they made 100 years ago --- to make it harder for kids to unintentionally kill themselves. We can say 'You know, it's the kid's fault, it's the parent's fault, it's somebody's fault fault fault,' or we can solve the problem, which is make it so that when you take out the magazine the gun won't fire. It's not rocket science."

Hemenway, Professor of Health Policy and Director of the Harvard Injury Control Research Center, offers other common sense solutions, including the need for better data collection, currently made scarce by both legislation and intimidation by gun proponents. "Whenever there's a motor vehicle death, we get 150 pieces of information collected consistently and comparably. We want to get good data on the number of guns in households in each state, but the Center for Disease Control is afraid to ask questions about that because they'll get beaten up by Congress."

He also discusses a number of myths from opponents of gun safety laws, including the claim that women need guns to protect themselves from predators and the notion that households are safer with a gun to protect the occupants. "Only about a third of households have guns," Hemenway tells me. "And the two-thirds that don't have guns, turns out they are much, much safer than the one third that does."

Guest: Legal analyst Ernest A. Canning; Plus: Listener calls and more!...
By Brad Friedman on 9/2/2015 5:17pm PT

Over the weekend at the DNC Summer Meeting in Minneapolis, 2016 Democratic Presidential candidate Martin O'Malley excoriated his party for their 'rigged process' of Presidential debates. Bernie Sanders agreed and BRAD BLOG's legal analyst Ernest A. Canning apparently does too.

He wrote about it this week, including his concerns that the process could result in a 1968-like rift within the party. He joins us to discuss it on today's BradCast.

Also today, in a victory for President Obama (and for peace and diplomacy) it looks like the Iran Deal now appears to be sealed in the U.S. Senate --- despite wild disinformation about it (and a Republican base which appears clueless about that and much more).

We also take listener calls on all of the above, including some on our programs earlier this week on the KS statistician being blocked by the state from examining evidence she believes suggest "voting machine manipulation" and the attorney representing the couples suing the KY County Clerk who refuses to issue marriage licenses in defiance of the U.S. Supreme Court.

Plus: Desi Doyen joins us for the latest Green News Report as we get ready to take a few days off for the holidays. (But, don't worry, your BradCast will be ably guest hosted once again by the excellent Nicole Sandler of RadioOrNot.com for a couple of days until we're back after the holidays!)

Guest Joe Dunman, attorney for the couples challenging Clerk Kim Davis: 'Imagine a Muslim clerk denying licenses to Christian couples'...
By Brad Friedman on 9/1/2015 6:02pm PT

Rowan County, Kentucky Clerk Kim Davis continues to defy federal court orders to issue marriage licenses to two gay and two straight couples. Their attorney, Joe Dunman, joins us on today's BradCast for a fascinating discussion of the case, how we got here, and where it all goes from here.

"To issue a marriage license which conflicts with God’s definition of marriage, with my name affixed to the certificate, would violate my conscience," the elected County Clerk said in a statement today following the U.S. Supreme Court's refusal yesterday to hear Davis' application for an "asylum of conscience" and her own refusal, once again today, to issue licenses.

"It is a Heaven or Hell decision," she adds. Guess which one she's choosing?

Dunman, who also represented the Kentucky couples in SCOTUS' landmark Obergefell v. Hodges case that declared marriage equality a fundamental right in all 50 states, tells me that Davis is not required to actually perform any marriages. "She's not obligated to solemnize a marriage at all. The only thing she has to do is stamp her name on the documents that are filed with the state."

"In her arguments so far, she claims that [by] putting her name on it, she is 'authorizing and blessing' those marriages." But the U.S. District Court Judge (as well as the 6th Circuit U.S. Court of Appeals and now the U.S. Supreme Court) "disagreed, and said 'look, you're just certifying that they meet the legal standards, that they're eligible for marriage licenses --- that's all you're doing. You're not blessing anything. For that reason she doesn't have a religious objection. Not to mention that there's no case law to support the idea that public officials have religious rights that trump the civil rights of other people."

"Extending her logic outward, there's really no end to what a public official could do. All they'd have to claim that they sincerely believe something, and they just do it," Dunman explains. "I want people to imagine a Muslim clerk in Kentucky denying licenses to Christian couples as they walk in the door, and whether or not people would be standing up for 'religious freedom.'"

The attorney also notes that Kentucky's Republican Gubernatorial candidate, Matt Bevin, "has come out strongly in her support" for Davis, who is actually a Democrat, "going so far as to say 'Clerks Lives Matter' during a rally in her favor."

Also on today's BradCast: Reverberations following yesterday's interview with Beth Clarkson, the Kansas statistician who believes she's found evidence of "voting machine manipulation", but is being blocked by KS Sec. of State Kris Kobach from examining the e-voting system's paper audit logs from the 2014 election.

Plus: A crazy case of "voter suppression" --- of a very bizarre sort --- in Columbia, Missouri; Alabama's plans to shut down 45 of its 49 driver's license offices (despite the state's strict Photo ID voting restriction law); and Obama makes an impassioned plea for action on climate change up in the Arctic...

Standing up to the NRA after Roanoke & a horrifying U.S. gun death toll
PLUS: Denying global warming on Katrina's 10th anniversary; Trump's ugly nativism gets uglier; Good news for Dems in new poll; Marriage dead-enders in KY...
By Brad Friedman on 8/27/2015 5:53pm PT

On the heels of yesterday's horrific on-air murders in Virginia, and as guns claim one life every 16 minutes in the U.S., the father of one of the Roanoke victims vows to stand up to the NRA and "cowards" elected to office who fail to take action to help prevent gun violence. On today's BradCast we look at the numbers, the jaw-dropping death toll in this nation, and what, if anything might ever be done about it.

For the record, as WaPo details, we've now had 247 mass shootings in the 238 days of 2015.

Also on today's busy program...

• Louisiana's Republican Governor and also-ran 2016 GOP candidate Bobby Jindal pretends [PDF] global warming had nothing do with Hurricane Katrina as Obama comes to New Orleans to commemorate the 10th anniversary of the devastating storm.

• New national poll finds Hillary Clinton, Joe Biden and, yes, Bernie Sanders would all trounce Trump and the other GOP front-runners if the election was held today...and if we had a national election...and if all voters who wanted to vote were allowed to vote...and if those votes were actually counted and counted accurately.

• Donald Trump's ugly nativism gets even uglier as the Republican establishment gets desperate.

• Kentucky dead-ender County Clerk defies still more federal court orders and denies same-sex marriage licenses --- and all marriage licenses --- in her county, under the ridiculous premise of "religious freedom".

By Brad Friedman on 7/10/2015 5:24pm PT

As history is made, today's BradCast takes a look at the background, context and FACTS behind a number of stories in today's headlines which haven't been reported as well as they should have been.

From the Confederate flag coming down in South Carolina today (it wasn't raised due to the Civil War, but rather, in response to a remarkable chapter in the fight for civil rights); to the bizarre intra-GOP fight over the Confederate flag in Congress (Hint: It's not really about the flag at all, it's about the EPA); to the facts, not fiction, behind Donald Trump's Republican Party immigration follies (he's just plain wrong); to the continuing (and hysterical) wingnut fallout from the Supreme Court's ruling on marriage equality (no, Glenn Beck, you won't be thrown off the air for opposing Constitutional equality for all, but that County Clerk in Kentucky should be tossed out of his job for failing to follow the law.)

Also: The nation's dumbest Governor invokes the "Pee-Wee Herman" defense; Responding to a complaint from a radio station manager; And much more! All on today's very busy BradCast!...

By Brad Friedman on 7/2/2015 3:47pm PT

It's our last BradCast before the long holiday weekend, so, after an amazingly encouraging week or two of news, we head into the July 4th weekend today with a whole bunch of stories that we've been trying to clear off our desk for the past week or two, along with a bunch of breaking news as well today.

From Trump and Bernie-mentum to Jim Webb entering the 2016 race to the dead-enders in Kentucky still fighting the Supreme Court ruling on marriage to more green news than we can even fit into a single Green News Report with Desi Doyen.

Oh, and real-life killer robots on the rise --- no, it's not product placement for the new Terminator movie, but it sure sounds like it --- before we finally end today's show with an encouraging bang (courtesy of our friend D.R. Tucker at Washington Monthly)!

Please enjoy and have a happy (and safe) 4th of July!...

P.S. We're taking a long weekend off from the show, so our friend Nicole Sandler of RadioOrNot.com will be filling in for us on Monday! We'll be back on Tuesday though! Peace!

GUEST: Journalist David Dayen; Plus: Jeb on Iraq & crazy Allen West...
By Brad Friedman on 5/12/2015 3:54pm PT

The Senate Democrats voted almost unanimously against giving President Obama "Fast Track" authority for trade agreements such as the Trans-Pacific Partnership (TPP) today.

Journalist David Dayen of Salon joined me on today's BradCast to discuss what today's procedural vote portends; what both TPP and "Fast Track" actually are (and aren't); whether Dems will continue to block the controversial trade agreement in the Senate; and whether Republicans will be able to do the same in the U.S. House.

Also today: The first lawsuit of the 2016 election season is filed in (where else?) Ohio; Defending Jeb Bush on Iraq (yes, you read that right!); Another 2-year old shoots his mom (thank, NRA!); Crazy former Rep. Allen West says he's a victim of "Sharia Law"...at the Walmart!; And Desi Doyen joins us for the latest Green News Report...

A Letter to the Editor on Saturday in Louisville's Courier-Journal...

Here is an enlightening little quiz. Guess the source of these quotations:

1. Congress should "authorize separate federal matching of state and local expenditures for the medical care needed by public assistance recipients."

2. "To guarantee adequate financing of health care on a nationwide basis," we need a "comprehensive health insurance plan (to) offer to every American the same broad and balanced health protection."

No, not Barack Obama. The answers are: 1. Dwight Eisenhower and 2. Richard Nixon who, today, would be called "socialists" and drummed out of the GOP.

Today we have only moderate Republicans - whom we now call Democrats - and the Tea Party.

Or, as I prefer to call them, the cowards and the bullies.

Just so you don't miss this part, since it's at the very bottom of the letter, let's run it up top and add a red arrow to it:

That's from the letter included inside of this very scary envelope being sent to Kentucky voters (at least some of them) by Sen. Mitch McConnell (R), in his sleazy re-election campaign against challenger Allison Lundergan Grimes (D):

Click the graphic above to enlarge and see the whole thing. The letter sent inside the scary envelope, as published by Sahil Kapur at TPM today, follows below (and is also enlargable by clicking)...
