UPDATE: Compared Vote Caging With 'Caging Animals'...

Tim Griffin, former Karl Rove protege, former interim US Attorney from Arkansas and felonious vote cager, finally answered some charges in a speech yesterday in Arkansas. Apparently, he welled up with tears at various points in his presentation --- "crying as he said he had no plans to return to politics," reported AP --- to the point that the person who forwarded us the articles on the matter, said we should "call him a wahhhhmbulance."

We'd never be so cruel as to say or report any such thing, of course. That, despite the thousands of voters that Griffin sought to keep from exercising their franchise in America in 2004. During a time of war, no less. All to benefit his Republican paymasters.

AP reports that Timmy says that he plans to stay in Little Rock to "open a 'bipartisan' public affairs firm." We're sure he does.

Concerning the vote caging charges --- the ones based on the pre-2004 emails he sent, with the subject line "Re: caging," which included spreadsheet attachments with the names of thousands of minority (read: Democratic-leaning) voters he'd hoped the GOP would challenge at the polls, including folks in the military serving overseas, by the way --- Arkansas Business reports the former US Attorney is in denial:

"Griffin’s remarks about reports that he participated in effort to suppress Democratic votes, using a technique called "caging," came in response to a question at the end of his speech."This is all made up of whole cloth," he said. "I didn’t cage votes."

Some evidence for the "made up of whole cloth" charges, including some of Griffin's email, is available in this earlier BRAD BLOG exclusive from Greg Palast, who tells us he may have some more comments for us tomorrow on all of this. (UPDATE: Palast's comments on "Tears of a Clone" now here...)

UPDATE: 6/15/07 ThinkProgress quotes more from Griffin's speech in which he refers to the "Internet stuff" about vote caging, and "made jokes comparing caging to tending zoo animals" [emphasis TP's]:

Obviously, I’ve seen the Internet stuff about caging. First of all, the allegations that are on the Internet and have spread through the tabloids are completely and absolutely false, number one. And ridiculous. Caging, as you may know, I had it looked up, is a direct-mail term for basically organizing returned mail. … And I’ll just say that it’s so untrue. … This is all made up and faux pas. I didn’t cage votes, I didn’t cage mail, I didn’t cage animals, I’m not a zookeeper.

Representatives of three liberal-leaning groups came to the Justice Department in 2004, armed with evidence that hundreds of public-assistance agencies had illegally failed to offer voter registration to their mostly poor and minority clients.Congress passed the National Voter Registration Act, which imposed the requirement, in 1993. But after these agencies registered 2.6 million people to vote in 1995-1996, the total registered plunged to about 1 million in 2003-2004.

Michael Slater, the Oregon-based deputy director of the national registration group Project Vote, said officials of the Justice Department's civil rights division showed little interest in enforcing that part of the law.
...
He said the groups' representatives told the Justice Department officials: "Look, we have physical hard evidence that states aren't doing this. They're taking their eye off the ball. We want to see some enforcement."

Slater said [Bush-appointee to the DoJ Civil Rights division, Hans] von Spakovsky listened quietly and then made comments to the effect of "hmmm" and "that's interesting," but took no action.

Emails from Von Spakovsky recently revealed that he was also busy strong-arming and attempting "deals" with the U.S. Election Assistance Commission (EAC) on a number of issues concerning disenfranchising Photo ID poll restrictions around that same time. For his efforts in all of the above, of course, von Spakovsky would later be recess-appointed by Bush to chair the Federal Elections Commission (FEC). We yelled about that appointment back in January of 2006 when nobody was listening.

*** Investigative Journalist Greg Palast replies to Internet commentary following his Exclusive Report filed here at The BRAD BLOG on Monica Goodling's testimony to the U.S. House Judiciary Committee last week, including her admissions concerning "Vote Caging" by former Karl Rove aide, now Arkansas U.S. Attorney, Tim Griffin.

Saturday morning, when most sensible folks were unfurling flags or taking their setters and children for a Memorial Day frisbee toss on the beach, someone using the nom d’puter of “DRATIONAL” was in his big sister’s bedroom furiously typing, “Greg Palast is Dangerous!” on her iMac.

Drat is quite right: I am dangerous, though not for the reasons in Drat’s screed.

So while the twins are off with the dog, let me respond between bites of this bagel, beginning with this immutable distinction:

There’s two kinds of illiterates in this world: those who can’t read, for whom I’m entirely sympathetic — and those who CAN read but WON’T, for whom I have no sympathy whatsoever.

Drat is of the latter. He (she/them/it?) has mounted a full-scale assault on the seven-year-long effort of my BBC and Guardian team investigating systematic suppression of the minority vote by the Republican Party and our latest revelation: ‘caging voters.’ His “evidence” is 100% limited to snippets of my conversations on talk radio or phone interviews, second-hand reports on websites and some musings of one of my good researchers, Zach Roberts, posted to this site.

Nowhere does he suggest he’s bothered reading the one hundred-page description of the attack on voters, including caging, in the new edition of Armed Madhouse. Shame that. Law professor Robert F. Kennedy Jr., using the book as a source, verified by his own corroborative work, found the matter therein convincing enough to call for putting Rove’s right hand man, Tim Griffin, “in prison, not in office.”

Picking up a book won’t hurt you, Mr. Drat, at least until Patriot Act IV goes into effect...

The most valuable takeaway from the entire U.S. Attorney Purge scandal will likely prove to have been the exposure of the long-perpetuated GOP "voter fraud" scam. The scheme has been been so pervasive for so long, but the coverage of it has been largely contained to blogs like ours.

In the interim, the MSM coverage of the issue had been given over to the well-funded Republican propaganda machine which had detailed the phony claims of "voter fraud" as if they were legitimate.

The result, as designed, were calls for restrictive Voter ID legislation at the polling place, an effort that was successful in a number of states. After all, as the Republican snakeoil salesmen oft-repeated, "you need an ID to get on a plane, to cash a check, why not to vote?"

It was a difficult line to refute on its face, but it was built on lies, disinformation, and attempts by this White House and this Republican party to wage an unprecedented effort to keep any portion of the 10 to 30 million Americans (mostly Dem-leaning) without photo ID's (many even without birth certificates!) from being able to cast a vote.

The U.S. Attorney Purge scandal has helped to reveal the insidious scheme, opening it up for everyone to see by helping to expose the slimy, well-funded campaign for what it really is: little more than a broadly-waged, party-funded, voter suppression ploy.

Scores of MSM articles and columns over the past week or two have finally helped expose this scam to the public, and the likes of vote-suppression operative Thor Hearne's well-financed, systematic, White House-run "non-partisan" American Center for Voting Rights (ACVR) has, for now, slithered back underground.

Much of the MSM coverage to date has repeated what BRAD BLOG readers already know since we've been covering it for so long. But there are a couple of notable must-read exceptions recently which move many of these inter-related stories forward several moves...

New Computerized System was Rife with Bugs, Unexplained Errors and Party-Flipping According to Newly Revealed Documents...

The 18,000 "undervotes" in Sarasota and other questionable elections in November 2006 election were not the only problems faced by Florida voters last year. Most of them, in fact, likely have no idea just how bad it really was.

Florida's statewide voter registration database, and election management systems designed to work with it, were plagued in early 2006 with a host of problems. Some of the details are now revealed by a raft of email messages sent recently by a source to the non-partisan election integrity watchdog group BlackBoxVoting.org which posted them quietly on their site for public scrutiny.

Sixty-four email messages to election officials, spanning a four-month period from January to April 2006, from VR Systems, a Florida corporation, document a staggering series of serious problems with Florida's new computerized voter registration database during the early months of its implementation. The emails, from Jane Watson, a manager at VR Systems, provide a disturbing picture vis a vis a nearly day-by-day report from inside the software test lab.

The Florida Voter Registration System (FVRS) is statewide voter registration database described by Watson in the emails as a "home grown system" built by IBM to Florida specifications and maintained by Department of State staff. Voter Focus is a software system, unique to Florida, which provides election management functions to 60 Florida counties.

The emails tell the tale of software failures which began in January 2006 as programmers furiously work to solve program glitches and failures prior to the state's upcoming elections. The system went online before development was complete, in order to meet the January 1st deadline imposed by the Help America Vote Act (HAVA). The source of the Florida emails, an insider familiar with the development and implementation of the database who has requested anonymity, tells The BRAD BLOG that, "The system should never have seen the light of day until the bugs were worked out. They used the voters and county election officials as guinea pigs to experiment on and test the program."

Documented failures include the software somehow, without apparent reason, switching the party registration for voters. As one of the emails describes: "We are seeing instances of voters being changed to a different party when there was no user activity. This is our top priority now." And the next day: "We worked this weekend on diagnosing voters whom we suspected as having had their party changed by Voter Focus...There were 3 counties with high numbers of suspected cases of this kind of inadvertent party change."

The emails remain unclear on whether the problems were completely found and fixed, and whether or not all voter files had been correctly restored. Later emails suggest that various related problems still existed months later when voters, whose registration should have been recorded in the system, were nowhere to be found. Votingindustry.com, a website which tracks the progress of the implementation of statewide registration databases, currently describes Florida's system as "Still working out kinks."

Jane Watson, the author of the memos, spoke with The BRAD BLOG and confirmed the authenticity of the emails. She explained that the federal government with its HAVA mandates "didn't understand the time it takes to develop programs."

While Watson stressed her confidence that no voter was disenfranchised in 2006 because of bugs in the statewide voter registration system, she admits that "party changes never have worked as well as they should" and that "there are still some things to work out..."

As reported yesterday exclusively by BRAD BLOG, Robert F. Kennedy Jr.'s exposé "Was the 2004 Election Stolen?" on the gaming of the 2004 Presidential Election is now live at Rolling Stone's website.

The online version of the article has detailed footnotes for sourcing, etc., which Rolling Stone tells us are not available in the published articles to hit stands tomorrow around the country. The issue is currently available on newsstands in both NYC and LA, according to an RS spokesman.

Republicans derided anyone who expressed doubts about Bush's victory as nut cases in "tinfoil hats," while the national media, with few exceptions, did little to question the validity of the election. The Washington Post immediately dismissed allegations of fraud as "conspiracy theories," and The New York Times declared that "there is no evidence of vote theft or errors on a large scale." But despite the media blackout, indications continued to emerge that something deeply troubling had taken place in 2004.

Nearly half of the 6 million American voters living abroad never received their ballots ? or received them too late to vote ? after the Pentagon unaccountably shut down a state-of-the-art Web site used to file overseas registrations. A consulting firm called Sproul & Associates, which was hired by the Republican National Committee to register voters in six battleground states, was discovered shredding Democratic registrations. In New Mexico, which was decided by 5,988 votes, malfunctioning machines mysteriously failed to properly register a presidential vote on more than 20,000 ballots. Nationwide, according to the federal commission charged with implementing election reforms, as many as 1 million ballots were spoiled by faulty voting equipment ? roughly one for every 100 cast.

The reports were especially disturbing in Ohio, the critical battleground state that clinched Bush's victory in the Electoral College. Officials there purged tens of thousands of eligible voters from the rolls, neglected to process registration cards generated by Democratic voter drives, shortchanged Democratic precincts when they allocated voting machines and illegally derailed a recount that could have given Kerry the presidency. A precinct in an evangelical church in Miami County recorded an impossibly high turnout of ninety-eight percent, while a polling place in inner-city Cleveland recorded an equally impossible turnout of only seven percent. In Warren County, GOP election officials even invented a nonexistent terrorist threat to bar the media from monitoring the official vote count.

But what is most anomalous about the irregularities in 2004 was their decidedly partisan bent: Almost without exception they hurt John Kerry and benefited George Bush. After carefully examining the evidence, I've become convinced that the president's party mounted a massive, coordinated campaign to subvert the will of the people in 2004. Across the country, Republican election officials and party stalwarts employed a wide range of illegal and unethical tactics to fix the election.

In what may be the single most astounding fact from the election, one in every four Ohio citizens who registered to vote in 2004 showed up at the polls only to discover that they were not listed on the rolls, thanks to GOP efforts to stem the unprecedented flood of Democrats eager to cast ballots. And that doesn't even take into account the troubling evidence of outright fraud, which indicates that upwards of 80,000 votes for Kerry were counted instead for Bush. That alone is a swing of more than 160,000 votes ? enough to have put John Kerry in the White House.

Indeed, the extent of the GOP's effort to rig the vote shocked even the most experienced observers of American elections. "Ohio was as dirty an election as America has ever seen," Lou Harris, the father of modern political polling, told me. "You look at the turnout and votes in individual precincts, compared to the historic patterns in those counties, and you can tell where the discrepancies are. They stand out like a sore thumb."

DoJ Staff Attorneys Now Barred From Offering Opinions in VRA Cases After WaPo Exposed Political Appointees Overruled Civil Rights Division Staffers

The beloved 40 year-old Voting Right Acts, implemented by Lyndon B. Johnson after violence and death to Voting Rights activists in Selma, Alabama in 1965 has been all but gutted by the George W. Bush administration. The VRA celebrated it's 40th anniversary this summer, even as Bush's Department of Justice was destroying one of its most important measures by covert political caveat.

That gutting now appears to be becoming a still greater threat to our democracy as it is being institutionalized by recent policy changes which bar career Voting Rights staffers and attorneys in the DoJ from offering opinions on new laws that fall under the jurisdication of the VRA.

Two recent reports by Dan Eggen of the Washington Post revealed that Bush political appointees in the DoJ has overruled the recommendations of career staffers and attorneys in the Voting Rights division tasked with determining the legality of two separate laws sent to the department for "pre-approval" under Section 5 of the Voting Rights Act.

Section 5 requires that states with a history of discriminatory election practices --- like Texas and Georgia --- must receive pre-approval from the DoJ before implementing any changes to their voting systems. It prohibits "retrogressive" changes to voting laws, or laws that would bring harm to minority voters.

In the last several weeks Eggen has reported on remarkable memos leaked by DoJ staffers showing that they had recommended against approval of new laws both in Georgia, where the legislature had insituted a new Photo ID requirement at the polls, and in Texas, where then Majority Leader Tom DeLay (R-TX) had helped to redistrict the state to allow for more Republican representatives after the GOP gained control of the state house in 2002.

Georgia's law has since been ruled unconstitutional by two Federal Courts who deemed the law to be a "Jim Crow-era Poll Tax". Texas' law has resulted in 7 additional Republicans in the U.S. House of Representatives. The fallout from the DeLay led gerrymander of Texas districts has resulted in several indictments for DeLay and his cronies who helped force it through the legislature and allegedly conspired with the Republican National Committee to launder money in support of GOP candidates running for the new seats. The Texas law, which had been unanimously recommended against by 8 DoJ staffers, including the lead attorney in the Voting Rights Act division, still stands.

Today Eggen reports that such staff opinions are now completely banned in Bush's Department of "Justice"!

The Justice Department has barred staff attorneys from offering recommendations in major Voting Rights Act cases, marking a significant change in the procedures meant to insulate such decisions from politics, congressional aides and current and former employees familiar with the issue said.

Disclosure of the change comes amid growing public criticism of Justice Department decisions to approve Republican-engineered plans in Texas and Georgia that were found to hurt minority voters by career staff attorneys who analyzed the plans. Political appointees overruled staff findings in both cases.

The one ray of hope that Eggen offers is that Sen. Arlen Spector (R-PA) is considering Senate Judiciary Committee Hearings...at least on the Texas redistricting case.

We often bristle when we hear those on the Left criticize the Bush Administration as Fascistic. It's simply too easy to ascribe to them the worst possible traits as a blunt political weapon. But if the issues discussed above don't send a shiver down the spine of every democracy-loving American it's either because they don't understand what's actually at stake --- and being dismantled in the process --- or they simply don't give a damn about this country's most important legacy to the world: A free and fair electoral system where all citizens are given an equal voice in the selection of our leaders...or at least a system as close to that as we can possibly muster.

Our Republic is in grave danger.

Letter just sent to Republican Majority Chairman!

Nine Democratic House Judiciary Committee members (Conyers, Nadler, Scott, Lofgren, Jackson Lee, Meehan, Waters, Wexler, Schiff) have just requested that the committee "hold hearings and investigate the vital issue of protecting our citizens right to vote".

The text of their letter (without footnotes) to the Republican chair of the committee is as follows...

Dear Mr. Chairman:

We write to you at the very outset of the 109th Congress, to request that our committee hold hearings and investigate the vital issue of protecting our citizens right to vote. The right to vote is the very foundation of our Democracy and is at the core of our Committee's jurisdiction, and we can think of no more important or urgent issue before us than protecting our democratic rights. While the election is settled, however, our job as legislators on the Judiciary Committee to make sure that the constitutional right to vote is protected is just beginning.

In congressional forums many of us participated in Washington D.C. and Columbus, Ohio, we learned of significant voter irregularities in Ohio. These irregularities are included in a 100 page report Mr. Conyers issued, and include the following:

� The misallocation of voting machines led to lines of ten hours or more that disenfranchised scores if not hundreds of thousands of predominantly minority and Democratic voters. In Franklin County, 27 of the 30 wards with the most machines per registered voter showed majorities for Bush, while six of the seven wards with the fewest machines delivered large margins for Kerry.

� The Ohio Republican Party's decision to engage in preelection �caging� tactics, selectively targeting 35,000 predominantly minority voters for intimidation had a negative impact on voter turnout. The Third Circuit found these activities to be illegal and in direct violation of consent decrees barring the targeting minority voters for poll challenges.

� The Ohio Republican Party's decision to utilize thousands of partisan challengers concentrated in minority and Democratic areas disenfranchised numerous legal voters, who were not only intimidated, but became discouraged by the long lines in the adverse weather. Shockingly, these disruptions were publicly predicted by Republican officials: Mark Weaver, a lawyer for the Ohio Republican Party, admitted the challenges �can't help but create chaos, longer lines and frustration.�

� Numerous instances of intimidation and misinformation occurred across the state of Ohio that would appear to violate the Voting Rights Act. For example, the NAACP stated that it received over 200 calls regarding incidents of suspected voter intimidation or unusual election related activities, particularly actions taken by challengers who intimidated poll workers and voters. Other specific incidents involved a caller who reported that someone was going door-to-door telling people they were not registered to vote. A voter in Franklin County received information in the mail identified as being from the state that said he would have to vote by provisional ballot because he had moved; in fact, the voter had not moved and had lived at the address for 10-15 years. One polling place worker was reportedly only asking African American voters for their address.

� In Franklin County, a worker at the Holiday Inn observed a team of 25 people who called themselves the �Texas Strike Force� using payphones to make intimidating calls to likely voters, targeting people recently in the prison system. The �Texas Strike Force� members hotel accommodations were apparently paid for by the Ohio Republican Party, whose headquarters is across the street. The hotel worker heard one caller threaten a likely voter with being reported to the FBI and returning to jail if he voted. Another hotel worker called the police, who came but did nothing. There were also reports of phone calls incorrectly informing voters that their polling place had changed.

� The Cleveland Plain Dealer found that several Lake County residents received an official-looking letter on Board of Elections letterhead informing them that their polling place had changed or that they were not properly registered to vote. A fake voter bulletin from Franklin County Board of Elections was posted at polling locations, and fliers were distributed in the inner city, telling Republicans to vote on Tuesday and Democrats to vote on Wednesday due to unexpected heavy voter registration.

� In Cleveland, the Washington Post reported that unknown volunteers began showing up at voters' doors illegally offering to collect and deliver complete absentee ballots to the election office. The Election Protection Coalition testified that in Franklin County, voters received fliers informing them that they could cast a ballot on November 3. Also, in Franklin County there were reports that about a dozen voters were contacted by someone claiming to be from the county board of elections, telling them their voting location was changed, and �door-hangers� telling African-American voters to go to the wrong precinct were distributed.

In our view, this course of events is not consistent with the right to vote as we understand it. The fact that many of these instances appear to be focused particularly on minority voters is all the more disheartening, and triggers even more clearly our jurisdiction involving civil rights.

We look forward to full and open hearings concerning these instances of disenfranchisement in Ohio and around the Nation. We very much would like to work with you and your staff to insure that allegations of improprieties by both Democrats and Republicans are looked into and considered.
