Today on The BradCast I spoke with Tyson Slocum,the Director of Public Citizen's energy program following the explosion and now oil spill into the Hudson River at the controversial Indian Point nuclear facility just 30 miles north of New York City and the 20 million people in harms way in the metropolitan area. What went wrong at the facility? Why is it still even in operation? And, oh, yeah, should we be worried still about what is happening at Fukushima while we're at it?

Then, I was joined by "DocDawg" of Daily Kos whose startling analysis published late last week, documenting an as-yet unexplained plummet in voter registration forms submitted via public assistance agencies in North Carolina since Gov. Pat McCrory (R) took office, has now lead to the threat of legal action by civil rights groups [PDF] who see a disturbing violation of the National Voter Registration Act (NVRA or "Motor Voter Act") of 1993. Someone has some explaining to do in the Tar Heel State where Republicans there have also enacted the most extreme voter suppression law since the Jim Crow era. You gotta check out this disturbing story!

Plus, some breaking news on the jackass George Zimmerman who was reportedly involved in yet another shooting today and a new report finding that the Baltimore City Jail turned away thousands of arrestees since 2012 after they were brought in by police but too injured to be admitted.

Some, but not all, attempted GOP cutbacks to Early Voting nixed...

A deal announced today by Ohio's Secretary of State may help avoid some of the legal nightmares that plagued the Buckeye State's 2014 elections. While the legal settlement [PDF] restores some of the early voting access Republicans have been attempted, for years, to impose, it also leaves other rollbacks to voting reforms passed after the state's 2004 Presidential nightmare in place.

MSNBC's Zach Roth explains the agreement between Ohio's Republican Sec. of State and the ACLU, which had sued on behalf of the Ohio NAACP and League of Women Voters last year to block new GOP cuts to polling place access:

The deal, announced Friday morning between Secretary of State Jon Husted, a Republican, and the ACLU, undoes some but not all of the damage to voting access caused by last year's cuts. It restores one day of Sunday voting and adds weekday evening hours, but lets stand the elimination of a week when Ohioans had been able to register and vote all in one day.

Both sides hailed the new agreement --- hopefully ending a years-long, roller-coaster legal battle --- as a victory for voters, though Roth added on Twitter that the deal, overall, seemed to be more of a victory for the GOP than for voting rights advocates. Elections expert Daniel Smith is a bit more optimistic about it today, noting that it's "a much bigger deal to have extended hours" and Sunday "Souls to the Polls" voting restored, even as the ACLU, for its part, concedes the settlement is "far from perfect"...

A provision added to Ohio's new transportation bill by Republican lawmakers would have made it more difficult --- and expensive --- for out-of-state students to vote in the Buckeye State. The scheme would have required anybody who registers to vote there to obtain an Ohio driver's license and register their car in the state (at a cost of at least $75) within 30 days, or risk losing their right to drive.

That provision, voting rights advocates warned, was likely to deter out-of-state students at Ohio colleges and universities from registering to vote there, despite a long-held U.S. Supreme Court determination that students may register to vote where they attend school.

The good news on this issue is that while Ohio's Republican Gov. John Kasich signed the transportation bill last week, he used a line-item veto to remove the offending provision. But more than a bit of potential confusion --- and the ability to deter student voters from exercising their right --- still looms...

I wrote a bit about this after last year's elections, though from a different direction. But, given the recent remarks by President Obama (and more than a fair bit of questionable reporting about those remarks), its worth adding a few more thoughts here.

Over the years, I've seen folks misinterpret The BRAD BLOG's coverage of voting and elections and voter suppression by presuming that by covering these things, it's the same thing as telling everyone to vote.

In fact, I strongly believe in the right to not vote. While I think it's a counter-productive response to pretty much everything --- including the misguided and lazy notions that "elections don't really matter" or "both parties are the same" --- I would fight for your right to not vote under our existing system as vigorously as I'd fight for your right to vote (if you want to) and to have that vote counted, counted accurately and in a way that everyone can know that everyone's votes have been counted accurately.

With that in mind, it was interesting to see the reactions to President Obama's statement last week in Cleveland which some, including CNN and, naturally, the ever-outraged Fox "News", took it upon themselves to interpret as a call for "mandatory voting" in the U.S...

FULL TRANSCRIPT OF STIRRING SPEECH NOW POSTED...

President Barack Obama offered a stirring speech this afternoon at the entrance to the Edmund Pettus Bridge to commemorate the 50th Anniversary of the Bloody Sunday March in Selma, Alabama in 1965.

The brutal police violence brought against courageous, peaceful marchers that day, and the subsequent peaceful marches that followed it, led directly to the passage of the landmark Voting Rights Act of 1965, widely regarded as one of the most important pieces of legislation in our nation's history.

The transcript of Obama's speech today is posted in full below. But, here is the portion of his remarks calling for the restoration of the VRA which was renewed for 25 years in 2006 by George W. Bush (one of very few Republican officials in attendance today), but then gutted by the U.S. Supreme Court in 2013...

And with effort, we can protect the foundation stone of our democracy for which so many marched across this bridge — and that is the right to vote. Right now, in 2015, fifty years after Selma, there are laws across this country designed to make it harder for people to vote. As we speak, more of such laws are being proposed. Meanwhile, the Voting Rights Act, the culmination of so much blood and sweat and tears, the product of so much sacrifice in the face of wanton violence, stands weakened, its future subject to partisan rancor.

How can that be? The Voting Rights Act was one of the crowning achievements of our democracy, the result of Republican and Democratic effort. President Reagan signed its renewal when he was in office. President Bush signed its renewal when he was in office. One hundred Members of Congress have come here today to honor people who were willing to die for the right it protects. If we want to honor this day, let these hundred go back to Washington, and gather four hundred more, and together, pledge to make it their mission to restore the law this year.

Of course, our democracy is not the task of Congress alone, or the courts alone, or the President alone. If every new voter suppression law was struck down today, we'd still have one of the lowest voting rates among free peoples. Fifty years ago, registering to vote here in Selma and much of the South meant guessing the number of jellybeans in a jar or bubbles on a bar of soap. It meant risking your dignity, and sometimes, your life. What is our excuse today for not voting? How do we so casually discard the right for which so many fought? How do we so fully give away our power, our voice, in shaping America's future?

New Harvard, Univ. of Sydney survey finds elections in U.S. rank just below Mexico, just above Barbados...

Electoral integrity has not improved in the U.S. over the past year, according to a new study. In fact, elections in Mexico now have more integrity than ours, the new survey, based on the observations of some 1,400 international election experts, finds.

Last year we reported: "A report [PDF] by researchers at Harvard and the University of Sydney finds the U.S. ranks just 26th on a global index of election integrity. That finding places the U.S. in the category of nations with 'Moderate' election integrity, ranking the country one notch above Mexico and one notch below Micronesia, according to the findings tracking elections in 66 countries."

Well, bad news --- of a sort. This year's new Electoral Integrity Project report [PDF] is now out. It takes into account the 2014 mid-term elections in the U.S. and more elections in a number of additional countries. It appears the U.S. has fallen a few pegs from it's 26th place ranking in last year's report [emphasis in the original]...

[C]ontests in the United States scored the worst performance among any long-established democracy. Hence the 2012 Presidential elections was ranked 42nd worldwide, while the 2014 mid-term Congressional races was ranked 45th, similar to Colombia and Bulgaria. One reason is that experts expressed growing concern over US electoral laws and processes of voter registration, both areas of heated partisan debate.

To make matters worse, the survey fails to examine the effects of vote-casting and counting technology on the integrity of elections. But, while the new report highlights what appears to be a huge drop in U.S. election integrity since last year's study, with our most recent national elections now ranked just worse than Mexico's and slightly better than those in Barbados, it's not all as bad as the plummeting ranking would seem to suggest...

Mind-boggling response to BRAD BLOG: 'No correction warranted'...

A few weeks ago, Francis Barry, whose bio identifies him as having "previously served as Director of Public Affairs and Chief Speechwriter for New York City Mayor Michael R. Bloomberg," had a piece published by Bloomberg View (the op-ed arm of the Bloomberg News outlet), portending to examine whether Photo ID voting laws had an adverse effect on turnout this year.

Specifically, as the very first paragraph of his piece explained, Barry claims to have been looking at whether "voter identification laws suppress turnout" since, as he opined in the same graf, "Liberals" argue "not all citizens have the type of ID that many states now require at the polls."

The piece, headlined "Quit Blaming Low Turnout on Voter ID", went out of its way to make the case that such laws had nothing to do with turnout this year, as some states with such laws even saw higher turnout than others without them. While one could attempt to make such an argument, in this case, unfortunately, Barry used extraordinarily deceptive data and moving goal posts in order to do so, as detailed in the emails (posted below) between me, him and one of his editors.

The main trick he employed was an apples to oranges comparison of turnout rates in "21 states that had a competitive gubernatorial or Senate race", where, he misleadingly claimed, "Fourteen of the 21 states had a voter ID requirement in place, while seven didn't".

But here's the thing. Barry deceptively swapped the type of very specific Photo ID laws cited in his first paragraph, with very non-restrictive ID laws that are in use without objection in many states.

When I explained all of this in detail to him and his editors via email (all posted below), the response I received back was, as I noted, "mind-boggling, to be frank"...

'World's Greatest Democracy' rated worst among Western nations; Ranked just below Micronesia, just above Mexico in overall list...

A report [PDF] by researchers at Harvard and the University of Sydney finds the U.S. ranks just 26th on a global index of election integrity. That finding places the U.S. in the category of nations with "Moderate" election integrity, ranking the country one notch above Mexico and one notch below Micronesia, according to the findings tracking elections in 66 countries.

The report, compiled earlier this year and published last month in the American Political Science Association's PS: Political Science and Politics journal, "aims to evaluate the quality of elections held around the world." It is the first of a planned annual series from the Electoral Integrity Project. The organization describes itself as "an independent non-profit scholarly research project based at Harvard University's Kennedy School of Government and the University of Sydney's Department of Government and International Relations, funded by the Australian Research Council and other research bodies."

The group aims to document "why elections fail and what we can do about it."

This year's assessments by 855 election experts around the world are indexed and included in the survey which covers "all national parliamentary and presidential elections held in independent nation-states (with a population of more than 100,000) over an eighteen month period from 1 July 2012 to 31 December 2013."

"Based on a survey collecting the views of election experts, the research aims to provide independent and reliable evidence to compare whether countries meet international standards of electoral integrity," the report's introduction explains. "The study collects 49 indicators to compare elections and countries around the globe."

While the researchers found even worse problems in the elections of many younger countries, some of those nations still managed to out-perform the U.S. on the overall ranking, as we brought up the tail end of Western democratic nations, according to the experts' analysis, as described in one of bullet-points summarizing the report's findings [emphasis in original]...

It's been happening for years now. On the day after elections like last Tuesday's, media figures begin navel gazing to figure out how pre-election polls, created by dozens of independent pollsters using dozens of different methodologies, could all find the same thing but turn out to be so wrong once the election results are in.

The presumption is that the results are always right, and if they don't match the pre-election polling, its the polling that must be wrong, as opposed to the election results.

On Wednesday morning, after Tuesday's mid-term election surprise in which Republicans reportedly won handily in race after race despite pre-election polls almost unanimously predicting much closer races or outright Democratic victories, FiveThirtyEight statistics guru Nate Silver declared "The Polls Were Skewed Toward Democrats".

His analysis of aggregated averages from dozens of different pollsters and polls this year found that the performance of Democrats was overestimated by approximately 4 percentage points in Senate races and 3.4 points in gubernatorial contests. Silver's assessment relies on a "simple average of all polls released in the final three weeks of the campaign," as compared to the (unofficial and almost entirely unverified) election results reported on Tuesday night. He doesn't suggest there was anything nefarious in the polling bias towards Dems this year, simply that the pollsters got it wrong for a number of speculative reasons.

Citing the fact that nearly all of the polls suggested Democrats would do much better than they ultimately did, when compared to the reported election results, Silver asserts it wasn't that the polls were more wrong that usual, per se, but that almost all of them were wrong in a way that appears to have overestimated Democratic performance on Election Day.

"This year's polls were not especially inaccurate," he explains. "Between gubernatorial and Senate races, the average poll missed the final result by an average of about 5 percentage points --- well in line with the recent average. The problem is that almost all of the misses were in the same direction."

Silver is much smarter than I when it comes to numbers; I'm happy to presume he has the basic math right. But he seems to have a blind spot in his presumption that the pre-election polls were wrong and the election results were right. That, despite the lack of verification of virtually any of the results from Tuesday night, despite myriad and widespread if almost completely ignored problems and failures at polls across the country that day, and despite systematic voter suppression and dirty tricks that almost certainly resulted in election results (verified or otherwise) that were skewed toward Republicans...

Despite 'army' of monitors and new smartphone app, discredited org uncovers just 18 'irregularities', 0 polling place impersonation...

For some reason, this tweet of mine, from about 4am on Election Night, has become very popular...

Perhaps we can chalk up its popularity to the joke it makes of right wing groups like "True the Vote" which has, since its dubious inception, received and spent a fortune over the years tripping over its own wingnut feet to publish fake "voter fraud!" data, find itself tossed out of courts, harass legal voters attempting to cast legal votes, and otherwise make repeated jackasses of themselves by attempting to perpetuate the well-worn, but fact-shy Republican hoax that there is a massive Democratic voter fraud epidemic at our polls.

TTV was made even more famous lately when they were cited, by name, by 7th Circuit Court of Appeals judge Richard Posner, a very well-respected Reagan-appointed conservative jurist, in his recent opinion on Wisconsin's Photo ID voting law. In Posner's devastating, must-read dissent decrying such discriminatory laws, the most well-cited legal scholar of the 20th century, according to the Yale Law School's Journal of Legal Studies, described the group's "evidence" of voter impersonation fraud as "downright goofy, if not paranoid," citing "the nonexistent buses that according to the 'True the Vote' movement transport foreigners and reservation Indians to polling places" to illegally cast a ballot.

The solution to the pretend problem that TTV lies to its followers about, is, of course, polling place Photo ID restrictions that, as Judge Lynn Adelman of the U.S. District Court in Wisconsin wrote in striking down that state's discriminatory, unconstitutional law after a full trial earlier this year, serve only to "prevent more legitimate votes from being cast than fraudulent votes."

So the group's newest embarrassing failure to uncover virtually any "voter fraud" at the polling places it monitored in dozens of states during Tuesday's mid-term general elections --- with an army of righteous and disinformed civilian wingnuts armed with a brand-new smart phone app --- comes as little surprise. It is, however, kind of amusing...

First and foremost:

  • If you have problems or see problems at the polls, be sure to report them to 866-OUR-VOTE, or at OurVoteLive.org!
  • Catch any problems at the polls on photo or video? Upload it to YouTube and social sites, and tell us and the rest of the world about it!
  • Be at the polls when they close and photograph and video tape the results tapes that are printed out from electronic systems. Results have a way of changing between the time they're printed out at the close of polls and the time they show up on the web. Your photographic evidence could help save an election!
  • Watching results on the web throughout the night? Take screenshots, save them as you go, and include a timestamp in the filename when you do. Those web results also have a way of changing, sometimes in the wrong direction, throughout the night. Your evidence could help save an election!
