Donald Trump was busy 'making American great again' today by extending the longest federal government shutdown in the nation's history, intimidating and threatening federal criminal witnesses and their families, lying about Democrats and calling the U.S. House Speaker silly names. And --- oh, yeah --- continuing to do nothing about a very clear case of election-flipping fraud.

By and large, the only good news we could find for today's BradCast comes from the states. But we'll take what we can get. Among the stories covered on today's program:

  • Los Angeles teachers returned to work after a six day strike was settled with a new contract that increases pay and decreases class size, among other things;
  • In D.C., in the meantime, the government shutdown continued as new polling from AP-NORC finds Trump's approval numbers plummeting over the last month in the bargain;
  • After the President insisted on Wednesday that he was coming to Congress next week to deliver his State of the Union address amid the shutdown, Speaker Pelosi called his bluff and announced she was officially postponing it until after the government was reopened;
  • Also cancelled for now, the public testimony of Trump's former lawyer Michael Cohen before the U.S. House Oversight Committee that had been scheduled for the first week in February. The cancellation, according to Cohen's attorney, comes after the President's attempts to intimidate the federal witness by calling for his family to be investigated. Intimidating or threatening Congressional witnesses is a federal crime, not unlike the felony Cohen says Trump "directed" regarding hush-money payoffs before the 2016 election to women with whom Trump had allegedly had sexual affairs. Cohen could still be subpoenaed to testify before he begins a three year sentence in March;
  • The U.S. House seat from North Carolina's 9th Congressional District remains vacant today, after a state judge on Tuesday declined to order the certification of Republican Mark Harris amid the ongoing investigation into absentee ballot fraud by a GOP contractor hired by Harris. The apparent fraud by the contractor, McCrae Dowless [pictured above with Harris], appears to have flipped the race in Harris' favor by 905 votes. The State Board of Elections investigating the matter was dissolved earlier this month by a court, in an unrelated case which found that Republican state lawmakers had unconstitutionally changed the make up of the Board to disadvantage the Democratic Governor elected in 2016. That was the same year that Dowless was reported to have committed absentee ballot fraud on behalf of a number of other Republicans.

    Despite the State Election Board's referral for prosecution to Trump's U.S. Attorney in the state in 2017, action was never taken by federal prosecutors in response to the mountain of evidence of actual election fraud discovered by the Board. That, as Trump falsely claimed that same year that massive "voter fraud" was the reason for his 3 million vote loss to Hillary Clinton in the popular vote. While Trump was lying about massive voter fraud, his U.S. Attorney in North Carolina was prosecuting a handful of cases of unlawful votes allegedly cast by some non-citizens, while ignoring the election-flipping GOP absentee ballot fraud scam and allowing it to be repeated in the 2018 contest;
  • One of Trump's longtime partners in false claims of non-citizen "voter fraud" was then-Kansas Sec. of State --- and top GOP "voter fraud" fraudster --- Kris Kobach, who lost his race for Governor last year to Democrat Laura Kelly. Now, KS state lawmakers have introduced measures to revoke the prosecutorial powers they had granted to Kobach, at his years-long insistence. (He was the only Sec. of State in the nation to enjoy such powers.) The new GOP Sec. of State in Kansas wants to return the office to its original purpose of administering elections, after years of claims by Kobach that "illegal aliens" were stealing Kansas elections by unlawfully voting. The disgraced former Sec. of State failed to prosecute any such cases. But he did nab less than a dozen voters, mostly for casting ballots in two different states while owning property in each;
  • Finally today, some Dems floated the idea of giving Trump some of the billions he's demanding for a border wall, but only for other forms of border security. At the same time, Republicans supporting the President's demands have never once demanded to known how that spending would be paid for, despite repeatedly telling Americans we simply can't afford money for healthcare or education or infrastructure or the environment or verifiable election systems unless we cut spending elsewhere. With that in mind, we close with a noteworthy observation by HBO's Bill Maher last weekend on what Americans should really be learning from the longest federal government shutdown in U.S. history...

The federal government continue to spiral towards utter dysfunction under a President on the precipice of (take your pick). But one freshman Congresswoman provides a bit of a light at the end of the Trump tunnel. [Audio link to today's complete BradCast is posted below.]

Among the stories covered on today's program...

  • Donald Trump's former personal lawyer Michael Cohen admits he paid a guy from Jerry Falwell Jr.'s Liberty University to rig online polls for Trump before he announced his candidacy in 2015. That, as Cohen is reportedly reconsidering his decision to testify to Congress next month in advance of his three year prison sentence, due to threats (witness tampering? intimidation?) by the President against him and his family. Trump failed to report the $50,000 payoff to rig polls to the FEC, which is yet another potential federal felony and/or article of impeachment for the sitting President. While the story should surprise no one at this point (remember, he also paid extras to cheer him on while announcing his candidacy at Trump Tower that year), its somehow still stunning and disturbing as yet another indication of just what Trump was likely willing to do, at any cost, to win in 2016;
  • Speaking of what Trump and his campaign were willing to do, his new personal lawyer, Rudy Giuliani, may have broken the Internet after his appearance on CNN Wednesday night, in which he moved the "collusion" goal posts by falsely claiming that neither he nor the President ever claimed his campaign --- if not Trump himself --- "colluded" with Russia. In fact, contrary to Giuliani's ridiculous assertions, both men claimed repeatedly that nobody on the Trump Campaign was involved in such an activity. As of Wednesday night, it seems, Trump's lawyer is officially backing off that claim on behalf of the President...for some reason;
  • Reverberations and consequences of Trump's nearly-month long federal government shutdown continue. As House Speaker Nancy Pelosi and a Congressional delegation were preparing to leave today for a secret trip to visit U.S. troops in Afghanistan, Trump, in retribution for Pelosi's threat to postpone his scheduled State of the Union Address during the shutdown, rescinded permission for the use of a military plane set to take Pelosi and the others on the overseas trip. You'll also be shocked to hear he lied about it all too;
  • Meanwhile, as more Congressional Republicans --- and even a top former Administration official --- are questioning the wisdom of shutting down the federal government over Trump's demand for $5.7 billion to begin building his southern border wall, senior citizens and people with disabilities are facing the threat of potential eviction in HUD and USDA subsidized housing across the country;
  • At the same time, the Administration is calling some 50,000 furloughed federal employees back to work without pay at agencies such as the FDA, FAA, and at the IRS as tax season begins;
  • But, speaking of taxes, there is a reason that Republicans are freaking out --- and lying --- about the recent proposal floated by Rep. Alexandria Ocasio-Cortez (D-NY) to raise the nation's top tax bracket to 70% on those earning more than $10 million: the proposal is wildly popular --- by double-digit margins --- across virtually every demographic and every area of the country. Thus, folks like Wisconsin's failed former GOP Gov. Scott Walker was out bragging on social media this week about lying to school children about how AOC's proposal would actually work, who would and wouldn't be affected by it, and by how much;
  • Finally, Desi Doyen joins us for the latest Green News Report, as Dems grill the Administration's new nominee/coal lobbyists tapped to head an Environmental Protection Agency (EPA) where pollution prosecutions have plummeted since Trump took office, while Australia faces yet another record heat wave, and as the business world slowly begins waking up to the mounting threat of climate change...

We start off today's BradCast with two encouraging legal rulings from the courts with our guest today, Slate legal reporter MARK JOSEPH STERN. [Audio link to complete show follows below.]

First up, the damning opinion issued on Tuesday by a U.S. District Court judge in Manhattan finding Treasury Secretary Wilbur Ross repeatedly violated the law --- and lied about his reasons for doing so --- in adding a controversial question on citizenship to the 2020 U.S. Census. Stern joins the federal judge in calling out Ross' lies about adding the question supposedly at the request of the the Dept. of Justice to help enforce the Voting Rights Act (rather than as a blatant attempt to rig the Census in hopes of boosting GOP political power during the next round of redistricting).

"By my count, Judge Furman held that Commerce Secretary Wilbur Ross violated the law by adding the citizenship question in at least six different ways," Stern observes. "When you add them all together, it is a sort of symphony of lawlessness that cannot be ignored by the courts."

"Ross just lied. He lied to Congress. He lied in court filings about why he added this citizenship question. It is very clear, black letter law, that when a federal agency like the Commerce Department wants to take some kind of formal action, it has to give the real and truthful grounds for its decision, it has to justify it truthfully. Ross just didn't do that here." He goes on to explain, however, that, despite the encouraging ruling yesterday, the Republicans' stolen Supreme Court will ultimately enjoy the final say on the matter. He also shares his thoughts on whether Ross should be and/or will be criminally prosecuted for lying to Congress and the courts about the issue, as made clear by the federal court ruling.

Then, Stern offers some surprisingly good news from SCOTUS today regarding a unanimous(!) opinion from the Court supporting the right of some workers to bypass costly arbitration clauses and file class action lawsuits against employers when they are ripped off by them --- though only in certain circumstances. Still, given the unanimous opinion in this case, authored by Neil Gorsuch of all Justices, we'll take it!

Next, we review Tuesday's confirmation hearing in the U.S. Senate Judiciary Committee for Donald Trump's Attorney General nominee William Barr. Stern warns that his troubling record alone --- "Barr takes a wildly expansive view of executive power and authority" --- might have been enough to derail his nomination in any other time, but for the fact that so many Democrats and Republicans alike are now desperate to replace Trump's wildly unqualified (and, arguably, unlawfully appointed) Acting AG Matthew Whitaker.

Barr, who served briefly as AG in 1991 during the George H.W. Bush Administration (where he successfully pushed for Presidential pardons for a number of top officials involved in the Iran-Contra scandal), promised independence from the White House and that he would allow Special Counsel Robert Mueller to complete his probe into Team Trump's alleged involvement with Russia and obstruction meant to cover it up. However, Barr equivocated on a number of points related to the probe, such as whether he'd recuse himself from overseeing it if DoJ ethics officials advised him to do so, and whether he would release Mueller's report at all to the public.

Stern shares insight and response to a number of other troubling moments from Tuesday's hearings, such as when Barr responded to a question from Sen. Richard Blumenthal (D-CT) about whether a sitting President could be indicted and when he was asked directly by Sen. Amy Klobuchar (D-MN) about whether the Justice Department, under his command, would "jail reporters for doing their jobs". Barr's response on the former was questionable, at best, and downright chilling on the latter, from the man tapped to be the nation's top law enforcement official. "There's just a right and wrong answer here," Stern quips, "and he gave the wrong one."

Finally today, the State of the Union Address to a joint session of Congress previously scheduled for later this month may now be cancelled amid the ongoing historic federal government shutdown, as House Speaker Nancy Pelosi rescinded her invitation to Trump today. And, in Syria today, four Americans --- two U.S. troops and two civilians --- were killed and three others wounded after a bombing claimed by ISIS in a crowded area. The attack in the northern city of Manbij comes on the heels of Trump's claim to have ordered the withdraw of all U.S. troops in country, based on his assertion that "we have defeated ISIS in Syria." The President's claim --- which helped lead to the resignation of Defense Secretary James Mattis before Christmas --- was, remarkably, repeated by Vice President Mike Pence today during an address at the State Department several hours after the news of the deadly attack on Americans and others in the war torn nation had become public...

On today's BradCast, as one political mess piles up on top of another in D.C. (and across the country), at what now seems to be an impossible pace, our old friend HEATHER DIGBY PARTON of Salon and "Digby's Hullabaloo" blog is here today to try and help us dig out of from under it. Wish her luck. [Audio link to show is posted at end of article.]

First up, Parton responds to Donald Trump's charge on Monday that Democrats who failed to stand and applaud during his State of the Union address last week were "unAmerican" and may have committed "treason". Yes, he actually said as much, even though treason is punishable by death, and couldn't possibly be applied in this case. (And, yes, we also discuss how many others also misuse the charge of "treason" against Trump.)

Then, Republicans on the U.S. House Intelligence Committee have finally voted to release the Democratic Rebuttal Memo written in response to the cherry-picked Republican Memo produced by committee Chair Devin Nunes (R-CA), perhaps in collusion with the White House. The Nunes memo, though landing with a thud after it's release on Friday, is still being used by Fox "News" GOPers to falsely make the case that Robert Mueller's Special Counsel probe must be shut down due to an alleged misuse of material from the so-called "Trump/Russia Dossier" written by a former British intelligence agent, for the FISA warrant application sought and obtained by the FBI in 2016 (and renewed three times) to intercept communications with Carter Page, a former Trump Campaign advisor and suspected Russian asset.

But will the President actually allow the House Democrats' rebuttal memo to be released to the public? Parton has her doubts ("I don't know why people think it's a done deal. I mean, I keep wanting to say, 'Have you met Donald Trump?!'") She also has a few thoughts on Nunes and the entire GOP attempt to undermine the Mueller probe on specious grounds and on the promise by Nunes' to produce several new memos in what is part of his new effort to make the case that Hillary Clinton, not Donald Trump, conspired with Russia before the 2016 election. Parton compares the effort to go after members of the FBI and DoJ, etc., to Sen. Joseph McCarthy's targeting, in the 1950s, of alleged Communists in the FBI, Dept. of Justice and State Department. Sadly, the effort by Nunes, Trump and friends seems to be working, at least partially, according to a stunning new Axios poll.

I also share my own concern with Parton about what I see as a serious weakness in the Democrats' case for "collusion" against Trump, and she shares her prediction that "there's an excellent chance" a second Special Counsel will be convened to try and prosecute Hillary Clinton before this is all said and done.

We then go on to discuss the mess in Congress in advance of another possible federal government shutdown later this week, which Trump, on Tuesday, said he welcomes amid what has been his own bad faith deal-making with Democrats over the fate of some 800,000 children of immigrants brought here illegally decades ago. Those kids had been protected from deportation by the Obama-era DACA program, until Trump reversed it --- using them as human shields for his radical new immigration demands --- setting a deadline to begin their deportation as early as March 5th, unless a deal can be struck for legislation passed by Congress to protect them.

"This is a mess. It's been a mess," Parton argues. "Giving the Democrats a little bit of slack, this immigration problem and the DACA kids have been out there for a long time, and they have tried. The problem for the Democrats was that they thought, when Donald Trump was elected, because of this promises "Oh, I love the [DACA] kids!', that he had the credibility to bring along the Freedom Caucus and all these right-wing anti-immigration hawks in the Congress. That was the game that Trump talked. It turns out that he's a complete mess. He doesn't know how the government works. He doesn't know how to negotiate."

So, now, such a deal must somehow be worked out between the Dems, who are lousy negotiators, and Trump, who is a dishonest one, in advance of Friday's government shutdown deadline, or be pushed off yet again, leaving the fate of the DACA kids in jeopardy as March approaches. Not helping in the matter, as Parton observes, is Trump's far-right, anti-immigrant Chief of Staff John Kelly, not to mention the untrustworthy Senate Majority Leader Mitch McConnell.

And, finally, some new developments out of Pennsylvania where, speaking of the rise of authoritarianism under Republican rule, an elected GOPer in the state House is now moving to impeach five of the seven Justices on the state Supreme Court after they voted to require new U.S. House maps for the state. The new districts would replace the GOP's illegally gerrymandered Congressional Districts that Republicans have been using to hold 13 of 18 U.S. House seats in the closely divided (but Democratic-leaning) swing-state. The nascent impeachment effort --- though one that should be taken seriously --- in the PA House comes as the Republican President of the state Senate continues to defy the court's orders, despite their ruling being upheld by the U.S. Supreme Court on Monday.

Yes, this mess keeps getting messier. By the minute...

On today's BradCast: The government shutdown ended just last week. Next week, the next deadline for funding the government is upon us, along with the same fight to protect some 800,000 "Dreamers" from being deported. Do Democrats have any better plan to stand up to Trump and the Republicans this time? [Audio link to show follows below.]

First up, some important news headlines that are likely to disappear among all of the madness in D.C. and much of the corporate media: There was yet another school shooting today, following the one in rural Kentucky just last week. This time it was a middle school in Los Angeles, where a 12-year old girl is said to be in custody after two 15-year olds were shot.

In Pennsylvania, the Republican President of the Senate, Joe Scarnati, is blatantly refusing orders by the State Supreme Court to turn over districting documents after the court found last week that the GOP-controlled legislature in the largely 50/50 swing-state had gerrymandered U.S. House districts in violation of state law. Republicans currently hold 13 seats to the Democrats' 5 under the GOP-drawn maps. The Court has ordered the maps immediately redrawn, but Republicans are trying to prevent that, and are now defying the court in doing so. Scarnati's behavior continues a growing and disturbing pattern by Republicans across the country --- and now all the way up to the White House --- to simply refuse to follow the rule of law and orders of the court.

Meanwhile, some very good news for voters in Florida, as a federal court, just before airtime, finds the "scheme" employed by Republican Gov. Rick Scott to consider restoration of voting rights for some 1.5 million former felons in the state, to be in violation of the U.S. Constitution's 1st Amendment Free Speech clause and 14th Amendment Equal Protection clause. Currently, the process to overcome Florida's lifetime ban on voting rights for former felons who have long ago completed their sentences, finished parole and paid off all restitution, requires personally groveling to the Governor and hoping rights are restored, at his standard-free whim, according to the federal judge. That may now, finally, change (unless the ballot initiative to restore such rights to former felons is adopted first this November, after the measure's proponents successfully gathered nearly 1 million signatures in support last week!)

Then, it was only last week that Senate Democrats caved to Donald Trump and the Republicans following just two days of a government shutdown. After promising to vote against any government spending bill unless it included protections for some 800,000 "Dreamers" --- Obama-Era DACA recipients who, thanks to Trump, now face deportation as soon as March 5 --- the Dems folded and reversed course.

That, as our guest today, DAVID FARIS, Roosevelt University political scientist and The Week contributor, argues, has now further weakened what had previously been a fairly strong hand for Democrats.

Now, the next funding deadline and possible shutdown looms just one week from today, as the previous reversal by Democrats has likely bolstered Republican resolve and afforded time for Trump to move the goal posts even farther right on his immigration demands. He detailed those demands during his offensive remarks on the matter in his State of the Union Address Tuesday night.

"It highlights to me way it was such a huge mistake for Democrats to cave and come back to the table and reopen the government. Because what it did was it allowed the President and his allies to seize the initiative here, and to release this plan to the public. It's just shocking to me that Democrats didn't think ahead, 'What's coming up? The State of the Union.' This will allow the President to set the parameters of the debate," Faris says.

He charges that Democrats "went from a situation where they were fighting for one issue that they had a 53 point advantage on --- and that's DACA and the Dreamers --- to a situation where now we have multiple immigration proposals thrown together, and they all, at least, have good plurality polling for the President."

Faris, author of the upcoming book, It's Time to Fight Dirty: How Democrats Can Build a Lasting Majority in American Politics, argues the fate of the "Dreamers" may now, unthinkably, be left up to the hope that Trump decides to simply do the right thing for those 800,000 children brought here illegally as children decades ago by their parents.

Finally, Desi Doyen joins us for the latest Green News Report, with some good news (for a change) for Puerto Rico, some very good news for the state of New Jersey under their new Democratic Governor, and some more bad news for the planet and the state of Maine under their dumbest Governor in the nation...

After some quick news headlines --- (on another top Trump official resigning in shame, another senior Republican Congressman announcing he won't run for reelection, a Democratic Senator avoiding a second corruption trial, and a literal GOP train-wreck) --- we dive into our special coverage of what used to be a solemn and largely serious U.S. tradition.

We're joined today for commentary, fact-checking and other post-SOTU analysis by DAVE JOHNSON, longtime blogger, creator of "Seeing the Forest", and former Senior Fellow at Campaign for America's Future, and TARA DEVLIN, comedian, creator of RDTDaily.com and host of the weekly, TaraBuster podcast.

Desi Doyen joins us as well, of course, to help break down and fact-check Trump's misleading claims and outright SOTU lies on the economy, tax cuts, healthcare, immigration, drug prices, dangerous "national security" plans, his deceptive infrastructure proposal, his racist dog-whistles and shameless attempts at fear-mongering the American people during Tuesday night's joint session of Congress.

Guest: New Republic's Jeet Heer on Trump's 'dark, dystopian and divisive' address to Congress, and the media's woeful mischaracterization of it...

On today's BradCast: with quickly mounting pressure from both Republicans and Democrats following reports that he failed to disclose meetings with Russia's U.S. ambassador as a Trump surrogate during last year's campaign, Attorney General Jeff Sessions finally announces he will recuse himself from any investigation into the Trump campaign's alleged ties to Russia. [Link to audio of show posted below.]

The breaking announcement today comes just hours after Trump said there was no need for Sessions to recuse himself, as some Democrats are now charging that sessions should resign for having "lied to Congress". But did he?

Also today, before and during his address on Tuesday to a joint session of Congress, Trump shamefully avoided responsibility for his botched raid in Yemen by hiding behind a Navy SEAL widow and his generals who, he claimed, described the mission as a great success, having obtained loads of actionable intelligence. The following day, however, it was inconveniently reported that "ten current U.S. officials across the government" disputed the President's characterization. They charge that no significant intelligence was obtained during the raid that was quickly approved by the President and led to the death of a U.S. Navy SEAL and 25 civilians, including 9 children.

Then, we're joined by New Republic's Jeet Heer on the "dark, dystopian, and divisive message" delivered by Trump to Congress this week, and on the corporate media's abject failure to accurately report on the address to the American people.

"I was kind of shocked at the coverage that the speech was receiving," Heer tells me. "I grant you, by Trump standards, this was more moderate and Presidential but only by those standards." He goes on to describe the "Jekyll and Hyde" nature of the speech in which he may have softened his tone, but still detailed extremist policies that harken back to his "American Carnage" inaugural address.

Heer also rings in on today's breaking news of Sessions' recusal, describing the new AG and former Senator "as a man who wanted to impeach a President over perjury. So, I think 'Do we have a different standard for him than Bill Clinton?'"

Finally today, Desi Doyen returns with our latest Green News Report on the new EPA Secretary Scott Pruitt who is also now being accused of having lied to Congress during his nomination hearings...

While the corporate media have been somewhat beside themselves with effusive praise of Donald Trump's success at reading a speech from a teleprompter at his address to a joint session of Congress on Tuesday night, our guests on today's BradCast see it somewhat differently.

Suffice to say journalists Jacki Schechner and Gaius Publius were far less impressed. They both join us today to un-spin Trump's speech and some of the alternative facts he presented --- on healthcare, energy, the hate-crime epidemic, his exploitation of the widow of a Navy SEAL killed recently in Yemen and more --- as well as both the media's and Democrats', at times, beguiling response to it all.

Both also offer thoughts on the very happy "merger" of the Trump and Republican Party brands, as well as the DNC's election of a new party chair over the weekend --- and what all of it means going forward.

On today's BradCast...

First up: New polling shows Bernie Sanders surging in NH among Democrats and Gov. John Kasich --- yes, John Kasich --- surging to second place among Republicans in the state...if you believe those sorts of things. At the same time, during the GOP establishment's half-hearted search for an alternative to Cruz/Trump, the Republican Party appears to be plummeting in popularity during the course of the 2016 Primary cycle, even as actual Republican voters seem to be warming up to the idea of Trump as their party's nominee.

Then, a remarkable new study from Oxfam finds that the world's richest "62 people own the same wealth as half the world" (the planet's 3.5 billion poorest!) And, some of those 62 richest-people-on-the-planet --- like the Koch Brothers and the Walmart heirs --- are amongst the biggest spenders when it comes to attempts to buy our political system.

So, what can be done about that last part? Jon Schwarz, Senior Editor at The Intercept, joins me to discuss how, despite "eloquent" comments suggesting otherwise during his State of the Union address last week, President Obama could take executive action immediately, on his own, to help radically reduce the "dark money" in our electoral and political system.

"One thing that Obama absolutely can do, by himself, this afternoon, if he wants to, is sign an executive order placing requirements on federal contractors," Schwarz explains, describing other similar actions that the President has taken in the recent past concerning federal contracting. "He can do it and he's done it in the past. What he could do about money in politics now is issue an executive order saying that federal contractors have to disclose any dark money contributions that they're making."

"If he did that, that would cover about 70 percent of the biggest corporations," Schwarz tells me. "So, it would not force the disclosure of any and all dark money, but it would force disclosure of a great deal of that. And, as I say, he could do that this afternoon."

We discuss some of the reasons Obama has failed to do this, to date, despite his calls for campaign finance reform throughout his career and as recently as last week's SOTU --- even with so many calls from so many quarters to take this action. "Obama likes to say really great-sounding stuff about money in politics --- he's said it his whole Senate career, his whole Presidency --- but he's never done anything. It's really extraordinary."

Finally on today's show, a few words on last night's passing of The Eagle's Glenn Frey and the latest on the outrageous lead poisoning crisis in Flint, MI, caused by the tyranny (literally) of Gov. Rick Snyder (R)...

On today's BradCast: How outrageous new fees imposed on behalf of Nevada's monopoly electricity company and the state's Big Government Republicans have suddenly resulted in thousands of lost jobs, ripped-off consumers, and a mass exodus of solar companies from the state where the industry had previously been booming.

What did GOP Governor Brian Sandoval --- whose top staffers are also lobbyists for the state's NV Energy company --- know and when did he know it? And how much did he personally have to do with his appointees on the state's Public Utilities Commission (PUC) ripping off solar customers by raising rates on them, while lowering the amount of money rooftop solar owners are paid for selling back unused, clean power to the grid?

Lauren Randall, manager of public policy for Sunrun, which describes itself as the largest dedicated residential solar company in the U.S., and a spokesperson for The Alliance for Solar Choice the rooftop solar industry's advocacy group, joins us to explain what just happened in NV and how it has resulted in Sunrun, Solar City and several other rooftop solar companies being forced to shut down entirely in the state. That, after Sandoval had previously offered incentives to encourage private consumers to invest in clean, solar energy.

"It's absolutely outrageous," Randall tells me on today's program. "The easiest way to understand this is it's a 'bait and switch'. Nevada passed incentives to attract residents to go solar, and then after baiting homeowners with incentives, the state switched the rules, penalizing solar homeowners to deliver basically additional profit to NV Energy."

She says there is a "tremendous amount of backlash from both sides of the aisle on this," after "the rules were changed in the middle of the game for over 16,000 customers who went solar to save money on their electricity bills and to move the country away from fossil fuels and on toward more clean energy."

During the interview, she details how her company is now suing the state to force Sandoval to release communications between himself and his staffers, the PUC and NV Energy, as the industry hopes to roll back the devastating new rules which were announced just before Christmas and took effect on the first of the year.

Sandoval's commission, Randall explains, "just presented the most anti-business, anti-solar rules that we've seen, really anywhere in the country. It's been just catastrophic for families in Nevada. What we're seeing now is upwards of a thousand job losses from this."

Randall is hopeful that public outrage may force the PUC to overturn their new rules that have otherwise just killed the solar industry in sunny Nevada. She charges that the effort is a "coordinated campaign" among fossil fuel-based utility companies in a number of states (and could be coming to a state near you!) and asks folks to sign up to help in the fight.

On today's BradCast, we expose a dangerous, deceptive new scheme to hoax California voters into allowing Internet Voting across the entire state. Plus, we discuss Obama's final State of the Union and take calls on all of the above.

First (after an official welcome to our newest affiliate --- the great am950 KTNF in Minnesota!), I explain the newly proposed California ballot initiative describing itself as the "Election Data Security & Military Ballot Access Act". The initiative is nothing of the sort. It is little more than a very well-financed and completely deceptive scam to force Internet Voting into the Golden State by describing it as something other than it is.

Rather than use the words "Internet Voting" or even "Internet" in any way, the 46-page initiative describes the proposed, dishonest new scheme as "electronically delivered vote-by-mail"!

Who's behind it? We still don't know. But it was submitted recently to the state Attorney General by the high-priced Sacramento law firm of Olson Hagel & Fishburn LLP and needs to be, at the very least, retitled before it ends up on the state ballot.

This is important even if you don't live in California! When it comes to voting systems, what happens here (where we have the most electoral votes in the nation) is often adopted by states across the country!

Election Integrity expert and advocate Jim Soper of CountedAsCast.org and the CA Voting Rights Task Force, joins us from the state capitol building in Sacramento to discuss the deceptive initiative and a similar (if somewhat less deceptive) legislative initiative sponsored by Democratic Assemblyman Phil Ting (San Francisco). The latter, happily, was killed in committee today, Soper reports.

He explains why the ballot initiative is so misleading, why Internet Voting is a horrific idea --- as virtually every computer scientist and security expert has demonstrated over and again --- and asks listeners to contact the CA Attorney General by Thursday, when the comment period on the initiative is supposed to end.

There's a reason why we always refer to Fox "News" here with quotes around that second word. Simply put, they're not a news outlet, they're a Republican propaganda outlet. That's fine, but it ain't news. Looks like the White House may have finally developed their own quiet version of that, as noted by Shepard Smith following his pre-SOTU luncheon at the White House last week...

In 2009, the White House took a bunch of push-back (and largely folded to it), when their Communications Director at the time told CNN: "What I think is fair to say about Fox --- and certainly it's the way we view it --- is that it really is more a wing of the Republican Party. They take their talking points, put them on the air; take their opposition research, put them on the air. And that's fine. But let's not pretend they're a news network the way CNN is."

They were right (correct, I mean, if not necessarily politically wise), in calling out Fox back then for what they are, even as they publicly backed off the accurate assertion in the face of the usual outrage --- OUTRAGE! --- from the Fox "News" Stooge Brigade. They are no less correct now in dropping the word "News" when referring to Fox...even if it wasn't necessarily meant as a slight in this case. It just happens to be true. Sorry, Shep.
