After three Presidents, trillions spent and hundreds of thousands killed, it's time to end the endless war...
By Ernest A. Canning on 8/30/2017 11:00am PT

There have been occasions during the history of our Republic where a traumatized Congress has, under the gravity and stress of a calamity, made a hasty decision without sustained debate or thoughtful consideration of its consequences. One of those occurred just three days after the September 11, 2001 terrorist attack.

Over the singular objection of Rep. Barbara Lee (D-CA), the only member to vote against it in either chamber, Congress passed a joint resolution --- the 2001 Authorization for Use of Military Force (AUMF). This joint resolution differed markedly from the formal Declarations of War that were issued in the aftermath of Pearl Harbor.

During World War II, there were specific nation-state enemies and an attainable, concrete goal --- the defeat of the Axis powers. Congress did not authorize and Presidents Franklin D. Roosevelt and Harry S. Truman did not embark upon a fool's errand --- the permanent elimination of any and all future threats to our republic created by the very existence of Nazi and fascist ideologies.

The 2001 AUMF, however, was not confined to specified nation-state enemies. Congress authorized the President to use military force against "nations, organizations or persons" as part of an impossible task: the prevention of any and all "future attacks of terrorism against the United States."

As astutely observed by Retired U.S. Army General William Odom in 2002...

Guest: Former U.S. Army Captain Sue Fulton of Sparta...
By Brad Friedman on 8/25/2017 6:30pm PT

On today's BradCast: With millions of Americans imperiled by a massive, potentially "catastrophic" hurricane tonight, the President of the United States took the moment to give the finger to the Pentagon by signing a ban on transgender service members in the military. [Audio link to show follows below.]

(Note: Giving the finger to the federal court system and the U.S. Constitution itself, with a pardon of the reviled Sheriff Joe Arpaio, didn't happen until the hurricane became a Category 4 and we were already off air today.)

First today, Hurricane Harvey is set to slam into the Texas Gulf coast as dire warnings are issued by the National Weather Service that some areas may be "uninhabitable for weeks or months" thereafter. The startling language in the forecasts echo that not heard since it was used by in the extraordinary NWS warning issued prior to Hurricane Katrina in 2005, 12 years ago this week (as we also covered on air at the time).

Our own Desi Doyen --- a native of south Texas herself --- explains the concerns of changing, global warming-fueled weather patterns that are leading forecasters to predict that Harvey may stall in place for days, dropping massive amounts of rainfall (as much as 40 inches in some places) over the next several days, before the storm could move back out to the Gulf only to return for a second landfall. Are state and federal officials --- with many key posts still unfilled by Trump --- fully prepared for what's to come?

Then, we're joined by SUE FULTON, former President of Sparta, an organization supporting lesbian, gay, bisexual and transgender members of the military and their families, to discuss Donald Trump's recent surprise Twitter-announcement that "The United States government will not accept or allow transgender individuals to serve in any capacity in the U.S. military."

Fulton, a former U.S. Army Captain and a member of the first coed graduating class at West Point, had worked with the Obama Administration's Pentagon on the policy that had previously lifted the ban on openly transgender service members last year. She describes the detailed and meticulous process that had been carried out by the Department of Defense, with stakeholders from every branch, as well as outside organizations, and the military's own interest in carrying out the policy change that Trump is now reversing.

We discuss how Trump's own process to reverse the policy change appears to run precisely counter to the one carried out by Obama, as well as the wishes of military leaders and service members and the vast majority of Americans of all parties. We also discuss why Trump appears to be carrying this reversal out, despite both the success of lifting the ban to date and comparable changes to similar exclusionary policies that had previously barred both women and openly gay members.

Fulton has a lot to share and inform us about all of this. I strongly recommend tuning in for today's show in full.

For now, however, especially with all of the breaking news I'm still trying to follow tonight, I'll share just this one quote from Fulton for now: "[The Pentagon] did not make this decision to open transgender service willy-nilly --- they made it based on their judgment about military readiness. That's as it should be. I hear people telling me, 'This should be about military readiness', and the answer is: this is absolutely about readiness. This is about having the strongest, most effective military force that we can muster to protect and defend the interests of the United States. And, as part of that, the Pentagon has determined that allowing transgender people to serve --- to keeping that talent within the armed forces, and continuing to recruit talent from as broad a pool as possible --- is right, is the best thing to create this strongest possible force. And that decision was made carefully. Now that decision is being overthrown based on no evidence. In fact, based on saying that the evidence that the Pentagon itself uncovered and determined to be accurate should somehow be thrown out the window."

Then, as luck would have it, no sooner did I finish speaking with Fulton, then news broke late today that, in fact, Trump has made good on his threat and has officially signed new guidance, ordering the Pentagon to proceed with restoration of the ban on transgender service members.

That, just days after calling for "unity" in the country, and telling members of the military at Fort Myers: "Every person who puts on the uniform makes our nation proud. They all come from across our land. They represent every race, ethnicity, and creed. But they all pledge the same oath, fight for the same cause, and operate as one team --- with one shared sense of purpose."

What an extraordinary monster. And I'm being very polite here...

Guest: Author, journalist David Dayen on the Democratic Party's 'quietly radical' 'Better Deal' plan and much more...
By Brad Friedman on 8/21/2017 5:57pm PT

For a few blessed moments on Monday, the peoples of the United States set politics aside, for the most part, to look skyward, toward the first continent-wide total solar eclipse in the U.S. since 1918. But the welcome distraction from politics in the madness of the Trump Era didn't last long, as reflected on today's BradCast. [Audio link to full show follows below.]

More and more top Republicans and Trump allies continue to publicly distance themselves from this President, following the past tumultuous month of his Presidency (breathlessly summarized today, courtesy of CNN's Brook Baldwin), as capped by his defiant defense last week of the white supremacist rally that turned deadly in Charlottesville.

Democrats are now reportedly beginning to salivate at the idea that a wave election could be ahead for them in 2018, in which they re-gain control of the U.S. House. But is that hope a realistic one? And is their new "Better Deal" plan to capture the majority, focusing on populist economic issues, enough to get them there?

We're joined today by financial author and journalist DAVID DAYEN of The Nation and The Intercept (among other places) to discuss the Democratic Party's plan for rebuilding with new populist regulatory agencies and oversight, which Dayen describes as "quietly radical".

"I don't have high expectations for Democratic campaign plans," he tells me. "But what I will say is that all of the things they've put out thus far all really boil down to one phrase, and that's Fighting Corporate Power."

He details how, based on the popularity of the Consumer Financial Protection Bureau (CFPB), created during the Obama Administration with Elizabeth Warren to fight for consumers rights, Democrats have a host of new oversight organizations that they hope to put in place, in what Dayen describes as the most expansive addition of federal agencies since FDR's Depression-era "New Deal". But, he warns, "credibility is the issue for Democrats --- whether they're going to follow through on this 'people vs. the powerful' rhetoric that they sometimes try to bring up to win elections."

We discuss that, as well as the debate on the Democratic/progressive side of the aisle between so-called "identity politics" and economic populism, and what he says he should know about all of the business leaders seemingly abandoning Trump and his Presidential economic councils, which have been publicly disbanded in the wake of Charlottesville. Dayen tells me he "can't believe that people are being duped by [it]...All you have to do is look beyond these 'advisory boards' --- which are really nothing more than direct lobbying efforts --- to know that the lobbying has just gone underground!"

Also, Dayen explains the purported "trade war" with China that Trump's now-former Chief Strategist Steve Bannon was murmuring about on his way out the door last week...

Guest: Political scientist, author David Faris of Roosevelt University...
By Brad Friedman on 8/18/2017 6:03pm PT

On today's BradCast, another tumultuous week, another White House firing, another major election system breach and another look at how it all could end. [Audio link follows below.]

White House Chief Strategist --- and once and future head of the far-right fake 'news' outlet Breitbart --- is fired after yet another tumultuous week of self-inflicted wounds by Donald Trump.

Also today, 11 years after The BRAD BLOG first reported exclusively on a massive breach of personal voting records for some 1.5 million Chicago voters, the private company contracted to run the city's voter registration system did it again. ES&S, the largest electronic voting system vendor in the nation, was discovered to have been storing 1.8 million voter registration records on an unprotected web server this week, exposing citizens to data theft and the city's administrative voting system passwords. All underscoring, yet again, the continuing failures and dangers of having privatized our public electoral system, as we've been trying to highlight for nearly 15 years now.

Then, with the President's approval rating at an historic low and support for his impeachment climbing, concerns about his fitness for office continue to mount in the wake of his equivalence between neo-Nazis and those who protest them, following the murder of a counter-protester in Charlottesville. New articles of impeachment are filed in the U.S. House, more Presidential advisory councils are disbanding, with CEOs and other business leaders (even James Murdoch of Fox "News"!) quickly distancing themselves from Trump, even some top Republicans who previously supported him are now finally suggesting he may be unfit for office.

So, how might this all end? We're joined today by columnist, author and political scientist DAVID FARIS of Roosevelt University to discuss that, Bannon, and his new piece at The Week on the Constitutional ambiguities of the 25th Amendment. Can it and should it be invoked to remove Trump from office? And how the hell does it even work?

Faris argues "we cannot take three-and-a-half more years of this nonstop hell without experiencing a collective nervous breakdown," describes the firing of Bannon as "a great victory for The Resistance", and offers his thoughts on whether the latest shake-up at the continuously chaotic White House is ultimately good for the nation. Then, he compares the difficulties of the impeachment process versus those in invoking the never-before-used Section 4 of the 25th Amendment to remove a President who is judged to be unfit for office. Faris also handicaps the odds --- and advantages to both the GOP Congress and Vice-President --- of either option actually being triggered.

Finally, as if things aren't troubling enough, we're joined by Desi Doyen for the latest Green News Report, as National Monuments are on the Administration's chopping block, Trump revokes Obama's Executive Order protecting the nation's infrastructure, and the U.S. looks forward to its first total eclipse of the sun in nearly 100 years...

Guest: TPM Congressional reporter Alice Ollstein | Also: Trump continues N. Korea threats, experts worry, diplomatic solutions remain...for now...
By Brad Friedman on 8/11/2017 6:45pm PT

On today's BradCast, the Trump Administration continues to destabilize both the Korean Peninsula and the U.S. health care insurance markets. [Audio link to show follows below.]

President Trump continued to increase his threatening rhetoric against North Korea (and to play the victim himself, as is his wont) on Friday, even as experts on the region see little new in the North's own bluster and saber-rattling. Instead, they worry that the Trump Administration's own unpredictable rhetoric and instability could lead to a misunderstanding or miscommunication that could, itself, result in military action by either side, the results of which could be catastrophic.

Still, there remain diplomatic ways out, via Russia and China, from the seemingly deadly collision course, so long as those options are not closed off by Trump. There are even direct, ongoing back-channel communications between representatives of both the US and NK, as reported on our previous show and confirmed today by the Associated Press.

Then, on the heels of the recently failed Republican attempt in Congress to repeal and/or replace the Affordable Care Act (ACA or 'ObamaCare'), new polling finds the public strongly prefers that Congress and the President move on to other issues, shore up funding for the ObamaCare exchanges where needed, and will otherwise hold both Republicans and the Administration responsible for further problems with U.S. health care coverage.

Nonetheless, the Trump Administration continues to take deliberate measures to undermine the landmark federal health care law, even as those actions have resulted in double-digit increases in premiums rates for 2018 across the country --- including for non-ObamaCare customers --- according to insurers. To date, the Administration has sabotaged the ACA by cutting the length of the open enrollment period in half, has cancelled advertising to let the public know about it, has used those resources instead on propaganda to attack the federal law, has ended some $20 million in contracts for in-person sign-up assistance in 18 under-served cities, and has threatened to end Cost-Sharing Reduction (CSR) payments to insurers for low-income individuals which, according to my guest today, could "send the market into a tailspin" if the President makes good on those threats.

Today, we are joined by Congressional reporter ALICE OLLSTEIN of Talking Points Memo to discuss her new exclusive revealing yet another way in which the Administration appears to be radically undermining the continuing success of the ACA, this time in the vastly under-served Latino community.

In this case, Ollstein explains, "It's more about what they are not doing." She explains that, at this time last year, and in previous years in advance of the annual open enrollment period beginning in November, hundreds of health care advocacy groups "were really revving up with tons of outside groups, and corporations, and religious organizations, health organizations, to get the word out and work with the government to promote information about open enrollment."

This year, however, after speaking with dozens of such groups, she says "every single one said" they have heard nothing from the government. "And I found a very stark pattern, particularly with the groups that focused on Latino enrollment," she tells me. "Latinos have the highest rate of un-insurance out of any racial demographic. They also disproportionately live in states like Texas and Florida that did not expand Medicaid. Those partnerships for outreach, leading up to open enrollment, are so far not happening this year."

The results, she reports, could be disastrous not only for the Latino Community, but for the health care market itself around the country. We also discuss what Trump and both Congressional Republicans and Democrats are considering for their various next steps regarding federal health care law.

[Update 8/14/2017: Ollstein follows up her exclusive with another, finding that it's not only Latino groups which had previously partnered with the government, but are now being ignored by the White House in the lead up to the open enrollment period.]

Finally, Desi Doyen joins us for the latest Green News Report before late-breaking news on Trump's announcement that he is now also considering military action against Venezuela...

Guest: David Faris of Roosevelt Univ. on our broken Congress...
By Brad Friedman on 8/8/2017 6:39pm PT

During a press avail in New Jersey on the opioid epidemic on Tuesday, Donald Trump threatened "fire and fury like the world has never seen". Disturbingly, he was threatening the Korean peninsula with those remarks. But he may as well have been talking about climate change without even realizing it. On today's BradCast: so much for the momentary sense of calm some of us may have felt for a few blessed hours with both Congress and Donald Trump on "vacation." [Audio link to complete show follows below.]

First up today, deadly dangerous saber rattling is quickly ratcheting up world tensions on the heels of new United Nations sanctions against North Korea. The isolated nation responded with threats of "physical action". Trump responded with promises of "fire and fury". NK responded in kind with a reported threat to attack Guam --- a U.S. territory and home to U.S. military bases --- with "enveloping fire", as our show got under way today.

Then, speaking of global threats, the New York Times published a disturbing leaked report last night authored by scientists from 13 federal agencies, warning of quickly accelerating man-made global warming. The report, already approved by the National Academy of Sciences, is part of the U.S. National Climate Assessment, a statutorily mandated quadrennial report now awaiting final approval by the climate science-denying Trump Administration. We discuss the alarming details of the report, why it was leaked to the press in advance of the August 18 deadline for approval, and the question of whether Trump, his EPA and other science-based federal agencies will sign off on it (or change it before they do).

Then we're joined by author and political scientist DAVID FARIS of Roosevelt University, to discuss his recent article on "Why the GOP Congress will be the most unproductive in 164 years". He blames the increasing extremism and polarization within the GOP's own caucus, which, he argues, has virtually hamstrung the Trump/GOP agenda.

"What has happened over the last forty years is Republicans have moved much, much further to right than Democrats have to the left," Faris tells me. "They've moved a little bit to the left since 1980, but not my much --- it's almost imperceptible. Whereas if you chart the movement of the GOP, it's just a long, consistent straight march off the ideological map into uncharted territory."

He describes what he sees as the the reasons for this historic "asymmetric polarization" among Republicans, and why there does not appear to be nearly as much of an ideological divide within the Democratic caucus in Congress.

Finally, we mark today's passing of country/pop superstar Glen Campbell before we return again to a world now very much on edge --- a fact made even more troubling as Trump's approval ratings, even from his most ardent base voters, appear to be quickly eroding at the 200th day mark of his Presidency...

Guest: Zina Merritt, Govt. Accountability Office Director on 'a systematic breakdown in the controls at every level' | Also: Keystone XL may be dead after all; EPA loses in court; Kobach's 'bizarre' appeal motion; more...
By Brad Friedman on 8/1/2017 5:48pm PT

On today's BradCast, a stunning story of remarkably lax Department of Defense oversight of lethal weaponry given away for free to state and local law enforcement agencies, and the government office which discovered the horrifying failure. [Audio link to complete show follows below.]

But, before and after that story, a few more sordid tales of government dysfunction, including: The U.S. Senate confirmation of a new FBI Director; Keystone XL pipeline may never get built after all; EPA loses in court attempting to roll back methane regulation; Earth is in very very big trouble (or, at least those of us who live on it are); GOP "voter fraud" fraudster and federal court scofflaw Kris Kobach's latest "bizarre" court appeal to avoid an under-oath deposition; and fired White House Comms Director Anthony Scaramucci's terrible week gets even worse.

As to our main story today: The U.S. Government Accountability Office (GAO) recently set up a phony law enforcement agency website and was able to use it to obtain over one million dollars worth of military-grade equipment and weaponry via the Pentagon's so-called 1033 program. The Department of Defense program offers everything from surplus mine-resistant armored vehicles, to high-powered assault weaponry and even helicopters and airplanes to state and local law enforcement agencies --- for free. The program, as of 2014, had doled out more than $5 billion in such equipment.

We're joined today by ZINA MERRITT, who, as Director of Defense Capabilities and Management at the GAO, helped create the disturbingly successful sting operation and the accompanying report on what happened, including recommendations to keep it from happening again. She also testified before Congress about all of this last week. The DoD's controversial 1033 program gained notoriety in 2014, during the protests in Ferguson, MO, when St. Louis County's police force rolled out tactical military gear and weaponry in response.

Merritt explains how the sting --- which netted "over 100 controlled items with an estimated value of $1.2 million, including night-vision goggles, simulated rifles, and simulated pipe bombs" --- was carried out, and what she describes as the "systematic breakdown in the controls at every level." The GAO had been tasked by Congress, during reforms to the program instituted under Obama, to probe the DoD unit where fake law enforcement officials were able to obtain real gear with a fake website and fake IDs (which weren't even checked at several of the warehouses when they picked up what could have been lethal equipment. Good thing they weren't attempting to vote!)

"We submitted [the application] online, and all you had to have, in order to do that, was a website as well as a point of contact, a physical location, and actual names --- points of contact --- within the agency. Also, you had to identify how many particular sworn officials that you have as a part of your agency. So we created all of that and submitted it," Merritt tells me, explaining that apparently none of it was actually verified by the DoD. "The actual physical location that we provided was an empty lot," she says.

Merritt also explains the recent reforms that have been made to the program, via Executive Order by Obama in 2016 (grenade launchers, for example, are no longer available, even though the Los Angeles Unified School District had obtained several prior to those reforms!), the several recommendations the GAO has now made to correct the startling security gaps in the program revealed by the sting operation, and whether "bad guys" may have already pulled off what the GAO has now discovered was easily done.

We also discuss how the 1033 program could be changed again by Trump, and whether the GAO --- an agency controlled by the U.S. Congress --- is facing changes under the new Administration...

Also: GOP and Trump still playing voters for morons, Priebus is out; 'The Mooch' unleashed; More evidence Dems still denying vaping science...
By Brad Friedman on 7/28/2017 5:50pm PT

On today's BradCast, an insane week in D.C. ends with a dramatic flourish (or two). [Audio link to show follows below.]

Unprecedented chaos besetting U.S. Senate Republicans over the past week, amidst their 7-year quest to kill the Affordable Care Act, came to a suspenseful and dramatic close late on Thursday night and early Friday morning --- as the ailing Sen. John McCain joined Senators Lisa Murkowski and Susan Collins to defeat the last of the GOP proposals drafted in haste in hopes of repealing ObamaCare. At least for now. If there's one thing you can count on, Republicans will continue to treat their voters like suckers and morons.

And, an insane, profanity-filled tirade of a phone call to a reporter by Donald Trump's new White House Communications Director results not in the firing of Anthony Scaramucci, but with the firing of Trump's Chief of Staff Reince Priebus.

In the meantime, while Democrats, to their credit, were successful in their efforts to save health care coverage for tens of millions of Americans, their efforts to prevent the use of vaping devices, which might otherwise help save the lives of half a million Americans each year, suffers a setback as the FDA delays restrictions on e-cigarettes and yet another new scientific study finds vaping is one of the most effective ways to help smokers quit.

Finally, speaking of science deniers, our latest Green News Report with Desi Doyen details U.S. Coast Guard plans to prepare for six feet of sea level rise and the GOP chair of the U.S. House Science Committee argues that climate change will actually be "beneficial". But, never fear, we've got quite a bit of good news in today's GNR as well!...

Intra-party Republican disarray over health care repeal, Trump's trans ban, threats to replace AG, more | GUEST: Former Acting CBO Director Donald Marron on why GOP plan to gut the agency is 'a terrible idea'...
By Brad Friedman on 7/27/2017 6:51pm PT

On today's BradCast, Trump's White House and the GOP Senate devolve into utter chaos. And a former CBO director joins us to explain why the Congressional Budget Office is so important. [Audio link to show follows below.]

Both Congress and the White House are, figuratively, exploding today, with unprecedented, intra-party, public food fights and disarray among Republicans that now seems to be breaking out in virtually every direction --- inside the U.S. Senate, inside the Trump Administration, not to mention between Congress and a number of Executive Branch agencies.

The U.S. Senate is in disarray as they try to pass a "skinny repeal" to the Affordable Care Act, a last gasp effort to pass something, anything, to call a "win" in the 7-year effort to repeal and replace ObamaCare. But a number of Senators are concerned that the effort which guts the requirement for individuals to buy health insurance, could be adopted as is in the U.S. House, sending premiums skyrocketing and the insurance market into a death spiral.

The White House is in disarray as Administration officials face down bipartisan outrage over Trump's surprise military transgender ban. Turns out, as we've since learned, he was actually trying to save funding for his border wall with Mexico (and other priorities) in exchange for spiking medical funding for trans members of the military, when he shocked lawmakers by announcing a complete ban, which is much more than those Rightwing Congressmembers had actually been lobbying for.

And, of course, there's the disarray that spans between a number of Executive agencies, the White House and Congress, as Senators hope to avert a full-blown Constitutional crisis by attempting to block Trump from firing his own Attorney General and appointing a replacement without Senate confirmation during the upcoming recess. And the Secretary of the Department of Interior threatens members of the Senate on behalf of the President, for not voting as the White House wishes on repealing health care for millions of Americans. Yes, the Secretary is actually threatening to protect the environment if the Senators don't play ball!

All of that without even delving into the wildly bizarre intra-White House disarray between Trump's new Communications Director and his own Chief of Staff!

Then we're joined by a former Acting Director of the Congressional Budget Office (CBO) DONALD MARRON, now a Fellow with the Urban Institute, to discuss the recent attacks by Republicans on the office responsible for scoring legislation like health care reform. Such analyses by the CBO help to let both Congress and the American public know how much such schemes will cost in both tax-payer dollars and Americans losing access to health care.

Marron, who also served as Chief Economist on the President's Council of Economic Advisers under George W. Bush, says the recent attempts by the Congressional Freedom Caucus to gut the CBO and have the office's work replaced by outside private research institutions is "a terrible idea". He explains why, what the CBO actually does for Congress and the American people --- such as scoring some 600 pieces of legislation a year and privately advising members as they develop bills --- that most are not familiar with, and how the office was formed out of the budget battles during the Nixon years.

"The folks at CBO are accustomed to some background level of being beaten up on --- just as umpires and referees are used to it," Marron tells me, but "the level of enmity towards CBO by some circles today is quite extreme." He goes on to detail why outside groups --- his own Urban Institute was cited by the Freedom Caucus as one of those which could help replace the CBO --- cannot take the place of the Congressional agency. "If you're going to run an intelligent Congressional budget process, Congress really ought to have its own agency, producing its own numbers, that works directly for Congress, is part of Congress, and responds to the needs of Congress in ways that outside groups simply can't," he explains.

He also responds to critiques that CBO analyses have been inaccurate in the past and that the office, currently headed up by a conservative Republican appointed by a Republican Congress, is biased against Republican proposals. "From my point of view, the Congressional Budget Office is a real jewel in our government. It is a wonderful agency, filled with non-partisan professional staff whose job it is to give their best read to members of Congress about what the budget and economic implications will be of proposed policy."

Finally, as today's show closes, the U.S. Senate adopts a new sanctions package against Russia, Iran and North Korea, which now heads to the White House for the President's signature...or veto. And Kris Kobach, the GOP "voter fraud" fraudster heading up Trump's so-called "Election Integrity" Commission has court sanctions upheld against him, and receives another smack-down from another federal judge for having 'demonstrat[ed] a pattern' of 'deceptive conduct' and 'patently misleading representations' in the ACLU's lawsuit against his proof-of-citizenship voter registration restrictions as Kansas Sec. of State...

Guest: Legal analyst Ernest A. Canning...
By Brad Friedman on 7/20/2017 6:36pm PT

On today's BradCast: We may be quickly heading towards a very troubling Constitutional crisis and what will it take for voters (and corporate media!) to appreciate the dangers posed by our absurd voting systems in the U.S.? [Audio link to full show is posted below.]

President Donald Trump offers some astounding revelations regarding his thoughts about firing the nation's top law enforcement officials (the Attorney General, Deputy Attorney General, the Acting FBI Director and the Special Counsel investigating Team Trump) during a rare interview with the New York Times. He also suggests he believes he can restructure the Dept. of Justice so that the FBI Director reports directly to the President, rather than the Dept. of Justice. The breathtaking admissions in the interview leads at least one former top Justice Department official under Obama to predict that "we are headed for a massive clash....I don't see how we get past this without him firing either [Special Counsel Robert] Mueller or other people at the Justice Department and a massive, massive crisis."

As disturbing and important as Trump's revelations are, the Times' reporters, Peter Baker, Michael Schmidt and Maggie Haberman, utterly failed to ask any substantive questions about the President's positions on and understanding of the various ongoing Republican schemes to repeal ObamaCare. That, despite each of the GOP's proposed plans for doing so predicted by the non-partisan Congressional Budget Office to result in anywhere from 22 million to 32 million Americans losing access to health care coverage.

Instead, the reporters focused only on process questions surrounding the political difficulty of enacting health care repeal, rather than the untold suffering and damage it will cause and Trump's own wildly conflicting advocacy for such proposals. They even ignored the fact that the transcript of the interview appears to suggest he does not even know the difference between health insurance and life insurance!

All of that, as former Presidential candidate and Vietnam War torture victim, Sen. John McCain (R-AZ) is diagnosed with an aggressive form of brain cancer and Senate GOP leadership is reported to be desperately promising to spend some $200 billion in hopes of buying votes for their health care repeal schemes from so-called moderate Republicans in the U.S. Senate.

Then, we're joined by BRAD BLOG legal analyst ERNIE CANNING, to discuss his analysis of the multi-partisan lawsuit recently filed in Georgia contesting the surprising and 100% unverifiable results of the June 20 U.S. House Special Election in the 6th Congressional District and his rather gob-smacking article on the massive security breaches before the election and the more-than-a-decade of disturbing revelations from computer scientists and whistleblowers alike about the Diebold touch-screen voting systems still forced on voters in the Peach State.

Moreover, he tells me about an Atlanta Journal-Constitution reporter who recently dismissed his concerns about her reporting on GA Sec. of State Brian Kemp's comments that there was no evidence to suggest any election results in the state, including the recent GA-06 race, were inaccurate, or that any manipulation, hacking or programming error occurred. "Well, that's true," says Canning, "but you can't prove that the actual count is valid, either. There's no scientific way to do it. The only one that would really know if it was rigged would be somebody who actually took part in the rigging of the vote."

"You have all this coverage everyday with MSNBC about potential Russian hacks," he continues, "and yet nobody there bothers to talk about the fact that these systems are vulnerable to anybody, whether it be Russia or anybody else, and that there's no way to know whether the votes have been altered."

So, what will it take for Americans --- Republicans and Democrats alike --- to understand the on-going threat to democracy posed by both 100% unverifiable touch-screen voting systems and by paper ballot systems that are tallied by easily-manipulated, oft-failed computer tabulators? What will it take, for that matter, for the corporate media (including Georgia's largest newspaper!) to understand it as well?

We discuss all of that and much more today, including the Texas County that is finally returning to paper ballots after a disaster in November, and the decision by Israel to stick with hand-counted paper ballots in light of recent election hacks around the world...

Guest: R.L. Miller, climate hawk Dem, on opposition to the CA bills | Also: Big Oil faces big new lawsuits; State Dept. shutting down war crimes office; Latest GOP health care repeal takes insurance from 32 million...
By Brad Friedman on 7/19/2017 6:36pm PT

On today's BradCast: U.S. war atrocities and California's fight against global warming. [Audio link to show follows below.]

The State Department is reportedly planning to close their office that investigates war crimes. That may come in handy for Donald Trump, as his campaign promise to "bomb the shit out of 'em", appears to be working. A startling new report from international analysts finds the U.S. has killed twice as many civilians in Iraq and Syria during Trump's first six months in office, compared to the previous three years of war against ISIS under Barack Obama. The U.S. air war is now killing, on average, 12 or more civilians per day in those two countries alone --- with 2,200 said to have been killed since Trump took office --- and neither Republicans nor Democrats are willing to even debate the issue in Congress.

At the same time, House Republicans have stripped Rep. Barbara Lee (D-CA)'s amendment repealing the 2001 Authorization for Use of Military Force (AUMF) from the Defense Authorization bill, despite the amendment's bi-partisan adoption in a House Committee late last month.

Meanwhile, on the heels of Trump vowing to pull the U.S. from the landmark Paris Climate Agreement, California and its Democratic Gov. Jerry Brown have stepped up to fill the leadership vacuum Trump has left behind in the battle against global warming. Two counties in the San Francisco Bay area and a city in Southern California have filed what are being regarded as landmark lawsuits against 37 of the world's largest oil and coal companies. The plaintiffs charge the companies --- including Chevron, ExxonMobil, BP, Shell and others --- have known about the climate change dangers of their products for some 50 years, but have covered it up. They are filing similar claims as those brought successfully against the tobacco industry in the 90's.

Moreover, after a bruising battle, this week the CA state assembly adopted a bipartisan package of climate bills that would, among other things, extend California's cap-and-trade legislation to curb the emission of carbon dioxide and other greenhouse gasses through 2030. While some are describing the legislation, which passed both houses with two-thirds majorities, as a "stunning" bipartisan victory, many environmentalists are unhappy with the bills they fought bitterly against.

R.L. MILLER, the elected chair of the CA Democratic Party's Environmental Caucus and founder of Climate Hawks Vote, is one of those who opposed the bills. She joins us to explain why. As she describes, even though the state has radically reduced emissions levels in recent years and has enacted one of the toughest targets to curb greenhouse gases, the newly adopted extension of the state's Cap-and-Trade program through 2030 was drafted to disproportionately meet the concerns of oil companies, and will result in restrictions on local regulations.

"The problem with it is that the people who live next to the refineries in California have correctly pointed out that this is not doing a darn thing to make their lives any better. And they live in California. And they vote. And they're mad," she tells me, going on to argue that the new measures "will not enable us to meet our 2030 goals."

Also today: The non-partisan Congressional Budget Office finds the ObamaCare repeal bill Senate Republicans are now promising a vote on next week, despite opposition from their own caucus, would result in 32 million Americans losing health care, including 17 million losing coverage next year alone...

Plus: 2016 election hack attempts even worse than previously known, Kobach voter fraud commission's suppression efforts already a success...
By Brad Friedman on 7/18/2017 6:34pm PT

On today's BradCast: Donald Trump and Congressional Republicans' attempt to govern continue to fall apart. Also, the assault on our nation's elections continue as well, both from without and within. [Audio link to full show is posted below.]

After new defections by two more GOP Senators late Monday night led to the stunning collapse of Majority Leader Mitch McConnell's latest attempt to repeal and replace the Affordable Care Act ("ObamaCare"), his subsequent plan, to repeal ObamaCare now and replace it later, also collapsed within hours, after the number of Republican Senators needed to kill the measure almost immediately vowed to vote against it. Cue Donald Trump's blame game, avoidance of responsibility and lies about the entire matter.

So what's next on the Republican agenda? A budget resolution must be passed to avoid a Government shutdown by the end of September and a major tax cut effort has long been promised. Evidence suggests both items may run into a similar inability of Congressional Republicans to even agree amongst themselves. Such is the danger of radicalized, illegitimate political enterprises. They may work for winning elections, but not so much when it comes to actually governing.

Also today: New and startling revelations (even to me) of hundreds of thousands of attempts to hack South Carolina's general election system last November offer a dark omen and yet another much-needed reminder regarding election systems in the rest of the country, as well as the need for the public to be able to oversee results; Thousands of legitimate Colorado voters un-register in response to the massive data request for private information by Trump's "Election Integrity" Commission headed up by "voter fraud" fraudster Kris Kobach; and new details about the hack last year of the U.S. Election Assistance Commission --- the federal agency tasked with overseeing electronic voting and tabulation systems in the U.S. --- highlight, yet again, why it's so disturbing that the GOP is attempting to shut down the agency entirely. (No matter how many times over the past decade The BRAD BLOG has found the EAC to be both corrupt and a failure.)

Finally: Desi Doyen joins us for the latest Green News Report, with huge wildfires in Canada, Trump giving away more tax-payer dollars to fossil fuel companies and much more...including, yes, some heroic nuns and a small, disorganized Tropical Storm named Don...

Plus: On the Espionage Act's 100th Anniversary, it's now being used against whistleblowers and journalists rather than spies...
By Brad Friedman on 7/14/2017 6:15pm PT

On today's BradCast, take your pick. Either the Trump Administration (and its cronies in Congress) are liars or completely incompetent. There is plenty of evidence for both. [Audio link for show follows below.]

For a start today, the number of people now reported to have been at that June 2016 Trump Tower meeting with a Russian attorney said to have dirt on Hillary Clinton has now risen to eight. And, not single day has gone by since the revelation of that meeting one week ago, without the Team Trump explanations for it --- including from the President himself --- changing. Why?

But those aren't the stories today to suggest they are either liars or buffoons (and can't do math either.). Among the many additional stories placed into appropriate context today:

  • Trump's own Sec. of State takes a withering shot at Trump's government;
  • A congressional GOPer laments Republicans "simply don't know how to govern";
  • The non-partisan CBO finds Trump's budget doesn't actually balance (it's only off by $3.4 trillion);
  • Senate Republicans newest health care repeal plan doesn't either;
  • Some GOPers are willing to shut down the government if Trump's wall isn't funded (by tax-payers, not by Mexico, as promised);
  • Trump's border "wall" is beginning to sound exactly like Dubya and Obama's border fence (And his plans for immigration reform are beginning to sound a lot like Obama's as well.)

Given a new Pew survey finding a huge majority of Republican voters now believe higher education at universities and colleges has a "negative effect" on the country, perhaps none of today's stories should come as much of a surprise.

Finally, on the 100th Anniversary of the Espionage Act, the Committee to Protect Journalists offers a report on how, since Nixon first did so in the 70's, the Act has been misused to prosecute whistleblowers rather than spies, particularly under Obama, and how Trump may well begin using it against journalists in the bargain...
