Back in December 2007, when I wrote "Torture is Wrong, Illegal and It Doesn't Work," I mentioned that "the FBI agent who reportedly had the best chance of foiling the 9/11 plot, Ali Soufan, the only Arabic-speaking agent in New York and one of only eight in the country, and who has since resigned from the FBI, could and should tell people the truth of how the CIA's tactics were counterproductive."

Well guess what?! HE FINALLY DID SO ON WEDNESDAY! The points Soufan makes are very instructive as our country begins to unravel the differences between the fictional world of Hollywood's "Jack Bauer," and the real world dilemmas and questions of morality and legality as faced by actual intelligence and law enforcement officers.

"My Tortured Decision" is how former FBI Agent Soufan titled his New York Times op-ed, speaking out to specifically refute a number of Dick Cheney's lies about how torture "worked." The truth, according to Soufan, is quite the opposite from how Cheney continues to paint it...

"Pensacola Jeff" speaks must-watch truth to (out of) power at a Tea Baggers Sore Losers Rally in Florida last Wednesday...


Brilliant. Priceless. (Hat-tip to BRAD BLOG commenter "Floridiot".)

Of course, the video above underscores the plain truth that the "protesting" tea baggers sore losers, had no real clue what the hell they were even doing at their tiny "protests" on Wednesday, which they only showed up for, to protest against their own best interests, because Fox "News" told them to. The photo below (courtesy "rumproast") may say it all...

All of Wednesday's confused, desperate (though rather amusing) "protests" were, of course, dwarfed in size, actual meaning, and actual grass-rootsness, by dozens of actual grass-roots protests during the Bush years, such as this one against the Iraq War and these when Bush was inaugurated in '05, even though somehow Fox "News" forgot to promote those actual protests, and the rest of the corporate media forgot to cover them at all.

But ssshhhh...don't tell the tea baggers sore losers, they think they've started a "revolution"...

World's most influential news outlet 'breaks' the news again
Downplays the WINNER of the U.S. Senate race in MN, following final ruling from bi-partisan state election contest court...

That's right, according to AP tonight, following the just released final ruling [PDF] from the 3-judge election contest court in Minnesota, Senator-elect Al Franken (D-MN) is not the "winner" of the election. Rather, he's merely the "leading vote-getter."

Are they kidding?! "Leading vote-getter"?! Apparently not.

Will that be how AP reports the results of elections on Election Nights from now on? The one with the most votes counted in the unofficial results will be the "leading vote-getter"? Somehow, we've got the feeling that AP's headline refers only to this race, and only since it's Franken, not Coleman, who actually won.

As The BRAD BLOG pointed out late last week, Franken isn't "leading" as the New York Times, MSNBC and others reported it last week after the court's final tally of all lawfully cast ballots concluded. And he certainly isn't the "leading vote-getter." Franken won. After one of the most painstaking and transparent hand counts, and then one of the longest election contests in U.S. history, it has been determined that Franken received more lawfully cast votes than anybody else in the race. Period. Furthermore, he has no legal leg to stand on in his likely appeal(s), as we detailed last week. All of that makes Franken the winner of the election, and former Sen. Norm Coleman the loser.

If Coleman wishes to try to overturn Franken's win --- and he's promised an appeal to the MN Supreme Court at the very least --- that's up to him. But Franken won the election. Got that AP? New York Times, et al?! Is that so difficult to report accurately?!

UPDATE 5:41pm PT: The rest of the media, other than AP, appear to be doing better in reporting on Franken's win tonight...

UPDATE 7:13pm PT: NY Times' headline: "In Minnesota, Another Blow to Coleman". Apparently "the paper of record" continues it's allergy to the word "win," along with AP. Downplaying the facts of the matter, Adam Nagourney writes tonight:

By any measure, this latest ruling – the latest in a string against Mr. Coleman – further diminishes his hopes of holding on to his seat.

"Further diminishes his hopes of holding onto his seat"?! That, despite the rather clear pronouncement in the MN court's ruling today [PDF]:

Franken received the highest number of lawfully cast ballots in the November 4, 2008 general election for United States Senator for the State of Minnesota and is entitled to receive the certificate of election.

Is that unclear?! In most worlds, other than the Times' and AP's in 2009, that would mean Franken has won. But the Times, like AP, just can't seem to say it. Now why would that be?

No. He's not crazy at all. Glenn Beck pours metaphorical "gasoline" on "himself," his viewers, and his imagined newly-tyrannical America, and his own, and his viewers', rapidly accelerating, self-perpetuated sense of victim-hood. When he/they eventually --- and it shouldn't be long at this rate --- actually light the match and blow themselves/us up, feel free to point back to this item, when we're told "who could have predicted it?"...


Beck's daily hour on governmentally subsidized cable TV, and three hours daily on our publicly owned radio waves, is a tremendously responsible use government welfare, and reflects brilliantly on our Founding Fathers' guarantee to one single industry --- and one single industry only (the press) --- in our U.S. Constitution.

That's a very responsible use of that singular Constitutional dispensation, Glenn. Keep up the bad work.

, in case you missed it on Wednesday, Jon Stewart --- an actually responsible steward of public largess --- spoke directly and brilliantly to the crazies like Beck and Hannity and O'Reilly and Levin and Bachmann et al, by informing them (since they don't seem to know): "I think you might be confusing tyranny with losing...that's not tyranny, that's democracy"...

Of course, lots of recommendations on those two sites result in thousands --- if not hundreds of thousands --- of more eyeballs to the various stories we run here at The BRAD BLOG --- stories which are often not seen anywhere else in the media, even in the Progressive Blogosphere for that matter!

So your REDDITs and DIGGs actually do matter quite a bit, particular now since the wingnuts seem to have begun their downrating campaign. Without all that downrating, the story would easily have made it to the front page of REDDIT for a long while, and therefore been propagated across dozens of other key sites on the net as well.

In his March 31st article at Media Matters, Eric Boehlert contrasted the difference in corporate media coverage between Florida's 2000 Presidential election contest and Minnesota's 2008 U.S. Senate election contest. "Norm Coleman's a sore loser," Boehlert argued, and asked "Why won't the press say so?"

He details the striking difference in the corporate media coverage of the two races, where Florida 2000 was both much closer and, as it would determine the Presidency of the United States, arguably more 'important' to get right, and yet the constant media framing continuously painted Al Gore as a "sore loser" for not bowing out 'gracefully' or 'admitting defeat' in the days following the razor-thin election (which, as we would learn later, Gore had actually won, having received more votes across the state of Florida [PDF] than George W. Bush, had the U.S. Supreme Court not kept the ballots from actually being counted).

But to go one further than Boehlert, we'd ask not why the media fail to describe Coleman as a "sore loser," but rather, why it is that --- particularly since Tuesday's final count of any remaining, lawfully cast, previously uncounted absentee ballots --- the media fail to describe Coleman as the loser at all, much less a sore one.

From the New York Times to AP to MSNBC, and even Democracy Now! et al, despite all countable ballots having now been counted, and clear rulings having been issued by both the MN Supreme Court and the bipartisan three-judge panel overseeing the contest, the media seem to have developed an aversion to using the "L" word --- loser --- in their coverage of the MN contest. Perhaps it's because they're listening to only one side of the argument (Coleman's), but the facts of the case, and the many clear court decisions, leave no question that Franken is the winner, and Coleman is the loser. So why won't they say so?...

"I follow the vote. And wherever the vote becomes an electron and touches a computer, that's an opportunity for a malicious actor potentially to...make bad things happen," CIA cybersecurity expert Steven Stigall explained, in a stunning presentation to a U.S. Election Assistance Commission (EAC) field hearing held one month ago in Orlando.

As initially reported earlier this week by Greg Gordon at McClatchy, "Stigall said that voting equipment connected to the Internet could be hacked, and machines that weren't connected could be compromised wirelessly. Eleven U.S. states have banned or limited wireless capability in voting equipment, but Stigall said that election officials didn't always know it when wireless cards were embedded in their machines."

"The CIA got interested in electronic systems a few years ago," Gordon reports Stigall as explaining at the EAC hearing, "after concluding that foreigners might try to hack U.S. election systems."

But as disturbing as Stigall's presentation was, what's almost as disturbing is that it took more than 11 days, McClatchy's coverage, a number of FOIA requests from VotersUnite's John Gideon (a frequent guest blogger here), and a couple of articles from BRAD BLOG alum, Michael Richardson of the Examiner (his coverage is here and here), before the EAC finally released the complete transcript of the meeting [WORD], including Stigall's remarks.

"The presenter did not provide the presentation, 'Computers and Elections: The Growing Potential for Cyber Vote Fraud', to the EAC, so we have no materials responsive to your request," Gideon was told in response to his Freedom of Information Act (FOIA) request to the EAC, as reported by Richardson. "We received the transcript on March 16, 2009, and it will be publicly available in the next few days."

As of last night, 10 days since the EAC admits they received the transcript of their own event which had taken place 20 days earlier, they had neither sent it to Gideon in response to his request, nor posted it on their website. As of this morning, a month since the hearing, it's finally up on their website, thanks in part, no doubt, to the pressure brought on the EAC by the public to do so. Even then, Stigall's remarks are not posted separately, as other presentations are, but rather, one has to go looking for the full transcript of the actual event to find it. So why both the delay and obfuscation from the famously dysfunctional (a nice way to put it) federal agency? Make your own best guesses, since there is no official explanation for the moment.

Happily, there were others at the meeting who had transcribed the CIA cybersecurity expert's startling remarks --- decimating the idea of supposedly "secure" e-voting --- independently, who then helped to bring it to the public's attention. Clearly, the strongly pro-e-voting EAC had/has little intention of doing so themselves.

Stigall's presentation, and we've got much more of it excerpted below, include a passel of disturbing thoughts. Many of them we've tried to impart on these pages for years, including comments which point up the dangers we've tried to warn about concerning pre-election voting machine "sleepovers" at the houses of pollworkers, and more indications of the dangers of Sequoia Voting Systems clandestine, on-going relationship with the Hugo Chavez-tied Venezuelan e-voting firm Smartmatic, as we reported exclusively here one year ago --- to little interest from the corporate media, despite Sequoia's claims to federal investigators that they had severed all ties with the firm...

Last year's Media Reform Conference with the theme "Have the Media Undermined Our Democracy?" at which I spoke, was pretty memorable. That one featured an FCC commissioner and then-Rep., now-Labor Secretary Hilda Solis (D-CA) on the panel. Here's some video and a transcript of my remarks last year.

This year, I've been invited back (book-keeping error, no doubt) and the focus will be on local media, though I'll likely be paraphrasing Tip O'Neill to make the case that 'all media is now local'.

This year's speakers include Domonique DiPrima, Tanya Acker, Mario Solis-March, Linda Milazzo, Anthony Samad and myself. Which one of us will be named Secretary of HUD next year? Who knows! But hey, it could happen!

I guess I'm just in the minority here, but I'm having a bit of trouble getting exercised about $165 million (just to put that into perspective, the movie sequel The Chronicles of Narnia: Prince Caspian had a budget of $200 million) in bonuses to AIG employees.

Yeah, it's a shame that approximately one-tenth of one-percent of the $144 billion made available to the company by the federal government in bailout monies went to such bonuses, but where is all the furor from public officials, media outlets and bloggers --- from both Right and Left --- over the 12 billions of dollars (with a "b") sent over to Iraq as pallets of cash (literally, shrink-wrapped $100 bills), which then simply disappeared into that trillion (with a "t") dollar rat hole without accounting or explanation?

Where is the outrage and accountability there? Nowhere.

How about the $4 billion (with a "b") that went to the Help America Vote Act (HAVA) of 2002 to purchase privately made electronic voting systems which don't work and don't meet the federal standards it was claimed that they did?

It's curious, but not particularly surprising by now, the stuff that folks in Congress get selectively pissed off about, the stuff that media (both mainstream and blogosphere) go selectively wall-to-wall over, versus the stuff they don't.

You'll pardon me if I'm not particularly moved much at all by the latest round of AIG sturm-und-drang, hand-wringing, navel-gazing, finger-pointing and speechifying. Listener activists scramble to keep the Progressive talker on the air, but time is short, and the fight is difficult...

I wanted to offer an update on the Peter B. Collins situation, that I detailed last Friday following Peter's announcement that he would be leaving the air after this Friday's program due to the difficult time he has been having in continuing to self-finance and self-syndicate his daily, live radio show in this economic climate, and under the rigid Progressives-need-not-apply rightwing corporate control of our public airwaves. [Disclosure: I am a regular weekly guest and occasional fill-in host for PBC, just to get that out of the way.]

Following last Friday's announcement on his show, some of the audio of which we posted with last week's article, a number of listeners have been working to help determine if sustainable funding could be raised to keep PBC on the air. I've been in close touch with Peter, both before his announcement last week, and since then. I have, of course, offered any help I might be able to provide, but what can feasibly done has been difficult to determine.

He noted during last week's show that his monthly costs are just over $5000 to stay on the air, and that while a miracle could happen to help keep him on the air, stations had been notified, and the outlook wasn't good.

Folks have asked me what can be done, and I've been doing my best to try and figure that out, while respecting both listeners' feelings (and the avoidance of building up hopes, only to see them dashed) and Peter's concerns, which are similar. But I'll take the liberty of trying to share some of his feelings here, many of which he's now shared himself publicly in a blog item he posted at his website over the weekend, and then during today's program (selected audio from which I'll post at the end of this article) in response to a number of callers rallying to see what they can do to help keep him on the air...

UPDATED: Fox issues very rare apology!

Wow, does the dishonesty never end at Fox "News"? Well, we all know the answer to that one, but as Ben Dimiero at Media Matters noted in email, "this is ridiculous, even by Fox News standards".

In a package with Martha MacCallum on Fox's Live Desk today, suggesting that Administration officials who once criticized John McCain's assertion that "the fundamentals of the economy are strong" have now changed their tune, they played some clips purported to be from "recent interviews this weekend." Included in those clips, is Joe Biden declaring "the fundamentals of the economy are strong." (Video at bottom of this article.)

Trouble is a) Biden's statement was six months ago, when he was on the campaign trail and b) it was taken completely out of context, as Biden was quoting McCain's statement which he was in the process of criticizing!

Biden's actual in-context statement to a campaign rally in September 2008 was...

Another progressive talker falls victim to the rightwing corporate stranglehold of our public airwaves...

The Peter B. Collins Show will come to an end, as of next Friday, according to an announcement by Collins on today's broadcast. After nearly five years on the air, the economic climate, and the stranglehold of rightwing corporate control over the public's airwaves has made it impossible for him to continue.

We've been a regular weekly guest, as well as an occasional fill-in host, for Peter since not long after he first began broadcasting his syndicated show, first heard on Monterey, California's KRXA 540am and, until next Friday, on stations in San Francisco, Eureka, CA, Portland, OR, Seattle, WA, Missoula, MT and on the Internet. His call to us earlier today with the news, a few hours prior to our weekly scheduled appearance during the final hour each Friday, was heartbreaking, but hardly surprising in today's climate for nearly everyone but the vast majority of rightwing whackjob radio hosts propped up by rightwing corporate interests.

After a quick segment, during our appearance on today's show, discussing a number of this week's developments in elections issues, we turned to the matter of his leaving the air, and our belief that the playing field is indisputably rigged against non-rightwing talk radio. It's not a matter of "Progressive Talk" having failed in America, it's a matter of progressives, to this day, not having been given a level playing field on which to compete. Period.

See the bottom of this article for the audio of today's hour, including Peter's announcement (and his very kind "emphatic endorsement" of us to take over the still-available 3p-6p PT daily timeslot on San Francisco's Green 960.)

As our friend and progressive talker Thom Hartmann pointed out on his show this morning, Stephanie Miller, another friend and progressive radio host, noted that she's syndicated on some 60 affiliates from 9 to Noon ET each weekday, while rightwing whack-job Laura Ingraham is on some 300 stations during that same time slot. Yet, Hartmann noted, Miller beats Ingraham in almost every single market where they air at the same time. Does that sound like fair competition, or that "Progressive Talk" has failed? We haven't failed, corporate America, however, has failed you.

More details on all of that, in the audio of today's hour posted below. It should also be noted, by the way, that PBC mentioned he'd be open to the idea of an angel from heaven dropping in to help meet his $5000 monthly nut. If someone could do so, a long shot we both realize, then one of the nation's most intelligent, informative, insightful, entertaining and important progressive voices would likely be able to stay on the public airwaves, where he belongs...
