On today's BradCast: Some maddening facts about what awaits when Robert Mueller's Special Counsel report is handed over to the Attorney General and what will and won't likely be in it. [Audio link to show follows below.]

But, first up today...in "lighter" news...some followup to our detailed coverage yesterday of the remarkable events leading up to the unanimous 5 to 0 vote by the North Carolina State Board of Elections for a new election in the state's 9th Congressional U.S. House District. The action was in response to what the board described as a "coordinated, unlawful, substantially resourced absentee ballot fraud scheme" in last November's election by the campaign of Trump-endorsed Baptist minister Mark Harris. The decision followed on stunning surprise testimony against Harris by his own son at the Board's public hearings on the matter this week.

Among our follow-up coverage today: the (not-at-all-shocking if wildly-hypocritical silence from GOP "voter fraud" fraudsters who've made their living for years lying about phony fraud to encourage laws that suppress the Democratic-leaning vote, while hoaxing Fox "News" brain-addled clowns like Donald Trump into believing there's an epidemic of Democratic voter fraud, rather than the insider election fraud which can easily flip the results of an entire election --- as seen in North Carolina. It was also nice to hear the NC Democratic Chairman finally explain the difference between "voter fraud" and "election fraud" to NPR's Steve Inskeep on today's Morning Edition. We'll see if NPR can remember that difference in the future.

And, speaking of GOP hypocrisy, long-time Trump-supporting billionaire and New England Patriots owner Robert Kraft was charged today by Florida police for two instances of soliciting prostitution, as he was caught amidst a probe into human sex trafficking. Ironically enough, human trafficking has long been disingenuously used by Trump to support his "National Emergency" declaration to steal money from the military for use in building his border wall with Mexico. The news of the warrant for Kraft's arrest today raises a panoply of interesting issues which Desi and I take a few minutes to discuss.

Then, with several media outlets reporting this week that a report from Special Counsel Robert Mueller may be coming as soon as next week (and, at least one outlet today reporting that's not so), the question of what happens whenever that report is finally delivered to the Attorney General is coming to the forefront.

My guest today, Professor STANLEY M. BRAND, Distinguished Fellow in Law and Government at Penn State University, recently argued in a column at The Conversation that those hoping the public may see this report after it's turned over, by statute, to Trump's newly-minted AG William Barr may be in for some disappointment. Brand, who formerly served for eight years as General Counsel to the U.S. House, now teaches a course on the Independent Counsel at Penn State, explains how it differs from the Special Counsel statute that replaced it after the Clinton era. He suggests the public may never see any of Mueller's "confidential" report.

More frustratingly, he tells me why he believes that Mueller is unlikely to indict the President or recommend such an indictment and how the by-the-book prosecutor is similarly unlikely to recommend impeachment in his report. Unlike the old Independent Counsel statute in effect under Nixon and Clinton, the new statute, he explains, as written by a Democrat, is limited to criminal matters only (not legislative matters such as impeachment) and requires Mueller largely to issue a "confidential" report with little more than details on who was prosecuted and who was not, and what, if any, actions were blocked by the Attorney General overseeing the probe. What Barr then does with that report, he explains, is a separate matter.

Brand, who says he has worked with both Mueller and Barr in the past, says "you may see portions of it, or you may see selected excerpts, or representations of what it contains, if Bill Barr --- and I take him at his word --- wants to be as transparent as he can within the rules and regulations."

In somewhat more comforting comments, he also contends, in response to my query about the curious timing of Barr being seated just days before news (accurate or not) of the report's imminent release: "I have no notion why it's wrapping up --- if it is --- at this particular point, but I have confidence that, if it is wrapping up, it's because Mueller has decided he's finished." He adds, "Nobody is going to push Bob Mueller around. So if there's a conclusion to this, it's because Mueller has determined in his judgment that it's time and he has no further actions to bring."

Brand also offers his insight on whether Mueller would testify to Congress, if subpoenaed, about what was in the report if it's not released to the public or even to Congress. The central frustration at the core of this conversation, at least for me, is that Brand essentially argues that Mueller can't indict Trump (thanks to very debatable, if long-held DoJ "guidelines") and wouldn't cite evidence of impeachable offensives in his report, since that is not part of the new statute's mandate, as written in the wake of "excesses" under the old statute.

"Leon Jaworski, who was the Independent Counsel in the Nixon case, decided that he had sufficient evidence to indict but determined it was not something he should do, given the ongoing investigation into impeachment by the House of Representatives," Brand explains. "Ken Starr, for his part, determined that he could indict a sitting President but determined as a matter of discretion not to do that, because the statute provided a specific mechanism for referring that type of evidence to the House for impeachment, which he did, and which resulted in an impeachment proceeding of President Clinton."

But now, If Mueller can't indict or recommend impeachment, how is this current process supposed to bring accountability for a scofflaw President? There is a lot more to dig into in our discussion, as maddening as it may be at times. It does, however, raise the clear need for a long-overdue Congressional Hearing in the U.S. House Judiciary Committee into whether a sitting President can, under the Constitution, be criminally indicted (a hearing that would, on its own, likely bring some accountability for our current Executive). It also raises the question of why the hell Democrats are waiting for the Mueller Report to be issued before taking action to bring accountability through impeachment, especially since even they may never see this report! If not this President, then what President would ever merit impeachment proceedings in Congress?!

Finally, Speaker Nancy Pelosi has announced that a vote will be held in the U.S. House on Tuesday to block Trump's "National Emergency" declaration under the National Emergency Act. It'll likely pass in the Democratic-controlled House, but what are its chances in the GOP Senate, which much also hold a vote within 18 days of a resolution being adopted by the House? And, will EITHER chamber be able to overcome an almost-certain veto by the President?

That all remains to be seen, but satirist Randy Rainbow has a few musical thoughts on Trump's "Border Lies" to play out us out today at the end of another impossible week...

On today's BradCast: Good news for Bernie, good news for the Green New Deal, bad news for Tucker Carlson and Fox "News", and the fight is joined against the "invasion" on the U.S. southern border. (No, not that one.) [Audio link to show follows below.]

First up: When Congress settled on a compromise spending deal last week to keep the federal government open, the agreement included a special carve-out to protect a number of sensitive wildlife and tourism related areas along the Rio Grande River in South Texas, including the threatened National Butterfly Center and the 150-year old La Lomita Mission Chapel. But, as the Director of the 100-acre butterfly and wildlife refuge tells us, she is continuing the Center's lawsuit against the government because she fears Donald Trump's "National Emergency" declaration may now override the protective legislative carve out. "In fact, we expect the equipment already at work near us will just roll right over and through us," Marianna Trevino-Wright said via email after bill was signed and the "emergency" declared by the President, noting that even the current legislative agreement lasts for just six months before negotiations for 2020 appropriations begin. "We have not been spared," Trevino-Wright wrote, "We were given a temporary stay of execution."

Receiving no such "stay" however, are thousands of private residents living along the South Texas border. So, last Friday, the non-profit good government organization Public Citizen filed a federal lawsuit on behalf of three private citizens and the Frontera Audubon Society challenging Trump's "National Emergency" declaration to steal money from the military in order to build his wall with Mexico on the border. The lawsuit [PDF] filed in the U.S. District Court for D.C. describes the scheme as unlawful and unconstitutional.

We're joined today by ALLISON ZIEVE, General Counsel for Public Citizen and Director of their Supreme Court Assistance Project, to discuss the complaint filed on behalf of three Starr County, TX residents whose property and homes on the banks of the Rio Grande --- where they and their families have lived for as many as five generations --- will now be bisected by a giant barrier, cutting them off from the river entirely. In one case, the wall would be built just feet from the landowner's house.

The suit describes the federal government's heavy-handed tactics to condemn and seize private lands from the plaintiffs as an "imminent invasion of privacy and the quiet enjoyment of their land." The case is also filed on behalf of Frontera Audubon, which charges the wall will impede migration of wildlife at the nature preserve and prevent their members from getting to where birds and other sensitive species are threatened along a 250-mile wildlife corridor on the Rio Grande River.

Zieve tells me how Public Citizen's complaint, filed last Friday, differs from the one filed by 16 state Attorneys General on Monday also seeking to block Trump's "emergency" declaration as an unlawful exercise of the National Emergency Act, and how the cases are likely to play out as they work their way, almost certainly, to the U.S. Supreme Court, particularly, she notes, "if any of the plaintiffs win" at the appellate level.

"If there's no emergency, the President can't declare one," Zieve argues, adding: "What it really comes down to is there is no emergency. Everybody knows that. It's not really that [the Administration] thinks there's an emergency. It's that they think the President can do whatever he wants. And that's just not our Constitutional system."

Also on today's show: Bernie Sanders shatters historic U.S. records for funds raised on the first day of his announcement that he's running for President again in 2020. And it wasn't even close. And the elements of the Green New Deal prove to be wildly popular, garnering well over 80 percent support across all political parties, according to a new poll by Business Insider.

Finally, the unaired profane interview between Tucker Carlson of Fox 'News' and historian Rutger Bregman about raising taxes on the wealthy that, apparently, Fox does not want you to hear, since they taped it last week but decided against running it --- so we did.

Many of the stories we broke years ago --- too numerous to link here, on everything from electronic voting concerns and voting rights to climate change and much more --- have since become part of the national consensus as well as many popular calls for reform. That, even as much (but not all) of our independently verifiable, evidence-based news coverage was marginalized or dismissed by many in the corporate media years earlier. We discuss just a few of those stories today --- too numerous to detail here --- as we look both back and forward on this latest milestone. We also offer thanks to the many who have made all of it possible over the years, from our blogging contributors, to radio affiliate partners, to various whistleblowers (publicly known and unknown) over the years.

• Donald Trump's federal government shutdown nears the end of it's fifth record week, as he folded like one of his own cheap and poorly tailored suits on Wednesday night in his standoff with U.S. House Speaker Nancy Pelosi on delivering his State of the Union next week.

• At the same time, federal aviation unions issued a dire warning about the ongoing effects and potential critical dangers of the shutdown.

• We share a heartbreaking story about a 10-year old girl who suffered a broken wrist in stoic silence for a week, because she was frightened to tell her father, a Dept. of Homeland Security employee forced to work without pay.

• Billionaire crypt-keeper and Commerce Dept. Secretary Wilbur Ross took to the airwaves to, essentially, call 800,000 federal workers whiners for needing to use food banks to feed their families, when they could just go out and get a bank loan instead to cover costs until the federal government reopens.

• In the U.S. Senate, Mitch McConnell finally allowed votes on measures to reopen the government, one from Rs and one from Ds. Both failed to get the 60 votes needed to overcome filibuster, though the D version --- which did not include funding for Trump's border wall --- received more votes than the R version in the GOP-majority Senate.

• And Trump's former attorney Michael Cohen learned that he may have to appear before both House and Senate Committees next month, despite threats to his family by the President of the United States.

• Finally. Desi brings us the latest Green News Report, with more bad news about the shutdown and Greenland's melting ice shelf, but some encouraging news on a huge majority of Americans who now appreciate the threat of climate change and on the amazing teen climate activist taking on the corporate powers and millionaire/billionaires at Davos this week...

Donald Trump's tantrums and partial federal government shutdown continue on today's BradCast, with no end in sight for either of them. [Audio link for today's show follows below.]

On Tuesday night and again on Wednesday, Democratic Senate Minority Leader Chuck Schumer accused Donald Trump of governing "by temper tantrum". The first reference came in Tuesday's Democratic response, with House Speaker Nancy Pelosi, to Trump's televised prime-time Oval Office address meant to gain public support for his demand of $5.7 billion for a southern border wall. The money is needed, Trump claims, to respond to what he described during his 9-minute speech as an immigration and humanitarian "crisis". But the address offered no new policies or information and, at times, parroted word-for-word rightwing anti-immigration, pro-wall commentary from Sean Hannity and Lou Dobbs' programs on Fox 'News'.

The second reference to a Trump "tantrum" came today after the President reportedly stormed out of a White House negotiation meeting with Congressional Democrats as the partial federal government shutdown over funding for his wall continues in its third week. The cost of that shutdown to some 800,000 federal workers is rapidly intensifying. Paychecks will not be issued this week for many workers who are already facing extraordinary hardship thanks to the shutdown which Trump has threatened to continue for "months or even years" unless Democrats agree to his border wall demand.

But, if nothing new was offered in his Tuesday night prime-time address, why did the television networks agree to clear the time for him to litter our public airwaves with false claims and long-ago debunked propaganda? Particularly since the same networks refused President Obama's request to air his own remarks on actual new immigration policy back in 2014?

We're joined today by Media Matters' Senior Fellow MATT GERTZ who charges that the "networks got played." He describes their capitulation to Trump as "cowardly" with the result being "exactly what we said was going to happen: the President used the time to lie to the public."

"I don't understand why there's such an urgency to just put the President on television when all of the people involved in producing the news know that he's a liar who is going to lie," he tells me. "It's the most predictable thing in American politics right now --- if the President is talking, he's lying."

So why did the networks give up that valuable airtime to allow it to happen? And, were the attempts by media outlets at debunking and fact-checking Trump's false claims during or after the speech actual helpful to the public? We discuss that and the larger challenge for media: "How do you respond to a President who is deliberately deceptive and is constantly trying to make people believe in a reality that is different from the actual one?"

Also today: The 2018 electoral 'blue wave' continues into 2019, as Dems in Virginia win very big (by 40 points!) in the first Special Election of the year. And Donald Trump announces, via misspelled tweet, that he is cutting off FEMA wildfire recovery aid to California, following the worst and most deadly fires in state history. Whether he will follow through with that threat is a separate question, of course, and his absurd explanation as to why he claims to be doing it is, as usual, nonsense...

The effects of the federal government's partial shutdown, now in its third week, continue to worsen, even as the effects of last year's 'blue wave' election continue to make things much better for Americans across the country. Among the stories covered on today's BradCast [audio link is posted below]...

• The shutdown is causing "a mess" for potentially tens of thousands of American families who live in properties subsidized by the Dept. of Housing and Urban Development. They may soon face rent increases or eviction due to HUD's failure to renew thousands of contracts before and during the agency's closure;

• Vice President Mike Pence made the media rounds in advance of Trump's Tuesday night prime-time Oval Office remarks (which TV networks didn't allow for Obama), in hopes of drumming up support for the Administration's false claim there is a national security crisis on the border which may precipitate a Presidential declaration of a "national emergency". Pence offered a number of false claims in the bargain, which even some GOPers were scoffing at today;

• With Trump having boxed himself into this protracted shutdown mess, a "national emergency" declaration may be his only face-saving way out of it. It would likely result in Republicans allowing a vote in the Senate for reopening the government, even as the declaration would face court challenges over its legality and, essentially, do little more than steal tax-payer money from national defense as U.S. troops are tasked with building Trump's southern border wall;

• The U.S. Supreme Court has decided to hear two partisan gerrymandering cases this session (from Maryland and North Carolina), which may not be good news following the retirement of Justice Anthony Kennedy;

• But, in better news from SCOTUS today, the Court rejected a plea from Virginia Republicans to delay a lower-court mandated remapping of districts for its House of Delegates in advance of this November's off-year legislative elections in the state. Twelve of those districts were previously found by the lower court to be unconstitutional racial gerrymanders;

• Meanwhile, last year's midterm 'blue wave' is already yielding dividends for the nation. In Maine, the nation's dumbest now-thankfully-former Governor Paul LePage certified what he declared to be a "stolen election" for the U.S. House on his way out the door, and the state's new Democratic Governor Janet Mills signed legislation on her first day on the job that will finally give access to healthcare to some 70,000 Mainers under the Affordable Care Act (Obamacare) Medicaid Expansion that had been blocked for some eight years by the former Republican Governor;

• And, in further good news following last year's midterms, Florida's Amendment 4, adopted by nearly 65 percent of voters in November, kicked in on Tuesday to allow as many as 1.4 million former felons the right to vote in a state that is notorious for its close elections. Despite claims by some Republicans that "implementing language" may need to be enacted, County Supervisors of Elections began allowing registrations under the new Amendment for most former felons who have served their time. The result could be a sea change for the state in 2020, not to mention for the rest of the nation where Florida's electoral votes are key to Presidential elections;

• Finally, Desi Doyen joins us for the first Green News Report of 2019, where last year's 'blue wave' is also being positively felt on the environmental front at both the state and federal level, even as Trump's shutdown is trashing national parks and blocking important scientific research...

Every great Reality TV show needs a dramatic and gripping season finale. So too, apparently, does does every horrible Reality TV Presidency! [Audio link is posted below]

Today is our last new BradCast before Christmas (Angie Coiro will be filling in for us, along with a few "evergreens" over the next week or two), but, as has become clear today, Trump! The Presidency! has certainly delivered in the shocking and suspenseful season finale department! Including...

TWISTS AND TURNS! Acting AG Matthew Whitaker did not, as misreported earlier today, get approval from a DoJ ethics review to oversee Special Counsel Robert Mueller's probe. In fact, the ethics review determined he should recuse himself. But, apparently, he plans to ignore that finding;

SURPRISES! Trump defies his military advisers, not to mention stuns and infuriates members of Congress on both sides of the aisle along with experts in the region, by declaring "victory" on Twitter over ISIS and that he plans to now pull U.S. troops out of Syria! But when? Nobody seems to know. Is Afghanistan next? (Apparently so!);

MAIN CHARACTERS 'KILLED OFF'! Defense Secretary Gen. James Mattis, the last of Trump's "My Generals", and none too happy about the Syria decision, submits his surprise resignation, charging the President is anything but "clear-eyed" about the need for U.S. alliances and the threats faced from its adversaries;

SUSPENSE! Will Trump shut down the federal government over Christmas? Last week he said he would. Earlier this week he indicated he wouldn't. But, today, it looks like he will! And all over $5 billion in funding for a southern border wall (now "steel slats") he promised that Mexico, not tax-payers, would be paying for;

CHRISTMAS VILLAINY! Trump's USDA, in defiance of Congress's newly passed farm bill, announces they will now make it more difficult for the poor to receive food stamps. That'll show 'em!;

NUCLEAR CLIFF-HANGER! North Korea bluntly declares that "denuclearization of the Korean peninsula" actually means what it sounds like, and what those of us in the reality-based world (as opposed to the Reality TV world) already knew. They will not denuclearize unless the U.S. removes its own troops and nuclear weapons at the same time. Will Trump return to his threats for "fire and fury like the world has never seen"?! Stay tuned for the thrilling 2019 season!

Also today: The DNC announces its planned schedule for a dozen 2020 Presidential primary debates beginning in 2019, even though we're not yet even done with the 2018 election around here yet!

As we await the scheduled January 11th evidentiary hearing over the GOP's 2018 Absentee Ballot Election Fraud Scandal that has prevented Republican Mark Harris' 905-vote U.S. House "victory" over Democrat Dan McCready from being certified in North Carolina's 9th Congressional District, the state Board of Election's stunning 279-page 2016 investigative report [PDF] on apparent absentee ballot fraud by McCrae Dowless, the same GOP contractor hired in 2018 by Harris, is released. And it includes some jaw-dropping evidence begging the question: How can it be that Dowless not already prosecuted after 2016, but allowed instead to carry out the same unlawful election fraud scams in 2018?!

On Friday of the Thanksgiving weekend, in hopes that nobody would notice, the Trump Administration quietly released the latest National Climate Assessment, a 1,700-page report compiled by 13 federal agencies with more than 300 scientists, including data from over 1,000 peer-reviewed scientific studies. The report is mandated by Congress every few years, so the Administration had little choice but to release it, though doing so a month earlier than expected over a holiday weekend --- without even notifying the scientists who worked on it --- was as noteworthy as the report's stark contradictions with Donald Trump's own climate change denialism.

Global warming, the report warns, may warm the U.S. by as much as 12 degrees Fahrenheit by 2100. It has already cost Americans $150 billion in various forms of damage since 2015 and, by the end of the century, unless severe steps are taken to curb emissions, climate change will result in a cost of some 10% to the nation's Gross Domestic Product. That hit to the economy will be more than twice that of the Great Recession a decade ago, the report finds, unless a very serious effort is undertaken immediately to curb man-made greenhouse gasses that cause global warming. Such action on a federal level, of course, seems very unlikely given that Donald Trump, when asked about the devastating economic effects detailed by his own administration's report, told reporters on Monday: "I don't believe it."

We're joined today by DR. MICHAEL E. MANN, Distinguished Professor and Director of the Earth System Science Center at Penn State University, to discuss the troubling scientific findings and the entirely predictable reaction by denialist Republicans and corporate media over the weekend since its release.

Mann's climate science work, as author of nearly 200 peer-reviewed and edited publications, as well as several landmark climate change books, has warned for years of the breathtaking scope of our current climate crisis, illustrated again by recent record hurricanes, wildfires, droughts and floods and outlined by the report. The new study was compiled prior to the recent fires in CA which have, so far, killed nearly 90 people, as well as before this year's Hurricanes Michael and Florence which devastated parts of Florida and the southeast coast of the U.S.

"Simply stating what the science has to say is alarming," Mann tells me. "We are seeing the impacts now play out in real time. That means we are much farther down this road than we ever should have allowed ourselves to get. And time is running out. There is a level of urgency unlike we've seen before. We have to bring our carbon emissions down dramatically now, to avoid ever more catastrophic warming of the planet. And this is what you see in the form of scientists, who are usually quite conservative, coming out and saying, 'Look, we have, in essence, an emergency now.'"

At the same time, Mann notes, "The emergency is heightened by the fact that, at a time when we need to see even more action if we're going to stabilize warming below catastrophic levels, we have a president who is trying to take us in exactly the opposite direction."

Last week, in response to a cold spell just days before his own Administration released its report, Trump tweeted: "Whatever happened to global warming?" When asked about that today, Mann responds today by saying: "I'm looking out the window now and it's dark outside. Whatever happened to the sun? His comments about climate change are about as sensible and intelligent as that. Even a 5-year-old understands the absurdity of the claims that he makes."

As usual, Mann has a lot of important thoughts and science to share on all of this, on whether action at this late date can even make a difference, on the media's coverage of the issue, and even on his "disagreement" with a recent comment made by newly elected Democratic progressive Rep.-elect Alexandria Ocasio-Cortez. Please tune in.

Also today: Speaking of the costs of Trump's reckless deregulation and science denial, last week's E. coli outbreak in Romaine lettuce (and the similar nationwide taint that sickened hundreds and killed five earlier this year), was also entirely predictable. It followed the Trump Administration's rollback of Obama Administration testing requirements for water used by producer growers, which would have kicked in this year. Trump's deregulation was supposed to save growers $12 million a year, while the costs of tainted fruits and vegetables costs consumers about $180 million in healthcare costs annually.

We've also got some more midterm election news as well (no, it's still not over!), including Republican Rep. Mia Love finally conceding her U.S. House reelection bid to Democrat Ben McAdams in otherwise ruby red Utah --- and slamming both Trump and her own party in the bargain. That brings the total to 38 House seats picked up by Democrats, so far, with two more still-undecided races in New York.

It's not just midterm counting that continues, but voting as well, as super-genius GOP U.S. Senator Cindy Hyde-Smith faces a tougher-than-expected runoff on Tuesday in Mississippi against Democrat Mike Espy, after a string of disturbing remarks about "public hangings" and voter suppression during her campaign.

It's the final day before Election Day polls open for the crucial 2018 midterms, and I hope you'll not believe a word about what you are hearing regarding who may or may not win or lose. In fact, for many reasons discussed on today's BradCast, nobody actually knows. And, given the way we tally votes in this country, it's possible nobody will ever know who won or lost, no matter whether Democrats or Republicans end up taking control of the Senate, the House or dozens of Governors' mansions across the country. But, over the weekend, amidst one of the nation's most hotly contested gubernatorial races, it was revealed by independent online news outlet WhoWhatWhy, that Georgia's entire voter registration database is completely vulnerable online such that "even a low-skilled hacker" could compromise all registrations in the state via its online My Voter Page portal. The stunning security hole allows any voter registration to be easily changed --- or even cancelled entirely --- as recently as this weekend, just hours before Election Day polls open on Tuesday for our crucial midterms.

The information about the vulnerability, as the outlet's Jordan Wilkie and Timothy Pratt reported first exclusively, came from an astute observer in Georgia who notified the state Democratic Party when he discovered the problem. In turn, the Dems notified U.S. intelligence officials and Georgia's Republican Sec. of State Brian Kemp, who happens to be overseeing his own reportedly very close race for Governor against Democrat Stacey Abrams. By Sunday morning, incredibly enough --- and without providing any evidence whatsoever --- Kemp released a statement falsely accusing the Democratic Party of Georgia of cybercrimes, suggesting they had attempted to hack the state's online voter registration database.

Shamefully, the corporate media ran with Kemp's claims. It would be hours before the actual facts of the matter were picked up, if at all, by those same media outlets who could simply have read WhoWhatWhy's original exclusive for details on what had actually happened in the first place.

We're joined today by MARILYN MARKS, Election Integrity champion and the Republican founder of Coalition for Good Governance, a non-partisan organization which has been taking Kemp to court countless times over recent months regarding his failed oversight of the state's 100% unverifiable touchscreen voting system, his voter roll purges of legitimate voters, and his rejection of absentee ballots from disproportionately African-American voters.

Her group was among the first to learn of the stunning online registration system vulnerability and help alert WhoWhatWhy to the problem. Marks details how Kemp --- who has resoundingly lost several times in federal court over the past week alone --- has pulled the same, almost identical scam on the public in the past. She tells me that this is at least the third time that Kemp has falsely claimed whistleblowers who discreetly reported vulnerabilities they discovered in the state's electoral system are actually attempting to hack it. He did the same in 2016 before, six months later, the Dept. of Homeland Security's Inspector General finally found that Kemp's allegations were completely baseless. And he did so again in 2017, after a data researcher discovered the state's entire voter registration database, voting machine programming and administrative passwords had been left online before and after the 2016 Presidential election with no security protections.

Then, as now, Kemp falsely reported the matter to the FBI as a cyber crime. Marks also had a word or two for the media outlets which continue to credulously parrot Kemp's claims, despite the complete lack of evidence to support the allegations. Marks described the latest incident as a "total abuse of [Kemp's] position as Secretary of State".

All of that comes over the weekend, even as the Dept. of Homeland Security, according to the Boston Globe today, is said to have discovered an alarming rate of actual attempted hacks --- some which they say have had "limited success" --- of our electoral systems in the weeks leading up to Tuesday's election.

Next, a few words of advice about voting from Oprah Winfrey, before we open the phone lines to callers regarding why they will or won't be voting in Tuesday's midterms.

On today's BradCast: There is no small amount of irony in the fact that the first people of this country, Native Americans, are now being forced in North Dakota to go through extraordinary measures to prove their residency in order to vote in America in next Tuesday's crucial midterm elections. [Audio link is posted at bottom of article.]

But, first up today, a small measure of good news from a federal court in Georgia regarding Republican Sec. of State and gubernatorial candidate Brian Kemp's continuing legal battle to throw out Vote-by-Mail ballots based on dubious hand-writing analysis made by partisan election officials. Kemp insists he has the right to toss out ballots without offering Constitutional due process to voters and continues to appeal the U.S. District Court judge's ruling, meant to avoid the disproportionate rejection of votes cast by African-Americans in Kemp's deadlocked race against African-American Democrat Stacey Abrams.

But while that race, which could turn the state "blue", has received a good deal of attention this year, the "toss-up" gubernatorial contest between Oregon's Democratic incumbent Gov. Kate Brown and her GOP challenger, Knute Buehler, has received far less notice. Despite an expected increase in Democratic turnout this year, the progressive Brown is facing a surprisingly close re-election contest in what is otherwise considered to be a very "blue" state, as the GOP and its corporate supporters are pouring millions into the effort to defeat Brown.

Next, we head to North Dakota, where an astonishing effort by state Republicans to disenfranchise Native Americans was recently approved by the U.S. Supreme Court. The effort to prevent the state's tribal members from voting began almost immediately after Democratic Sen. Heidi Heitkamp's razor-thin election by fewer than 3,000 votes back in 2012. Now that she's running for re-election against Republican Kevin Cramer, state Republicans have changed the state's Voter ID law to require physical street addresses rather than the P.O. Box addresses used by many Native American voters living on reservations. In early October, SCOTUS allowed the new requirement to stand, even though the restriction was not in place during primaries last June, giving tribal members less than a month to figure out how to assign addresses to thousands of eligible voters and help prevent chaos and confusion.

Chaos has reportedly reigned, however, even as the state's tribes have been banding together to assign street addresses and create new tribal IDs as quickly as they can, vowing to create such IDs outside polling places even on Election Day on November 6th. On Tuesday, a new lawsuit [PDF] was filed charging that election officials have been rejecting addresses on absentee ballot requests, since newly assigned addresses do not exist in some state databases, and the state's Secretary of State refuses to say whether IDs with new street addresses assigned by Native American voting rights groups will be allowed for use on Election Day.

We're joined today by longtime Native American voting rights advocate OLIVER "OJ" SEMANS, a member of the Rosebud Sioux Tribe and co-founder of the non-partisan Four Directions, which focuses on Native American voter engagement and access. He explains his group's extraordinary (and expensive) efforts being taken to help organize against the suppression of ND's shameful new law, why he believes it was enacted, and whether he feels that indigenous Americans in the state will be able to overcome it.

"The rulings by the 8th Circuit and by the [U.S.] Supreme Court was basically severe spinal damage to the backbone of democracy," he tells me. "The backbone of democracy, which is voting, can only take so many kicks in the back like that before it's broken. Native Americans, who have basically enlisted in the United States services, percentage-wise, more than any other race, and have fought for freedoms for the country, have decided that we're going to fight for our own country for awhile and stop this madness."

Semans explains how claims of "voter fraud" used to justify these restrictions by the GOP, in a very Republican state, have no evidence to support them. "More than likely there is fraud --- but it's not by the Native American Indian," he says. "How can you have one party being re-elected, ten years, sixteen years, twenty years, over and over, without some type of fraud being committed. So, yeah, there's probably fraud, but it's not in Indian Country."

He also details how this new voting restriction would never have been allowed to stand at all, had not the U.S. Supreme Court, in 2013, gutted the landmark Voting Rights Act of 1965 which previously had protected tribal members and other racial minorities from this sort of disenfranchisement. Semans has testified several times in D.C. on behalf of the VRA, going back more than a decade now.

I hope you'll tune in for this, at times, heart-breaking conversation.

Finally today, some listener mail and a bit of a rant against a laughably misleading report on voting systems in St. Louis County, MO, where the most powerful radio station in the state, the 50,000 clear-channel watt blowtorch, KMOX NewsRadio 1120, has misinformed voters that the County's oft-failed and easily-hackable 100% unverifiable touchscreen voting machines and optical scanners are "tamper-proof" and never connected to the Internet. Both assertions --- made by election officials and their private vendor, ES&S, and passed on this week by KMOX (the station I group up listening to) and reporter Kevin Killeen --- are patently false and wildly misleading. As I mentioned on Twitter today, it's a terrible disservice to Show Me State voters that the once-great KMOX would credulously echo such long-ago debunked misinformation to their millions of listeners and readers. I discuss both that, and the woeful response I received from Killeen on Twitter today, to his irresponsible "reporting"...

On today's BradCast, the darkness continues, even as some rays of light appear in the electoral distance. [Audio link to show is posted below.]

On Monday, attorneys for one of three far-right militiamen convicted in a plot to bomb a Kansas apartment building that was home to over a hundred Somali Muslim refugees in late 2016, cited Donald Trump's anti-Muslim rhetoric during the President campaign as reason for shortening the man's life sentence. In sentencing documents, the lawyers charge that then-candidate Trump and videos from rightwing media personalities such as Fox News' Sean Hannity helped stoke their client's hatred "to 11".

On Tuesday, despite being told by victims' families, the city's mayor, and thousands of members of Pittsburgh's Jewish community that he was not welcome, Trump came to the city's grief-stricken Squirrel Hill neighborhood to visit the Tree of Life synagogue where 11 Jewish worshipers were gunned down during services on Saturday. Trump came to the city where he was not wanted today, even as the first funerals for victims got under way, because it reportedly fits in with his campaign schedule that otherwise includes political rallies around the country every day for the rest of the week until next Tuesday's crucial midterms.

The anti-Semitic, anti-immigration rightwinger charged in the Pittsburgh massacre had espoused anti-"globalist" rhetoric akin to those from the Trump fan charged last week with mailing bombs to more than a dozen top Democrats, philanthropists, media outlets and celebrities who had been vilified in recent months by the President. Both men had referenced the so-called Central American migrant "caravan" that Trump, Republican candidates and media outlets from the Right and non-Right have been focusing on over the past several weeks. The group of slowly walking refugees still remains some 1,000 miles from the U.S. border and is unlikely to arrive here for months, posing zero threat to the U.S. Nonetheless, on Monday, Trump ordered the immediate deployment of at least 5,200 more U.S. military troops to the border in advance of next week's election.

Despite the increasing wave of Rightwing violence, the President and the White House and Rightwing news outlets continue to cite the "caravan" as an existential threat. Former top Republican strategist Steve Schmidt unloaded on what has become of the GOP under Trump and the years-long barrage of Rightwing media propaganda. He describes "this whole caravan in the last week of the election" as "a giant lie" and as "Trump's Reichstag Fire".

We share the full, must-listen segment from his remarkable appearance on last night's All In with Chris Hayes on MSNBC, in which the former campaign chair for John McCain's 2008 Presidential run describes the GOP as having become no more than a "cult of personality...that is authoritarian in nature" and charges the "Rightwing propaganda machine industry" has "blood on their hands" after having "radicalized" those who are now committing violence against minorities and immigrants.

Then, just to lighten things up a bit, some election news out of Texas, where legal officials with the Beto O'Rourke (D) campaign tell me about their concerns regarding reports of votes flipping to Ted Cruz (R) on Democratic straight ticket ballots cast on 100% unverifiable Hart-Intercivic eSlate voting computers used across much of the state.

We've also got a bit of slightly brighter news from the Lone Star state, where threats of legal action have resulted in the expansion of early voting opportunities on the campus of Texas State University after students were turned away last week, and a rollback to new voter registration requirements recently imposed at the historically African-American Prairie View A&M University.

Finally, Desi Doyen joins us for the latest Green News Report with details on the serious environmental threat posed by this week's election of the hard-right Jair Bolsonaro in Brazil, and a number of important climate and environment initiatives that are on the ballot in several U.S. states on November 6th...

It's been a harrowing and deadly week --- and weekend --- filled with Rightwing hate and hate mongering (coincidentally, one week before Election Day for the most important election most of us have ever lived through). So, today we kick open the phones to callers on all of the above to get a sense of where things stand at this point and to help answer a bunch of questions about the crucial midterms.

On today's BradCast: More chilling Khashoggi news, more maddening voter suppression, and the Republican deregulation of phone companies in Florida and at the FCC have deadly consequences in the Sunshine State. [Audio link to full show is at bottom of article.]

First up today, an update on the latest in the alleged Saudi murder of Washington Post journalist Jamal Khashoggi and the wildly unreported fact that he had "self-exiled" from Saudi Arabia after being banned by the Saudis from writing and appearing on television or at conferences back in December of 2016 --- for being critical of then President-elect Donald Trump! That point seems quite important, given the Trump Administration's continuing efforts to help cover up the assassination in coordination with the Saudis and their ruling Crown Prince Mohammed Bin Salman, after they repeatedly lied about the grisly killing of a journalist who had been mildly critical of Trump, as first reported in late 2016 and by the U.S. State Department in 2017.

Next, GOP voter suppression continues across many states in advance of the crucial November 6th midterms. Over the weekend on Twitter, President Trump lauded Georgia's Republican Gubernatorial candidate Brian Kemp, who as Secretary of State, has been working for years to suppress tens and even hundreds of thousands of disproportionately African-American voters in the Peach State. Kemp, as the state's chief election official, is overseeing his own election in a reportedly tight race for Governor against African-American Democratic candidate Stacey Abrams.

Trump also took the opportunity on Twitter over the weekend to falsely fan the flames of the GOP's phony claims of "VOTER FRAUD" in hopes, according to the Lawyer's Committee for Civil Rights Under the Law, of inciting government officials and law enforcement to intimidate minority voters before the crucial November 6 election. The Lawyer's Committee heads up the 866-OUR-VOTE hotline to answer question and help trouble-shoot voting problems, such as recent reports that early voters are being either turned away or forced to vote by provisional ballot --- rather than normal ones --- if the address on their ID does not match the one under which they are registered. Georgia's Photo ID voting restriction does not require registration addressees to match those on IDs (e.g. student voters who may not have in-state driver licenses or those who recently moved but have not yet updated their license.) Please contact the 866-OUR-VOTE hotline with questions about local voting laws or any problems at the polls --- and share that number far and wide over the next two weeks!

Finally, despite national media now focusing elsewhere, the devastation in Florida's Panhandle following the Category 4 Hurricane Michael two weeks ago continues and the official death toll is still rising. At the same time, power and phone service is still out in a number of rural areas, thanks in no small part to the deregulation of telecommunications company rules by Florida's Republican Gov. Rick Scott shortly after taking office in 2011, and by Donald Trump's FCC Chairman Ajit Pai.

We're joined today by Public Knowledge's Senior Vice President HAROLD FELD, who has been warning for years about exactly such a situation. Feld explains how Scott gutted almost all of Florida's telecom company rules when he signed the "Regulatory Reform Act of 2011" and how Pai went still further when he gutted Obama-era phone company regulations in November of 2017.

Scott's 2011 measure "was a complete deregulation of the telephone industry in Florida. It removed the state Public Service Commission from any sort of jurisdiction over residential telephone service. It removed something called 'Carrier of Last Resort,' which means there always has to be a telephone provider in the area. It even removed the ability of the Public Service Commission to take complaints from consumers," Feld tells me. He describes it as "one of the most radical deregulations in the country."

As to the federal regulations scrapped by Trump's FCC, that was in response to federal regulations enacted in the wake of the disastrous performance by Verizon following SuperStorm Sandy in 2012, when copper lines were swept away, and phone companies failed to restore them, claiming that the use of cell phones meant they were no longer necessary. Obama's FCC insisted that "no repairing was not an option," says Feld. But Pai "insisted that there was no reason for any of these regulations [and] that companies have private incentive to deploy these networks, despite everything that actually happened," particularly in rural areas, following Sandy.

The Government, he notes, largely for decades has recognized "that it's always going to be profitable [to ensure service] in the cities, [but] it's not going to be profitable once you get out into the rural areas." So, it's been a value and tradition "through each upgrade of our communication network --- when we went from letters to the telegraph, from the telegraph to the telephone" to ensure service to all. But that's no longer the case.

Like Gov. Scott's Florida, Feld describes, some 37 states have lifted similar decades-old telecommunications requirements, thanks to legislation encouraged by the American Legislative Exchange Council (ALEC), a privately-funded partnership between major corporations and (mostly) Republican state lawmakers.

The Republicans' deregulate-at-all-costs efforts to gut regulations --- regulations that Pai scoffed at before he became Trump's FCC Chairman --- may now be costing lives in Florida, as many in rural areas, as of late last week, remained unaccounted for, weeks after the storm. The non-partisan Public Knowledge group is suing for a reversal of those deregulations, and Florida's own Chief Financial Officer and State Fire Marshal, a longtime resident of the Panhandle himself, is now also begging Pai to consider a reversal...

• The catastrophic and climate change-fueled Hurricane Michael made landfall in Florida on Wednesday as a deadly and unprecedented Category 4, the strongest ever to strike the Panhandle since record keeping began in 1851;

• In not unrelated news, another major coal company, one of the nation's oldest, declares bankruptcy. It's the fourth to do so in the past three years;

• ExxonMobil gets some great publicity from Bloomberg by spending just $1 million (which they generated every two minutes in 2017) in pretending to support a carbon tax scheme (that would benefit them anyway);

• The U.S. Supreme Court allows a lower court's voter ID ruling to stand in North Dakota, despite the fact that the rule is a change from voting laws used during the April primary and is now likely to result in the disenfranchisement of thousands of Native Americans in a state where Democratic Sen. Heidi Heitkamp faces re-election after winning by just 3,000 votes in 2012. (Here's the ridiculous effort that thousands of Native Americans without a residential address, as now required by ND law to vote, must now go through to get one registered somehow before November 6th.);

• A state court in Missouri blocks part of their new voter ID law for being "contradictory and misleading" and "impermissibly infring[ing] on a citizen's right to vote" in the state where Democratic Sen. Claire McCaskill is in a very close re-election battle. Her opponent, Republican Attorney General Josh Hawley is defending the law and is likely to seek an appeal from a higher state court;

• After Georgia's Republican Sec. of State Brian Kemp was found to have purged hundreds of thousands of voters from the rolls over the past several years, AP finds that some 53,000 voter registrations are currently in a suspended state due to GA's "exact match" rule, which allows election officials to block registrants whose names aren't listed identically to the way they are on found on file at either the state's Department of Driver Services or the Social Security Administration. A missing hyphen or a typo by officials entering a name into one of the databases is enough to result in a suspension which, the AP finds, is disproportionately keeping black voters off the rolls. 70% of those blocked are African-Americans, even though GA’s population is just 32% black. Kemp is currently running for Governor against Stacey Abrams who, if successful on November 6th, would become the nation's first African-American female Governor;

• Some listener mail on a recent show regarding West Virginia's Sen. Joe Manchin, who voted in favor of Brett Kavanaugh's confirmation to the U.S. Supreme Court last weekend, as the coal state Democrat faces re-election after WV voted for Trump by 42 points in 2016;

• And, finally, a viral musical ditty to close us out today on the "very scary time for young men," as Donald Trump appallingly described it, following the multiple credible allegations of sexual assault by now-Supreme Court Justice Kavanaugh...
