And so begins our traditional, biennial (if not more frequent) coverage of partisans understandably freaking out when their 100% unverifiable touch-screen votes are seen flipping on screen from a candidate or candidates of their preferred party to a candidate or candidates from a different party.

Historically, over the past decade since we've been covering it (and related issues), this issue has occurred far more often for Democratic voters seeing their votes flip to Republicans. Nonetheless, the opposite phenomenon (as well the scenario involving third party or independent candidates) is not entirely uncommon. And, in all cases, voters should be concerned, election officials should be embarrassed and elected officials who continue to allow the use of these unverifiable secret vote-counting systems --- antithetical to American democracy and public elections as they are --- should beg forgiveness from their constituents, rather than begging for more money and more unverifiable votes.

As Early Voting is now under way in much of the country, we are, predictably, beginning to receive our first reports from voters seeing their votes flipped before their eyes on touch-screen voting systems. One such case involves a tip we received about straight-party Democratic votes reportedly flipping to Republican straight-party votes in Collin County, TX. Another case, reported widely on Thursday in the rightwing media, concerns a similar incident in Cook County, IL, where a GOP candidate says that his attempted Republican votes flipped before his very eyes to Democratic ones on that county's unverifiable touch-screen voting systems.

There is good and bad news here. And there are a number of myths and truths about these systems and these sorts of incidents which we've documented almost non-stop over the past ten years at The BRAD BLOG. So let's review a few key points about what actually occurred and didn't, what you should be concerned about in both the TX and IL cases and what you should do if it happens to you, as these occurrences are almost certainly going to continue between now and Election Day on November 4th...

System failure follows warnings from e-voting experts that Estonian Internet Voting system vulnerable to attack, manipulated results...

In case you're wondering, the U.S. isn't the only nation who still uses woefully unverifiable e-voting systems that are easily hacked and prone to malfunction and malfeasance. E-voting systems in Belgium failed spectacularly over the weekend, during the European Union "Super Sunday" elections there, according to PCWorld...

A bug in an e-voting application halted the release of European, federal and regional election results in Belgium, the country's interior ministry said Monday.
...
A bug in the voting software used at canton headquarters where the votes are counted caused "incoherent" election results when it tried to add up preferential votes from those machines, ministry spokesman Peter Grouwels said. The application counted the results in different ways that should always get the same outcome but that wasn't the case, he said, adding that the release of the results was immediately stopped when this was discovered.

The fault appeared in the system despite the fact that the application was especially developed for these elections, was "tested thousands of times" and was certified by PriceWaterhouseCoopers, he said.

"Tested thousands of times." Gosh, that sounds familiar.

Also, familiar? The response to the disaster from the group that has been fighting against unverifiable e-voting systems for years there [emphasis added]...

On Monday night's All In with Chris Hayes on MSNBC, New Jersey State Senate Majority Leader Loretta Weinberg joined Hayes to discuss "smart gun" legislation she helped pass in her state. But it was the curious assertion by a supporter of the technology, claiming that electronic voting machines are now "fool-proof", which kinda just blew my mind.

Mark Glaze, spokesman for Everytown for Gun Safety, a group which, according to its website "brings together survivors of gun violence to share their stories and advocate for laws that will prevent future tragedies," said twice during the conversation, that e-voting systems are now "fool-proof."

While there were once concerns about e-voting systems, he said (see his full remarks below), those worries have now been assuaged thanks to "public and private partnerships at both the federal and state level that guaranteed that these machines were fool-proof".

Huh, what?! When did that "partnership" take place? And how did they "guarantee" such "fool-proof" results? Was that before or after, for example, the 2012 election in Palm Beach County, FL, when a paper-ballot optical-scan computer tabulation system (made by Sequoia Voting Systems) was discovered, through pretty much a stroke of luck, to have inaccurately declared the "winners" of three different elections, such that the contests were overturned and a hand-count by human beings found that the computers had declared the wrong "winners" in two of them? After that incident came to light, the Vice-President of Dominion Voting, the e-voting vendor which now owns Sequoia, admitted that the bug which caused the wrong "winners" to be named by the computer tabulator exists in all versions of it's Sequoia systems --- both paper-ballot op-scan systems as well as touch-screen systems --- in use across the country.

"And guess what?," Glaze continued telling Hayes on Monday night's show, "Today, there are very few questions about electronic voting machines." Really? Someone must have forgotten to tell that to the voters in St. Lucie County, FL, where hundreds of votes were mistabulated thanks to faulty memory cards in the county's computerized paper-ballot tabulation system (made by Diebold) in the contested U.S. House race between Rep. Allen West (R) and Patrick Murphy (D), also in 2012?

I could go on --- and on, and on --- with similar recent examples along those lines, but I'll spare you. For now. You're welcome. Hopefully you get the picture.

Glaze then went on to assert that, whatever the initial concerns may have been about electronic voting and tabulation systems, "we figured out how to get around it and today electronic voting makes things more fool-proof and easier and reduces the risk of fraud."

Yes. That's actually what he said. And on television, where everyone could hear it!

We've sought comment from Glaze, asking for details in support of his remarks --- and on his great, if unconfirmed news about electronic voting systems! --- and will update this item when and if we receive a response.

Democrat Derek Cressman fights for sunshine among a weak slate of candidates to oversee elections in nation's most populous state...

He makes a very cute campaign video. Please watch it above. It's quite clever. But it would be nice if California Secretary of State candidate Derek Cressman, one of two Democratic candidates vying for the job in the upcoming June 3rd primary, had a better understanding of the electronic voting systems he'd be overseeing as SoS.

I had originally intended to run the video above, because it's smart and fun, along with a throw-away remark expressing the wish that Cressman understood more about the very technical concerns about the security and verifiable of e-voting system --- particularly since the way CA deals with them has such a sweeping effect on the same systems as used across the country.

As a former Common Cause executive, Cressman has made his important fight to overturn the Supreme Court's abhorrent Citizens United ruling central to his campaign, as highlighted in the animated campaign video above. That's fine, but the office of Sec. of State, particularly in CA, requires much more.

Rather than offer that throw-away remark, however, I thought I'd see if Cressman had learned more about electronic voting systems since he and I briefly chatted in person at an event last summer, just as he was originally entering the race.

According to comments he sent in response to a recent query from The BRAD BLOG, while Cressman's general knowledge of the systems seems to have improved since we last spoke, and while he remains an ardent opponent of the madness of Internet Voting and some of the most unsecure methods of precinct-based voting, his understanding of the concerns about the vulnerability of e-voting remains troubling --- at least for a Sec. of State candidate in the nation's most populous state...

The U.S. National Security Agency knew for at least two years about a flaw in the way that many websites send sensitive information, now dubbed the Heartbleed bug, and regularly used it to gather critical intelligence, two people familiar with the matter said.

The NSA's decision to keep the bug secret in pursuit of national security interests threatens to renew the rancorous debate over the role of the government's top computer experts.

Heartbleed appears to be one of the biggest glitches in the Internet's history, a flaw in the basic security of as many as two-thirds of the world's websites. Its discovery and the creation of a fix by researchers five days ago prompted consumers to change their passwords, the Canadian government to suspend electronic tax filing and computer companies including Cisco Systems Inc. to Juniper Networks Inc. to provide patches for their systems.

So the NSA knew about this massive security flaw, one of the biggest in the history of the Internet, and rather than warning about the security vulnerability to all Americans, exploited it, instead.

While I can't say I'm particularly surprised by this, I can say, I'm infuriated by it.

If it wasn't before, the NSA has now become a complete joke. What part of "national security" is unclear to the National Security Agency, for chrissakes?!!

Ever since the situation in Ukraine began to blow up (again), I've been trying to figure out what's really been going on. It hasn't been easy. And the U.S. corporate media has not been particularly helpful (again).

My attempt to sort out fact from fiction after last weekend's '97.6%' referendum vote in Crimea is just one example of finding the facts running counter to the U.S. MSM narrative.

We pick up that thread on this week's KPFK/Pacifica Radio BradCast, as I was joined by investigative reporter Robert Parry of ConsortiumNews.com to try and sort much of it out. His must-read article, "Mainstream US Media Is Lost in Ukraine", tying together blatant media failures on Iraq and Syria and now in Ukraine, begins to crack the nut of what the U.S. media is failing to tell us about the entire fine mess, including some startling audio evidence that we play on the show suggesting that certain narratives --- for example, the one about now former Ukraine President Viktor Yanukovych's police gunning down protesters --- may be much less (or, at least, much different) than has been generally reported in this country.

Parry explains how "The U.S. mainstream news media is reaching a new professional low point as it covers the Ukraine crisis by brazenly touting Official Washington’s propaganda themes, blatantly ignoring contrary facts and leading the American public into another geopolitical blind alley."

But he's not alone in his support among 2014 SoS candidates for unverifiable e-voting systems in the Golden State...

The Green Party's candidate for California Secretary of State this year is a strong proponent of Internet Voting. David Curtis, who was also the Green's 2010 candidate for Governor in Nevada, is now running to replace CA's term-limited Democratic Sec. of State Debra Bowen and he's staking out a position that contradicts computer scientists and security experts who warn that online voting cannot be done securely.

Recently, I had a "conversation" with Curtis on Twitter about his advocacy for Internet Voting, after Steven Dorst, an election integrity advocate who follows The BRAD BLOG on Twitter, responded to a tweet of Curtis' declaring his support for an optional "online method of voting".

My enlightening conversation with Curtis follows in full below.

The BRAD BLOG has long been on record documenting the many dangers of Internet elections. While the ease of hacking such elections is certainly a major concern (among many others), the over-arching problem with Internet Voting is that, after voting is complete, it is 100% impossible for citizens to oversee their own election results in order to determine that any vote has been tallied as per any voter's intent.

As with electronic touch-screen voting, which is 100% unverifiable in any form, even when done securely --- if there is even a way to measure such things (and virtually all computer security experts have told us for years that there isn't) --- Internet Voting can never been done in such a way that the citizenry can know that its been done securely. Thus, no matter how "secure", Internet Voting is ultimately a threat to confidence in elections and, along with it, representative democracy in the U.S.

Nonetheless, Curtis, like at least one other candidate in this year's SoS race in California, disagrees. He strongly advocates in favor of Internet Voting...

UPDATED with 'recount' details and more...

Meanwhile, back in Virginia...here we go again...

Yes. As reported by the State Board of Elections website tonight, that's a 9-vote margin in the state Senate special election held on Tuesday to replace Democratic state Sen. Ralph Northam who is vacating his seat after being elected last November as VA's next Lt. Governor.

To put that another way, control of the entire VA state Senate now rests on 9 unverifiable touch-screen votes out of more than 20,000 cast.

The VA state Senate is currently evenly split between Democrats and Republicans, twenty seats each. The tie-breaking vote in the state Senate goes to the Lt. Governor. Until Northam is sworn in to his new job on Saturday, when he takes over from the current Republican Lt. Governor, the GOP controls both chambers of the state legislature. A Democratic Lt. Governor will, theoretically, for the first time since 1998, mean that control of the upper chamber goes back to Democrats. But that is only if both Northam's Senate seat and the one being vacated by Attorney General-elect Mark Herring both go to Democrats in the special elections...

County Registrar tells BRAD BLOG how e-vote and human error led to big gain for GOP candidate during canvass of tight race...

Sometimes it's a good idea to get a full explanation before these things become fodder in a contentious partisan legal election contest. So that's what we've tried to do. Happily, the General Registrar of Bedford County, VA was more than willing to help.

Last week, and the week before, The BRAD BLOG devoted quite a bit of coverage to the incredibly close Attorney General's race in Virginia. As of last week, the Democratic candidate Mark Herring was certified by the state's local voting jurisdictions (counties and cities), as the "winner" over Republican Mark Obenshain by just 164 votes out of more than 2.2 million cast.

The contest is, for now, in the hands of the State Board of Elections which will issue its own official official certification of results on November 25th, after which the candidate declared the "loser" is almost certain to ask for a "recount" and potentially file an election contest thereafter, depending on the outcome. (See the last section of this article for an explanation as to why we put quotes around the word "recount", especially in Virginia.)

During the week-long roller coaster canvass by jurisdictions across Virginia following the November 5th election, there were a number of minor adjustments to local tallies as county and city election officials checked and double-checked results printed by touch-screen and paper ballot optical-scan tabulation computers from Election Night and then adjudicated provisional ballots for tally and inclusion in the final results. While most of the adjustments made during the week following the election were relatively small, each was of great significance in a race this tight.

But there were three rather large changes to the results during the post-election canvass process --- two were in the Democratic strongholds of Fairfax County and the city of Richmond, and one was in heavily Republican Bedford County. All of the large tabulation adjustments were said to have been caused by various combinations of computer tabulator and human error.

Two of them, the ones which resulted in about 1,300 votes beginning picked up by the Democrat over his Republican rival in both Fairfax and Richmond, were covered and explained in the media in some detail. The adjustments made during the canvass by heavily-Republican Bedford County, however, which resulted in a net pick-up of about 500 votes for Obenshain, received considerably less public explanation.

Given that all of these matters may be revisited once again in a "recount" --- and the inevitable legal challenges to go with it --- we thought it might be good to get the explanation for Obenshain's big vote pickup in Bedford County on the written record. Bedford's General Registrar Barbara Gunter was kind enough to reply to our queries last week on that point, offering her explanation for the known details of the computer and/or human errors that led to more than 700 votes in the AG's race being initially misreported on Election Night in Bedford County...

We reported yesterday on the incredibly close race for Attorney General in Virginia. With more than 2.2 million votes cast, the margin between Mark Obenshain (R) and Mark Herring (D) has been within a few hundred votes since Election Night on Tuesday.

Within the last few hours, an unexplained discrepancy has been discovered by those combing over the reported numbers in Fairfax County. The county leans heavily Democratic and, unlike much of the rest of the state which uses 100% unverifiable touch-screen, Fairfax uses optically-scanned paper ballots for its main vote tabulation system.

After Democrats reportedly won both the Governor and Lt. Governor races, only the AG's remains undecided at the top of the ticket. For the last 24 hours or so, the Republican Obenshain has been leading during the canvassing of ballots by about 700 votes, as absentee and provisionals are tallied and doubled-checked.

But now, thanks to some smart detective work by both a Democratic political team in Fairfax County and by Dave Wasserman of the non-partisan Cook Political Report, the fortunes for the Democrat candidate Herring may just have taken a big turn, even as a new mystery is added to the equation...

Incredibly close race was run mostly on 100% unverifiable electronic touch-screen voting systems...

As of today, following yesterday's off-off year Election Day 2013, the race for Virginia Attorney General is still uncalled by the media, and for good reason. Out of some 2.2 million votes cast in VA yesterday, the Democratic candidate for AG, Mark Herring and the Republican candidate, Mark Obenshain are now reportedly just a hair's breadth apart.

Depending on whose numbers you look at, as of 2p ET this afternoon, Obenshain is reportedly ahead by either 965 votes, according to the State Board of Elections (SBE), or by 286 votes, according to AP (which was often well ahead of the SBE numbers during reporting of results last night), with all precincts now said to have been accounted for in unofficial results.

The last numbers I had seen before going to bed last night at around 4am ET, showed Herring up over the Republican by 616 votes, but there were still said to be about 4 precincts out at that time, according to AP. The SBE's numbers had several more precincts unreported at that hour, as it looks like they had knocked off for the night several hours earlier.

Given the tightness of these reported numbers, and the fact that Republicans are certainly hoping to deny Democrats of a "clean sweep" win last night (the Ds took both the Governor's and Lt. Governor's race), a Commonwealth-wide "recount" is almost certain in the Attorney General's race. Current AG, and last night's failed Gubernatorial candidate Ken Cuccinelli will likely oversee that "recount," as luck would have it.

But a "recount" in VA, may offer much less than one would think. So, here's why I put the word "recount" in quotes. This is what the map of Virginia looks like, courtesy of Verified Voting's 2012 database, as identified by types of voting systems used across the state...

And how to maximize the likelihood of your vote actually being counted and counted accurately...

These tweets are from Col. Morris Davis, the former Chief Prosecutor at Gitmo, on how things went for him today as he was trying to vote in Virginia...

In another tweet, Davis notes that he "voted in Buckland Precinct in Prince William County, Virginia," and then noted to others that he "Hope[s] voters will double check their ballots before pushing submit to make sure they're right."

Good advice, of course. But, unfortunately, given the 100% unverifiable touch-screen voting systems used in Prince William County (and across much of Virginia and most of New Jersey), even checking the onscreen "ballot" for accuracy is no guarantee that the vote will be counted accurately, or even at all, unfortunately.

The same is true on systems that have so-called "paper trails" that print out for voters to examine before "casting" them. (On those systems, the "Voter Verifiable Paper Audit Trail" or VVPAT, is largely to make the voter feel better, somehow. In truth, those "paper trails" are almost never actually tallied. The internal computer numbers are used instead. And, even if the VVPATs were to be tallied by humans, there would be no way to know for certain that they actually reflect the intent of any voter.)

For the record, Prince William County uses touch-screen systems made by Sequoia Voting Systems, which is now owned by the Canadian firm Dominion Voting. To get an idea of the many problems and concerns over the years with Sequoia touch-screen systems, see this article detailing the day that Barack Obama early voted on one of them in Chicago last year. Those are also the same systems which managed to flip Oprah Winfrey's Presidential vote back in 2008. (The Obama piece also includes links to our articles detailing things such as Sequoia's "yellow button" on the back of each touch-screen system which, if pressed correctly, as an election official explained to us back in 2006, allows a voter to "vote as many times as you want. You won't ever have to stop until someone physically restrains you from voting.")

Want to maximize the possibility that your vote will be counted and counted accurately? Try to vote on a hand-marked paper ballot where available. We were told today that, for the first time, some locations in Virginia are allowing voters to vote on paper if they like, though Charlottesville, VA voter David Swanson reports than when he voted at the precinct today, "Most people chose not to."

Of course, paper ballots are also almost always tallied by computers, instead of humans, so those are causing big problems for voters as well today...

If you haven't been able to follow Reagan-appointed federal appellate court judge Richard Posner's stunning disavowal of his landmark 2007 polling place Photo ID law ruling - from admitting he got it wrong a few weeks ago...to unconvincingly unadmitting it this week --- I'd hardly blame ya.

On this week's BradCast on KPFK/Pacifica Radio, I tried to help make sense of the Photo ID Posner Coaster, as much as possible, and explain where it leaves the continuing fight against the ramped up GOP voter suppression in this country.

We also covered the criminal charges recently filed against repeat offender Diebold (for what the U.S. Attorney described as "a worldwide pattern of criminal conduct"); the new way that KS and AZ have come up with to keep legal voters from voting; and, with NJ Gov. Chris Christie up for re-election next week and taking a bow for his post-"Superstorm Sandy" performance one year ago this week, it seemed a good time to revisit the secret Koch Brothers audio tapes we revealed in 2011, when Christie was lauded at a secret Koch Brothers meeting in Colorado, where brother David introduced him proudly as "my kind of guy", among other praises sung.

Oh, and Desi Doyen joined us, as usual, for the latest Green News Report and lessons --- learned or otherwise --- one year after "Sandy"...
