A formal challenge to the announced results of South Carolina's Democratic primary for the U.S. Senate has now been filed by Judge Vic Rawl, the candidate who wasn't announced the winner by the state's oft-failed, easily-manipulated, 100% unverifiable ES&S e-voting system.

Rawl released an official statement on his website today, in conjunction with the filing and a press conference he held in Charleston this afternoon.

The statement points generally to a number of findings being made by the campaign as independent experts have analyzed the results, voting patterns and problems being reported by poll workers and voters on Election Day where the unknown, unemployed candidate Alvin Greene defeated Rawl on the unverifiable ES&S iVotronic touch-screen voting systems, performing 11 points better on those machines than he did in the paper-based absentee results. The oft-failed, easily-manipulated ES&S election results reporting system gave Greene a 59% to 41% "victory" over Rawl.

Greene did no campaigning, had no name recognition, had no campaign website, faces felony obscenity charges and managed, somehow, according to the electronic results, to best Rawl, a four-term state legislator to win the nomination to face incumbent Republican U.S. Sen. Jim DeMint in this November's general election.

In Florida, state Senate Democrats are just barely blocking (for now) an abortion restriction advocated by Republicans that would force women to have, pay for, and view, an ultrasound image before having an abortion.

In Oklahoma, it is already law that women are forced to undergo and view such an ultrasound, along with listening to a detailed description of the embryo or fetus. In a completely inconsistent addendum, a doctor is permitted to withhold information about any defects that are revealed in such an ultrasound.

In Virginia, new budgetary measures cut Medicaid funding for abortions, even if the woman's life is in danger.

In Nebraska, a medically unsupported "pain provision" bars all abortions after 20 weeks and requires women seeking abortions before then to undergo a mental health evaluation.

In Kansas, only a gubernatorial veto stands between women's right to self-determination and being reported to the state for having abortions.

Why now? Foes of women's sovereignty over their own bodies have been working on abortion restrictions for decades. But after standing pat during the Bush years, perhaps thinking that sooner or later George W. Bush would give them the magic prize they've coveted for so long, all of a sudden state after state is passing abortion restrictions that make very clear the misogynistic leanings of these states' legislatures. Forcing women to have invasive vaginal ultrasounds? Forcing them to view images? Mental health evaluations?

But is it just about misogyny? Or does it have something to do with the pee-in-the-pants terror of the teabag movement at the inevitable end of white majority that's coming in this country?

Demon coupling will result in company counting 92% of Sunshine State votes, at least 70% nation wide...

TALLAHASSEE --- Florida Attorney General Bill McCollum is conducting an anti-trust investigation of a voting-machine company merger that would create a near-monopoly over the levers of democracy in Florida and much of the United States.

McCollum's office has issued at least six subpoenas covering every major voting-machine company as part of a civil investigation of Election Systems & Software's $5 million acquisition of Diebold Inc.'s elections division --- a merger that would give a private company too much power over the machines used to cast votes, voting-rights groups say.

``Our office engaged in this issue because anti-competitive behavior can seriously harm consumers,'' McCollum said in a written statement. ``Competitive behavior encourages the best products be available to consumers, including technology, particularly in a market as sensitive as the voting systems market.''

Under the state's 1980 anti-trust law, McCollum could persuade a court to levy fines against ES&S or prevent the company from operating in Florida. By next year, the company is expected to be the exclusive provider of voting machines and services in 65 of the 67 counties in Florida, the nation's most important swing state.

That means, under the acquisition announced Sept. 2, ES&S will provide election services to 92 percent of Florida's 11.2 million voters.

More broadly, ES&S's purchase of the competitor company gives it control of the voting machines in nearly 70 percent of the nation's precincts, according to a federal lawsuit in Delaware filed by a rival company, Hart Intercivic. The U.S. Department of Justice is conducting its own inquiry.

ES&S, of course, told the Herald/Times that their acquisition of Diebold "will result in better products and services for all customers and voters alike." And, if you believe that, we've got an unhackable voting machine to sell you....

Another screw-up for notorious Election Director Kathy Dent...

On October 17th, we reported that World's Worst Supervisor of Elections Kathy Dent of Sarasota, FL, had discovered in pre-election tests that her new Diebold/Premier optical-scan voting systems failed to properly read paper ballots marked with blue ink.

Her "solution": Make sure that black pens were available at polling places, and otherwise have election officials duplicate blue-inked ballots by hand (and in secret, naturally, where the voter wouldn't be able to watch).

While an attempt could be made to encourage voters to use black ink at the polling place, there was no real way to ensure that absentee voters used black ink, other than try to encourage them to do so.

So, naturally, the inimitable Ms. Dent sent out thousands of sample ballots [PDF] encouraging votes to use "a blue or black pen"...

Dent, of course, is the same disastrous Supervisor of Elections who presided over the 2006 FL-13 Congressional race in which 18,000 electronic ballots in Democratic-leaning Sarasota disappeared from the county's ES&S touch-screen systems, in a race decided in favor of the Republican by just 369 votes. Later, she actively campaigned --- by placing leaflets in the polling place! --- to keep those touch-screen machines in use, despite that failure, and despite a measure on the ballot in the same election calling for a move to paper ballots.

Since the state now requires paper ballots, Dent chose to install the newest Diebold/Premier optical-scan systems, the ones that don't read blue ink properly, despite the fact that they had not been federally tested or certified for use at the time. Florida does not require federal certification tests for voting systems before using them.

Heckuva job --- as usual --- Kathy!

County election director Kathy Dent's 'solution' as bad or worse than the actual problem...as usual...

The November 3rd Election Day is nearing, so naturally the words "glitch," "hiccup," "snafu," and "snag" are back in the headlines, instead of the word "failure," which would be the appropriate one to use in such cases.

Today, it's our old friends in Sarasota, under the continuing and now-legendarily failed direction of Supervisor of Elections Kathy Dent and her latest failed voting system, this one an optical-scan system made by Diebold, featured in the Charlotte Sun's "Scanning glitch in vote machine test":

A handful of individuals were on hand this week at the Sarasota County Supervisor of Elections office where Supervisor Kathy Dent and staff tested 16 ballot scanners that will be used in the Nov. 3 city council election.

In one test a ballot with both blue and black ink was unable to be scanned. Officials pulled that scanner from service and substituted another. It didn't work either.

The machine that didn't work --- no, it's not a "glitch," it didn't succeed in carrying out the purpose for which it was designed and purchased anymore than a car which didn't start, or whose brakes failed could be said to have a "glitch" --- was the old, failed Diebold Accuvote optical-scan system, similarly used in hundreds and hundreds of counties in dozens and dozens of other states.

The "solution" Dent ultimately settled on in response to the failure of the machines made by Diebold (now calling themselves Premier and recently purchased by their larger competitor ES&S) is as bad, and as offensive, as the original failure itself...

On this coming weekend's Ring of Fire on Air America Radio, attorney/co-host Mike Papantonio can't stop laughing as he reads our headline from last week: "Georgia Supreme Court Rules Unauditable, Unverifiable Elections Are Just Fine".

Though they give me the credit, it was Rady Ananda's story here last week which expertly covered Diebold's wholly unverifiable touch-screen voting machines receiving the thumbs up for use across the entire state of Georgia, where they've been using them since 2002. That, even though there is no way to determine that any vote ever cast on any of them has ever been recorded accurately as per any voter's intent.

Once Pap stops laughing at our headline, he and David Bender discuss the article noting its even more terrifying "subtext", our previous coverage of the horrifying ES&S takeover over of Diebold's election division.

"Bad as Diebold was, it's now gonna be ES&S, their largest competitor ... ES&S may be the single voting machine company --- this one Goliath that will be unaccountable, unauditable to anybody --- and that's really where we're headed," Bender accurately warns. He advises folks to call Congress at 202-224-3121 in support of Sen. Chuck Schumer's demand for a DoJ antitrust investigation on this matter. We'll also point you to BlackBoxVoting.org who instructs how you can send your own antitrust complaint to the DoJ.

Finally, after Pap details ES&S' legendarily monumental "screw-ups" over the years (his firm was one of those who took on the state of Florida and ES&S after their voting machines simply lost 18,000 votes cast in the 2006 FL-13 U.S. House race, decided for the Republican candidate by just 369 votes), they go on to say some extraordinarily kind things about our work here at The BRAD BLOG.

Please see RAW STORY for the whole story, but Bush's former White House spokesperson Ari Fleischer pulled a slick, if sleazy maneuver on CNN's Larry King Live last night while undermining the wingnut "birthers" who believe that Obama is not a U.S. citizen:

I want to point out something that is a terrible hypocrisy about all of this. When George Bush was elected, there were many people who called him illegitimate and said that he lost Florida despite there being no evidence of that being the case.

Actually, there is "evidence of that being the case," Ari. Plenty of it. Beginning (but not ending) with this years-old independent study [PDF] by a media/academic consortium posted at the "conservative" American Enterprise Institute showing that when all the ballots in the state of Florida were counted --- by any standard (hanging chads, swing chads, pregnant chads, etc.) --- Bush lost and Gore won. By. Every. Conceivable. Counting. Standard. Period.

Other than that, yeah, "for everyone...who's a little lulu on the right, there's about 1.8 who's lulu on the left," as Fleischer misled.

Dishonest Moral Equivalence Accomplished.

Arrest warrants have been issued in Miami for 11 people suspected of falsifying information on hundreds of voter registration cards last year.

The FBI and state authorities were making arrests Wednesday. The workers being sought were hired to register voters by the Association of Community Organizations for Reform Now, or ACORN.

Prosecutors say they were first notified by ACORN about problems with workers in June 2008.

Republicans and conservative activists have accused ACORN of fraud in voter registration drives around the country. ACORN officials say the Florida case proves the organization is committed to an honest process.

The case involved nearly 900 fraudulent voter cards in the Homestead area.

Prosecutors notified in June of 2008? But nobody bothered to point that out publicly until now? Go figure.

Of course, for those Fox "News" viewers who don't already know, virtually every one of the handful of ACORN workers (out of some 13,000 employees) who were arrested for defrauding the organization, were turned in to officials by ACORN themselves. Here's some help for disinformed Glenn Beck fans. Yes, ACORN is the one that flags voter registrations themselves as fraudulent before turning them into officials, as they are required to do by law.

Contrast this case (and all the other ACORN-smear cases) with the one, among many, that Fox "News" (and the others) forgot to report and/or become outraged about: The arrest, and subsequent guilty plea of the head of the California GOP's own voter registration firm, Mark Anthony Jacoby of Young Political Majors (YPM), for voter registration fraud.

Yes, I had to personally break that news on Fox.

Oh, yeah, and for good measure, there's well-documented felony vote fraudster Ann Coulter who is even paid by Fox "News" to appear on their network regularly, even to this day.

New: Finger Bitten Off at Healthcare Protest in CA...

A 65-year-old man cheering healthcare reform in Miami was punched in the face and knocked to the ground by an opponent of a public health plan, according to a reporter at the scene. The rally took place outside a Great Miami Chamber of Commerce event where Florida Sen. Bill Nelson (D-FL) was speaking.

"I'm amazed the way this has become such a politicized issue,'' [the victim, Luis] Perrero told [Miami Herald's Toulouse] Oloronippa. "It shows that people who are against the public option will resort to anything, including battery on a senior citizen to prevent healthcare reform.''

Perrero is right, and extremely lucky, that all he received was a punch in the face. As we've noted, on several occasions, we'll consider it a great success if we can make it through this teabagging nightmare without someone getting killed.

Are there any grown-up Republicans left out there? Can anybody save that party (and the country along with it) from utter ruin?

DoJ said to have dropped two-year investigation into corrupt former Florida Rep's lobbyist-funded trip to Scotland...

[Updated: Former Congressman Bob Ney (R-OH) responds to this article. Ney, convicted for his dealings with Abramoff, including a trip to Scotland, suggests Feeney may have been helped off the hook by friends in high places. See details and Ney's comments in UPDATE at bottom of story.]

Late last week, alleged vote-rigging conspirator and former three-term Congressman Tom Feeney (R-FL) was informed that the Department of Justice was dropping their two year probe into his 2003 lobbyist-paid junket with Jack Abramoff to play golf in Scotland, according to his attorney Robert Luskin (who also happens to be Karl Rove's criminal attorney).

The DoJ's investigation was stymied earlier this year by an appellate court decision disallowing their subpoena of Feeney's statements to the U.S. House Ethics Commission on the basis of Constitutional separation of powers. As we noted last month, the friendly Feeney finding was likely to foul the fed's felony fact-finding against the failed former Florida Congressman.

The Ethics Commission had, themselves, let Feeney off the hook on the last day in which Republicans controlled the panel before Democrats took over in 2007. He would agree to pay just $5,643 for the private plane trip and swanky vacation with rightwing lobbyists, despite court papers declaring the trip to have been worth approximately $20,000...

So whatever happened to that expected indictment of former Congressman Tom Feeney (R-FL) and alleged vote-rigging conspirator for, among other things, his 2003 Abramoff-funded junket to play golf in St. Andrews, Scotland?

The other two Congressman who took the trips with the disgraced, imprisoned Republican uber-lobbyist have been held, at least, partially to account (Rep. Bob Ney (R-OH) spent time in jail, Rep. Tom DeLay (R-TX) is still facing related indictments in Texas). Feeney ran a sad "apology" commercial --- five years later --- during his unsuccessful re-election bid in 2008, but since then has so-far escaped real accountability for that, and the many other allegations of corruption that helped see him listed as among Congress' "Most Corrupt" for four years running.

So what happened to Feeney's indictment? A D.C. Court of Appeals decision from February (as we reported at the time, when we also noted Feeney is now being repped by Karl Rove's criminal attorney) was finally unsealed last week likely explaining the answer --- at least for the delay of such an indictment...

State officials say case of alleged voting improprieties in 2002 and 2004 'still pending' nearly five months since complaint filed...

It's been nearly five months since the official complaint about Ann Coulter's alleged voter fraud in 2002 and 2004 was filed in Connecticut, yet state election officials continue to refuse comment on the status of the case beyond acknowledging that it's "still pending," as recently confirmed by The BRAD BLOG.

Several charges of absentee voter fraud were alleged in the complaint against Coulter in Connecticut, where evidence shows she cast absentee ballots illegally while living in her then permanent New York City residence.

In addition to the head of the California GOP's voter registration firm pleading guilty to fraud last week (his company, Young Political Majors, is under investigation in several other states as well, and is alleged to have secretly changed thousands of registrations from Democratic to Republican, denying voters the ability to cast votes in last year's primary), and the Republican election official in Kentucky who last month pleaded guilty to participating in a massive election fraud conspiracy beginning in 2002, there still remains the outstanding official investigation into the allegations against Coulter, the GOP's storied Queen of Voter Fraud.

If all you watched was the Fox "News" Channel, however, and their increasingly bizarre --- and yet still evidence-free --- "investigation" into "voter fraud" by ACORN, you'd have no idea. That, even though Coulter herself continues to parade in front of their cameras as a regular guest without ever being asked about the official inquiry in the second state to investigate voting improprieties by the GOP superstar.

"The delay in this case is inexplicable given they need to prove two things: where she registered to vote/voted and where she lived when she registered to vote/voted," the complainant in the case, Daniel Borchers, a Christian conservative who has long opposed Coulter's behavior, told The BRAD BLOG. "Both are easily proven."...

It appears that there may be some good news coming from Florida. The State House Majority Leader has said that the regressive voter suppression bill will be totally rewritten to remove almost all of the provisions that had any controversy.

This change in tone is the result a lot of hard work on the part of advocacy groups. Clearly they made it so uncomfortable for the majority party that the party had no choice but to back-off of their really bad bill. Congratulations on a great job go to all of the advocacy groups and advocates who worked long hours to kill this bill. Of course we now have to see what the changed bill will look like. Fingers crossed here....
